I pledge allegiance to the flag of the United States of America and to the Republic for which we stand on nation under under God, and in this hall. We have every place to get justice. Please remain standing by your heads. Heavenly Father, we ask for your guidance as we be tonight to conduct business of our city government. Help us keep in mind that we are here to serve the people of Westminster and enable us to make our decisions so that we may do what is best for all of our citizens we represent. Amen. Thank you. Please be seated. Thank you. Thanks, the council member, Manzo, and vice mayor Hall for a salute to the flag and invocation. Next is the attorney closed session report, please. Thank you, Mayor and Council. We had four items on the closed session agenda. Each one was discussed and the council gave direction to staff on them. There's nothing further to report in that regard. There was one letter that was received just an hour or so before the meeting. And so it was something we just became aware of. It was from an attorney representing vice mayor Ho. And so it would be something that I would ask that you would maybe walk on as a closed session item for discussion purposes. It would require motion a second and four votes Vice-Marrow is the one sending it so she would not be something we're not able to participate in that my understanding is that you're asking for To walk on because potential litigation correct all right, okay, I'm with a proof second I mentioned that there's a since we only have three council members, Vice-Maro could not vote for that, so it could not pass at this juncture. Oh, okay. You would need a fourth vote. So we need to, we need to, at this point then, we can't, we can move. I think we see for that. So just disregard it. We can't move. We can move. To see if we can. So just disregard it. We can always come back later on. If we have five council here. All right. Next is the next part of communication. Do we have anything from the council? No. Seeing none. Hearing none. So moving on to City Court report, please. Thank you, Mayor and the members of the City Council. nomination period for upcoming general muted selection closed on Friday, August 9th for District 2. An extension period for District 3 remained open and closed today at 5 p.m. And for me, regarding qualified candidates, can be found on the City website. And that concludes my report for tonight, thank you. Before we go on for a special presentation today, I noticed that Councilmember West just jointed us at the Dias so why don't you go ahead and mention what you request earlier so that we can see if we- Yeah, I'd mention that there's one potential litigation item that would need to be discussed in closed session and that that could be a walk on item. Would require four votes, a motion and four votes. And this concerns a letter that was received from Vice Mayor Ho's legal council. So again, move the move. Seconded. Thank you. I have a motion made by Mayor Wynne. Seconded by Councillor Bumbermanso. This is to walk on a closed session for potential litigation. I have a call roll. Councillor Minifian-West. Fan-West no. Councillor Bumbermanso. Yes. Councillor Bumber-Wynne. No. And Mayor Wyn Mayor Wain. Motion failed. All right. Thank you. We now come to special presentation. A certificate of recognition to Westminster Police Department officers for earning an award for models against driving approvisionvision as met MADDD. I'm more than happy to present these and I will also join me at the podium after this. Certificate of recognition, certificate of recognition to Westminster Police Department officers for owning an award for models against drug driving, MAD. Models against drug driving honors law enforcement personnel for their continuous effort in the UI enforcement. As each U.S. arrest is potentially a life safe to honor and thank these officers, mad, awards, us to get along with their prestigious 23152 pin to the officers who make over 25 the U.I. arrest annually. The California Vehicle Code section for driving under the influence is 23152 and the pin is red in color. The officers who earn and wear the pin symbolize math mission and and truck driving. On behalf of the entire city council, I want to recognize the following officers for achieving this honor. Officers of it, officer of vis-le, officer of cruise and officer of cruise-Z. So, council, can you join me at the podium and I would like to invite the four officers just mentioned, please come up for recognition. First is Certificate of Recognition presented to officer Christopher Salveys and Westminster Police Department in recognition of your effort to keep our street safer by making 27 DUI arrests in 2023 and earning an award from the mothers against trunk driving. So, congratulations. Next certificate of recognition presented to officer Brandon Kuz, Westminster Police Department in recognition of your effort to keep our streets safer by making 38 DUI arrests in 2023, and only in a work from murders against crime driving against side by me, and also the city council. Applause. Next, the certificate of recognition presented to the officer, even Boosey and Westminster Police Department in recognition of your effort to keep our streets safe, safer by making 32 DUI arrests in 2023 and earning an award for models again, children driving again signed by me and also by City Council. Congratulations. Carso. Congratulations. Thank you. Thank you. Thank you. Last but not least, officer Willie, obviously, and was Mr. Police Department, a dissatisfied recognition to him in recognition of your efforts to keep our streets safer by making 42 DUI arrests in 2023 and earning our work for mothers against drug driving against and by me and also city council. Congratulations. And thank you for your service. I guess the energy of you want to say anything? All right. Well, I hope you all know how many lives you saved. You saved my family's lives because all the people that you arrested for you, the UI, had you not arrested them. Who they could have killed. So I could have been one of my family members, could have been one of our constituents members could have been one of our constituents are You know people from the community and so I really appreciate your efforts your bravery and You know you look out for the city and for for everybody in the community. Thank you so much for everything you've done. Thank you for all you done and your service to our community. Thank you and we're really proud of you. Thank you, Mr. Mayor. Thank you, Westminster PD. You guys are the finest and thank you for all you do protecting our city, keeping us safe and please continue to be brave and be safe out there. Thank you for all you do, protecting our city, keeping us safe and please continue to be brave and be safe out there. God bless you guys. Thank you. Thank you. It's time for drops. If you don't mind, can I stand in the middle? Thank you. Congratulations to you. Congratulations to you, Chief. Thank you Chief, you are a leadership for the great recognition here. So why don't we put together our hands to thank Chief for his leadership though. All right, next is our schedule here. Mayor, if I may, I forgot a request that we had on staff under senior manager at park. Tonight's agenda is, you know, we have a lot of city business and we do have some of our staff members here tonight, ready to represent on some items. So I was wondering if we would be, if the council would, wouldn't mind if we moved item number six and 7.1 through 7.4. So basically our legislative and commission committee items to be heard after the consent calendar but before regular business. Did you say item six point one? item 6.1. It would be 6.1 which is our legislative item, legislative item as well as 7.1 through 7.4. Moved to approve. I second. I was there away that you can modify a little bit and move maybe the 5.9 and 5.9. I'd rather have to care of the business so that staff can get done and then get back and prepare for tomorrow because they have to work tomorrow. So hopefully that we can if you don't mind that we can go ahead and move those two items after the item. That would be perfect. 5.9, 5.10 and 5.9 after that. That would be great. Thank you. Is that okay with that?'m going to approve with that and I second it. I second it. Okay. Let me repeat. City managers recommend that to move item 6.1 and from 7.1 to 7.4, 4, a head up or the items. Okay, so that we get. But then, customer member, we're thinking that, you know, trying to move in front of that, but I make a motion to move those two items, which is 5.9, 5.10, right? Yeah. 5.9, 10, right after, 6.1 and 7.1 to 7.4. And those would be African. And African. And African. Yeah. Yes, Mr. Mayor, 5.10 and 5.9 after, right? 5.9% Yes, I second that. We already have a motion in a second. Will we just modify it? We just modify it. We just modify it. Well, when I modified, let me ask the second, will you agree with the modification? Yes, I agree. No, no. He's list. Who second it, please? You second it? No. What? The first, when I make a motion, who second it? I did. You did. So at this point here the motion has been modified to include the 5.9 and 5.10 right after 6.1 and 7.1 to 7.4. That's fine. Okay. All right. Thank you. So motion by Mayor and seconded by Vice Mayor Hall. Thank you, Mayor. So I've been motion made by Mayor Wins seconded by Vice Mayor Hull. This is to change the order of the agenda to hear item 6.171, 7.273, to be heard after the consent calendar before regular business. And here 5.9 and 5.10 immediately after 7.3. I've got a call roll. Councilwoman Fan West. Fan West yes. Councilmember Monzo. Yes. Councilmember Wynne. Yes. Vice Mayor Ho. Yes. Mayor Wynne. Yes. Motion carried 5.0. Thank you very much. At this time, I would like to open for oral communication for agenda items only. Please, address the council with the items on the agenda today. If there is none, if the item, if something that you want to address to us, it's not on the agenda please wait until the oral communication for non-achained items. So city clerk would you please read the instruction into record please. Thank you mayor. This is the time in the meeting that members of the public may address the city council regarding any items on the agenda. Unless otherwise extended by a majority vote of the city council, comments shall be limited to three minutes per speaker. Any person wishing to address the city council in person should complete a green speaker slip that is provided at the entrance to the council chambers and submit the card to the city clerk. When our name is called, please step to the podium at that time and state your name and city of residents for the record. Our first speaker- Before, before, yes, I just wanted to mention that there's a resolution number 4963, a resolution of the mayor and the City Council of the City of what's Mr. Establishing rules of the quorum and civility at the City Council's meeting. So I would like to ask you if you present be treat everyone cursively and also be open-minded and consider all viewpoints and all members of the public to speak without intimidation and interruption. Otherwise, I have to stop you and I don't want to do that. Please help me to have the right effort to meet. Thank you. Now we can open for the first speaker. Our first speaker is Noon Hung, followed by Mark Noon. Noon. I have a my interpreter So my answer of the meeting and I can read both, but he on the way now. My interpreter, I read the Vietnamese first and then congratulating. Whichever one you prefer. Whichever one you prefer. Okay, by Vietnamese first. Thank you. There's two voices and two horses and two horses. Who doesn't have one? Did you ask one? Stop the time for a second. You're asking for a double English time. Eddie, what are you going to say with English? No, if you don't have the interpreter, then you will buy yourself. Okay. Thank you. Thank you. Good then you will buy yourself. Okay. Thank you. Thank you. Good evening, ladies and gentlemen. I speaking on item 9, 9 and 510, ladies and gentlemen, item number 9, I would like to re-retreat that the function of the coaching member is to serve the community. We like you to represent us in doing good things for the city. In the past, you have worked a lot of my touch money and even your precious time for the central issue. Because the limit of a time, I only suggest to skip the decision on central thousand women in the fun world. I think we should not take advance of this democratic forum to create a state for condemn each other. In the past, you discipline Major Kita and why Major Chi Choling-Wen. But later, we build this decision. So therefore, instead of being tense or confronting each other, you should treat each other more gently and maintain harmony. Among the members of the Couching, so the residents do not see the noisy in the city, Calcinton, et al. I have free market. I think we just need to issue a recommendation with the apology of the Calcinton Army upon wealth to be more careful in the future. Something, Calcinton women, Army upon wealth, were willing to apologize for last time. And I agree with the proposal from the Calcint men, number one queen, last time. And I agree with the proposal from the Councilman number one, Quint, last time. He made a previous meeting, Councilman Womens, Amy van Wert apologize and speak to Simpat the Dick Colleague to her colleagues who have a hat conflict in the past. At the same time, we reveal the accusation to the chain attitude for the better. Like every American citizen, cousin woman, Amy von Warthaus, had the right to free them of the pitch. And I question, if you can pick cousin woman Amy von Wert, except for the Kousselmann-Kalo Manzo. I think all four of you should be censored too, based on my document. Remember that we should live in United States, we not live in Vietnam. You are again communist, how come you do like a communist? I have item number five, thank you. Okay. Our next speaker is Mark Ngu Member, City staff and fellow citizens. My name is Mark Huen, I am the board president of Midway City Sanitary District. I am here to speak on the district behalf regarding item 5.6, which is about the city consideration and sponsoring the district 85th anniversary celebration. Westminster and the district have always had an extraordinary relationship, working together to serve our community. Please consider partnering with us for this community event celebrating the district, Major Maestong. It has come to my attention that this room where the city has millions in the coffer. So I'm here to ask only for one million, but I'm sure we can come to somewhere in the middle. All kidding aside, on behalf of the board of directors and district, I want to personally invite the mayor, all council members and your families, city staff and all residents of Westminster and Midway City to this 85th anniversary celebration on September 14th, from 10 a.m. to 1 p.m. It's a free community event that will be live music and kids activities. We will serve food, refreshments, snacks, and give out gifts. Invites are already going to be sent out in the mail, so look for it in your mail box. I thank you for your time and consideration. Thank you. Next speaker is Robert Furman, followed by Michael Verangia. Good evening. My name is Robert Furman. I live in Westminster in the first district. I want to express my strong objection to the council's efforts to censor councilwoman Amy Fand West. This action represents a significant way to tax payer dollars and to miss you to the city council's time. I'm aware of the allegations against her and I find some of the allegations a little hypocritical. I've sat in this gallery in the past and I've seen a member to interrupt constituents and argue with them. And I don't think that's appropriate. Months ago, I'm sorry. The job of the council person is to listen, ask questions, make a decision, and then vote. That's all we expect from you. Not to argue, but most people don't really care about your petty squabbles between you. They are turned off by local politics. If they did care, I think you'd have a full gallery here. The way it should be. Council on West was elected by the voters of the first district to represent their interest and concerns. Attempting a silence at dissenting voice through center undermines the democratic process and it disrespects the will of the voters and put her in office. If there is an overwhelming pressure from district one constituents to silencer, then I suggest you show us the evidence. Absent that, this is nothing more than a personal vendetta. The law may allow you to censor fellow officials, but it's not always the right thing to do. It is a voter's prerogative, not the councils to address and respond to the perceived issues with their elected representatives. The council should prioritize its efforts to un-matters that directly impact the well-being and economic prosperity of our community, not petty disagreements. Instead of engaging petty efforts to censor one another, which displays weakness and leadership in my opinion, your focus should be on discussing and implementing policies and increase revenues and incentives for business growth in the city. These are issues that will enhance our city's future, provide opportunities for our residents and ensure a thriving local economy. I urge the council to redirect its attention to these critical areas and respect the electoral process by allowing councilwoman west to serve her constituents without undue interference. Thank you. Our next speaker is Michael Vertengea, followed by Devora Meriskel. Thank you. Item 5.10. This has nothing to do with city business. Mayor, what I suggest you do is make a motion, get a second, and vote to take no action on that. It has no business on the agenda. This is nothing more than a personal grief. 5.7, make sure you appoint people to go to that trip. Somebody that will actually pay attention. We've seen pictures of one of our esteemed council members sitting there on her phone with her feet up on a chair not bothering to pay attention what the training was. 7.4 RV parking. You need to recuse yourself. You and Hubby run an RV rental business in this city. You can't even be in these chambers during the discussion of this. You need to recuse yourself and also limit it to the 12 permits that the police department recommended. Not 36, we don't need 36 permits out there. 5.9, this is a censure. It's not eliminating somebody's first amendment rights. I keep hearing people come up here and complain they don't want to, the council members, censored. It's censure. Basically, it's a scolding. That's all it is. Nobody's gonna lose their job. Nobody's gonna be limiting their job, nobody's going to be limiting their First Amendment rights, they're still going to be able to represent their district. And as a Christian, you should know that we're taught that our actions have results. When you do things and you violate an ethics code, there's going to be consequences. So if you want to be a good Christian, remember, there's consequences for your actions, all of our actions, that includes me. And I shouldn't be the one that sculled anybody for that. Let me see, I think I hit them all, but especially 5.10, that has no business on here. Make a motion, get a second, and eliminate this thing off the agenda. There shouldn't be on here discussing this. And also chief, congratulations to you and your officers for the DUI arrests. I always wanted one of those. I could never do the FST myself. All right, thank you very much folks. Our next speaker is Devar Mariskel, followed by Tammy Hamel. Who's already here? Good evening, Council. I'd like to say congratulations to our police officers having done a couple of ride-alongs and done some sobriety checks. Good job. 3.10. Yes, agenda and non-agenda items need to go back to the beginning. People can't stay here until midnight. There's no reason that it should have been done. Let's move on to 5.7. Traveling for the council members. Sometimes I have to go to Sacramento to lobby at Pay My Own Way. Maybe one of the council members could go, but we still are in financial crisis. I think it would be great for the mayor to go if he wants to, maybe one other person. But we need to not be spending money that's not really going to do anything. I agree with Michael, we are not taking away Miss West's right to speak. When our daughter was little, we had certain words that were not allowed in our house, not just the swear words, but other words as well. I could not censor her. I could not make her not say them. But if she did, she got censored, and she got consequences. Same thing here. 5.10. what are you thinking? This is a civil matter that has nothing to do with the city. This is ridiculous. Take it off. 7.3? Yes, there does need to be parking restrictions by the driveway at Liberty Park. I live over there. I walk by there. It is difficult for our maintenance people to get in there sometimes, like Toli agree with that. Parking is a commodity here. It is prime real estate. We do not need 36 permits for RVs. If you own an RV or an RV business, store your RV so you can bring it to your house three or four times so you can load up your stuff and bring it back and unload it but I go with the police department 12 should be absolutely the max. Thank you Tammy Hamill followed by Jody Boyd. Good evening. Tammy Hamill, district one resident, Westminster. There's quite a few I want to comment on. 5.7, I do not think that she needs to go anywhere. She keeps proving that it's all, anything she does is self-serving. She does not have the best interest of the city at heart. Also for 7.4, recuse herself because she, whether she says she does or not, there's proof that she has RVs in the city. 5.9, again, I agree with, you know, Those are not, there's proof that she has RVs in the city. 5.9, again, I agree with, you know, everyone else that talked about it, that it is not censoring her, it is censuring. Her actions continue to prove she doesn't know how to control herself. She lashes out at people. 5.10 is a prime example of her bad behavior. She immediately went out and started defaming and accusing a fellow council member that had nothing to do with her and now she's putting it on the agenda to continue that attack. That's what she does. If people here commenting in favor of her actually understood that, watched the meetings, looked at her social media, they would understand that. It's not about her disagreeing or going to the bathroom. It's about her being late, leaving her seat for 40, 45 minutes at a time. It's her attacking council members, it's her attacking residents, calling names, using defamatory language. That's what she's about. Her husband gave a prime example when he went on media and said she thinks this seat is chump change. She does not care to be here. She's only doing this to promote herself to higher office, which hopefully she will never get, because who knows how much more waste will she can be, the higher she gets. I urge you to go through with the censure. I really hope you do. A lot of the things that I saw of people writing in, they do not live in Westminster, they clearly have no idea what's going on because all they talk about is her being silenced. She is clearly not silenced. If they watch the meetings they will see, she interrupts, she badgers people, she constantly, she will not stop talking. Even when she's muted, she just stops talking, she starts talking louder. If they actually paid attention, they wouldn't be up here praising her of her actions because they clearly do not understand what she does and what she's really about. And I believe 5.10 also I believe doesn't not belong in here. It's just her way of personally attacking Kimberly and with his center thing and her center thing, they're going to just continue wasting more time with all the center because she's a baby. He's going along with it because she cannot control herself. Please continue with the center and yeah, 5.10 does not even need to be on here. Thank you. Our next speaker is Jody Boyd followed by John Ingrassani. Good evening. I'm Jody Boyd. I have lived in Westminster since 2009. More years than I can count. More years than I have ever lived any one place in my entire life. Most of you know that I was traveling for two years, happily living the life, traveling in an RV when I got cancer. I had to make a choice. I could have received treatment anywhere. I chose to return to Southern California for treatments and to live in Westminster again. And I've been a resident of District 1 the entire time where I'm very proud to live. There are many things on the agenda that I could talk about tonight. Of course, I am dearly concerned about our city's finances and the complete lack of progress by our city government to solve this issue. Yet another year we have taken money from reserve, not borrowing it because there's no plan to pay it back. We need to solve this problem. The citizens, you're already balancing the budget to keep the lights on on our backs. I'm a senior citizen, a retiree, on a fixed income. You know what? The higher sales tax hurts me when I go to the grocery store. A lot of my weekly items are indeed taxable items. That sales tax comes out of my food budget. Yet we can't talk about innovative ideas like plant-based medicine, which throughout history and I'm a history major has existed. In fact, modern pharmacology is based on plant-based medicine. My chemotherapy medication was derived from the bark of the Pacific U-Tree plant-based until it was synthesized into a very modern, aggressive chemotherapy treatment. It really boils down to math. So let's get deep in the weeds, basic math, addition, subtraction, division, and multiplication. You know, we can solve our financial problems with basic math. And with basic math, I would like to touch on another issue. I live in district one. Amy, we've talked, we've prayed together. We have a lot in common. I have intentionally stayed above and out of the fray, although it's pain me. Thank you. Thank you, Senator. Next speaker is John Ingersani followed by rolling guyer. Hello, my name is John Ingersani. I'm a 33 year resident of West Mr. In District 1. Councilman Amy Van is my council representative. From the moment that councilman West was inaugurated to the council, she's been the subject of relentless attacks from external interest groups, many originating from this very podium. Section 509, Subsection 2AA labels terms weak and despicable as grounds for breaching the conduct of members. Yet nearly every council meeting, the language permitted to address the councilwoman was, is not only despicable but often includes personal attacks on her intelligence, attire, and her action also has a native born Vietnamese. Myself is an Italian born immigrant who has faced a similar ridicule. I'm appalled that her colleagues on the dius remain silent while these attacks continue. While it's appalling that we have a council member show up late to little league games, you know, lie about how dog menus and also display her OCD and re-arranging seats at public events, it might be in as far more appalling that the council puts the city at risk for a potential liable lawsuit arising from several of the complaints on in 509. For example, the most egregious is 509 to a subsection to part C. The psychoanalysis of council person west is written in a manner to deceive the public in believing a licensed professional has evaluated her. When in fact, the accusation is pearly, conjecture in nature. There's also potential risk with Bible 9 section 2R. The council is the accusation of Councilman West's filing a false police report. It implies that she's violated the law. When in fact, according to the voice of OOC, quote, police investigation found Manzo committed no crime at this time. End quote. Filing a false police report is a crime in California that can result in a six months jail sentence, and subject to a $1,000 fine. Well, $1,000's chump change compared to the money, the council put the city at risk because of such slanderous attacks. I won't even go into the potential financial harm to the city. Should councilwoman West press criminal charges of potential civil rights violations? Our city is in constant battle to avoid bankruptcy. Your primary solution is to hold residents hostage and force tax increases in exchange for our release. We begrudgedually paid the ransom by voting higher taxes. However, we didn't sign up to fund your never ending internal battles. Now, of course, thank you. Our next speaker is Ronald Gyer, followed by GGVO. Thanks. For a minute there, I thought I had a new name. That's because I can't write, okay? So she read what I wrote. Nice to be here again. And it's always very interesting. I'm here about her and about my initial, initial of feelings about the first couple of times that I was here watching what was going on. And the reason I was doing that was because when there was a problem on a city council meeting in other areas, I made note of that. And there was a difficult thing for one woman on another city councilman where a guy was really, really pounding her. And to the point where I was so afraid that she was going to have a heart attack. I mean these are serious things that were going on. It was Irvine so I don't think I have to go into a lot of detail on that kind of thing. But I stayed down there for every city council meeting just about for two years. I lived in Chino Hills. So I made sure that I was there for her. And all that meant was when she was really being nailed and all of this guy sitting right next to her, all I did was smile. And I did that for two years. And they got the job done, but it got her through the hard times when she had to go through hard times. So when I first came here to the first meeting that I came to because of what we're dealing with in Los Angeles, the fighting that was going on and the blistering that was going on, and don't you do this and shut up and all of this was completely the opposite of what I expected, but I've been there before. And that's exactly what I saw when I first came here. You had wonderful expressions here from people. They really feel what they've been saying. They have their reasons. But there's some really qualified people that have given you ways out of this without having to do anything else. And that is just to open your hearts. And be there. It's worth it. For me it was worth two years of coming to a city council meeting to make a difference in someone's life or something that was needed. Okay so my heart's here. I go to every city council meeting where I live and I've been made awarded for that and things like that but that's not why I do it. I love being here. I'm 82 years old. I'm having a blast, okay? And she works her tail off doing new things. She is like Jay of Kay was when he first became president. And I shook hands with him. The day he accepted his party's nomination in the Colosseum. So I know what I'm talking about. I just fresh out of high school. I want to thank you for listening to me. Thank you for listening to the voices. Thank you very much for your good hearts. Well done. Thank you. Our next speaker is Gigi Vo. Followed by Huiay Donato. I was a member of the National University of Canada. I was a member of the National University of Canada. I was a member of the National University of Canada. I was a member of the National University of Canada. I was a member of the National University of Canada. It's not like the M.I. But it's like a school for anyone who wants to build a city to build a fair, to build a fair, a fair, and a fair, The The two of them are the leaders of the world and the leaders of the world. I really have to say that the first two of them are the two of them. The two of them are the leaders of the world and the leaders of the world. Thank you. Good evening, mares, councils, and everyone present. I am G. G. Vaugh, I am the person who campaigned for Councilwoman Amy and closely follow her activities since she was elected. I have comment on Agenda 5.9. I can say, Amy is just someone who entered politics to build her name regardless of the law and ethics. Just for the purpose of climbing to the top of the ladder, someone like big Congress, like she has run for office many time and humiliating the fit. As a resident of the city, I affirm I do not accept electric officials who use political means to create factions, cause disunity and destabilize the city. Amy just in competent and immoral. She wants to climb high by gossiping, lying, making phone accusations, slandering her colleague. Amy put her personal interest and ego above the interest of the resident. We need to unite it City Council that share ideas, knowledge and responsibility so that investor choose the city to invest. As resident, we find Westminster a worthy place to live. The centering of Amy is necessary and appropriated. Not for only council women, women, Amy, but also a lesson for those who want to join the City Council to expand their prestige, faction and seek honor for their family. Item 510, I also object to item 510, which is Court Judgment. In my opinion, Council Member Amy and Namquan run out of way to take revenge on Vice Mayor Kimberley Hall. So they brought the issue of Go Fenby into the City Council meeting, which is both against the principle, against the law, and regardless of harming people. It's a waste of taxpayer money and a waste of everyone's time. I'm sorry to say this directly to the City Council. The two council member Amy and Namguan are just two puppets. Bless up Thai upright in the City Council's diet and the string would tangle. So they still around and kick around causing the advisor of the two puppet to fall and confuse. I am finished here. My sincere thanks to everyone who has listened. Listening. Thank you. Thank you. Applause. Our next speaker is Juan Donato, followed by Dao Tran. The and the last five nine nine nine nine nine nine nine nine the last few years, I have been thinking about a great and wonderful, and a great, and a great, and a great, and a great, and a great, and a great, and a great, and a great, and a great, and a great, and a great, and a great, and a great, and a great, and a great, and be failed. La la home show. Rabin, Gwai, Tua, Chit, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, Gop, The first question of the year of the New Year is the history of the young generation of the young generation. and the and I am very grateful to the staff and the staff of the staff and the staff of the staff and the staff and the staff of the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff and the staff hearing work and community activities. I affirm one thing, regarding item 5.9, censure council member Amy is necessary and just viable. It is a lesson in the ethics of an elected official in humility and solidarity in teamwork and compliance with rules, regulations, statutes and democratic laws. Amy Fan West, during her half term as council member, was just a puppet. Disrupting the city council meetings, despite having a degree, shows her limited ability and capacity. Yet she is also arrogant, conceded, looks down on her colleagues, and puts her ego too high and destroys the unity of the council. In the past decades, there's never been an elected official who after a council meeting where her proposed item failed went on YouTube or have one of her so-called press conferences, publicly the next day to complain, condemn, and convict the members who said no to her proposed items. What a crybaby. Does she understand democracy? With the blind support of council member Nhamquan and the direction of factional forces, Ms. Amy further promoted her tyranny and blatant language exceeding the ethical and moral limits of an elected official. From the resident's perspective, center of NV Amy is appropriate and should be done quickly to end the financial and time consuming expense of the city council and residents. Council memor Amy, inserting political labels into her censure shows stubbornness, has no self-control, only wants to be a star. Anyone who objects is insulted and labeled by Amy. About item 5.10, I can say it is the mad struggle of two council members, Amy Annumquan, shamelessly and immorally. I hope you to look back at yourselves because voters hate and despise you too much. Thank you. Our next speaker is Dow Tran. Dow Tran followed by the youth media. Good evening, my and Council Members. My name is Dow Tran. And first of all, I want to talk to Council Member Amy Fanrois. I am the one who came in for you two years ago. But I can say, today, I'm very upset with your conducts and behaviors that brought to the sensor that you deserve it tonight. Remember when you teach your children, when the kindergarten, you teach them the alphabet, right? They, B, C, D, F, G. And today, when I read the start report, I can find that you violated the city of Westminster, God of ethics, all the way from A to Z, which is 26 issues. And I think you are guilty, and you deserve the censure. Getting a censure is a pain, is a pain. But you need that pain to gain. I hope you learn from your mistakes and correct yourself. So in 2026, I can campaign for you again. Okay? Now about item 510. It is so, so ridiculous. I don't know what council members, Amy and Nam Kuan thought when they brought this to the City Council. Because council members are not jurors and Mayor is not church. So this issue should bring to the court, not to the city council. So it is so ridiculous to bring it here. And I think what you need to do for two of you is when we vote for you, I campaign for both Namguan and Amy. So I can, my message for you, because you focus on the work of the city. How can you bring the benefit to the city and its resident? Thank you for listening. Thank you. Thank you for listening. Thank you for listening. Thank you for listening. Our next speaker is Kadeau, followed by Connie Cohen. Sorry about that. Oh, can you start your class again? Good evening. Well, we got July off, and this is how we start coming back with this. You know, I saw that we have quite a few items here. And most of the speeches that residents come up here are concerning with, I guess, is item 5.9 and 5.10. So I don't know if Mayor Charlie, Chen Wen would remember how you guys reduce our speaking time to take up city's business. Like I said, I don't know if this is what you really call city's business. To me, it's more like it has more to do with personal gain, personal fame, personal credit, personal shame. And since this election season, I'd like to remind if anybody, anyone remember in 2012 when I found the run. The reason I ran is I said the cities on the virtual bankruptcy, you guys have no solution and eventually 12 years later, the solution that you guys came up with is raising tax. Most of you guys are Republican. I don't know if raising tax is the solution that your party would approve. I'm glad that people are repeating the phrase that I described you guys. Why have been against you guys, condensing you guys, as public servants, as not worthy to represent us because in Vietnamese it's that Winton Phi Yeh. So you end it for the money to profit yourself, your group, racketeering. So I hope I heard that in this election, you guys are divided in the two groups. And competing to see which group is going to have the majority to control the city. So I hope you learn from Andrew Doe. The county is investigating how he spent managed $200 dollars of the Cali Span. And I hope somebody is going to pay for it with even facing charge and go to prison even. So good luck with your cronies, Jason. And I think I can describe you guys in app incompetent, ant immoral and corrupted. Thank you. All right, next speaker is Connie Cohen followed by Monique Nguyen. Good evening. First I'd like to really give Kudos thanks to the people who decided to print 5.9 and 5.10 to make it easy for the rest of us to see. There were more copies in the back when I got there so if you don't have one I can suggest you the public go get one so you're able to read along. I vote if I were a council member, I would vote to censure Amy Panoest, censure, not censor. I wanna thank the people who pointed that out. I agree 5.10, doesn't have any business here. Regarding permits for RVs, I hope you ask a lot of questions as to why staff and police department recommended 12 versus 36. As you make your decision, I have a wonder of how many days each one of those permits are for is it just for one night or is a permit for four nights. 36 nights at four nights a pop you would have a lot of people living in their RVs on our streets and I just am curious about that. I don't have any information to know when we are the other. And if I were in your shoes, I would support the Midway City Sanitary Districts ask for donation. And I would be very interested in hearing the woman who had lived in many places and returned here, finished her conversation. I have a minute 20 left if anybody wants to give her my time. Thank you. Thank you. Our next speaker is Monique Nguyen followed by Natlin. Monique Nguyen followed by Nhat Ling. Yes. Good evening, everybody. My name is Monique. I suggest definitely censure a mis-aiming West. Please, everybody, please go through the 20 plus subject that she had been violated in the past. She has been council member over a year. Any co-operate council member should be at just to the room and ethical manner. But Amy was not. Apparently she never thinks she has to share anything. We will not have to tolerate her attitude and wrong being any more day. Please send her to stop any more problem she may cause in the future. And item 510. Councilmember Amy and NAMK 1 had chosen to listen to one side of the party for the purpose to defame the vice mayor's reputation. They are together, have interfere in other people's business. And the council has no jurisdiction to any thing about that either. City council has more important thing to do than this matter. Please, Council Member Amy and NAMKWAN, you are wasting city staff time and resources. Item by ten, Council Member, please toss this item by ten aside. Thank you. Next speaker is Natlin, followed by representative from American citizen defense coalition. Xin chào, hình trưởng và hồi động thành pho-wes-minter. The government is the first to take care of the health of the country. The two young people, the three of them, the A.M. and the A.M. will take care of the health of the people and the health of the country. The government will take care of the health of the people and the health has to be able to make a decision. The National Council of the United States is not enough to express all the stubbornness and defiance of this mischievous council member. Amy is a person with an aggressive nature, insatiable ambition for power and status. Wanting to become a political star quickly using many tricks, regardless of ethics and law. Amy is someone who refuses to learn to improve her understanding when working as an elected official. But she is used every opportunity to meet businessmen, tycoons, and political needs. The fact that Amy left the city council meeting while still in session to chase after the casual business man David Zung, when he returned the certificate of merit to the city council meeting is a typical example of her this regard for city rules and also shamelessness. Amy is a rebellious council member. She always thinks she is right because her ego is too big. After every meeting of the city council and if she did not get the support for her proposed item, she had to go on YouTube channel the next day to criticize DeFam and insult her college. I think if all the council members act like Ms. Amy, how bad will our city be? Amy's proposed agenda only revolves around a yellow flag that belong to the Republic of Vietnam and lacks knowledge and understanding. Remember, Kasson, remember Amy, West is a, remember Kasson, remember Amy, West is a... remember, Council member Amy, West is a city of many ethnic cities, not just Vietnamese people, and residents need a United City Council council working together. Thank you. Singable. Applause. All right next speaker is a representative from American Citizen Defense Coalition followed by Terry Reigns. Good evening council. My name is Smithy Lou. And I came here with a friendly recommendation. I'm not here with hostility. So here's my recommendation. You all want to wait for the mayor to come back? Oh, okay. To address them. Oh, it's okay. Yeah, I'll go ahead. So you're all sitting right here. That's one body. And my recommendation is this. If it's one part of your body, it retains the other parts. What do you do? You have two options. Resolve it in private. I'll bring it out to public like this. And we all professionals, we understand how to operate this, and we know how to conduct our business, right? So my friend, recommendation to you always is tap to the sorts that put you in your seat. Every one of you here, the region is sitting here because the people vote you in, you know who they are, tap into them first, just like if you have one part of your body causing discomfort to the other part, what did you do? You go to a doctor, you don't bring it out on the street and say, oh, I eat right here and try to scratch in front of everybody. That's unprofessional. So that's my friend recommendation to all of you. Thank you. All right next week are his Terry Reigns. Three minutes 26 items, congrats officers, crews, Brutsey, Beasley and Tava for the DUI arrest recognition. Item 5.6 Mayor went to recuse himself for this item as silver or gold sponsorship but not platinum. Items 5.7 and 6.1, Council Member West should be prohibited from attending city paid conferences in addition to being removed from all internal and external committees. We don't want her representing us anywhere. She wants to go to DC to further her political career, not to help our city. Vote for Mayor Wynn and Vice Mayor Ho and or Council Member Manzo if they want to go. ICS see with a huge success with these three. Item 5.10, this isn't city business and shouldn't be discussing a city council meeting period. Christine tried with the staff report based on Amy's slanderous input but there are factual Arizona missions. I went to Amy's first press conference. There were two and viewed videos of her, Nam Kwan and many others, slandering Vice Mayor Ho and threatening to sue the city over this. I spoke to Shin, not Hassan, Amy, and whose family lives in Anaheim. Amy's slanders conspiracy theories are total BS. The funeral was paid for. Shin did sign a legally binding contract with at least one family member who present who also signed it. The beneficiary of the GF, the GoFundMe is the non-profit, Santa Procedure, so donations are tax deductible. But bottom line, the beef is between the family and the non-profit period. Show us a lit of Kimberly and Sue Hurley. 7.4 Amy, the habitual offender must recusers sell from this discussion and vote and have no input on this ordinance. Lawbreakers can't be law makers. You have all copies of the six page email I sent about the numerous errors of missions and the biggest language offering my edits. The traffic commission went against PD's recommendation of 12 permits per year. Our materially increasing to 36 push solely by Amy's brand new commissioner, Kristen Summers, no surprise, with zero justification. The chair couldn't recount the vote or ordinance details to me. Staff and PD, the experts, have research and worked on this forever. We aren't a tourist beach camping destination like I need to beach Kristen and Amy. The average California RVers take three to four trips a year with 6 is a high outlayer, assuming two permits for trip 12 is plenty. Item 5.9, staff was directed to bring back a list of internal external committees that West serves on to consider sanctions, but sanctions aren't mentioned, and there's no separate sanction item on this agenda. Who would City Hall is purposely trying to avoid or delay the sanction discussion? We've already endured four friggin' meetings about Amy's crap. Do you want more? Amy, your campaign to get people to write or speak against this or pathetic, most to live in what's Mr. have never set foot inside these chambers and haven't had to endure your narcissistic BS violation of laws and egregious behavior like we have. You lied to them saying this is to silence you. That's censor, Amy, not censure, Amy. Your naive, non-resident fans don't know the difference either, relying on your false narrative to provide their scripted comments. So go big and go home, Amy, for good. Center, Amy, fan, west, sanction, Amy, fan, west. Recall, Amy, fan, west. last. We do have one final speaker, Minteen. I am the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the first to be the and the 9th is not near the mountains, as the mountains are now. My dear N.E.M.E, I am just a tool to help you to overcome the enemy. and the government has to be responsible for the Good morning, Mayor and Council. My name is Min Thien. I think agenda item 5.9 is no brainer. The Council and the resident had had multiple discussion meeting and had wasted enough time of the city for everyone involved. The decision is clear. Councilwoman Amy needs to be censored in the hope of maybe, maybe she would stop her lie and control her big mouth. Freedom of speech does not mean that she can lie and sweat rumor about the city. The mayor and other council members, two councilwoman Amy's advantage. Councilwoman Amy abused her powers and grandstanding to make herself important. She forgot, she just a public servant. He should act like one for a chance. In the past, the people of the city, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, the government, I have been working for a long time. Good evening Mayor and Council. My name is this is regarding item 510. 510 is another example of Council members Amy and Namquan ignore about law and order. What power do you think the Westminster City Council has over what is happening to private parties? Again, Councilwoman Amy choose to listen to one party and in the process trying very hard to defame and slander the vice mayor reputation carelessly. Councilwoman Amy is no judge and she has no right. Thanks. Sorry. Thank you. Mayor, we have no further speakers. Thank you very much. Mr. Mayor, I have a brief comment. Thank you. Gigi, Hoé, Dao, Monique, Nyacklin, and Mintan, Mintin. I know that you guys mentioned that you campaigned for me. The only time I remember seeing you guys are at the Mayor Charlie event maybe twice. I walk by myself. I never see you guys walk with me so I don't know what you guys talking about. But thank you. That's okay. That's okay. That's okay. All right. You done? You done, right? Thank you. All right. Next. Well, on behalf of the city council, I would like to thank you all for coming out attending the custom meeting today. And I know that you take it out of your busy schedule to be here. We appreciate you. Listen to you. Listen to your recommendation. We will take that into consideration when we are making our decisions. So again, thank you for being here this evening. Next is a consent calendar. All matters listed under the consent calendar or considered routine and maybe approved by a single motion followed by a roll call vote? There will be no separate discussion of these items unless members of the City Council are staff. Request that specific items be removed from the consent calendar for separate action or discussion. With that, I motion to pull item 3.4. Any order? Mayor, may I pull item 3.9? 3.9? Any orders? Motion to approve the remainder. Okay, second. Motion to approve all items except for 3.4 and 3.9. I approve for a separate discussion. Thank you mayor. I have a motion made by Councillor Monzo, seconded by Mayor Winn. This is to approve the consent calendar and Councillor Kowndor and pulled items 3.4 and 3.9 for a separate discussion. I'll go at a call roll. Councilwoman Fan West. Fan West yes. Councillor Marmonzo. Yes. Councillor Berwin. Vice Mayor Ho. Yes. Emma Erwin. Yes. Motion carried 4-0. All right. Item 3.4 was pulled by me and I would like to ask for staff report. Chief, will you please present it. Good evening, Mayor, council members. This is quarter two crime statistics and compared with quarter two of 2023 last year. So we compared this time of year with last year's time of year. Violent crime did see a little over a 7% increase on our streets, specifically with homicides and robbery where the two biggest jumps. On a positive note, property crime was down almost 6%. The biggest drop there being burglary. We accredited the burglary drop for two different reasons. One was the arrest of a serial burglary that we believe was the person that burglaryized several different storage units throughout town and in other parts of Orange County. He was arrested. We also to date this year have made 22 arrests for burglary compared to the entire last year of 2023 we had 20 arrests for burglary. So our arrests are way up. I'd like to go back to our homicides because I know that's a great concern to everyone including myself. The two homicides we had, one was a homeless man that's still under investigation that I can't speak to many details about because of that investigation. And the second was a stabbing that was the one off of 21st Street where good Samaritan tried to prevent another man from being stabbed unfortunately. In that person getting involved in cost of his life and he was stabbed to death. The suspect on that one is in custody. I'm prepared to answer any of your questions at this time. I just wanted to thank you for having this report to the public. So we understand where we are compared to last year. I understand that there is something that we went out with our control. But do you take any measures to see whether we can do anything to help? Do you do is there the crowd if there's any? Thank you, Mayor. The only thing we actually do have some things in the works, they're dependent on staffing levels for us to implement. There is one other thing we are doing. We are in the final stages of completing an MOU or agreement with the feds on having a retail theft task force housed in our police department. And not only for our city but throughout Orange County. But a lot of these rings that are doing the retail theft just don't do it in one area. They are opportunists for regions. So we're looking at attacking it that way. A little long term on that, it's not going to happen tomorrow, but we're hoping it will happen by the end of the year. I know that you worked there diligently on that, so I want to thank on behalf of the City Council and I want to thank you for your leadership. Thank you. Thank you. Questions? With that, I motion to approve, the item. Seconded Motion and second on the floor I have a motion made by Mayor Wynn seconded by council member Monzo. This is to receive and file the report I've got a call roll councilwoman fan west and west yes Council member Monzo. Yes council member win. Yes, vice mayor. Ho. Yes,erroho. Yes. Mayor Wynne. Yes. Motion carried 50. Next aside, I'm a 3.9 with a Westpool by Councillor Member Menzo. So thank you, Mayor. Staff, I just had a question on the staff report and mentions the fence along the way underneath the 22 overpass at Hoover. And as I mentioned before, I think that one is just relentlessly constantly being cut. So I want to know what the plan is going forward because there's just going to be a constant problem. And what is going to be how it's addressed and how we're going to address that. Thank you, sir. In reference to item 3.9, which is related to the delegated maintenance agreement between the City of Westminster and the state of California. We are partnering closely with CalTrans on this agreement. We're also working collaboratively with City Manager's Office and Garden Grove because we have a vested interest in making sure that that entire interchange area is effectively cleaned and policed and maintained and I'm referring to beach boulevard and the 22 freeway. The area that we are looking to partner with CalTrans on is west side of beach boulevard. So if you think of the Costco business center, that strip of landscape that goes all the way to Hoover. And if you jump over the 22 freeway behind the hotels and some of the other uses on that north side of the 22, that entire area. Caltrans is responsible for it. They're supposed to come through and do it periodically. It's a big county and it takes them a while to circle back. So instead they're paying us to hire a contractor to maintain that area. And we would put up the money and then receive reimbursement. The dollar amount is based on the budget that CalTrans has to offer. So we're going to work it as much as we can to effectively maintain it on a reimbursement basis. Now as I mentioned in garden groves a little bit further ahead than we are on this, and they were great partners, and they added to their contract with CalTrans, which calls for special fencing in some Garden Grove areas. They're actually including the fencing that would prevent pedestrians from walking between the 22 freeway in the Costco Business Center and all the homes that are along there. Which is particularly impactful because it slopes up to the 22 so as folks are walking along that green belt, they're essentially looking down into people's backyards. So we're looking at fencing that area on Beach Boulevard to prevent that. And then in addition to that on Hoover, where there's already fencing, like you said, ineffective fencing that is often lifted and people access it, that is going to be replaced with high-strength fencing that has certain design features that prevent people from essentially climbing it, sticking their tennis shoes, and it and climbing up. And it's much more resistant. For many years it was not a cal-trans standard, so that fencing was not seen in cal-trans right away, but because of some of the issues we've experienced over the years, they've now added that. The flood control channels is where you probably see that type of fencing. So once that's implemented, then we'd be responsible for maintaining it, but it is high strength. And then as far as the maintenance and right now you currently have a plan in place as far as the areas and how we're going to maintain it. What about assessing it after how long, three months, four months, and then making adjustments accordingly? Yeah, we tried to get CalTrans to agree on an escalating cost and they essentially said, let's get started with it, let's monitor it. I would say realistically, within between six months and a year, we would be in a good position to say, we need additional funds to be able to maintain it to the standards that we fill are appropriate. And then we're going to be reimbursed to funds. Absolutely. And it will not take away from our staff that's very busy maintaining our city infrastructure, potholes, parks, all that stuff. That staff is going to continue to work under the direction of Jake to perform all of those duties. Jake and his team, our director public works and his team will hire a contractor that'll focus on these problem areas in state right away. Okay, and I just really concerned about this, and I'm really excited to see it. It's been a problem that we've been working on for quite a while. Yes. And quite a few angry residents along the 22 corridor there that been violated, their privacy has been violated. So I'm really hopeful that this is going to be monitored closely going forward and also keep an eye on the cost of property as well to make sure that that fence is being maintained. And if it's if any homeless individuals are going back there, make sure that we're not. Patrol, is there a way that we can keep an eye on that as well patrolling in? I mean that whole area is known as a hotspot. So that she's right here next to me. I know the HLO team is very active. They know the hotspots in the area. And we do have a good working relationship with the property owners that are impacted by such activities. And we have good relationship with Costco business center. Okay. We are excited to see that fence, I want to see that fence, what it looks like, the conditions and how it's going to work better than what's there now. Yeah, so I'm excited. Move things. On the motion to approve. Second. I have a motion made by Councillor Monso, a second made by Mayor and Wynn. This is to approve the delegated maintenance agreement between the city of Westminster and the state of California, acting by and through the Department of Transportation for litter, debris and fence maintenance along a portion of the beach boulevard. An approval increase to the revenue budget account number 51500-39069, street maintenance reimbursement other in the total amount of $25,000. An approval increase to the expenditure budget account number 51500-43090, street maintenance contractual in the amount of $25,000. I'll go to call roll. Councilman Fan West. Fan West yes. Councilmember Monzo. Yes. Councilmember Win. Vice Mayor Ho. Yes. Mayor Win. Yes. Motion carried for zero. All right. We are going to jump to 6.1. Desination of voting delegate and alternates for 2024 and you're a lick of California city, California, to be how in Sacramento, California. So with this, I want to go ahead and go first on this. Mayor, if you don't mind it. Just for the clarification for the public and council, there was a late communications memo in front of you. The location will be held in Long Beach, California. Okay, all right, thank you. So, to be held in Long Beach, okay. I want to go first on this. I was there every year. And if I don't go, yes, I don't mind to have somebody represent me as delegate but as a mayor to be at their conference. I think it's my responsibility to be as a delegate. So I hope that the council understand that and I will be there on that day to represent the city. So I'd like to be a delegate for the event. So we can move to elect two alternates if you decide to do so. I'm fine with that. I have, I'm okay know having you be the delegate Motion to that's my motion motions for me second There's a motion a second to Don't we want to discuss are you approving? Assess well, it's right now for the delegate first and then we'll talk about you alternate I thought I I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- I thought- We go to this last year we went to Sacramento and it was Charlie Mayor and then Namguang vice mayor at the time and then myself. And that was fine. I think that's whoever can make it, they should make it because that represents the City of Westminster. So it seems like for this conference that yearly that we go to, it seems like just you and I are able to go or able to make it. So don't you want representation? Because so far, I'm guessing there's other councils they will go. Where did you get that from? I don't think this is an item that we're talking about. So right now we have nobody volunteer to go, except we are discussing it right now. And I am volunteering myself to go there. That's a delegate. So for the alternate, do you wanna talk about it right now as well? Yes, if you want to, okay. I don't have anything for me. I'm available to be an alternate. I was planning on attending anyways. Okay. I will be available to if you need me. Okay. So we have two alternate. Is there any others want to be an alternate? If you want to go, I don't have to go. I should volunteer. I will withdraw my mayor. You can withdraw or if you can see. It's not a good job. Okay. So anyone else want to volunteer to be an alternate? If not, we do have, we do have, the mayor has a delegate and then two alternates, which is Council Member Menzo and Council Member West. And my clerk. Vice mayor. Oh, Vice mayor, sorry for that. So, yes are you withdraw? So we have a motion and second on the floor for the three of us to attend the conference in Long Beach, California. Do we need to have a first and a second alternate rather than just go? So just to kind of clarify this item, sorry. So the council, this takes place in the state, so there's actually no need for a council approval for you to attend. But what we're actually looking for is just the voting delegate portion of it. So all five of you are welcome to attend the conference, but this is just the voting portion. So I just wanted to make that clear in the motion that you're designating voting delegate and the alternates for voting, not attendance. Okay, understand. Okay, thank you. Now that the CD-20 raise the question that we have to have the first alternate a second. Yeah, because if for some reason you're ill that day, who would be the person to step in and vote for you? Okay, if that's the case then between the two who? Vice mayor. Vice mayor's, you know, next in line will be a vice mayor. So vice mayor, I would say that vice mayor is going to be the first alternate. Is there any objection to that? No, except. Okay. All right, so motion is taken on the floor. And then the second alternate was the second alternate would be council member West. Okay. All right. And the second agrees to that. All right. All right. Okay. I have a motion made by Councilmember Monzo, seconded by Vice Mayor Hill. This is to appoint Mayor Wynne as the voting delegate and to appoint Vice Mayor Hill as the first alternate and Councilwoman Van West as the second alternate. I'll go to call roll. Councilman Van West. Van West yes. Councillor Member Monzo. Yes. Councillor Member Wynne. Yes. Vice Mayor Hill. Yes. Mayor Wynne. Yes. Motion carried 50. 7.1 appointment of 13 members to the youth committee. So this is staff. Who represent who represent this otherwise I move to approve. Second. I have a motion made by Airne, seconded by Councillor Romanzo. This is to select and appoint the members of the youth committee for the term expiring June 30th, 2025 as outlined in your staff report. I'll call roll. Councillor Wynne, Van West. Councillor Romanzo. Yes. Councillor Wynne. Yes. Vice Mayor Hill. Yes mayor hope yes mayor win. Yes motion carried by zero Next is to point to appointment to planning commissioner and I know that this is One member from the vice mayor can be the whole point T so You recognize yes, thank you. Thank you mayor First of all, I'd like to thank my applicants. I do appreciate you. I know we only have one spot unfortunately. And this is mid year and so you would be serving the remainder of the year due to the resignation of Commissioner Jameson Power from what I understand. Commissioner Power is moving to Thant Valley and so therefore he really wanted to stay, but unfortunately he will be out of our city. So with that, I'd like to appoint Miss Laura Rose. Thank you for applying and I thank you for serving. And I would like to wish you luck. It is a very important position. You make final decisions probably most of the time. So I look forward to your service. Thank you. Is that a motion? That's motion from you, Vice Mayor. Yes, I'd like to motion. Second to that. Second. Thank you. I have a motion made by Vice Mayor Ho, seconded by Mayor Nguyen. This is to appoint Laura Rose to the Planning Commission. For a term ending in December 2024, waving other applicable requirements. I'll go ahead and call roll. Councilwoman Fanwhats. Yes. Council Member Monzo. Yes. Council Member fanwrest. Yes. Councilmember Monzo. Yes. Councilmember Wayne. Yes. Vice Mayor Ho. Yes. And Mayor Wayne. Yes. Five zero motion carried. Seven point three. Request to is parking restriction on one rose at Liberty Park access drive way. TC 77 dash 123. I'd like to ask for a stop report, please. Thank you, Mayor. You want to go ahead? Go for it. We're leaving Mayor, Vice Mayor and Council Members. This is a request for the parking restrictions at a driveway that's going to continue this Liberty Park. This driveway been used by City Maintenance staff and as well as Police Department. A maintenance staff just going into the park every day for pick up a trash, clean up the restroom. And also our Police Department using this driveway basically to do a safety check of the park. We do have an issue with vehicles that park very close to the driveway so it's very make it very difficult for staff to get in and get out every time we be in there. So this item has been presented to the traffic commission on July 27th and at the meeting there's nobody spoke against this request and the traffic commission you know end up approving this request to install five feet on both sides of the driveway for you know better maneuver for city staff. I will open up for a question but I will move to approve. Seconded. Okay. Motion in second on the floor. I have a motion made by Mayor Wynn, seconded by Councillor Monzo. This is to adopt a resolution entitled a resolution of the mayor and city council of the city of Westminster, California, providing for no parking or stopping at a certain location on the east side of Monroe Street at 19th Street. I'll call a call roll. Councilman fan west. Councilman for Monzo. Yes. Councilman for Win. Yes. Vice Mayor Ho. Yes. Mayor Win. Yes. Motion carried for zero. Five. Five point nine resolution to censure Council. We're still doing 7.4. We do 7.4? No. I check markets. All right. 7.4 introduced the first reading and ordinance. Section 10.44.050 and adding section 10.44.25. The Westminster Municipal Court relating to the permit requirements for the parking of procreation vehicles. So I may ask for a stop report please? Could it be Mayor of isolated area? Councillor Emiffin, West recruits the software right away. No, she's just not here. She needs to but she's not here. Okay, I want to make sure. Senior Attorney, I want to ask you for your advice if the council member West need to recuse herself on this item. Well recusals required if you would have a financial interest that conflicts with what's being discussed. In this case we're talking about an ordinance that would affect RVs. So I think it's been intimated that she may have a business that does business in town related to RVs in which case the recommendation would be to recuse. But ultimately the decision to recuse or not is up to the councilman of themselves. And so I present that for their consideration. Mr. Weatherman, she has a full concern about this. I have a question. Okay. City Attorney, does that also apply to family members having a financial benefit? Yeah, under state law it applies to interest of the public official. There's spouse or any dependents. Okay. So we want to make sure that there's evidence online that shows that there is financial monetary benefit to a member of Miss West's family. So I would suggest recuse. Okay. So Councilmember West, is your decision? You know, no. Christian sent me today a message regarding the ordinance and asking me if there's conflict of interest and I text back and see there's no conflict of interest. So yeah. Thank you. All right. Okay. All right. Thank you. So, I'm sorry, please. It's council decision at this time. So I may ask for the staff report, please. Good evening, Mayor, Vice Mayor and City Council. My name is Veronica Johnson. Management analyst. Please, please, quiet. If you need to discuss something that I suggest you can discuss that. Can I just clarify for the audience because I see they're all shaking their heads. The decision to recuse is incumbent on the public official. They make the decision. You don't force them out. So they look at the facts and they make the decision. So I'm just want to clarify. All right, thank you very much. So please go ahead. Today we're here to talk about the proposed ordinance for the recreational vehicles and permit parking. The issues with the RVs on our city streets has been ongoing for many years. Many complaints and concerns have come through the traffic engineering and traffic enforcement divisions throughout the years. RV issues in the city were first addressed in 2012 by amending the Westminster Municipal Code for large, oversized vehicles to include RVs and restrict them to a maximum of 24 hours for the purpose of loading and unloading. People were quick to realize that as long as they moved the RVs some distance within that 24 hours they were in compliance with the code. The code was then amended to restrict RVs from returning to within two tenths of a mile of the previous location for at least 24 hours. The conversation regarding our fees began again in 2020 with it appearing on our traffic committee agenda, but we know what happened in 2020 and it delayed everything. It did, so it did come back, but it did, the conversation has never really stopped, so it really did come up in 2020. So Commander Drinden and I presented the item to our traffic commission on June 27th, 2024. The traffic commission is a recommending body, so that's why we bring the traffic commission recommendation to the mayor and city council today to adopt the proposed ordinance. The proposed ordinance is proposing to amend section 10.44050 and adding 10.44.25. This would require permits in order to park an RBI on a city street and it would lay out the permit procedures and regulations for the permits. Many adjacent cities around Westminster have an inactive law restricting recreational vehicles on public streets and requiring permits. As we said, the currently the Westminster Municipal Code only limits RV parking to 24 hours, meaning that they can park in one area for 24 hours, move it to a mile, park in another area for 24 hours, and continue that throughout the city. Because every city surrounding us requires permits, we have learned that people have been using our city streets. Non-resident have been using our city streets in order to store their RV to avoid storage fees. So these RV's MP visibility for smaller vehicles, pedestrians and bicycles. It deteriorates our roadways and increases light in neighborhoods. It's also a safety concern for children playing around these vehicles. The proposed ordinance is not intended to punish or make it more difficult for our residents, but rather to protect our residents and our city streets for Westminster residents. The Westminster Police Traffic Bureau, Traffic Engineering Division and the City of Terny's office worked closely together to discuss the parameters of a comprehensive RV parking permit. Items discussed include the time limits, the maximum permits allowed for calendar year, application and fees, restricted locations. We had discussions with RV owners, we've had discussions with even staff members who own RVs about what the parameters or what a permit system would look like. I'll turn it over to Commander Dernan to discuss items regarding the municipal code. Good evening, Mayor, Vice Mayor and Council members. I'm Commander Draining from the Westminster Police Department. As we look currently at what Veronica mentioned, section 10.44.050. Currently as stated, it states that no recreational vehicle can park on any street or alley for more than 24 consecutive hours. What we're looking to do to add to that what's being proposed is to enact this section where the residents of Westminster can obtain RV parking permits from the police department which in the police department from specifically the traffic division which I manage. And in looking at the new section that we want to add 10.44.245, one of the things that we're going to highlight in that particular section is clearly defining what a recreational vehicle is, per the California vehicle code, which states that a recreational vehicle is a motor home, house car, travel trailer, truck camper, or camp trailer, with or without motive power designed for human habitation or other occupancy. So that'll be clearly defined in that particular section that we wanna add as well. It will also implement and elaborate on the, how the members of the community would go about obtaining the parking permit from the police department. Which essentially would consist of an application process us ensuring that they are in fact residents of the city and they would have to show proof of all of that as well. And in conjunction with providing some sort of government issued ID. Another thing that we would add in that would be as I mentioned the application and payment process for temporary permits from the police department. As it stands right now the permits are not going through there's not going to be any cost for that. That verbiage was left in there in the event that council wants to entertain the idea of charging for those permits in the future. And I covered the application process. Once the application is completed they would have to show some sort of government issued ID, proof of residency such as a utility bill, vehicle registration to show that they are in fact the registered owner of the motor home or a rental agreement in the event that they rented the motor home that they don't own. The next slide that you got everyone sees up there as a chart. As Veronica mentioned, we've done our homework on all of this and we reached out to our neighboring cities and looked at what their permit time limits and the number of permits that some cities have in the surrounding area and you can see those numbers there and then the proposed restrictions for the City of Westminster as well. To add to this you can see that the proposed restrictions that we're bringing before you today from the traffic commission are 36 recommended permits. Staff did recommend 12 permits, but as the commission is a public hearing body, we do encourage them when they do receive their packets to go out into the neighbourhoods to discuss the items with their Neighbors to get feedback from their neighbors to look at the items that are being proposed and it was brought back There was a concern that 12 was not going to be enough So it was recommended that they that we do increase the the amount of permits to 36 But of course this again is the recommendation and is up to the Mayor and City Council to make the final decision on that. As you can see this on this page, we did survey the surrounding cities. As you can see, the first column you will see other than city is the permit duration, which is the maximum duration of 48 hours and 72-72 further down. The third column in is the number of permits allowed for a 12-month period. As you can see, one of the park allows six permits per month at a maximum of 48 hours. So we're looking at 12 days per 12 permits a year. So based on that our recommendation or our trust commission's recommendation our permit duration is only for one day with a non consecutive day in between. How does that work? We don't expect people to call us on their vacation and let us know when they're returning. We are proposing that only one permit be issued at a time per address, but that's only per calendar day. We're not expecting them to foresee into the future. If they, when they request their permit is going to be, I'm requesting my permit for Friday, we do ask for a time because the 24 hour period is going to be, I'm requesting my permit for Friday. We do ask for time because the 24 hour period is gonna be contingent on that time. So if they're gonna say we need a permit for Friday at 12, that's when I'm gonna pick up my RVM, leave it on the street. It's gonna be good for the following 12 noon, and that's the 24 hour period. At that time they can also request their return trip. If they say I'm going to come back a week from now, we will issue that permit. So the one permit per address at a time is contingent on one day at a time. So what we didn't want is that one resident asks for various permits for various RVs on one day. That's what we're trying to stay away from. Currently as Commander-in-Chief said, no fees being proposed. That's also in line with our surrounding cities. No one charges for a permit at this time. We did leave it as part of the ordinance as we left it as part of our permit parking districts should the council lever decide to charge for these permits the the ordinance does not need to be revised it just needs to be adopted by resolution should this be adopted we will be erecting signs within the city these are some samples of some signs within our neighboring cities we are are proposing that the signage be at every entrance to the city. This is also continuing what other cities do. It's also consistent with our street sweepable signage we do. We do entrances to every neighborhood. So we're not going to have signs on every single city street. We are going to have it at every entrance to the city. And basically what this is going to look like if this is approved by the mayor and city council members is after the second reading in August, we would immediately begin outreach from now until as early as January was, is when we feel comfortable kind of unpacking this thing between now and then for the community. And that would be in terms of outreach that would be the calls for service that we get related to RVs or motor homes is public education. Hey, this is what's coming as early as January or once we figure out what that date's going to be. And this is what you guys, everyone can expect in regards to how to get the permits and what's not going to be allowed. I'm just reiterating the installation of the new signs at all the city entrances and an update on the citation amount which would be brought to council at a later date in regards to the citation amount. From now on or until that outreach begins until the end of the year as early as January 1st, that would kind of be the grace period which we feel if this was to go or be approved, and after the second reading in August, they would have a couple of months to kind of wrap their head around and give us plenty of time to finish the outreach and then start enforcement as early as January. So the final recommended action is that the traffic commission recommends that the mayor and city council members adopt the proposed ordinance for our be permit parking in the city. Before I open up for questions from the council, I'd like to ask, there's one, can you come back to the proposed from staff for how many that slide I don't know was slide I forgot to slide numbers that this one the one with the proposed permits yeah the proposal in the screen back on what's What's line up is that? Sorry I should. That's okay. Okay, this one. Yes. I know that traffic commissioner would recommend 36. But stop recommended a maximum of 12 per minute, 12 months period. I understand from your stopping work, I am concerned that there were number of, I wasn't concerned about safety as well as the number of people from other cities that came over in the camp at our city. I understand that and can you explain why staff recommended the maximum of 12 permit for calendar year. Sure. Well, in speaking with the police department and along with traffic engineering division and speaking with RV owners and users, it was discussed that the maximum number that the average number that a RV is RV user is taking on a trip, it's about six per year. So that's six trips to get your ARB here, six trips to unload it. We want to keep in mind that this is only supposed to be for loading and unloading only. You're not supposed to be vacationing here on the streets. And that was the consensus of a good starting Number was 12 and when we looked at our our resident our neighboring cities It it was pretty in line with what they're offering also but in that with the traffic commissioners when they were speaking to their residents and their neighbors If there was a concern that what happens if I need more? What happens, there was talk about what happens if there's more needed. So 36 was just something that they threw out and because it's not a something that's based on law, it's every city is different. We do entertain the option of bringing back a recommendation that doesn't quite fall into line with what staff recommends because it's not a legal matter. Should it have been something where it's a something on policy and it's really back in white, say a speed limit where our hands are really tied we would have Let them know that it's not something that we would recommend at that point All right, thank you at this time. I would like to open up for our council discussion. So Mayor can I go for yes? Yes, I'm in so thank you mayor Yeah, I mean that with this particular item. I mean, there's, I think, is a really sensitive item. I'm sure step is aware of issues in other cities regarding RVs and the negative impacts that they pose to those particular cities. One city that I can think of is I visited this city when my daughter was going to college there was San Francisco and there they had a major major problem with RVs and completely blighted that whole I mean multiple streets were not only residents but college kids were in fear of walking streets, especially after dark. And then also recently in the news, it been some more nearby cities who are being affected by this. And they just started now recently enforcing and ticketing and towing RVs in those particular cities. So when I know, as you mentioned, that you really started working on this issue, I thought you said 2012. I want to say it and you restarted it again in 2020. So you've been doing a lot of homework. I'm assuming. Right? And one of the questions I have is from what I understand in reading and seeing what I heard about the traffic commission, only one particular commissioner really had input and others did not. Is that the case? We only have three commissioners at our commission meeting. is that the case? We only have three commissioners at our commission meeting. Our regular commission meeting was canceled due to a special council meeting. So we did transfer it. We did switch it over to a Thursday. We only got three commissioners to show up, which was a quorum. One was more vocal than the others, but the chair also, the chair was the one that actually proposed the 36 permits, and the other commissioner also supported the item. Okay. And one of the things we're trying to avoid also is that you mentioned you're not supposed to vacation on the public streets. And then the other one is storing the store in our views on public streets. And one of the things to me it's a major thing is life and safety issue with visibility. Vehicles exiting streets and creating these vehicles creating blind sides. So that's a major issue issue. I was looking at the, it's going through your numbers here as far as, uh, right on one through 17 as far as the conditions and what it would look like. And I agree with most of them except I just have a really issues with the traffic commission going against the recommendation of staff that's been studying this issue for many years. And the traffic commission is just there so or whatever they got their staff report to do that so I have an issue with the 36 consecutive days because I really goes against what we're trying to avoid as a city to creating these negative impacts to our community. They would be non consecutive days. Yeah but the negative impacts that having vehiclesicles store the multiple days at a time And then the other issue I saw that I don't agree with is the distance The two tenths of a mile I don't come in since they take the you're not gonna park your RV Two tenths of a mile away and load and unload from that fall away from your home take a look at the process. The process takes a lot of time. The process takes a lot of time. The process takes a lot of time. The process takes a lot of time. The process takes a lot of time. The process takes a lot of time. The process takes a lot of time. The process takes a lot of time. The process takes a lot of time. The process takes a lot of time. The process takes a lot of time. I just wanted as close as possible to where you're gonna be loading it and unloading it. So my recommendation with that, and I was just looking at just some comments and saying, so looking at what a thousand feet looks like and what 500 feet looks like. And I think that's another point, they need to be an actual number that's easy to understand like a feet wipe. So I put that on the text. I started saying it being too tense of a mile. I wanted to be, you know, in my recommendation is 500 feet. To state 500 feet. There will be, if I can add, there will be a information page, landing page on our website that's going to take, it's going to break it down to a much more digestible Simple process Different than the ordinance, but we hear you loud and clear people reference feet not miles, especially fractions of miles. Yeah Splay of RV false Display of a false RV parking permit constitutes grounds for disqualification from obtaining another permit for one year So is that something you feel comfortable with and how will we how will we Police that part of it, you know without getting into too much of the details we have operated to successful permit parking districts in the city for About decade now. And we have it down to pretty much an exact science where we get a phone call or an email. And then we issue a permit that has a randomly generated code. And then that is shown on the permit that the resident displays on their dash. Our parking enforcement have the address, information, and that's secret code. And each time it's randomly generated by a computer. So those codes don't match up, then we have a forfeit, we have a counterfeit permit, and we'll act upon it accordingly. Our staff would have that in through the old scanner check here. They will verify the number they see versus the number that's sent to the parking enforcement officers I would say that in the decade we've had the system in place We've had to knock on some doors and let them know that we're on to them But it but quickly the word gets out there and and we rarely have issues with counterfeits and then a reading items one through 17 I want thing that came to mind and I don't know if this is something that's already in staff and took this into account, is that when that particular, if an applicant came to apply for this permit, if they have an outstanding parking ticket that hasn't been paid, then I think that that will constitute and not be any recall of five for a permit. Can we talk about that? Do you have an opinion on that? I think the biggest issue that we're going to see with that is if what happens with the DMV is if they have that many parking citations on file that they haven't paid, they're not going to be allowed to register. They're not going to be able to renew the registration on their vehicle. So if it does end up, if DMV ends up missing it, we do have the capabilities of when we run the license plate on the vehicle of figuring that out as well, sir. My question is when they come to the traffic wherever they come to apply for this permit, when they, whatever information they give, you know, address, name, you know, ID, it doesn't come, at that point it doesn't come up that there's an outstanding parking ticket on pay. So in the application process, when they bring in their government ID, it's going to have their photo on it. They'll also bring in a proof of residency, a registration of the vehicle. Before we issue the permit to that resident, we will of course run the vehicle that they're trying to get the permit for to confirm that it is in fact that everything is lining up. And it's at that point that we'll be able to determine how many parking citations they have on file. Okay, but my question issue we not add is not a good idea to, as I think if they have outstanding parking, unpaid parking, and specifically for RVs, unpaid parking citations, that they would not be issued a parking permit for RV. I think we feel more comfortable if our city attorney waiting on that question. Yes. Well, arguably if you have citations on the RV that would be grounds for refusing this permit, that's what I'm getting at. It's discretionary in the sense that this program. So can we, it doesn not make sense to add that on to your on here? We can add that on that landing page that Assistant City manager was talking about so that'll be clear before they even come in I would like to make sure that we had that on there. Yeah, I think that it would tie it to the RV at issue Yes, but not to you know because your child might have to yes. No, no Just this the RV for for what's being applied for. In New York, yes or no? The RV had issues. So those are my, so you say any other. Yes, so I just want to make sure that we have, again, my point across, that my motion is going to be to include the items, but the maximum would be for 12 as recommended by staff through their thorough research and to maintain it at the 24 hour and to add that outstanding parking citation to make that item number 18 on the area. So that is going to be my motion mayor. Thank you very much. I want to hear from other council before we can take action on that. Thank you. Any question from the council? Thank you, Mr. Mayor. So I have a question for DARREN, Commander DARREN, right? So when you mention on the slide, let me see, municipal code under that. And I think you mention they have to get a permit for RVs, big trucks, cars, vehicle as well, or just RVs only. What I was referencing was strictly from the California vehicle code and what that definition of a recreational vehicle is which was a motor home house car, travel trailer, truck camper or camp trailer with or without, motive powered, designed for human habitation or other occupancy. So when you say house vehicle, house car, are you talking about like a Jeep? Something that's able to be a porch? Or? That's able to be habit where they can live in. Okay, so any car that people can live in, I mean, people can live in any kind of car. If you think about it, two doors. So that's kind of like restriction to other residents who are in the district that they have to get a permit for their own car. But then of course they're not going to live in it. So how do you determine which car they're living in, which car they're just parking outside like normal parking? So I think the definition of, to elaborate on the definition, it's a motor vehicle with living quarters, right? So like a bed, most cars don't have beds. So this is... Right, you know how we do see people who sometimes stay in their car for the night or whatever reason. We have seen and heard that they became homeless or something and they're just sleeping in their car for the night or whatever it is, right? So does that mean that you're going to kick those homeless people for the day out? I mean, I feel like there's going to be loss here from the ACLU on this. So what do you mean? Because that seems. So just kind of elaborating on the definition of a recreational vehicle and what the definition of a motor vehicle is in the California vehicle code, a recreational vehicle like Doppel just mentioned're homeless and they're living in their car. There's no living quarters in there. They may be sleeping in the vehicle, they may have their belongings in there. There's no human habitation or there's no living quarters inside that vehicle like there is It's clearly defined in the definition in the vehicle code for a recreational vehicle When you say living quarters meaning their belongings their section out of like You know there's many things that they can buy an Amazon for a little bed or whatever You know cushion or whatever is that what you're saying? No, I'm talking specifically like a recreational vehicle that has an established bed and there's a kitchen. There's the things that recreational vehicles that campers have that clearly defined motor vehicles defined by the California vehicle code don't have So basically What I'm seeing is that in the even neighboring city in the city of Hunten Beach We have a lot of are you talking about the stout camper van that big one that they have like some time There's no toilet, but maybe just a sink and so they can go down to the beach to watch the air show and they have their van there. Are you talking about something like that? That will be ticketed in our city. If the vehicle in question has established living quarters in it then they're going to be required to apply for a permit and they have to live in the city of Westminster in order to get it. Okay. That's a more proposed. So that's good. Thanks for verifying that. Now when you're talking about getting the permit, so everyone has to go to the Westminster PD to obtain the permit for 24 hours. That's correct. Correct. Okay. is Westminster PD to obtain the permit for 24 hours. That correct? Correct. Okay. So I'm looking at your chart. And I notice our neighboring cities, which is very close to the garden growth in Hunting Beach and Hunting Beach have a very huge population than us as well as Garden Grove. They have a permit duration of 72 hours maximum. And then of course, Hunting Beach has 144 days more than what the commissioner suggests of 36. Now, I know that they don't really have that problem because they have that permit of 72 is reasonable for the people who live in the city of Puntum Beach in Garing Grove. I've talked to the council member in both city and they don't have those issue within 72 because they're not. I understand, Mr. Mayor. I'm just addressing the inconvenience of going to Westminster PD, resident Westminster, getting their RV out of their facility, parking facility. And go to the city of Westminster, get the permit in 24 hours. I feel like it's just a hassle and a rush. And then each time they do go, I mean, it seems like such a hassle when it's 72 in mixed sense. And of course, I don't see Hunting Beach or Garden Grove or Stanton ever have those problems. They get the permit and it's noted, you know what I mean? So I feel like what we're trying to do is make it very difficult and trust me. I know that the resident of Westminster will rise up on this issue and say why are you becoming a dictator, a socialist kind of like controlling where they, I mean, reasonable is 72, right? And then the other thing too with parking in the Sierra Westminster we all know in Orange County Sometime with the high density that the state of California requiring us to build housing with no parking Is getting to be where an area where we can't just park right in front of our home Like in district one we have other air and Moran sheet, right? And if they bring the RV they have to park a little farther because they're fighting for space. So I feel like what Mr. Menzer was talking about, what you guys put in there is reasonable because we have to factor in that sometimes the resident cannot park right in front of the home. They have to park three, four cars away just because they're fighting over parking, right? In certain areas. So I think we have to be reasonable in our parking and ordinance because the people are gonna be very upset. And especially in those areas like Moran, you know, Street and you know, we know other area in Locust, Street, and whatnot, you know, I just feel like if we're going to do this, we have to factor that into our city. If I can clarify a few of the things, keep in track of some of the topics you brought up. So I've been doing this dealing with traffic matters for the better part of 20 years now. So when we do propose some of these solutions, we're really looking back at the specific needs of our community. Referencing adjacent communities is important just as a reference, but really we feel that our historical knowledge of the issues in the city that go back to 2000, 2005 when I first started here. Folks were very concerned about RVs being on the street for more than 24 hours. And that's one of the reasons that the previous council in 2012 went ahead and said, you know what, we feel that RVs should only be on the street for 24 hours. So based on all of that input that was gathered by the community back in 2012, we feel that that needs to be presented to you. And that's the reason we landed on the 24 hours. I do agree with you about having to come to PD each time that's not the intent of the program. The other permit districts that we operate, you only had to do that the first time. Come to PD the first time, get all information put you in our system and then once you're in our system a folks said Can you can we do this over email? We said yes, and it's been working over email the entire time So they would be able to email it we email them back It's your experience in the past in the city Westminster That's what we currently do in the parking district They only had to come into city hall one time to register there You know get the information show them the documentation and then after that, they're in the system, they can do this over email. So just to clarify that. So maybe if we can put clarification on that, the first time initial to the Westminster PD to register your RV. We can definitely add that to the application process. Yeah. Okay, thank you. the rest of your RV. We can definitely add that to the application process. Yeah. Okay. Thank you. And then also the other thing too, I'm concerned is that Garden Grove, Huntington Beach, Damton, Seal Beach, even other area where they say, you know, option permit duration, say for example, Seal Beach, which is a couple of two cities from us here. 24 hours and the max is 72, but it seems like all of this is 72 hours. It's very reasonable. Why are we more stricter or more? I thought usually we kind of work with our neighbor in the city, where it's kind of similar, whatever agenda or ordinance we have, the bicycle or whatever it is, it's still the same similar to Huntson Beach, similar to Garne Grove, you know, Stanton, what not. But I feel like if we are being deconium and strict like this, it's going to be very, there's no way, like room for the resident. So I think it's reasonable to say up to 72 hours. Maybe you can put first 24 hours, but up to 72 hours, if maybe like Conten Beach, they go, can you have an option of 24 hour permit if you need that? If you need something to yes, up to max, that's it. Get that permit, that's it it so I think that's very reasonable That if we can do something like that like Hanson Beach, I think it's very reasonable. Yes It's up to council or decision to be honest with you. I understand I appreciate for all the questions that you have But I would like to have to hear it from, I don't have anything. But I want to hear it from the other council before we, you know, it's a good time for you to ask questions. So anything else from any council member here? I think you already spoke. I'm good. Thank you so much. Thank you staff. It's very clear. And I thank you for spoke. I'm good, thank you so much. Thank you staff, it's very clear. And I thank you for the other studies. You know, so Mr. Veronica, Johnson there. Thank you. Okay, what about council member? Yeah, thank you, Mr. Mayor. You know what, upon hearing council member Mendoza and the council, we found West talking about this item, I have my own question and suggestion. We are here to serve the community. We make it easier for our residents to to enjoy their life. And everything I see here is, you know, we create more trouble for the residents not to make, you know, their life more easier. So I don't want to, you know, sacrifice something for another. Just took a look at the table right here. All the cities around us, they have, I think, reasonable number. Why we make it more difficult for the resident, 24 and 12. Let me make it clear. Why don't we compromise here? I suggest like a 48 hours duration and 24 for the number per 12 months period. So that's my suggestion. Moreover, let me ask you this question. So if my friend came over from somewhere else and you know, my friend driving an RV. How can he stay at my house and park in front of my house? Do you ever Encounter that situation? I Think by allowing that to happen. I think we're going to start gravitating back to a little bit of the problem that we're having right now with all of these Motorhomes that are not residents of the problem that we're having right now with all of these motor homes that are not residents of the city. When we did the research on this and what we ended up coming up with is that the permits are going to be strictly for the residents in the city. As they're the ones like was mentioned several times before, if they want to utilize their motorhome, if we allow this to happen, we feel it's just going to take up additional parking and it's going to be more of an inconvenience for the residents. So we did agree upon just making the permits for the residents of the the city was minster only. But I know that just make it easier for us to make it safer, but why don't we create some exception for just a case that I just mentioned. So if my friend came over and then I want to register for him to park in front of my house, can I do that? Because right now, my name is not in the registration. So there's no way for my friend to visit me and park in front of my house. Is that reason over to you? No sir, as indicated, we wanted to keep the permits strictly for the residents because we just feel that if we allow everyone to do that then we're going to start moving back to the problem that we're having now. I've specifically seen incidents and talked to people from other cities who, because our city is one of the only ones around, especially the ones that we've, when we were doing our research, that did not have a permit system and what ends up happening is in a situation like that is a friend of a friend will get a permit for someone to come park through our B&R city. People are already parking their RVs in our community right now in various locations that I'm sure a lot of you guys have already seen. And it's really problematic for us. It calls for an extreme amount of calls for service when our police officers can be handling priority one calls and doing something better to serve the community than trying to track down the owners of the RVs and whatnot. That's where we landed and unfortunately, that was our recommendation. All right, thank you. Thank you. I have a question. I have a question. So myself, please, go ahead. Okay, so do we have a motion on a floor? Not yet, it's my turn. But I thought that... I was in plan to talk on this after you then I like to make my comments. Number one customer when I don't think is a staff trying to make a difficult, difficult east for the cities and the over for the resident, what's the residence? I think they trying to find a better way to manage the city in terms of, you know, other vehicles parking, other recreation to vehicles parking in our city. That's one thing. The second thing is I want to make sure that you mentioned that it make it difficult for the residents and you concerned for the resident. I don't think that this concern, if there is a concern from the resident, they are out here today talking about it already. I happen to see none of them talking about this item. I'm worried about having limited the number of hours or number of times to part of vehicles in our city. So I know that I'm concerned about the safety of our children. If they pop there, they make black, the car coming forth. So those are the things that I'm worried about. So at this time, I know that we have the motion on the floor. Mr. Mayor, I have one last question for the patient. Thank you. Let's see. Let's have last question then. Thank you, Mr. Mayor. So on the note of Namguang Councilman regarding his friend come to visit, since you did a last study, what is Hunter and Beach implementing for if a friend come with his stone-go van for visiting? Do they have a permit right now for a friend or how does that work do you know so we Did we did not we did not Learn every aspect of every cities way of doing business. We just know that Based on the problem we were please try again based on the problem that we're trying to mitigate That would create a problem for us. So we're not the only city that would not allow visitors to obtain a permit. Other cities don't, you know, are more restrictive than us. Other cities don't have permits, don't allow RVs period on the street. So we didn't really talk about those other extremes. We're kind of still in the middle. So we have the motion on the floor. It seems like You cannot, Hunts and Beach, you don't know right now, Hunts and Beach, you don't know what they're doing with guests permit. We know that visitors and outside folks parking in our city creates a problem and that's why our code, our recommendation discourages that or does not include that. We're mitigating that. Okay, so you don't know what Hanson-Beech is doing with their guest permit. We do not know. Thank you. You're correct. Okay. So my substitute motion, since you have a motion. I don't think we have a motion. Yes, we do. I made a motion. I don't have a second. You'll have a follow-up question that I jotted it down. I forgot to ask. So the permit's going to, you mentioned the permit's going to be per adress, correct? Yes, sir. So what happens when there's multiple, if there's multiple RVs per one adress, Veronica? So it was discussed and say there happens to be roommates. And both of you own an RV, you would have to share the number of permits allowed per that address. And it cannot be on the same day. So if one was coming on Friday, only one can come on Friday. The next one has to come at least two days later. And that was decided that they were going to have to share the permit. So when we have a multiple, which we don't see very often when we discuss the owners and the operators of RVs within our city, most RV owners have parking on site. Most of them are storing them at an RV park. We don't see a lot of RVs being parked on the street. The only ones, the majority of the ones that we've encountered have been from other cities. When we've talked to them, when PD has gone out to run their plates, they've been from Seal Beach. They've been from Los Alamedos. We've had admitted people come in and say, I can't get a permit in my city. I know you don't require a permit. That's why I'm here on Garden Grove Boulevard, on Melanie, or on anywhere on our street. So it was discussed and it was decided that multiple RVs at one address would have to share the number. Okay, thank you. And just on the point of my colleagues here, for an example, as you just mentioned, if your most RV owners usually have somewhere to park their RV on their property, not on the street. For example, my neighbors, they have RVs, they park them on the side of the house, they have an RV parking or on the driveway. My family has one of my sister and I has an RV when she comes to visit us. She stays in her RVs, but you know where she stays? I had an RV park. Three, four miles down the street where you got to pay there and she has full hookups where she's living in her RV while she's visiting us. And they have a vehicle they, you know, they tow. So that's people following the rules, people being considered of others to park their RV at a RV park when they're visiting. And if you own one or you're my neighbor, his brother visits him from out of state. When he comes in, he parks his RV on his brother's driveway, not on this public street. And that's typically the way he's done. Not trying to take advantage of the neighbors because now we have this new thing called ADUs. And there's no parking on the streets and sometimes in especially on my street that people who live in the ADU not only are they fighting the neighbors for parking but they're also fighting their own people in the front unit for parking. So having a RV is a detriment to the neighbors as well. So again, I'm going to repeat my motion. My motion was to go with the recommended staff of 12 days and the 24 hours that's recommended by staff and to go with the 500 foot max distance and to add if there's outstanding unpaid RV parking citations that would negate the issue in civil RV parking permit. That's a second to that motion. are we parking permit? Yes. Mr. Chair, second to that motion. I subsecure motion. Seconded motion. Okay. Is there any substitute motion to that? I substitute motion to, since we have two neighboring city, Stanton, Hunton Beach, Garden Grove, they're pretty much doing the same thing of 72 hours. So I substitute motion for 72 hours per minute and then keep the 36 per minute calendar year versus Hunting Beach 144 days. We can do 36 so that's my substitute motion. Any second to the substitute motion? I second. Can I speak something? Yes, please. This is like to answer my colleagues' and the Colossment. So not a lot of people fortunate to own a house like you. Okay. So I think you should think for the people, not yourself. All right. I think we each have a second rail already. And we have the subsidy board. We have the subsidy motion. And the subsidy motion not well off, you know. Here's the one that's running a business in parking in the streets. I don't know if you're talking about. If you guys continue to talk about this, then I will move to call for questions. Okay, so we are not, so go ahead and move. Go on call for a separate motion first. Thank you, Mayor. I would substitute motion made by Councilwoman Fan West, seconded by Councilmember Nguyen. This is to make a 72-hour permit and keep the 36-perman calendar year. I'll go to call roll. Councilwoman Fan West. Fan West, yes. Councilmember Monzo. No. Councilmember Wynne. Yes. Vice Mayor Ho. No. Mayor Wynne. No. Motion failed. Two-three. We'll back to our motion. Yes. So the original motion on the floor is made by Councillor Monzo. This is to go with staff recommendation of 12 days and 24 hours. Have a 500 foot max distance and add if there's any outstanding unpaid RV parking citations that they're not eligible for a parking permit. I'll go to call roll. Councilwoman Fanowes? No. Councilmember Monzo? Yes. Councilmember Wynne? No. Vice Mayor Hoh? Yes. Mayor Wynne? Yes. Motion carried. Free two. Next item is 5.9. Resolution to censure Councilwoman Amy from the district one. Mayor, I thought it's mayor. I'm sorry. 10. Mayor. For 7.4 may I please read the ordinance title into the record. We're introducing an ordinance for the first reading. We do the 7.4. I thought we did. We did. I just need to read the ordinance title into the record before we move on. Okay. So this is for an ordinance of the mayor and city council, the city of Westminster, California, a meeting section 1 0.44.050. We use the streets for storage of vehicles prohibited of chapter 10.44, stopping standing and parking to title 10. Vehicles and traffic and adding section 10.44.245, recreational vehicle parking permit required. Of chapter 10.44, stopping standing and parking to title 10 vehicles in traffic of the Westminster municipal code related to the permit requirement for the parking of recreational vehicles. And finding the ordinance not subject to the California Environmental Quality Act, read by title only away for the reading. Thank you, Mayor. Thank you. Next item is 5.9 resolution to censure councilwoman Amy van West district one. I thought it's 5.10 first and 5.9 next. That's what I asked. 5.10, what's the difference between 5.9? I ask for 5.10 first and the 5.9 you agree. Mayor motion to the 5.9. We are right now we are 5.9 then where can we go ahead? But that's what we have earlier that you approve. Okay, I don't remember that. I actually have it here 5.9, 5.10. But if that's okay. I don't remember that. I actually have it here 5.9 5.10, but if that's a case, we, we, is that is that what the case is? Yeah, that's what I asked. What, what the, the motion that was approved was to take 5.9 and then 5.10. Okay, then that's it. Okay, let's do 5.9 resolution Resolution to censor, censor Councillor Wouman and me from West District 1. So I've been, I know that we, this is the fourth time that we're going through this. I don't think that I need anything from staff or anything, so I will open up for Councillor to discuss on this item. I think we discussed enough on this item. I think we discussed enough on this item. Well, it's regarding me, so I should be able to be out there. There's the point here. Because there's new things added to it. Yes, thank you. No, there is. Mayor, this is my item, if my may. Go for this. This is a continuation of my item. Oh, yes, that is. Yes. This is her item so she can make the first. Yes, a mayor. I plead with you that we have spent so much time on this already. We have heard our constituents over and over again. I think I have to respect for everyone and I just want to move along. And today we're not talking about, we're not asking yes or no, we already know that the censure is, we already voted and we have the majority. And I think today we are just voting on the resolution that was staff to prepare. And that is it. And we already, I prove the resolution. And so I hereby, I would like to move to approve 5.9. Mr. Mayor, I would like to make a statement right here, because I notice it's different on the resolution than what you guys proposed last time. The proposal to have staff to craft up a resolution number one censure councilwoman Amy Fan was to remove me from all committees. That's why we're going from about three is to remove me from all city attorney privileges. But I don't see it here. All I see is just the centering me. And so I see right here is section three. The council find that the above statement of councilwoman Femme was true and that her conduct in this matter was inappropriate, unprofessional, unacceptable, and constitute the violation of city ethics policy. And I'm thinking, you know, if you're making a statement of me violating the city ethic policy, all of you guys have violated this, ethic policy, ethical policy and from day one we all seen it. So if you're going to censor me like one of the member have made a statement is that you all should be censor as well. I just feel like I know before you put this agenda on the item on the agenda here, you guys have in your mind to center me already. And I understand that because you have three votes. Please. And may I finish? Let me address your, let me address your question. May I finish my thought? No. Let me address your concern. I'm speaking. We've been talking about this in the morning. May I finish? You should let her speak. No, she is repeating of what we already done. No, she has not. She has not. She's repeating. And I'm trying to respond to her. But you should let the person finish. You have the right to speak. She has the right to speak. I have the right to speak. Yes, but then she is repeating of what we already have come for now. Okay, you try now. No, because remember when. Yes, you are. You are pointing finger at me now. Thank you. Okay, so. Let us speak. I can finish you all. Okay. Thank you for letting me finish my thoughts. Thank you. Okay, so with that, section three. So I guess you say the council. So I cannot say for this is false statement because the council doesn't mean Namguang and myself. We don't approve of this because we don't think this is true. So maybe you should say the Chinese Communist dictator find above statement of the council member, West, as true. And then section four, the Chinese Communist Dictator, the three of you guys, the new gang of three here by center councilwoman Amy Fan-Wes, conduct describe above. And section five, going forward, the three Chinese Communist Dictator, the gang of three, have expressed councilwoman Amy Fen, Nguyen S. C. C. C. C. C. C. C. C. C. C. C. C. C. C. C. C. C. C. C. C. C. C. C. C. And they're a professional conduct toward the other three council commoners Chinese dictators. And I understand you have the majority and the thing is that with your majority why don't why you monitor me going to the bathroom often text message you know Not looking at my face may have finished. I'm not finished. Yes, but instead of Instead of wasting your time on Monitoring how often I go to the bathroom. Why don't you fix the homeless problem? Where they're peeing in the, peeing in people's yard? You know what I mean? So when you have that power, you should do something good like that to take care of the homeless population. So watching monitoring, you know, what I speak, you know, or what I say, or when I go to pee to the bathroom. I mean, come on guys. I'm repeating this again. And so the thing is, I recall for question, I just have like, first or second. Hold on. Hold on. I want to address you. You know what? When you put it on the side, you let her speak. You should let her defend herself. She finished and it might hurt. She's not. She's not finished. You're putting on the army on the, the, your judge. You're the Venus. And I have every right to defend myself in the court of law. And you guys are pretending to be judges. You guys are pretending to be judges. You guys even don't legal, Justin. You not allow me to defend myself I told you I told you I told you that you have a valid I can't even defend myself I'm trying to silence you The majority is just trying to silence me And silence is the only option And you guys promise to uphold the Constitution You guys are not. Yes, yes, yes. To uphold the Constitution. But we have a motion to this. You guys are not upholding the Constitution. You guys should resign. You guys have a majority. You guys are quiet. Just go ahead. A second. And it's really sad, as the guys are letting me. It's the man. You should be. That's a quarter in the crowd. It's a question already. You are the mayor, you are violating the activists running your city. When Mr. Mayor, you are the mayor elected. Why you laying the activists run out of cities? Please, please, please. This is on activist cities. The president of almost 100 people do not want activists run out of city. Mr. Mayor, when they can see his impultancy to the city, Mr. Mayor, the legacy is impultancy. Please hold this in the act of it. I have a motion made by Mayor Wins. I can write councilmember monzo for call for question. I'm calling roll for call for question. Call for question roll. This is democracy, right? Mr. Mayor? Why are you not all very silent and silent? When I'm on the juror in a way, the seclusion. It does question to the city attorney. When you have the majority and then you want to go to the university, you can't speak Okay Okay City attorney Attorney have a question for Time is time for me to address. It's time for me to address. It's time for me to address. We should discuss already. And then we have the concern. I am going to address the concern. No, but you see, what is already discussed before? You can't Westlifant herself. No. Because I see has a valid reason to ask a question. And I am trying to address that question. No, no, no, no, no. I'm sorry I'm sorry what City of Tony City of Tony let me ask you if there is a call for question and there was a second to it what are we going to do? Okay going to do. Okay. The only thing my voice. But the meaning of having an item and without discussion. Whenever there is an item on the agenda every council member should be given a reasonable opportunity to address the item. Once that's been satisfied you can do a call. I guess so what is the subject of discussion? You're talking about. It doesn't mean endless discussion is an opportunity. So it's just speaking and then you silence. So the clerk, go ahead and call for questions. I have a motion made by Mayor Winn, a second by Council member Monzo for call for question. Roe call for call for question. Councilwoman Fan West. Fan West no. Councilwoman Monzo. Yes. Councilwoman Winn. No. Vice Mayor Ho. Yes. I'm Mayor Winn. Yes. So at this point here, I would like to, is there any motion? Was there a motion to approve this item? Yes, I did. I have a motion on the floor. Before we go on, I want to address her concern. I thought we're done talking. We have a question. Oh, we vote already. Okay. No. No. Okay. Yeah, we can't talk. Okay. Okay. That's fine. So there is a motion to approve this item and there's, there was second two, right? Yes. Correct. I have a motion made by Vice Mayor Hull, a second made by Council Member Monzo. This is to adopt a resolution entitled a resolution of the Mayor and City Council of the City of Westminster, California, Centering Councilwoman Amy Fan West, District 1 for unacceptable conduct. I'll go ahead call roll. Were you able to read what's in the centering? So it's just only to censure public rep. Reader whole thing. No, just read. We have the right to ask for that. Read out what you're centering me for. I'd like to hear it. That's the discretion of the council. We are generally obligated to read the title. So if the council would like to have the entire resolution read, that's that's the discretion of the council. What part of the sanction that we were talking about last time that you got in there? Oh, so we're discussing the sanctions. So the sanctions were not included. That was- What was the reason? That was- so when the resolution was drafted for this agenda, it was just overlooked. So- Is it- is there any- Sinks for sanctions? Yes. We'll be right back next- at the next meeting for that part. Yes, because there was council direction to bring it back at the next meeting for that part. Yes, because there was council direction to bring it back to the future meeting. Unfortunately, the sanctioned part was left out. Okay. All right. Go ahead. That and read the chance to read today. The resolution. You want to read the whole resolution? I don't know. What? What are you sent for? Recommendation. Don't be a coward. I'm finding a re-it. Yes, I'm fine if you want to read the entire thing if you could like quickly. Because I really think that it's a waste. And especially at the request of some council members. I will not that. I would open that. My point is we should, we as a council have this staff report already. We should be able to read that before we come to the meeting. We have been doing this for a while and today we have a lot of ideas that we speak good and need to discuss. So my recommendation is not to read the entire list. Mr. Mayor. The head on my mind remind you that you are the one that brought this up. Yes, it is all right. Come on, reent. Let me respect you. I respect you. I respect you. I respect you. Okay. Let me finish my. Okay. I respect you. I respect you. I respect you. Let me finish my. My recommendation is we need to move on because we have a lot to discuss tonight. We have many more items. There is something you are hiking. You have one resolution that you want to censure me. Come on. Motion it or. Okay, we need to take the vote though. We actually need to. We have the motion but we have the voted. So I believe that. I hope that so. Vice mayor, you know, stand up for herself, you know. I call you to the city of what is to say. You need to take a vote. So. But yes, come to motion. To read the whole thing. Is that a motion to read the whole resolution? Yes, to me, Mary. Mary is one. I make a motion to, yeah. We need to know what you're centering me for. Let's hear from the seated. Yeah. Yeah. There was a motion made to call the question and then we voted on that but prior to that there was a motion and a second to adopt the resolution Okay, so we have that motion already made and we need to vote on that motion that hasn't occurred yet So all we need to do at this point is vote on the motion which is a recommendation to adopt the resolution Well, the thing is that for the thing is that I don't even know what you guys are centering me for. So why don't you put it into the public record? So the public can know exactly what you're centering me for. So I think it's really important. Mayor, because it's going to be very ridiculous about your centering me for. So that's why the public need to hear it. No, because Kimberly, you should put your name to this agenda in Carlos Menzo too, what you're center me for. It's really ridiculous. So please read out what you're center me for. So then the people can look at the circus of council. That's the best point here. There is no more. The vice mayor and Mr. Carlos Monzo, ridiculous accusation of me. I would like to know. I said slow motion. I'm going to have to call. Okay. Everything's the same, but I would like. I don't know. It's valid at this point. Like I said, I want to discuss. No, after a call, the question that passes, we go right to the motion that is on the table. So we have to vote on the underlying motion. Thank you. So I have a motion made. I make a substitute motion. No. Too explicitly, because I call the question made a pass. That is a motion that takes precedence. And it says that that when it passes you must vote on the underlying motion. That was already- So you can't do a- So basically when you guys are going to censure me and you don't read out what I'm going to be censured for or the public to know what it is. Then isn't it my right to know? Is it my right? Or you let the activists run now city again, Mr. Mayor. Please, please, please. We have over 90,000 residents, restresidents, but you allow this few. I'll remember this. Seven years after this to run now city. the resident but you allow this few. Council member west, we have seven days. After this, run now city. Every. Okay, I have a motion made by vice mayor ho. To run now city. Second made by council member monzo. This is redict. To adopt a resolution entitled. A resolution of the mayor and city council. The city of Westminster, California. Centering councilwoman Amy Fan westess, District 1 for unacceptable conduct. I'll go to call roll, Councilwoman Fanwess. Wait, so you guys are just centering me for my unacceptable conduct by the three commoners gang dictator. We had no longer discussions about this before I vote. So that's what you guys are doing to center me. I understand because the other thing you guys forgot to add on. That's fine. You can center me. Bring it on. I welcome it. So go ahead because you have the majority vote. So you're going to center me. Center me. So my vote is no. go ahead you abuse your power. Councillor Monzo. Councillor Wilbur. No. Vice Mayor Hell. Yes, Mayor Wynne. Well before I vote, let me have a few councilmember West. I said mayor, my intention is to work with everyone in the council for the betterment of our community. It's always been that way to me. And I want to express that my intention is not to sign with any councilmembers. You never give me the answer. Hold on please. The decision is not to sign with any council members. You never give me the answer. Hold on please. To, you know, your accusation, you never work with me. You never sit down with me. Please. That's a lie. Please. So you work with me. Please. You did not. That's why I say this was a shock when this agenda was on. So I need to vote please. So Mr. Mayor, that's a lie. That's a lie. That's a lie. Three, two motion carry. All right, thank you. Mr. Mayor, can I make a motion? No, there's no motion. That's not a little weird. No, I think we're going on. I think we're going to make a motion, right? Item 5.10. Item 5.10. I think we're going I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. What is the motion about? The motion far to the whole entire resolution. That just essential Amy found West. Absolutely, seconded. So you can make that motion. All right. Thank you Mr. Mase. Thank you Mr. Attorney. CD Attorney. The motion just to read the resolution. Yes. But before that on that already. Attorney. CD Attorney. The motion just to read the resolution. Yes. But before that, on that already. Yeah, the resolution is passed. The question is whether to read it or not. Yeah, that's normal. Okay. So I second it. Go ahead. Okay, I hope, you know, we have to vote on it. If I smell home, going to say yes. Okay, so that's a motion to read. Vice mayor, yes. Okay. Go ahead. I have a motion made by Councillor Neuwen, seconded by Councillor Womens and Fan West for myself to read the resolution into the record. I've got a call roll. Councillor Womens and Fan West. Fan West, yes. Councillor Monzo. No, we have multiple meetings and pay attention you will learn. This is our new resolution. This is the first time you guys put a resolution on the other resident item. So Mr. Montz will make you correct yourself. This is a new resolution. I forgot about that. So Mr. Montz, please be correct. Maybe listen next time. Okay. Councilman Wilson, you should listen. Yes. Councilman Renoy. Do you listen next time. Okay. Councilman Robinson. You should listen. Yes. Councilman Renoin. Do you listen next time? Okay, don't tell me I need listen. Oh yes. This is a new resolution. Vice Mayor Hoh. No, huh. I'm sorry. Who would say for you now? I know. Wow. It's so chaotic. Wow, it's just chaos. Just so nobody. Yeah, no. I mean, if you would like, I would say I apologize to everybody for having to go sit through. But if you know, if she would like to hear it, and if everybody wants to hear it again, that's fine. I just asked that if you could speak through, because we did spend three different meetings, very, very long meetings on this. And so what you wrote on the resolution is based on what we told you we wanted on the resolution. So this is nothing new, but go ahead. I would vote yes. Go ahead. Okay. Well, before I want to clarify something with the City of Journey because there's a accusation being made. Did with the previous hearings that we had on this topic, legally the council member was, have the sufficient time to address each and every one of these items that were listed on here at previous meetings. Does she not? That's a factual question. So yes or no? You add 32 items. The council determines no. No, I'm asking for the first. Before 21, I'm looking at it. It's 32 now. No, no, no, no. When somebody else is talking, my question is don't talk to any team at the council. I'm sorry, I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I mean, line by line. And then she was given, she was legally had the opportunity to answer each and every one of these items line by line. Does she not? We have extensive discussions. So yes or no? Yes, we have extensive discussions. So I just want to clarify that you can't answer a simple question. Yes, it's a yes or no question. That's because you're trying to intimidate here. And we all know that. And the thing is that there's 30 times that we all want to hear. And the five of us are on the spot. You're right. I wasn't talking to you. You're talking to me. You're done. So, Monzo, you like to intimidate people and leave them a city tourney. You don't even need to listen. This is a new resolution. And on here, look at it. The next time you go to the 21 item that you guys accused me of. Now it's 32. It's a, a, a, b, a, c, a, d, a, e. Like what the heck is that? That you finished the call. May I, you don't have your vote? Okay, you call. And your vote is? Yes, go ahead. Okay, motion passed for one. Thank you. Okay. A resolution of the mayor and city council of the City of Westminster, California is centering council women, Amy, and West, district one for unacceptable conduct. Whereas the city council, the city of Westminster has a duty to the residents of Westminster to ensure that state and federal laws and the rules, regulations and policies of the city of Westminster are far lowed by all members of the city council and members of the City of Westminster are followed by all members of the City Council and that members of the City Council demonstrate the highest level of professionalism in respect while acting in the course and scope of their office. Whereas the ethics policy adopted by the Westminster City Council on May 22, 2019, ethics policy requires each council member to affirm that they understand that the citizens of Westminster expect me to serve with dignity and respect and to be an agent of the democratic process. We'll treat other public officials and members of city staff in the public with respect, patients, courtesy and civility. Even when I disagree with the opinions they have expressed, we'll be honest with other public officials, city staff and the public. And we'll take responsibility for their actions even when it may be uncomfortable to do so. And whereas complaints were recently made by other members of the City Council, asserting that Councilwoman Van West had violated the City Council's ethics policy by failing to treat all public officials with respect, patience, courtesy and civility, and being honest with other public officials, city staff and the public. And whereas at the June 12th, 2024 city council meeting, the city council agenda is an item to discuss and consider out links. The statements alleged to have been made by councilwoman Fian West and to decide whether a resolution of center should be prepared. During the discussion of that item, the City Council dually considered the evidence and comments presented by the other members of the City Council, as well as the comments and responses made by Councilwoman Fiannwest and public comments. And whereas it's a conclusion of the discussion, the City Council voted to proceed with the preparation of a resolution of censure. And whereas the City Council has determined that Council on the Van West violation of the city's ethics policy, as more a particular set forth below, has brought just, just, to the city of Westminster. And whereas the City Council does not condone or approve this type of conduct or behavior and finds it necessary, and prudent to declare it's strong disapproval of such conduct. Whereas the City Council further determines that adoption of this resolution is necessary to affirm that such conduct will not be tolerated and to prevent such conduct from being repeated. Councilwoman Amy Fenwes constantly violates section 2A and disrespects the speakers at council meetings by leaving the dius, texting, arguing, and engaging of verbal altercations with the speakers. She has walked out in the middle of a meeting for at least an hour to go to the back, sometimes to eat or talk on the phone and miss voting on three fourth agenda items. Disruptive B. When he was trying to run the meeting and called the meeting to order, ignores the rule of order. Two, practice ability. She constantly is not civil and lacks decorum. Two publicly criticized staff from the dice and lies about what employees said. H, May 24, 2023 during Council meeting insinuated staff of hiring someone they knew through the RFP selection process for billboard sign project. One, excuse me, I June 7, 2023 filmed the live social media video insinuating staff of taking a bribe for a special treatment from a special event permit applicant for a long standing annual. Jay, at community events constantly move, seating arrangements to or liking, this is a violation of basic manners and decency, K, rates in use is abusive language towards member of the public in violation of the code of conduct. Q, I mean, third, 2024 left the dice to interact with members of the public while the council meeting was still in session. Our file defaults police report about a fellow council member S S may 4th, 2024, recorded the YouTube report. You know that's wrong, right? The false police report? That's legally, can be lost. You know that right? City Attorney? Because the police report we have it, it says there's no crime committed at this. Oh, S may 4th, 2024, recorded a YouTube interview criticizing the city manager and stated false information. This violated the code of conduct and over publicly criticized an individual employee. She mispublic comments and did not return to her seat until 30 minutes later at 256. Why? And provide for the fair and equal treatment of all persons coming before them. Councilwoman Fian West is respected the public when they came up many times to address her. She was still in the building, but it was not an intercede to listen to them. A few examples on May 8th, 2024, at 236 regarding the sober living house topic. At 239, when a speaker, some concerns with Councilman Fan West's behavior, and what the speaker would like to see changed but Miss West was not in her seat at 241. Z putting aside self interest and considered the needs of all residents. June 22, 2024 Councilwoman Fan West placed three agenda items with the sole purpose of wanting credit for herself. As a result, the Council meeting dragged on until 2 a.m. Result the public did not wait for oral communication and most left before they got to speak. AA, conduct of members, the professional, should be above reproach and seek to avoid even the appearance of impropriety. Members should refrain from abusive conduct, personal charges, or verbal attacks of staff or the public. Unprofessional conduct, verbal attacks, 534 meeting, hour 58 and 15 seconds. West labeled all but one of the LA supervisors a socialist at two hour, three minutes, 54 seconds. Week when the majority of the council did not vote with her to label the action of the LA supervisors as despicable. Speaking in a demeaning way to the rest of the council. How she treated staff by putting words in staff's mouth, 522-24 meeting. AB, respect for the process. After being told the process of calling for a special meeting and placing an agenda, she's still insisted on putting her name on vice mayor Jose agenda item for five three special meeting, accusing staff of being cohoots. C5-324, 5-824 meeting, and continue to argue over the process on the 5-22-24 meeting. To respect the process is to spend the time to learn the process. She does not seem to have a handle on the process. AC conduct at public meetings, 5-324 meeting at two hours, five minutes, and 49 seconds. Councilwoman Fiannouette left her seat, was disrespectful to the mayor. When she asked to come back to her seat, she did not comply and talked back to the person in charge of running the meeting, the mayor. She talked back to the mayor, you guys have the quorum and refused to come back. At 206, Councilwoman Van West was speaking from the theater seats while Councilmember Carlos Monzo was making a statement. This is an example of lack of focus on the meeting and professional behavior, lack of decorum. It did not listen courtesy and attentively to the public who stand before the council. A.D., no member should request or grant a special consideration to remain or advantage to any person beyond that which is available to every other citizen in similar circumstances or need. B, conduct guidelines. One, members, conduct with each other. A, honor the role of the chair in maintaining order, 5324 at 2 hour, 5 minutes, 45 seconds. She left her seat in the mayor asked her to come back. She talked back and did not come back. B, practice civility and decorum in discussions and debate. Colleagues Council majority week when we did not vote her way as stated on the previous page. West has a pessimistic body language that signals disinterest, disrespect, and condescending body language that can make the public feel like texting and doing something else. Like going to the back room while they are trying to address you, is outright rude in a violation of the practice of active listening. Three members, conduct with city staff, treat all staff as professionals, clear honest communication that respects the ability to experience a dignity of each individual is expected, putting words in their mouth and accusing them of something they didn't do. C52224 item 5.5, stating that the director of community services said it was okay to have the barbecue on the proposed date. This is poor behavior toward staff. When staff is speaking to explain the process or to reply to your question, give them your undivided attention. C52224, item 5.4, when the chief tried to answer Councilwoman Fan West's questions about the axon agenda. She continuously text, did not listen, wasting everyone's time because she had tasks three times. Lame city manager for lying on the report, Councilman Fan West claims that the city manager said her name would be on the report. AE, Councilman Fan West pressed conference 6-1-1-2024 at 145-41, Westminster Street, Westminster, California, 92683. 2229 to address issues stemming from the May 3rd special meeting and subsequently efforts to bully and silence her, which involves a police report. 2245, she was verbally berated by the Council member Carlos Monzo when I spoke out against April 30th of the Jane Fonda Day. 2340, when I was leaving the Dias, Councilman Monzo was waiting for me, not Truan in an exaggeration of what really happened. He did not block her. 2603, they tried to accuse me of stealing a $6 police report as a way to silence the bully me. But when the allegation was proven false, they came up with more false allegation that they are going to attempt to use to censure me tomorrow night. This is alive. 2708, tomorrow night's attempt to censure me is just an underhand tactic to silence me from exposing Councilman Carlos Mons' actions. She lies to the public to incite them and to cover up her actions. Section three, the City Council finds that the above statements by Councilwoman Fan West were true and that her conduct in these matters were improper and professional and unacceptable and constitute a violation of the city ethics policy. The council finds that councilman fan west was acting as an individual when she engaged in this conduct and was acting without any authorization or ratification by the city council and contrary to the legitimate interest in the city. Section seven, the city clerk shall certify to the passage and adoption of this resolution. And shall a fixed signature in the city seal. And that same shall be entered into the book of resolutions. Passed approved and adopted this 14th day of August 2024. All right, let me finish what I was about to say when I cast my vote but I didn't have a chance to. I just want to spread that my intention is not to sign with any council members to censure council member west personally but rather to address some concerns that have arisen. Understand that this action is necessary at this time. However, I believe in your potential, because remember, we're potential for positive change. And I am committed to reversing this decision in the future if we can work together towards improvements. That's all I have. Just for the record of it. So next item is 5.10. 5.10 is talking about the men of payment of gold friendly funds to Ms. Henson, Alin and proposed investigation of Vice Mayor Kimberley Hall related to the use of her title in connection with the legend, go find me scam to raise fun in the e-bike death of Mrs. Land, me Thai in the city of Westminster. Before we go into this, let me go ahead and express my concern. I noticed that the agenda includes the topic. We can't hear a thing with these people talking. Okay. Will you please? Go outside if you're going to talk. Please. Okay. I noticed that the agenda includes a topic that seemed to be outside of scope of the city business. Not to mention that it might pose a potential litigation to the city. And what I see is not involved in the city business at all. The subject on the agenda has nothing to do with the city business. It should not be urgent, urgent, dice in the first place. But I understand from the staff's standpoint because we have the policy of two members, two council members can bring it in, so I understand that. But concerning the validity of whether this item is a city business related or not, I won't let it go depth into discussion as it might constitute a non-necessary lawsuit. So from the agenda, like I mentioned, it has nothing to do with the city business. And the city has nothing, we are not responsible for that. So the payment of GoFundMe, why the payment of GoFundMe, City has no business in the GoFundMe for this. I don't understand. The second one proposed investigation of Vice Mayor Ho, to use her title in connected with the girl for me. That's the two things that are under agenda today. Let me ask, let me ask, may I answer your question? No, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. I don't know. You let Kimberly talk about this item for this item Follow the We put it on the agenda so miss mr. Mayor do respect I it's my agenda that I have every right to say why I brought it up and why it's valid to the city Great have a question for you soon. Yeah, but yes, my thank you. Thank you. So is my agenda? I have the right to speak. Please. So I have the right to speak. I don't want to go deep into with no other opinion. But I've made the protocol. We follow the pro, Mr. City Attorney. a man. I'm not a man. I'm not a man. I'm not a man. I'm not a man. I'm not a man. I'm not a man. I'm not a man. I'm not a man. I'm not a man. I'm not a man. I'm not a man. I'm not a man. I'm not a man. You know what Mr. May? Because you don't follow the protocol. That way, this is how it's okay. I'm sitting here. When you bring the agenda items, so may I address your concern? I'm asking for that question. May I ask your concern? Because Mr. May, why is this even on the end? I asked by the mayor. So you speak, you say why and do I put on? I'm not recognized at this time. I am asking council, rise me a hold. Let me ask, no. I am not going into the agenda item because it might pose a potential litigation. I have a question for you. You wait until her answer first and I have a question for you. But I am determined because I see this is not related to CD business. Then let me ask her first and then you. Why are you always catering to? I'm not catering. I am not catering. This is not related to city business. Okay. Then let me ask you. Hold on. Let me ask her first. Okay. I'd like to ask a question. Are you by a city attorney? This is my agenda item. I'd like to ask a question. Are you by a city attorney? City attorney. This is my agenda item. I have a question. Okay. City attorney, please answer my question earlier. Please. I would like to speak to a city attorney. I ask for advice from the city attorney please. City attorney answer my question. City attorney. Quiet and I will listen to advice from the city attorney. Including me, I will. If I may answer. City attorney my question. I ask the question. So can you please answer. I want the question. So can you please answer? I want the legal answer. So city turn please. I need to know what the question is because we got a couple of questions. We asked. I call for five minute recess. So now we're five minutes recessed. Please come back. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm going to go to the next room. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. continue with our regular council meeting. So who call please? Mayor Wynne. I'm here. Vice Mayor Ho. Councilman Van West. Phil West here. Councillor Verbonzo. Councillor Verbon. Mayor you have a quorum with all members present. Okay. Before going further I'd like to move because we are about five minutes to turn. I would like to move to extend the other. Yes, I second it. Meeting. I have a motion made by Mayor Wynne, seconded by Councilman Fan West to extend the meeting past 10 p.m. per city policy. I'll go ahead and call roll. Councilman Fan West. Fan West, yes. Councillor Burmanz west. Yes. Councillor Burmanzo. Yes. Councillor Buerne. Yes. Vice Mayor Hell. Yes. Mayor Womens. Yes. Five zero motion carried. Okay. Let me continue with the item 5.10. Let me ask Councillor Member West again. I want to make sure that we are not going to discussion up because I have the determine, I'm trying to determine the validity of this item, whether it's related to the city business or not. Yes, ma'am. To me, I took hold on. To me, I don't think it is. And if there's any litigation on this, I can tell you right at this point I, as a mayor, will not take that litigation and any of these council members, I don't know how they feel, but at this point here, I understand. I question for you. I question for you is without going into the discussion, do you have any evidence that Vice Mayor Ho had represented the City Council on this matter? Yes, I do, so that's why may I explain to you? No, no, no, no, no, no very quickly. Yes, very quickly. Okay, I think this is very important. We talked about it before about a letter being received from Vice Mayor Ho and her attorney where they raise some concerns about saying things that would be defamatory and the city being potentially at issue. So I just want to put that out there that either A, we can go talk about that now. Or B, if we're going to proceed, everyone just needs to understand that this does not represent the city in anything that's said. And if you say something, just choose your words wisely. Because if something is said that's defamatory, that is potentially on the council member who makes those statements. So I'm just, I'm putting that out there. I appreciate City Attorney for mentioning that because on this staff report is it a ledge? A ledge? So there's no anything to be made, okay? I'd like to do a lot to see your attorney. I'd like for you to stop if there is anything that you that pose to, you know, the misunderstanding or allegation. A legend for the, you know. May I speak though? Hold on, hold on. Let me have her answer me. So you take anything concerning? So you're going to, you're asking a question of her at this point. Yes. Yes. Is she saying something that may lead to the potential litigation to the CD or to the any council member here, including me, then you to stop her on that. Oh yeah, if it leads into something that seems to be potentially defamatory. Yeah, okay. Thank you. The best is I can. Thank you, Mr. City Attorney. Okay, so my statement so you understand why this is related to the city. Kimberly Ho did this action the GoFund me in her role as vice mayor? As she did this in her office in the council chamber behind here, her office behind here. Okay, can you stop there? Let me ask. We have text message. I got you there. Before going there, let me ask councilwoman, I mean vice mayor. But I haven't finished Did you do the go for me? No the question is that you represent the city to No I did not. Did you do it? Maybe your question should be did she do it in her office after that? No I did not. That's a lie because you know what that's called. Oh my gosh. But then we have text message. We have text message from my son, the child, that you meet her. You call them to meet you and meet them in your office and you give her $20 to help her. And you say you're going to help with the pizza. To stay here. To sit in, represent. Well, she can lie all she wants until we have evidence and proof of text message and that's what you need. And that's why I'm trying to present here. The people are seeking truth. Imagine your daughter, someone took advantage and stole 21,000, they had $60. If they still got with you, I would not treat the five. Who's true? $1. If they still got for there, I would not read the file. The file is left. Would you have a city council? It's a love, Mr. Benton-Hausen. Right here. I would like to read the my attorney's letter in the record. Please. Okay. From Catden and Fuller LLP. And it is dated August 14th. And it is emailed to Mayor Chi Charli, Council Member Amy Fan West, Council Member Carlos Manzo, and Namco Ngwin, and also City Manager Christine Corden. And do you miss Fan West? This is coming from my attorney and members of the Westminster City Council. You know, the first thing is that I spanked the item. And I have not even allowed to present the item to the committee. Don Kimberly Ho get to present her. And you say the walk-in litigation, why are we even talking about it? City Attorney, you want a city to be sued? Why are we even talking about it? You want our city to be sued? Go are we even talking about it? You want our city to be sued? Go ahead because what's on that letter is false and your attorney has not done the research. You have not done your research. You have not done your research. That is the problem. Mr. Thung and attorney, we look at the state bar and he does not have an ID. He does not say. You know what she's doing there? I mean, you want me to, you want me to not be, you are not running. Go ahead. I'm sorry, I'm sorry, I'm sorry. I'm sorry, I'm sorry. I'm sorry, I'm sorry. I'm sorry, I'm sorry. I'm sorry, I'm sorry. I'm sorry, I'm sorry. I'm sorry, I'm sorry. I'm sorry, I'm sorry. I'm sorry, I already told you at beginning, I'm trying to determine the validity of that item. And if it's not, then I ask you the question. I ask you the question, and I ask her for the answer and see refuse. She did not. So that's willing to interrupt. He's willing to interrupt. So let me interrupt if I say something that's illegal. So let me finish. This is my condolences. We are business. This is unacceptable. Mr. Mayor, you have gone wrong on your agenda item that's fine that's why I told you already I understand that's the pop that's a process, but this item, I need to determine the validity of the items. It shouldn't be, it shouldn't be. I'm asking you and I determined, my determined is that not. Mr. Mayor, you are breaking the law. You are breaking the law. That's okay. That's okay. That's what you accused me. That's fine. Okay. At this point here, what I asked her a question. And I asked Vice Mayor for the answer. The answer was not, she did not represent the city. There is nothing to do with the CD here. So I want you to turn not to discuss the item. That's my motion. That's unacceptable. Because we do process, Mr. Mayor. We waited our turn. We have the process and my process is so sweet. Mr. Mayor, is there a second to this? I make a motion not to further this and we can be further at a later time. At this time, I don't think it's validity and it's related to city business. And my motion is not to discuss this So is there a second to that? Okay, is there a substitute motion to this? Okay, there is no Okay, go ahead To make a substitute motion I want this item to be discussed today. Okay. Not to the first. Second. I second it. Because that is how our due process, Mr. Mayor, no. Mr. City Attorney, this is illegal. You cannot even vote on the agenda. It's due process. I have every right to talk about my job. I didn't even talk about it. I have a sub-subsisting. Mr. Man, I want to ask you the legal. No. I don't. I don't. I don't. I'm not going to be a process. We've waited our turn to put it on. Mr. Man, this is so far from the city attorney. Why? When is it going to be is my are you so afraid of you? Oh, that you decided to be. Oh, you protect. You know, Mr. Mayor and for sensual. Something. I told you I told you to do this I do process this item I want to define the validity of the city attorney legal legal legal is it I have ever right to talk about my Okay, well you second the motion. I cannot. That you go wrong, Mr. Mayor. Let me ask you, you second the substitute motion. Because you first have not. First, I have not. The thing is that you force me. You do right. I know but it's my duty to give it. No, that's illegal. I have a city attorney that williccio for the legality. Do I have my due process to speak on my agenda item? I have not even spoken. For this one, you are not. No, that is your opinion, Mr. Mayor. You are going broke and you're breaking the due process. I do not allow if something is not breaking the due process My the thousand members why are you silencing my voice with agenda items on you? Mr city attorney what is my legal rights? We have substitute. What is my legal rights? The substitution is invalid. What is my legal right, Mr. City Attorney? Why is he going broke? I don't know. I'm not letting me speak about my agenda. What is my right? Let me ask you. What is my right, Mr. City Attorney? What is my right? Let me ask you. Okay. What is my right, Mr. City Attorney? What is my right? What is my right? No, I'm asking the City Attorney. I am asking you. You have no legal. You're not attorneys. Mr. Mayor. Mr. City Attorney, what's my legal rights? Yes, please. Okay. What is my legal rights? Okay, if an item is properly put on the agenda, you have to at least allow each council member an opportunity to speak to the item. Once that's done, you've met your requirement and then a motion can be made. Exactly, Mr. Mayor. You go rogue on us. What kind of mayor is that? I ask the question, did the side not? Now you hear the truth. The legal rights. Mr. Mayor, you, the legal rights. You heard the legal rights. So let us speak. Don't break the law. You're a law. I'm not breaking the law because you are. He just told you that everyone speak. Let me speak, then go through the council, then you make a motion. That's what he just said. Let me let me understand you, city attorney. What did you tell me before the meeting? What did you tell me when I asked you about this item? We have to talk about the validity of the item. Before we move on. Yes, the man I'm trying to engage in. That's exactly what I do. Now you are changing your, your, your, your. Please don't intimidate, no. No, tell me. No, I'm not. See, he says not, Mr. Mayor. You're 100% correct. The question, the sole question to be asked is, what is, how is this item related to city business? That's the only question. That's exactly what I was talking about. That's the only question. And as soon as the council feels that that question, that a reasonable amount of time has been given to answer that question. You can take a motion to determine if it's properly discussed. What I asked earlier. And I also asked Vice Mayor Hall to respond to that. That's the reason why I make a decision, that make a motion. So now one to one, you want to go ahead and conduct this? Go ahead. On my behalf. Okay. So, my turn. Thank you. So now what you want to go ahead and deduct this go ahead How many have okay so my Thank you. Let me see you are threatening Mr. Mayor don't bend the city attorney and please this is a normal protocol You know that you run meetings for the last year and a half mr. Mayor. I am not good You know any agenda item you let the offer speak list let her talk you let the author speak and now you just don't know. And you're silencing my voice, yes. I'm her second. I am trying to decide where you have run into conclusion. You want to defer this to another time. No, you try to sign with us. You try not to give us the protocol. This is, no, you need to set it. City Attorney just give us the protocol. This is no, you just said it. City Attorney just give us the legal process that he said we need to talk. Each one of us will let him hear me out. And then you determine. Yes. And then you come to be closer. You haven't heard about me yet, right? When we go deep into that, it's already open. No, it's not. I mean, you know the protocol, we say a ledge on there. When we go deep into that is already open to kind of what Mr. City Attorney said I'm going to have that right I'm going to use that right right now to speak and then whoever counts I want to talk on it go ahead because I'm following the legal Protocol and my legal rights so I'm going to do it. Okay thank you Mr. City Attorney thank you Mr. Mayor and thank you for the council for letting me speak on my item. Okay so the thing is that I'm going to read my statement again because you interrupt. Okay, so Kimberly Ho did this, which agenda 5.10? I guess so, so we related in her role. So we related to whether it relates to city business. So Kimberly Ho did this as her role as a vice mayor and she did this in her office in the back of the chamber here. Our office is back here. We have text message from the child has sin of this meeting in the office of this will impact our council here and the city of Westminster reputation. And that raised a lot of question for me and for the community. And this is a reason why we have this item on the agenda today. So regarding Ms. Kimberly Ho, you know, she promised, this is what I'm going to read from Mike Veng Thau. Mike Veng Thau. This is what he said. Okay, dear all, we're writing, this is from Mike Veng Thau. Mayor, we write to you, we're writing the tragic heat by accident on those as strength, Westminster. I'm coming from the council. I'm just resorbing 1000 here. But I'm reading, you know, she's a heavy man. You know what I have on here as well. I'm trying to protect her city. I have one of them. Resulbed in the ultimate death of Miss Hassan's mother. I'm not sure if that's the case. I'm not sure if that's the case. I'm not sure if that's the case. I'm not sure if that's the case. I'm not sure if that's the case. I'm not sure if that's the case. I'm not sure if that's the case. I'm not sure if that's the case. I'm not sure if that's the case. I'm not sure if that's the case. and why? How did you introduce her? Vice Mayor Ho at this time present herself in an official capacity, offering assistance to Ms. Hasen. The troubles begin at the office of Vice Mayor Ho, where later she introduced Mr. Thung Weng as a reputable attorney. However, we have since learned that Mr. Thung Weng has a history of unethical behavior with letters from somebody who is not here right now. I don't think that's a matter of liberty of the copy. The thing is that I'm reading, that's my right. That's my right, my time to read the comments of the guy who might have found his friend. My friend was there with Kimberly Ho and Carlos Menzo at the funeral since then. Exactly. And you guys came to the funeral. We went to the funeral. Yes, you did. And you guys even asked for the back. Not illegal, but you guys were there. So I'm saying to you guys the council. You're not a host city. I'm not there as this council member. Is there a mayor? I'm not there is this council member. You guys know you were there. You got the man by hand. Come on in. We're talking about he, but agenda. The family of Miss Missin. For 40 minutes without sending condolence, miss Ho to the family. But Mr. Menso did. So what I'm saying is you guys were here in the capacity of your elected official since day one, Miss Kimberly Holt here in the city chamber, the council chamber. It happened here, it happened in no city. And if someone, you know, have this racist money with that title to get money into this little kid to help her, then that is a good thing, but if you do it, give that money to the kid. Why the community in Miss Hassan, Bayer Hassan, asks where's the $21,860? If you fundraise for the Bayer, the child, then why didn't you give it to her? She can really buy food with $21,000. I know Miss Kimmelie, how you say you're worth $24, $20 million. You can take it outside, $1,000. But it's not the same business. See, they have nothing to do with it. If you fundraise that money, then please give that money to the child. And she even tells me right now she's busing table at a Chinese restaurant to get the money to live. And she writes her bike. OK, she ride her bike to bus table to 1130 at night. And you promised to help fundraise for the Bayer, the child, who's 19 years old, Ms. Kimberly Ho. I'm trying to. Then you should give her about $21,000. Why are you making this kid who lost her dad and her mom? And now she has no family member, and you wouldn't give this $21,000 to this child. Now she has the best table at a Chinese restaurant to make money by riding her bike to live. To live, to make a WIS. To make a ESL class. I'm asking you why would you do that? her bike to live. That's a member wish. That's a member wish. That's a member wish. I'm asking you why would you do that? I would say to me. If you have a heart. That's a motion. Okay. If you have a heart, it's by fair. It's by fair. Like you should give her that. We have a substitute motion to continue the discussion. So take the substitute motion first. The thing is that didn't Mr. City Attorney, didn't you want every council to speak unless they don't have anything to speak? I have a sub-tute motion made by Councillor Neill and the general. It's in that normal councilwoman. Madam, we have a sub-tute motion to continue discussion of this item. I'll go out and call roll call for the substitute motion to continue discussion on the item. Councilman, Fan West? The thing is that we haven't even go through our legal process in the attorney. City attorney. City attorney, this is so illegal, breaking all the protocols. It's up to you, Council Member. I haven't even finished my statement. Yes, I can hear you, right? My second, couldn't even make a statement. What kind of process is this? Is this then? This is not even a legal process that you're doing city attorney. You just mentioned that we have this legal process, let us finish through the legal process. I have some other questions. You want to continue this item or not? Because this is dangerous water. You want to continue this item or not? That we are walking through a legal role. You want to continue to discuss this item or not? And you are allowing the majority to get us into loss. I ask you a question. Mr. City Attorney, what is the legal process? Let us finish the legal process. Right now, there's a substitute motion. No, the legal process is that we're right for the agenda item. You cannot break this agenda item. You don't every council member from New York need to carry this item or not. No, that is their legal process. That is their legal process and we go back to the legal process. Do not lie. Because a woman found West needle right to speak on her item. Yes, and Mr. Namquan has his right. Make a motion. Mr. Namquan has the right. Mr. Namquan has the right to speak on this item as well. That's the legal process. Mr. Mayor, you have been running the mayor. That's right. Mr. Mayor, for the last year and a half. I'm going to send you an item. The process is made up for hours and then the process is a tough one. I think the cost is much too much. Just remember. Mr. Mayor. No, you may do that to me, okay? I think I'll listen to the talk for hours. I think I'll listen to the talk for hours. I think I'll listen to the talk for hours. I think I'll listen to the talk for hours. I think I'll listen to the talk for hours. I think I'll listen to the talk for hours. I think I'll listen to the talk for hours. I think I'll listen to the talk for hours. I think I'll listen to the talk for hours. Mr. Mayor, you have run a meeting. You should know. You should know. See, say, no. No, no. We cannot. That is a legal right. This is when people are talking. Okay. That is how legal rights is. This is how legal rights is. This is how legal rights is. Mr. Monser doesn't want to speak, then that's fine. But this is how agenda item. I have the right to speak my legal rights to speak on my item. Give order. And Ms. Nam Kwan has his right to speak as well. Take a recess. Let me ask you one more time, Council Member West. Do you please, let me ask you this question. Do you want to continue this item or not? My legal right to speak on my agenda item. That's what City Attorney said. I'm going to follow that. No, I'm going to follow what City Attorney legal rights for me as a council member. I look to file this in motion and I follow the process that is my legal process. And I'm going to continue to follow my legal process. Let me look at my year one more time. Councillor McGress. Councillor Member Winn. I remember when already make a substitute motion to continue this item. And you say, can it, okay? Now are you? Mr. Mayor, my legal process, I'm gonna follow that legal process. You cannot stop. You cannot stop me from my legal process. I am asking you to say, can it or not? If you don't say, can it be true? This is my legal process. City Attorney has just verified that. Mr. Mayor, please do not go rogue. You have run this meeting for so long. You know Mr. Mayor, please do not favor Kimberly Ho and you're getting a three. Do what's right. Okay. Do what's right, follow the process. If that agenda item, you always let the other speak. You have mistaken it. May I speak, may I have my legal right to speak? Or my gender item? You are mistaken with it or you are wrong. My legal right. My agenda item, this is my agenda item. I follow the process to put it up. And I got my second and we didn't even have a choice to speak. From the city attorney that we need to be on purpose. No, he already said that I'll legal rights. I have to finish and then the council, the council want to speak. They can speak on this item. Mr. Mayor, why don't you let us go for that as an legal process. Why are you going to move Mr. Mayor? Are you trying to protect her? Are you trying to protect Ms. Vice Mayor? I told you from beginning, not trying to protect her. That is how to protect the city. Mr. Mayor, your job as Mayor in council. Is to help and serve the people. When the people bring concerns up, let me ask you one more time, because remember West, do you want, Let me ask you one more time, Professor Member West. Do you want, it's my question to you, it's very clear. Do you want to continue to discuss this item or not? Yes or no? I'm going my legal rights to speak. Okay, so if I ask you one more time, if you don't answer, I assume that the substitute motion is failed. Okay, Council member West, if you do you want to continue this item or not, you second the item, are you continue? Okay, I assume that you withdraw your. Okay. I'm not. Do not. You have one. I know you want to fire city turning all. Please stop. Okay. We are. My. Thank you. Let's come back and please take room. It is time right now.'s at 10.30. I'm sorry about it. Yeah. Sorry. Go ahead. Thank you for a roll call, Mayor Wynne. Yeah, I'm here. Vice Mayor Ho. I'm here. Councilwoman Fan West. Fan West here. Councilmember Bonso. I'm here. Councilwoman Fan West. Fan West here. Councilmember Bonso. I'm here. Councilmember Wynne. Mary, you have a quorum with all members present. All right, thank you. My understanding that we have the motion and second on the floor. And we also have a substitute motion and substitute motion by Councilmember Hoda. Councilmember Nancuan Nguyen and seconded by Council Member West. So I'd like to be a commissioner. Mr. Mayor, I have my right. Is that another case? No, I have my rights. This is my agenda item. I waited. I followed the procedure and the protocol. Mr. City, can I ask you to ask? Can I say one thing? We have a mechanism with the same thing. We have safety motion with the second on the floor. This time I call for questions. No, no. We just had to do the questions. And would thou me talk? Yes, that's not right. We follow the protocol. We follow the procedure. We tell that we don't know the procedures. This item here. And City Attorney, we have a right. Let us be. You know what, Mr. Mayor? And I'll see the one to be up this one. When it come to censoring. You know, Amy from West, we personally listen to 20 true items that Mr must be made through. And then we demand that you honor. Yes. OK. I am going to make a decision. I am called a call for questions. No, that's right. No, that's right. The next thing is that you don't make a decision. Then break the law. OK, second. You have a lot of questions. Let's say, no decision that break the law. Okay, second. No, hit the law. Mr. Mayor, that's going to be a lot of wrongs to you. And sit in prison. You've got a buster. This item yet. Mr. City Attorney, please. You are already making law. It's illegal for crimes. I don't mind. You are breaking the law. Mr. Mayor. Do you have a second? Yes, I have a second. The second by question. No, the thing is that I was only right. I was wrong. We draw your second. No, I will legal right to speak. Because that's what you say, city attorney. You say every council is speaking. I am asking. Then you make a motion. The city attorney. Why are we making a motion now? We have to. Why are we making motion now? When Kimberly Hall is not spoken. Carlos is not spoken. My second has not even speak or the may. My. No, Mr. Senator. City Attorney. We have the motion and second on the floor. I have a spoke yet. Okay. Right now we are not talking about the item. Because of validity is not there. I mean, she's read the letter from somebody else who is not here. And that can't go on to the evidence. The letter from somebody else. We cannot say that is the evidence. No, no. I can have somebody drop up something and then we can talk about it. No. Until you prove to me that there is evidence of it, then we can continue. At this time, we have We have the city attorney. The attorney. City attorney. I'm not letting you. All right. You're not letting me present it. It's okay. It's okay. It's okay. I was thinking about it. But I'm trying to see. Am I right in terms of I can call for question now. Answer me. Why a couple questions without discussing? Because it's not a dictator. You follow the democracy. Follow the process. Democracy. Okay. This is a democracy. Please, Mr. Mayor. Well, if that's the case, okay, we have the motion. Mr. Mayor, please follow the process. The process is, if this is the city related items, items yes it is not because you are reading the letter from somebody else out there I don't I don't see that the validity that is it is a business item and I am not risking the city to be legal. All right. At this time. Okay. I did. I did. And you read the letters. You read the letter. You read the letter. I'm going to present the facts and the letters and everything. Well, the letter, if you let me speak, we have even evidence of movie, movie news. Let me present it. At this time, I'd like to thank you all for being here tonight. And I don't think it's going anywhere. And my role is to determine whether it's a validity to have this item. Because I'm not going to risk this it's a validity to have this item. Because I'm not going to risk this city for a potential litigation. So at this time, I would like to adjourn the meeting and the next meeting is the next meeting. The next regular meeting will be held. Yes, go ahead. Go ahead. Yes. Oral comment too. We have everything. We have them. You cannot go wrong. Mr. Mayor, you have to follow. Then let me call. Let me call for you to stop arguing. I am going to. Let me call for you to stop arguing. I am going to- This is my legal process. I can't read on the agenda. Okay. Whatever, you don't like. Mr. Mendez- City Manager, do you have anything? You have any concerns? Hold on, hold on. We cannot hear each other. The mic is off. I want to, I know, let me take a look to see if there was anything that had a deadline that we needed because the rest of this is really city business. Well this is city business, Miss City Manager. You cannot silence my voice. I'm sorry, I'm sorry. This is, there was a question. She in her capacity of vice. And have evidence that I need to present city manager. We are telling you we need to do this. You know what we are in the middle of discussing this item five percent and then we should not silence me because you favor the majority. I'm not doing that. Councilwoman West, I would be very careful with that statement. This is city business. You say this not city business? I did not imply anything. There was other city business and then you referring this is not city business. Councilwoman West. The mayor addressed me. He is one of my bosses regarding items, and so I'm simply responding to his questions. I have no opinion about the rest of this that's happening right now. I just need to ensure that if it's the desire of the mayor and the council to continue the rest of the items. If there's something on here that has a deadline, a financial deadline, or something that needs to be signed, that we address that. That's all. Okay. Go ahead, but we will continue this agenda item. That is not my call, so please leave me out of that. So go ahead, you can tell us what so the deadline Are there I so Public works a lot of these are public work items do we have deadlines for particular ones Yeah, we do we have five or there anything to discuss tonight We have three awarding contracts and one, basically authorization to purchase the water meter. I guess that one may have. No debt, I'm sorry. Basically that one. Can these basically be continued to the August 28th meeting? Yes, they can. Yes. And then as far as. As among the water board I know Yeah, that would be it then and that that's all we need it So thank you very much Thank you. There's no rush to to that now Senator Is this under my right? To continue to whether to continue the meeting or I can call for. You can make a motion to continue the meeting. That's my next question. Do I need to have the motion? I can make the decision not to continue the meeting. You should have a motion. At this point here, I don't see us going anywhere. We've been talking about this and we've been talking over each other and I just let it begin. I don't see that this is the validity or the decision that we have been prepared. That's fine. So my decision is to make a motion to adjourn the meeting. No. Okay. There is a second to check then please. Am I right? Councilor, I mean, City of the Republic. And to continue the items to the next meeting remaining items. Okay. Then a motion to continue this item. Yes. I second it. Okay. I second it. All right. So there is a second to continue this item next time. So please do your vote, Paul. We're not going to talk about this item. You know, you say to close, you say adjourn, right? Well, you're going to continue this next, all of this item. Right, we're going to continue the discussion. All of this agenda item to the next one. You're going to continue all of this agenda item to the next one. You're continue all of this agenda item to the next one, right? Is that what you're saying, Mr. Mayor? All the items to the next meeting. Okay. Yes, that's what I understand. I agree. Is there a second in? I second it. Okay, there's a motion on the floor. Okay, so I have a motion made by Mayor Wins, sector by Councilwoman Fan West, to continue the remaining items to the August 28th meeting. That's correct. I'll go out and call roll, Councilwoman Fan West. Yes. Councilwoman Burbonzo. I don't know. I don't have, I just concerned that next meeting is gonna be, have a packed agenda and we're gonna keep doing the same thing we're doing now. So what's the point? What's your vote? We're just waiting for your vote. Whatever you want. Skip me. Go ahead. Casual. You can say a thing. Mr. Mendo, you can say a thing if you don't want to. What do you want to do? Yeah, I just let's get it over with now. I guess with now. Is your vote. So if you want to get council over. Councillor Winn. Yes. Vice Mayor Hull. Mayor. I'm sorry if I may just address really quickly. How can you lose control of your own meeting? Please don't intimidate the meeting. So I just want to know, I mean if this is we're going to continue, it's going to be the same thing. Yelling in my ear and just talking over everybody. I don't understand how we we going to get things done? He's trying to do this job. This is recommendation from the CD attorney. So we're not going to do any way. We've been taking two recesses on this already and we are not getting anywhere. If you want to continue to dig onto this. recesses and this already and we are not getting anywhere. If you want to continue to dig onto this. Mr. Bay, I think she just spoke yes. I'm fine with that. I'll go ahead and vote yes. And, Marywin. My concern is it's going to be the same things. Exactly. At the same time, I don't see the validity of this. If she continue to read that item, unless she proves it to us, that this is indeed a CD related thing. Next time, I can take on it. Maybe she could prove between now and the 28th when you put it, bring it back. I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I can I No. Yes. We need to see something concrete evidence, something in writing so that we can determine otherwise it's going to be the same thing. So my vote is yes. For one motion carried. Okay. Even though we move all the items about oral communication, we continue with oral communication and that. Is it oral communication can see the item on that? I have to go to the table. I think you adjourn the meeting. You adjourn the meeting. So that's fine. We're continuing. Why to adjourn the meeting and the people not to, that's why we have to talk about this one. So at this point here. Yeah. The motion was to adjourn. Okay. All right. Meeting adjourned. So the comments will be made at the next meeting. We're going to be held on Wednesday, August 28th, 2024 at 6pm. Thank you for being here.
