Hello, I'm Kekeli, welcome to the D-D section of the Hawaii County Council. Today is March 7, 2025. We're meeting here at our D-Dutch Chambers at the Hawaii County D-Dutch 25th Opens Street, NGL. And we have another data stream that should be from our clinic chambers this morning. I took today's meeting, I'd like to call a past day in March. Zero of Christ, the day in church to provide our invitation. Good morning. I'm going to speak to them. Excuse me. Thank you so much for inviting me back. Again, to share with you an invitation this morning and some of us have had a chance to talk a little bit as this will be my last opportunity to do this. And I have some mixed feelings about that mostly sadness because I really enjoyed being able to do this and it's a privilege and an honor and a thank you for that opportunity. But as I was thinking about what to share, because over the years I've shared different things, sometimes try to be a little humorous, but always try to bring some encouragement to you as you begin your meetings. And I thought, what kind of words of wisdom could I leave? And I thought, I'm not that smart. And so I thought maybe the best thing I could do is leave you with an assurance and a promise and a blessing. So as we have developed a current ministry of Christ, we've been church one of the things that we regularly play for our civic leaders. We play for our first responders and all types. We play for our mayor. We play for you as a council. And you don't pray that you do what we want you to do. We pray for all my God to grant you wisdom and discernment insights that you need. And that I know will be a continued prayer that will continue our people that I hope will be in assurance to you. That when the days are long, the meetings seem to be too many, the conversations are really tough and it feels like the choices in front of you are not with good options. that you would remember that there are people that are planning for you and Almighty God can grant you wisdom and discernment. And I would also remind you that that same Almighty God that our people are planning to is available for you to pray to you as well. So as I review today, I want to review with an ancient blessing. It is one that shared by Christians and Jewish people alike, it got traces back to Moses and Aaron. And it's how we conclude our worship services. But I'm going to give it to you as I conclude my service. And you begin your serving today. It is that great blessing. May the Lord bless you and keep you. May the Lord look upon you with favor. First, most important to me is that the nominee apparently and disturbingly erupt numerous campaign finance violations are heard from when he runs for county council. A commissioner must be a person who respects and follows the law so that they are in turn respected and trusted by the public, they're much represented. Second and also very critical, the nominee has no land-use experience that I can find. Let the job of the people doing required deep knowledge of land-use issues and laws. Every person who lives on a visit to the island is affected by the official of the commissioners' tape. Let the public have no inkling what the nominee's view of our land-use already served and visions might be. Third, the LPC, the Donalds and the diversity qualities that have an overall lack of the decades. It's a company. We are on land use already closed ambitions like B. If you come and upon the mayor and council to help create that balance, without clear land use experience and a background with the VPW, how did we know for instance that the nominee won't add to the already extremely developed and friendly commission majority? And majority that's consistently annoyed the growth of the public, including passing among other debauchers, the development of 100 UN Hotel and more condors with downtown clear opponent and as we drive, they're already being checked to death by lack of planning and chronically efficient and dangerous infrastructure. For at least one high-requalified experienced applicant, the disposition of high-requited being a personnel and use advocate, we found through the development. and back to application how the record of being a personal and his advocate without doing development. In fact, your application is a gift to our county that shouldn't be passed out. Among other positive actions related to local Andy Fishy, she's fit up in support of the tenants of the Conor Community Development Plan and its implementation, something that's a year and year to, that's a year and year to me, as well as many other other regions stakeholders. I'm not sure if we can say that I'm talking to a theater. And last, the nominees like the Benhammers and the Threads. This feels a little too in the fold, especially when he makes the right choice to come up with. And thirdly, it seems that in the end, there's not good reasons that the combination should be a theater, other than the nominees' willingness, which is I'm not there, but just not slide. Like he's gonna really push forward to get things done. And he said that for so many years, there's been so much delays and there's been like, I guess not helping the veterans who need help. And so I'm looking forward to seeing him do that. You know, Uncle Cionic Alave in Puna has recreated a Huluwa sled. For those that don't know, it is an ancient Hawaiian pastime that involves sliding down steep slopes of hardened lava fields. And he's recreated that in a safe way. And it's really wonderful. They take into community events and schools around the island so that they can continue to perpetuate this tradition. But every time they do, they have to dismantle it because there is no trailer. Recovery work for Pune is ongoing, and it's really hard to believe that this year marks the seventh anniversary of the Killaway of volcanic eruption. May 3rd, exactly, or specifically. And so this year, I've been working with some community partners to launch a cultural entrepreneur hub, where the old Occupy Bono Theater and Luchines restaurant were in downtown Pahoa. Hanpehua, they burned down tragically in a fire in 2017. But there's been a lot of folks in the community that want to create a tourism economy that is regenerative and on their own terms and is a curation of some of the best products and cultural experiences that can be found in Lourpuna. So this funding is seed money to help kickstart that effort. The community is invited to attend Saturday March 3rd 10 a.m. to 2 p.m. for the cultural demonstrations followed by a town party 5 to 10 p.m. It's going to be a great time and I'm looking for everyone's support and please come join us if you are in the area. Yeah, I'm just, but I just wanted the idea of an entrepreneur hub is very cultural entrepreneur hub. It's very interesting to me. So, in the long term, what kind of services or facilities would you be, be, be, be envisioning for this entrepreneur hub? Sure if I might, thank you. And the smallest footprint possible in terms of built infrastructure. So there is an investment being made in canopy tents, pop-up tents so that there is a unique look for the pop-ups that all of the cultural experts are going to be demonstrating under. So many of them in Pune have incredible talents, making lay, pounding poi, a number of things. And so this will be a space to demonstrate that. And if there are products that folks also have to sell, that again, are made here on Hawaii Island, we certainly want to have a place to showcase that. There is an element where we are going to be inviting students from local high schools. So we have the charter school haws and the whole high and intermediate. There are entrepreneurial programs that are running in those schools. So this will also be a space for high schoolers to get real life experience in running a business being part of events and seeing that they can actually make it in their community. But I did want to see if Deputy Corporation Council Cody Friends is available or Assistant Corporation Council. Do we have? Thank you. So I just wanted to deputy corporation council, Cody friends, had brought up to our office as we are trying to get our similar CRF through for dare day in East Hawaii. That she, she's recommending or that she believes that says we should or shall. If we're giving something to a nonprofit that is staffed by or led by County Council, not County Council County employees, that we should have them just do a quick ruling through the board of ethics to make sure that, you know,'s clean and clear. And I know several of these DRCRFs have already gone through for West Hawaii. I know some other ones are going to be coming for East Hawaii and I just want to make sure that we are kind of all on the same page. So I don't know if you have any insight here or if if Miss Friends can get on. Okay, good morning everyone. Jiyoshi Muroto, Assistant Corporation Council. I'm not familiar with that request or this CRF request, but based on the information you provided, it does sound like it would be something that the Board of Ethics would be needing to weigh in upon because it involves, well, the faxinar that you presented, right? So Miss Friends is not available right now, but in any event, the recommendation would probably be the same that they would need to go through the Board of Ethics to make sure there are no conflicts or anything else that would need to be addressed prior to the award. You're saying the other there were other results that already passed that to this organization yes. So I'm just wondering do you know if she might be available later today, where we can move this to the end of our agenda is just so she's familiar with this and she's the one that brought it to us. She said she could attend either via Zoom or come here. So you want to move it to the end of the agenda. It might take her 15 minutes or so to get here. I mean, Council's what have you guys want to do? I would just request that we table this so that we could have her input. I think it would be important. Vice-Chair Onishi. Thank you, Chair. I don't think we need to because as you mentioned before, it was done in the past, right? And I think, and I think, and I'm correct, is that the money is going to go towards the police department's dare program. So we'll have officers that is in the their program that is running this event. So the possibility is maybe the funds that was given from the council members might have gone to the nonprofit of there, but I think like for my office we're working on one right now. It's going towards the department's their program and that's going to be helping with providing funding for the bus scene of the participants to come to the event. And so I would say it's all good and I mean if now and the system Conversion council or deputy if we done it before and we have one in front of us right now and it was never mentioned to councilmember who's this then why would what what is the delay I mean why I Don't know what the specific fact pattern is for this particular request work. They're all the same so I mean it if you're having If the situation involves county employees serving in a volunteer role on a nonprofit in which the CRFs are being transferred to that nonprofit, you know, in the center that you're mentioning. It might trigger something with the Board of Ethics to make sure that there's clearance, so there's no, you know, conflict of interest or making sure that the fair treatment provisions are being here to. Again, I don't know what happened with the last two, But he misfriends knows more. I know she does apparently, right? Is what? that provisions are being adhered to. Again, I don't know what happened with the last two, but you miss friends knows more. I know she does apparently, right, is what is being represented, right? So I know that Roy Valera, who's on the police, is an officer with the police department. He is involved with the nonprofit there. Okay? Like for East Hawaii, we got asked by, I guess, the lieutenant from community policing to help support the DER program on East Hawaii. So there might be the difference, like because our request is coming from the department, and maybe I don't think I ever relinquished the floor. I'm still trying to just get the information now. Sorry, Councilmember. My share on East Asia is the floor right now. I wasn't clear that you still have the floor. Okay. Thank you. And so maybe that's where the information now. Sorry, Councilmember, my sure on issue as a fly right now, I wasn't clear that you still have the same thing. Thank you. And so maybe that's where the difference is. Could be and the facts do matter right in terms of what's happening right again, I don't know what the specific fact pattern is for this one but maybe Miss friends does I don't know I mean I wish could give you a better answer than that, but I, it's as far as what I know. So, but if it comes from the department, then it's okay. They would have to go in front of the Board of Ethics. Correct? It would be depending on who is involved because, okay, hypothetically, right, because I don't know what the fact pattern is here. Hypothetically, if you have county employees serving on a nonprofit, right, that is the sponsoring entity for this year. And so you have the department, you have the nonprofit, and you have whatever event they're going to do, right? So that might be what's triggering, you know, the ethics question. No, but if we give it directly to the department for the dare activity, is there any conflict? Well, I think I don't see an issue with that because that's how the process works. The CRS transfer goes to a sponsoring department that supports that particular activity or program. But I think the question is the people involved with the nonprofit. Yeah, right? That's if the fun needs going towards that nonprofit. Yes, correct. Right? It's just too difficult, right? Yeah. You know, I think that when the agricultural bills were initially introduced, there was a lot of confusion and concern about how people would comply. Now that the department has the FAQ sheet up and the Farm Plan template, which is a three-page document, I think there's a lot less concern in the intervening periods in Mr. Houston. Introduced this bill I did speak with the cattlemen's, the East Hawaii chapter of the Farmers Union. And there wasn't a real strong feeling that this was necessary to expand it to the five years. There is folks do like the flexibility of the three year time frame just because they don't always know that their program is going to work out for the full five years. But I think, you know, to your point, the agricultural dedication benefits, short term or long term, do provide thousands of dollars in some cases of tax benefit. And I just don't see it as overly burdensome to fill out a three page form to ensure compliance in a three year interval. So as much as I appreciate Mr. Houston for introducing this, I'm going to continue to suggest we keep it at the three year interval. Thank you. Thank you, Councilmember Kimball. And I'd love your comments on do we have the authority to put this sort of regulation on our state roadways. So for example, we have the one that in conversation with you, we have signage up now that, you know, when this bill went in, the sign didn't go right away, but I followed up with you to make sure that the signage was on a Coney Pulley highway out to Polo Luvalli. So that signage is out there now and the community is grateful for that and your work doing that. But the Cahalla Mountain Peace was also part of that legislation and that process. But that is a state highway. Do we have the authority to add that sort of county regulation on top of a state highway? To my knowledge, I don't think so, but I cannot make the official interpretation on that. That's probably something for a court council or the attorney general's office. Okay. Well, that is something that we definitely need to figure out because it is sitting in that ordinance that that is a road that is regulated for no commercial bike tours. And so it's kind of sitting on a limbo and if the if the DPW can't perform any action on it, then the communities, you know pounding their fist saying we don't want bikes in these areas, but we don't necessarily have the authority to do so in that space. I do think the enforcement piece is something that we need to come back to on this. The language in that section of chapter six indicates that the any funding or any fines would go actually towards bicycle safety in this case. They would go to the general fund and go towards bicycle safety, but it is as pointed out silent on the actual enforcement entity. So I think it's important for us to consider revisiting this section of chapter six and clarifying that aspect of it You know in some ways it makes sense that it would be HPD, but if that is the case that those ones then go to the state that's really not what we're intending, I think, to accomplish with this. So I would be happy to maybe work with the original introducer or actually that was Councilmember Evans isn't it but I'm thinking about Councilmember Kirkwitz's contribution to this particular section and the rewrite of it and perhaps we can look at that and have a discussion about the enforcement piece because it is as you highlight that not clear clear. And so I guess this needs to be really thought of, because of it's like a cat and mouse kind of thing. And so we can have that, but if there's no enforcement, or if the enforcement is going to be hard for the department, then the community still can be upset. And then they're going to want more things, or they're going to expect us to provide more services to that area. And so I want something to think about, because we can always put in legislation.
