Item 11 we have one public hearing this evening. Item 11.1 resolution of the City Council the City of Enriville granting a waiver for the noise ordinance to resources for a presentation on this item. Madam mayor, if you'd like a presentation, and if I may introduce to you, Alyssa Chong or assistant planner, she's not had the opportunity to present to the city council. So I thought an introduction was in order. She hasn't been presenting to you in the past. I think it's a good idea to present to you. I think it not sure if she's going to be able to do that. She's not had the opportunity to present to the city council. So I thought an introduction was in order. She hasn't been presenting to you. In the past, she does a ton of work for us. Great work and is a super valuable member of our staff. I just wanted to acknowledge her. Wonderful. So no, no official. Oh, please come and present. All right. Good evening, Mayor Welch and members of the council. I'm presenting to you today with a noise waiver request for a Saturday work to complete the affordable housing project at 3,600 San Pablo Avenue, otherwise known as Mellie Hannon. Next slide. It's for a little background in October 2020, planning staff approved a 90 unit affordable housing development with commercial space for the Emeryville Citizens Assistance Program at 3600 San Pablo. Resources for community development is the developer for this. J.F. Fitzmurice is the general contractor and the city has been a significant financial partner on this project, providing over $17 million in loan financing. The contract completion date for the project is on May 30th of 2025. Next slide. All right. So this is the location of the work. It is a single parcel located between 36th and 37th street, Frontine, San Pablo, Avenue, slide. And then this is just a closer view of it from a different orientation. San Pablo, Avenue, is to the south. And then this is just a closer view of it from a different orientation. Sam Pablo Avenue is to the south, so you can see a little more closely the building footprint and sidewalk improvements associated with the project. Next slide. So the noise waiver request is for Saturday work from September 7th to May of 2024 this month to May to May 31st of 2025, from the hours of 8 to 5 p.m. Work is not anticipated to occur every Saturday, but at its peak it may occur up to three Saturdays per month. Work will require hand tools and occasional use of mixers for a mix of interior work, including drywall, taping, texturing, painting and installing trim and exterior work, including lathene, stucco, painting, waterproofing and paper installation. None of the proposed scope of work for Saturdays will include public facing work, sidewalk improvements or deliveries to the site that would occur on public property. Next slide. So the exterior improvements that would occur on the site would be located in this courtyard. This is an interior courtyard that starts on the first residential level on top of the commercial and parking podium. It is located on the interior of the site, so it does not have any visibility from public frontages. However, it is adjacent to existing residential uses, as you can see in that second photo. Next slide. Depending on the scope of work for each Saturday, work is going to be occurring, there will be between five to 25 workers onsite. Parking will be provided off street in the projects existing or the projects garage or in 13 reserved spaces at a street of vista apartments across the street on 37. Next slide. the area of the city. So the reason for this request is there have been unforeseen delays related to the time lining for framing and exterior work on some of the 37th street units. Per OSHA safety standards, certain exterior work on some of those units cannot occur until the existing PG&E power lines are relocated at least 10 feet away from scaffolding. So the reason for this request is there have been unforeseen delays exterior work on some of those units cannot occur until the existing PG&E power lines are relocated at least 10 feet away from scaffolding. So PG&E will be responsible for the relocation of these power lines. The date of this relocation in this work is not currently known. So the exact length of delay and its impact on the project's timeline are unknown. So the intent of the Saturday work is to prioritize key scopes of work that will impact the overall schedule, minimizing delays and making it so that the project can meet the contract completion date or potentially be constructed faster. Next slide. the project is a project that is a project that is constructed faster. Next slide. And here is a photo just showing those power lines on 37th street relative to the face of the project. Next slide. According to the noise ordinance, staff has mailed notifications to property owners and site addresses within 300 feet of the project area. We have also included a legal advertisement in the Oakland Tribune. Next slide. Staff believes that the request for Saturday work is reasonable because the proposed scope of work will not generate executive noise and will help ex-devit, ex-budy development of critical affordable housing, as well as this commercial place for one of our local nonprofits. We also note that the work will not be occurring every Saturday, but it is necessary for the exact dates to be flexible for the type of construction needed. Next slide. We have made some recommendations included in the conditions of approval, considering that some of the work may take place in the exterior and adjacent to residential uses. We are recommending a start time of 9 a.m. instead of 8 a.m. as requested. We are also requesting that the general contractor perform public notice scene at least 10 days in advance of any Saturday when work will occur. And we are prohibiting Saturday work on the weekends of Thanksgiving and Memorial Day. Thanks, slide. So we do recommend approval of this noise waiver subject to the conditions of approval outlined in the resolution. I do have the applicant and project team available for any questions. Hi. Moving on to action items. Item 12.1 California Public Employees Retirement System. Contract amendment. Mr. Kennedy, welcome back. Thank you mayor Welch. Good evening council members. So for these two items staff is recommending that the City Council adopt the attached resolution of intention to approve an amendment to the contract between the California Public Employees Retirement System and the City Council of the City of Emeryville and introduce and waive first reading of the ordinance which was included in the packet, which approves an amendment to the contract between purERS and the City of Emeryville to provide a merger of the Mesa PERS contract into the City of Emeryville's PERS contract. By way of background on September 1st, 1999, Mesa entered into a contract with PERS to provide employees of Mesa with retirement benefits through PERS in accordance with the public employee's retirement law. PERS issued a determination letter finding a former city manager was a common law employee of the city for purposes of that retirement law and not a common law employee of Mesa and that this employee needed to be retroactively enrolled in PERS under the city's contract. After an appeal of that determination was filed, a settlement agreement was entered into requiring that Mesa's PERS contract be merged into the city's PERS contract so that all current and former individuals enrolled in the Mesa contract are enrolled in the city's purge contract so that all current and former individuals enrolled in the Mesa contract are enrolled in the city's purge contract. In order to implement the contract amendment, the city must first amend its current contract with purge by an ordinance approved by the city council. Prior to adopting the ordinance, the city council must first adopt a resolution of intention indicating its intent to approve a contract amendment. Pursuant to a government code section, there must be a 20-day period between the adoption of the resolution of intention and the final adoption of the ordinance. As a result, if the first reading is approved, the final adoption of the ordinance will be scheduled for the October 1st, 2024 City Council meeting and the ordinance will go into effect on October 31st, 2024. The resolution of intention requires the signature of the presiding officer, the mayor of the City Council, the City of Emeryville and the date that it was adopted. In addition to providing a copy of the resolution of intention, the city must also provide two additional certifications to purses. As a condition of the settlement agreement, the merger process requires the city council to approve the amendment. And after the contract amendment process and merger have been completed, purses will dissolve maces's PERS plan within 30 days. I can answer any questions that you may have. I'm 12.2 resolution of the City Council the City of Emergo authorizing the acquisition of 12.45 power street appropriating $1.7 million from the Park Impact Feed Fund to the budget for the capital improvement project for fiscal year 24, 25 for that position of 1245 Powell Street and the associated closing costs. Hi, Chad. Hello. Are you good evening, Chad Smalley Community Development Director here to give me great pleasure actually to present this item to you this evening for the potential acquisition of 1245 Powell Street. Next slide please. So 1245 Powell Street is the property occupied currently by Boyd's Autobotty. You see it here on the slide aerial with Powell Street at the top. And a bowdry in the Leo streets on either side of this piece of property. Next slide please. And again, this is this is a street view of Boyd's Autobot. And what makes this property unique, we can go to the next slide please, is that it's adjacent to a park. It's 12,800 square foot, the property is, and it's improved with an auto repair shop of about 3200 square feet adjacent to the park, as I mentioned, and it's owned mixed use with residential. Next slide. Our parks and recreation and strategic plan in acknowledging that this property is right next to a well-loved park actually calls out for us to monitor the north half of the block bounded by Powell, O'Leah, Bodrian Stanford, avenues for opportunity to purchase this property adjacent to the existing park with the interest of expanding the community. We have a little bit of a little bit of a little bit of a little bit of a little bit of a little bit of a little bit of a little bit of a little bit of a year we executed a purchase agreement for 2.1 million with a due diligence period commencing in March and then extending through September 11th of this year. The outside closed date in that agreement was October 23rd and on April 2nd this City Council approved a contract amendment with our environmental consultant, vice associates to complete investigations relating to our due diligence. On June of this year, those investigations were complete and we did find that there were some petroleum high carbon contamination at the site from the site's prior use as a service station. Next slide, please. So on June 27th, we took it to the Planning Commission who made the finding of general plan consistency is required by the government code when the city acquires properties. And on August 6th in 2024 we amended that purchase agreement with the seller in light of what we found during the environmental investigations reducing the purchase price to $1.7 million and extending the outside closed date to January 15th of next year to allow the owner time to wind down his business affairs at the site. Next slide please. So for funding this, the purchase price of $1.7 million and there's some nominal closing costs estimated currently at $6,000. We proposed to fund that through fund 237. That's the park impact fee. Those are fees that are paid by developers when they build new projects specifically for expanding and improving parks. The current balance in that fund is approximately $1.8. That's $5 million, which is sufficient to fund the purchase of the property. As far as remediation costs, those are as yet unknown. While we know there's contamination at the site, there needs to be much more work done in terms of characterizing the site to really put a firm handle on what it's gonna cost to clean these up, but it's potentially between $400,000.00. Fortunately, we also have fund 247, which is our brown field EPA grant fund. These are revolving loan funds provided by the federal government that have been loaned and paid back to us, are subject to a close-out agreement, and there's currently 1.8 million in uncommitted funds in that fund that would be available to support the cleanup costs. Next slide, please. And so staff's recommendation today is to adopt a resolution to authorize the acquisition of this property. Appropriate those funds for the $1,706,000 from the park impact fee to the fiscal 25 budget for the CIP project, URG01, which is a general basket of parks projects. Authorize the city manager to execute all the documents necessary for us to acquire that property. If you choose to do so, the next steps would be the closing date as I mentioned is in mid January at which point we would take title to the property We will start environmental investigations and reports and all that regulatory process estimated to take about a year to get the cleanup figured out And during that time we can start on designing the park expansion Which will require use permit design review from the planning commission and then ultimately of course will be back here before you That concludes my presentation. In Cheney 18, 70% of the annual water approved emergency offer a city to use 50 million general obligation bond for affordable housing. Then in March 2021, the city council adopted the affordable housing bond administration and expenditure plan that guide the emergency affordable housing bond proceed. And in April last year, the City Council adopted a resolution approving the sale of the general obligation bond. Next night, please. Well, we first take a look at the definition on the secure public test and unsecure public test. Secure public test include land and building, and unsecure public test may include, air-prened office furniture and machinery. Next slide, please. Now, we look at the emergency test rate statement in the ballot merger. At that time, we estimated the highest test rate will be $63 and $35 per $100,000 of assess variation. And the average annual test rate is around $49 per $100,000 of AV. And based on the public test information from the Alameda County assessor offers the FY25 public test navi is projected at $43.66 per $100,000 of AV, which is lower than the average test rate in the ballot measure. Next slide, please. Based on the Alameda County methodology, the prior year's secure test rate becomes the current year's unsecure test rate. So the FY25 unsecure test rate is $59.82 per $100,000 of AB. Next, Nye, please. Now, we look at the depth surface payment schedule of the emergency. The depth surface payment for Chinese 25 is 3.5 million. Next night, please. And staff recommended the City Council to adopt a resolution approving the FY25 POP-D test-nevy rate of $43.66 per $100,000 in assess variation for the secure and utility test road. And $59.82 per $100,000 in assess variation for the unsecured test road. This is for the emergency channel obligation bond series 2003. And this concludes my presentation. Not only is it delivering on its promise to provide a housing to people who are living with challenges, marginalized, disenfranchisers are unable to afford places here in the Bay area, but it's actually performing better than what we had in the tax rate so the $43 value is below the $49 per 100 and I'm that we had in the ballot measure which just goes to show that you can build a livable community and also provide affordable housing at the same time if you put your values in your budget. I don't know if people realize just how difficult it has been for many municipalities to build affordable housing since redevelopment was dissolved. And this is a testament to the city of Emoryville being an inclusive welcoming community. It is honestly unheard of that ballot measures bonds get passed at that high of a threshold. You see municipalities all over the region struggling just to pass affordable housing bonds transportation, infrastructure bonds, and so I think that is a great testament to our city and its values that something like this was not just passed but past at such a high threshold and We have a motion and a second on the floor madam clerk the role please council member bouders. I am 12.5 resolution of the City Council of the City of Imriville adopting the amended expenditure and reserve policies for measure F funds. So I do have a short pop-up on presentation. We first look at the background of the merger F in 2020. 74.5% of AMA will be approved to merger F, increasing the sales test by 0.25% with revenue for police, fire, childcare service, and also fund one co-enforcement officer and one engineer position. And in 2023, the City Council amend the merger F-RECIRC policy and establish a target reserve of four million for the M-Wheel Child Development Standard ECDC in the event of any economic uncertainty. Next slide please. The Budget and Governance Committee met in April and August and discussed amending the merger after reserve policy and assign the remaining fund balance to public safety. Next slide, please. And staff recommend the merger after reserve fund in excess of four million set aside for ECDC, be reserved for additional public safety positions, where 50% for additional policies are positioned and public safety support positioned, and 50% for additional five fighter positions, and this concludes my presentation. All five members of the Commission were present. We have two vacancies that you just filled this evening. The Commission elected Jordan Wax as Chair and Rod Hemi as Vice Chair on a unanimous vote. Commission unanimously with one recusal approved a major conditional use permit allowing for the temporary use of 4,300 San Pavela Avenue as transitional housing known as the Stair Center to be operated by Bay Area Community Services. The license agreement for the use of this space was also approved by this council this evening as part of the consent calendar tonight. The commission unanimously approved a resolution recommending the city council approve amendments to the planning regulations regarding accessory dwelling units in order to conform those requirements to state law. This was the second time the commission had heard these changes and you'll recall that we had requested a continuing such your last meeting, or July, teeth meeting, to respond to a public comment that we received just before the meeting, staff's response to that comment resulted in changes to the proposed ordinance that necessitated planning commission re-review and that revised ordinance will be brought back to the city council on September 17th. Finally, the commission held a study session on a master sign program for the Pell Street Plaza Shopping Center and provided comments to the applicant. This concludes my report. Whereas the city of in Rio recognize the profound benefits, healthy food plays in fostering physical and mental well-being, and whereas National Food is Medicine Day was created in July, 2021 by Food Equity Initiative and Free From Market to raise awareness of embedded barriers to healthy food access for under-resourced families and individuals, and whereas these barriers exacerbate chronic disease, increase mental health challenges and drive up medical costs, and whereas national food is medicine day calls for a private enterprise, government agencies, and nonprofit organizations to join together to overcome these barriers that are leading cause of death in the United States, and whereas the city acknowledges Assemblymember Mia Bonta for introducing legislation aimed at improving health outcomes and reducing health care spending by transitioning medically supportive food and nutrition interventions to permanent benefits under MediCal and whereas National Food is Medicine Day highlights that access to and education about healthy food for families and individuals who reduced chronic disease, mental health challenges and medical costs. And now they're for be resolved by the City Council of the City of Inverville. That September 14, 2024 is hereby proclaimed as National Foodism Medicine Day and the City calls upon schools, businesses, community organizations, and individuals to join in raising awareness of the barriers of under-resourced families and individuals so healthy food by promoting foodism medicine day. And we have one last proclamation this evening. And it's the proclamation of the City Council, the City of Irmryville honoring Paul Boonehagen for his service to the city as city manager. I didn't call you up. You could have stayed in your seat. I stayed for a minute. Whereas Paul Boonehagen has been the Irmryville City Manager since January 2023, a short but impactful stand with the city, and whereas Paul came from the city of Berkeley, to which we return him only slightly scathed. Whereas Paul will be remembered for his leadership and guidance, particularly navigating the complex IRS, social security, and purse changes, steering the city and staff towards practical solutions, and whereas Paul helped oversee the completion dedication of Oucing Park and the Inveriveville Greenway, and whereas Paul helped bring the quiet zone project for livability and safety to finality, and whereas Paul modeled the city's active transportation values, there was own personal life choices. And whereas Paul maintained an optimistic outlook, encouraging constructive feedback and celebrating achievements both big and small. And whereas Paul inspired growth and staff through continuous learning and embracing innovation with enthusiasm and open mindedness. And whereas Paul was instrumental in changing the coffee vendor for the Civic Center, resulting in superior coffee at a lower cost for staff. And whereas Paul maintained an adequate stock of jelly beans in his office for council management meetings and whereas Paul led by example, being a donkey in the dunk tank at the Harvest Festival. And whereas Paul is a professional public sector employee, dedicated, hardworking, but with a great sense of humor, a good listener, strategic, and always support of a staff, he will be greatly missed. And even though we do not fully understand why he wants to re-subject himself to 10-hour public meetings at Berkeley, all shade. And whereas Paul provided a positive attitude and can do approach to leadership while in the office of the city manager. And now therefore be resolved by the city council of the city of Imreville that Paul Zunoggen is honored and appreciated for his service to the city of Imreville as city manager, proclaimed by the mayor of the city council of the city of Imreville at a regular meeting held Tuesday, September 3rd, 2024. Oh, that was funny. Good work. Good work. I won't, it's been a long meeting so I won't, I won't keep you too much longer but I do want to say again thank you all. Council for your leadership, for your vision, or your support, or really thinking about how to make Henryville a place where everyone can thrive, no matter who they are, no matter what they look like, no matter how they get around the city, whether they come here for work or whether they live here every day, the things that you've done to quiet the railroads and create bike lanes and have beautifully paved streets and wonderful parks and build housing for people to come and enjoy it are something for other cities to follow as an example. And that is because of your leadership on the policy side is because of the incredible work that staff has done to bring all this stuff to life. And I'm deeply grateful to you, staff, for your hard work, for your taking the vision of the City Council and their policy direction and making it into the things that we all enjoy here. For your friendship, for your humor, for your kindness, that is a high value of mine, and it is something that is present. I see every day in every bill. It's something that makes us like want to come here and be to do it together. And I'm grateful for you all for sharing that with me. It was my honor to share it with you. I will miss you all Thursday is my last day, but I will only be one city over. I'll be there till midnight. I'm going to text call. But if there's anything that I can do to be supportive, I absolutely look forward to doing that. I will keep an eye on every bill. I still live in 9468. And I will for the first cerebral future and I will come to events and see you there. I wish you nothing but the greatest success. I cannot wait to see the new park at 1245, Powell Street. Each city manager that we've had has brought a different approach to running the city and leading the staff and has had different skills and strengths. And I think one of the most foundational and educational components I've had as an experience on the council over these years has been just seeing how many different ways there are to do this job effectively. that the city managers did for which I celebrated and thank them. And I think for you, it is your positive attitude, your ability and willingness to bring people together, your commitment to living joyfully and your sense of humor. And those are really important things, especially coming out of an era like COVID, dealing with challenges in the economy and the national political discourse, and sometimes even the political discourse in not too far away cities. And I think that you have in my experience, artfully managed that in a way that I wish to be to see replicated when I think deserves commendation. So thank you for your service, not just to our city, but to all the people you've served across the different roles you've had over the years. I'm very grateful for your service here. I'll be as short as it is. I know you're not far away and I know that people in these bear better for you being in public service. So thank you. Members, anyone else? I have appreciated your steady hand, your guidance and patience with me as a relatively newer council member. And I will greatly miss your thoughtful and informative weekly updates. I'm sad we're losing you, but I'm heartened knowing that you are not going far, and we will likely benefit from your expertise serving our neighbor to the north. Anyone else? Member, perforce? I remember a time when I didn't always think you were hostile, that we have had a really good rapport and working relationship and friendship and then I mean there was a moment when I was left to set and and I remember sharing that with you and and I could tell in that process that you were upset. And I remember the subsequent conversations after that it felt like you and I were all in that path of repair and that that's something that happens in any work or family environment or even a relationship. It's not the conflict. It's whether you can repair. And we did that. And our work and relationship, our friendship was stronger than ever, because I knew that I could share. And I guess you knew that you could share. And that could create a bond. And I hope that in any possible conflicts that you might come across in your new kind of new post that spirit of repair that you'll have with your colleagues, whether it be staff, whether it be council members or mayors, that that spirit repair you carry with you because it's like that spiral thing horn, I guess that's on a unicorn. And that's exactly what you are. You're a flying Pegasus unicorn, this creature, magical creature, that any city is lucky to have as a city manager and beyond. Well, I will just like to say that I was always so happy when I would go many different places, a lot of times out of town, and meet people. And they would ask who I was and I oh I'm you know at that at some point in time was the vice mayor and then mayor and you know in public service in Imriville and people would light up and say oh Paul's your city manager like he's so awesome. You have such an amazing reputation just for being inspiring. I've never heard anyone tell me that they disliked working with you. Even if it was you all had to go through some challenges together or there might have been things like conflict, but the overall message was that you were someone that inspired other people to be great and people learned so much from you and I think that is the true representation of a leader is someone that is inspiring that people feel like they can learn from. And you've, you said, I've came into this role with so much grace. I feel like you are so much a part of that. You've helped me transition into this role with grace, with support. I know I could always depend on you. We've had many phone calls, many where I was yelling about all types of different things. And you've been able to talk me down from the edge, but it's just really a testament to your character and your impact here in the Bay area that so many people just look to you as a leader in public service and public administration. And so I am happy for you for this new opportunity. I wish you the absolute best. I know we'll always be in touch. You always have a home here. You can always come back. I just had to say that. But just thank you for giving us a piece of what makes Paul special, which is just your kindness, your thoughtfulness, your collaborative attitude, just in your willingness to just hop right in and just be a part of the solutions and here in Imriville we always talk about finding a way to yes you've helped us find so many different ways to yes and yeah your impact will be felt for much longer than you were here believe that so thank you so much for just coming and spending just a little bit of time with us.
