It is my honor, as we did on March 8th when our tournament took place to present the city of South Miami with both the tournament trophy and our community champion trophy as well. We create a separate bracket for the municipalities. And so the city of South Miami for the third time in four years. And for the second time in the last three, one, both of these trophies defeating the city of Miami firefighters, the village of Palmeiro Bay and the village of Pinecrest Police Department. So congratulations to you all. We can't thank you enough for your support over these years. This year's tournament was our 12th. It takes place at Palmetto Bay Park and this year we raised over $82,000. Thanks to municipalities like yours and the support of those teams, businesses, families, and other sponsors, which we are incredibly proud of. And we can't thank you enough. This trophy stays here at City Hall for you all. Jerry, before you go out. Jerry, what did you raise money for so the public goes somewhere? Yes. So, I'm from the Curecystic Fibrosis Miami Foundation. So we are a local family foundation that raises money and awareness in support of Cystic Fibrosis and the Cystic Fibrosis Foundation. My goddaughter Delaney has Cystic Fibrosis. She's 14 and a half years old. It is a genetic disease that affects the lungs in digestive system and really any organ in your body. Unfortunately, she has a genetic defect as do about 40,000 other Americans that produces a thick sticky mucus in her body that coats all of her organs, primarily the lungs, causes digestive issues as well. And so it makes it difficult to breathe over time. And people with CFR are more susceptible to infections. And that does long-term damage to the lungs. Fortunately, there have been some miraculous advancements in this last decade and a half since she was born. And there are medications now that can treat the symptoms and the genetic cause and the defect for about 90% of people with CF. It is not a cure. There is still permanent damage, it's still long-term and it is a debilitating disease. Delaney is, her pancreas doesn't function so she is insulin-dependent. It's a special kind of diabetes called cystic fibrosis-related diabetes, not type one type, too. It's completely different. She also has difficulty with adjusting food and she has a feeding tube as well. So it's incredibly challenging for her, but she perseveres and so do so many others with CF. And so we are incredibly honored and proud to be representing her and all of the other people with CF and to continue fighting for this cause until we find a cure. And we will continue to do that as a matter of fact. Tomorrow morning, I'm heading to the National Volunteer Leadership Conference in San Antonio, and I'm running from here to a meeting that my partner in crime who is Delaney's grandmother, Bonnie, who's the co-founder of our foundation, is currently monitoring for an event that we're gonna be having here in the city of South Miami at the South Miami Elk Club. It's actually a problem. So it is an opportunity to revisit that nostalgia, sans chaperones, and for you to experience it actually with your significant other of today because I would venture to say I could probably on a hand, on one hand, guess the amount of people that would attend this event with the same person that they may have attended, they are original problem. So it's and the the South Miami Alcs Club is doing a fabulous job, giving us a hand with that. So we are appreciative and honored to be hosting it in your wonderful city. I thought this was a zoning and planning board meeting about the lot on the corner of Manor Lane and Aides Street. But since you guys are here, it's on the agenda. Oh, fantastic. If you'd like to speak when the item is called up, we will keep reckonings at the time as well. Are they gonna give their presentation before public comment? We know, no, they are not. I am tired of y'all cost me money at this point. I am tired of the amount of time that is gone by and my community has yet to receive an apology for something that clearly has to be a directive that has to be coming from the leadership with South Miami PD. So I'm going to break down my issues that I have not only with this department but with this government at this point because you guys are failing us. I need to make this very clear, Mr. City Manager, something has to get done and it has to get done. Now, one thing I do not play about is my seed. That's 16 hours and 43 minutes that I put in on that. Yes, a college educated young lady. I'm a product of this community and what I will not have is having police now targeting her based on a sign that we ask the previous mayor, I think it was mayor's starter at the time, to stop Larkin Hospital employees and students from taking up all of the parking that was in the Marshall Williamson's area. And so to get waking up for the last three weeks and a row on stupidity, that's a direct result of violations that this police department that I already came to you guys and spoke to you about that is still continuing to happen. So explain to me how my daughter can rent a car from enterprise that is a reputable company. And now all of a sudden, allegedly, the tag is coming back, not there. When there was no reason for her to be what was her offense, being home. Then the story changed. And this is why I recorded. I definitely recorded. And it's out. Got thousands of views at this point. We should be tired of our city being targeted. We should be tired of college educated, people who are actually doing what we raise them to do, which is to be a productive citizen in this community, to get an education, to give back all of the things that she is actually doing. But instead, what was she harassed by the police? And you know what? That encounter, as soon as I came out the door, if they were in such the right, they would say they would have tried to continue on. If somebody has an unregistered add allegedly, like come on, like I'm tired of the games. I am tired of the games. One of my mom's friends lost her son. You think that's the ideal time to now come and disrupt a funeral. A funeral. It's getting ridiculous and I've had enough. I need you guys to be interested and I need action. I want the after-action report for what happened after the Black History Program. And I also want to know I have yet to see the community officer. A lot of things can be resolved. Listen, in the North, they have those type of problems and relationships with the police. We've never had an antagonistic type of relationship with our police, which tells me there's a directive. They have to be carrying out someone else's orders and that typically comes from the head. And here's the thing, the assistant chief came out and met with the community. I don't want to hear the excuses of oh we didn't realize it was private property. I want that apology for Miss Tula. I want that apology for my mother. I want the apology because it's clear and you all know that over 20 plus years we've been a private community and none of you have yet to apologize to what happened to the seniors in my community. None of you have apologized to even me for what I've witnessed. None of you have apologized for what took place with my daughter this past Saturday. It's ridiculous. There's no reason for police to be harassing people who are not breaking the law, people who are doing nothing other than just arriving home. Broke no laws, none. I'm sick of it. And I'm asking this commission, I'm asking you mr. Mayor before this things has to escalate You know even further because I promise you if we want to turn this into Mississippi burning and we want to be the latest city on the on the news I can do it. I think you don't know who my pastor is and I think you guys don't realize like what's waiting We gotta do something about your time is up I we fully hear you I'm gonna use my mom we fully hear you she here is you here to give it to you okay okay okay that's fine so if I if I could if I could address your comments so as to the after-action report for what happened at Lee Connom idioms, for the benefit of the public as well, the chief has retained outside investigators who have conducted interviews in the community about the event. They're compiling a report. Those interviews, I think, just concluded this past week. I've been sharing the information as I get updates with Mr. Ford at the end of ACP so he's aware. We will be providing a copy that reports to the public. If an apology is owed we are going to provide it. Okay we're just going through what are the steps to understand what transpired. So we get a full perspective from everyone in the community about what may have happened that was improper, proper, but we'll have an accounting of the facts that we will happily share with you and everyone else. I believe the chief has gone out and met with Lee kind of any board. I was not advised on the meeting, or I would have been there personally, happy to go. When the report is completed and persists at the findings of the report to the community and have a conversation about it, okay? So. What do you mean if? if what, man? What do you mean if an apology? See, that's my issue. Man, man, I have my own opinion about what happened, which I will share at the appropriate time. I'm allowing the police chief and the department to do their work. Right? I don't, you know, we're here. We're here to do, we're here to discharge an obligation, which is first and foremost to keep the public safe. Right? We only have an opinion about what happened at the incident, but we have to allow there to be a compilation of the facts. That's what's happening right now. It's not an issue that's being ignored or brushed into the rug. I don't want to give anyone that opinion. Okay, the chief has undercaken to expend resources to have an outside group of people. Okay, do an investigation understand where we may have failed, okay, in our management of that particular event, and where that encounter may have gone in the wrong direction, okay. Full acknowledges the possibility that something wrong was done, okay, but I'm not here to judge it until I'm giving it a county of the facts. Okay, but I'm telling you I witnessed something. I'm not saying that your perception is anyway wrong. I've seen all the videos you've posted. I've seen that other videos have been posted by people of community. I've observed them. I have my personal opinion, but I'm waiting to get a full perspective based on that investigation. So there isn't accounting that's, there isn't accounting the fact it's underway. Again, if you have a question about it, I'm not hiding from anyone. My cell phone is on the city's website. You can contact me anytime to ask me about the status of it. And when the report becomes available, we made widely, it'll be made, we made widely available to the public so everyone can digest it, criticize it, confirm it, and we will take as a body the appropriate act of the time. And it may include an apology. Yes, ma'am. Yeah, I definitely want one for myself, my mother, Miss Tula and all those residents that were there, that were told to go into their homes unjustly. No one has a right to do that. We understand. My other issue. See here's something that is very clear to me is when they're smoked There's usually spires somewhere around the premises. I'm trying to understand what is the purpose, specifically, and I want answers to this question. What is the purpose of us trying to now change the zoning across the city, citywide, as you brought up, Mr. Rodriguez, that hasn't passed yet, but you guys seem to be gung-o on this. I'm trying to understand what is wrong with our current zoning and the legislation and everything that we have, you know, taking place as is why do we want to do a city-wide thing if there's no intent to get rid of those, you know, houses that are on 64th Street. Because something, in my instincts, is telling me, if you're going through all of this, there has to be a purpose and no one has told me one good reason as to why you're attempting to do that, and the last thing is I want to understand why are we even considering trying to turn the Marshall-Lumson's area into a concrete jungle? That was not the purpose of what that land was given for, and I want to understand why you all are specifically targeting this specific area. I want answers and I want them so. Ma'am, as you know, because I think you were here when we announced that we're having a community meeting for those who do not know. It's this Thursday evening, April 3rd at the Bethel Gibson Center at 6 p.m. We have, as we said, we would, we put out a community survey, which is being compiled right now, to understand what the community wants us to do with, I believe, referring to the mango lots. Just a- Okay, correct. So, as we've shared before, I believe you were here, the CRA, which is now extinct, had a plan to develop a portion of those lots for affordable housing. We all recognize that the situation can may have changed. We were advancing a plan to preserve a portion of that lot as a park where we've decided to honor the first African-American mayor in the history of the city, which was Dr. Anna Price. That has been approved, so a portion of the park will, a portion of that will remain a park. The question is what happens with the rest? We've put to the community. And I think I speak for all of us when I say we will be guided by the community's feedback. So if you'd like to participate this Thursday at six o'clock at the Bethel Gibson Center, please come out and you can share your opinion as to what you'd like to see happen with that piece of property in the community. The prior desire of the community, as we understand it memorialized in the CRA plan, was to redevelop a portion of that lot for affordable housing. Okay, that is what's under question. Do we preserve it as a public space as a passive park or do we develop a portion of it consistent with the CRA plan and that's what we're hoping to hear from the community in terms of what their preferences are so we can move forward, concurrent with the wishes of the community. As a right now, I think from an individual standpoint of elected Lord of Temperature, as we discuss some important issues that we have to deal with. I think that in the first part of the discussion, there were some things that happened that shouldn't have happened. But those things have been discussed, they've been investigated, they've been community input in terms of talking to the investigators. I would for a fact that there's going to be a finished product that's coming aboard. I personally had conversations with the chief and the assistant chief. They're committed to doing what's right. And I just want to make sure that everybody in this community know that this is not going to be overlooked and is going to be done decent and in order. I think there's too much estate for this city, a good city. And I think that we as a community and as an elected government have in the past had a good working relationship. And I think that relationship is still there. I think there's a real need to and peel back a little bit of the anger and the anxiety that happened before and just discuss it in a civil manner. I think that yeah, there are some things that made me angry. I'm not going to burn down City Hall. I'm not going to get to the point where I'm going to be pointing fingers at individuals because it's a collective effort by all of us that need to happen. I think the fact that we as a community have an obligation also to make sure collectively that I've voted or heard clearly and that in totality not by a few. And based on that, I think that we need to keep that in mind and move forward with what we need to do as a community. I know this manager has committed, I've talked to him, to make sure that everything is going to be upright, up straight to the point, no hidden agenda. And the fact that the chief has made a commitment also, that his officers are gonna be looked at pretty clear-eyed and where there's improvement need to be made, he's gonna make those improvements. So that's on the first issue. The second issue is it relates to the affordable housing complex area. I served on a board with Anna Price. Her commitment was to have additional affordable housing. And the part of that plan was that area facing JRE Lee. She wanted that to happen. And it would be very appropriate at this time to make that happen, but part of that meant recognizes a passive park for her as she overlooked that development for us, so to speak. I think that's something that should happen. It shouldn't be a debate on that. I think those who have served the community in some capacity understand that we are somewhat losing the ability to tell our story as a black community. Because of the fact we don't have the necessary housing, I've talked to people every day that's down south. I wanna come back to South Miami. My family, my uproots, everything is here. I'm down there with strangers. I don't feel comfortable. So I think that we need to keep eye on the prize. Make sure that we understand what we're asking and why we're asking. The reason I'm here is that I want to make sure that everyone who lives in the Marshall Williamson community, and even the rest of the city, who may be very interested in this situation with the new project that they be given a very good opportunity and a thorough enough opportunity. Fisher just to clarify for the benefit of us and everyone else which project are you referring to? I'm referring to a project that's being proposed on facing Southwest 64th Street, a One acre project adjacent to the Marshall Williams in Lod. I'm sorry, I'm sorry, the mango law. The mango law. In my mind, I think of it as the Marshall Williams in sight. Thank you, okay. I know the history. Appreciate it, thank you. Okay. Okay, so that's the project and I was invited when I came here to the beautiful event for Martin Luther King Day, a young lady at the end. A young lady invited me to come and attend a meeting called a CAC. She didn't tell me what the name of it was. She said, come attend our meeting. You should go in the senior center on the third Wednesday of every month. So I went to the last meeting. I was very happy that I did. I learned a lot. I learned that it's the CAC and Dr. Joyce Price was the moderator of the meeting and I connected with a lot of people. I hadn't seen for a long time. It was great. And I want to make sure that everyone gets proper notice and there's like a char at. I know there's a meeting this Thursday, but when this project actually becomes comes before the commission and everyone is hearing about all the legalities of it, is there going to be a land use change? Are they going to get variances? Are they applying for variances? When they get into all those legal details, I want the citizens to have a great opportunity to express any concerns that they may have. And I think we need something like a workshop with the commission, or you could call it a charade, a workshop, whatever, but something more than this that is only three minutes. Because I spoke to a citizen over there, very close to the very, very close right in that immediate neighborhood. And she talked my ear off for at least an hour. And I had, and she's a brilliant woman. I had to listen to everything she said. I said, I've got to get to the commission meeting. I've got to speak at public remarks because you have too much to say in three minutes. So I just wanted you to know that. So and also it wouldn't hurt. You could call it a town hall. March 23rd at 11 p.m., I was in my 7th and 3rd of the parks kind of meetings. So there's a dead end circle. And I had a car at the time. And I had parked in my car. And I was probably, you know, sometimes you just sit in the car for like a few minutes after you like, so that was me. I was there for like 10 minutes and I'm sitting in the car, the car is still running and then I see a bunch of flashing lights in front of me and then up on the side of me. Somebody not gonna door. So I was confused. I'm like, okay, what are you know? I wrote down the window and and they said, it's just your car, it's registered to, like where's the registration? And I'm like, what do you mean? I was like, this is a rental. He's like, oh well, you're parked illegally. Or like, he first he said that the car wasn't registered. Then he said I was parked illegally. And so I felt harassed. I had three cops surrounding me. I have the pictures and everything surrounding me in video of them surrounding me. I gave them the registration. And then he pursued on saying, oh, where's the rental agreement? Because it's not registered. Well, first of all, it's Indiana. So we're in Florida. So obviously, it wasn't registered in the state. And then he just kept switching up the story about why he was there. When I said, OK, he first he said it was about the sign. And I'm like, there are so many cars that were parked on the side of me. So what about that car? What about that car? Everyone that lives in Lee Park, Conminyons, in that dead encircle that's extra parking. It's been like that for years. That little red sign that's been there, you don't even know if I've been there for two hours and I how my illegally. We are everyone that lives in Lee Park condominiums and that dead in circle, that's extra parking. And it's been like that for years. So the original call was a robbery call. the officers in the area looking for a robbery suspect. From my understanding at this point, the officers encountered a a vehicle assuming that it's her vehicle that she was renting. It was parked under a restricted parking sign. The officers ran the tag on the vehicle. The vehicle did not come back on file. Officers investigated the driver of the vehicle who was parked in a restricted parking spot in the cul-de-sac. They identified themselves. She identified herself. She provided the rental information to the vehicle. Officers let her go. The encounter was cordial. Sorry, before you go, just to ask this question. So, from her perspective, I can understand that having three officers respond to that call to what seems to be a parking enforcement matter would be a typical correct If it were just if it were just about the parking enforcement issue. Yes, sir. Okay, but If it's a if it's a call related to a robbery is a typical for three officers to arrive in support of an officer Trying to identify the vehicle. It wasn't necessarily identifying a vehicle. They're actually looking for a known person But they found the area the vehicle matched the the vehicle match the description of the vehicle that was used in robbery? There was no vehicle mentioned in the robbery. The officers were there looking for an individual on foot in the area and countered the vehicle that was running. Ran the tag on that vehicle, unbeknownst to them. She was occupying said vehicle in a restricted parking spot, so investigated that and moved on from there so. Okay I think I think it warrants us having a conversation offline so we can kind of explain what the standard operating procedure is because I can share the body-worn camera with them so they can see it from their perspective from the officer's perspective as well. Okay. Ms. Smith, you recognize again. I would like to say to please get the story straight because you're saying it's a robbery that you said restricted. The thing says two hours, I only been there for two minutes. So how is it restricted? How is it restricted? And there were three other cars that were parked right there. And then my neighbors they parked right on the, so how's it restricted? I've seen the parking enforcement's come to that dead in circle millions of times. And not one has everybody got to take it. You don't even know how long I was sitting there. Yeah, I think what I think, again, I'm just trying to distill the information that I'm hearing from everyone. Cause I saw the video posted online. It seems that what tripped the interaction with you was the fact that they observed the car that was legally parked and they ran the tag and the tag did not did not register on their system And that's what let me park where they they weren't even there for two hours I even know the time was running illegal. How's he legal? So if it's illegal then why is it? Still available for people to park there? The sign literally says two hours. I wasn't even there for even an hour. Not even 15 minutes. Understood. I want to discuss what I've seen as a resident of South Miami. While we appreciate development and growth, we also understand re-gentrification. What happened to a Sh Smith is deplorable. Is she not happened to anyone, let alone a young black woman, where three or four officers show up to detain a citizen of South Miami? Is inexcusable, in fact, as a member of Delta Sigma Theta sorority, over 400,000 members strong, as a member of the NAACP, with contacts and understanding of while we want growth, while we want development, we can't push out the old to allow for the new. Our citizens do not deserve that. There are families that have lived in this area for over 50 plus years. My grandparents moved here in 1973 in Lee Park, Condominium. I have recently moved back to this area and so that you have for the record Tiffany Irving, 6111 Southwest, 69th Street, South Miami, Florida, 33143. I've recently moved back to the area and was very disheartened and amazed to see the quote unquote growth of this community. The University of Miami students parading around with no clothes on. Regentification. The citizens being harassed in this area because of regentification, we do not deserve this. We can all coexist, but not at the point of pushing out the old to develop and embrace the new. We should not have stood up for it. I remember at GRLE Community Center, we used to link up bikes and skates and skate through what we called the creek. Now I see advocates, new citizens, playing tennis, overdeveloped by what was a senior citizen community. Individuals sitting in a park and being told they have to leave because they don't belong there. Who says? We do not deserve this. We do not care for this quite frankly. And when one mine, because the shanty is my sister's Goddaughter, is harassed by law enforcement. My dad is blue, but he'll always say he's black. There's no blue or black. When one of mine Mine is her rest, quite frankly, I am now taking off time from my job because I work 11 to 8 by the way. To speak about the injustice, I saw the bought party, I saw the uni, I saw what it was supposed to be. I saw that we got a little bit excited and crashed in the streets and we came and spilled over, and that made a little bit of people feel uncomfortable. Because we were doing what we always did and always do. I saw it. But quite frankly, there needs to be an embracement and it doesn't have to be with harassment. We can all co-exist. We can all embrace re-gentrification, but not with someone's life being possibly in danger. That situation could have gone a different way. And we will not stand for it. That is my time. Thank you. We have a very good relationship with the police department. And we did speak to some investigators. And was pleased with that. We gave our recommendation of what we saw to them. And I look forward to sharing this with our community here. In there, so I'm not gonna speak to that case. Okay, I didn't see the film, but I was told by the chief that some things need to change. Now, with the Unity Festival, we saw film that had to be discussed. So that report will come to you guys. And I think the working together we can make a positive change for next year. I think that we should be on a better speaking term with the police to iron out these things and mistakes. And sometimes with the young officers that are not familiar, we need to deal with that in a different matter. And I'm going to stop it there because I can go on with that. I'm gonna stop it there, but I wanna go to the to the apartment for Marsha Wemmes and apartment. Over 23 years with the CRA, we gone through planning, we begged residents to come speak and be a part of the planning process. We saw businesses go, we heard of businesses go, we saw apartments torn down, we saw shotgun homes torn down. In my office personally before the CRA was stopped, had numerous folks coming to me wanting to move back to South Miami for whatever reason they love. So part of the strategy and the planning was to always use the back portion of Washington Williamson's property to try to bring back folks. The original part of that was to be connected to the original Madison Square project. That's why we bought that as an agency that was short-change with us. We lost within a 10-year period 189 housing units. Just think about that 189 housing units. And we're not talking about just one family. We're talking about grandmothers and granddaughters and children. So we wanted a place that we can actively have people come back and have a chance to come back and self-mame me. So that we can live to unify and fight for another day. I believe that the young people like Sean Tate coming aboard and others, that they can have and maybe do things a little bit different from us to make it better so that community can actually come together for a positive change. And that's partial was you was meant to be used for it. So I hope you take that and strive and we're going to talk about it again on Thursday and everybody just have a good night. Okay. I wrote the original email for those signs to be put up in the back of our leaf park The signs was originally supposed to be in so that Locke and Hoss Spiller were not parked back there. I also spoke to the mayor when he put those signs up saying those were the wrong signs he put up saying that it was only for us on the singing citizen in Marshall William Park for two hours. Is there any way we can have those signs taken down? Because now we do not have lock and hospital a park there, they have a parking lot that they park in. So, Mr. Vickers, I think what we can do is have Mr. River All Runs our parking enforcement program for lack of better way of describing it. What we can do is if we want to make that our residential parking zone, so it benefits the Abutting Cod of many association, we can certainly sign it that way as we have in some other neighborhoods. And so Mr. Riverall, if you can work on having a conversation with the association and figure out that's something they would want, we can certainly go ahead and change the signage out. We've done that for in other areas They're adjacent to commercial, like a hospital where there's spillover and often people that are working in the adjacent visible park in the residential area. We strap them to the axiom people can park curbside, but only people that have a residential parking decal. So that would be one way to kind of help, I guess mitigate any potential conflict there. Okay, then I have a two question and a second question, but Quentmate can answer this question since he's the director of the park. There's a corner sack in the middle of the park where it used to be swings. Our kids at our neighborhood does not have a swing set on our park. I go to Danny Fesele, I go to, especially I don't even wanna talk about it about it, park over there, y'all spun all that money over there. They have all this new stuff, but our kids does not have it. What is coming into our neighborhood for our kids as far as parking recreation? Okay, he's quitting here. I'm sorry. Yeah. Upon my arrival about 11 years ago, there was a playground structure underneath the power lines. Also, underneath that playground structure is the main water main extension that goes down was at 68th Street. So upon my arrival, we were looking at replacing the playground structures, which included a swing. It was deteriorated at that time. It must have been about 13 years old. It was time to take out the old bringing a new. We brought in two new structures. During the permitting process, we could not put that playground structure at that same location. Again, underneath is a water man extension that goes all the way down 68 and above are the power lines. So for those reasons, we had to place the two new playgrounds that are there now in different locations and that's where they are today. Okay, so I think we are working on a Park's master plan as vickers. So we've, our master plan is over 10 years old at this point, so we're going, we're just starting that process now. I think we can work with the Park's apartment to figure out there's a place where we can actually locate, or a placement apparatus. If you think it's worth having a conversation with some of the adjacent communities to figure out what they would want, we can do, we can repeat the exercise queue that we're doing right now around the mangle lots and figure out what people would want to see and what kind of age we need to serve us because I will speak personally. Dante Fissell has got a new swing set, but I will tell you for kids that are a little bit older than nine years old. We had there before, it was fantastic, but we have there today, it doesn't engage older kids. So it's not just about replacing it with something but also replacing something that gives kids from toddlers to pre-adolescence, an opportunity to kind of still use that space. She explained to me on her retiring that that area Miss Scott was the manager and lead part for years. She explained to me on her retiring that that area where we park it because I'm her neighbor. That area the city knows that we're allowed to park there that it has not been a problem. People have been parking there. I park there every night. So I don't understand why the, well I heard what the chief said other captain, but why harass a young female, like they did that night. When I saw, I can see the lights from my wonder when I saw all of this going on. I'm thinking that they're after somebody and I grabbed my phone and her mother's on live and I'm looking at what's going on and I couldn't believe it. So, as the, we said in the last meeting that some of these police officers need training, they need to know history of what's going on in South Miami before they attack. What if they, they'll at her or something, thinking that she's somebody else in that car? She lived right there. I mean, she's in and out. Every police should know her. The police is sitting there at night. Why would they have to do something like that to her? Secondly, with the parking with Quentin, I spoke to him a year ago about that because of that open space there. It allows for other people to be out there that don't live in a Lee Park with their dogs and their animals. And our kids, when they go out and play, they're stepping on dog poop and everything and their shoes and things. And he explained to me the easement, but what I tried to explain to him is that that street used to go all the way through when Lee Park was built, 6th A street went all the way through. The park came later. So. This figure's, you know, do you know why the street was closed? I'm just curious if you had a history or Mr. McKance. The park was built. It was built to extend the park, or is it? No, the park wasn't there. The park came after Lee Park was built. The condominiums was built. Then the park, so when they built the park, that's when they did the coldest side. And they closed that portion of the street. Right, right. So, and my question to Quentin, last year, if you remember, we met at the, when they put the stature up for Marshall Williams. And I said that to him then, that our kids run around because they don't have anything to play. It's an area for the younger kids, but what residents have done is taking that area where they removed the swing sets from and made that a dog area. So I have emails from him telling me where the dog park is. I'm not interested in a dog park. I'm interested in a place for our kids to play and I understand about easements and how for you have to be away from an easement but it should be a way that the park department could put something there for the kids so that it could be a enough space between the easements. I know some easements you have to be seven feet in a way and everything I worked for the county in the building department for 32 years so I know that there's a ways around that if you have to put something smaller or whatever. So nothing has been done in over a year. And our kids have to go to the bigger part. When they get to the bigger part, they're met with, oh, you can't play here. This is going on here. They're bringing other people in. So they charge your dollar to get into the gym to play. So you're just running our kids away everywhere they go and what they should have somewhere to play. They don't because it's been removed and he was supposed to send me the the survey sure and the easement. I never got it. I've got letters about they put up dog signs and everything. I'm not interested in that. We need it's a park, Marshall Wilson gave it to the community for a park then we should have something if we have to redesign it or whatever so that the smaller kids have one side and the larger kids have a side. I don't see what you know why that's such a big problem. It doesn't sound like it we can if we could get a fix. Now that we know that's an issue we'll think. We'll think we'll look at the scene here. And then on the issue with, I guess what you said, you had to meet with the police chief about the incident with Ms. Wells. It shouldn't be an issue. They should know what they're doing. Yeah, I think just on that issue, again, to Ms. Smith, I mean, I apologize. I don't think the intent was to harass you if that's how it came off. I read the video, I believe from what I've observed. Yeah, there were people that should be arrested. They were arrested in has been harassed. They were responding to a call and they identified an unidentified vehicle and that led to the interaction. I think what I'm hearing though is that we need to have, and I don't Mr. Ford is in the back. I think we need to figure out and we'll speak to the chief about some sort of community conversation that's structured. So we can actually do something and we have hired 10 new officers in the in the past year. Right. There probably is a good opportunity for some more dialogue, some more integration of both the police department and the community. So we will we will put our heads together. Right. And we'll have a conversation about what we can do to kind of bridge that gap. Now what I would ask is, I think to a person on this day is including Commissioner Cory or the vice mayor, who's here, we're not afraid of having these conversations. But I certainly would prefer to have them one-on-one to start as opposed to people having them here at the day as because it's very hard to have an earnest conversation and get through our business. When the first time we're hanging about something is here. So I would ask, our numbers or contact information is available. We're typically, all of our office numbers are going to please call us. Sir, and I feel the same way. As I said to you, I'm the president of the association. My door is always open. The police department brought me signs on a holiday, not going my door and deliver signs. So, I mean, they're not afraid. They can come anytime. And I believe the whole community in our association. We welcome it, but we don't want to have closed meetings. We want you out. We had two officers. What was the name of the officer? Corbett came and sat in our association meeting in our last meeting. And we didn't scare him anything. He sat there through the whole meeting. In fact, he knew everybody but me, and I've been there 50 years. So it's not that we're afraid of the police that we hate the police. It needs to be some communication, okay? And as I said that last year, when the shooting, when the game banging was going on, and I called Jane McCann, and he was in a meeting here. And when I said that about the shooting, James and this guy came over. They said, how many shots did you hear? I said three. When they finished, it was about 40 shots. So they he stayed out there with us half of the night. We're not afraid. We want to communicate. We want our community to be nice. We wanted to be a place where you can walk the sidewalks, the streets and everything. We wanted to look nice, but we don't want to be harassed. We all feel the same way. So we're like mine. Let's have a conversation. I don't want you to that because... Please. That's... You're the mayor. Sure. I'm looking for that. Okay? And I just want us to have the same opportunities as other areas in South Miami. We do as well and I've heard some comments about gentrification. I want to make sure that this is on their radar because I'm one of the things I often looked at when I go into situations is what was the catalyst? What was initiating action that spurred whatever transpired? And even though we've talked about the community meeting and what happened with that whole situation, I've not heard what led to police feeling the need to respond at that particular event. Not that it has to be answered today, but I want to make sure it's a part of the report. Second, as a relates to this young lady in the robbery call that went out, did their vehicle fit the description? That's one of the questions that's ringing in the back of my mind. And then the other piece that's most important to me is, did you catch the suspects? I heard nothing. So that is a priority to me. You've got dangerous individuals who just committed an act and are focused on a certain amount of resources. Not on how many resources you had on that particular shift. But a good number was dealing with a situation that I felt was less of a priority than what should have been the priority. So I want to make sure that that stays a focus as it relates to the housing situation. As you and I talked, affordable housing basically is robbing taxpayers. Point blank period. Because developers end up owning the property and doing whatever they want to whomever, still getting the tax breaks, they look for the loopholes and now guess what, your community's not one level better. So if we're gonna talk about housing, let's talk about affordable home ownership. Let's have that conversation. And I called and spoke to Sergeant Corgan about an escort from my Commissioner Baptist Church and he said that they didn't do that anymore, but he told me to reach out to Sweetwater and the city of Miami. But at that point, the front-on, which is Paradise Enriched My Heights, told me that they were hampered. So they did, they took care of it. But on Thursday night, as my family was coming in, we were sitting out there playing music. The volume problem was like one or two percent because we didn't have to scream over each other to talk. The radio was real low and it's 5.30 in the afternoon. We were talking and then all of a sudden, we seen all the police is coming up with the So we saw the referment and then I seen them jump out they car at that point. I got up and went to the gate and say, man, I hope you. They say, well, we got a call saying that the music is too loud. I said, well, you all are here. Do y'all hear the music? No. We don't hear the music. But we got to do our job. We got a call. We got to come out and check it. I said, okay. So they left. They comes back again. The music is still at the same volume. And everybody's just sitting around grieving. We were grieving because my son, death, was not playing. He was on an operation table when he died. And he went in just for coughing up blood. So at that point, my whole family was just tore up. So after that day, the next day, they come back again. So I'm like, what's going on? You can't even grieve in your own neighborhood. We live at my mom's house. We've been there since 1970. And I'm still in South Ma'am. I'm not at her house, but my house is on 68th Street in my own house. But that's what we celebrate. That's what my son asks. He's there every day with her. So at that point, my mama come out, what I know was going on. Why did officers keep coming? We're just grieving. Nobody wasn't smoking anything. Everybody was on the sidewalk, just communicating. Family was studying coming in. And I told the officer, I said, if y'all coming out for these people that's on this street now and the whole block was loaded with cars, I said, wait till Friday, I'm gonna have over 200 family members here. And it was, and the funeral was to 200 plus people. That's just how big my family is. So the thing is that we need to get these officers together. When people are grieving, they don't need to be intimidated by these officers. You know you come up and tell them to stand on the sidewalk. Don't stand in the road. Everybody's grown. Brought daylight. You can't stand in the streets. everybody's grown, broad daylight. You can't stand in the streets. Ain't no cars coming. I just want this to be on record. And tonight I will be presenting the application for 6540 matter lane for the request to resume the property. So on your screen now you can see the location map on the left side of your screen showing other property is located next to Southwest 66 Avenue Southwest 80th Street to the South and Madeline to the North. So the question for you is to amend the city zoning map to resume the property from RT 6 which is duplex residential to RT 18 which is townhouse residential. The property is the approximately.38 acres in size, or just a little bit over a third of an acre, or approximately 16,528 square feet. And the current land use is residential. So on the left of your screen is the existing future land use map, showing the existing future land use designation. And on the right of your screen is the existing future land use map showing the existing future land use designation and on the right of your screen is the zoning district showing the zoning district map showing the existing zoning district. So the property is currently, excuse me, the property currently has a future land use designation of townhouse residential. to the north is single family residential, to the south is the metro rail right away with Miami-Dade County. To the east is single family residential and the metro rail right away. And to the south, sorry, and to the west is business office. But it's only district, as mentioned earlier, it is currently zoned as duplex residential, which is RT6. RS3 is located to the north, which is low density residential. GU, general use, with Miami-Dade County to the south. RS3 and GU to the east, and RO, which is residential office to the west. So the property had to meet six, a total of six review criteria, which include multiple properties, city initiated application, intergovernmental notice, rezoning reapplication, application requirements, neighborhood awareness, and the application did meet all of the review criteria. In addition, the application request is consistent with the following comprehensive plan goals, objectives, and policies, including the future land use goal one, and along with the objective 1.1 and policy 1.1.3, future land use goal six, along with the objective 6.1, and policy 6.1.1, and a housing gold 1, and the policy 1.1.1. So for the proposed zoning district, what exactly will it do for the property? How will it affect the property? It will increase the maximum density and the allowable height. specifically the the density will increase from a 6 dwelling units per acre to 18 dwelling units per acre. What that means for the site is that the potential maximum number of units that can be built on the site will increase from 2 dwelling units to a potential maximum of 6 dwelling units. The applicant has provided a conceptual plan that proposes a total of six dwelling units and I must stress that the plan is conceptual and it will have to go through the city's design review board prior to building permit approval. So that's site plan is not being approved through this action tonight. The maximum allowable height will increase from 25 feet or two sores to a maximum of 40 feet or three sores. And the conceptual cyclan submitted by the applicant proposes two stories with the main roof height indicated at 31 feet. So on your screen is an example of the conceptual cyclan. You can see there are six units. There will be parking and culminated on site, a total of, believe, 12 parking spaces, five of those being garage spaces for five of the units, and also proposal for some on-screen parking. But it's important to note that all of the required parking can be accommodated on of the area of the area of the area of the area of the area of the area of the area of the area of the area of the spaces would encroach into the travel lane. Right, so again, this is a conceptual site plan and that will be fully vetted through the review process. But that is about a question, so thank you. So the staff recommendation is for the City Commission to approve the requested application to amend the official zoning map to rezone the 6540 minor lane address from two-plex residential, RT62 townhouse residential, RT18. The planning board, sorry, the meeting went before the planning board on March 11th and received unanimous approval with the recommendation that the conceptual plan be updated to demonstrate all of the required parking on site, which was demonstrated with the plan that I showed earlier. Our intent is to provide a housing product or housing product type that is not necessarily in abundance within the city of South Miami. That is our goal here. Regarding the parking, the question that was asked, the intent behind the on-street parking, we were actually under the impression that the city would be looking for that based off the staff recommendation or comments from the planning board. We have offered to provide a covenant regarding the two parking spaces per unit onsite and remove that on stream parking regarding any other design questions. We also sorry so just to clarify there's there's as a covenant been offered formally so it has been they have been working on a covenant they have not formally offered a signed version it, but I think they intend to speak about it and we'll have it ready for second reading. I want to speak for them. But thank you. Yes. OK. The intent was to obviously provide that, especially at the time for obviously site plan approval when we came for that based off. I'm sorry. So two quick things, the covenant that we will be proffering is to provide at least two parking spaces on site per unit to limit the height of the town homes to two stories, as opposed to the three stories that's allowed under the current zoning or the RTA teen zoning. And we would be more than happy to proffer that we will not build the parking spaces on street. We do not prefer the parking spaces on street. If you look at the design that we have done, we have purposely tried to create the best street front that we can, right? So we've done the little stoops in front of the town homes. We've done the little front yard. We're stepping them up to a three feet, just to give it that great feel. So if we could get that area that is shown as parking today as landscaping, we would definitely prefer that. So, and we also think that this plan, having one way in with all the parking sort of behind the units works a lot better than if you were to have your typical duplex with, you know, three or four cars backing up into the street from the front of the house. And we do feel that one point of access is much better than having as I said before, a condition that you typically get when you do these smaller lots on the busier streets, Bird Road, Coral Way where you've got the traffic backing up into the drive. And it also happens along 67th Avenue in some places. We realize that we've got commercial to the south of us. We've got an office building to the west of us. We've got US one to the east of us so it's you know We think this is a very nice transitional product between us one the Metro obviously is a big impact on this particular property We think it's a good transition from US one you know north to the to the residential partials so So, is that an answer to your question? So the answer is the driveway to and all the parking spots about to the neighbor. So I think the driveway about the neighbor I think the parking is oriented south and east into that corner into the corner. So I when I when I looked at this one of my concerns and we'll have some more conversation. My concerns was evening access and headlights. And so obviously this of the orientations that I could try to figure out, this at least had the more optimal effect of orienting headlights back towards the right of way as opposed to directly east into the abliting home. My question is, okay, first of all, has this been approved, this change of zoning? No, man, that's what's before us tonight. And we'll be, before us again on second reading one more time. So we'll have a second public hearing on the side of us. Well, I'm sorry. In order for the zoning to be approved, it has to be approved twice. Today is an initial vote with the public hearing and there will be a second vote next month to discuss the same application again and here from the public on it as well. This is about a third of an acre. Okay, a third of an acre. And therefore no more than six units could be built. Okay, so I'm showing you. So I want to go on record opposing the change in zoning. I would question why it would be needed to change the zoning there. That lot has been empty since I bought my house in 2000, so that's 25 years. I understand they'd like to develop it. It makes sense to use it for something. I mean, we walk our dogs on it sometimes. But it seems like there is a move toward maximizing profits over the city of pleasant living, right? The idea of living being pleasant. Because when you have traffic stacked up and you can't move, you can't get in or out of your residence, that's not really pleasant living, is it? So what would be the reason is it just the revenue? It's just they're gonna make money. Who else makes money city makes money is it just that or do we talk about quality of Life quality of living in the neighborhood so What's what's the reason for needing six? Man, I think this is not an application that we are sponsoring as a city. It's being brought forward by a private party. I believe it owns the property and so that's the right to make the request. The question I would have for you, if I may, while I have you here, is between zero, which is there today and six, which is what they're asking for. Is there some level of development you think would be appropriate on that site? Yeah, I think. I had thought when this property was at one point in receivership, that would be a great thing for us to try to acquire. As a park, unfortunately, that did not happen. So knowing that that's not the realm of what we can do today, I would ask you as a neighbor between nothing that is, you know, at times that I drive by it is poorly maintained on occasion, right? Yes. And something, what would be the something that you could think would make for a harmonious existence? Well, I think the current zoning that allows for what, one or two? Just two units, yeah. Two units. Two units. Okay. So that would be acceptable, I think, for two units there. But anything that you put there is going to increase the traffic. So just the bigger, you know, the more spread out, the higher is not optimal because of the congestion that already is there and also because of things like beauty trees, for instance. It seems to me that you guys have two neighborhoods asking you to control the development in front of you. It's pretty clear here that the residents are the residents. The people that live in the residential neighborhoods are struggling with the folks that are coming in and trying to make a dollar off of us. That was very clear in the previous conversations we heard. And I can tell you that in my neighborhood, this proposal that was put up is not taking into account my actual neighborhood. It's taking into account a bunch of lawyers speak and a bunch of stuff on paper that people can make money out. It's the entrance to my neighborhood. It's always been there. The plan that they're proposing is going to cut every one of those trees down, both royals, which are as old as the city of Miami probably. all four mango trees are going to go. The pointy end is going to go. And then most of all, it's dangerous. They're going to be putting up this monstrosity on a corner. And I was very glad to see that they took the parking off of that initial road on the backside as you enter manually, because the previous proposal they had had six driveways backing up. But now it's all going to the back of that property. When you build a two and a half story building because remember they're raising it up for it to look better, you are going to be creating a blind spot around that corner on Manor Lane. And I can tell you living there now it's already dangerous. The comes, both directions, we have people piling through there. And so this facility is going to make it so that it's not going to be 12 cars. It's going to be 18 cars. This is Miami. It's a three bedroom house. It could be 22 cars, we don't even know. They're going to end up parking on the street. It's not a safe place to park. It has never been used for parking. People used to park further on the interior of the property. But since that sidewalk was put in, it's no longer used for parking for the professional center. And so I imagine the trash trucks that come by. All of the different services that are going to be included in this property are not taking into account the actual flow of the space. I respect that they want to make money, but it is our neighborhood and it is an entrance. They're saying it's keeping with the neighborhood. It's a single family residential neighborhood that they're entering into and they're getting by on a technicality because there's a professional center across the way. This is an entrance to single family residential neighborhood. And I realize, Sidious South Miami needs to make more revenue, but there is a middle ground. This thing that's being proposed is greedy, and it's not taking the residents into account. I ask that you consider the residents in your decision making. Thank you, Mr. Lopez. Put a two-unit thing there, you know? It's not healthy for the neighborhood. And it's a sweet neighborhood. Just, you know, it just, it doesn't make sense. It, you know, it's just common sense, you know? I mean, they're out to make some money. You know, so that everybody else is expense. And I do not want to see that happen. This is supposed to be the city of Pleasant Living. We are in all American city and the quality of life matters, the heat index matters. We don't need to increase the capacity. I am definitely someone that is pro-business, I'm pro-money, but not at the expense of the safety. And I've been through there. I went to a Luttle Melementary School, so I go to big chief. Like this is an area, many of the residents we all go through. And we, you can't like, unsee like the concern and the safety issue that's going to be about. Like he said, people blow right through that stop sign. It's like a suggestion. And my concern is that we're not fully taken into account what us as the residents. Those of us who have been here and our families have built the city and invested in the city. This is a tricky situation because you're literally right next to a business center, an office building that has during a day crazy amount of parking. My kids go there to have worth the doneness appointments. It is nonstop. But there's already parking issue there. I think the city, I think I think we should welcome the ability of having more neighbors in specific and smart areas. Be welcome to our city. We're talking about a difference of two units versus six units. In that corner, the traffic is not going to be crazy more amount because of those four extra units. The traffic that's already going through is coming from the south. It's not something that we're controlling, right? We already do a decent you know decent enough job of enforcement there, no left turns, trying to make sure it's hard as possible for traffic to get through there. I do agree with the concrete jungle. We're all not big fans. Historically on the record, we do not love trees being cut down. So I will try to make sure that we work with the architect to make sure we keep as much landscape and tree scape, especially the mature trees in place. If we need them, we move then we'll figure that out. But those are the three comments I really wanted to touch to because I think that we're struggling as a South Florida community, not just South Miami, but a community in general where you know we want to, but then we get upset when prices go up and people get priced out and people leave. We have to find a balance. This is a very specific lot that might cater to that. So, you know, that's my opinion, particularly on this particular lot. For the comments. Could you start, do youing recognize. I'm I'm having a hard time with this. I continue to look at this one way and the other and anyway I look at it. I can't make it work in my head. I'm looking at six units that feel like they're crammed into that property. When I look at the impervious space, I just see, I mean I understand it's not the shape of a diamond, but I see essentially the shape of, you know, whatever that is. Where it has a little strip of grass, a little strip of grass, a little strip of grass. I'm not sure if I'm reading this zoning chart properly. When it's saying that each dwelling unit is going to be 2754 square feet. I don't know if I'm reading that correctly. My mark is correct me if I'm wrong, please. If you know or the developers, if you know, it just I think we might be looking at an unintended consequence of a zoning change. And I'm sorry, I know your first name, but I don't know your last name. Shanti? Shanti, and she continues to bring it up. And there's, while I might not agree, 100% with what you're saying. There's a kernel of that that continues to stick with me and when I see this it's what I think. Then there's, I feel like we're trying to fit square pegs into round holes on some of these properties and this is one of those for me and I think it's great that they want to two stories two stories instead of three. It is in character with the area. I you know the shifts and grooves that the developers talking about wanting to make simply makes it agreeable with the rest of the area. But I think there's some work to be done here and I wouldn't want to be the one to say what that is I just know that the way it is right now doesn't work for me like There's some parking spaces. They don't fit will figure it out. There's not this will figure it out then I Can't do that Shardry is So I guess again, I'm'm like Mayor Bonich. I'm sorry, sorry. I meant to say vice-fair. Commissioner Bonich. I'm trying to see how it fits. I mean, I'm in the world of construction. I understand. and I also understand what Commissioner Guy is saying. I'm also thinking that, you know, in other areas in our city, we use this concept of town homes to separate the commercial district from the residential district as a buffer. So that's how the whole city's playing. We're doing it in downtown. We're looking at 60-second Avenue. And the brownstone concept is actually what we're trying to get from a lot of these builders or people who want to, who are on these properties of the product that they're trying to put together. So I understand the neighbors and the residents of what you're saying, you know, the stop signs. I don't see and trust me, I've walked this. I know that how everybody walks their dogs and how everything goes in this neighborhood. The concept, again, I say it again, the concept that we're doing, this is not just for this lot, this is something that we are trying to use townhomes to avoid buildings and avoid a concrete jungle. We're not trying to do buildings, these are two-story townomes where two stories that developers says that they were going to two stories. So what you see here will be less. Is there work to be done? Well this is not the final product. I think in my opinion also the trees. I do agree. We have some of these trees that have been there for a while. In the footprint of the building, there's no way those trees are staying there. I mean, it's just logical. So, what can we do? Can we relocate it to the back of the property? To give shade? I don't know. I just, I'm in the'm in the place where I, the product is what, again, what we're looking for to buffer into the residential areas. I mean, that's what we're trying to do with town homes. Or someone buys us and tries to do a building. That would be worse, right? Exactly. So I just think it needs to be worked. I think the owner of the property of the architect needs to work this out, show us where the trees are going to go, fix the parking of what you're going to do, bring it down to the two stories, and give us what this, because this is not what we're looking at right now. it's not going to be what they're going to apply or submit. So we would, I don't know, I would need to see something before we, I proceeded with changing the zoning. Yeah. So from my perspective, you know, I ran with the idea that we would grow around our town center, right downtown, near the transit station. So, I'm a big believer of growth and doing whatever we can to drive development there because I think that's where it's most appropriate. With these applications, I see the opportunity that the applicant is asking us to kind of walk down the road with them on, but I share the trepidation of a lot of the neighbors because it's a transitional area where a rezoning without any commitments Certainly, poor ten's a lot of negative things, right? It's the same way I feel colleagues. We talked about the air south of 74 street We were talking about the rezoning for the town center while we know a lot of good thing could come from That possible growth the possibly for conflicts. They are very real with single family residential neighborhoods. And I kind of feel that this property is the same way. I always imagine that this would have been redeveloped with a small, you know, something like a small office building, two stories at this site that would have seemed to me to be the obvious development. I think town homes here could work. What gives me the most discomfort about the applications is presenters is not presented with a site plan. Just like I had mentioned before in that other area south of downtown, I would love for us to consider rezoning when there's a site plan in front of us. So that we have a sense that we're not just approving the rezoning, but a project that actually functionally works on the property. So I think, you know, I want to commend the team. I know the people that are, I know the people, yes, I'll recognize you, if you like, let me finish the comments. I know that Mr. Font and Font Family and the team that are here, Mr. LePont are good people. They are well-. I'm not sure if you're going to be able to do that. I'm not sure if you're going to be able to do that. I'm not sure if you're going to be able to do that. I'm not sure if you're terms of the total number of units. You know, it'd be something shy of six would be better suited to, you know, integrate with the balance of the neighborhood. So when I think probably the most prudent thing from my perspective, because I think I, you know, I saw Mr. Lopez-Shake his head in the back there. When I saw this site come onto the market a few months ago, my thought was, God, that would be a great site. It's for us to pick up. We didn't have the bond. We didn't have the bond approved to do it, so we didn't have the capacity, we didn't have the capacity to do it, but I would have loved this happen 12 months from now, 18 months from now, it would have been here in the last 25 years if someone could make the economics work around the land costs with two units. I don't think that's reasonable. But what I think would probably be the best thing for us to do and Mr. Fawn, if you're meanable, I would like to move to defer this item maybe for 30 days and allow the team to maybe work on a binding development concept, have some conversations with the neighbors and see if we can get to a site plan, to an approval of a site plan with the rezoning so that, or at least a profit covenant to a site plan. So if we approve a rezoning, we know that what we're getting in exchange for, and the neighbors have a sense that there's a commitment being made around the product that's going to be developed there. So those are my thoughts, colleagues. I don't disagree with what you just said. I just, in the character of being fair, you know, the transition spots that we've always spoken about between business and residential, having the opportunity to have these opportunities these opportunities to have these type of homes in this place fits this character here, right? We were doing it throughout all South Miami in very specific areas, very smartly put in places that we think the transitions apply. Manor Lane historically has always had the transition between residential homes on the north side and businesses and apartments on the south side all across Manor Lane. There are some few homes obviously on the south side of that, but historically it's been there, right? So this does not, for me, complete the out of character with the area. I'm a big fan of green, I'm a big fan of keeping our residential. It's just this specific spot fits the character. I don't disagree with that observation. I think that it's again, no, the geometry of the site in particular makes the execution of the project more challenging than a square rectangle, right? I think here, you know, that the, you know, I think, you know, to the applicant's credit, I think it seems, it sounds like, because I haven't seen a prior site when they've evolved the site plan to bring, you know, the traffic to the back of the lot. I mean, when I looked at this, again, without the benefit of talking into one, my first thought was, okay, people are gonna access a site. What are the conflicts in terms of headlights? Are we going to be basically sitting apart? So it's facing the homes to the east. Clearly it's facing the homes to the east? Clearly, it seems like they thought through some of those conflicts and they've adjusted the site plan accordingly. But I think there are some access and circulation and some functionality issues are probably worth exploring. I think there's reason for the neighbors to have some consternation about what's here. My consternation comes from the fact that there's just not a biting site plan. I think if I had a product that was designed at two stories, maybe something less than six units, that kind of address these conflicts that had for me a survey, a tree survey, and said, here's how we've mitigated the conflicts to preserve the canopy. I would feel much more comfortable approving the rezoning, but we don't have that information right now. We're being asked right now on first reading is to adopt a rezoning without any commitments. I know there've been representations about future proffers. I look forward to those. I would think, again, I don't know if there were three votes to support it tonight. If there's not, my preference would be rather than send a well-intended developer away. It sounds like development team away. Let's give a chance to kind of work on some of the issues and bring something back that strikes a better balance. Yes, ma'am. I would urge the right side of the day to seriously consider the mayor because as it stands right now, I would be a no vote if we don't vote to defer. And so if that helps, doesn't help you guys make a decision. I just want to be clear. I said, I said, I think we need, I think the developer needs to work this and bring it back with the two stories, not three stories show an actual depiction of what's going to happen. Maybe six doesn't work, maybe five works. Where are the trees going to go? Like the Mayor said, an actual site plan showing us what it is. Again, like Mr. Kaya said, Commissioner Kaya said, and like we've said, are looking to transition from commercial to residential. We've always spoken about the town home's product because it's residential, it's smaller, and it doesn't impose on you like a building would. Because if we put there an office building, three or four stories with lighting all over their parking, you're not going to like because that's gonna just, at night, you're just gonna have these parking lights, dwelling over your house. So this is a much calmer, nicer looking, possibly increased property value, but at the same, so there are things we need to work out, but as of right now, the way it stands right now, I think the developer needs to go and just provide us the site plan, show us where things are gonna go and bring us what's actually gonna be there. I have been, I'm not a resident of South Miami today because I've moved a little further south, but I grew up in South Miami from the time I was eight years old until I moved out of my parents' house after college. So, it's a city that I've been in a long time and we want to do we want to do something correct and right. And we are architects, so we do want to put out a product that we could be proud of and the city can be proud of. If you look at the plan on the left hand side, and I know it doesn't show below us, but everything below us is Dave County and it is a commercial zoning. And I am sure that that property, which is a beautiful corner piece, right, is going to end up being some RTC development at that point, right? If you look, the office building, which is in the sort of purplish color, and then look at the orange that you see there, that's not something that we've done to accent the property, that is the land use that has been with the property since day one. So somebody a long time ago said, this is a transition piece. This is a piece that needs a little more density than the yellow to the north of it, right? It is a transition piece, as Commissioner Coye pointed out. So we do feel that this property deserves a little more than a duplex. The city did not have a zoning in place at the time to accommodate that. It does today. We think it's a great product for the city. We've seen it go down the street on the Dave County side and how successful that has been and how popular that product is. And that's what we would like to bring to the city. more than happy to work with staff to get this to the point where we've got all the parking on site which we do now. We take off to parking below and to keep it to two stories. We will work and we have to mitigate whatever trees we take off, right? So obviously, as you all know, that's a huge process. We find out how big the trees are, what we need to take down, we need to replace them with a certain amount of canopy, et cetera, et cetera. And we're happy to do so because that will benefit the property as well. So hopefully that address some of the concerns that you guys have. We're happy to defer this for another 30 days. Okay. As we've discussed over time, that the parking layout at that park is very challenging and it was always the intent to take a look at that and identify some improvements. We had a lot going on at the time so we're bringing it forward. As you know we have somebody that's taking a look at that for us and so there's an interim report of where we are and get some feedback and certainly we're going to be doing some more work but just want to bring you into the loop of what's going on with the review of Parking Operating. Who's the project engineer? So just wanted to introduce her. Come on up, Miss Sheila. Give a brief presentation on where we are today. Thank you. Thank you, Quizz. Good evening, everybody. I'll try to keep this short and sweet for you guys, because I know you've been here for a while. I'm pretty much home. Thank you. So I'm glad to be able to give you guys the update so far what my firm has been working on for the city of South Miami. This is a very popular park, especially with all the improvements you guys have been doing. We've been looking at expansion of the parking spaces where it makes more sense, but also the safety of pedestrians and the kids. So as of the end of March, we're only about 55% complete. So total overview of the project is the expansion. So we're thinking about adding 60 additional official parking spaces. We know that the residents and the visitors kind of park where they're able to be fit. So we took that into account as well. But we're also focusing on safety, accessibility, and just connecting visitors all throughout the entire parking area. So for the parking spaces, currently you guys have 90. We're proposing an additional 60, making it entirely 150 parking stalls. In order to do this, we are thinking of expanding the North Quarter portion of the park. So that would have, and repurposing the median on South List 58 Avenue. This would have an environmental impact of removing 27 trees, but we are proposing an addition of 38 trees all within the parking area. So this is a quick rendering of the park. You can see here where the median on the east side of the park is repurposed to have parking stalls on both ends. We kept the ADA accessible parking spaces kind of within the same areas, but on the west side, we added an additional ramp towards the middle. For lighting, right now we are proposing 15 new light poles all with LED lighting that's more cost efficient but also overall overhead costs. So this is the existing photometric plan of South Miami Park just the parking lot area. There's a single pole towards the entrance you guys have a lot of games at night it's not very safe for kids or petitions. It's perfectly safe for the record. Okay. It's free. It's anybody in case anybody wants to sue us. It's perfectly safe. Correct. Mr. St. Attorney? It's quite safe. That is a very, it meets every building code in life safety. I do not want the record. Can I strike that for the record please? Sorry. So for the proposed photometric plans you see here it has a elimination all throughout the parking area specifically where there are also ramps with very little overhead spillage over to the neighboring residents. For the pedestrian safety and access routes we wanted to dedicate pathways connecting pedestrians all throughout the entire parking space, not just focusing on the parking areas and kind of where they're adjacent to, and also include traffic calming devices like speed homes. So on this point, if you see illuminated in the light blue, it's kind of where pedestrians are able to access and come into the park. So right at the beginning towards the entrance, you have the extension of the sidewalks that come into the park on each side that go down a proposed sidewalk towards the east. That's adjacent to the elementary school and also a whizing path that goes into the playground. There's also a proposed path where we're trying to connect the playground into the athletic field. This is an area where people naturally just walk up the berm. So wanting to actually visually delete a space for them, as well as create an accessible route where everybody can kind of also connect to the current construction project of the restrooms. So this is a rendering of what that ramp will look like towards the middle, where it would have steps, and then also wrap next to it. For security, we're trying to do the Turing Bredial system. It's integrated with the design of the entire parking area. It can capture vehicle images and also license plates. And you can have real-time surveillance also a CUB-based system. So you're able to review footage 24-7. For the enhanced entrance, this is a rendering of what we're proposing. So you have beautiful columns cladded in the keystone. That's something that's kind of carried throughout the park. You have it in the picnic shelters, but also on the exterior building of the restrooms, a black aluminum picket fencing, and an artway along with the South Miami logo. For the landscaping the project will meet full tree medication requirements. That's set forth from South Miami But also Miami-D County. So that would include the planting of 38 hardwood trees that are all native to South Florida and additional vibrant shrubs and flowers So some of the hardwood trees and shade trees that we're proposing are what's currently at the park as well. You have live oak, gumballimbo, silver button wood and wild tamarind. And these are a couple of the native low maintenance shrubs. There are also salt tolerant that we're thinking about planning throughout the landscaping. Overall costs within our design progress we're thinking of range from anywhere from 850,000 to a million. Is that number inclusive of design costs or is that just the hard construction costs? car construction. Okay, so what we have to add for design? Design costs, we have a contract for 134. 134. Okay. That's something that's more methods for the contractor. But we are proposing where the parking lot is fully awful just shutting down particular sections at a time. And you're part, you said you're 55% complete with design. In design progress. When do you envision that part being done? That part should be done in June. Yeah, June. Yeah, so what's your thought process on how we're going to have dual lanes on some of these areas here? You know, as as we've struggled, especially some of these parking spots on the on the west side of the parking lot there. They're very tight Do Dual access going back and forth on traffic is difficult and you're gonna have that same problem on the east side of those parking spots. So actually it's hard to see here, but Southwest with the avenue was widened. So it comes more into the green space of what's actually existing. I think currently right now that road is only between 19 to 20 feet and here we're proposing what you guys have in the other areas which is 22. In terms of the turning lanes where you're more so on the medians around, we're proposing mountable curbs. So you see them a lot and on like traffic circles and highway applications where if there is a need that's more so for turning vehicle access for fire trucks, they're going to be easily be able to maneuver throughout that area. I would just look at the traffic clothes that we have currently. It's very difficult to come in back and forth or drop balls with the kids, the amount of cars that are stopping. When there's not that much, like when it's at capacity, it's gonna be very difficult. So I would suggest that we go ahead and look at the traffic location to go all the way through on like one way. Oh, one way, okay. So yeah, I want to ask to clarify, see, you want them to examine a one way traffic circulation pattern, supposed to dole the reaction a little bit. Okay, it's a good idea. Hi. Hi. It ended up not being an emergency but I was there when with Robert when the guy told them like I'm going to take the cars out next time you know if we have to get out an emergency so how do we address the people parking along that and I know know they were giving tickets and all that, but people still parked there. Yeah. To a contract. I think something that we can do as a design firm is that we can put entire no parking striping along that entire soft corridor. We do show it as a one-way, just because we know that it's used for parking. That's why we didn't expand it into also include parking on that area except for that small portion where there's a meeting in taxes. So that is something that we can include. I plan my biggest concern is this park is pretty under landscape generally. You know, to Quentin, I think one of the complaints I've gotten most about what we've done is that the existing shade structures over the bleachers really do not provide much shade when you're sitting more than above the first or second row. So we you're probably need to look at not sure when you design that whether we looked at how the sun travels across and they're actually structured by here that they get very hot prepare instead out there on the weekends So my concern here is the biggest thing is we're moving 27 trees. I'm not sure are those are these mature specimen trees that we're removing I mean, are nine that are mature specimen trees? Okay, so I mean, and where are they located, if you can highlight the four. Also, those are located towards the north end, where we are expanding. Okay, so I mean, how many parking spaces will we lose if we kept those nine mature trees? 22. 22. So we would basically net 38 spaces as opposed to 60. Yeah. Okay., uh, that's a conversation we should have, frankly, whether it is ma'am. But realistically, where those trees are, would people be sitting there? Would they don't hope anybody were there? No, but I mean, they do, but I mean, again, the point is we want to just, I mean, again, lower, lower the general, we made the decision for operational purposes to turf the play field, because we have 900 kids in that program. And so I just want to make sure that we're not creating more of a heat island there. Do we want to then instead of, I don't remember the numbers, so don't kill me, but instead of like 38 trees, do we want to maybe put a little bit less and get bigger trees? I always think of you when you're like, I don't wanna tree that's like two or five. Yeah, that's correct. Like I don't wanna tree that my grandchild will, you know. So that's, so that was gonna be the core layer of my comment, which is, I think there's a conversation about keeping them or are these nine trees candidates relocation into other areas of the park. And then for the 38 hardwood trees, I certainly do not want to see two inch DPH or four inch DPH trees. I want something that's close to mature, right? So that we're getting shade day one. And I think we had talked about this before when we were out there for the opening, the air is right now in between the playing fields. So if we need to expand the scope, and on the west end of the park, closer to the playing fields, are there opportunities to add more canopy trees there as well? That's just kind of, again, soft in the condition. I mean, we made this decision to turf it for, I think very valid operational reason, but I do not want to be a cavalier about getting rid of specimens trees and creating more of a heat island effect there. The other thing, I don't know if we've had any conversation. If you've looked at, if there's a way for us to optimize our use of the adjacent parking lot and integrate it into the operation of this facility, after hours and on weekends, I do believe there's an actual parking lot just across the fence line right next door. You know, I don't know what the inventory is there. If we've analyzed that again, this is one of those opportunities, I think Mr. Manager, where we can immediately go to the school system and say, hey, we're gonna upgrade your parking lot. Let's have a cross use agreement for that facility. And maybe we can still create 60 spaces of inventory, just not all on the footprint of our park, right? So, you know, I would think if that's something that the design isn't so far down the field that we can look at that as an alternative to maybe removing some of these specimens trees, that would be something I'd like for us to consider. Because I think we've had a lot of discussion about trying to see how we can integrate this park with the school And this might be the first opportunity to start some tangible progress towards that goal Related question in terms of the cost not not to you, but to our staff Mr. City Attorney You know, we to the chagrin of my colleague to my left enacted a school zone camera enforcement program. And you know, there are, this is a park that is in many ways a safe route to the neighboring school. Is there any way that we can use those resources which are very limited in terms their application, to actually build some of this connectivity, you know, through the park to David Fairchild Elementary. Particularly the perimeter enhancements, you know, I think they show some intersection or, you know, speed mitigation elements on the periphery of the park, on the west side. I was imagining that was that the image on the west side of the park. the one you showed that had the kind of the trap of the park. I think that's the reason why we're doing this. So we are essentially placing a moratorium, which we had effectively already done, taking into account the discussions that we had for Surami to then follow the suggestions that the mayor had had in looking at other incentives and coming back to us and Commissioner Kaye and Commissioner Rodriguez, everybody's input so that we can have a more effective way of dealing with alternative energies in our city and that we don't have edicts down like if this was a monarchy we will have incentives and we look forward to them and that's what this is. This may also, or does also include re-roofing projects, where you were supposed to do that. Yes, that's our interpretation of the ordinance. Our analysis had not included the re-roofing permit numbers or the remodeling and renovation numbers. It was the construction, but my recollection of the presentation was that included new construction, construction by the third and third- and re-roofing projects. But that was just my takeaway. I spoke to you after that I read the ordinance, we're clearly, I went to Tony to see if his interpretation was what I was reading. If it included reruves or not. And we both agree that it includes reruves. You got proof. I was in short the last meeting. Okay. No problem. I discussed it with you. I've conflated our conversation. So anyhow. She provided a memo this afternoon of which I'm going to take a look at and share the information. Part of the research was capturing those categories that were mentioned, re-roves, and try to get some numbers behind it. And then historically, what happened as a result of enforcing this in it? It seems like back actually all the way to 2017 where it inconsistencies throughout that time frame and certainly from 22 November 22 Another confusion as to where there was a moratorium in place right now So that's part of her research and I'm gonna take a look at what she shared and and If there's more research involved we'll do that and then share it give you something So I just want to say this as a corollary to this, which is when you and I first met, I think what my conversation about this opportunity was I want to make sure that we have the best department to handle, you know, small single family and do pledge projects and terms of our capacity on staff today. You know, certainly if you're less confident about that today than I did 24 months ago. You know, today's presentation on the one project that we had that we discussed I was surprised to see that it was handled by third party consultant. Given the size of the project, it's a pretty small project. I think the kind of speaks to the fact that we kind of really need to grow the capacity of our in-house staff and figure out how we're going to get to the balance of what's going to be handled outside, you know, our typical review process. So, you know, hopefully between now and the end of the year we kind of figure out a plan so that going into our budget discussion if we do need to add resources or make some modifications there, that we do that. And I have now had a couple of experiences and elect officials seeing things and identifying gross deficiencies and people's understanding of the code internally that, you know, it's not a reflection on you because you've really just gotten here. But I just think we really need to grow the capacity of development services, particularly for what is our core function, which is permitting homes. And the better we make that experience, the better the quality of the interaction, I think obviously it serves the city very well in the long term. So I'll just say that by way of editorial. I have just one piece of information I want to share on an item regarding Don't you Fasalt Park and the new building we've been trying to get permitted where we had the fire access issue. Had a lot of conversations with Rodney Mandelstrom about granting us access off his parking lot. He has agreed to do that. So hopefully we'll have a solution, we'll bring an easement forward. He is looking for us to also, he's had some concerns about his zoning rights on that property for some time, is looking at making some modifications. So I've asked to see attorney to bring forward a settlement agreement in that lawsuit. That would basically provide this consideration in the form of easement. And we would then take, promise to take affirmative steps to, I think modify his pud, correct? And possibly then entering to a development agreement would give him some entitlement guarantees for the maximum statutory term, which I think is 30 years. So that's where we are in that conversation. We've made some progress there. Hopefully that'll result in us being able to get that building permitted. So just wanted to share that boy of information.
