I'm going to go into the August 8th Board of Supervisors meeting here in Falkier County. Pretty brief session today. We're going to go into a gender review here at 4 o'clock. And go through what we're looking at this evening, which frankly is hardly anything. We do not have any work sessions whatsoever today, which is why we push this agenda review to four o'clock. So I'll just go ahead and start off with... That, and prior to starting the agenda review, I believe Ms. Downs would like to introduce a new employee to the public. Thank you, sir. Today in our audience, we have Kim Brown. Kim is joining us as our new human resources director for both the government and the public school division. Kim comes from the city of Bruno public schools. She brings a wealth of public sector experience both with government and school divisions as well as private sector. I get it. I get it. All right, so as I mentioned, we're off to agenda review. First up on the agenda of this evening will be a 5 o'clock dinner after agenda review. The regular meeting this evening, there is really, well, we'll start at 6.30 as normal. We start with the indication of the pleasure of allegiance, the adoption of agenda, citizens time, then proclamations and recognitions, which there are none this evening, and then consenting into items. First up is approval of the minutes, and as usual, I'm sure Mr. Mayor Colbertson has them. All tied up in a nice bow for us. The next up is a resolution to authorize the Warranton Falky Airport to apply for grant funding from the Federal Aviation Administration and Virginia Department of Aviation Grant Programs. Yes, sir. This is a resolution to apply for grant funding from the FAA and DOAB in support of the updated airport layout plan. This is necessary to complete before any build-out of hangar development as a follow-up from last month's work session. The grant total is estimated to cost 378,500 of which we would be responsible for 2% of that or 7,570. And this is sourced within the Airports existing operating budget. A resolution to authorize the execution of a minimum of understanding between Prince William County Department of Fire and Rescue and Falkier County Fire and Rescue System for Training Center use. and so many different services we can have all to support. We, uh, they just want to get a good understanding of the liability between 36 million per year and we have very kind of good. Okay, the service will be to us and for every school, we often think over there for races and models and all types of things. So just, uh, just a liability to make your own demand for the insurance. Approval of this consent agenda item would allow a community development to start initiating work on a text amendment that would allow us larger acreage to be put into a non-common open space by boundary line adjustment when all of the land is placed into non-common open space. I'm not even going to go through this. An application for zoning ordinance text amendment to sections 3-332 and 5-3203 related to approving commercial use uses on properties historically utilize solely for commercial uses. That is a mouthful. Thank you, Mr. Chairman-3 of zoning ordinance. Text amendments can either be initiated by the Planning Commission or Board at any time or by applicants two times per year. This text amendment was developed with the applicant through consultation with staff to address specific challenges related to the use of their property. The applicant's own property located at the intersection of Berk Lane and Route 29, approximately three and a half miles south of the Warranton Service District. The applicant's own property located at the intersection of Burk Lane and Route 29, approximately 3.5 miles south of the warrant in service district. The property is owned R.A. but has historically had commercial uses. As you can see from the aerial, there are two commercial buildings on the property, which in the past have been home to retail plant nursery and greenhouse uses, a farm market and farm equipment sales and rental and service uses. These businesses have been sold in since relocated off site. The applicant has stated that the limited range of commercial uses permitted in the RRI's zoning district has made it difficult to effectively lease the property and its existing improvements to prospective tenants under current zoning ordinance requirements. Specifically, to potential tenants, the fencing contractor and a landscape contractor have been unable to lease the property due to current use restrictions on our eyes on properties. Rather than requesting rezoning of the property or wholesale ordinance change staff recommended this text amendment as the most efficient way to appropriately expand the permitted uses available and allow the applicant to effectively use their property. Section 533203 was originally added to the zoning ordinance in 2012 to expand the list of allowable commercial uses for certain residential and row residential properties that have historically been used for commercial purposes and have an existing commercial building. A special exception is required and the section includes standards that limit eligible properties and uses and provide additional protection to surrounding properties. Under this text amendment these same standards with a few additional restrictions would apply to eligible RA properties. Generally speaking under the zoning ordinance regulations related to RA districts, commercial business or retail uses are generally limited to those associated with agricultural and others uses considered to be compatible with the rural areas of the county. The applicant selected the proposed RA commercial uses from a longer list of uses approved for the residential properties when the ordinance was adopted in 2012. Commercial activities already permitted on RA properties were excluded while uses most similar in nature and therefore compatible to those currently allowed on RA properties were selected. To limit the potential impact of these additional uses as applied to RA zone properties, the applicant proposed additional requirements that eligible RA properties must meet, they must be less than 10 acres, have a maximum 15 percent increase in the square footage of commercial structures compared to 30% permitted on residential properties. And the Board of Supervisors must find that the property due to existing commercial infrastructure is not suitable for agricultural or residential uses. Restricting the size available properties will reduce the scale and impact of any commercial use on an RA property while still providing additional flexibility. A reduced allowable increase in square footage is intended to ensure that the new commercial use will not differ significantly in impact on surrounding properties and roadways from the existing rural commercial use. Some flexibility will be permissible, but the overall goal under the proposed text amendment is intended to be a change of commercial use, not an expansion of commercial use. Staff believes the special acceptance requirement is appropriate and adequate to provide proper oversight of these limited commercial uses, allowing the planning commission and the board, the opportunity to ensure compatibility with the comprehensive plan, receive public input, and require conditions as needed. It should be noted that high level analysis by staff revealed very few, if any additional RA properties that would be meet the proposed eligibility requirements. On July 18th, the Planning Commission held a public hearing on the text amendment. The applicant was the only speaker following the public hearing the Planning Commission voted four to zero with one member absent to recommend adoption of the proposed amendment and happy to answer any questions. Any questions? All right. Thank you very much. And last, this evening on the public hearing list, a resolution to amend the fiscal year 2024 adopted budget. Yes, sir. This is a public hearing to amend the FY24 adopted budget as recommended by our auditor as we prepare year and close out. The public hearing is required as total amendments to the budget exceed the amount set by the court of Virginia. The first is the transfer of the budget stabilization reserve, which is just over 6.4 million, from our capital fund to the general fund in order for the reserve to remain in fund balance where recommended. The second is the transfer of approximately $2 million in county savings back to the general fund based on a larger than necessary employer health transfer in FY 24. And last is a transfer from capital reserves the general fund in the amount of 824,000 to source a previous legal payment differently. I'd be happy to answer any questions. Any questions? All right. Afternoon. So if you haven't seen the Trump storm now depression Debbie is punching up your punch then originally forecasted for us. We're currently looking at a change the the eye of the storm is going further west. It kind of had been slowly leaning west. Now it's a little bit further, which is going to cause us some central problems tonight. Usually, about between six o'clock tonight, it's a shock tomorrow. We're going to probably see the, I guess the front of the storm, mostly overnight hours, late night into early tomorrow, probably three to four inches, which is really not a bad deal for 12-hour period. But that's where the service is thrown this line and it cuts off here, county right, kind of down the middle, and in the northern part potentially seeing up to five to seven inches and potentially seven to nine inches of rain. We get five to seven, you know, six-hour and even more. It's going to cause some serious problems. Right now we're on a flood watch for the northern part of Alquire County. We're on a flood watch for the Rappanac River down to Remington, the entirety of that river. We're looking at potential flash floods, obviously, with the type of rain, the amount of rain that we're going to get, probability one to two inches in an hour, but that's only going to be limited, but there's a chance that we can get far more than that in one-hour period. That's problematic for us. Trees down, power lines down, low-lying areas flooded, roads flooded, that sort of thing. So, really wanted to kind of get this out there. There's 30-mov per hour wind gusts. And there's a two and five chance of tornadoes spawning from this. And part of the reason this has changed is as this is going up north, the conditions have changed. And we're seeing what's happening south of us. And we're kind of trying to predict what may happen here. Nestle oil service kind can give you a low side and a high side and a shoot the middle for what would probably happen. So we are kind of looking at a definite three to four inches of rain, 30-mile per hour wind gusts, potential for tornadoes and the flooding issues. Right now the flood gauge at Brennington is showing that it could hit about 17 feet, which is not really problematic. The low-unglying areas will get flooded. It goes 20 feet, that we have a couple of houses that are affected. Right now it's not predicted for that, but it could get up to about 17 feet. Again, being a tropical storm, tropical depression, that amount of moisture could rise. So really one of the, you know, briefing on that, but also reach out to our public and say if you don't have to drive tonight If it's raining really severely, please don't go out of the house Also prepare for power outages if these trees start pulling because we've been in a drought. We're gonna get a lot of rain We could have trees over toppling power lines and stuff right now. I think when I left the office was about Actually, there was zero power outages earlier this morning morning there's only about 22 so right now we're good but prepare for power outages and please don't travel if you don't have to so any questions we've leaped up all our crews right now we've got two boats so we're staffing through the night and probably through the marm majority of those are like usually cars in the water we do a walkout not too not too crazy but the teams are ready for that and basically I feel like you know up to five inches we're probably good because we're out in a drought right so all the creeks are gonna be able to hold a lot of water before we get to the point where it's it's really making a big impact with past the five inches I just feel like best I can tell that's where it's going to be concerning to us. We've just found out that Moonies has given us a triple A rating and that speaks volumes as to how the finances in this county are handled and what the outside or how the outside feels we manage this county as a whole. So very proud of our staff. They did a fantastic job. It was a pleasure to go up there with them. And yeah, we have two more to go. But I think Fitch is just a basic re-information of our old rating, which should be pretty easy, which was the top rating you'd get. I think it's double-a with Fitch there. It is triple-a. And then the next one we're waiting on is standard and pours. But what this means for the county essentially is, the lowers are borrowing costs. Behind the rain we have is a county amongst all these rating agencies, the lower our borrowing costs. And considering we have about 50 million coming up between Taylor Central Sports Complex and Opal Water, it couldn't have come in a more opportunity time for us since our congratulations to the staff did a fantastic job. I live in this got district First of all, I want to congratulate you on your triple a rating and it looks like rates are going your way So congratulations on that I'm you because I want to speak to about the transfer of $6 million going to the schools if I read the attachments correct related to their insurance fund. That's not correct. It's really not a question and an answer. You're allowed to speak to your... Okay. Well, that's the way I read it. And if that's the case, basically bringing it back to the level that I'm supposed to be. If that is the case, then I urge this board to do an in-depth audit. I don't mean a year and a half and wait to and tie, you know, with the auditor's, the bank statements. I'm talking about doing an RFP because you want to look at everything. You want to look at procedures, processes. You want to do the kind of audits if you had a fraud. A besting class finance department does that every five to 10 years. There's been a lot of turnover in their staff, but I'm really more concerned about the current staff because if I read it correctly and it is the insurance fund that you are replenishing for the contributions that the school makes, then that six million dollars was money because you just moved it from capital. That is that. You could, you could almost look at it as a task. Sorry, I brought you to do an in-depth audit and make sure that everything is going okay. Thank you. Thank you.
