So yeah, commissioners crews, so that one is consider this one is for these sort of recipient, funds that are going to solve recipients outside the city because the police department is considered to be in part of the city is to be part of the grantee what's going to happen there is going to be like a inter-interlocked agreement inter-interlocked agreement and that one is will be signed with the police department and in this case the city manager will say that agreement with the police department because just internal. All right. 6-E. Proposed resolution R24 210 approving a template, facility use agreement for entities desiring to use city spaces for meetings, programs, and or events. I'll let the city attorney speak on this one. Yes, so the city commission has to approve each facility use agreement. That's anytime someone wants to use one of our facilities. They have to sign off. And so that could potentially take time in some of these events and getting people in there. So what we are proposing is that you review the form. If you approve the form, then this resolution gives the mayor authority to sign all of those forms once completed by somebody who wants to rent the facility. So it obvites the need to come back to commission every time someone's renting it for a wedding or a walk or anything like that. Okay. Any questions? So if someone wants to utilize like the intercoase of clubhouse park I know they do comedy nights that has to come before us Yes, what happens in the case that we don't have a meeting like a second scheduled meeting and that bypasses when they're trying to rent that space and they can't utilize that No, if I mean if you pass this then it'll allow the mayor to come in and approve it. And if the mayor comes in and approves it then it won't have to go to commission. So that way we don't. Yes. Okay, this is to prevent you from having to review every single one in the future. Right. Well, and that's fine. I don't mind reviewing anything. I'm here to work. But I just want to make sure that people who are trying to utilize our spaces in the city trying to generate revenue from that, right? We don't lose those opportunities. And we don't be a bad partner for local organizations to not being operationally efficient. So what you're telling me is that this will allow the mayor to then come in. So it doesn't have to go before commission. So we don't have that lapse or potential loss of revenue, you know, or put a bad taste in applicant's mouth. Correct. Okay. Perfect. And then what if the mayor's not here? And it would go to the vice mayor. Okay. So pecking order. So I mean, technically this ordinance is only allowing the mayor to sign. It is not laying out a pecking order. Okay. So I believe that the vice mayor can sign in instances where the mayor is unavailable. If you want us to change the resolution to add a second person, we can certainly do that. Yeah, change it or allow it. What do we need to do? The lenient vice mayor from mayor because both of them have mayor in their title. And it's not. They're okay. I don't you know my thing on this is I think we owe it to applicants. We owe it to city staff, the residents that we're going to generate revenue. And people want to utilize our spaces that we are efficient and we don't create like any gutter clogging. You're right. So I don't, it shouldn't rely on one individual. Is mine perception? Historically, this was something signed by the City Manager because it's operational. But we're trying to have full disclosure, make sure everything is not a problem. So we need your approval on everything as to who could sign what. So if you want the mayor and the vice mayor, the mayor and the City Manager, the mayor and the city manager, however you want it, we can do it. I've historically been signing these. Right, right, right. And it has, there's no monitor. This is just an agreement to utilize space. So I think this will chime into a different conversation later down the road. Yeah, all I want to do is make sure that, you know, us as representatives of the city and managing the city manager's city attorney's office that we're not missing revenue and we're not being bad partners with our local organizations by creating opportunities where we can, we may fail them. And if someone wants to utilize a space for however long and we can't even get this agreement signed, I just don't want that issue to happen. I don't want that scenario to become a reality. And so I want to make sure that there's a, you know, there's some form of failsafe. You know, if we move down this avenue. This is coinciding with the will of the commission for the last meeting. But you guys, yes, one of you will have to come in and sign these agreements. Yes so I think we need to change it to- What if this- sorry when you're done? Six G proposed resolution amend the location from Ocean Avenue to Low League Park Field 3 for energy efficiency and conservation block grant in the amount of $134,990 offered by the Department of Energy. That was us using our conservation block grant for anywhere in the city for energy efficiency. So, any questions? 6-H, proposed resolution 24 to 13, authorizing the mayor to sign releases of code enforcement leans. This is another change. I'll let the city attorney speak on this as well. Oh, so this is something that has been also historically just signed by the mayor and we cannot find anything that allows the mayor to sign off on those resolutions or excuse me on those releases of lean and therefore I mean when you're releasing a lean basically it's acknowledging that they've paid it so it's kind of like a receipt and then you give them the release of lean so that is something that has been historically signed by the mayor and we just want to make sure we have something in writing that gives him the express authority to sign those so there isn't a challenge to them. All right. Do we want to do the same thing for the other? You want to go forward with the same language? I think we need to go forward with the same language. I think we need to go forward with the same language because what has been created from the previous consensus is potential for operations in the city to come to a screaming halt. And that is what I am not going to do is allow this city to elementally stop its operations on a day-to-day basis based on whatever intention you know this was brought forward. We owe it to the tax fairs and we owe it to the residents we owe it to city staff that we operate as efficiently as possible and you know especially people who want to invest in our city new and current homeowners and so you know these are the type of housekeeping items that we can't wait because then you're going to get more concerns and people are going to complain. These are the fundamental things that other cities don't discuss because they're already doing it. So I want to make sure that we are not relying on one individual that we are operating at a level that is just the bear standard for residents because we they are residents don't deserve the bear standard they deserve golden excellent customer service. There's I'm gonna get with your guys executive assistant Kendra Brown. She's most likely gonna be definitely calling you guys to come in quite a bit more to sign documents so okay. We're on a six I now, proposed. I'm sorry. And we'll just talk about, I apologize, but anything that has to get signed, typically legal, goes through my office first. So either I can reach out or I can have kind of reach out, just let me know what your individual preferences and I make that happen. And I would like documentation of these reach outs too because I need to see what the response is. You know if an individual is waiting six to eight hours or a day to respond to come sign a document for a parking use agreement whatever the case may be that is unacceptable. We owe it to our tax payers and our residents and anyone who wants to invest in this community quick and efficient operations. And so if we see a trend where we're not responding in a timely manner for something so fundamental and easy, then maybe we need to adjust in the future. Okay. We need to do that. I'm agreeing with- Right, but just for the record, all elected officials have full-time jobs except for Commissioner Haye, right? Right. And so six to eight hours would not be unreasonable because someone in this position is not full time. Sure. So why wouldn't we let the city manage assignment if he's here all day? Therefore, if we're going to give a time frame, it should be a reasonable time frame, not six to eight hours because you're working at your job, six to eight hours. I get it. Trust me. I've worked 10 hours some days, you know? I, you know, and it's very hit or miss, you know, I can't always plan. So, you know, I just wanna remind us for the record, this is city manager form of government, right? Not a strong mayor form of government, nothing like that. And so if we gotta wait six to eight or 24 hours, I get it. Listen, Commissioner, I'm with you. I get it. I work hard. And I know the rest of us do. This man worked hard for years, and that's why he's retired. But I don't see the need to wait for a signature that has no monetary intention. So I just want to make sure that, hey,'s the mayor's called, he's busy, if you're called, you're busy, you know what I mean? That we are not letting the taxpayers suffer based on this being a part-time position and us working six to eight hours or ten hours a day, right? That's not fair to them. And so I want to make sure that we create opportunity and a process that eliminates that completely. Good. All right, six eye. So we'll move on to 7a if you guys don't have any questions and references to that one item. 7A approve the renewal and annual expenditure for one year extension for RFP bids and piggybacks for procurement services. Commodities these are over a hundred thousand. There's quite a bit if you guys want to have any questions and reference to those extension. Deputy City Manager Andrew Mack has it pulled up right now. Moving on. 7B approve of a piggyback agreement with GT supplies for the repair and maintenance of the the city of West Palm Beach. This is obviously just giving us better rates. So, 6C or I'm sorry, 7C. It's going to be proposed resolution number R24 to 18 approve an increase to the annual expenditure of the agreement between the city of Bowling Beach and Blue Marlin investments doing business as Kiko Landscaping from 340,000 to a total annual amount of 418 to $78,000 increase. That's due to the fact that we are trimming more trees. The trees are growing a lot more than what we anticipate is our landscaping cost is essentially going up. Is it a bad thing that the cost is increasing? Yes, but I mean, we have to maintain our landscaping around the city. If you want any more intricate details as far as that, I can have Andrew reach out to any of you guys. I mean, do we not want to look at a different landscaping company? If that's a viable option, I'm just saying if you know. The increase is more to the fact that we're planning more trees and so the trees that we plan and have now maturing that need to get. So they're doing more work. This isn't an increase in price. This is really well this is a potential this is a CPI increase which is allowed to the contract. And then the part of it is we're actually doing more there's actually more trimming than this We should could do around the city. I could spend a million dollars a year trimming trees But we we do what we can to keep what we can maintain So this is gone up year over year for last several years because we're doing a better job of maintaining what we have Okay, Andrew is there a point at which we should consider how many trees we plant because we could be our worst enemy. We should now sell them to foot. We keep planting trees and yet we complain about the cost is going up. It doesn't make much sense. There should be where we could say, okay, well, this tree is gonna cost me extra $100. Yeah, let's play them all in private property. And then you'll be fine. But what do we have to do? What, what do we have to do like an agreement for that? No, we do trig giveaways with them. So there's a lot of times, so a lot of that, you know, a lot of the new trees we planted was a part of the our efforts to do the 3000 trees a year, which we do support. I mean trees are great. They have a God benefits. It's just you have to pay if you want to plant trees. You're going to have to pay at some point. So she's just have to be cognizant and we'll do better job as we do plant trees to make sure we're not putting them into locations. We're going to cause problems and stuff like that. So I think we'll get a little bit better. This is something that is we've done better over the last three years, identifying what the scope and work in that we're doing in throughout the city. So you're seeing a little bit of an increase too because we're just doing better work, maintaining what we have better. But the answer is a question. Yes, absolutely. When we plan a tree, it should automatically come with that tree is going to cost you X dollars a year to maintain. Absolutely. Yeah. Not a bad idea. I have a quick question. Is it possible? How long is this contract? Is it one year contract or is it a two through year piggyback? Just a question. Is there three here? We're piggybacking. I believe it's a one year renewal. But as we prepare for next year, tree trimming, landscaping, power washing, like these basic things, we should really, if the, and if the rest of the commission agrees, we should really see if assuming that we have the same budget and it costs the same amount of money, if we can provide opportunities for boy and businesses, because local businesses are struggling, you know, a lot of, it's tough right now, and it makes a difference to be able to be supported by your own city. And it helps us too because we, we get taxes on that money back. So I can tell you that this is a company that we are, they do our, part of our median landscape and some of our parks landscaping too as well. They got, they were a small business that started with us in the city, so they've grown as they've been here. This is a piggyback because we have not done our own bid. That is something we do anticipate doing in the future. I don't, I really like to do our own bids because we control the bid versus doing piggybacks. But sometimes this necessitates it because of timing and the size of the contract. But that's definitely something that we will strive to do is to write and break down some of these elements to do local businesses I think it worked very well. We're bringing an item to you guys back I think October 1st for the pressure-washing We're gonna need you to wave a portion of the procurement code to allow us to award to them But it makes sense in this case because we're using a all local vendors Have we not we would have to do an RFP and I couldn't guarantee you that you would get those local vendors. So as we work on that procurement code and start working through some of that, that's something that will definitely keep in touch. I mean, I think it's money will spend to be put back into the city, for sure. Good. All right, moving on to 70. It's gonna be approved a first amendment to the piggyback agreement with Ergo Flex Systems, doing business as Zeibach Systems for the second phase, a renovation and upgrading the Boyn Beach Police Department's Communications Center at 2080 High Ridge Road in the amount of 135,207 dollars and 32 cents, which is reimbursed, which is going to be reimbursed by the county. This is our upgrades to our communication center. So any questions on that? All right. A seven E proposed resolution R24 to 220 approve a piggyback agreement with municipal emergency services utilizing late county contracts for fire equipment supplies and services for an annual amount of 160,000. If you guys want specifics on the actual equipment, we have Chief Bruder here who can answer any questions as far as the specific equipment that's been. Most of this stuff is into life, Chief Bruder. I'm going to allow the city attorney to take this. This is again the signature authority. I want to say that the first reading, everything was struck except for the employee aspect of- Correct. I don't know if you need to look or if you review the actual ordinance, everything has been struck from it other than what is already given in the charter, this is just outlining this specific authority to sign those agreements that have been historically signed and are under the authority of the city manager. So those agreements that will no longer be signed by the city manager are those agreements, I know it looks like you mentioned a few of those earlier. I want to make sure those agreements are not relying on one individual because the taxpayers do not deserve a screeching halt to city operations. So I want to make sure that we have a fail safe. Let me give you an example. Because you don't have a resolution that or I'm sorry, let me say an ordinance, specifically authorizing anyone to sign without commission approval. Every single one of those things, for example, a building permit application on behalf of the city that the city manager used to sign now has to come to commission for approval. Hold on, hold on, because, all right, I'm gonna repeat what you just said, because one of the number one concerns I get are how long our permitting takes. No offense, and nobody gotten really good and better, and there's been a huge change. This is our application for a permitting. Okay, our application. Correct. Like the owner application. Okay. So get, for example, if you're redoing art and cultural center, that application to apply for a permit has to be approved by the commission. But wouldn't we approve the funds to do any type of improvement? What we can, yes. So here's the point I'm trying to make is, so we would have to approve the funds for any type of renovation or any improvement upgrade, whether it's at the Arts and Cultural Center, the Women's Club, intercoastal clubhouse, whatever. We've all agreed at that point, hey, yes, we want to do this improvement. We're going to spend $150,000. For over $200,000. Over $200,000. And then that permit would need to come back to be approved. So what the City Attorney's Office will do in the future is once you approve the project, potentially allow the city, whomever, mayor, whomever, to come back and sign all necessary documents to fulfill the project. When the items you have on the commission agenda tonight is just that. It's the art and cultural sign. That's on here because you have to authorize the mayor to sign the permit application to submit to the building department to do the work. So until we get an ordinance in place that allows the city manager with the pecking order or a man at city manager, the mayor with your your pecking order we're going to have to do this until that's done. This seems like we're going down around a lot of silly inefficiencies and so I'd like to see what other cities are doing because I imagine that West Palm Beach, Boca Raton, Delray some of our neighboring cities aren't there's no way you operate a city that efficient inefficiently. We already pulled the commissioner out. Can I get that information? And we'll sort of go back. I don't want to be the dead horse and no commissioner has to go somewhere. Yeah, essentially on a weekly basis, I probably sign between 50 to 100 documents. Somewhere in that range. So with the direction that we're heading that's going to probably reduce by about 90%. So we're going to make sure that staff is documenting the communication that we have to make sure that staff isn't going to be blamed when operations get halted, stalled, or delayed. This ordinance just removes all the fees that are stipulated in the ordinance itself, removing them from the ordinance and adopting them by resolution and then allowing for a CPI adjustment in the future. Just quick comment. The reason why I voted on this ordinance at the last meeting is because this is going to be providing a automatic 3.5% increase to our water utilities every single year. Unless the commission pulls it and says no, I don't want that increase to happen. So that's kind of, is that what's happening? When you look at finance and you look at like future value of money versus present value of money, like everywhere in the United States takes into account CPI increases. So we can't get into the habit of price controls when it's going to be detrimental to our enterprise funds. So that's essentially what we're doing as far as. Wait, but you still have to bring it forward in the future instead of by ordinance, which takes two readings, it would be a resolution. It could be put in consent right. So if not it pulls it from consent then nobody really talks about. It could be but you guys have the right to pull it from consent and when we have meetings like this that's the time to tell us you know what I want to pull this off consent I want to talk about I want to put it under city managers report and we could make that happen. That way we're not moving as much stuff on the day of the meeting. And by resolution, you guys are still gonna see it. It's not, you know, and that may also means every time we change the rates by taking the numbers out of the rates, we don't have to amend an ordinance, which is a lot more, well, it's a lot more work, yeah, first staff. I think I sent everyone in the commission to email regarding why we rejected the bids and where we are and where we stand now So we're at that point now where we've rejected the bids and so we need some direction from the commission to Either whether we would want to see us go back for an RFP Or there's another still the opportunity to go back to speak to ats mobile vera to Renegotiate a contract amendment. So can I get elaboration on that? Sure. Deputy Chief can go on to detail. Not the latter option that you can. Contract amendment. Yes. Yes. And I'll tell you the reason I'm asking before I'm asked is I want to make sure that what we're doing here is first and foremost, promptness for the kids and making sure that our main focus is the children of the city, right? And so I just want to know what options would be, obviously, the most fiscally responsible for the city, what's the best deal for the city, and what delivers promptness to make sure that we can get these installed and ensure that we can make our streets safer. Absolutely. Because I think originally there was a possibility or discussion about using the current vendor for the... Well, what originally came up is when we brought the ordinance forward to codify the actual ability to actually have the speed cameras installed. The process from a procurement standpoint would be probably an amendment to our current red light camera, process similar to Davy. And we would be up an amendment to our current red light and camera process similar to Davie. And we would be up and running a lot sooner while school is still in session. So that's still the recommendation from the police department. Is to go with our current red light vendor? Correct. Okay. And what's the comparison between that and then the bids that we did receive? It's a significant savings to the city on cost. Can you define significant? I believe it's somewhere in $12 a citation I believe or something to that effect. That's correct. And what is the anticipated? that Disappointed forecasted revenue or I guess forecasted revenue. Or I guess forecasted savings, not revenue. The four castes. Revenue would, I think you would pick up additional in almost 2.7 million dollars in revenue, I think. Roughly. Yeah, the fundamental difference between the bids that came in and the possibility of amending a contract is whether or not we want more revenue to come to the city or to vendors. So it's our fiduciary responsibility to look out for the residents and the city not vendors coffers, right? So thank you for elaborating that. So just so I understand and I'm going to make this a practical, you know, as possible for the public is it is better, when I'm hearing it is better and more physically responsible to go with this current vendor than it is with what the bids that we received. So my only, you know, whatever but with that is, you know, how do you compare the quality as well, right? And what are we all getting? You know, because I think there's a value in that. I just want to, I just, and maybe you can get this to me at some point. If I can just get a comparison of what the proposal is, what the potential, you know what I mean? Because then it makes me easier. It makes it easier for me to go with an option that's, look at a few things, budget timeline quality. And so I think obviously the timeline we know is from what Chief mentioned is the current vendor. Budget, it seems to be that this was the best in a sense of, you know, fiscal responsibility. So the third, you know, factor for me is the quality, right? What is the quality, you know, of the service and the product that we're getting? And the only thing I would mention is that it's hard to compare because that's comparing it to a bid that's been rejected. So if we go back out to bid, we can't tell you what the prices you could increase. It could decrease. So I mean, obviously we know what, you know, we know what the vendors are or who they are. We understand that. So I don't need, I would just like to see what the comparison, you know, very simple, pragmatic comparison of what the comparison, you know, very simple pragmatic comparison of what we currently there are current vendor and what that potential option is because we know that the time on aspect is there and then what these vendors that originally proposed can offer and, you know, maybe get a very practical, or something, comparison chart. So we really need to- Does that make sense to you? It does. I think what it's a little bit cart before the horse, we kind of need you to tell us, like, authorize to explore that, to go negotiate that contract, to bring it back to you, to see you, to show you at that point. OK. So I kind of want to put it in perspective in this way. And I think the most important thing for the city is to get this infrastructure in place rather than later because you're looking at the opportunistic loss of public safety dollars in the amount of $250,000 a week, the longer we wait. So if we go back out to RFP. And more importantly though, is that we don't have this infrastructure and there's potential that you're gonna have increased speeding, continuing, and there could be a tragedy, right? That's what we're, my intention is, the children say, the children say, if you do what we can, and also I think it helps mitigate some workload too with our officers that are road patrol and so that way they can utilize their time, to focus on other crimes or be a little bit more proactive and lead with a television policing. So yeah, my main focus is getting this done and I just wanna know what the quickest avenue is and it seems like the current vendor is, but at the same time, I wanna make sure we're being physically responsible, sounds like that's the case, and then the quality product. So I don't need that information now if I can just get an overview. It just makes it, you know, it helps me want to fight for what we're all trying to do here. And that's making sure that we can implement this and, you know, put the kits first. Understood. Any other questions? Yeah, so my understanding is that the current vendor did they apply to the RFP? They did. Okay. Okay, so I think you said this earlier commissioner, but if we can get information on what on basically on on all the RFPs like because it's difficult for me to make a decision with zero information like the information that's on this paper. It's two pages of very high-level because it's difficult for me to make a decision with zero information. The information that's on this paper, it's two pages of very high-level information that I can't really tell you what's better for the kids and what's better for the city. So I would love to see some sort of a chart. I know we've done that. For example, our CRA has done that with with different types of RFPs where they'll do like an Excel sheet of like These are the questions we asked these are the responses we got you know So just to be able to give a good comparison and then obviously the rating of the city like why do we rate them? In a certain way if if that's something that's you know feasible time-wise and Provide that to the commission because even like this is gonna be discussed on Tuesday Oh, sorry Monday But I know nothing about it so I don't feel comfortable making a decision With something that I have no information on I mean the information's out there It's just and I'm going to say this is we're not here full time so my expectation is you know you guys get that information make it pragmatic easy chart boom good to go so if we could have that before Monday and glad you said Monday because my head thing Tuesday. I was thinking Tuesday so I what we can do is as a part of the bid we do a tabulation with all the bids. It has all that information. It's something that we could send you tomorrow. But when we gave that, we when we utilized those ARPA funds for WVRF, it was to focus on homelessness. And so it's kind of a gray area and I know they're hesitant. My focus is what can we do for this man or woman, I don't know the details and when you get that back. And so maybe looking into, if the individuals doesn't have a roof, I think, you know, you could consider he could or she could end up in homeless. And so, you know, habitat deny them. And so I want to make sure that, you know, we do what we can at the city level, you know, because the funds are there to maybe reassure WVRF for this individual.
