We will move to the first item under new business, which is VA2426 request for variances from Article 3, Section 21-36.03C to allow for proper storage to exceed height of the privacy wall and from Article 20 to allow for a yellow building and white missionary wall color at all floor to plumbing located at 1 1 0 3 South Ridge would happen. And we have a staff report please. Thank you Chairman. City staff sent out public notice within 500 feet of the subject property. The request before you is from Article 3, Section 21-3030, allow for outdoor storage to exceed the height of a privacy wall, and from Article 20 to allow for a yellow building and white maistron wall color at all Florida and plumbing. The proposed use is outdoor storage of plumbing equipment and yellow paint on the building at Ridgewood Corridor. The applicant is requesting the two variances for the business at Allfloor Deplumbing, located at 1103 South Ridgewood Avenue. The first variance is from Article 3 to allow for outdoor storage to exceed the height of the existing privacy fence. The outdoor storage of various plumbing equipment is currently screened behind an eight foot tall privacy wall. However, the equipment exceeds the height of said wall. The second request is for the variance from Article 20 of the Ridgewood Design Corridor. To allow for a predominant building color of yellow, the land development code states, excuse me, that the use of garish or gaudy colors is prohibited. Use of black, neon or fluorescent colors is prohibited as the predominant building color. City staff use Google Street View and went back on the requested dates and you can see the subject property how it's changed over time and today present day that is the building in the far right hand corner. So with all variances staff must review in accordance with article 9 section 21104D, non-administrative variance of the city of Edwatersland development code. We only have to make the six findings of fact. The applicant has explained that the hardship is that they have $25,000 in pipe racking and chlorine storage tank since 1995 that is visible above our newly installed wall that needs variance to be approved with along with our ten year old color of our commercial building. The first question is, will granting of the proposed variance result in a conflict with the comprehensive Plan. Staff's response is yes. The future land use policy 1.6.6 guidelines for State Road 442 and US 1-Cordors. The city shall continue to use of the Indian River Boulevard State Road 442-Cordor Design Regulations and the Ridgewood Avenue, Avenue Cordor Design Regulations adopted in 2012 as the guide to implement regulations for specific street scopes, landscaping and architectural design standards. This criterion has not been met. Will the granting of the proposed variance result in creating or continuing a use, which is not compatible with adjacent uses in the area? Applicants respond as yes, just trying to continue business since 1993. Staff's response is yes, granting the variance will result in creating or continuing a use, which is not compatible with adjacent uses. Other businesses along US one in the adjacent areas are complying with the Ritwood Court or regulations. This criterion has not been met. Is the proposed action, the minimum action available to permit reasonable use of the property applicants responses, nothing else else is necessary. It's not a response that the applicant couldn't meet the requirements by reducing the height of the storage rack. This criterion has not met. Are the physical characteristics of the subject site unique and not present on adjacent sites? The applicant's response is that nothing has changed since 1993. You could always see our materials in our backyard building color was the same before the new building. The subject property is conforming a lot, meeting the minimum lot size with and depth with adequate room for compliance storage. However, the uses are operating in a legal non-conforming manner. This criterion has not been met. Are the circumstances creating the need for the variance to result of actions by the applicant or actions proposed by the applicant? The applicant's response is that the variance is because of the neighbor that we can't make happy, probably never will. Staff's response, the business has had the same storage locations as far back as 2006 according to the aerial imagery. In addition, the building has had the same yellow primary color for at least the past 10 years. This criterion has been met. Well, the granting of the proposed variance caused substantial detriment to the public welfare or impair the purposes in 10 of the land development code. The applicant's response is that actually nothing will change. We have always tried to keep our business in top shape. Building color is the same as our business at 670 Nova Road. We have been selling chlorine since 1995 and nothing has changed. When we had a six foot chain link fence with white slats, you can see all my pipe racks. The new eight foot high concrete wall hides everything in the yard. We also have a buffer lot between our business and the East Side neighbor. Staff responses. Yes,, though granting the variance will not be detrimental to public welfare, it will impair the purposes intent of the land development code. Staff comments from the technical review committee, the environmental services department and the fire department were the only ones to respond for the request for comment and offered no comments and recommended approval of the requested variances. Staff does not recommend approval of VA 2426 because the applicant could not meet all six criteria of Article 9, section 211040. Thank you, sir. Chairman, the request before you is a condition used permit to allow for the distribution facility, warehouse and storage, wholesale and distribution and outdoor storage for the property at 11 to three south ridge would have it. Initially used permit to allow for the distribution facility warehouse and storage wholesale and distribution and outdoor storage for the property at 11 to 3 South Ridgewood Avenue city staff did send out public notice within 500 feet of the subject property. Within the B3 highway commercial zoning district outdoor storage distribution wholesale and distribution and warehousing and storage are conditional use permits, so they're not allowed by right. They do require those copies or that CUP. So the applicant is requesting a conditional use permit for outdoor storage for their business. The subject property is located east of US one and is known by all Florida plumbing. They have been using outdoor storage on the property since at least 1995. The conditional use permit will bring the business up to the current code. The applicants business tax receipt has identified that the business has the following uses. General retail and wholesale. The property does have a future land use designation of commercial and is in within the B3 highway commercial zoning district. Outdoor storage within B3 zoning district is a conditional use permit and must meet the requirements of Article 3, Section 21-6303, Outdoor Storage and Display Commercial in Industrial. Within that subsection there are 11 sections within Section 21-6303 for conditional use permits and found that the request is in compliance with the current requirements. staff has reviewed the subject property with the surrounding land uses and zoning districts and found compatible with the proposed uses in the adjacent area. staff did not receive any other comments from any other departments within the technical review committee. So according to Section 21-36-03, Outdoor Storage Display and Commercial Industrial, this requires that it be screened from view by a 6 foot high stockade fence or masonry wall. The subject property does have an 8 foot wall. In addition, this section indicates that Outdoor Storage and display may be permitted in conjunction with uses allowed in certain commercial and industrial districts. Outdoor storage or display should not be located adjacent to any residential district or use unless such storage or display is screened from view of the neighboring residential district or use. Again, the subject property does have an eight-foot wall And it is a significant improvement over the slatted chain link fence that existed in 2007. The land development code does not specify conditions for a conditional use permit for a distribution facility or wholesale with distribution. The applicant currently receives wholesale product deliveries at the subject property. I apologize, there's a lot of code sections. So section 213303 of conditional uses of Article 3 states the following, explaining how the table works in their compatibility with the future land use table in the zoning district. Within Article 9, the application procedures of the land development code, specifically Section 2192-04, the decision criteria that requires staff in the board to follow in order for a conditional use permit to be granted are the following. There's three items. Is it consistent with the land development regulations for the zoning district in which the property is located? Staff have found, I don't know, reiterate, go back to the different cup uses. Some of the uses don't have any regulations to them in the land development code. The ones that do outdoor storage, address. So is it consistent with the applicable land development regulations for the zoning district in which the property is located? Is it compatible with existing and proposed uses in the adjacent area? And does it meet concurrency management system requirements described in article 11? So he's asked did look at the prior building permits, the development, or the applicant has paid all his impact fees and all building permit fees. So he is satisfying the requirements of Article 11. So this is where it gets tricky. So the issue of compatibility has been always an issue between residential and commercial along US1 due to the narrow commercial properties they're with. The council must recently approved the modifications to Article V to allow commercial to residential building setbacks to decrease from 50 feet to 30 feet with the caveat of enhanced landscape buffers. I brought that change several months ago. Subject property and its use is operating as a commercial business with industrial undertones that require these conditional use permits Staff believe with modifications to the property and appropriate buffers shielding could be achieved for a vie for compatibility Again city staff did not receive any comments from any other members on the technical review committee city staff are recommending The boards recommended's recommended approval for CU-24-02. All floors been operating as a non-combooring business for nearly 35 years. In addition, we and our neighbors have witnessed a large expansion of this non-combooring business for the last 13 years without proper permitting. Now they're coming to you requesting variances which you've granted and conditional use permits after the fact which I seriously question whether or or not that is permitted. I can give you nearly two dozen codes that he is in violation of. It should never have been permitted to continue without these conditional use permits, and it never ever should have been allowed to expand. It expanded from what was originally listed as a retail plumbing, commercial and retail plumbing store to now a huge, that it has now a huge warehouse. You never had a warehouse before, you had a back storage room. Again, bottom line is written in the city's comprehensive plan, chapter three, protection of existing residential neighborhoods and the existing quality of life. In addition to these codes, the operation of this business does not comply with that. It's destroying the quality of our life and our neighbor's life. You've already heard about the truck traffic. If you would mind, put those pictures up again, you can see these tractor trailers, these tanker trucks parking on the swell, loading, offloading, going down East Top, Turrock Avenue, to Ridgewood Avenue to get back to US one. And they have broken sidewalks and culverts in doing so. When they're using that as well, it's impossible to exit or enter on the East Terga without risking an accident. Our small neighborhood, in the 1920s, is being severely impacted, negatively impacted. It's not just the tanker trailers. They have over one ton delivery trucks that are their business vehicles daily up and down our street. They also use that parking, the driveway of that residential home, which is still owned R3 for parking, for loading, and offloading product. And they use it for their commercial vehicles itself, which you'll see up there, that second photograph in the upper left hand corner. They park their business trucks there.
