All right. Good evening. We will call the order the special session meeting for the City Council Wednesday April 30th 2025 at 631 p.m. Miss Adele, do we have public comments? We do. We have two. The first is Karen Wydra. Karen, if you'd like to take the lectern, are you Karen? state your name and your address please. Karen Wydra 244, M the lectern, are you Karen? State your name and your address please? Okay. Karen, Yadra, 244, Mockingbird Lane, Heath, Texas, 75332, I probably didn't need to do all that. Anyway, a couple things that I want to talk about. First of all, I want to thank all of the, because I may not see you again, all of the outgoing council folks, whoever they may be. Thank you very much for your service because I know this is not easy and there's probably much more that you learned about the city Then you ever thought you would. And much more about the residents of the city. But thank you, because I appreciate every one of you for doing the job that you do, and everyone who runs for their own reasons, I appreciate the fact that they run, because it is a selfless act as far as I'm concerned. So thank you. Now for what I really came here to say. And we're on Mockingbird Lane. We're back to the Bristol Valley development. We are on the creek. We do not own the creek. Our neighbor actually owns part of his creek, but we do not. And since they have started their digging and they're developing, they have blocked the creek on numerous occasions, which causes flooding on our property, luckily far enough away from our house that it's not a danger to our residents, but nonetheless, they blocked the creek, so it stops running. And it has started to erode the creek bank there and it's more of a concern obviously for our neighbors since we do not own the creek but nonetheless there's a path that goes to the to the back of the property that we maintain that back part and so it's just it's become a pretty regular problem and we've had Richard Dormier, Fred Burns. Okay, sure. Yeah, not sure, but we've had several people that we've contacted, we've called, and they have come out, they have mentioned that yes, the developer blocked the creak way farther down, didn't tell anybody that they were doing it. And, you know, it's not being a good neighbor. Not starting off on the right foot, right? So, they've started their work hours or 7 a.m. to 7 p.m. One morning at, I believe it was 5.19, wasn't it? 5.19 a.m. B, B, B, B, all the tractors starting to back, or whatever their equipment is. Starting to back up. And one night Steve was out and at 7.50 something I said they're still working at night. So they're not obeying their hours. I mentioned that to Richard Dormier and he said if that's the case please call the police which I promptly did the next morning. And I hate wasting their time on something like having to go out and tell the construction guys to stay within their hours. That's just silly. They shouldn't, they have many more pressing issues to worry about than that. However, that was our recourse. That's what we were told by the city to do, so that is what we did. There is a neighbor farther down the street that is called three or four times because he actually just bought his house last year didn't know that that development was going in and so he's not happy but he's had to call several times and because they are not obeying their work hours. One of the more disturbing things for me personally was I got a call from my my neighbor saying, what are these stakes in our back of the property? And I said, I don't know, I'm not home, but I'll look when I get there. And sure enough, someone had come on our property and put stakes in there that said property that on property line. It wasn't even on the correct property line. They were on our property. They had no business being there without permission. And that's not the first time when they were initially doing the surveying. And I realized all this is on the comprehensive plan. So it's been in developed, you know, it's been in process for years. But when they were surveying for the property last year, there was guys back there all the time. And I even walked out there and I said, what do y'all do in here? Well, we're surveying. Did you ask anybody? Because, you know, I live here. I want to check with me. And so they don't, they're not, they're not considerate of people's property. So we promptly pulled up the stakes and that was the end of that. And what else am I doing? Oh, the stop light. Okay. So the last couple days they've had work being done in electrical lines and I understand for safety reasons they need to block off the street and make it a one-way road. Well they put their stop light at the end of the entrance and exit for our neighborhood which means that all the cars back up and you can't get in or out. So that's kind of a safety hazard. And trying to get out you can't see around the cars that are in the line. This may be a non-issue because they've moved the light. But I'm just telling you some of the things that we've been dealing with. They had one of their water trucks barreling down, and I kid you not, I'm not being, I'm not exaggerating. Bareling down the road a couple weeks ago, and bless you. And he was swirving, I think he is his load of water, gone a little wonky, and he almost took me out. And I had nowhere to go because I was stopped at the curb. And I mean, he was just coming around that curb where you can't see. And there are construction trucks regularly speed up and down the street. There's just a lot, okay? And it's, I don't know if it's anything. Anyone can do anything about but and I think you have to kind of catch them in the act in order to be able to say something but all of these things just point to not very friendly to us. Did I miss anything? I'm sorry I'm looking to my council for council. green. You have to get up here, talk. Did I miss anything? No, hermits. Okay. Okay, no permits for the creek to block anything. Anybody have any questions for me? If you can even do that. Yes, sir. We're at this again. 244 Mockingbird Lane. I remember well. No, we don't comment, but I want to show you the creek is leaving water that's standing you call hog here. That's a factor And that was something yeah, okay, thank you anything Steve widera to for4 Mockingbird Lane. Yeah, I mean, like regarding the creek, I call the Army Corps and they never had any permits to do any blocking of the creek. That comes off of, it's long branch creek and that comes off of a water conservation big pond. Fred Burns told me that they'd never had any permits with the city either to block off the creek. So that's just been an ongoing thing since last September. But I'm really here to talk about the fire hydrants. Since September, there are two fire hydrants on McDonald Road that have black trash bags on them, which signify that they're inoperable. I know there's also numerous other ones throughout the city. Is that $5.50, $5.49 going towards Cain? There's a couple over there too. It's a safety hazard for the residents. I mean we had big problem in the city already because of no fire hydrants and stuff. So I mean it's houses, it's families and I mean if the city can't afford the parts something needs to be done but this is since September and I was told that they were going to be fixed two months ago. Now one of the fighter hydrants, the black trash bag, because of the weather and everything is not no longer there. But the other one at the front of Falcon Point, it still has a black trash bag on it. So I mean, I don't know, I don't know who's responsible for it. If they have the parts, if they don't have the parts, or if they just really don't care. Because by me seeing that, they really don't care. And I'd hate for someone to lose their life or their property because, you know, the fire department was out there department was out there oh we can't use this. That's it. Thank you very much. So, please follow up with him. The last he told me about two months ago where parts had arrived and were scheduled the next day to be installed. And so, so that's the last I heard of it. Okay. So I assumed it all was well. Yeah. All right. Obviously not. I'll visit with him in the morning and send out an update to the council. Very well. Thank you. This is a close meaning to discuss the following. 3.8, Section 551.071, consultation with attorney on a matter in which the duty of the attorney to the governmental body under the Texas disciplinary rules of professional conduct of the state bar of Texas clearly conflicts with this chapter regarding city manager position 3.b. section 551.074 deliberation regarding the appointment evaluation reassignment duties discipline or dismissal of a public officer or employee regarding the city manager position we are now in executive session at 642. All right agenda item number four reconvene into open session and accordance with Texas government code chapter 551 the city council will reconvene into a regular session to consider action if any on matters discussed in executive session at 715.
