For each case I will hear testimony from the property owners and the city's code compliance department about whether a property that was previously found to be in violation of the city code has been brought into compliance. This issue is not whether the property was in violation, but code enforcement board made that decision at an earlier hearing. The issue today will be whether the violations have been corrected. And if not, I especially magistrate would then consider whether a fine or a lien should be imposed on the property. I will your testimony from the city's code's compliance assistance department, even if a property owner who has received notice of this hearing fails to appear in any property owner who arrives late or after his or her case has been called by me, will no longer have a right to be heard. The hearing will be conducted as follows. The city will present its case first. After each witness has testified, the property owner may cross examine or ask questions, but always directed through me. When the city has presented all of its case, the property owner may present his or her case. An attorney or some other representative may represent you and you can submit evidence or present evidence in your defense or through witness testimony or testimony on your own behalf. If you present photographs or written documents as evidence, they must be submitted to the recording secretary seated before me and placed in the permanent case file. The city will also be able to cross examine you or your witnesses. I may ask questions of the witnesses on either side at any time. Based upon the evidence and the testimony presented, I will decide whether the violation or violations have been corrected. If a violation has not been corrected, or was corrected after the deadline for compliance, I may impose a fine or certify a lien on the property based on the original findings and orders of the code enforcement board. Board, I may defer such action for a specific amount of time. An additional fine and lien may be imposed at a later date if the property is still not brought into compliance. The case will be brought to a future monthly special magistrate meeting for consideration and further certification. If Alenis imposed upon your property, a copy of the order imposing the lien will be handed to you before you leave this meeting. It is the only written record you will receive of my decision. From approval to the time that they issue it, is four or five days. So they're telling me that's gonna be done, but that's the temporary shoring permit. Again, I met with the engineer on site Friday. It's sort of the same time frame, same cost. In this one, it's a little bit different because we've got litigation filed with the insurance company. The owner would really like to restore the balcony that he has. But due to the cost, he's filed an insurance claim. Insurance claim was denied. Case was filed and the cases on the litigation track right now, they just received the responses from citizens. So at this point in time, we're probably in a 30 day before it ever gets scheduled for trial. However, we're working to get the permit issued. But as far back as July 12, I've got emails between city staff is from Shelley Thomas to Beatrice Zavra. I do not think the Airbnb link on the spreadsheet is for the right property. It does not match the Marley's link or the VRBO link. The only similarity is the bathroom. We've got a response to that email that says the photos in this case are for the wrong Airbnb. The Airbnb link is for property at 4101, 6th Avenue South. The VRBO link is correct for this address, so please use that. And again, the pictures that were submitted to the city for purposes of establishing the short-term rentals, all reference a property hosted by Sarah, and I'm going to assume it's the 4101 6th Avenue South. But this is straight from city's public records. And the request was made day before yesterday. These all came over, hosted by Sarah, hosted by Sarah, the comments that reference it. My friends and I spent a night at Sarah's place and we were greatly enthused with it. But these all reference a separate property. And so I think that the initial findings were based upon a property other than the subject property. Now the subject property was used for purposes of rentals. It was at the beginning of this suit used for short term rentals. They were made aware of it. They canceled their short-terms and we have got- Five times I sent my cancellations. Correct. The cancellations, proof of cancellation, were sent directly from VRBO from the other websites that were used in order to post and list the property. Those have all been sent over to the city. The city as of yesterday, I've got an email from Margie Nichols. Thank you. We're in receipt of the cancellations you have supplied. They are sufficient to cover the proof of cancellation requirements that were needed. Now there's no admission that the dates that they were looking for prior there too were connected to this 41.01 sixth avenue south But apparently the the cancellations are sufficient to support that they have been Taking care of but there is reference to the Airbnb site is still advertising a two-night minimum stay The case will continue to move forward until this is cleared or corrected There is no air B& Airbnb site that allows for it. It's not on common on a day-to-day basis for us to, in error, load the wrong picture from the wrong property into the wrong case. However, we're not at that point going to then alter a public record by deleting them out, so they made in the case we're not trying to hide anything here. I believe if I can ask the property owners, the evidence that was presented when you were here for the code of force and board hearing was evidence for your property correct and not the property that was referenced by your attorney. I think we did not believe so after we're doing all these documents with this property, we don't need to do that. As of yesterday. I would speak, come up to the mic. As of yesterday, I was still being asked for dates on my Airbnb. They were one night bookings. I don't do one night bookings. You've clearly said that. I did not see any pictures other than what I have on these units. And that's where we requested them. And within the packet there is evidence from your property with advertisements, future bookings that were not associated with the other link that were loaded up in the first time, correct. As far as I can tell, there was no, you know, we did not have any listings. What you did call out, we did contact our guests and they were canceled and there were, the rentals never happened. So as of yesterday you did not have a two-night minimum where your property could have potentially been booked so essentially advertising if I was to go on Airbnb looking for a three-night stay within St. Petersburg your property would have come up correct. If you advertise okay so it would come, correct. So that's an advertisement of a rental for less than a monthly term after you've already had you are three within a 365 day period. Yeah, it is and I believe we've expressed that multiple times in our communication beyond the fact that there is future bookings that we need to cancelations for that the property was still actively advertised for less than a monthly term, thus being in violation, also being available for somebody to book, contingent on you not allowing that to happen, which in our experience with multiple property owners utilizing these platforms, they don't always not allow those bookings to occur. I guess I want to go back to that because I know Marley Price has chimed in on this and I think it's her or it's you that's saying They want her to say their compliant all day laugh out loud.
