The bill should be tabled this session because the impacts of the bill corrupt the general plan comprehensive review process as well as the assumptions upon which the draft general plan 2045 are based. In addition, Hwyling Group believes it should should be table this session because state act 39 be amended to restrict 80 years to the state urban land use district only. The state agriculture and rural and your district should be specifically excluded to reduce as yet unknown impacts of bill 123. The second would be to amends so that in exchange for the right to build a D use on a building site that right show to bill shall be limited to the use of a D use being the primary residences or long term rental. creates an inherent socio economic competitive advantage to local residents need for housing versus non-residents demand for housing units. The third request would be to amend to a prevent prohibit feature subdivision of a building site if a property owner is given the right to build a D use on the building site and this would prevent future market speculation of the property. The fourth would be to amend to reinstate the prohibition against A.D.U.s on building sites with transient accommodation rentals because this has been county law since 1999. Again, act 39 gives the counties until December 31st, 2026 over two years from today to pass county A.D.U. legislation. The Wyoming group Burgess the County Council to table the bill just as the planning department causes subdivision and zoning codes process in order to prevent interference of the general plan comprehensive review process. However, if the County Council is determined to pass bill 2123 25. My name is Tom Keeney testifying on bill 123. I spoke with. I'm sorry. I'm con. Okay, sorry. I'm con canee testifying on bill 123. I spoke with Daniel or a dinker executive officer of the state land use commission yesterday afternoon on the phone. He stated that some time ago when he had received notice of the amendment to bill 123, allowing one transient accommodations rental as an accessory dwelling unit on property in the county zoning districts, which included the agricultural zone that he had sent a letter responding that this was not allowed. and with several people yesterday morning about the the so before decision was very the council and the public needs to see that letter and all subsequent written communication, which is taken place between the planning department and the state land news commission about one two three. As reported in my written testimony, there is prima facacia evidence that the county council cannot ratify this bill. First by an unidentified official at the Lanus Commission stating that's illegal in hearing my description of the change from prohibition to allowance of one TAR on the county, Agzone, more confirmatory as the executive officers statement to the planning department that this would not be allowed. The question is raised, however, of what the reference is that is illegal and likewise what is not allowed. My impression from these two conversations is that the Land Use Commission is stating that it is illegal or not allowed that the county's county's county's county's county's agricultural land. All written communication between the Planning Director or Council Chair Kimball and the Executive Officer of the Land Use Commission pertaining pertaining to bill 123 needs to be seen by council and the public prior to proceeding to ratification about 123. You'll have three minutes if you could just reintroduce yourself. Thank you very much. Good morning everyone. Nancy Karsmith. I'm here representing WaiMaiah Community Association. I'm here today regarding the Aloha Bench project that many people have been working on for about the last four years. I just became involved this year, but it's been an ongoing process project to get to this point is a lot of people have put a lot of effort into it, including Northaway Blue Zones, who they're no longer active, but path was also involved. This includes White County, Parker Ranch, and many other private individuals in the community. So the, all OPA is the road that goes along the rodeo grounds and parker ranch lands kind of bypasses why may I if you will and it's become quite a nice walking spot. It's level, it's paved and the the vistas are beautiful so a lot of people seem to walk there. Kupun I had reached out and mentioned that it would be really nice if there were benches, so that's what prompted this project. So 12 benches were purchased, sponsored by community members, and were stored, and then things sort of sat for a bit. Anyway, long story short, when we activated the project again this year, we found that four of the benches had disappeared. So that's what these funds are for that we're requesting of you to be able to purchase these four benches that are missing so that we can put a full 12 benches on along the route. We couldn't go back to the sponsors and ask for them to pay for the bench twice. And so we looked and looked for other alternatives and this seemed to be the best alternative. So we appreciate your consideration of this. I think Chair Kimbles offers for helping to facilitate the request for this grant. Why me and community association is facilitating the process and because of our nonprofit status. So if you have questions, I'm happy to answer them. Thank you very much. Janice, when you transition, if you could just let us know so we can reset your time and please reintroduce yourself as you begin. Thanks, Valley. Yes, I'm Janice Paul McLean. I'm tuning in from Klanny tuning in. I'm going to speak to Bill 127 first. That's okay. Morning, the low-ha council members. I've testified on Bill 127 numerous times and asked that the full council put their weight behind it. There have been many instances in which the county has been asked to approve and has given inordinately long multiple permitting extensions for development. Those extensions have facilitated broken promises and contracts. They took advantage of and even harmed the community and the resources while helping speculators increase their profit. Cona 3, Cona Vista's 40-year extension request through bill 169 is one of many good examples of speculation scams. The Councilman Inaba responded to by introducing Bill 127. Bill 127 will help make developers fulfill their obligations in a timely manner or require them to start the permitting process over and whatever the current land use paradigm is at that later date. Again, I ask that you please support Bill 127. My next topic is Bill 123. People in the public don't need to understand everything and every bill, but there are many instances including Bill 123 where the public is deeply interested in the ramifications of legislation. And they often have more expertise or skin in the game than many council members. One thing for sure is they have lots of great questions that need to be answered before legislation. They'll be saddled with for decades as voted into law. I appreciate Chair Kimbell's commitment to the tar bills. I agree with her that they need to be specific to make sure they work and can be enforced. It's also true that no one in the council is a land use planner. Meanwhile, our planning director is not the person the public is most inclined to rely on when it comes to protecting them from vacation rental abuses. And that's not to mention away tires to manage the availability of local affordable housing. So who is the public to turn to if the process is rushed and there's no time to research and wrap their heads around what's happening before their lies and neighborhoods could be changed forever. The answer is this council and in particular, Chair Kimball. What I'm asking and what I hear members of the public continually asking is that this process be put on hold until the general plan is adopted. The biggest reasons are so the public and council have enough time to think these bills through and to avoid potential conflicts between the final tar rules and the general plan. Every meeting there are new tar amendments, sometimes quite substantive and confusing. Council members have keeps to wait through and make sense of not just in the proposed free laws but how they intersect with and affect complex and changing state laws. At the same time, the general plan process is lurching and zooming along, demanding the attention of council, the public and stretched planners. A few of my continually burning questions regarding Bill 123 include number one would R.A. And F.A. Zone lands be open to Tars like residential areas. Number two, how would county rural zoning affect the situation? A question asked at the last general plan meeting, but unspecifically answered the county saying they'll do whatever they're required by state law. And three, how would larger Ag Land regulations compare to R.A. F.A. and World-Zoned areas. While we wait for definitive answers the confluence or crashing of the GP, tar and state rivers continues unabated. That's why I agree with Sierra Club's request of the Council of Void Potential Disaster by tabling the 123 until after the GP process is complete. When I asked Chair Kimble to please slow the tar and GP process well as the biweekly overloaded council schedule, she said but there's so much to do. Yes, there always is and there always will be, but no one wants to revisit this issue with her. So council needs to slow this train down to get the tar bills right. A final request, the county needs to be clear that tar operation, operators cannot advertise that they're being bees without serving breakfast. Otherwise, the county will be complicit in misleading false advertising. It's not a good look or a pono position to take. So let me go back to the very beginning of this conversation when I mentioned that when the Ohana code was originally drafted in chapter 25 there was an anti-density sentiment and as a result to much of our sugar right now we've seen sprawl out into the agricultural areas across the entire island. The intention of this bill is to increase density in our urban core areas, making sure that people are close to work, close to educational opportunities, close to income opportunities, close to infrastructure. As a result, we'll be reducing the amount of sprawl, protecting our agricultural lands, reducing vehicle miles, traveled, and ensuring that we have housing for all of the different members of our community. As our housing structure is set up now, we are on a trajectory where we will have housing for the very well to do and housing for the not very much at all, the subsidized housing that the county provides. So we need that affordable housing. But we're missing is that missing middle housing families that want to make you know and provide an opportunity for their kids to build a house and live next door on the same property. Middle income housing that is for our teachers, our nurses, our doctors, our county workers, our police officers, our firefighters. Now, I do want to respond just quickly to some of the comments made. And there's just one key misunderstanding. The difference between Hawaii County zoning and state land use. State land use law, chapter 205-4.5, prohibits, the accessory dwelling units, unless they're developed as additional farm dwellings and the folks living in those additional farm dwellings must be tied to the agricultural activities on the property. You can see that in the bill on page four under section 25-6-31B, which says any building site within state land use agricultural district shall be subject to agricultural requirements for farm dwellings. This includes the prohibition of farmed dwellings to be used as transient accommodation rentals. So while I appreciate the concerns of the testifiers, I want to make clear that this is already prohibited by state law, and it is also prohibited by this ordinance. So while the comments were made about illegality, this ordinance is in alignment and does still remain legal with respect to the state law. With that, I encourage my colleagues to support this effort. We are not going to be able to provide all of the housing needed for our community through affordable housing subsidized by the Housing Protection Fund and other programs. This is a way to have the private sector help improve the housing picture for our island, but do so in a way that we're preventing sprawl and protecting our natural and agricultural areas. I'm going to urge my colleagues to vote to pass this measure today. Bill 123 has been in the making for more than two years. If folks recall in 2019 SMS research produced a housing study that says, here on Hawaii Island we need more than 13,000 new dwelling units by 2025 to meet the growing population demands here on our island and 123 is just one way that this council has actively been working to make it easier for residents to be housing contributors and increase our housing inventory on the island. 123 aligns with recently passed state legislation. Housing was on our state legislators' mind and so we are definitely in alignment with this bill. And I have every faith in our public to understand what this bill does. It's very simple. It gives property owners the ability to build up to three accessory dwelling units by right on their property if infrastructure allows for it. And as council Chair Kimball says, this is what we want. We want to improve residents' quality of life by having access to jobs, healthcare, education, recreation in their community. Trust me, I leave my house at 6.30 every single morning to drop my kids off to school and in the office an hour later And I would love for more of these opportunities to be in our community There was this concern about seeing a huge proliferation of building overnight I would love to see that but the reality is if you take a look at the cost of construction, if we estimate $500 to build one square foot and on average an ADU is 1,000 feet, we're talking half a million dollars. I don't know if folks can afford that right now in this market, but what we are doing by passing this bill is we are making it easier for homeowners and builders here in our community to secure financing and construct housing. Yeah, part of it is what happened yesterday on our bill 198, 199 for those who weren't available yesterday or were able to watch it. Clearly the community when they talk about going from Ag5 to half acre lots or looking at how it's going to change the feel of their agricultural community. Well, if you look at this getting passed, that would take half acre lots and then the ability for people to put dwelling units on it, which would even increase more the density in this very rural agricultural environment around Waimea. I think that the effect of this bill, even though there's good intentions, I think that the public has yet understood how it could eventually roll out and change the makeup of their community. I heard the Sierra Club testifiers say, if you did this in urban zone, that might make more sense because that's a place of usually in all your general plans and community development plans. They will say that's where density should increase is in an urban area where you have wastewater, where you have water, hopefully, where you have mass transit. That makes a lot more sense. But in this case, we're looking at putting it in other districts, rural districts, what, FAA, family, Ag. I mean, I think the impact of this is big enough that I think we need to give the public time. I heard a comment by one of the colleagues that you've been working on it for two years. I do know you've been working on the tar bill, the transient accommodation rental, but I don't remember any of the realtors and people talking to me about this Ohana dwelling being converted to another category. And now the state legislature are passing something that was more recent than two years. And I just think there's a lot of confusion when you talk about tar. And now we're talking about this. We're talking about increasing density. And I just kind of think the public hasn't yet wrapped their head around what this particular bill is doing. And I really was when I read what was Honolulu was doing and Esther Kiana hoping that next year they can go and repeal the bill that Stanley Chang passed to create this ability to do this density that Honolulu doesn't, they're trying to repeal it. So people are questioning maybe not the intent of building density for more housing. What they're really saying is you're really changing community and everything, you could change it quickly and have unintended consequences and slow down. We don't have to have it done to 2026, and I just don't think we need to push it fast. I think we need to slow down, and possibly add a few amendments to make it more in line to the vision of what our communities want. I know there's community development plan action committees, there's one meeting in Kona, there's community development plan action committees. There's one meeting in Kona. There's one meeting in Waimea. I think the community action committees should know about this too. I just think there needs to be a little more dialogue. And that is why I'm asking for the postponement, not indefinitely, but postponement, because I do think there still needs to be more. And yesterday, one of the reasons we postpone it because I do think there's still needs to be more. And yesterday, one of the reasons we postponed 198 and 199 is because we didn't have a lot of testifiers. Why? Because there are these conferences, there's the Native Hawaiian conference at the Hilton Lake Loha Village today. I just think because we're lacking testimony, that even bothers me because I do think this is really a change, a big change, not a little change. It's a big change. And I'm not talking about the urban areas and I know Hilo, I mean you could even say Hilo go for it, you know Kona go for it. But when we're talking about the other smaller communities. I just I still feel there is not enough understanding by our community as to what we're really agreeing to. That is why I want it postponed. Thank you. I've had a number of constituents reach out to me and ask, why do I oppose tiny homes? And my response to them is, these are not tiny homes. An ADU and the potential addition of three ADUs on somebody's property is not a tiny home. And I feel unsettled by the push on this when there is so much, so many other things going on. I am trying to work on some amendments with a couple of different people that would temper. Some of what I feel is kind of Pandora's box here and I'll be supporting the postponement. I also still I also still have real questions about the title and I feel that it's misleading to have the title of a piece of legislation call something an Ohana dwelling unit and then the first thing that happens is you strike out the term Ohana dwelling unit and if we look into the future and providing a direct communication, direct pathway for people to find this legislation. I think that that should be edited. And I don't think that three, I think that 380 uses too many to just open it in straight go for it. Also concerns me if a Wahoo is looking at repealing theirs and you know talking about density is a tricky thing especially in district seven because we already have so much pressure on our infrastructure. So, to add density and open Pandora's box for adding on to that without having our infrastructure in place, I don't think is a wise move forward. So, anyway, I am always supporting the postponement today and I just ask for my colleagues to reconsider what the rush is on this. If this is truly the right thing to do and truly the Pono Avenue, then everything will be an alignment and community will feel more comfortable and confident and the reward will outweigh the risk. And so I do support this. I did not really like the amendment we made that allowed for one TAR to be possible on a property. But I also know that if people do choose to do that, their taxes will go up. They will lose their homeowners tax rate. So it'll be something people will have to decide. I don't see a lot of people choosing to do that, hopefully. And I hope that most people, if they are able to fund and build a home, a second home as a talk, I mean, sorry, as a O'Hana ADU unit that they will do it because they know somebody here, need to home whether that's a long-term rental or providing housing for their own family. So I will be supporting this and I feel it's so necessary to protect our precious Ag lands and our open spaces that we do do this in fill type housing for our people. So thank you. I yield. Just echoing councilmember Covey Wada really the need for housing on our island is really pretty extreme and I feel that this is the organic option in a way to allow our citizens, our families, to help to provide housing for their own families, or long-term rentals for people, you know, residents in the community. So I believe the restriction that does not allow it on agricultural, state land use, agricultural land is, is going to take care of a lot of the issues that folks have. For instance, councilmember Evans brought up the proposed project in Leimea, and currently that is agricultural, it's SLU Ag, so that would not be possible unless we agree to change it into a rural-zoned piece of land. So it's an example of how this bill would actually not allow ADUs on agricultural land as long as it continues to be S-L-U-AG. So that's something we're going to have to consider as we go forward. But I believe that is an appropriate restriction and it will condense housing to basically urban areas because most of our island, no matter what the zoning on top of it might be the state land use designation is agricultural.
