So I am here just to be a representative of my parents who are under other obligations. So I'm going to read this letter that was written by my father. To the city of Bellmeat City Council members, I, George W. Phil Mitchell, and the business owner of last chance bar on $1,200 new dollars highway in Bellmeat Texas. I know that a few of you do not know me, but I grew up in Bellmeat, attended and graduated from Lomag in 1977, and then graduated from Mary Hart & Baylor University with a bachelor's degree. I was president of Levega Little Lake for five years, my wife and children group at Bellmeat as well. I retired after 31 years of service as a medical technologist from Levega B.A. Hospital. Ten years ago, last chance for a restarted Bellmeat as a place to have friends and family with the same place to come together. As far as a special place, kid and pet friendly and has the ability for people to enjoy their cigarettes while enjoying a cold beverage and playing games. Games include board games, cards, dice, pool, eight-liner games and listen to music. Now the city of Bill Meade has taken away my revenue by removing the eight-liners in my business. The eight-er games kept our patrons entertained while enjoying the atmosphere with 10 friends. Without the games, I feel it will put a string on our ability to pay all the expenses to stay in business. I am not in this business to become rich. I just want it to be the bills and let it sustain itself. The building has a lot of history. And this bar has once been built twice, once by the Travel Channel for a ghost episode. True statement. Which unfortunately never aired due to COVID and more recently a Christian film called Maddie's Large Chance where several patrons in myself start in the movie and it is in circulation. My father, a Bellamy Police officer under a chief herald, would stop and talk to Ron and drink coffee while off duty. My niece, daughter, and LeBega school friends played here in bands when they were in high school. As long as I can remember, this building had eight liners. I have had the same game owner for ten years at this location and two years prior at another location. We've had numerous inspections including Bellamy, McClennan, and the Gaming Commission without any problems that have been lost here. Please consider a last chance for an exception to the City of Bellmeat Code of Ordination in Section 10161, which states, no licensed indoor amusement facility can be located within 1,000 feet of another licensed indoor amusement facility. Without gains, we are losing revenue to L Lacey Lakey-Barrs. Patrons come in and walk out because their aims are their favorite top of amusement. This is a big loss of revenue for the bar and for the city of Bellmeat. As a Bellmeat business owner at the location for the last 10 years I employ the city council to please grant her goal for an exception to the role for Lachgansk Farm. Thank you for your consideration since your late George Mitchell business owner. And if I have just one minute or two, I would like to say we also did a measurement where you block it. So the tool has shown and we can give you a picture if you would line it up to you. But if you were to walk the proper way of driving, it is just over 1,000 feet. It's 1,023 feet. If you were to take the legal direction. And then of course, and I'll wrap it up. I'm so sorry. And then of course, if it's a course of line from door to door where it just goes straight across, then you're looking at 682 feet. So I do employ you, if you will, just take into consideration. You all have to check them out, look down, we've gone to the state. We have everything, we've done everything we possibly could, and they're still being denied. With them not being able, if they're not making revenue, the building's the business shuts down, and it stays vacant. I own other businesses and other buildings. I can use it as a storage and have it as a text write-off. I do not want to do that. So that's what we're here asking y'all if y'all can have east go back to looking at it at another time. I'm also asking some sort of punishment because I want to file a complaint that I am scared because I have tried to file a complaint. My hands would not hurt. I resided 2, 3, 8 locked in our room and I'm wanting to have to speak on the hand of my chance. As Hendry had said, it has taken away a lot of people's livelihood going into the bar not seeing the machines. Well, I'm one of the people that my livelihood is going now. Not only that, but if the bar has to close down because they don't have enough revenue, you're going to hurt a lot of people. You're going to hurt my friends, Bill and Ruth Mitchell. But you're going to have the friends that I've made are the bar agendas. How are they going to make a living? How are they going to support their families if you take all of this away from them? I've been in there several times since the machines have been taken out. I can count on many one two hands, at the amount of people that are in there. Usually the place is full. We were in there Saturday night. They had loud live music. Maybe 18 people in the whole police. And usually it's It's health on Saturday night because not only do you have to live music and they'll call it beverage but you have the machines to play to kind of you know live it up your time you see somebody playing a machine and they're about to hit and everybody's like oh come on come on you know so you're taking away a lot of livelihood. It made for us a business of no need to close and I hate to see that. One of the reason is because my mom everybody knew my mom's mom or one to She's the last birthday she's been in there last July when she turned 91 And it was awesome because my mom was there my Great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great, great,. If that place closes down because they can't have the revenue, you're taking away a lot of memories for a lot of people. But my mom turned 90, we had the same party down there. Had out of town folks come in, grandkids and everything else. You know, my mom loved that place along with her family now. Like I said, if that place closes, you're taking away how a family can live, how a family can afford. So I was asking again to reconsider the machines at last chance because we have made so many family and friends there that I hate to see it close and that not have to be able to connect with them again. They've also thrown countless numbers of benefits, helping friends and family and people that they know, having benefits for the Ambitz ladies, they've had several benefits for them. First, we are preparing a report for you to talk about the SS4A grant to reassure everyone of a couple of things that I have heard that we want to dispel number one. We have no desire to take anybody's proper, the federal government through this contract wouldn't even allow anybody's property to be seized. And so we're gonna kind of give you an update of what we are thinking. And then from there, you can move as you see fit. The second thing I did get an update from Dr. Shields. And we are, we'll be, I guess, meeting again again I'm assuming that they're out this week But our last response said that they did not want to do a month by month But they will be reaching out and we look forward to visiting with them and trying to iron something out until they get to a point where they are comfortable Next thing that I really want to encourage everybody up here and everybody out here that has friends, we are very fortunate to have Bader stepping out, join us on a cleanup day. And this is an opportunity for every Bell Meed citizen, if they know of someone that needs help cleaning up their yard, getting rid of some trash, you already have bulk pickup, but this is an opportunity where we will have two opportunities one. This is a great opportunity for us. Feeding up the City of Bell Meat is a very high priority, and that's what we get the majority of the calls on. We have another opportunity at the Civic Center that morning where you can bring your trash, your stuff that you no longer need that you are, I think there are like 833 letters up and out to people in the various parts of the city. Bring it to the Civic Center, we will have rolled-offs. It will not cost you anything just to drop it off. But of course, there's going to have people there to assist you. Now, we are not doing the tire cleanup until the September date. So we will take all your rubbish, whatever you want to get rid of, as long as not hazardous material, oils, paints, or anything with refrigerant in it. So please, please, I urge you to please take an opportunity to do that. And then the last thing is required by law. That is resolution 13. The next resolution is authorizing me the Blaster the moment competed. We get a lot of calls for a speeding on various streets and we try to monitor it the best we can. But one of the tools we use is a speed monitoring trailer which tells us speed limits, tells us the minimum and the average. It gives us a lot of data when we can concentrate on areas that we need to. The police department chief, under chief my direction, his staff was able to submit a grant. It's 100% made grant and the Heart of Texas Council government is recommending it's approval. That's about $1.2,000 grant that we are getting 100% match on that no funding for the city. And I think you may see a few more, I know the MPL, Metropolitan Planning Organization, the committee that I serve on has also acquired some additional speed monitoring trailers. We have access to additional trailers, so don't be surprised or alarmed if you see multiple trailers throughout the cities. We have the rights for the city. And what that is is for making sure that the software is updated and staying current and it also covers the maintenance agreement with the warranty. We can continue that as long as we want to or we can discontinue it. If we discontinue it, we won't have the updated software upgrades as the technology advances and that's what that's all about. And we have a budget for that every year. It's already been. We've discussed it with finance and the city manager. We have found money to take care of that $1500 a year. But his first year, it's a well-not cost-of-safety. Chief, would you mind adding the one thing I failed to mention that is this new system will also allow us to have a message board on how you mention that, which is very so, which we get a lot of calls for. Yes, sir. So there are several. Actually, there are a couple of things looking in the future, trying to prepare, is this trailer has the capability of having a license plate reader, which is advanced technology that most cities are going to. If you have a license plate reader, you can capture solid vehicles. I can commit a robbery done for bid. We don't put those, but in the event that they do, these readers will pick up these vehicles and log in. We have nothing we would be able to access a system as a part of that. The first and main part that's for later on is not now but what a part of this right now this B Trader is and I talked to our public works director that's going to assist is we have a message board that comes with this Trader. So not only can we monitor speeds in certain areas but if the public works department is conducting work in the area we can put a message on their work ahead so that we can protect our staff that are working on the roadways along the side the ditches with drainage or whatever that they're working on. So it could serve as a dual purpose, not just for police, to gather them stats, but it can also protect public works department individuals. We could also have different messages on there if we have a B-tool or whatever. It would have many purposes that we can use for. And the one we have now, it doesn't have that capability, does it? No, ma'am. And quite frankly, it's pretty old and antiquated. And that's why we're looking at this grant. Pretty low. Thank you, Mary Gazzle. As many of those great loves you draw out of Andrew from Swanson. I have for you the same thing that 2020, 324, this school year, other results. In front of you, you should have a pound copy of the report. I'll be utilizing the power go over the results of the might have picked up your ice cream mixture. So, use the next slide. So, first I'd like to always just go over the audit process and be sure there's just, give it a whole deal of what we're doing throughout the audit process. So, we performed a lot of the courts with general and study auditing centers and throughout that audit we can bring it down into various phases, the first phase being the assessment phase. So we're pretty much anywhere where money's coming in or going out of the city, we want to evaluate the controls that are in place. We sit down with questions, departments, do walkthroughs, team processes, and question of process documentation as well of the set standards there. And then we also have questionnaires that we have included as well to help make sure that we have clear understanding of our different that each department is doing for those areas. And then in addition to that, we do sample testing to ensure that what we see in practice in those samples is consistent before we see through those law-free and documented for process and procedures. So from that, if you saw any area of concern, I would then rate the city management attention. Thankfully, the city has done a really good job at making sure there's a lot of checks and balances and proper controls that are in place and The segregation duties, the things of that nature. So, have you reported or know concerns? I know it there. What we do is call a risk-based approach. So, each, we evaluate the financial statements at every line item within the financial statements at a different risk associated with it. So, every year we evaluate the risks which then draw as a type of procedure we perform, with and detailed performance procedures to make sure that we are comfortable with the material accuracy. And because of the financials, when all testing is done, I think they are. Then we deal with called compliance testing. So grant requirements, bid requirements, public fund investment act, any compliance component that you always counsel me up for your meeting minutes, could we review all meeting minutes, make sure that we are aware of things that are occurring within the city. So from that, we would then make sure that those items are being followed properly and compliance with it. Then we move into what we actually call a field work, where we do the actual tile of the numbers with the public interest we perform cutoff procedures confirmed with, thank, and other third party the bonus as aware of possible. And then we tie out the revenues and expenses and ensure that those are materially accurate as well. For once we've completed all procedures, we then move into that reporting review phase where the most of the view. So make sure no additional procedures are needed and then have that report that we have for tonight prepared. Then it's there. So within the report, there are various phases of sections within the report. The first section will be the introductory section. So there's transmission middle letter and other information related to the city about what's going on in the city, so this work with information and what the city is looking for and doing. Behind that's the financial aspect of the report. So there's the auditor to the bidding letter. That's our bidding over the financials. Behind that's the management discussion and analysis. That's going to give you the year-to-year comparison information, covering the major swings or changes from year-to-year and hit on big areas such as capital and debt and things of that nature. Behind that is the actual financial statements. So that's going to be both your full of cruel government-wide statements as well as your fundable statements. And then behind that is going to be your notes to the financial statements. There's a lot of language behind the financial statements to ensure that there's some breakdown of what the numbers consist of and a little bit of this more detail of what those relate to. So that way, you have a little detailed protein field of numbers. Then behind that's just supplementary information so there's a budget reports as well as TMRS reporting and then the statistical section. So that's the statistical section has many, points for a lot of clarity on what the city hasn't had historically for the past 10 years worth of data. So it's really cool to be able to see how the city has traded the last 10 years and just provide a lot more clarity on what the city's at and what's going for. As it relates, sorry, one more one more thing. On, as it relates to that first item, and they're the 100ers opinion. There are four possible opinion types that we can issue as the audience. So there's a modified, qualified, disclaimed or reversed city gives or seen a unmodified opinion, as often referred to as a clean opinion, as a highest-stellable insurance fee, if I were able to provide. So we want to see in some happy report that the city did receive a clean report. Next. So we're going to go through this high-level financial results here for the 24-fiskewe years. This is for the government funds, comparing you to here, some of those major funds and how they're presented within the report. So general fund had a increase in fund balance by 176,000, which was in line with what budgeted as the city planned on utilizing that fund balance for part of the 2020 purpose we year. That whole sale motel tax fund we saw an increase there in the $420,000, $420,000, that's over $900,000 approximately $8,000 payments that fund and expenditures going to captured $480,000. So overall, that positive in the fund balance there, your street maintenance fund was up by 39,000, just due to sales tax outpacing the expenses for the year. Your governmental, the SIP fund was up by 1.2 million. And that's the student transfers that the city made into that for future capital expenses. And then that other non-mater fund is going to be a consolidation of all the other non-mater funds. And primarily, this is seeing a special revenue fund, so they all have their restricted use. And so overall, the total change is an increase in 1,151,000, but those funds are all being consistently used within those restricted purposes. And so, everything will get there as well. All right, next. And this is retaining to you the budget results for the year for the general fund. So overall, the general fund had a positive budget variance of 323,000. So there's a more detailed view of this in the report, but in summary, the revenues were pretty close to the target. It's only a positive variance of 4,000. so about $4,000 from the more came in the budget. Your expenses were under budget by $331,000 so positive variance there. Other sources of uses, those are going to be transfers and transfers out of case of ad nature so small negative variance there of 12,000 but overall as I said there's a overall positive variance of 323,000, so assuming the city was able to accomplish everything you received into a college for the year, that's a very healthy fiscal budget year, so things look good there. As it related to the fund balance as a whole, we look at the unrestricted portion of the fund balance between the general fund, and so the city does have goal or policy to get that close to this 25% of operating expenses. So if you compare your operating visits for the year to the unassigned fund balance, you want to get about a quarter of it worth kind of in a reserve to make sure that you have funds going forward in case of emergency or things are slow to come in in the next So I've left in there the past three this year and last two years to prepare. So the city is at 51% currently for 2024. So that's exceeding that expectation that I know this 2024 year it was budgeted to try to use some of that fund balance and so to bring that down a little bit. So it is down from last year, but right in line with what it was two years ago. So overall, it's just a very healthy fiscal budget for the general fund. Next. So this is the proprietary fund. So it's going to be your business type fund, so your water sewer fund, your drainage funds, those operate wildlife businesses. So we evaluate them for the link where your environmental funds are not intended to make money that you use to operate the city where these funds are, you need to be able to be self-sustaining and make enough money to be able to support itself. And so we make sure that is the case. So looking at that net operating income line So the water sewer has a net operating in 7996 thousand from the year and drainage is at 254,000 for the year so Self-saneable to operate and it will Build a bit reserved there so that way they can take care of bears and maintenance cost because that nature in the future. So that's good. Overall, after operating activity, there's other non-operative transactions that occurs, such as transfers and other things that nature. So after all transfers in and things like that, there's an overall increase in the net position by 3.2 million in the water sewer and then drainage is, for consistent to the small increase from the 250 for it, 280 3000. So that's overall increasing the net position. And then there's a breakdown for the net position of the total net position for the water sewer family, so 2.6 million. Of that there's 5.6 related specifically to capital and infrastructure and then the remaining 4.6.0 million. I'll be on that. Next. And then lastly, there's two location letters that come with the report. So there's first letters that come with those charter governance. There's a lot of required communication in that letter that we have to include there. And so that's concerning our responsibility as auditors. It goes over the management's responsibility as a agency audit as well. There are a few people, I always like to point out from that letter, I'm one. The audit was conducted in compliance with all ethics requirements regarding the finance. I'm two, we didn't have any difficulty working with management. And and three audit adjustments that were identified were corrected by management. In the back, there's any adjustments that we needed. There were only two needed. And those are intentionally left by the city because it's a one-time unique entry. You've related to Team R Us, Pitch and OPEP stuff. So if they leave that, and so it's very few entries, really the fewest entries you've ever really encountered. So, the team was really on top, but it made sure everything was ready to go for us for the audit, so I was very clean. And then the second letter, the communication regarding control controls, that would be, or we communicate any concerns over control findings or suggestions there. The only item that are listed in that letter is we're not findings, but just more of FYIs for the future. So we didn't have anything to report in terms of control as she concerns, I think, Flick. But there's a gathering announcement related to how you report sickly to the future. So the guys that came out with a new thing that we're having in for the next year. And then also a single audit requirement has been for several years, $750,000. And that has been approved effective next year to go up to a million. So that would, the city would know how you're required to get a single audit unless it it spent at least a million in federal funding So that's the only items go to the Internet or just for FYI and you sure that city was aware of the items that are coming That would impact the future of the city And that's it on that and so with that open to any question you guys have One quick question. Let me say a couple of words that we introduce. Our goal here is, and I'm sure Mr. Rice want to talk about our goal here, is to protect our businesses and protect our sure and water system and the limester rice walk you through what the entire Steve staff has been working on. This has been a joint project with inspections, fire marshal, police department, director of community development and then Mr. Rice. So, we'll then return what we serve and you can walk us through what you're thinking. Thank you, sir. Good evening, Mayor Good evening, council. The city of Belman's current regulations for mobile food units established in August 2016, by ordinance number 2016-01, has significant impacts on the city's water and wastewater infrastructure. Mobile food units have increasingly engaged in stationary operations, connecting directly to city's water, wastewater utilities, and violation of the ordinance's intent. Connections by stationary mobile food units bypass the city's batch oil increases ordinance and results in improper disposal practices. These improper connections have caused significant blockages requiring staff to address after-adversed emergencies, easy emergencies, impact businesses and residents who experience disruptions in water and wastewater services. And in these services, some established businesses have faced operational delays or a closure due to the sewer backups. The proposed amendment is necessary to align mobile food unit operations with the city's long-term infrastructure goals while supporting adequate access to city services. And I do have a power port presentation and we'll accept questions at any time. So just general descriptions, definitions for the mobile food units. The mobile food unit means a vehicle man itself or otherwise propelled self-contained food service operation It's designed to be readily movable, including but not limited to catering trucks, trailers, push carts and roadside vendors or used to store prepared display, serve or sell food. A mobile food court is more than two units in a typical and in the same location. And a food establishment means a food establishment which includes an establishment that contains more than 100 square feet of display space of commercially pre-packaged food products. Or childcare centers that care for seven or more children and which prepare food for consumption by the children other than ready to eat food first in the hacks and drinks. And these are definitions from our own. Thanks, I have this. A couple of issues, for example, that we've faced in the public works world and like Mr. Zachary mentioned that has impacted all city staff. So one of the big items right now is hauling water in large containers. And with all of these big water totes, their waste water containers are smaller than their water. So there's overflow, there's additional auxiliary tanks that are having to be used and create a health and safety concern. Ultimately, it will cutly to at least elicit waste dumping. There's also direct connections to our water supply. Where there's an issue with that, most commercial businesses, especially through establishments, need backflow preventors for any cross-connection issues. This is a health and safety issue. It's more of a change in pressure from the water supply. So if there's a bigger head pressure on a sink filled with dirty dishes and grease and whatnot, it's higher than all water supply. It backfills. And we are no longer able to control the quality of that water. And that goes through our system, impacts additional businesses and packs our residents as well. And as you can see in this picture that is a little tank, that is one of the additional auxiliary holding tanks for the wastewater. So as these food units are connected directly to the water line, they've got that constant source of water, limited wastewater capacity. Another issue that we had with these direct connections with water wastewater is a lot of these new mobile food units have. Bents, and these vents, uh, will end up being rain catchers. And these rain catchers will go down through the vents, go through the network that they haven't go directly into our wastewater system. What we call Info and Infiltration ultimately gets into our collection system and impacts our water consumption for the month or daily at the panel on the rain. So heavy rain a lot of rain water collection into our waste water system that we don't want. And again this is another direct connection to the water line, no backflow preventer, because some cross-connection issues. I have a quick question. Yes sir. When these are reviewed by the health department, do the e-tactis inconsiderate issues, do they have any anxiety or any water tanks? So are inspecting those along with because you were sitting they could be a contamination That is a conversation that we've had with the city Waco Health or the city Waco in the McLean County Yeah Um, I just didn't know that was was me. Um, so we have had those communications with them. Um, it's really into our ordinance that we've got to, um, be able to, um, give our staff the ability to tell them that they can't have that. So our current ordinance right now is fairly vague. Um, we do have a communication with ourenforcement to help them communicate that they're not able to, they're not supposed to connect to our water wastewater. They're supposed to be disposing with these tanks to different sites' properties so they can dispose of them properly. But when the health inspector sees them at their annual inspection, they're not going to have these auxiliary tanks attached to them. So when the mobile food units move to get their inspection from the health department, they've got their own water supply on their units and they've got their own holding tanks. And there is a state ordinance that makes sure that the wastewater container is 50% bigger than their water supply. Did I answer your question? Yes. Next slide, Bruce. This is an example of some sewage backup that we had here, a mobile food unit. what looks like toilet paper and paper grease that's at our toilet paper and grind, there's actually some of the grease that we see popping out from these sewage lines. This is right as winter started to hit for us so you see that grease and that fat start to gel up. This is broken down but what we do see in our lines and our manholes as our machines are clearing these lines it can almost look like talking pucks of solid fat that's clogging these lines and so this is what our guys tackle and this is during business hours after hours if it's impacting somebody that can't flush a toilet can't you know their brains aren't draining this is more times than not what they're looking at. This is more times the number of what they're looking at. This is just recapping some of the causes and the impacts. We correlated about 16 sewage backups in the past years, the year that I've been here, related to these mobile food units that were connected to our waste water infrastructure where we've had a backup for businesses report backups, residence report backups for these lines collect. Again this this impacts our staff this after hours at all hours additional equipment use and then it also has additional staff oversight as we're driving by and going on to make sure that they're not connecting to our water, not connecting to our waste water. That concludes my presentation. More than happy to answer any questions you may have. I'm not that attached to the bigger lines, not just the smaller lines. It affects all of them. During the winter times, it is more... I'll go and see some sewer lines. No, some of them was, I've seen y'all didn't with, or the big man, or the streets. And it's blocking off, like the major businesses of all of those. And specifically, you know, Harrison Line has a lot of arterial lines that connect into that bigger collection line. So they got to track that one down. And it was on Hopster Style, the rather than it was blocked, no. They had to force side. I have a couple of questions. Skipping. Sorry, yeah. Then I'm just trying to use this as an example because this is kind of new to me. But then I'll push chicken. Going into the dollar general. there's always this really bad odor and I've questioned the dollar general and the question about it and I was told it might be a grease trap and I'm just trying to figure this out is this kind of something like what we have in the issues with? So what what can happen and you work with the health department on this is every restaurant has a grease trap and it's got it has a typical size of it on the type of food. You know, the frequency of degrees going through, they're not going through. And so they are instructed to have these grease traps cleaned out every 90 days, if not sooner if they need to. So like, Jim's chicken is probably going to have their grease traps cleaned out way more than... They're going? They're going. You know, just because the type of food is providing a different amount of grease. Now what happens is if they... If the grease-chat builds up, then that Greece now flows over and goes into our system. And so that's something that we're working with, our health department, to make sure that all these commercial businesses are adhering to our vast flows of Greece. OK, so based on your recommendation, the problem that we have with your expertise, what are you saying that the council needs? The recommendation is to approve the amendment of the ordinance. No, and what this does, it's going to help. It's going to deter mobile foodiness from connecting to our water supply and connecting to our wastewater infrastructure. That's the intent of this one. Let's put what's so different, count from the comb source that's male, is right behind the dollar store going in, kind of what is it? You can use the up? Can you pick it up? Can you pick it up? Thanks. It won't be too loud. Not really. So is that smell behind going that kind of what is it? It's attributed to the grease traps. It has been something that I can bring back to my team and we can investigate and see if we can help.'s been like that for years to go down. So take color as it's over Absolutely, I can I can be my team Not by the San Jacinto and the grace coming to the level affect those hallucinations. They can. Yes. So, most of that flow in that area will go into that Harrison collection line sooner than anything. Back up, step into the creative issue there. Yes sir. And it does make our pumps work harder, it does make our staff have to do some additional preventative maintenance to keep those pumps running. And of course, if we have to run this pumps longer, it's higher electricity. So let's end it. Snowball effect. I mean, I made a fool of trust that we have in this city of Berlin. I'm sorry. I mean, I made a fool of trust that we have in this interpellium. Roughly severing. So I know there was one by the bell mark when this was initially discussed February March and they have since moved on. But we do have a part, you know, the stationery wants to be easy to identify. I don't think I've talked to anybody from James Chicken, but they also want to bring on a point that a lot of times these food trucks come into the city they may know sales tax which is doable I talk to manager the partner of the Chick-fil-A and he said like when he goes to Roosevelt or goes to China Spring and he uses a Chick-fil- mobile unit. They actually report that sales tax in Grozbach. They report that sales tax in the city of Wake of its China Spring. Sales tax is very important to this city. And my growth up to variance has been a lot of times. It's always an even amount, no matter what I get it's either $5.00, the web number is. And so they are concerned about this because their attitude is we've invested hundreds of thousands of dollars and food trucks are supposed to be mobile, Correct me if I'm not set up to do their business in the part unless they are in an established food truck. Food trucks, and every research I have done that find the stating, sorry, please correct me. Food trucks are not to set up permanent canopies, are not to set up concrete pants and operators are restaurant by passing the investment that the dairy queens, the gyms chicken, the moment to build more down here, all these establishments have invested thousands of not millions of dollars in the city of Bummi and that's what we want to do to protect. We're not against food trucks, we just want them to be regulated and comply with all the rules and regulations and not bypass our established Wendy's, water burgers, all these restaurants that we continue to appreciate and help Why the food trust Because they show up and where they pay their sales time That's right. I know I know you we talked about this you want to address the stationary versus a mobile? It's supposed to be a mobile food truck. Yeah, so the mobile food trucks are supposed to have a commissary that they're housing. So that's where they're prepping their food. That's where they have a greased traffic to be monitored with any city's food ordinance or ordinance. You know, and, you know, with this, it allows them to operate in a very different way. So you've got a different code and rulebook for food establishments, your brick and mortar and your stick builds to your food trucks, right? So from the building code to the health code, the amount of food storage is a big thing. So how do they prepare the food, how they cook their food is very, very different. One more question, the stationary food truck, stationary for a multiple so do the stationary food truck for the poor and pays us tax. Down the stationary. They are supposed to. But I don't know. Most of these food trucks, they were poor and like when they said they, they have a physical address. Most of it could be their house and wake up Robinson wherever they reside. So that's where their listed physical business address is. That's where their report and their taxes. They could be set up and bill meet with paying taxes in Robinson. And we're losing out on all that tax dollars. So we're back in one of the states of Ohio. They know to have been on the same states there. So what is happening in the state of operating between the building establishment and local food truck and air making which rules they want to go by? And so this helps identify and provide this to you. To enforce that. They're on that mom-climate county side. said, don't be the state and there that you can't use a resident as your commissary has got to be commissary kitchen. Correct. And that is the health department that is supposed to be inspecting the commissary that they put down as their home for the kitchen. They're not supposed to be using their home address, although they do, they're supposed to be happy, they're supposed to have a commercial kitchen at their bracket. Has everyone know that something that we can address inside the city isn't? Not to my knowledge and as far as when this was initially investigated all the food and the commissaries were outside of the Bellington Act and all. So there's no commissaries in the city. That's one of the reasons we updated this the ordinance was. Right. The force was applied. And in 2016 I know if we tried to just now start to start up it in the next year. I mean if you knew that it was going to be the situation in this now. What has question? Yes, ma'am. You see we had eight, maybe seven or eight fruit trucks are? Yes, ma'am. And I'm sure some of those food trucks are not in compliance with my look at it. Pretty good sense, really. So, again, what we grandfathered in on these was once the art, it's changed. It's changing for even the people that are really established in their spots. I'm going to be clear. You know, my tip, what to bring them into compliance? They would have a timeframe to be made compliant, not approve this tomorrow or tonight. We expect them to be compliant tomorrow morning. But that would be hopefully the recommendation and cancel our hours time with people to be compliant and see them both. I think what council would like, I don't know, speak to councilman, I'm going ahead. What time do you and the team think is the most important time for people to come and complicate? Is it 60 days, 90 days, 30 days. You work with this every day. So I want to, I think the council would like to at least hear your recommendation if that's OK. That's that. I was looking forward to it. My recommendation would be 30 days. And I think that is reasonable. A lot of them should be readily movable now. We are working on making sure that they're not connected to our water, with water and the structures for that issue should not prolong that time-rending complaint. Did not come complied with in the third day what the next step for the city. You know, I think we've got a different type of enforcement. We'd have to discuss. I'll raise my eyes across. We'd have to talk in satan-turning without a good play. That would be handled with what we would do, we would certify the course level of the letter. And if they choose to not comply, they would be in violation of the ordinance. And like anything else, they are entitled to their day in court. So we would take them to court. We've got a case right now that's pending that a gentleman is refusing to comply with a certain part of the ordinance. So we think of a court and let the impartial judge look at it and make it a termination. All right. I've got a couple of questions. So under this, under section two, subsection nine, nine, nine, it states that they have to have a permit. We make food trucks have a permit in Belly. There is a mobile food unit permit. There's a food establishment and a mobile food unit. And so if they're operating under that permit, there's supposed to be a mobile They're supposed to be mobil, which means that they have to move at least 1,000 feet every 24 hours. Correct. According to the amendment that's in here right now. So that means that they relocate to have to have any permit, correct? Or is it permit for a period of time? The permit will be annual. Oh's also the annual inspection without the permit. And then another question was under. It talks about drive-in service, not permitted. So, you know, I've got around town quite a bit. There's a few elderly people that like to eat the food trucks and they don't get out of their car and they're served at their car. So, you guys considered a drive-in? I don't believe so. I think what you're looking at is like a mobile food coffee a coffee truck that I have like I'd drive right under this adoration thank you ma'am thank you thank you there's another question is there a?
