If anyone that wishes to address the council on anything non-agenda item, they are welcome to do so. I only have one person that has signed up, but if you didn't sign up, no worries. You can come up and do the same thing in general three minutes. The first item, the first person I have is Adam Wagner. Adam would like to share what's on his mind, just give us your name and address for the record and we'd appreciate that. Adam Wagner, 202 Shines Street. Dear council members, I would like to express my deep concerns regarding the imagined belt and proposal specifically the construction department complex as businesses restaurants, et cetera and residential neighborhoods while I recognize the need for growth. I strongly believe this type of development in primarily residential areas has serious consequences that are detrimental to our communities while being a residential neighborhoods are vital to the fabric of our city. They offer it family-friendly environment that many of us moved here to enjoy this imagined belt and proposal Disrupts this balance leading to increased traffic, congestion, crime and strain on local infrastructure, including green spaces and public amenities. These developments threaten them fundamentally change the character of our communities, making them less livable and more crowded. Additionally, I'm troubled by the city's current approach to planning and zoning. The recent development suggests the pattern where zoning decisions are without sufficient input from the public were clear justification for why certain areas are being targeted. Specifically, I have concerns about the transition zone that appears to be allowing the city to bypass traditional zoning rules. It seems that the zone is being used as a loophole to rezone areas at the discretion of city planners regardless of the wishes of the residents. This has led to the perception that the city is abusing its power to Zongland overseas fit without regard to the long-term consequences of the needs of the people who live in these neighborhoods. Seems that rather than following a rigorous planning process that accounts for the impact on the surrounding communities, the city is opted for, let's pass and see what happens mentality. Disapproach lacks the foresight and due diligence necessary to ensure that the development benefits the entire city The absence of community input and meaningful consultation is deeply concerning. I respectfully ask the city council to reconsider the imagined Development proposal, but I'll get to that specifically the transition zone This zone is not a tool for unchecked development that disregards concerns for existing residents I urge you to develop more thoughtful transparent planning process that considers both the immediate need for housing and the long-term impact on the livability and character of our communities. Furthermore, I'd appreciate if the City Council would provide greater transparency as to how that preserves at Nolan Creek apartments were built between homes on my residential street. Residents deserve a clear explanation as to how this happened and why areas are being re-zoned and re reasoning behind using the transitions on to facilitate these changes. I refuse to allow our tax dollars to be used to accommodate your vision of what our neighborhood should look like. I hope your vision doesn't have the same negative impact on your life as it has ours. I invested hundreds of thousands of dollars and hundreds, if not thousands of our time, and harder than money to live in a residential area. Not a transition zone, next to 80 plus unit apartment and complexes. Thank you for your time. I apologize. No worries. Good, appreciate it. Yeah. We appreciate that kind of input. We're continuing to evaluate, we roll out the Imagine Belton. I won't say anything regarding it, but definitely we will continue to keep that input coming. I would encourage anyone just on this particular item. We have town halls. We have town halls. I think we continue to will continue to have. Do we have a few more planned as we look at other zones? So anyway, so if you're interested in those town halls, I just get with staff and we can do that. So for information. Anyone else wish to address the council on any non-agenda item? The first item after public comments is to receive a child safety fees in the amount of $25,869.73 from Bell County. So, it's like we got two for the price alone. Getting two checks today. All right. Yeah. Do we bother that to be on the agenda? No. OK. No, we won't take any money. Public comments too. You can just throw those in there. Well, Mayor Counsel, thank you for having me. I am Shay Lutike. I am your tax assessor collector for Bell County. And I'm here to give you the child safety check. Last fiscal year, our registrations worked down about 3,000 vehicles, so we didn't collect near as much as we did the previous year. But we'd still collected $462,124.50 countywide for registering 3883 vehicles. State law says we must allocate those funds to all the municipalities. And that's why I'm here today. This is the best time of year for the tax assessor collector. Instead of collecting money, I get to give some of it back. Since the program started in 2001, I got to mention this. Belc County has and distributed $9,184,748.98 cents in these $1.50 fees. Of that total, we allocated $198,819.16 just to the city of Belton. So, you all got got a $1 million in those 24 years. I'm going to read this second paragraph here that states how these funds can be spent. And then I'll hand you the check or turn it over to Commissioner Schneider to handle the next check. As outlined in the Transportation Code, chapter 402.502.403, the County Tax Cessar Collector has the authority with the approval from the commissioners court to levied the $1.50 per vehicle registration, excluding those exempted by code. These funds are earmarked for existing crossing guard programs. In cases where school districts lack crossing guard programs, the money may be allocated to initiatives promoting child safety, health or nutrition. This includes for child abuse prevention, intervention, as well as drug and alcohol abuse prevention. Alternatively, the funds can be directed towards programs enhancing public safety and security, as per article 102.014G of the Code of Criminal Procedure. The check for this year's allocation, as mentioned, for Beltan is $25,869.73, and this notification was also sent to the Beltan ISD superintendent. With that, that concludes my presentation. I would like to make a comment about the child safety. It's not something that Bill County should be patting theirself on the back. It's the citizens that live in Bell County, that drive in Bell County, that contribute that $1.50, other harm to many to protect these kids and the programs that we need and we have adopted across the city. So thank you for the citizens of Bell County and particularly today, the other check we've got today, as you will know, we have a hotel motel tax that we get every year and this year's portion for the city of Belton is 21,245.58 cents. So we're here also to the deliver that one and thank you for all the people who choose to stay and play here in Belk County and spend spend their time here enjoying skating rains. That's absolutely. And council meetings we felt that we would appoint a subcommittee to work with staff to review those and bring key items to the staff. I mean, from the staff and the council back to the council. I've asked John Holmes, council member Dave Covington, and the one that's absent any, Obanion, if she'd show up, she could get out of it, but she didn't show up on time. So anyway, so I'm suggesting the appointment of those three individuals to serve on that committee. I guess one is any comments or questions or the chair would entertain a motion. Item six is consider item related to wastewater infrastructure improvement for future phases of river place. I'll go ahead and No, I'll just I'll take these one of time. We'll to six a hold a public here and consider an ordinance amending the project plan and financing plan for the city of Belton Tax Agreement Reinvestment Zone number one for the extension of wastewater services to the future phases of river place on the west side of 317 in north of 439. Mayor butyl also call item B. Okay, I'll go and call. And he is considered authorizing the city manager to execute a chapter 380 economic development agreement with a insulate corporation regarding the extension of wastewater services to future phases of River Place on the west side of Texas 317 in north of FM 439. Thank you, Mayor. I appreciate the chance to present this item tonight. It's item that we've been working on for some time. Tonight will add to the conduct of public hearing to amend the Project and Financing Plan of the TURRS to address future utility and can lead to execute a 380 development agreement with the ANSLE Corporation to the obligations of both the city and the developer in this particular case. I just wanted to point out the location of what we're talking about here. The property that's shown here is the location of sections 1011 and 12 that are under consideration for immediate development. As you recall, the TURS plan was amended just a couple of years ago in November of 22. The rezoning of that property occurred in last year, the summer of 23, to establish the SF1 zoning for all that property. And then tonight we'll deal with the amendment to the TURRS and the agreement as well to that and this is the area showing the expansion of the towers that occurred just a couple years ago. This is the area of consideration obviously you're all familiar with with Main Street and the river the focus of our consideration is this area right here. What is proposed is an extension of a sewer line under 317 to provide sewer service, sewer infrastructure as a public project to extend sewer to the next phases of river place. Had a lot of discussion with the barge family and their representatives on this issue, but there is great opportunity for extension of the services into this area. The plan would be to connect with the Mr. Grieber, Tuscan River development and extend that line across 317 and then the developer will extend it from that point westward up to the area of, replace 10 through 12 here. The area you can see, y'all may remember this view, this is just a concept plan of what was done. The 214 lots that are planned in that area for service, there has not been a plant submitted just yet. That's the next phase after the development agreement. But we look forward to working with the developer on that as they lay out the 214 lots and address this area. Remember, this is on SF1, which is the larger lots, the 10,000 square foot lots. So again, a great nerdy for continuing the River Place development with the extension of sewer services, as opposed to not having sewer and forced to rely on septic tank service. The costs are identified based on working with a Turley engineers who've done all the engineering for this project. The two areas highlighted in yellow are the city's obligations acquisition of the easement that we've had some discussions about. Also our cost for the extension of the wastewater across Main Street to the barge property, a total of approximately $595,000. We approach the tours and ask them to commit $650 to just make sure we do not have to go back to the church border to the council Not knowing what the bids might be but we hope the funding that the cost would be something less than that But our recommendation to you is for the 650 the other two items a Future lift station will be needed at some point in the future that could be as far as five to seven years out As this property and then the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the development of the This is the area of the 15 foot easement that we need across the lot at the western edge of River Tuscan River, they're adjacent on River's edge. And so that would extend along the property and then cross under 317. The costs are outlined here and the obligations on the left hand side you can see the developer's obligation feels for the offsite sewer, master plan for all the property, preliminary and final plans of the property designing all the sewer improvements, bidding the improvements, which we would have review of that, and then the developer would award that to the lowest bidder. Our compensation would come at that point after the bids have been reviewed. Internally, of course, the developer would have all the obligation, $860,000 estimate to provide utilities to that area. Our obligation, again, summarizing, we would secure that easement, coordinate all the work with textile to get the line across the 317 site, for the lift station and then of course our major cost here the 595 the combination of the easement and the extassure to side of 317 So our recommendation for you today is to acknowledge fiscal impact of the 650 the church recommendation They made on December 5th. You'd anonymously recommended approval of these two items. We would ask you to conduct public hearing and then recommend the amendment to the project and financing plan to provide for this as a project listing in those two documents. And then finally to as execution of an economic development agreement with the Ainsley Corporation. I've got to answer any questions. All right, any questions before we open the public hearing? All right, there being no initial questions, we will close the deliberations and open the floor for public comments on this project. If anyone has any questions or comments, well, mainly comments, please address the microphone there. Give us a name and address. All right, there being no comments. If not, I guess we will need an emotion for 6A and then another motion for 6B. Very sensible expansion of the three cars to allow to assist with sewer expansion on term great benefit for the city. And I think Matt may have mentioned that there might be the opportunity that that could go under the bridge and not have to bore for maybe some possible savings there. Kind of shared a little. Right now we have this scheduled as a bore underneath. Maybe that's maybe what we'll be asked to do from text on. Obviously, if we are able to open cut underneath the road, that would have some savings on that. But we're prepared for the bore. Certainly we'll make every effort to try and open cut. So, Matt, the board is worst case, most expensive. Yes sir. Okay. That seemed obvious. Okay. Chair would you entertain a motion? I would move. We approve item 6A. We have motion, second to approve item 6A which is amending the tours to help fund this as presented. I will make a comment that it's been, I know it takes a while to negotiate with entities like the City of Belters but I think the staff working with the developers gone very well. It's a, we again, I think it's a really good use of public funds to get the services underneath the highway and then let the developer do what they wish. Also with the Terrors, this is what it's intended to do is to take investments that other people have made in the taxes that it had basically assessed on the improvements of the area to improve another area, which is just a snowball and allows for more taxes to go into this increment re-investment zone and continue to improve the infrastructure of the city belt for growth and I would say tax efficient for the homeowner. So again, I think it's a very, very good use of funds. So any other comments before we vote? All in favor, say aye. Aye. Those opposed? All right, passes unanimously. Item seven, Lucky Seven, consider authorizing the city manager to execute a boundary adjustment agreement between the city of Belton, the village of Saledo, and CE accounts or sales, depending on which side. From international LLC regarding common boundaries of Ben Saledo, City of Lent property located northwest to the intersection of Interstate 35, BIM 24, 84. Thank you, Mr. President. Thank you,. The council. Again, this is an important item to bring to you tonight. Something that's been under discussion for quite some time, but I think we have a good solution to present to you tonight. A boundary adjustment agreement is something that's authorized by this slager. This occurs, obviously, as cities but each other, and their issues involving development or perceived issues involving development that emerge. In this case the parties are the two cities built in in Salato and private developer Celts, LLC. The location, as I'll show you in just one second here, is right at where the asterisk is the location of the potential conflict I guess you might say where are the two cities but this is you can see I just wanted you to visualize the the city of Belton city limits coming down the interstate and then the area in blue the village of Salato and of course we've a butt right there at the asterisk. These other areas are ETJ areas. And so what has occurred is obviously discussion over quite a time about how development might occur at that edge. We began discussions four years ago, if you can believe that, in terms of zoning and plight review between the city and Salato, mostly between us and the although Salato was involved to a degree. The applicant at the time expressed a preference to be in the village of Salato nation. Obviously you have two jurisdictions of budding each other, not an uncommon situation. You can imagine cities that have grown into each other. This isn't really that usual, but it was a perceived conflict issue. And in addition, it was at the edge of our existing services. Salado water supply corporation was the developer had built a private sewer package plant to serve the area. And so the perceived benefit of Belton and that particular location was limited. And so there was a lot of discussion, but really no consensus. We had really struggled to reach consensus. The applicant sought de-annexation from the city. And from Arstham Pond, in terms of the plat review, plat review occurred. We gave comments. And yet was really no response to those utilities, drainage improvements were then built by the applicant without plan approval or any public entity inspection. And I've provided for you a chronology that goes into some detail about that history. And I think you all are fairly aware of that basically. After really almost four years, the slate of all of our alderman finally determined in September of this year to accept the built public improvements with an extended warranty was a concern to everybody about something that was built without inspections. With that approval or that concept of improvement acceptance, we all shifted our efforts to try to find an equitable distribution of property to Belton into Salito as part of a boundary adjustment agreement. And I'll share with you a couple of maps here. This is a little bit confusing, but please bear with me for just a second and I'll kind of show you. Make sure you all have a good understanding of what's going on. Again, city of Belton, area in red, coming down the interstate, Aedo coming up this area in blue. And you can even see the subdivision crossing over into the city limits of Belton here right at that intersection of Soleto, Sinodrive. A built street, that inspections or approval or any of that nature, basically. And then of course the Soleto and Belton E2Js out in this area. The area is to... a built street that inspections are approval or any of that nature basically. And of course the the Salado and Belton ETJ is out in this area. The areas to note are a small portion of Salado city limits this area right here. A small portion of area that's in our ETJ and then the crossover, the area in red, that occurs right here where the subdivision is built. And so those are the areas of coordination and compromise basically that we have worked on. And so the resulting condition, the proposed city limits are what you see here. City limit of Beltan extending down to the Salito-Centered Drive Street. Belton extending from that point northward, and then Salito extending up to three. So we have a good solid street location as a boundary for the city limits basically. And so that's the resulting condition. The elements that make that work are this area in green that is proposed to be, that is city limits of salito that would come to us. This portion of Belton City limits that would go to salito, and this area in blue that is privately owned, ETJ property, Belton ETJ, that is being voluntarily annexed by the SELF family. And so that's the proposed layout of the situation, something that ends up being two, well over two acres total to each entity. So all the entities receive the same amount of property. We end up, it's an elite basically, which is something that we've worked on 2.08, five acres go to Soleto and 2.08, five acres go to Belton. And so we end up with a resolution that satisfies us all. We had some concerns about the previous development occurring in the city without zoning or plating or construction approval. We requested a number of things, all of which have been satisfied. There was draw of the zoning case and platt at acknowledgement that none of those improvements built in the city limits had been approved and indemnity for us for any of those improvements and exchange of land that is equitable and logical and then the voluntary annexation by sales. All those things have been done. The boundary adjustment agreement that you have before you meets all those objectives. The Greens factory to all the parties. The Board of Alderman approved this item last night at their council meeting. And the City Manager has signed that. And we're here today for your consideration as well. Long time to get here, but I think it's a satisfactory solution. We've had similar with Harker Heights and Nolabill entities that work together can ultimately work out these kind of situations that present conflicts or even apparent conflict. So with that, and with Slydo's favorable action, we mean your approval to boundary adjustment agreement. The action today by the council approval of that agreement will achieve the swap with Salito. Those two elements will be satisfied. The annexation process for the privately owned property will take place now. And so the sales action will be coming forward to y'all as we can establish a schedule for that. So any questions that I can answer for you, I know that's a lot of background but you've had bits and pieces of it all over time as this action or inaction has transpired. Any comments or questions? If I could just add one thing and this is the only you don't read about because it worked out good and cooperated between the cities. I wish Russell was still here but the county was also involved and helped facilitate some of the fact finding the things that went on and also obviously part of it's in our ETJ which means it's in county. But anyway they were very helpful but City of Salado, City of Belton, Bel County, they really did the right thing. This deal was in the through no fault of any of those entities. And nobody had to agree to this. But it just speaks well of our City of Salado and the County to help get this out of the ditch and end up being a good deal. I think for everybody, but it ended up working out a whole lot better than it could have. I mean, I'd say that. Better than bulldozing or tearing up a street that somebody just built. Exactly and all of that could have happened. It's a lot of work that you'll put in on this and I appreciate that. It just points out to me the importance of cities being able to maintain the ability to develop or to can develop a guide development in our ETJs and that we have to be so vigilant that the legislature and their infinite wisdom does not restrict us any more than they already have.
