She cleared our property that another hurricane comes through and destroyed my shed that I had. It has all been cleaned up. I was told I have a new appraisal for my property and I was waiting for that to come in before I could do anything so that I got to appraisal. Then I went and filed for a new application for Permanent and on that application it said it was dated till September the 9th and I kept calling back every month during the summer like I was told to while I was getting soar during stuff and they told me I'm going to stop you right there. I'm going to stop you right there. This is all going to the original violation. What we're here for is that it's still in violation. So I'm going to issue the fine and you can go to the building department and check with them and see what the status is. What they told me all I needed was an engineer to draw as built drawings and sign off on it. I did that. Well, I'm going to, I'm, this is not the place to discuss that. Do you have any questions for the officer? I misunderstood on the last year. I thought that was done already. And so, but this year, I helped a veteran to get into one of the room. He was very sick. And I had to get rid of the things in the room so he can get in it. So he helped me out to get him out. And so that's why when she came there in February, the things was in there. But I didn't realize that I was violating. So I apologize for that, and I cleaned up. I cleaned up so much that I called her. I'm going to. She's going to know and I cleaned them all up. I don't know if this is relevant. Yeah, and so at the time of the inspection it was still in violation. If it's cleaned up when she does her next inspection then it'll be fine. Finding violations of outside storage, creating junk like addition and prohibit use of the property have returned. This case is being taken directly to hearing as a recurrent offender. There was a previous case for the same violations. Previous code case number COD-01651 was opened on July 11th of 2024 for same violations. And scheduled for the September 2024 NOV hearing was dismissed prior to hearing on August 11th, 2024. And also this is rental property. During the investigation took photographs of property. I'd like to offer the photographs and evidence as county composite, exhibit number one. They'll be accepted. The notice violation was served by certified mail in accordance with Florida statute 162. I have had communication with the owner regarding this case. March 26th of 2025, I conducted the final inspection of the property. Find the violations have cleared. However, I'm requesting the deceased and the sister to be imposed due to the recurring violations. This is the end of my testimony. Do you have any questions for the officer? So what they're doing, what the county is requesting of me today is to say it's cleared, but we're going to issue an order that says for the next two years, don't do it again, or you'll be subject to a fine if they find a problem re-exit exists again okay so therefore a little explanation here okay the daughter can't be here she's they all right they moved to Florida to start a new her inter-husband and the three kids and ended they decided to separate, move back to South Dakota to be close to family during divorce. They tried to sell the house, it was on the market for five to six months, not sure she says, but no interest in the property at that time, even reduced the price of the house, still nothing. We ended up renting it to Flavio instead. I got the house and the divorce and we would like to sell it, but the market is not right now. There's a lot of houses. I got the gist of it. It was a renter that was in there and caused the problem. Yeah, and she's has him in check now, she thinks. And we have people driving by and sending her pictures. And at this time where she didn't respond to some of these, was because the mail wasn't either forwarded or it was sent to the property and he threw it away, but she would have been on it right away. Okay, well we appreciate that it's cleaned up now and we just want to keep it that way. So I'm going to issue the order that you're found in violation of the cited code section 15 days from the order to bring the property into compliance, but it already is in compliance. Thereafter you would be issued a fine of $100 per day for each day the violation continues and the issuance of a two-year cease and desist for repeat zoning violations and abatement in the event of noncompliance with cost of abatements to be added to the fines and costs. International property maintenance code violations of broken windows, holes in the walls, missing outside electrical fixtures, missing soft, rear shed is collapsed and the fence is not being maintained. During the investigation I took photographs of the property or liked to offer the photographs into Missing SOFIT, rear shed is collapsed, and the fence is not being maintained. So any previous correspondence that was sent to him was going to this address, which of course is not receiving mail. So he was not aware that he was for sure aware of the issues that have been going on with the house, but not that the county was involved with the code violation issues. We've been trying to sell that house and it's as is condition which has not been very successful right now. And, you know, his not being aware of the problem is why, or aware of the county's involvement is why he hasn't really done anything to make any improvements to the property. It has definitely had some issues over the past three hurricanes. The first one, not so bad, the last two hurricanes were definitely a little more destructive to the house. But he is now aware that the county is involved, but still there's quite a bit of work to do. because of his recent knowledge of the county's involvement would just request a little more time than average to try to fix the multiple violations that the county's saying are there and which are there. What I've found with county is if they see substantial improvements over the period of time that you're given they'll probably work with you but I'm going to issue an order that you are found in violation or the owner is found in violation given 30 days from the date of the order to bring the property into compliance or there after be fined $50 a day for each violation that continues to exist. Also issue a two year cease and to cease order for repeat violations and abatement in the event of non-compliment with cost and abatement to be added to the fines and costs in the future. Like I said, if they see substantial improvement in the next 30 days, I'm sure they'll work with you, but the order will give them 30 days to bring in property into compliance.
