There is no minutes to approve at this time. There is no old business at this time. There are two items that were originally on the agenda which which were VA2426 and CU2402. Both of those items are being tabled at this time, so we will move directly onto VA2427. Request for variances from Article 5, site design criteria to allow for a 20-foot setback, 20-foot second front yard setback in lieu of the required 40-foot setback for the residential property located at 218 North Riverside Drive. And we have a staff report, please. Thank you, Chairman. The applicant is requesting a variance from Article 5 site design criteria to allow for a 20 foot second front yard setback and lieu of the required 40 foot setback for the residential property at 218 North Riverside Drive. So on a corner lot in the land development code within the Article 5 of the site design criteria, a corner lot has two front yard setbacks and two side yard setbacks. So the applicant is requesting for a second 20- foot front yard setback. The applicant is requesting the variance to build a new single family residence. There was a residence there. It was torn down. And this is the site plan the applicant had submitted for the new building. The original building was 21.5 feet from Plaza Lane and the applicant is requesting 20. Staff did review the application for non-administrative variance against Article 9, Section 21104.D or O4D, pardon me, not as administrative variance in order to grant and not administrative variance. The following findings must be made that the granting of the proposed variance is not in conflict with the comprehensive plan. That the granting of the proposed variance were not result in creating or continuing a use, which is not compatible with adjacent uses in the area. That granting of the proposed variance is the minimum action available to permit reasonable use of the property, that the physical characteristics of the subject site are unique and not present on the adjacent sites, and that the circumstances creating the need for the variance are not the result of actions by the applicant. City staff note that the applicant said the footprint of the home will be restricted and not Esthetically pleasing to the surrounding homes and neighborhoods that they have to adhere to the two 40 foot front yard setbacks City staff did review In accordance with article nine section 21 100 point O4 D and found that the applicant could not meet all six of the criteria Staff Staff will note that the Planning and Zoning Board has granted variances for corner lots at 216 North River Side Drive, 200 North River Side Drive, and 124 North River Side Drive. My name is Mike Rose and Trader 218 North Riverside Drive. I'd like to thank the board for the opportunity to present our variance requests this evening. The request before the board is to allow for a 20-foot second front yard setback on plasalane is I'm sure you're all aware edge water requires two front yard setbacks on corner lots. Unfortunately we weren't aware of that when we purchased the property in September of 2024. It's important to note the structure that was demolished was 19 and a half feet from the plaza lane set back. I know Ryan just said 21 feet, 6 inches. I have the official survey here and it was 19.5. If I could, I'd like to share a document with the board that our architect will produce to try to simplify what it is we're trying to do. Maybe okay if I pass this out? Yes. Okay, I'm hopeful that this document will clarify some of the things going on with our request. If you look at the top right hand, the legend you'll notice in red with the red stripes, that is the footprint of the original structure that we have torn down. And the blue is the proposed structure that we would like to build. You'll see I've put seven numbers. I've got the numbers one through seven on there to try to, so I can be helpful to bring your attention to what it is I'm talking about. Number one, again, the structure we tore down the 19.5 feet is what was taken off of the survey of the property before we took the house down. Number two, we're proposing that the frontal garage be 24 feet, five inches off the setback. Number three is a post. We hope to put a side entry into the house and the post would be 20 feet 11 inches off the setback. And four and five are simply the dimensions to the exterior wall, the kitchen, and dining room. Number six, you'll notice we've improved the vision triangle by moving the house to the east. The house we proposed would be 38 feet six inches from the setback versus the 253 on what we tore down. And number seven is basically there was an old storage shed in brush in that corner of the property, which has also been removed. So that's it for that document. It's my wife and I's plan to build a forever home on this property. If the board would see fit to approve a variance, we will be building Hicks and Home on the site. I think the site. Hicks and already has two homes on Plaza Lane. We hope that ours would be the third. We've met with all of our potential new neighbors or hopefully new neighbors in regards to the variance request. They've answered questions that they've had in regards to our plans and I believe we've met with 11 property owners, not just the immediate butters, but everybody around us to let them know what we would do as we commenced with terror in the house, strong, and where we're at today as far as this variance requests to see evening. So with that, my wife and I, respect your request to approve our variance. So we look forward to becoming a part of the Edgewater community. Thank you. What is the total square footage of the house that you're proposing to build? I believe it's 3,200 air conditioned. Thank you. Anybody else? My wife won is like, pardon me. Did you really change your 2p? No, I like a half of it. Yeah, 19 and a half to 20, right? Correct. But because the old house was grandfathered, but it was torn down and lost the grandfathering stuff. So he's encroaching 20 feet because the front yard set back should be 40 feet. And because he's got two right on the yard just changing from the original. Well right, yeah from the original. The only question I had and I mean I go up down Rivers not as much as Bob, but close. And I'm usually moving a little faster. My only concern was like the dry, is that going to be a garage coming off that driveway? What do you put your driveways proposed? Are you going to put a garage to in two and three? Between two and three? Yeah, right there at two and three. So the corner, I guess, above the dimensions, 19, five from one going towards six, that is the corner of the garage and heading east, I guess, above the dimension that's number three, 24 to 11, that's the footprint of the garage and the houses to the right of that. So the only concern I had, because that means your driveways really only gonna be 20 feet? 24 foot, five inches to the front of the garage. So I don't wanna say this, because I drive a big truck. My truck's 24 feet. My only concern is, and I know those roads aren't super, like plaza and some of those roads are super wide, is parking gonna be a problem with a truck, cars car or something like that bumper hanging out in the glass. Well that's my only concern. I have no problem moving the garage back five feet if that helps. Plus I mean I'm sorry. No you're good. The only other thing I was saying was like trailer parking, anything like a lift in it so I can actually have a place for a golf park car underneath it. So I drove down Plaza and it's kind of a tight suite. The house is directly across the street also. Is that 2-8? Is that 2-16? Is that the one? That's like it would be across the street. So coming out of his driveway. It would be like 2 1717. Okay. That one's super close to the Plaza also. So like, I just, when I kind of sat in the driveway, I was like, this is very close. It's a tight squeeze. So the purpose of the 40-foot setback is what? We want to make sure we have plenty of room for emergency vehicles. vehicles we want to make sure that if cows catch a sunfire it's not going to just leap to the next one because it's so close to it there's reasons why we have the 40 foot setback so I mean I know there's three other ones but they were probably grandfathered in. I just don't like that we keep on saying, well, there's a couple more in that area. Why not throw another one in? I just, if we keep doing that, I don't feel comfortable with it. Well, let me just say he has a front yard set back to 40 years and the property is a big piece of property. He can't change the size of the road. That's the edgewater situation. And I don't think what he's asking for is unreasonable at all. What if you haven't been here a long time and we've seen many things like this on my vow and in lieu of what he's building and what he's gonna be creating, it's an improvement to the community, number one. And I don't feel it is a detriment to his neighbor building it where he's building it. I don't feel like it's a detriment to the neighbor. I mean, just driving down that street in general. It was a tight. I know. I'm there all the time. I ride. I know that I haven't been here a long time. But what I have seen from what I've been here it's we keep on saying they did it a couple times so why not the point is what's the reason for having the 40 puts that back what I mean what was the purpose of setting that in motion if we're just going to find if we're just going to keep on saying well so staff have in floor to shores at least we've staff have administratively done so that people don't have those setbacks. And that's mostly because of the issue that people that requirement of having to front yard setbacks in floor to shores has resulted in a lot of people building on the east west for attention puns for their driveways. So city staff have kind of kicked that policy in the Florida Shores area because it is led to bad policy. Throughout the city, I think the intent was to, for that purpose, traffic, those issues, I will say that the ordinance in the city doesn't allow public parking on the street. So, you know, he would, you know, it's kind of an enforcement issue at that point. I think the gentleman has expressed is this a three car garage? Yes. Three car garage with a lift. Based on the size on US one, I think he's a, I'm gonna make an assumption that he is someone that has the means to not have his cars in the street with a three car garage with a lift. So, staff isn't asked in certain. Where's the, looking at that aerial, but there's nothing here right now, right? So looking at the aerial looking at the proximity to the driveway across the street. Yeah, and they were also bringing up the survey. So where is proposed driveway going to be in conjunction with the one that's already there for your neighbor? It's definitely going to be right. Well, you already have like somewhat of an apron or something. How far from that like driveway apron to the east is the driveway going to be? Are you moving the apron? The contractor that tore the house down recommended leaving that so it wouldn't break the asphalt coming in and out that that apron Will come out if the house was done in concrete driveway would be poured, but that Weaver construction tore the house down for us and you recommended leaving that piece I can't tell without looking at the blueprint, you know where the where the Garage at the driveway or garage is gonna be in reference to that's the fellow across the street. The base on is planned that the applicant has provided it appears that the driveway heads east of the driveway apron, so it looks like it'd be an extended driveway apron there for the three car garage.. We have a, I mean, probably it's too hard to read the survey. Can we put the survey, I know it's the old house that's on the survey, but I'm trying to figure out. I have the survey drawing here, if that helps, it's like three feet by two feet, if that helps. Yeah, that's what's on this thing. Of course, it's been condensed with the numbers. Because it's not like your property line's on the road, it actually looks like it's five or six feet once the road to your actual property. It's not like your property lines on the road. It actually looks like it's five or six feet off the road already. Where I'm going with that is this 24 feet is actually from the property line. But it's probably lines by way from the edge of the last road. Now it's 30 feet. That's where I was trying to get to. It really is 24,. If I could answer your point, there's a telephone pole way to the left and all the flags they put in when they survey your property disappear. That's the only one that's left that it appears to be like three feet of grass between the asphalt and where the one pin is on the I guess it would be the southwest corner or a lot. 27, 27 and a half. If the staff are coming, they're no help. Let's face on the way. Give it that's there that's going to be the easement still right there. So they already have recorded you would have to put in an easement driveway which would cost a fortune to go from Riverside right to put a driveway from Riverside right so you would have to put it in there somewhere and the only thing that he could do is move is make the garage go back a little bit further and then you're I mean that's pretty much it. I really just had a question for Mike. I was told this afternoon by him that the garage was going to be only one story. Now I just heard that there's going to be a lift in it, which I do have a lift. It's only one you can get a full size pickup truck on it and pick it up. And I'm a dwarf so I can walk out of under it without getting it way up. But the structure itself is going to be a single stall garage with just a roof. It's not going to be a two-story garage. The living, the hard-and-making. The vaulted ceiling. Yeah, they're going to engineer the trusses so that, you know, like you said, it vaulted, sailing so I can pick up a full-size pick up truck. I'll also point out in all of our residential zoning districts, you have the right to build the building. But just as long as the garage height is no higher than the structure, the construction. That that's only the K-CRAC. It's only the detached structure. Detached structures. So, if it's part of the principal structure, it's part of the roof. So, it's measured from the base, bottom of the floor to the peak of the roof. But it is accounting for the full height. So even if he was to build a 11 foot heel height, so that refers to the distance from the slab to the heel of the truss works. It's on the wall. So even if he built 11 feet, which isn't uncommon, I mean, my house is 10 feet. So even if he did that and didn't bolt the trusses on that pitch of a roof, even if he did a 6, 12 pitch roof, he's going to be 18 to 19 feet to the eave, to the ridge of his roof, not going to be that high. That's if he did a 45 degree triangle, which I don't imagine he's going to do. So, thank you. Thank you. Any other questions? How much? 28 plasoline. My concern is the road, the curve and the road, the visibility with the house close to plasoline. So I was wondering if they shifted it to the North 5 feet on the other side of the house. We'd have the extra space on the driveway side where the house is, and it wouldn't be so close if you have a truck in the driveway and everything else. Just move it over, move it North 5 feet. And then he gets to build the house he wants, and it would fit on a lot not be so close to the road Living in the house that you're living in when this structure was here before was knocked down. Yes Was it hard to see coming around that well the difference is when we come out of when I come out of my driveway Don comes out of driveway, it was a really sharp curve. That was a one car garage. The original. So you really, it didn't block, you'd have some kind of visibility when you're coming up the driveway. This is a really long house. I'd like to see them be able to build that home. But I don't see what I can't just shift it over five feet to the north and It would make you know, it still fit the whole house And it's more room in the driveway for parking. You're shifting it down to the east More than five feet which doesn't seem like it would be impeding anything Because it's gonna be further down I think he's actually opened up. He opened it up is what I'm thinking when you look at the comparative You can see the red where the old house was versus the new yeah, he's opened it up Probably five or seven feet Okay, so even with the vehicle the corner is still the corner. We're going to cover the coastal management element, our parks and recreation element, and our open space conservation element. So I invite everyone to attend. So trying to get the word out, we had about 50 people, which was better than the public education seminars. But I'd really like to get more feedback because this document guides how we grow through 2060 and it would be nice if more people participated in what they want to see the vision of the city be so we have more of a consensus moving forward time on Thursday. Six to eight next Thursday and 10 the noon on Saturday At the last meeting Mayor was talking about forming some committees I think this more pertains to asking Mr. Wolfe, if it's a lie, it might be easier for us. It was developed that they were talking about a committee of seven, but a quorum was four. But for us it's five. Can it be switched to four? Is that that involved? I mean, that would be easier because we've had time to, we have a cancel because we only had four people which in the normal committee would be able to continue to meet and we had to turn the people away because we didn't have a quorum. Would it be an idea to make a quorum for us? I think it would be a good idea. City council would be up to them to change your bylaws. It's in the council. I just I remember hearing you say to the quorum. Nice four but here it was seven. It might give a little more flexibility to have a meeting. Maybe some of the reasons behind that is, you know, this board does have the power as you just did to grant variances and so forth. So they wanted to make sure that there was a reason for these five. I know we had to let people know. But I understand the reason for it. Because you get it close folks. It's very, very critical. Okay. I think this is probably one of the most meaningful dialogues that we had on an issue. I think that's what it was.
