In ethics, integrity is regarded as the honesty and truthfulness of earnestness of one's action. Integrity can stand an opposition to hypocrisy. So what that basically means is if you don't have any integrity, you're really a hypocrite. What's an integrity mindset? Integrity often call the cornerstone of leadership and encompass his honesty, ethics, and commitment to doing what is right, even when faced with difficult choices. How do you tell when someone has integrity? Someone with integrity doesn't jump to conclusions. They always give others the chance to explain themselves and move forward considering those other points of view. Someone with integrity knows that things aren't always as they seem, and that each person has a unique point of view that deserves to be heard. What is the golden rule of integrity? If it's not right, don't do it. If it's not true, don't say it. That's the golden rule of integrity. How do you know if someone lacks integrity? Someone without integrity is perfectly happy to let others take the fall for their mistakes or even deliberately point fingers at others because they tend to be egotistical. They aren't very sensitive to how they negatively influence others and won't say they're sorry for problems they create. You could say that a psychopath, personally the psychopath personality, would not have any integrity, like George Santos. Remember him. What is a good quote for integrity? Especially if you're in politics, you should remember this. Don't ever promise more than you can deliver, but always deliver more than you promise. It is true that integrity alone won't make you a leader, but without integrity, you will never be one. People may doubt what you say, but they will believe what you do. I'm a mayor, City Council. Selma Garcia, six three other six and our wise 115 place throughout Florida. I'm here because, or what movement to be here is the situation that the renders for the new ways to energy facility has been presented in the Board of Commissioners in Miami-Dade County. And we have been fighting against considering the role as a possibility for that, for locating that facility. I decided as an expert in environmental sciences, as a PhD in environmental sciences, I decided to review the three documents that I am in the county request to contractors. One was about dispensing dispersing modeling, the other one was about the human health and ecological risk assessment. And the other one was the environmental impact assessment and mitigation for only for one site, which is West Airport of Eloka. The reason why the AIA was not made for the other sites was, in my opinion, kind of disrespectful because they said those two other sides, which are mentally and raw already has a waste management facilities in there, without considering the magnitude of the project. It's a project that is the largest facility in Florida, and actually is four times the size of the facility that we already had in here. I decided to compare my conclusions with the executive summary and we reached two very different conclusions. I decided them to use artificial intelligence software to analyze the document and reach to the conclusion decided them to use artificial intelligence software to analyze the document and reach to the conclusion, because I said this was made by the team of experts, and that is only my humble opinion. So let me see what artificial intelligence says. And it said, the airport west, Bologna, is a most suitable area for developing the ways to energy facility. The reason is health. Dural has the highest risk of non-cancerous diseases. The percentage of risk for cardiovascular diseases is 3% higher than the current situation and versus 0.0 with the other places. Even though the cost seems to be lowest in the world, human health is the highest and most important factor to consider. Keep in mind that the proposed facility, as I said, is four times larger than the one that we had in here. Also, we have evidence that we still have problems with equality in Dural after the facility was burned because we have the emissions of the land filling metally. Most people don't know that Albiz University's history dates back to 1966. But I'm not here to talk to you about history today. I'm here to talk to you about my personal history with the university. When I started to study psychology, I didn't want to study psychology. I didn't want to study psychology. Just in any institution that would give me a diploma, I wanted to study in a university that would give me the strengths and the skillset to have an impact in my society and not only my society, but something very dear and near to my heart, which is diversity and multicultural ethics and principles. So when I decided to study within al-Bizu, I decided to study not only in Albezo University, I wanted to study within this institution to make that impact. And that impact was not only gathered by me as an individual and as a professional student psychologist, but also within my family, which dates back to 1977 when my, my, I decided to study within Albezo University and then my sister followed. So I don't only have, not only one of you to know about the history, Albezo has to offer, but also about the history that it has within its alumni and the importance of that. Thanks to Albezo and some of my professors here present, I am not only able to send to before you today to say that I feel more than prepared to serve my community, but I also have the privilege to have the being approved to match in NYU and Russ University and my internship for Russ University. So I just wanted the of the community to know that because our university is here for you. We work to make a difference. You know, I skipped over a lot of the clinic offerings and the services, but I think that it's very important to know that we work to collaborate with our schools in D'Areal, with our families in D'Areal, and we have a number of our professionals here with us today in representing that. But what can we actually offer to the citizens of Derell? Well, let's see that $1,000 scholarship to Derell residents on a yearly basis at Albizu University. And I know that's the intention, that's the idea, especially when we talk about human trafficking, domestic violence. You guys are already working on these providing services. Yes, we are. I want to thank you for that. And I know that you will be in conversations with that administration as well to see how how you can continue collaborating with the city. We know that that is major for the city, the domestic violence and the human trafficking. I lost my train of thought. That's okay. Item B, you said? Item HC. I think it's the annual Comprehensive Financial Report. We have the consultative here. The manager's report, yes, ma'am. It's Andrew Fearman from, yes. Fearman, Kawaiiero. I forgot the rest of the name of the firm is here to present the information for our 2023 annual comprehensive financial report. Perfect. Thank you very much. Well, thank you very much. Once again for the record, my name is Andrew Fearman, and I'm a partner with Gauaiero, Fearman, Adon, and Garcia, or CFLG for short. I am the partner in charge of the city's audit. I am here to provide a brief presentation on the city's annual comprehensive financial report for the fiscal year in September 30, 2023. What I'm going to do is I'm just going to walk through a few items within the document, paraphrase a few things, and then open it up to any questions that you may have for me or for finance. The document itself is broken up into various sections. You have the introductory section, the financial section, the statistical section, and the compliance section. Within that first section of the introductory section, one thing that I wanted to point out for anybody who's following along is on Roman numeral page six. It's a it's a certificate and it's the certificate of achievement for excellence in financial reporting. The city did receive this the certificate for the September 30th, 2022 annual comprehensive financial report. It has been submitted for consideration for the 2023 financials. We do expect the city will receive it once again because it does meet all of the requirements and there are some additional requirements that need to be included not only that the document is done in accordance with generally except that accounting principles but in addition to that there's also other items that the city works hard to include within there to receive this prestigious award which comes from the government finance offers as association. I'm going to move forward to the financial section, which is a second section within the document, and going straight to page one, which is our auditor's report. And that has a few different sections. I'm going to paraphrase a few things within here. The first section is the opinion section. It's the most important section. It talks about what we've audited, and it also gives us the opinion on is the opinion section, it's the most important section. It talks about what we've audited, and it also gives us the opinion on the financial statements. So the auditors report now cuts right to the chase. It states that we have audited the accompanying financial statements of the city of Dural Florida as of and for the fiscal in September of 30th, 2023. In our opinion, the financial statements referred to above present fairly and almost to respects the financial position of the city as of September 3rd 2023. Now that's an unmodified or a clean opinion and it's of course the only opinion that you want on your financial statements. So the city does have a clean opinion on the financial statements once again this year. The next section talks about under what standards we performed or audit. And that states that we conducted our audit in accordance with auditing standards, generally accepted the United States of America and government auditing standards. The next section gets into what management's responsibilities are for the financial statements. And that states that management is responsible for the preparation and fair presentation of the financial statements. The last section I'm gonna point out is what our responsibilities are as auditors. And that states that our objectives would obtain reasonable assurance about whether the financial statements as a whole are free from a tier of misstatement and to issue an auditory report that includes our opinions. The next item within document is going to page four and that's the management's discussion analysis. And that runs to about page 13, so it's about a nine-page part of this 140-page document. And if no one reads anything else in this document, they should read this. It talks about the year, it compares currently to prior year, it provides explanations for those changes and it's written from management's perspective. So it has a lot of good summarized financial information as well. So it's a really, really good executive summary of what's included within the document when you get into all the financial statements and the notes and everything. So again, it sits about nine pages and there's a lot of good information within there. And once again, that's on pages 4 through 13 of the document. After that comes the basic financial statements and that includes the government-wide statement of net position as well as the statement of activities and the fund financial statements for the various funds of the city, the governmental for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the budget for the bottom within the fund balance that the city did have approximately September through 2023, 63.9 million of unassigned fund balance. So, you know, a very strong and good fund balance that the city has. Moving past the financial statements themselves and beginning on page 25. And this runs all the way to page 59. It's the notes of the financial statements. So this includes the required disclosures which provide additional information on the city as well as the numbers that are presented within the financial statements. So it is suggested that you read the notes in conjunction with the financial statements because it tells the whole story. It gives narrative information on the numbers. It also gives additional detailed information of the numbers. So there might be an amount there, say for the capital assets of the city, then the financial statements is just one or two line items within the financial statements, but within the notes of the financial statements, it's broken out by type of asset, beginning balance, the changes for the year, details on depreciation, and things like that that are included within the notes. So again, it tells the whole story, it gives all the information. Next, after the notes to the financial statements, and we're still in the financial section, is the required supplementary information. And this is information that is required under the governmental accounting standards board requirements. This includes budgetary comparison information for some of the funds, as well as information on the pensions and other post-employment benefits. The one thing I wanted to point out here, which is on page 60 and it's a AC on one page of the document, is a budgetary comparison schedule for the general fund. What this includes here is the original, and this is on one page. Again, a lot of good information on this one page. This gives you the original adopted budget, the final amended budget, and the actual results. And so it compares those actual results to the final budget. And that's what that gives a lot of good information within there as well, because you can see how the city did in regards to the final budget. And that's what that gives a lot of good information within there as well, because you can see how the city did in regards to the budget instead of what actually occurred. The, now I'm gonna move forward to the third section of the document, which is the statistical section. The statistical section includes a lot of good information because in many cases there's just 10 years of financial trend information, revenue information, demographic information of the city, operating information of the city. And the city works very hard, the city various city departments and the finance department work together getting information from within the city as well as outside of the city to include it within here. And this is actually a required section that is needed for the certificate of achievement for Exons of Financial Reporting. Again, this runs from pages 89 through 106. And finally, the last section of the document is the compliance section. The compliance section begins on page 107. The compliance section includes the reports that are required under generally accepted government auditing standards as well as the single audit act. And we are pleased to report within these reports that we did not identify any significant efficiencies or met two weaknesses in internal control, nor do our test finances and noncompliance. That's on the financial statement side as well as on the grant side for the work that was performed. So there's clean reports in the back as well. There's nothing significant to report to you there either. So good news, good news in the back as well in your compliance section. And you're also you also received with the with the financial statements a letter and it's the communications to those charged with governance letters It's various items that we required to communicate to you and They're all standard communications our professional standards require that we do communicate these matters to you Talks about if there were any any new accounting policies that were there were They were brought into place which there were this year. There was a new gas be that was implemented. In addition to that, it points out any disclosures that we think maybe you want to take a look at. It's nothing negative. It just points out a few things to you. A couple positive things within this letter is that we did not encounter any difficulties in completing and performing audit and there were no disagreements with management. Overall, it was a successful audit, it was a smooth audit. We come in, we ask for a lot of information, we process that information, then we ask for more information and we ask more questions. You know, we do our best to be as least disruptive to the finance department in the city's day-to-day operations. But again, it is a big effort on our side, as well as on the city side. And the city was up to the task to provide us what we needed to be in a position to render our report and be able to present to you this clean opinion today. Overall, I'd just like to thank Fernando Sol Michelle, the rest of the finance staff and the city team for their cooperation and assistance throughout the process. I'd also like to thank you for the trust that you have put in me and my firm to perform the services for the city. It truly is an honor privilege to be of service. Approving the waiver of a competitive bidding for the procurement of community rating systems program support and modification assistance services for a total amount not to exceed budget of funds. Authorizing the city rendered to expand budget of funds in for the NZRF. and providing for an effective date. Good morning Madam Mayor, Vice Mayor, Council, City Manager, Assistant Manager, Madam Clerk. My colleagues and residents, I'm Jane Decker, I'm your Building Department Director, and with me is Vinceehas, your Building Official and Flood Plain Administrator, and Flood Pl floodplain manager and Grisferius. Today we're discussing an important opportunity to improve our city's flood resilience and save our residents money on flood insurance premiums. It is crucial to note that many of these changes are being driven by external agencies not just our own initiative. The City of Dorault currently holds a community rating system, CRS Class 6 rating. This program administered by FEMA rewards communities for going above and beyond minimum flood plain management requirements. Our current rating provides a 20% discount on flood insurance premiums for properties in the special flood hazard area or SFHA. We have the potential to improve our rating to a class four, which would increase that discount to 30%. Now while this improvement aligns with our goals, it is important to understand that we're also responding to those external mandates. Number one, locally Miami-Dade County's Department of Environmental Resource Management, Derm is requiring regulation of storm water to the 25-year event, county-wide, and this is through chapter 24 of the code and would become effective after the September meeting of the Board of County Commissioners. Number two, at the federal level, the federal flood risk management standard or FFRMS, by executive order and through HUD is compelling higher free board standards. That's adding two feet to the base flood elevation for non-critical actions and adding three feet to the BFE for critical actions. This would to maintain eligibility for HUD funding. And this would become effective 90 days after September 9th and when it's registered on the Code of Federal Regulations or CFR. Number three, FEMA has preliminarily published and the city just received last Thursday confirmation of map updates and ingress has some maps here we can go through in a minute and lastly because of participation in the higher regulatory standard of CRS, the city must also update its program for public information, PPI, and the repetitive loss area analysis or RLAA every five years. These external requirements are pushing us towards higher standards. So the pros of pursuing this improvement are obviously increased savings for our residents, enhanced flood protection measures, and improved community resilience. So we do need to point out that it will require effort and resources to implement the necessary changes and gain the 473 points needed to meet the class we're rating. This includes updating our flood plain management practices, improving stormwater regulations, and revising our flood damage prevention ordinance. These changes will require obviously time, staff, resources and some community outreach. So new regulations may also impact future development. So I know that's a concern for everybody on the day. Strictor building codes and land use regulations can always affect construction costs and limit certain types of development in flood prone areas. So while these changes ultimately benefit our communities long-term resilience, they may present short-term challenges for developers and property owners. To achieve the higher CRS class rating, we're requesting today that first and foremost, we'd like to gauge your feedback on the proposed changes. And then second, to waive the competitive bidding requirement, using budgeted funds and approve the resolution to retain WSP and their consultant Doug Stroud, David Stroud, sorry. They've had a proven track record and have helped us improve from the seven to six previously. Their expertise is crucial in navigating the complex requirements of CRS. So we believe it aligns with our strategic goal of exceptional service and promoting community resilience. And we'd love to hear what you have to say if you have any questions for Ingress or Vince or die further into the maps. We would come back at a later date, obviously, once we have completed the consult with the consultant, bring back the changes to the floodplain ordinance and have a presentation at that time as well. As you, as you might know, on November 5th of this year, Florida voters will decide on amendment three. These amendments seeks to legalize no medical personal use of Murray-Wanup products and accessories for adults, age 21 and older. The amendment allows adults to possess purchase and use marijuana products and accessories for personal consumption by various methods, including smoking and ingestion. Medical marijuana treatment centers and other state license entities will be permitted to acquire, cultivate, process, manufacture, sell and distribute these products as well. I recommend that as a council, we oppose amendment three. They are, again, since the amendment seems, in my humble opinion, seen as a threat to existing laws, community safety, and residents well-being, which I believe he has to remain as residents of city, something that we have to keep in mind. Certainly, the role, as we all know, it's a family-oriented community with deep rooted values and our foremost priority, most always be the well- deep rooted values and our four most priority, most always be the well-being and safety of our residents. Certainly by opposing amendment three, we uphold our commitment to maintain a safe and healthy environment for all residents. I believe this is important that we take a stand not only as elected officials, but also as the city, as residents, as parents, because the last thing that we wanna see is certainly people walking our street, smoking marijuana, without any consequences or affecting our quality of life in our city. This is something that for me, it's, again, not only as a racing, but as an elected official and as a father. The last thing that I want for my seven-year-old boys to see people smoking marijuana in the streets. So, I see it as a well-being of our community, something that at the same time potentially can affect our safety and the way that our police department will have to operate. Obviously, this is a stay low. If it passes, we will have to deal with that after November 5th, but I believe that it is important for us to take a stand. Also, other municipalities has done it here in Miami-Dade County. I also have some data that I'm going to pass around. I'm sorry, thank you. Data shows not only the effects of marijuana consumption in general, which I have my own opinion about it. But it also shows certainly the effects taken half in our community and our residents. And now in November, like you mentioned, and I think that we should, my position that we should wait until December, so we will be able to see what will be the results when it comes to the ballot because there's so many things that are going to be presented now on November. So if it is okay with all of you, I would like to make a motion to defer to December. So we will see what will be the conclusion and how the vote will be in November. And then from there, like you said, we will have a more clear understanding on the decisions that the voters are making so that we can actually have a better plan of action with our police department and how we can work based on the decision that is going to be made by the voters in November. So like you were saying to educate, I think that that will be much more effective for the residents, for them to understand that we can bring scientists. We can bring people that are expert in the medical field when it comes to neurocognitive and all of that. So they will be able to explain not just something that it is just here in the valley, but like you said, to be able to educate our youth in how this can affect them later on. Like I said, I mean, the research is being there that has shown that until the brain is not mature 25, 26, 24, 25 years old, it does have shown that it can affect. But also, I think that we should not intervene when it is something that is in the ballot. I mean, there's so many other things, so important that is also for a community that then we should bring almost everything you know and have a discussion but I think that to be fair we you know to have a better understanding and definitely we can before that we can actually bring and I will be I will definitely would like to cooperate and being in our sciences to be able to bring some of my colleagues and we can do some presentation events. As you know, in July 28 of this year, Venezuela had an opportunity to turn out and vote for a new leader, and they did. Our well-meaning members reflect that in Mundo Gonzales won the July 28th, 2024 election. However, Nicolas Maduro, as a specter, has refused to accept the results and relinquish control. Since then, Congressman Maria Diaz-Balar and Senator Mark Rubio with bipartisan support have submitted congressional resolutions in the House and the Senate, recognizing not only in Mundo Gonzales as the president-elect of Venezuela, but at the same time condemning the actions of Nicolas Maduro. As you know, the city of Dorao is the home to the largest population of Venezuelans, many of who have faced the terror of Maduros and Hugo Chávez-Ruchim. And he's only feeding the city of Dorao formally at top and support both congressional resolutions and at the same time to urge the Biden administration, as well as Congress, to demand the release of political prisoners in Venezuela, just to give you a number in the last three weeks, over 2,000 people have been incarcerated by the Maduro street gym. Madam Mayor, Council members, this is a call to artist. As I'm sure you'll agree, the Dural Central Park is going to be the crown jewel of our parks and recreation system. And we have a significant landmark there that being the water tower or the water tank and the idea is we're putting out a call to artist having a $60,000 budget to get bids on a mural or some type of art that will further enhance the beauty of this creation that the city of council embarked on that being the park Thank you. Mr. Manager, so this is an item that I had actually brought to parks and recreation when I came back. I'm envisioning that this water tank become an icon of community involvement and unity. And so one of the things I did not see in that call to artists because I didn't get to see that anything was attached with an actual request of what we're going to be asking the artists. But one of my requests when I brought this to them was that it be something that the community can participate in. A section of the tank that all the community could come and paint because ideas to bring everybody together and kind of leave their mark. When we did Dorauglaid's Park, we did a sculpt, we did the iron piece inside. Every council member got to come and make each a leaf that was part of the sculpture, which I thought was beautiful. And actually it was open to the community. A lot of people came. But in this case, I envisioned that when this happened, that there may be a piece of the tank that the community could come and paint together Whether it's a panel that's painted or whatever the call to artists In vision I just want to make sure that in our description of what we're asking for from the artist that we include something in there That says that we would have a day where the community would come out and participate in that in that action Most definitely ma'am I will make sure that staff follows up on your comments and that they are taken and given the strongest consideration prior to any commitment to any type of artwork that's decided and finalized. Okay. And then I wanted to add another part to this, if possible, because I thought about it last time. I was there and actually, it was my community, I was coordinator, came up with the idea and I thought it was great. You know, we're right in the flyover of the airport with that park. And so I'd like to see if there was a way we could add for the word or our logo, Daral, to be put either the top of the building or on the top of the water tank as well. So I wanted to see if there was a way we could incorporate that into this call to artists, because it's a great opportunity for branding as planes fly over that you look down and you can see the Darau logo on top of the building or on top of the water tank. The solicitation was placed about a year after that session, if I'm not mistaken, February of this year. And we've had another strategic session since then. I think that the scope has changed and new comments from this strategic session from this year's should be incorporated. And also, I actually have a concern regarding the scoring. The firm being proposed came in fourth place during the first evaluation, and then came in first place during the second round. And that just seems very off to me. And I know we had the same issue with the school zone cameras scoring when we saw scores change. As such, I proposed canceling this solicitation, that we're going to be discussing when we saw scores change. As such, I propose canceling this solicitation, reforming the scope to include comments from this year's strategic session and resubmitting the bid, and I'll be making a motion to that effect. This exact list of people were recognized in the 20-year anniversary in a very special way. And so again, I'm not against it. I'm not gonna sit here and vote against people that I think have done a great job. There's people I would add to this list. But at the end of the day, I just think it looks very un... It looks invaluable that so many people are being given the same homage as a huge group. So that's my comments on it. That's my opinion. Again, I'm not going to not be supportive of it. I value many of these people, but I did want to leave it on the record because there's been man who's criticized for how many keys to the city they give in the past. The policy that is in place today, well, not the exact policy today, but the policy that was put in in 2015 was because or 16 was because the mayors previously had given so many keys to the city. So I just think that, you know, we're kind're doing the same thing over and over again. I just wanted to leave that on the record and hopefully in the future it will change. I was out there on Saturday for the first tournament. Of course, Parks and Recreation for the Fourth of July event, which was beautiful and we look forward to having a next year in our park so that everybody in the community can be there. And it's been, it was a great little vacation that many got to take. I know at the beginning of this meeting, we also recognized the passing of one of our own. We had a done a moment of silence for Pedro Garcia, which was a longtime parks and recreation maintenance employee. And so I know the staff came together and helped family. And so it was very sad to learn of his passing. I want to congratulate Councilman Pinedo for being named to the NLAO Board of Directors. It's a great opportunity to have that recognition by our city, and it's a part of that board. I want to thank everyone who was integral in the recognitions and solidarity that was pulled together in the very hard moments for our Venezuelan community. Many of us were out there for them and I think that we continue to show our commitment to democracy and to seeing there will be granted. And then lastly, there's a lot of birthdays this month. And one of the action items we took was asking for a formal opinion or legal opinion from our council at the time of what the city's position would be if Dorao was chosen as the location once again for the Coventa site. And we have not received that. We have an understanding that the county will be taking up the item in September. Additional to that, we had directed staff to find an expert to review the Archaedis report and give us an argument, which I know one of our residents did today rather well just with AI, but I think it's important to take a look at that report and have an expert give us an actual, you know, an actual argument that could be used should the city need to take legal action, which I think we will, if they decide to put it back in Dharal. So I know both of you kind of came in in the middle of all that, but it's now been three months. We will be seeing that come forward. We as a council will have to make a decision if it's not put in Deral and if it is put in Deral and I think that we need to be ready to have a discussion about it as a council. So. Most definitely I will consult with the attorney and as well as finding a third opinion somebody that can is qualified to render an opinion and give us guidance on that matter. Perfect. Okay. Last but not least I want to make sure that our community comes out on August 24th for the first phase opening of Dorao Central Park. I think we've all been out there several times and are extremely excited for the official grand opening of the park. So that's my mayor's report. Move on to council comments. Council comments. This week was, is the first week of back to school. So I want to thank everyone for that. And also Mayor, I know you mentioned the Central Park opening. I actually had a discussion with the manager where I expressed that this opening is such a big deal and event. It took a lot of people to make this happen, including those of us that are sitting here, those of us that have sat here before us. And so I would like to actually see our city communicate directly with the County Commissioner's Office, as well as the County Mayor's Office, to ensure that their participation is going to be, they're going to be with us participating in the grant opening. I don't believe that something that was done. I think that definitely should be. And so again, I don't know if everyone here would agree to that. I think it's something that we need to do. I wasn't able to add it as an additional item. So if we can all agree to do that here, I think that's a good step in the right direction for all of us. Thank you. That's all. Okay. I think that also if we're going to check with our offices and the city managers going to confirm with our offices, see also our state and also representative to see if they will be also available. If we're looking at county mayor commissioners state legislators it could get very difficult to find date that everybody's a part of so I definitely think the residents are ready for this to open and that advertised date is extremely important has been out there for weeks so I think yes absolutely we need to invite everybody but I think we need to stick to getting open and then if we need to do an additional little smith ceremony and photo op for everybody to be there we can do that as well. I think everyone's had a chance to also tour the park individually before hand so that's that also provided a backdrop for people to participate that we're part of this process But I think finding dates is extremely difficult that accommodates everyone's schedule And I think the most important people are residents and they're ready to get out there and this park needs to be turned over to them Mayor Yes, I agree that we should we really don't need to coordinate with everyone. I mean I think there should be an invitation sent out to the legislators. I mean it's and to my understanding that's what's happened right you've sent out a letter but you've also done a manager if you can correct me from wrong. You've also done already some outreach to the commissioners office and the county mayor's office, right? Our park staff has done that may. Yes, ma'am. Yes, and what and there's a date proposed that it's a week after the 24th, correct? That would be Labor Day weekend. Yeah, so I would I would say again, it's up to all of you guys, but I think that there are some people that should be part of this opening and moving at one weekend is not going to be sufficient. Do we have to take a vote on that? Should we have to take a vote on that? Mr. Labour, Labour Day weekend is a holiday and you're going to have a lot of residents out of town. So I will certainly follow the council's direction, but those are two major considerations with regards to exposure that we may have financially to contracts that have already been inked. I well I'm going to agree with Councillor Lone Porra that certainly future events, certainly we have to take these into consideration and plan it better. But for me, you know, racing is our first. And I'm not going to change, I mean, even if we have the meeting internally, I'm not going to change my position. This is a park that is way delayed. My name is Bill Watts, everyone. William Bill Watts, some people call me Captain Bill, but I'm Bill Watts. I am the chair of the Dorao Military Advisory Committee, one of the hardest working committees of the city. For those of you that are not aware, we have one of the major facilities within the city of Dorao, major command facility, Southern Command. So part of what the military advisory committee does is we bring together the veterans, the Southern Command service members and the community. That's our main focus for the city just to give you a little bit of background of the five current city sitting members, four of those five are all combat veterans. Some of them is sort of more than one tour of combat. So I'm here before the council today to request, as we've done in prior years, to hold the Daryl Military and Veteran Family event at the Daryl Glades Park on November 16th. This is again to bring together the community, Southern Command, and the veterans within the city. The last check, I think we were around 900 veterans, and I think that number was from two years ago. During this event, we're wanting to hold also a health fair, a small health fair. We've already reached out to the chief of staff of the Miami-B-A. He's willing to provide some doctors and different departments for that. Last year, we had about 300 sign up for this event. We're hoping to make it bigger. Each year our military events have only gotten bigger and bigger. Veterans Day started out, you know, 20 to 40 people. And I think it was over 100 this last year. Memorial Day, which started in 2018 with one person putting it together. We had four veterans come out, a reef that was purchased personally by myself. We placed it on a lot gate at the Dural Veterans Park. Our last Memorial Day event, we had almost 100 people. So it's more than doubled each year since we started it. So with that Mayor and Council you should have already received a memo. We're requesting 7,500 due to inflation and rising cost. Though we do not foresee it being that amount. We're in negotiation with Southern Command, providing the bounce houses that we pre-prior, we had to rent for the day. We're also working with Mission BBQ to either get the cost of the food, reduced or partially donated as well as the new little caesars here in Dorao to provide the piece for the kids. as well as the new little seizures here in Dorao to provide the peace for the kids. So we're working with many different vendors to make this event even better. And like I said, each year we only hope to grow and make it bigger. So therefore we're requesting a waiver of the rental fees of the community center as well as the park. Per the mayor and some of the council members request that info will provide their kayaks in fishing equipment for the day to be there along with safety personnel and numerous volunteers to help cover the city. So the city does have to have a great burden on the parks department. As always, that info has helped our parks department whenever there's been an event. So therefore we would like to request those items as in the memo. Then in closing, I'd just like to say to everyone here. If you see a service member or a veteran, please give them a thank you. These are special individuals. These are people who actually signed a check up to their life to give you the freedom that you live here in the United States today. Thank you. Thank you Bill. In public works, ridership in the trolley continues to be very popular. In June, there were over 45,000 in revenue through the pay-by-phone app. And street maintenance, street and road maintenance continues to be a priority as indicated by the number of ongoing projects and work orders that were submitted to council this month by our public works department. On public affairs, followers of our social media platforms have reached over 84,000. The overwhelming number of interactions have been very positive. The police department is currently involved in the reaccreditation process being conducted by the commission for Florida law enforcement accreditation. By all indications, per the conversations I've had with Chief Lopez, we seem to be on solid ground towards reacreditation. There was a recent mock assessment or dress rehearsal, if you will, which we passed with flying colors. So we are on solid ground towards reacreditation. The popularity of our parks continues to grow a year to date attendance in compared to last year is up over 9,000, I'm sorry, over 9% for a total of 976,000 part visits. So we're at the cusp of touching 1 million part visits. And lastly, our Human Resources Department worked very efficiently with evergreen solutions to provide an accurate assessment of positions and their pay scales in comparison to other municipalities in the region. It's like the way the whole system is set up from beginning to end with all the rights supposedly that people have and all the studies that are made. Yadda, yadda, yadda, yadda. And if we don't do what they want, they're gonna sue us and they'll probably win. Yada, yada, yada, stuff like that. Well, what's the point of even having council? Why don't we just let, you know, number 45's buddy over here who works for him and Mr. Russo and all these other guys on the team just do whatever the hell they want. Why did they even have to come to the meeting? That would be real freedom. But supposedly they have to go through, you know, hoop one and hoop two and hoop three. But it's like the whole thing is a set up. They always get what they want within reason. And they start out saying, well, we want 3,000 units. And they know, damn, well, you're not going to get them 3,000 units. So they settle for the 1,500 or 1,498 that they wanted anyway. And on top of that, they're going to put in some retail down there. On the bottom, and they have to get approved for that. The whole thing's already passed. The city didn't say anything against it, but if we try to stop them, they say, oh, they're gonna sue us. This other thing about Midtown, D'Areal. This, both of these things have been here before. This is from the old rodeo. What they're doing here is they're increasing the amount of units from 253 to 552, but supposedly because of the reduction in the office space and the commercial, it's going to be okay because there's going to be less traffic than before, even though there's 552 units, double the units. I'm not buying that. I don't think it's gonna happen. So when you have double the units, you have all kinds of people there, and it's all rental units, by the way. These are all rental units. What the hell do we need more fricking rental units for? And these things in the Trump, they're all gonna to be rich people investors buy them by blocks and then they're just going to sell them and rent them out anyway. Nobody's going to live there that lives in that. They're all going to be like a vacation place. So none of these people that are living these places are going to be talking to me or you. And that means four times the amount of cars we're going to have, the vehicles we're going to have in those new buildings. As it is right now, the 107 Avenue, it's got a lot of traffic jam. We have that new industrial zone that's developing in 41 street with 107 Avenue. And that's gonna bring a lot of warehouses, guess which way everybody's gonna use the people coming from the northern cities like Haya-Lio, they're gonna work on the warehouses. They're all gonna use a 107-o-sip and avenue. That's going to be impossible. So I'm really concerned of what is happening, what's going to happen with our style of living, what's going to happen with our quality of life, is that being considered, is there a plan to, for all the traffic is going to come along. I don't know, I haven't heard about it. And I'm really concerned. And what really annoys is that in our specific community, we've been waiting two years to get our pool back. And we're waiting for the permits for the city. So it takes years and years and years. And but these things, you know, they get so fast and everything goes like smooth when it's big people or big investors on these things. However, the current Venezuelan government has refused to acknowledge and accept the electoral defeat, undermining the democratic process and the will of the Venezuelan people. We, within my, the approval of this resolution, we were recognizing at Mundo Gonzales as the legit president of the Venezuelan following the results of the July 2024 election, this resolution and force the city of Doral's stance of democracy and human rights and aligns with the values of our significant Venezuela community. So I hope that my fellow Councilman members also approved for support. My resolution on recognizing that motion to be on the president of Venezuela. Today I will be speaking about my EGLE projects. My EGLE project is reserved for veteran parking signs that I would like to install in the route public spaces specifically parks. The sign is rustproof, durable and laminated. The base is mobile, making it easy for park personnel to move them in an event of harsh weather. A permanent post is also an option giving it a more uniform look. There are a few examples of other places doing this. The Sacred Heart Hospital of Pensacola, Orange City, Florida, Lowe's of Davy, Florida, and the City of West Miami are all examples of this. By adding these signs to public areas in the city, we can make sure our veterans continue to feel our appreciation for their service and sacrifices. Durral already has an increased military presence with the U.S. Southern Command being located in our city. I think this project will be a welcomed addition to derives public spaces and simultaneously maintain and improve relations with those residents and visitors who served and continue to serve. My grandfather was in was in the Air Force and fought in Vietnam and I have been taught to respect and honor the sacrifices of them and all veterans. Veterans are the inspiration behind this project. For my proposal, I'm sorry, I'm trying to find my place. So the places I would like to have my project would be the parks in Darau, including Darau Central Park, Darau Cultural Arts Center, Darau Glades Park, Darau Legacy Park, Darau Meadow Park, Downtown Darau Park, MAU Park, Morgan Levy, Trails and Tails, Veterans, White Course, and other public places, also the substation and here. The sign is a rust proof and laminated and sturdy, and it's made out of aluminum for durability and sturdiness. UF, a top five public land grant university, currently works alongside Miami-Dade County to create free seminars that educate the public on composting. The request is being done through the Environmental Advice Report. We have the chair of the Environmental Advice Rewards. You're involved in has been instrumental in bringing the composite training partnership program to life. We sincerely appreciate your contribution and recognize that this project will not be possible without you. We want to highlight some of the assets that you have that will be key to the success of this program. Number one, I will say strong leadership and teamwork. Excellent institutional relationship with the Miami-Dade County Department of Solid Waste, which is the policy maker of this business. Capability of managed scale, focus on training and experience coordinating program with different institutions. We are grateful for your active involvement in crafting this project. Your effort has allowed us to continue working together in the future to improve the environment of the city of Doral. Now I also want to say thanks to our people that has been involved in this project. First, I would like to say that 18 months ago, Christi Fragher was elected mayor of the city. And at that time, she brought a policy of entering the city with the community and the community of the city. In order to do so, one of the initiatives was the creation of the advisory committee and thank to the policy and to her, now we are discussing this project for the city. Also, I want to say thanks to Maureen Porra, who is our committee liaison with the Council. She has been working with us, advising us on the process and other matters. I want also to say thanks to Connie Diaz and Ting, because she has been very efficient making everything happen during the meeting and program in the meeting. And also want to say thanks to the member of the environmental advisory committee for his participation, discussion, he advised in the project process program. We present Laura Baskis, the University of Florida Program Director for the Miami-Dade County Composting Training Program, a program that now holds the potential to be extended to the City of Doral, bringing hope and inspiration to our environmental initiative. Welcome, Laura. Thank you. Thank you, Seth. Connie, can you guys hear me? Yes, we can hear you. Okay, perfect. First of all, to think Sethesar for including me in this council meeting and also do say who works for the city of Joral that we've worked with for many many years. I know Joral is very environmentally conscious of what's going on in the city. So we're pleased to partner with you guys and that you guys reached out to us for this composting program. As I said I mentioned this is a current partnership with the University of Florida, the Miami-Dade County Solid Waste Department and the public library system because that is how we are hosting some of the programs that we have available or some of the workshops. The purpose of this particular composting program is established in order to have sustainability efforts to reduce the waste disposal volume. The great thing with Dural is that the Home Chemical Center is located in Dural and that is where we are distributing most of the composting bins. What I've noticed with some of our workshops is that we don't have that many participants from the city of Dural and I think it also has to do with marketing. So I'm going to continue and talk to you guys a little bit about how our program works. We have a five-year memo of understanding with the Solid Waste Management Department. This project has been going on or this program since 2014. I took over this position as the Urban Horticulture Agent and Master Garden Reportigator for Miami-Dade County in 2021. So I've been running this program for about three years now. In the past, the Solid Waste Department was giving up 240 bins per fiscal year from 2014 to 2023. Now they are responsible for purchasing a thousand bins per fiscal year. The bins have to be at least 80 gallons or more. They're responsible for preparing reports for the office's sustainability and then reproducing any brochures or training material that we need for this particular program. And recently they are now helping promote the composting workshops, which they work in the past. And that has helped greatly to increase the numbers in participation. Of course, our responsibility with the composting program is to schedule, organize, you know, develop the curriculum, you know, obtain the instructors. We have to find different locations around the county to present these not only virtually, but we do many, many more than just four. We also recently I just created like a post-serving to see all the people that attended the workshop. You know, are they using the compost bin? You know, how much material are they composting so that we can get some feedback about the program itself? Before we were giving out the earth machine, if you look on the right hand side, this is the Earth machine. Recently, we changed it to the Geo bin. There's a lot of pros and cons. You know, we wanted to reduce the carbon footprint, the Earth machine, which we were giving out before, was purchased in Canada and was being shipped from Canada. The Geo bin is made in the United States States and it's also made with less plastic. The earth machine can only make about 80 gallons of material, of waste material where the geobin can make about 246 gallons. It's also in a smaller box. If you look at the box here for the geobin, it's really small compared to the earth machine, you could break it up in three pieces and people were concerned about taking it home. It is less expensive, the Geo bin, we can purchase with what we could purchase 300 earth machines, we can now purchase 300 of the Geo bin so that we can get out, you know, more into the community. The cons are, as you can see, the Geo bin does not have a top on it. So there's some people have some concerns about it not having a top. I mean, you should have it. You could have it covered with like a mesh. We go through all of these things during the program when we do the training. So we give you different options. Miami Beach residents, they actually have a different program there. That would be another option for Darrell. If you guys were interested, Miami Beach, the Surfrider Foundation applied for a grant and they purchased tumblers for their residence. So only the people in Miami Beach could get the tumbler where you can actually crank the bin and it kind of turns for you. It goes, it's actually sideways and you can turn the material. So they have funding for that. Again, we are doing this for free, but if the residents of Dorawer are interested in something else, maybe that's something the city could look into purchasing or applying for a grant for specific compostments, if that is a concern. Also, homeowners can also create their own compostment. It doesn't have to be made of plastic. We show them different options of how they can make a compostment at home. So we do provide them different resources. This is the Miami-Dade Solid Waste Departments website. As you can see, it talks about our program, provides the links to the different registrations. They also posted on their social media as do we. What really hit big and really got the program promoted was the Instagram posts. They posted it one time in Instagram and it increased the participation. So I'm going to show you that in one of the slides as well. Currently what we're doing is we're having the classes online. Like I said, most of the classes are virtual, so everyone in the county can attend. After the program is over, homeowners are given a link to a survey, as you can see here's a screenshot of what the survey looks like. We do ask for demographics information just to make sure that we are serving all the diverse communities. At the end, when they hit submit, this voucher will pop up the orange voucher. It will give them a date of the voucher when they can pick up the compost that been there in Jorral. And then we also provide them our contact information in order for them to ask us questions if they have additional questions after the training. We do have the chat open so they can ask questions throughout the chat or throughout the workshop in the future. I would like to do some workshops in Spanish because right now we're only doing them in English. And we also are going to try to do the workshops pre-recorded online. So the idea moving forward would be to do like a 30-minute presentation online already recorded. People would then fill out the survey and we have to work on how to show proof that they took the class. So we're in the process of doing that now with the Solid Waste Department. As you can see here, like I mentioned to you, I started in 2021. Here are the numbers of our attendees. The first year I had about 394 people attend and how many people receive vouchers. As you can see in 2023, our numbers increased to 670. That was just because of that one in Sagram post. And about 574 people received vouchers that year, last year. So what I did is, a 1169 people that attended the three years of workshops, I sent them a survey to see, you know, ask them different questions on how they're using the compost bin, how they're using it. Out of those thousand people, we had about 310 that responded. 92% of the people said that, you know, they received the free compost bin and they're using it. 80% are saying they're continuing to compost at this time. I'm still determining the amount of waste that's being diverted because it was an open-ended question. So we have to calculate what people are determining that they are composting. And I'd also like to look at the amounts that the Earth machine is saying that a household of four people would then compost. So we can compare notes with the residents. And how can the city of Dural become a partner? You guys can one become an official partner. Like I mentioned, whether it's helping us market to the residents of Dural. Maybe we can host a couple of programs there, maybe at the Home Chemical Center, maybe at the city. Also, having a compost resource page on the city website, if you guys do become a partner, it'd be great to have that information available on your site for some of the homeowners. And ordinance of the mayor and the city council, the city of Duralford are approving a modification to mid-town Dural plan unit development PUD, faces 456, master development agreement, and pattern book to increase approved residential units from 253 to 552, reduce commercial grossly civil area for 96,875 square feet to 22,700 square feet and remove 75,000 square feet of net leaseable area of office use providing for implementation and providing for an effect of date. Thank you Madam Clerk. Okay we will open up public comments for item 24-5772 and 24-5775 at this time. I do have one comment card from Mr. Richard Glitzdap on item 2 4-5-775. Richard Glitzdad, I'm against this, and I think I already kind of explained why. Supposedly, they're cutting retail space and office space, but they're increasing. They're doubling the amount of units from $253 to $552. These are all rental units. I think that's horrible. This community is winding up becoming a full 100% rental community. You can buy a condominium here and rent it out and leave town. That's what almost everybody's doing here. Where I live, we have 162 units. It was built in 1999. I'm still there, I'm living there. I plan to live there and retire. And now all you see is rental people. It's like a big flop house, come and go, come and go. And the type of people that rent these places don't have any money. The apartment next to me at one point had nine people living in there at a three-bedroom apartment from Peru, nine people. I helped to get rid of three of them. There was still six left at the end. They destroyed the apartment. Now somebody else lives there from Venezuela and it's a lot better. But that's what happens here. These people are gongettos. We already know these Venezuelan gang people are here. They're not property owners. They rent. We don't know who our neighbors are. Nobody talks to anybody here anymore because of all the rental units. This is what they're going to do here. So what they decrease the of all the rental units. This is what they're gonna do here. So what they decrease the office and the other stuff. Okay, supposedly there's more trips with offices and retail in this, but I'm not buying into it. If you can have up to nine people living in a three-bedroom rental apartment, that's a hell of a lot more people than they're gonna go to a store and come and go. And the ones that come and go in the stores in the offices, they don't live there, they don't create a demand on the police and the fire and the schools. When these apartments fill up with trash, they're gonna wind up in the schools over here. With your kids, you can't keep them out. Those of they have papers or don't have papers. That's what Doral's turned into. Just look around. Go to the supermarkets. Go to the streets. Look at the crime reports like I do. There's more assaults than ever before, more fights. These are things we never had here. People are freaking out in the streets and beating a lot of each other. They're not necessarily shooting each other like they did at city plays, but there there's a lot of fights here and there's also a lot of shoplifting because these people don't have any money to buy anything. They just shoplifted it. That's what we're getting here. I'd rather have less units and leave the stores alone. Thank you, Mr. Goldstein. Would anybody else like to speak on these two items? Last call for public hearing on items two, four, dash five, seven, seven, two, last call for public hearing on items 24-5772 and 5775. Okay, public comments is now closed and we will hear from staff first. Okay. This is up as you are going to give a brief explanation first. So just to put us all in a proper posture, one of the things that's unique about this application that you're going to hear about a little bit more is that this is tied into a settlement agreement that was entered with Atlas 1 and Atlas 2 back in 2004. It's well negotiations started in 2004, the first agreement ended up in 2005. Sorry. The reasoning for the agreement was the disagreement of the city of Duraal with regards to the intensity of what Alice was proposing to place there. Alice got permission from the county, not from the city itself, city intervened and it was able to obtain certain, profits and certain benefits. Part of it were certain parts that we received and also the ability by additional property at discounted rates and also lesser intense and the other side of the area is the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of the area of address additional city's concerns. There were additional reductions in the overall amount of units, and there were additional benefits as far as open land that was provided to the city. The third amendment brushed up a couple of issues dealing with the naming of the business, the entity that was only to century, and also, there was an additional amount of units and a mixing as far as the intensity of it. The other iterations of the agreement really dealt more with the shifting as needs changed. The current iteration of it, what it's basically doing is as we heard in public comments is reducing the amount of commercial space and also office space. So retail space and office space and increasing the amount of units that are going to be allowed. That being the case, though, Council, it's important to note that in this particular area, the allowable uses 19 units per acre and reality what we're seeing here is about and the other thing that's interesting about this is that we've been able to negotiate the ability to have a heroes housing actually within the negotiate it was offered by the applicant. Heroes housing is a program that my mid-eat county has specifically for teachers and first responders for them to be able to get the property at a discounted price. And these are going to be able to get the property at a discounted price. And these are going to be market rate type apartments. So they're not going to get anything, you know, a studio versus the market rate being, you know, it's two and one bedrooms. No, these are going to be market rate two bedroom and one bedroom homes. The same ones that everyone else is going to be able to get. But at a discounted rate based on this hero's program. And that's basically the agreement that's before you. And then everything else is the actual amendments that are going to follow in. Ms. Lopez can discuss those a little bit more. But I'm open to any questions that you have right now with regards to the settlement agreement. Thank you, Lorenzo. Thank you, Mr. City Attorney. Michelle Lopez, Interim Planning and Zoning Director for the City of Dural. If we could bring up the presentation, please. Thank you. The applicant, M.G. Dural Partners LLC is seeking a amendment to settlement agreement that City Attorney just described and also an amendment to their master development agreement and implementation of a pattern book for property along Along east side of northwest 107th Avenue from 86th Street to 90th Street. It's up. It's three parcels that are approximately 7.1 eight acres They're a future land use designation is community mixed use with a zoning district of plan unit development. The applicant is seeking three items through this modification. The first is an increase to 299 dwelling units from the two, I'm sorry, increase 299 dwelling units from 253 to 552, removal of 75,000 square feet of office space and a reduction of 74,135 square feet of commercial space, which would realize from 96,875 to 22,740 square feet. The property is surrounded to the north, south, and east with future land use designations of community mixed use and zoning district planned unit development. Similar to the property that we're speaking of. To the west is Ronald Reagan High School and that's an institutional use and then we're also bounded by to the west residential communities that have a medium density residential and use designation, and a multifamily residential zoning district. Like the settlement agreement, the MDA or the master development agreement has gone through several iterations since 2014. When it was originally adopted in 2014, there was a maximum unit count of 1,548 dwelling units, 300,000 square feet of commercial space, 75,000 square feet of office space, 47,000 square feet of clubhouse in the first three phases of Midtown, which has now been expanded to six phases of Midtown. In 2020, the City Council modified the Master Development Agreement by allowing the development of unbuilt parcels as individual phases. So IE, instead of developing all the phases together, you would do it in segments. So phases 2, 3, 4, 5, and 6 could be built independent of one another. The next iteration occurred in 2022. And that modification provided for an increase of 170 dwelling units which took the unit count from 505 to 675. And there was also an increase of commercial square footage from a 3250 which took that square footage from 89750 to 93,000. I'm almost done. In 2023, there was another modification, which increased 59 dwelling units, taking that unit count to 734, and then also increasing 11,000 52 square feet for the clubhouse, which took that to 58,000 52 square feet. And then there was also a reduction of commercial space of 31,936, which took that count from 93,000 to 61,064 square feet. So for this evening, we're dealing with what we all hope is the final reduction with the final amendment to the MDA. And as city attorney and I stated earlier in our presentations, the request is to increase an additional 299 dwelling units taking that unit count to 552 for phases 45 six, the removal of 75,000 square feet of office space and the reduction of commercial space from 96,875 to 22,740. And on the screen, I have a comparison table. So to the left is what's currently approved to the right are their proposed amendments. And in red, you'll see in phase four, there's only a net increase of 20 units, no changes to commercial. In phase five there's a net increase of 76 units with a net decrease in commercial space of 11,370 and finally in the last phase, phase six, there is a net increase of 203 units with a net reduction in commercial square footage of 11,067.5 square feet and a net reduction in office space of 75,000 square feet. So when you look at the comp plan, your community mixed use land use designation allows for a maximum density. And in the CMU, the maximum density is 19 units per acre. And this project is realizing somewhere between 14 units to 15.1 units per acre, where again, your comp plan allows for up to 19. So that number is important because when we look at comp plan changes and when we look at the MDA changes and settlement agreements and all of these guiding documents, we want to make sure that those units don't exceed what the comp plan allows. When we look at comp plan and when we look at development, we look at traffic. And so the gentleman indicated the request does have a reduction in traffic that has been confirmed by the applicant's traffic engineer, the city's traffic engineer and Miami-Dade County Department of Transportation and Public Works. So the traffic statement for the record. The results of the trip generation comparison show that the proposed changes to phase 4 and 5 of the development will generate 724 more daily trips, 20 less AM peak hour trips, and 12 less PM peak hour trips when compared to the approved phase four and phase five development. The analysis also shows that the proposed phase six development will generate 2,488 less daily trips, 88 less AM peak hour trips and 156 less PM peak hour trips when compared to the approved phase Six development as the changes in the development program decreased the overall trips in the AM and PM peak hours The impact of the project on a adjacent roadway network will be reduced As my colleague indicated, city attorney during his presentation of the settlement agreement, the applicant is also profaring a hero housing covenant that's running with the land. The covenant will benefit Miami-Dade County public schools employees, city employees, and first responders. The hero housing be 26 units in phase four, 15 units in phase five and 15 units in phase six. There are terms and conditions that have been offered by the applicant through the covenant. The rental rate will be controlled with specified affordability ranges for 20 years. The maximum monthly cost shall be restricted to an amount affordable to a workforce household with a total annual income not to exceed 140 percent AMI. One third of the hero housing units must be affordable to households making an annual income equal to 65 percent to 90 percent of the AMI. When third of the hero housing units must be affordable to households making 91% to 115% of the AMI. And one third of the hero housing units must be affordable to households making 116% to 140% of the AMI. The declaration is to run with the land and shall be binding on all parties and all persons claiming claiming it for a period of 30 years from the date of the declaration is recorded after which time it can be extended automatically every 10 years until severed by the city and the property owner collectively. With that staff recommends that the mayor and council members approve the proposed modification to the Midtown, DRL, PUD, Pattern Book, the Master Development Agreement, the Declaration of Restrictions that I just spoke about, and the settlement agreement. I can go through it rather quickly. More for the benefit of the community who I did have the opportunity to speak with and we will be meeting with the association who did not attend the workshop. So if we can excellent, thank you so much. So I'm here representing MG Dorao Partners, the contract purchaser of the property with me this evening is Alidio Torruba, as well as Ariel Gutierrez and George Sapero from NG Developers, Ernesto Deluca from Delcop Group. They are the property owners. Our design team, Mario Pascual, Peter Kiligian and Andrew Star from P.P. K.S. As you all know, P.P. K.S. has worked in Dorao for decades since before the city's founding and it has been part of this Midtown Dorao project for many, many years. We also have one Espinoza from David Plummer and Associates, our traffic engineer. And I should mention that the delay in getting this project to hearing has been our work in trying to ensure that we provide more than what is required in infrastructure. And I'll speak about that in a moment as it relates to parking. So staff explained our proposal as to what we're here to request. So I'll get into a little bit more just to orient the community to the site. Midtown Darau, the PUD is 30 acres of land on the east side of 107th Avenue originally approved in 2014. The PUD is also bounded by the FPL transmission corridor to the east and there's 50 acres of conservation land that the city negotiated in the past that is protected also to the east of the site. Our application involves the northernmost three phases for five and six, which equates to 7.21 acres. Faces four and five are south of 90th and street and phase six is north of 90th Street. Our approvals on today's agenda is the amendment to the PUD pattern book. That is what implements the proposed site plan, which will be before you in September. Our amendment to the development agreement, as well as the amendment to the original section 8 settlement agreement. We'll be back for site plan and tentative plat approval or hoping next month. So to just orient the community to the surroundings we mentioned the FPL and the 50 acres that you see to the bottom left of the, I'm sorry, bottom right of the screen and you'll see the Coronado project further to our West and that was the HOA that we've agreed to meet with between now and second reading. Ronald Reagan High is immediately abutting the site across 107th Avenue and that is we think a very important part of this project because they are our most instant neighbors. I think it's also important to note that Day County owns a large land assemblage to our north and Medley does as well. So this really is the northernmost area of the city along 107th Avenue and the reason for our proposed revision to the development program. The existing development program as that has been approved as was mentioned includes 150,000 square feet of office and commercial. We simply believe not only is it market reality but most importantly this is at the northern edge of the city and what we're looking to do is create more ground floor neighborhood serving retail rather than 150,000 square feet of destination retail. As the traffic analysis shows and the planning director mentioned that's a significant reduction in proposed trips. This is our proposed development program. I mentioned the ground floor retail and phases five and six which equates to 22,740 square feet and again a total of 552 residential units. I think it's very important for the community to note that this represents an effective down zoning of the properties. We're eliminating all office uses and significantly reducing commercial uses and providing a modest impact to this expanded residential use would completely be offset by the removal of this component. So there's no real changes to the massing of the structures, just a significant reduction in traffic. The other, I think, important note is that the overall density staff mentioned the issue of this actual project only being about 14 units per acre, where 19 is allowed in the community mix use. I think it's really important to note that applied to the section 8 overall, it's 48% less units. What we are overall the buildouts will be 48% less total for the site. So specifically, at 19 units per acre, this PUD would be allowed 8,835 units and we are proposing a total density at the end of the entire section 8 and I misspoke not the PUD the entire section 8 4,669 so that's a 48% reduction. All the reviewing agencies have reviewed and approved for levels of service concurrency and the reduction of daily vehicle trips is 4,000 and I do have Juan Espinoza if you have any technical traffic questions to respond to. it was approved with special parking rates. And that was something that has been problematic overall to the city. Our application proposes to go through and have today's parking requirements, which are more stringent, and eliminate those special parking criteria that the PUD otherwise has. So we will comply with today's code, and that is part of the approval. Staff mentioned the hero housing proper and that just goes to the fact that Ronald Reagan High School is our immediate neighbor. We've had numerous meetings with their PTSA as well as their principal as ways to work together and hero housing was something that was referenced as something that we thought was a very positive nature to have employees of the school board in the city to live close to where they work and that is itself has very specific language and we're happy to work with the council as to making it more stringent. But the bottom line is the goal is for us to let the school board the city and the first responders know when there's a vacancy and give them 45 days following that notification to have preference. That's basically the bottom line and it's covenant to. We've already informed those agencies that this project is hopeful to come through in the near future. So we want to make sure that people know about it. And I know from speaking to the folks at Ronald Reagan high that they're already making plans and people are quite excited about it. These will be one and two bedroom units identical in size to the market rate units. They'll have the same interior and exterior finishes, which we think is very important to make this a real community regardless of one's ability to pay for market rate. This control is for 20 years and we also thought it was important to pay for market rate. This control is for 20 years, and we also thought it was important to allow for not only the economic growth of each individual family or household within this project, so to allow a range of income, we're hopeful that people will do better every year, and we want their ability to stay at this project to go along with that. So we provided the full range of affordability for 65% area to a very immediate income all the way to 140%, which is the maximum of workforce housing. And I mentioned those restrictions. So onto the project itself, these are, this is the overall Midtown Duralo project. You'll see the the northernmost three phases that are the subject of this application to the left of your screen. This is the actual site plan itself and you'll see that there are three buildings. Each building is aligned with the streets with pedestrian access along the streets as well as with the Paseo in the middle of the project. All parking is moved to the rear of the site, butting the FPL easement. Commercial spaces and generous pedestrian plazas also front 88 streets. And you can see that on a hundred and seventh avenue, there is a public park, Plaza component, obviously privately maintained with a gazebo that is part of the project as well. We wanted to create a synergy for people coming and going, hopefully students and families can live here, teachers, administrators can live here and across a hundred and seventh avenue safely. And we'll speak to the infrastructure in just a moment as well. Here you can see a little bit better on the actual site plan. If you have any technical details I can go back to that slide. And this is a building 12. This is specifically phase five. As you can see it's a well articulated facade with ground floor retail and a colonnade. I have the pleasure of representing MG in other developments, and I welcome you to see what they're doing in highly and coral gables. Very incredible architecture, well found out design, and of course, PPKS does not disappoint. This is the elevation of 107th Avenue, where you can see the three buildings at a maximum of 10 stories with the parking garages in the rear, not visible, 107th Avenue, at about six and seven stories each. This is the line of sight from Ronald Reagan High, where you can see the colonnade frontage on 107th Avenue. This is the entrance into the parking garages between phases four and five, and that parking garage is shared between those two buildings. And this is from the FPL easement, where you can see that the rear facade is fully articulated. The garage is fully lined consistent with deraude urban design principles. And you can see that the balconies, etc, create that eye on the street that really helps with safety concerns. Another very important part of this project is that it boasts the resort style amenities that Dorao is known for and acclaimed for. In addition to residents and guests enjoying the Midtown Dorao community facilities that are to the south of the project, each one of these buildings is built with their own resort style amenities, including pools, as the ones that you see, and children's playgrounds and bark parks as well. Last but not least, we're committed to upgrade infrastructure in the area. Of course, there'll be a bus shelter for the city's wildly successful trolley system, where hopefully it'll take doing Roman students from Ronald Reagan High to FIU in Miami-Dade College, we'll also be providing a traffic signal on 107th Avenue and 86th Street. That is a goal of assisting pedestrians at crossing 107th Avenue and allowing for that morning school commute to be a little easier and with more control. That was the issue that I was referencing earlier that while a traffic signal is not warranted under county guidelines, it's something that we thought was all for the benefit of the community and we asked to the county's request and the city's request and that will be constructed and paid for by the applicant. In summary, this project represents a significant first class development for the city of Darau. This project has been long in the making. This amendment is one that's in keeping with the trajectory of the city today. It is a significant reduction in traffic impacts. And we would respectfully request your approval of the items before you. And of course, we remain committed to working with the city, our neighbors, including Ronald Reagan High in the interim. Also is our technical traffic engineering team from BCC engineering, who I believe actually is one of the consultants and engineering teams for the city. We hired them to be our traffic engineers and they're here to answer any questions that this council may have. I wanna introduce some of the folks from the Trump organization that are here tonight. I want to start with Mike Vergara, who is the senior head of development and design for the Trump organization, who came down today's his birthday. Happy birthday, Mike. I'm sure he's very happy to be spending it here. I have Michele Damley-Court,, I'm sure you know from the resort. He's a general manager. And we also have Ed Russo, who has been a long time consultant and advocate, even when they started to develop Bedminster in New Jersey. He has been working with the Trump Organization. And he has two claims to fame, and I'm going to say it, number one, that beautiful bridge that you have over the 97th avenue, that was Ed Russo who got that done. And he also got done the covenant for the Blue Monster, the conservation easement. That was actually his idea, and he was the guy that they got it through. And now you have a huge conservation easement of over 150 acres. You know, you hear, you know, the public and I'm always very respectful. And they say, you know, we things go quickly and that it up. I mean, this project has been before in the process since the year 2022. I actually started to work on this project in March of 2021, and I remember going to meet with the president and Eric Trump at their offices in Mar-a-Lago. And, you know, what the ideas were for the development of this project and they wanted something that would be complementary and enhancing to the existing golf course and country club that are there. The designer although we're not approving the site plan today, we are going through the zoning process, but the site plan process, the site plan that we've had put together, actually respects the way that the sun moves, so that way the shading doesn't affect the growth of the grass on the golf course. We have four amazing golf courses there, and we're not touching a blade of grass on those golf courses. We're not taking away any green. We are in the existing parking lots that are adjacent to the resort. We are developing and hopefully want to develop a luxury condominium project and high end retail project. the Minion Project and High End Retail Project. And I'm gonna go ahead and maybe go through some of the slides. I don't know if that's the beginning. And that would be the views that some of the units would have. The course of the resort was obviously the brainchild of Alan and Doris Cascale, who bought thousands of acres in Doral when this was really like nothing. The only thing closest to it was Miami International Airport, which had just moved there. And they bought it because they wanted to create a club that would accept Jews. And from that history, that resort came out. And I think it's really becoming an iconic, or what I would say is the heart of the city. And a lot of people come to visit the city of Dural from all parts of the world, because they want to play in our golf courses, and they want to be part of that community. That vision of people wanting to come and be part of this is what's really driving this development. You see developments that are off Florida where you have golf courses and they put homes around it. And here we're constrained. With space we're in an urbanized area. And what Doral has is a very unique situation. You have four full 18 size golf courses next to each other. And it's a unique proposition. And we believe that there's going to be a lot of international and buyers and local and national buyers that like the brand, the Trump brand and want to come in and be part of the golfing experience that they could have there, be part of the country club, and obviously be part of the fabric of the city. We do expect that most condominiums and Miami Beach are in Brickle, that these will be occupied maybe 20% of the time, because they will be second homes. These units, the way that they're built, are going to be starting probably in the rubble about $2 million. And I understand that some people are skeptical that this could be done, but I think there is a vision to do this. And if you see what happens on that golf course and the people that are coming there that come to play, the rates to play at the Blue Monster are $1,000 per person during the height of the season. So we believe that this is gonna be part of that. And I think that this project will enhance that country club and will preserve it. Since the cast girl sold the property, the to the previous operator, the resort and the golf courses and I think the people in the rural estates would argue were not really kept very well. When Trump bought this in 2012, the Trump Organization, they've invested hundreds of millions of dollars into this project. They have a world-class golf courses, the Blue Monsters once again hosting professional golf. And I say this because, you know, if we weren't good operators and we would be doing things wrong, you would have this entire room full of people from Doralis states criticizing us and now wanting this. And the fact that none of our neighbors are here from people that live either in the silver or Doralis states I think says something about the way we operate in our commitment to the city. The Trump organization has been a good partner with a city since 2012. We've hosted events at our club and we've been, well, we believe, a good community partner. We've been very mindful of how we've designed this project not only to not impact the golf course, but to also allow the country club and this future development to thrive. We've basically created in our parking lots in about approximately 56 acres. We're coming forward with a proposal to do 1,498 units and retail. That is a substantial reduction from what we originally came in to ask for when this process first started in the year 2022. In 2023, this went through a land use process which allowed, you know, at that point, I believe it was, I don't know how many units, I think it was over, yeah, 2300 units, so there's been a substantial reduction to where we are today versus what we had originally proposed. And we have been working diligently with staff and through various iterations. We've had a couple of planners, had a couple of city attorneys, and we've been working with them diligently to try to make sure that this project moves forward in a thoughtful and deliberate manner. You know, I want to, you know, because you know, you see these site plans and you really, you know, can't really visualize them until you really see the renderings and I'm going to show that although we're not approving the site plan, but I will talk a little bit about the main focus of the site plant is going to be the center building which is on 87th Avenue and 42nd Street or 36th Street and that parcel the is going to have a civic plaza that's about three acres in size. It's going to have a canal walk. It's going to have art and it's going to have every single feature required under the Dura-Ral Boulevard Master Plan. We are not only having it in front on 36th Street, we're actually respecting the Dura-Ral Boulevard master plan up 87th Avenue as well. Meaning that little sidewalk that you have now on 87th Avenue that you could barely walk through is going to be expanded to meet the same criteria that you have under the Raul Boulevard master plan. So we believe it's going to be a great enhancement in terms of connecting downtown Dorao to the towers and vice versa to create connectivity. Some of our traffic improvements will include high visibility crosswalks and we're spending about $5 million in traffic improvements, creating turn lanes, and to remove any type of traffic and additional roadway dedications to remove any type of traffic from 41st Street in 87th Avenue, and for us to be able to keep the level of service that's required under the city's code. I'm going to show you, I'm sure a lot of you have seen some of these renderings because we have been working with them, but these are beautiful condos. You have the ability to make them larger, so we're probably going to have even less units because really the goal is just to have three and four bedroom units on a lot of these condos. You can see this is some of the vistas of some of the walkways through this, through the plows in the civic area. And that's going to be accessed by the public, and that's just for the residents of the condos. And you're going to have the restaurants and cafes. You can see in the background there's the canal walk on behind the trees. I want to talk a little bit about trees. We're preserving all the specimen trees on the property. The mahogany and the oak trees are going to be preserved on site and the black olives that are along the canal way are also going to be preserved. So you can see some of the different perspectives. That's the actual canal that exists currently and we're gonna activate that. And that's a vista of the three acre plaza. Much different than many of quite frankly, of a lot of the developments that have been developed on that corner. And if you look at them, even the newer ones don't really have this type of amenities and an approach to the community. This is, again, another vista of the towers and this is basically the end of the presentation. I do have a video we could play. I was a key club advisor for many years there at Gehomes Ratic over 17 years and now I'm a Coani and if anybody knows about Coani's, we're about giving back to the city's, giving back to the children, to the many students that in the Dural area right now, a lot of your schools Dural, Charter's one of the biggest ones, Ronald Reagan, the opera Dural Charter, they all have key clubs. So we're bringing the Cuanese Club of Dural to your city. I think it's going to for what I'm hearing. It's going to be a great organization to help our people that are struggling because believe it or not, like somebody else said earlier, there are a lot of people here that do struggle. And we wanna help them. We wanna help kids in the upper charter school that don't have uniforms. I know last week, I, like about a week and a half ago, I sent some of you guys an email that came from me, but I know that now you guys are having night out, so I couldn't compete, but we were having a appeal of pizza, we were having a meet and greet. So I would like to invite all of you to please become a member. I would love to have you guys on our Kiwana's board. It doesn't take a lot of your time because I know a lot of your time is here.
