And I just want to read this paragraph and just remind everybody that state law prohibits the mayor and members of City Council from commenting on any statement or engaging a dialogue without an appropriate agenda out of the posted and accordance with the Texas Open Meeting's law. Comments should be directed at the entire Council and not an individual member. Engaging in verbal attacks or comments intended to insult abuse, malign or slander any individual shall be caused for termination of speaking privileges and expulsion from council chambers. Your comments are limited to three minutes and there will be a buzzer that goes off at the three minutes. The first person who signed up to address council is Mr. Paul Robinson. Thank you Mayor of council. Great to be back this time of year again for the 18th time. My name is Paul Robinson. I produce the Texas Outlaw Challenge voting event. I don't know whether it's the economy or our construction is over with or what it is, but we're about to have a record year without law challenge. We've already made the cover of a national magazine. We have a nice shot of the Kim Arches district in here. Always a great photograph. Our card has gone out to over 5,000 people on our mailing list. I'm old school. I like to get something in the mail. I'll open an email too, but this is nice. But I am here today to repeat my request for review and approval of the resolution for a no-wake zone for four hours on clear lake the Friday morning of the activity that we have on the lake. This document is reviewed by Seven Cities who have jurisdiction around the lake and this is the key document to our safety record of 100 percent and I appreciate you looking at this and looking to approve it again. It's critical to our event and I'll leave it right there. One thing I will add in my minutes, we do have a bit of an issue on the lake. We have a viral situation happening with abandoned boats showing up. And this isn't the first year. It happened last. And there was a boat anchored, windows broken out, no navigation lights, lots of growth on it, pretty much abandoned, but in the way of our activity. I had one of my safety group boats, moved the boat about 200 yards, pulled up the anchor, dropped the anchor, and we put it back at the end of the event. I got sued $25,000 for doing that by the owner. Settled for less, but point is maritime law, I don't know what's a 1600 laws or what it is, but it's well in favor of what's happening out there. But it's going to be viral. There's now 18 boats sitting out there on the lake and various areas that are a problem. If I have to move one for my guests by participants to be safe during the event I will move it. I will pay the money. Safety is number one. If it takes that to do it, I will get sued again, and I will pay it. But I really hope I don't. Don't have to do that. I will add this last point. When I paid the last year person who did that, I said, what are you going to do with the money? Are you going to get a boat slip? You know, now you have some money. And you're boating at it. He says, Prince said, no, I'm going to add it to my fund for the suit that I'm suing the Dallas police force. So this is an organized operation of suing. And I'm not worried about my four hours of the year on the lead. I have safety patrols, I have all kinds of things that I want to do in this area. I'm worried about tonight when a family comes across the lake and hits one of these boats with no lights on them and they've been sitting there and I understand there's things being done but they're still there and I fear for repercussions. In the last of years there have been almost $3 billion dollars of the B of dollars voted for school buildings for the Clear Creek schools. That was in two different pretty large bond issues. So my main point here tonight is on children's sports complexes. The medium house median household income for TEMA is 95,000. Oh, that sounds great, except for you got both husband and wife working. So if he's making 50, and she's making 40, that's really not, that's pretty humble. Or if you factor in a millionaire, and then somebody down here who's making 20,000. So various people have different ideas about our population is I'm going to go with 2500 tax payers residents of Kima right now as it stands. If we build a $55,000,000 children's sports complex that's just the building because we don't know about the land yet that's it that hasn't been invented yet that is $22,000 for every man, woman, and child in Kima. People who are making house payments on their homes, they're making payment plus interest plus mortgage insurance premium if they didn't put down at least 20%. They pay wind storm, flood, and they pay HOA fees. So, and the guidelines now used to be 36% you had to allow for your debts. Now it's like 50%. So these people are right on the edge in my opinion of going into foreclosure and 36% of Americans are in danger of foreclosure. My question for you to think about, have you proven a certain income minus expenses leading to a bottom line profit for a children's sports complex or a team of convention center? Advertising maintenance, playing field stadiums, gyms, utilities, 365 days a year, keeping it heated and cooled, liability insurance, I could go on. This thing needs to go to a vote. Do you know that McKinney-Texas has a gorgeous children's sports complex, but they have 213,000 people living in McKinney-Texas. Not just 2,500 of us. And do you know what the final tab is for the lawsuits that you as a body have already caused? Do you know that the bloom is off the rose for municipalities to build new stadiums? I brought this up several months ago concerning Kansas City and several big cities who are saying no not now devil so a lot of people the bloom is off the rose for driving their kids for travel sports they're wise to that they don't want to do it anymore bad weather darkness kids have school so five people are planning to decide an expenditure of maybe $75 million here in Kima by the time you buy some land, find some land, bid on some land, and then the costs of that. Children's sports complex have ballooned again. Oh, we're so sorry. Contractor came in with some more expenses. Whatever. Who is the contractor who stands to benefit from this endeavor? I don't know if you've had a big, big, big biz presentation given to you that gives all the pie in the sky. I don't know because it's always behind closed doors and it's always super, super secret. Cheryl, you're three minutes is the, thank you. Thank you. Next on the list is Shaleigh at the Horn I hope this first second I would ask that we put back three minute clocks so you don't have the opportunity because of a speaker can get and gross who what they're saying and don't have it you've done it before I'm I'm not understanding why you're not doing it. And I am confident that the entire council will serve in the best interests of Kema, its citizens, businesses, and visitors. My first thing is regards to the city health district. I lair that I'm the one that brought this to the attention of the city. And there's been no movement on it. And I'm eagerly awaiting the debrief today on what will happen there. And then I lashed that a vendor of the city does not have liability insurance as stated in their contract with the city. Why put the city in harm's way when they are known that they're not following their contract. My last thing is the optics on this request for a variance are very concerning, and that's it best, and it can be downright considered a could pro quo at worse, to give a variance when other businesses and people that take out permits have followed the ordinance, now you're going to give a variance to, and again, the optics, a employer of I allege, one of the soon to be council persons. But the little town that I was staying and I was kind of on the little town square and I ran and I spoke with there, I went to City Hall and their population are smaller than ours and they had mentioned that they just had an election but the turnout was just terrible because the only thing we really have going on here is a new fire hydrant going on. Their turnout was almost 30 percent and I was like good lord, or you think that's low? We don't get anywhere near that. And I think that's one of the things that he's not lying. This is a lot of work. It's loud, it's a lot of reading. It's a lot of studying. And it's disheartening to find out so few people that are capable of taking the part in the process choose to. And while it was definitely congratulations everybody that won and thanks everybody that ran, I don't know what we have to do to sort of stimulate people to understand that this is important. I mean, it really does have an effect on your day-to-day lives, the decision that gets a decision to get made by the five of us. and it's important. I mean it really does have an effect on your day-to-day lives. The decision that gets mid-assissioned, get made by the five of us. And it's important to at least have a voice at Houston's up here. As you're aware, I shared this letter, but I wanted to have it on the record. They do intend to terminate their agreement effect of the end of this fiscal year. They're stating they want to redraft a new interlocal agreement with e-tentity to make sure that we continue these services. But they are providing their usage fee structure. So we will need to obtain that in time to properly incorporate that into the budget. But they're also basing that on fair use of the facilities and services that they provide to us. It's neat, interesting to see how they're going to break that down as to what that is, but they also stated in the letter that their resource centers are needed of significant renovations and possible expansion, and they would like to incorporate that fair share of all the cities into their cost. So the decision will have to be made on what we'd like to do with those services moving forward. I'll likely work with PDE because that's only who handles animal control services for most cities. So we'll work hand in hand with that. But they have noted that they intend to terminate the current agreement with a drafting of a renewal. So once we get that, we'll be ready to sit in now with finance and incorporate that into the budget discussions. If there's any direction that you'd like to give on that as we're planning now, obviously as we always do, we'll look through alternatives and what that could mean for us. Besides that, that's all I have on that item right now. We have reached out reached out to them to see how long Until we get some information back as soon as we get some information. The 2005 Gradle did come back at a pricing of $25,000. The 1997 Gradle came back at a pricing of $8,000. Since both of these are below what the amount toward that we were respecting, I didn't feel feel comfortable just acknowledging the sale of those those are the highest bid Those folks have already paid it over to the auction company and Technically have won the bid, but I want to make sure that you authorize release of that before we move forward tonight Is there like a There is actually we had a number in mind however if I guess we'll compare it to Kelly Blue book if you will the blue book for the 97 was about 10,000 what we expected she's going to take that back five to 10,000 with 10 being the highest so five was a low end. bid for that? That being said, our current engineer is making the request that we require that drainage. And I'll ask Isaac to speak on that as needed. But there have been some modifications made by the engineers of the organization. But it is a five lot subdivision. Again, it was the plant was approved and recorded in 2022 with the water sanitary paving COVID-prevented construction from taking place. Currently ordinance 30802 requires attention for this type of development but the reason for the variance is that they don't have space for construction of a detention park, but they can move for the storm system they've upgraded to provide capacity for a 10-year storm event instead of the typical two-year storm event. Concerned that I have is that they are proposing to restrict that flow and to detain within the property. And that means there's not a formal detention site. There is ditches, there is pipe, the pipes and the ditches are being used for conveyance. And there's maybe some amount that hasn't been conveyed by their engineer of how much is being used for storage. But whatever that delta is, there's more, potentially once it overflows the storm sewer system, it would store within their properties and within these logs that are being sold. So that's my concern concern that the tension why they are doing restriction in order to hold that flow back, that's something that they're definitely doing. However, they're not providing formal detention and besides whatever is remaining capacity wise in the pipes and ditch. So open it. It's both as an open ditch and it goes into underground sports system that connects into the Coburn on Park. Post-top, okay. Oh, so it's curbing good and you can consider the difference in the curve. And it's not. It's a so the way it was isn't inverted crown rowing. So there there is maybe some amount of detention but that hasn't been provided as far as the calculations. Is there a way to increase the size of the ditch and orb and around five to try to accommodate some of that? I believe the engineer tried to do that because one of the suggestions I have is, do as much as you can. I understand that this is coming in after the fact that you guys I've already had a proof flat. Let's try to get as much attention as you can. I don't think that he's up sizes, of the sounds, to provide that attention. I think there's other methods in granting, I understand that he's up sizes, up sizes like enough to provide that detention. I think there's other methods in granting, I understand that there's some methods that are not cost effective for the developer. However, I'm just telling them, hey, I understand that you can't meet the full detention based on how this plaque was approved. However, within the public right away, or within the private roads that, and drainage system that you're gonna have, I think you need a provider as much as you can, even if you can meet the full criteria. And ultimately that decision also comes from the Kima Master drainage plan, where Park Avenue, we saw that the ditches and the colds were undersized to me a two-year storm of it. So we don't want, we want to make sure that we're not discharging more into the public right away, which they're attempting to do by restricting the flow. However, I'm concerned about that overflow coming back, whether it exits into park Avenue or it stores within their yards and then someday in the future, they come and say, well, why did you approve these plans? So that's where I'm coming from. That's where I'm coming from. That's where I'm coming from. I just thought I'd come back and I'll show them. It seems like, well, I said, I would think that we'll probably owe the neighbors to be able to do this correctly so they don't put out your neighbors. Is there a comment? I'm like, it is, you might be looking at them, I'm going to go back to the drawing board and level wrap this up. opportunity that increases digit size, opportunity that increases the pipe and the quargerant unity improves the digits around it so that it will accommodate that. And I think that there is an opportunity for increasing the power size or running a door triple barrel system under the HDPE pipe or something but like I said I don't think that they've back some of my subspace that they have. I don't know why that's got additional cost, but it's almost great. But you also know how to get the cost of using the land with the pension money, and that's the value. That's correct. And I think the ditches are built out as much as they can build them out. Now, that doesn't mean that they can't deepen them, but I do feel that probably they try to deepen as much as possible. Because I did work with the engineer and I commented on his plans. He came back with the plan and I gave him a different option. I told him, well you can use our .65 acre feet per acre which is our standard rate or you have the Galveston drainage criteria that has another methodology for you to calculate the tension. If you can do it that way and it works then I'm okay with that. And he tried that however the calculations are very correct. I sent. And after that, I think it was more of, okay, well, I know that they're having a hard time getting it. And I understand that. That's why I told them, maybe you don't need fully and we can work with you on that. However, I do think that you need to provide more. I also like that we always ask lost to be caught by just some of the others. They were clearly the houses that got to lost. All those aid others approved, just saying, get your claim that the city team of the approved is prospered. I can't get on other than that. But the problem is, your permitties will be only good for a year. So again, this is not uncommon where it is. So it sound like maybe you were possibly best if you came in and had your plans approved and you were given consideration to continue approvals under what you originally submitted. So that's not uncommon. So you got the permit. But the permit's only good for so long. And so this is actually, we run into this situation also where we have developments that don't happen. They're approved, they're permitted. and then if they don't happen, then they come back in, and we have to go back to the reprimary process if the standards are... So what would cause you to make your plus loss to not be able to hold that water? And I know he has rules where the drainage might be through a month's end. But I don't think he's changed. Well, the standards, Galveston County, it's not just city of Kema, it's Galveston. We have, so I and I have changed our frustration, but every time we have an event, everybody's flooding it and they get upset that there's water coming into the, like, off the street, into the homes. I understand it's an acre, but I mean, I would rely on our eighth engineers expertise that we really need to try to accommodate the capacity within the existing system. I mean, so it sounds like you're not, there's not, we're trying to help you not requiring, if allowing you to detain not an upon, but within the ditches. We have done everything physically possible and you know, thrown a lot of personal money at this, just because our life is a side of itself because we've been trying to reflect this in summer. I don't know if our current experience in summer, tell that. But, um, guess what, you know, Shell Art has been working with Isaac. They've been working very hard to tell that. But between four or five lots, definitely on a flow perspective, it's not going to be that huge of a difference. But there is, I mean, yeah, it's on that technique. It was a good one. I think you can. Can that be addressed at the time of individual permitting, meaning limiting the size of whatever's constructed at that time? I think at that point it'd be more difficult, because from a residential standpoint, you're not gonna ask a homeowner to put a decent sized storm sewer system in order to, I don't wanna say mitigate the flow, but to convey the flow into the main system because what their plan is is to put swells around the properties which would be typical and then discharge that flow into the ditch, main ditch that they're designed or have designed. I've went to the new town, and I think the way that they're my opinion is to try to get the capacity as much as you can on those pipes and that the edge of it. Like you said, get close to it. You can do less than that number if you limited the size because you're saying they're built smaller houses. Yeah Yeah, I was talking about size houses. I mean, if they put it in there, and they're covenants, you can only build a certain specific house that's that health in. I mean, it would, if they're building something smaller, because now you have a smaller footprint. So it's nice. We have more ground for the barren to, to the whole building smaller houses. And you actually put something in restriction to say You can only build a house up to some expert fee because that helps us. I mean, I'm just going to be for a save bill. Yeah, but his is going to be full of stuff. But you know, all the lives of such a stuff. Yeah, but that should also be true. Yeah, and I think that's where the suggestion came in. that can do like permeable surfaces, using pavers and gravel and set concrete. It triples the amount of infrastructure and that's after putting in a concrete drive, all the water, all the sewer. And it's everybody about the plots based off of crew planes. And essentially what they're requesting is an additional parking space associated with the proposed meeting room, which the meeting room is we know many times in hotels like this is not often used and definitely not during full capacity not by those from outside. But the nature of the meeting rooms intended use its limited occupancy and the overall parking capacity that we're already requiring for them to have on site is a reason why they're requesting this variance They're they feel that it's more of sufficient to accommodate the entire demand without impacting surrounding properties or any public infrastructure They hope to still keep compliance with the city's goals of Efficient land use they've come forward with this again. This is home to it's for that space and I don't know exactly what they're using it for but if I had to guess I'd say for breakfast or for whatever the space would be, it's not a large space requiring those 20 parking spots. It's a standard conference room. I think 20 people, I think, that what it looks. I think. Yeah, that's about 80 people. Well, I think it seats 20 comfortably. You pipe at 25 25 in there. But in talking to the landowner or the developer, he stated that 90% of the times that the meeting rooms being used, especially in a property like this being a little bit off-site, it's going to be people that are staying at the hotel, they own multiple hotels across the state of Texas. They run the same business model and other places very successful. They know when they're going to be a full capacity and not to run out the meeting ring, because they're going to be sitting next to the sewer plants and they're not going to have any place to push them to other than 146 or something like that. This was a grant application we submitted. They requested for some language to be changed on the actual resolution. Lieutenant Rees has been leading this particular grant application.
