Good morning. I'm going to call the meeting of the zoning and administrator of August 15, 2024 to order. It is now 10 a.m. My name is Jesterna Wollcomb and I am the zoning administrator. At this time, I'd like to find out from Vera if there is any public comments or public requests to speak for item that is not on the agenda. Justina, I have not received any requests to speak forms and there are no emails or any audience members. Thank you. Thank you Vera. We have no item under consent calendar and we do have one item under the public hearing. This is a conditional use permit number 2024-0009. And this is a request for an authorization to sell beer and wine for onsite consumption in conjunction with a proposed restaurant or cafe. The address is 15771 Red Hill Avenue and we have a presentation by Aaron Valley. All right, good morning and thank you for the introduction, Jacina. The item before you is conditional use permit 2024-9, which is a request to authorize a type 41 ABC license, which is sales of beer and wine for onsite consumption, for proposed restaurant cafe with an occur working office space located at 15771 Red Hill Avenue. The project site, Shonen Yellow, is located on the eastern corner of Red Hill and Bell Avenue. The existing 12,000 square foot ten in space is located within a 96,000 square foot office building. The site is located within our International Rectifier Specific Plan, which is surrounded by office and industrial to the north, east and and west and is bordered by the Tuscany Legacy specific plan to the south. For some background, Jason Tennant's space known as the Parler obtained a type 41 ABC license which is also for onsite sale of beer and wine in 2022. The proposed business will be located within a co-working space. Customers of the co-working space must reserve the office space in order to make use of the amenities. However, the cafe will be open to both co-working space customers and members of the public. Neighboring tenant spaces have converted office space into food service. However, the proposed business will be the first to integrate both office and food service in one tenant space. Moving forward with the floor plan. And as you can see here, this is how the tenant space will be divided, blue and decoding indoor seating for the cafe, green for the cafe itself, purple for the outdoor dining, and orange for the co-working space. And here you can see how the cafe is integrated into the office space. Moving next to analysis, the proposed business is substantially the same use classification, office-based with accessory food service. We received no concerns regarding calls for service from either PD nor the local ABC office. And approving the conditional use permit would impose standard conditions of approval, such as employee training and hours of operation. In conclusion, staff recommends that zoning administrator adopt zoning administrator action the . . . . . . . . . . . . . . I conclude my presentation. Hello good morning. Good morning can you identify yourself with a record please? Certainly my name is Steve Rawlings I am a consultant to Adam Fogel in his business even house and I also believe that on the call is Adam as well. And I had a few comments and so does Adam. So just wanted to make sure he was on the line as well. For the record, we do concur with the staff's recommendation for approval. And we had a point of clarity that we were hoping we could discuss, and that had somewhat to do with the hours of operation. In the findings on the resolution, it does talk about us being able to sell a serv alcohol until 2 a.m. But then in the conditions of approval, it says that the business has to close by 10. And there seems to be a little bit of confusion on our side, and I wanted to just sort of elaborate on that just a little bit. The co-working space, as you may be somewhat familiar, the people that use co-working space often work late into the night. These are typically entrepreneurs, small businesses. And I think we've all heard of the legendary stories about the Silicon Valley people, you know, being at the office for 24 hours. We're certainly not allowing people to stay at the office for 24 hours, but we do need to recognize the fact that there's a lot of late night people that are working into the late night. And Adam has written a business plan and done extensive, extensive research on what is going to make a successful co-working operation. And part of those operations, including able to allow people to stay later into the evening, but also having amenities available such as food and beverages, so on and so forth. We have no intentions of running any kind of like nightlife operation. It is all intended to be an amenity. The cafe is not being advertised like a denny. Denny's are an eye-hop. We're not looking for anybody to come in. It's really catering to the people that are members of the co-working space. But in addition, some of the surrounding businesses, certainly Adam would be more than happy to sell somebody a sandwich or a coffee and a bagel and so on and so forth. And we certainly't going to allow people on our patio, past like say 10 o'clock in the evening. That's, that's, you know, as I said, we're not interested in that type of business. But we, we would like the ability to be able to continue to sell alcohol until 2 a.m. But operating the cafe, closing the business, I guess I was just kind of confused as to what that meant. And in talking to Aaron, it was like, well, closing the cafe. And I'm like, well, technically, I have to quote, have the cafe open? Food available in order to be able to serve because we're not a bar by any means. And so I'm just looking for maybe a little bit of clarity on that and maybe just a little bit of latitude. We're not advertising this cafe like it's a restaurant. We certainly would not anticipate anybody from the public driving over and say at 11 o'clock at night and say they want to catch a bite to eat. That's not what the arrangement, you know, that's not what this business and bottle is. So that's that's the one talking point. And I just wanted to see if we could get some clarity on that. And with that, Adam, do you have anything else to like to add? My questions, I think you may have answered portion of it. My question has to do with the, how does the cafe operate in conjunction with the co-working space. I guess my question is that would alcohol be available anywhere within the co-working space, but alcohol may not leave the premises? Can you clarify that? That is correct. It certainly cannot leave the premises. It is an amenity that is designed for just on-site consumption only. And yeah, I mean, people will eat, obviously, in the cafe because we've got tables and chairs set up there, too. But sometimes people we have a little bit more of a lounge, kind of area in other parts of there and some people may have meetings or so on and so forth over in those other areas. So yeah, the idea is within the building only. Thank you. Questions for Aaron? The hours of operation If we were to modify from 6 a.m. to 2 a.m. The police department Review the hours of operation up to 2 a.m Correct. Yes initially Adam had sent in his hours of operation from 6 a.m. to 2 a.m. And they had no concerns. Okay. At this point, I have no other questions. The staff would have the ability to check in at six months from the commencement of the business to ensure that no nuisance will be created from the operation. And with that, I will adopt zoning administrator action number 24-010, approving the conditional use permit 24-009, authorizing the type 41 ABC license in conjunction with the proposed restaurants located at 15771 Red Hill Avenue.
