Moving into agenda item number two, this are public comments. Miss Adele. Yes, we have one speaker signed up tonight. Michelle Thurgood. If'd like to take the lectern to state your name in your address, please. Michelle Thurgood, 2404 Grant Court. So I wanted to speak a little bit today in regards to what was mentioned and discussed in the last meeting with regard to some of the dangerous intersections we have in Heath. Now, I have, but seven children and five of them, I have taught how to drive on these roads and in doing so and seeing the roads and the dangerous situations that some of them pose intersections that maybe need some refining, it's really become a huge concern for myself and for the other residents of our town. So I've done some studying into how to help prioritize some of the infrastructure improvements that could definitely improve the safety needs of our city. So with regards to rabbit ridge 550 in McDonald road, I would definitely suggest we consider that intersection as well as perhaps even the one at Country Club, where Country Club and Ridge Road intersect. Both of these roads have hazardous blinding issues that make it difficult for drivers to attempt to see what's coming at them. and therefore making turns can be really dangerous. And particularly the one on 550 that was discussed. There's a lot of accidents there, definitely highlighting the dangers that are inherent to that intersection. So what I would propose is that we work closely with text.in to help these intersections and concerns get prioritized with them. The first person I would discuss this, these accidents that were highlighted, is with Jeff Bush. He's the Director of Transportation Operations and Travis Campbell. He's the Director of Transportation of Planning and Design, both there at TechS. I would talk to them and present the plan as follows. I would say the city of Heath has these concerns about these intersections. And so what we would propose in conjunction with TechS. would be to pay for a traffic study, have that done by us, and take the findings of that traffic study back to you so you could see the issues that arise and the needs to remedy will be done. Now the traffic study itself is a $7,000 price tag. But as was quoted in the previous meeting, it is valid $1 million to add all the turning lanes and put in the traffic signal, the design and all of that completed from start to finish. It's a very hefty price tag. However, with the traffic study done and with the information about the safety issues in place that presented wood. And also, even coordinating and having these discussions before you even invest any of that money, we definitely help prioritize it for tech. And as they are the parents of our roads, right? Like each city can decide if they, what they want to do with their roads to a point, but at the end of the day, tech. Will, the safety of the citizens of Texas rests at the feet of text. So that is why bringing this to their attention is so important. They do have that obligation to the citizens of Texas. The only other thing I would maybe add to this proposal is to approach our road county commissioners road consortium and see if they would be willing to even pay for the $7,000 price tag of a traffic study to begin with. Therefore, we're not out of pocket any money and we get the safety improvements that our citizens request. All right. Thank you. Thank you, ma'am. Mr. Dill? This all. All right. Very well. Moving into agenda item number three. This is our Council and City Manager's comments. Mr. Dell. Thank you. Mayor and Council, I do have a few quick announcements for your information. First of all, just a reminder that the heart of Heath, 5K family run is coming up on the Saturday before Easter, April 19th, and that will be in the reserve this year while the Town Center Park is under renovation. Register by March 31st if you'd like to get the lowest price on your registration, and you'll find the link and more information about the entire event on the Heath website. And this is just a really fun tradition in our community. So we are on track for record signups and anticipate a big crowd this year. Starting tomorrow, the City Council chambers are getting an AV system upgrade that will make our meetings run a little bit smoother and it'll tidy up some of the things that have to be sitting out in this room in order to run our meetings the way we do right now. It'll also be a boost to our public participation and it'll add live streaming ability to our meetings. So that's pretty exciting. No more having to come up and sit in the room if you want to be participating in real time. So the work as I mentioned kicks off tomorrow and it should be wrapped up by March 28th and it'll be ready for the Planning and Zoning Commission meeting that's coming up on April 1st. And then I have a few quick things from DPS. You might have seen on social media that our Drone Program, Hawk One, is operational for DPS. We have four pilots on our staff, one on each shift, and this technology we're expecting it to be invaluable for our guys and gals to be able to assist greatly on fires, criminal apprehensions, search and rescue operations, et cetera. And we will continue to push more information out about that program as we're able. On March 27th at 430, from 430 to 730, we're having a rock, there will be a rock wall children's advocacy center, annual go blue for kids event and recognition of child abuse prevention month. That event is that standard service. Again, it's March 27th from 430 to 730 at standard service. And then finally, our very own Sergeant Waitiman is hosting a self-defense class for NCL. Remind me what that stands for. Charity League, thank you so much. And that is happening on the 27th also and that's here, right? Yeah. At what time do we know? 430 p. So if you want to be able to do all the things that Sergeant Williamson can do with his Giujitsu proficiency then come to that class and he will train you up. Discuss an act on the scope of work for engineering services to Kimlee Horn, not to exceed 58,000 for redesign and bid services well number one in town, so our part Mr. Creed. Mayor council, as we briefly discussed, we ran into some extremely long lead times on our last bid package that we were going to put out for well number one, it was leading at the 67 weeks in some of the, some of the electoral items, which is well over a year before we even get, you know, operational well in the park, which was, which was not going to work out with, sorry, ability to water this grass, and even finish the park. We need to get the welders in and out to even get some of the park amenities completed in the parking lot area of vegetable street. So what we've done is what the help of Kimley Horn, who's here, this is Julio, I've got many before. We rework the design or are masking to rework design. And we're going to change it to a design that we will not, will not require those lead times because we won't have to have those those medium voltage transformers and but it will require a VFD on-side and a little canopy we'll have to build over it because we've got to keep a VFD cool. So that's what this this is asking for is for the $58,000 for just redesign services for the electrical and then a bit services to go ahead and put that out for bed and bring that back to us. Additionally, we are going to break this out and just get the well drilled and then I want to bring back to you. change order for the sea water to put the underground popping in and then we'll bring back services to put the actual treatment treatment. Yes, we're going to do a low voltage with a step up VFD. And that's that's how we love that kind of stuff. I love that. I know. Sorry, very low frequency drive to operate the action upon. So what that means is we're going to get off the shelf transformer is what they call it off the shelf. So the lead times go away, but we do have to build a VFD on site, which will be a little bit more than we anticipate to be out there in the park. It's going to be covered. It's got to be air conditioned. And we don't have to build a building, the cabinet itself can be air conditioned, but we do have to build it. And we'll have to change the plants to make this work. Can't be accessible fighting a little kid who wanders over. So it's already designed to be in enclosure, and it's all locked up. You can't get in. OK, the enclosure is locked up as well. So it's fenced, and all you see is a cabinet where they can be on it this long. You can't get into the cabinet. Okay, so the time differential and the cost differential, we're now looking at 58,000 additional regardless of pumping the girl on the well. Yes, man. And that's just for design It's for design and bid services. Yes, man And at this point since he hasn't bid it we don't know how much bigger of a bite. This is gonna take No, and I asked those questions and it looks like there's some savings on the on the front end, but they're the wire and then the encore is going to be able to move the conduit. Now we're on have you run, I'm getting the leads here a little bit so we fall on. We're going to have to run along the road out here that goes down to the tower and then bring it back and then set an additional transformer. Now on core is saying that they believe now we can move all that, do away with all that and we'll come straight in the long work we call Festival Street kind of where the construction is here. that an additional transformer. And because of this design, they're gonna do away with two conduits, we'll just bring into one line. And are those normally prohibitively expensive? Verbal frequency drives. We have them on all of our other pumps. It's our pump station. We have some of our lift stations. It's a common item, but it's not necessarily an off-the-shelf item. I guess it could be if you bought what I would consider a cheaper one. So we really aren't buying an off the shelf one. Now I think they're going to build this. The same art specific needs. But let's get off the shelf transformer. It is an off the shelf transformer. So the transformer was the first big hurdle. Right. And so if you get around that, you use a conventional transformer and then then coupled through the FD, which then gives you the flexibility. So I'm assuming that the motor is still the pump is still going to be the same horsepower that you had originally intended. Correct. We'll just be driven by the FD instead of a medium voltage transformer. You got it. Okay. So the pull rate would be expected to your point grant to be in that higher end, whatever the draw is from that offer. Yeah, so it's right because the conversation last time was that if we went kind of to the smaller pump, we wouldn't potentially get the optimize the pull rate out of that. You wouldn't even in a design that well that big because you're not going to get gotcha that That kind of flow rates. Gotcha. Correct. Okay. So this VFD is kind of the turbocharger on the... It's our way of stepping the electricity up. Gotcha. So the pump can get the required juice it needs to pump the water we want to pump. Yes. And an idea that I asked the well-driller, I said, is this even worth it again? I asked him a point of mind. I said, look, I saw on your, when you, when you submit some documents, he'll listen, they can say, you could not guarantee the 700. And I said, that kind of worries me. He said that he said, we'll put in all our documents. He's asking, I saw on your, when you, when you submit some documents, he'll listen. They can say, you could not guarantee the 700 and I said, that kind of worries me. He said that he said, we'll put in all our documents. He's asking no reason on this well and do over 600 all day. I said, well, that's great to hear. Right. And that's the third world. The word's kind of told me that. So I feel like you feel good. Okay. So with you know, with that being said, with the long poll on the 10 with the other version being kind of 60 somewhat weeks, what might this get us to just before, you know, before you do the whole scoping and the RP on this, you know, that was the long pole on the tent before it's 60 somewhat weeks. What would this system allow for? At least times for the VFD. Yep. I'm understanding it's forward five months to get this one so six out of twenty weeks. Give you a significant. That's great. That's significant. Okay. Thank you. Very good. Thank you, Brother Gantt. Quick one. So just I just want to make sure, does you print a back-and-oh up and understand the sequence. So Kim Lee Horne put together an initial design using the medium, medium frequency transformers. The medium voltage. Medium voltage. Medium voltage. Medium voltage. Medium voltage transformers. And that was and then we bid it. Is that because I see in here what you're doing design and bid. We did not bid it properly. It had been, it was we. City manager, previously manager gave it to to Helen Wilkeson without a contract and they ran it through their bid process, but we could not use that. Uh, that, that is not the proper current procedure we could use. So I can clean me back down to that and, and, and we, we were going to have to re-bid it regardless. to follow for certain procedures. But then the electrical issue also raises head because of the reach out to Hill of Winston said, hey, all these contractors coming back to us, it's a year and a half, a year, a month, a year and three months to even get this thing going on the ground and I was like, okay, but that's good to know. And let's let's go back and reassess and redesign and if we can't and that's what I discussed with you guys. And then we're going to be properly. Okay. So, Hill and Wilkerson is not on the hook to fix their They are not there. They're there. This would this would require a contract with the C-MAR to be able to do this. And this is far outside of 25% of their original contract. So therefore, it would have to be an entire rebate process for it C-MAR to even be able to do it. Does that make sense? Yeah. Yeah. It doesn't qualify for the change route. It does not. And And given the add on fees that we had with the other bid, you feel so that we can with this RFP do better on the terms and do better on the overall costing. Yes, sir. Gotcha. It is $700,000. Yeah. Yeah. Built into the now. Thank. Thank you. Are any further questions, Council? I want to re ask the other questions. So who is it to design those into this corner? Can we board the original? Uh, okay. Yeah, I pay people designed stuff or aircraft all the time. I don't pay them to paint me into a delivery corner. That's why you pay professionals in fact. That's why we can't even bid it out competitively. We have to do it based on experience and we hired you on your experience. And my opinion, you failed us. You designed us in a corner and that we're paying $58,000 to fix it. I don't think that's right. I really do. We took the design approach as far as we thought in the the most sense technically for the design in terms of a medium voltage pump. Once we got the lead on spec, that's when we kind of have pivoted and said, okay, cool. You know, even though this isn't the best design that we want, you know, we can get around to try to help. I expect my engineers to know that when they're designing systems, I also want to know if this stuff's going to be obsolete in six months. That's the next thing that comes up when you have people who aren't looking ahead in their design. Now, all of a sudden, you need more parts and they're obsolete. I don't think we should have to pay this. And I think you should also consider if we're going to be impacted by obsolescence, because I'm a little concerned that that may not be considered either. Definitely looking to that. Okay. Any further questions? No, I do think that's a fair, a fair thing to bring up, but I thought you, I thought Hill Wilterson maybe did this initial design, but it sounds like Kim Lee Horn did. And I mean, I understand when there's a lead time with supply chain, but I do have some pain when the citizens have to pay or to pay for the redesign based upon a misstep with supply chain that was directed by Emily Horn. So that's my concern with the 58,000. I mean, maybe some of these are things that weren't initially done or were not initially in a contract but we are in a sense paying for rework and since how much of this 58,000 goes to the actual RF, RFQ process. It's designed as well as a certain. So I actually have a breakdowns, right? So yeah, so I actually have a bidding phase in this one for 36. That was not included in it originally. The 22. So the original bid design didn't include the pad, the ceiling block and all that. That was going to be broken out by the CMAR. So we have to put all that back in. The only thing that is essentially a redesign is the electrical But we are asking for a repackaging and breaking out asking for new plans to be drawn that I can get to the change order But see more that has been broken out separately So I can bring that before you guys so full transparency is understand Catholic cross the point. Good for living for 30 years. And you're very good at it. No doubt. No doubt. It's not all that's allowed to be fair. And we can't do the bidding process. I can. We're not capable. I can. But my workload is my bandwidth is stress, sir. I'm not, I'm not, I'm not, I'm not, you know, I'll be honest. We're all supposed to be partners in this project and I don't want us coming up with changelars every time there's an echo, especially when it's clearly not out of heart. That's why we hire engineers to know what lead times are, to know what NTVF needs and things like that. that's why I have an issue with it. This is a brand new system. This is not something we're trying to repair. This 30 years old, I had to repair planes that were 60 years old. Yeah, you wind up with obsolescence and issues. You don't pay someone to design something brand new and then come up with an outcome like this, especially when you can't even do a competitively, you have to do it based on their experience. But we designed the electrical and re-packaging of the bright gas of the water irons with the C-R. And then the well has some additional design criteria that's got to be put in. We've got to have a pad put in. We've got to be sitting block in concrete with back in. For this bit back, if they did not get it then when the CMAR, or killed with some did it, they had broken all that out because I guess they have their own folks. Well, maybe they should also concentrate on our part of the CMAR and accept some of the risk too. And we're going to contract with them for this at all. Okay. How does that have? How do we get impacted when we don't have a contract? I can't speak for Mr. Latcher. So. So right now it kind of seems like there's three approaches. Can we warn Sharpen's pencil on what's being proposed here to we re-bid it with someone else, but in all likelihood you're going to have probably something closer to that or three Brian you look at it internally and try to bid it out that way and see what happens to that price. If it's a costing item, it kind of feels like it goes into those three unless Kimlee warned in their divine generosity. It's just going to do this work for free. And I'm not going to speak to that. I'll do. It's rhetorical, but you're. I'll do what I was asked to do. That's for sure. I think 36,000 for a big package and bidding is kind of not too. I'll do it. You want me to do it? I'll do it. I'll do it. I'd be accomplished. I'll do it. We have a lot of that on here. You're all quite a conflict of interest I think I shouldn't join the Christmas. There should be a fourth option and that would be there'd be some responsibility taken for the stinker that there is in Kimberling Horn adjust the price as a gesture of good will. Remind me with the original service contract for for community Williams for the amount the design service and the 15,000. It seems like very reasonable. I know you may not be in position to make that decision tonight, but it seemed like very reasonable to me that the electrical redesign should be waived, the service should be waived, but the good process, I understand, should be intact because that's a procedure that you had. There wasn't included in the original service, but to redesign, the redesign should be, the electrical portion should be waived in my opinion. Is that something you can speak to? I can definitely get my tea. Okay. And my spirit is in top grade and delay the message. Fairly, I'll let you know. Well, you know, nobody wants to hold up the project for 22k. But I'm talking about 22 grand, you know, roughly a little bit less than 10% of the original bid. It seems like that would be reasonable for King Lee Warren to absorb in this instance. Well, we would probably need you to do that fourth quip, so we can act in a timely fashion to pick this whole together. Here's another option. Maybe we approve that we're the NTE that does not include the electrical and neither accept or other don't. If they accept it, we're going. If they don't accept it, then we have to come back and discuss it. It's an NTE court, anyway. Yes, it's a yes. It's a lot more. When the odds are hold. Perhaps we could. And not to the right. Yeah. No acronyms here. Not to exceed, sorry. So we could do that. We could approve it, but they're not to exceed whatever that is, minus whatever that is. And if Kimmy Hohen accepts that, that then we're good if not we're back in two weeks. I asked a question of the attorney roughly if they table this and then in say they table that's in the 22nd workshop is that work even though that's already posted. Yeah yeah. The council could table this item. So I'm meeting to the 20 second even though 20 second. Oh I thought the 22nd. No, that agenda's already been posted. OK, so it'd be the 8th. OK. OK. And I can work on it. And of course, time is of the essence here. What's our two weeks of delay? It would be more than $22,000 or the delay. But I would sure like to see that waived. Perhaps we've new riches suggesting that to exceed 36,000. We starting to think. You have any thoughts? I do. This is reasonable to me. And I would approve this. When these guys are designing these things, you don't know the demand of the materials and stuff that they're reducing. And so there's no way that you can know and you could kind of parallel that with the whole idea of having a park in the first place. There is oversight when people make decisions. And in my opinion, it wasn't a good time to make decision on a line when we had so many needs. But however, we're moving on here we are. It's just you've got to understand when you decided to do this part, not only do you have this kind of consequence, but there's a lot more to come because you have to take care of the part. Who's going to operate the part? And what I've said numerous times is, what are those costs, right? So when those costs get here, you're gonna be blown away and blown away and blown away because it takes money Take care of this thing and yet have I been able to see what is the maintenance cost on this thing? And if you're like fighting over to $58,000 right now You're really gonna have a hard time stomaching the cost of the ongoing maintenance of this thing. So I would say back up just for a minute, these are legit. I can't believe that anybody would hold an engineer accountable for not knowing the demand and having a crystal ball. You didn't have a crystal ball when you said, hey, I want a park. Well, if you didn't know all of these things, you probably would have considered thought harder about your decision to want a park. So just guys, it's time is of the essence that this is not out of line and this needs to be approved so Mr. Creed and Kimlin, Warner, can move ahead with this thing. This is just the first change order. You know how many are becoming after this? And when you pay people to design something, no, it should be foreseen. When your designing is system, you should know the delivery of the material you're designing. We pay good money. 245,000. This is just the first change order you're going to see. How many times will people get screwed saying hurry up you got to do it you got to do it now And that's so we should do it now. Against the park in the first place. Well, that's your problem.
