All right. We will start with the apartment heads and fire department. Good afternoon mayor and council. You have my report in front of you and I kind of want to give you guys little cliff notes. We started AVL last month on July 22nd, which is automatic vehicle location through dispatch. And basically it's dispatching the closest fire apparatus to an emergency. So that just means that if windcrest is at Eisenhower and at EagleCrest, we get a call and 167 are closer to the next department around us, they would get toned out. Well, we would also get toned out, but they're gonna automatically tone out 167. They're trying to get the closest apparatus for the emergency. It's in its infancy stage right now. It just basically started on July 22nd and in July we've assisted 167, 17 times and so it's basically a mutual aid agreement that we're having and it's just close to the closest unit. It's just going to benefit the city and they're going to get everyone who's coming into our area are certified EMTs and certified firefighters and the same with us when we're going into the area. So this is not San Antonio though. No it is not San Antonio so basically the surrounding units that are currently under ABL, ourself district 10 district 12 so the three departments closest to us so dispatch is still trying to figure out what type of calls that we really want to dedicate some units if it's just a minor call. They might not tone out the AVL, they might just tone out the actual department to go to that location. But if it's a more serious call, they want to tone out the closest medical personnel to that call. We have finished all our school inspections prior to school starting. Everyone did fairly well. Nothing to a point that we told them they could not open. So that's great. We've worked with San Antonio Fire Department. They've actually started inviting us to training at their station 24, which is off of Austin Highway. They just had a brush truck training. That's a long ago. And since we made a call on Walsum, and we all kind of ended up together, their captain was, why don't you guys train with us? We boarded you guys. We're happy with this training, and I think that's fantastic. The more we can work with Santilla, since we do have bordering boundaries, I think it's going to be great. And the last thing that we're doing also is, we're meeting with ICP every Tuesday. They have a Tuesday meeting with, and they just asked our Fire Mars, Tim Dillenek and myself if possible, to join in on their meetings, just kind of sit back and kind of see what hurdles there might have or what questions that we have to help them out and to expedite the process of doing things correctly in our city. I don't know if you guys have any questions on the monthly report. I got two things. Number one, don a lighter fireman is a faster fireman and when you're running from fire, that's important. So I think we, I just stand up, Robbie. I would, Deputy Chief Robbie has managed to shred 40 pounds and which makes him a much more efficient firefighter which helps the city of Wincrest. What's that? How does that seem for you? Yeah, that's not good. Anyway, good job, Robbie. Yeah, that's great. Absolutely. So I do have a question about 9-11 because that's coming up in just three weeks. Is there anything? We have another meeting with them. Rob wants our next meeting with them. It's coming up pretty soon. This Thursday. Actually this Thursday We're having another meeting We had to change up the route because we didn't want people running on Eagle Crest because it came kind of With the traffic and not being able to shut that lane off for the safety. The coordinator did send up another different route which is inside of Wing Crest and I think that we all kind of agreed on that one better, more safely for the people. But then that I think I but it's cheaper if you do it now. We have prizes. I think there's five or six different awards that we can give out to people. Age ranges. Yeah, age ranges and stuff like that. I think it's going to be a pretty decent event. We've been trying to post it all on social media and on the on the on the marquee as well. I want to win or sir Fire alliance Good evening my name is Will Bowman. I am the acting president of the Wincraft Volunteer Fire Alliance. I have sent our report, as you can see on the screen, just to quickly summarize, we well as tax reporting, budgeting, legal services and helping us with nonprofit status things as it stands with the state of Texas and the IRS. In the meantime, based on feedback from the mayor and certain council members that we have met with, we had temporarily paused payments or the purchase of large items such as the requested bunker gear, just waiting on us to solidify our budget so that we're making sure that we're being fiduciarily conscious of the money entrusted to us by the citizens of the city and the surrounding area, we will be putting our bylaws in front of the body on September 4th, hopefully. Fingers crossed as we're working a few last minute things out with the city and the department regarding that and hopefully as well a budget that will allocate all of our funds over the next few years as we have some large purchases coming up. Sorry, I'm reading this from that. So we have also engaged in discussions and meetings with the city on light up. I think our next meeting is on the 23rd, if I'm not mistaken. So we were working with the city on that, and I'd like to reach out to EDC to help support fundraising and sponsorship ideas with that. As I mentioned, I am the acting president, Jose Riness is not yet stepped down, but is preparing to step down due to conflicts with the schedule. And Jason Benson, who wished he could be here tonight, but work hasn't flying out this evening. He is stepping up to acting treasurer. And then we did spend $1,472 in certifications and trainings in July for members of the Alliance, or department members of the Fire Department. There is our budget versus actuals. Again, our CPA has now gotten access to our quick books. So I'm hoping that our reporting will be a lot more streamlined and a lot more visually friendly and less confusing. I understand that reports looking like this have come under eye or just because there's minus's you know minus signs where they really shouldn't be which it's based on our net operating revenue versus what we have in the bank so we are shifting our budgeting to what we have now versus what we anticipate having because we do want to to spend the money that donated by the members of the city and you questions of me? I just have one you said that you guys are gonna hold off buying the bunker gear. We have, but we anticipate signing off on that. No, my question is, is that mean we're not getting any new bunker gear or you're getting what your department ordered and we're just waiting for the backup with him? You know what, we've had already purchased nine. I've already just gone by to give our department suffice. I'm doing 9999, but if they assist us and I won't have to go as far as so many more years. So we do have nine bunkers here coming. All right, Jonathan. This is not going to affect the safety that you're not going to step coming. No, no, no, no, just expedite the ability to give people the two sets that we're supposed to get. But currently everybody has current gear. And we have been purchasing equipment requested by the city for immediate need such as batteries for the trucks. No, I understand that. I would like to invite the City Council members and the mayor to our next Alliance meeting on September 4th. Our CPA will be there to present what they're going to be doing for us. So, so, so, so, for somebody that's listening and not understanding how, you know, the, the, the, the association works and how they're kind of in tandem with our fire department. You know, the fire department is fully funded, fully equipped by the city of Windcrest and how we appropriate tax dollars and things of that nature. What the volunteer association does is, I don't want to say gift, but use their activities and resources to enhance maybe. That's the term that we want to get to. But if the Volunteer Association was removed from that and sent to another planet, the City of Wincrash Fire Department will still be fully capable to operate and fully equipped and with trained personnel to do what they do And that is fight fires and save lives Okay, all right, you know, I just wanted to make sure that we we made that one clear. Police. Mayor, council. I'm going to have my packet of tea. One extra thing on there that it came out when we were getting hit with burger of the vehicles on the I-35 corridor. So we started a program called TLC, which is either take the item or leave with the item or conceal the item in the car. So the program we started were going to be putting out cards. We're printing those this week and then we're going to distribute those to the businesses up and down that 35 quarter or mainly to the two our two hotels there because we get people leave their stuff in there. So hopefully that'll be a reminder and encourage people to load the items for the car and see them and hopefully we'll reduce that. We have some of the patrols have intersected some of those people when they take off running In a car we don't So any questions was more within the residential area was that group doing that for the fence. You're crying out on the fence? Yeah, on the map it's up. I'll see the dots are a little bit more creep me, but I'll check on that. I mean the majority are again against along the business routes, walls, I'm in 35, but there seem to be a few more than normal within residential areas. I don't know. We have some issues over there. We are done, some stuff, and I want to discuss what we're doing over there, but we have some operations in a couple of places. I just scrolled up to the calls. I just wanted to ask on a proactive police activity, and we had a bit of a drop from June to July. But it seems like it's more in line with April and May is that kind of was June just a heavier than expected month or That's what it looks like to me You know, following on that I'm like in January we had even more 34 15 but That's supposed to be the proactive is when the officers initiate something. So depending on our call load sometimes, that fluctuates. Is it safe to say, when you say call load, is it safe to say that the officer is doing something proactive when they're not doing something else. I mean, as far as if you're out doing a report because there's a theft or whatever, then they're not doing proactive, right? I mean, proactive would be, you're not doing a report, you're out doing, I mean, is that what a proactive? It would be where the officer, this is where an officer makes up a case for something that he's come across. Okay, proactively. As opposed to being called to the beginning call. I guess so. So there's still to combine we're dealing with, you know what? I'm asking about 6000 calls on the off-road. I mean between the officer and then between his pro-active and the on-call school. Of course, I think these are supposed to be the number of cases that we're seeing there. So that's including everything as far as, you know, there's other statistics on here kind of breakdown from those two categories, which is like when they do a crime, prevention, no this or those kind of things. So by the combinations, I know. I had a couple things that came up on in the Wincrust in the website. It's been a year over a year since you guys have published any monthly reports. Is that just not done anymore or what? No, that was something that kind of fell through when we did a reorganization and putting people in different places. But it was brought to my attention and it has been updated today. They did that and that'll be something that will be a regular You know in currents that won't get back on Okay, then I also notice that the less I guess maybe it's the same problem, but the last Report of the weekly calls for service was the first right in the beginning of June that's the same thing same Yes, correct That's the same thing. So I'm, so I'm issued. Yes. Corrected. The other day, it was supposed to be updated today. I have no MAC check, but I was told to me that it's been updated today. Thank you. Can you also look under a criminal investigation report, the active fugitives with 28 in July, which year to date, we only have 32 32 so that just seemed like a huge time. And the other was evidence submitted to the crime lab. June had 125, where previously the highest was 48. Not be a backlog there. I can check on those numbers, but again, but... I didn't know there was a warrant roundup or something that maybe... The active fugitive, what that means is that they have walked the warrant, and we have not arrested the person yet. They're still outstanding. So that's how many warrants or warrants that came out. And then that's just a status. So cases may be followed and maybe you should have wore for it, but we have not located in the rest of the group. Yeah, I didn't notice it before I tell you. Cindy just spoke with an underacted fugitive. You have 0, 4, 0, 0, 0, 0, 28. We have 28 fugitives from crimes. Yeah, but that can be, I mean, that would be where a detective goes and gets a warrant. And I'm going to check on that because the number is, because we should be, we walk warrant all the time. But they may be making a rest on them. These are where they've walked a warrant or we have a warrant for somebody, but we haven't found them to make an arrest. So, look, for the four months prior, there was none of no warrant. But by the time we ran this report, I'll go back and check. But by the time we ran this report, it is possible that they had them all arrested. But they should still show as they were an active fugitive. They would clear, as soon as they get arrested, it would change the status from active. But how do you record then the ones that you've arrested on these active fugitive ones? I mean, you're taking it, if you don't record who you arrested or how many you arrested, then that distracts from your efficiency. If you don't record who you arrested or how many you arrested, then that distracts from your efficiency. It would get counted somewhere else. How it would get counted as an active arrest case at that time. It would move from that active fugitive status to an active arrest case. My report's in front of you. Did you have any questions? So we are doing a warrant roundup in September. We're going to try for two warrant roundups the first week of September and the second week. I know that officer hate that the worn officer it has a meeting with PV with Lieutenant Ellis to coordinate that. So I should have those numbers in December or early October. You said the first and second week? Probably the first and second week. Probably the first and second. Now since we have that, a collection agency, they sent out postcards. So I have emailed them and told them to send out the postcard for the whole month. So that way we can try to get as much as we can prepared in the war. Let me ask you what do you mean now that we have a collection date and see? Well, we have always had them. But usually they send out postcards when it's the statewide warrants roundup. They'll send out postcards saying warrants amnesty program. But if we do warrant roundups like we were last, when we used to do every month, they would send out postcards specifically for that month or that period of time. It's nice to be here before you give me this first public works department in report. So I don't want to take credit for these actions. These actions were taken before. I showed up and I do want you to know that the team works really, really hard. And I definitely don't want to sit here and take credit for these things that they did. They had a really busy month in July. Most of their man hours were spent dedicated to mowing and trimming and edging the parks and green spaces because we paused the contract with clean scapes. We were gonna renew it this month, but it looks like we'll be able to continue holding that off for a little bit longer without the rain. The guys can manage it pretty well. It kinda got out of hand when we had those back to back rains and it got a little long. We did get a few complaints, but we addressed them as they came up. There was some debris and things, dead tree, things like that. In the take us park ditch, we got those out of there. There were some irrigation issues that occurred a couple times here at City Hall. One of them was just an accident related to getting that fence in. But we had our guys fix those. They just capped them for now. We haven't put new sprinklers on them. We're going to come back and do a round where we just get new sprinklers on all the ones that are currently damaged. I think there's a third one came up this past week. So I think there's three of those that are damaged right now. We repaired a blackflow, one of our backflow preventers installed some concrete pads for the shelters, along with rock for the bus stops and we installed the shelters on those. There was some roads I trash pick up that they did. There was some trash clean out at the parks and some mine repairs to the dog park water fountains. That's a regular current some of the folks go out there. They're a little rough with them so we get some leaks out there in order to keep it from getting too muddy. They try to get on those as quick as they can. Our facility maintenance tech had some repairs here at City Hall and on a drain at the Civic Center. Currently animal control is out for part of the month of July and going into August so we're assisting them right now. We're cleaning out the dog stations twice a week. And we've had two dead animal pickups in July and a couple already this month in August. We had a fallen tree in the roadway in August, and then a fallen tree in the roadway immediately. I mean, in July and then another fallen tree in the roadway already this month in August as well. We repaired a water leak on Windway Island. That happens every once and a while. We'll see what we can do about that. It seems to come back every few months, so we'll see what we can do about that. Street Trooper was out most of the month of July. The last three days of July was operating, and it did operate all three of those days, which was Friday, Saturday, and Sunday. He did come in on the weekend, and he has been really active since then. I don't have the list for the streets he did that day from my understanding. He just went for all, you know, as far as he could go all three days to get as much as he could in the city. But it was back in service. We hadn't had any issues with it since then. then so he's out there five days a week, sometimes six if we get an issue. Our future projects will be talking about on the next one and some of the things that we're getting ready to do this month which we've already started which we have some windy hollow stormdream improvements which might also need to get pushed to September potentially after light up. Try to get to it before the rainy season. We're going to put some more rocks and clean out the intake that goes in. We're going to do some alley repairs. Those already actually started this month. We already got to two alleys. We're going to list. So we're working our way down. Some of them can be just base repairs, but some of them do need asphalt. And so we're just trying to group them all together to get them all done and respond as residents to play in some people who are a little okay with waiting because there's not so bad. Some people is really bad. And it's just great in the bottom of the car. So we're just trying to address them and prioritize them. We're going to try to get a weed garden into the butterfly. I mean, a weed barrier into the butterfly garden, because the garden club has talked to us about having a lot of trouble keeping all the weeds out of there. And we're going to have a lot of trouble assisting them keeping all the weeds out of there. So we're just going to try to get in there, scrape everything out and put a weed barrier down. We did already do this one of the future projects that we already took care of this month. That will be on our next report. We installed some trash cans along those same bus stops and windrock. We started painting the crosswalks and we're going to do some light-up prep this month. There is a second page, a new part of the report. This isn't, for the month of July, as we'll start seeing more of this filled out in the month of August and moving forward. But I have a four-way Venn diagram here that is sort of what I'm going to consider our prime directives here in the Public Works Department. If I come to the City Council with an action that we have taken or an action I would like to take and have one to permission for or some expense something along those lines. I'm going to show you how that falls under one of our four prime directors here or some combination thereof and if it doesn't I'm going to I'm going to show you how it supports our mission statement. I don't believe we had a mission statement before, so I came up with that one. I'm not married to that, so if anyone has any suggestions on, you know, any improvements I'd be happy to hear them, but this will be something you'll be seeing in the future just to sort of justify the actions that we're taking and sort of explain why we're doing what we're doing. And that being said, I will be changing this report a little bit more in the future. So if there's anything that you guys would like to see, just let me know when I'll start to include it on the report. So, do you have any questions? So Dusty, you mentioned repairing the alleys. What's other than the heavy trash trucks going through there, what would you suggest is the cause of the damage? It's us two residents. A lot of residents do use their alleys. Personally, my garage is on the alleyside. I drive through there four or five times a day. We have some hot holes in our alleys too. It's the rain too. Without really doing something with Leonard and getting an engineer out and re-grading them, it's just gonna be an issue that we're gonna have because of the nature of our alleys and what they're made up of. We just, what I would say is, drive slow, be careful, because driving fast, it tears them out quicker. But it's all of us. It's not just the trash trucks, it's all utility trucks too, but it's also just the residential use of the alleyway. Definitely. Thanks. Just to do you. So sometimes someone will come say, hey, there's something broken at the dog park or whatever. Do you have a regular schedule where you ask someone to go by and say check the gates or check the water fountain or for that matter like the the exercise park Where you would have and I don't know you do or don't but Sort of a check once a week or whatever Yes, yes, sir. We have a guy his name is Troy. He goes around. He's our park sky and he goes around one of his daily duties in addition. You'll see him out here at the at the school putting out the cones and assisting with the crossing guards. He goes to the parks every day. If he sees something he immediately notes it but he only goes once a day. In the mornings usually before the heat gets pretty bad. He'll go hill and deal the trash cans from the day before. He'll take a look at everything. And he'll come back to us, tell us our facility technician the most of the time about something that's broken, that needs to be fixed, and then we'll get on it. But because he only goes once a day, sometimes, we don't find out about it until the next day, or until the resident. And let's us snow about that. Great. Okay. Perfect. Thank you, sir. John Bestie. Mr. Manning said, I love you here in Dina. I think that passed me a note. Oh. I knew it. All right. EDC. Mayor City Council members, staff and and congress presidents, Mario Hernandez or EDC. Our president aboard is out of town on her duty. I'm in Petitio, for current. Let me start. I'll touch on a few highlights. You have to report from us. I start with the Wincrafts International Business Park. ICP, I think local heads of construction, but also the primary construction person from headquarters. The purpose of was to make sure that we're maximizing the sales tax during the construction period. There's not a question about whether doing something wrong is just we want to make sure that they have everything they need and the information and they've needed assistance from HDL in that process so that they're giving full consideration whether it's whether it's a lump sum contract or whether they have separate contracts that they'll be using during construction all things all those things come into play so I thought it was a very good productive meeting They also Reaffirm the Nadine West project they have given us a name to for that as the Canadian West project they have given us a name to. For that, as their possible first permit, the Canadian West, if I can remember, Remind you, it's an Internet clothing company that would move headquarters and most of its operations. Here have about 250 people. And we cleared a good hurdle because we had the draft lease come back and then the company has responded. So it's still on track and that's always good to get past that first hump. There are two others that were working with between 50 and 60,000. And 18 West is 85,000 square feet. The other two are between 50 and 60,000. One is primarily on office use, which would be kind of labor-intensive and be a nice addition if we can be successful on that one. And the other has some warehouse and some distribution as well. The renovations, it was a timely meeting on construction because of renovations are pushing forward now on the Montgomery building. You may have seen the pictures that the owner sent to us that were the second floors being taken down in Montgomery Wardens shows a lot of progress there. Let me touch on a few things related to lead generation. We were able to have 12 new lead projects, projects identified for analysis this past month. Follow up contact was made and the process continues as needed. Leads have been developed from local brokers to Governor's Office of Economic Development and Tourism. Greater SATX, and in this particular month, we generate two leads from national restaurant and use, that two leads that we were able to get from our following of publications and different sources of what we may be able to identify growth businesses. The BRE effort was very active. Ten meetings, visits were made with local companies. By the staff, technical systems was provided to a number of them. I'll mention a couple. Buffalo Wild Wings, no fault to anybody local, but they were out of business for a few days because of their conditioning problems. And they wanted us to help with some social media campaigns, try to get some of their customers back. And we did that. The other one I'll mention is a shipotle because they're wanted to get their name on the highway sign that the exit sign where it says business is coming up. Next exit. And so we put them in contact with TechStyle. I'll also mention while I'm talking about shipotle, that their sales are a little under where they had projected. From my discussions with them, it sounds like obese and we're around 2.2 million for the first year below where they had projected, but still a significant contributor to the sales tax. On the real estate side, you've heard about cons and their shift of all their stores onto the bankruptcy list where Wincress we had initially not been included in that list now all stores are included So we've talked to the headquarters about this and they're Gonna take the next month or two for really selling out the store We've met with the owners of the property discussed possible prospect tenant recruitment procedures with them and also the possibility of if they were considered selling the facility. It's not something we're pushing. We're just asking if, you know, what they feel like the best use of the property is. And we do have two possible owners of the cons building that have shown interest in buying it in the past. So we'll stay on top of that as that progress is through the closing of cons. The other one, the builders mark, I mentioned that one because we did get with the owner and does have a national restaurant chain that is looking at it and we're not talking directly to the restaurant chain as well. His preference is to lease the property to someone else not sell it. So it will work with him not only on that lead but also on generating other possible tenants. Finally on properties real estate that all of mentioned is Lubies, the owner of the property. This month went to headquarters of Pizzo Ranch. That's the franchise that he's looking at. And we can use it in hand because he's given the commission to do that. He went there to work with them on the cost and the structure of the deal. And by all accounts, it has gone well. And so that's that's progressing. And hopefully we'll get into the final stages of that in the next couple of months. You have a list of some new businesses that have moved in primarily to the four wins. Complex, the FICA PECs is equipment and equipment, furniture and vehicle leasing operation. It's a Mexican base, but there's open an office here. Center G home care, just what it says, home care services and fidelity benefits, of course, you know what that is. I want to mention that our work with some of the Nutanets at the East Group location at the Eisenhower Point. And talking to DNR signs, they're projecting that most of their sales will be directly to retail customers. And so that's good news for all of us. They're projected first year sales that are at $1.2 million. And so it looks like they're going to be a fair, significant sales tax generator from that new location that they have in building 7 to 312 at the IceHour point. And then finally, under other business, we listed our work with best practices and retail development. The training that the staff has gone under that I think will help us a lot in helping, in, excuse me, in identifying additional retail leads. And then finally, at the end of the report, I put a note because we did restructure our report. The report now includes more information about lead generation, specifically where we're going to try to learn, generate leads where I go to, generate leads where I go to cold calls kinds of things. And also at the end of each subject paragraph, we'll put a lead person for that particular subject. Turning that work on almost everything together. But if I am the lead on the retail strategy development, then at the end of the program, I would have lead and they'll have my initials better to indicate to counsel who the lead person is on any particular subject, both staff and a lot of times the president of the board and others will know about the particular subject. And we know that city staff, for example, works on a lot of these things. And there's a lot of people that involve it. I thought we thought that it might be helpful to state that their lead person on staff is me or Karen. Any update on Take Five over there by Taco Cabana? Yeah, they're going to go to another site that's going to be in Winchrist, but it's going to be where the pizza hut is. I have a call into the representative right now. We just found this out in fact. Rachel's the one that let me know that they had started a process for permitting, I think, Mr. Manager on that side, which was a surprise to us. You know, we really thought they were focused. We knew they were still looking at other sites, including sites outside of Wincress, which is we thought they were going to be in the shell, station site, the service stand in Wincress. I'll know more about that when I talk to the company and the representatives of the property. So that's where we are right now. I do have a call in to do West and the Wzum Street. Excuse me, Walzum Partners III, a little C, that owns the Shell Station. It's like to see what the next steps are. And there's other leads there, other leads were working with them on. But nothing in was as solid as tape 5. So we just have to see where else we can focus our attention to generate another tenant for that site. Okay, thank you. I mentioned that Chipotle sales worked down or below projections. Did we have a projected number? We were at 2.2. Do you remember off the top of your head? Yes, it was over 3 million. There was a Halloween party last year in the parking lot during election. I would say that you shouldn't have anything there. Just the election to keep it safe, like you want it to be. I don't recall anything having been written up for the last 15 years of a pedestrian or traffic accident during the time of the voting in that particular area. If there is, the police should be a police report. I don't think there was, or is. The other thing was that there would be altercations and intimidations done to any of the voters. They have not been to the voters. Altercations are intimidations. We're not talking about council people and their volunteers. We're talking about the voters that are not involved with any of the candidates. On the contrary, many of the voters have approached us to thank us for being there at the last minute to answer any of the questions may have about a candidate when we were in that area in the past. I have looked at the designated areas that are supposed to be approved for the electioneering, and I have a copy, and I believe you have a copy of that, too. I have one in color. No one responded to my request. No one used his computer or city phone to address the concerns I raised due to having some defamatory comments made about myself and others. The update on my two complaints, the documents went to Debt Navarro and hope each other names law firm for ethical review. Got an email stating a notice had been sent to the city about my complaints, never heard anything from the city, did an open records request and the contract or agreement for the hiring of the city attorney. All I have gotten are two letters from Ryan Henry's office from 2020 and 2020. I have made a couple of open records request for the contract or agreement for the hiring of the city attorney. I know our charter is clear on the duties of the city attorney, but there should be a document that states both parties agree to it. Both parties should have copies of that signed agreement. So do you know, does your city attorney have a written agreement or contract with the city? Doing some of my own research on October 1, 2018, he was voted in with the provisions that the city manager would work out the details. Here is the motion. I make a motion to hire attorney Ryan Henry as our new city attorney with an employment day of October 2018. With a monthly compensation not to exceed $2,800 and have our city manager work out the arrangements. Does the city have a copy of those arrangements in writing? Then I want to talk about 11V. Then let's talk about how you want to amend the personnel manual this evening suggested by the city manager. I would imagine that since you're trying to update the personnel manual that all of you have received a copy, a complete copy of this document, you realize that it's not been updated since 2015. Nine years. I also would like to point out that it's interesting that for a taxpayer to see this document, they must make an open records request. There is no confidential information in this manual, so I'm not sure why the people who should know the procedures used for the employees or the standards the employees are to operate under should not have access to the manual on the website. Now we have the city manager suggestion you give him even more of your authority as a council member by restricting the department heads and employees from providing you with their cell numbers. Let me give you just a couple of instances that have occurred over the years. The city had a mayor and a council sue the taxpayers because a group of concerned citizens had stopped there moving forward on a town hall center. Next to Home Depot which would have also included a new city hall. This group of taxpayers were asking the council bring this idea of a new city hall to the voters for their consideration. This mayor and council then sued each taxpayer in the city of Wincraft so they could move forward with the city council's plan. The case was heard in Austin and thank goodness the judge sided with the City Council's plan. The case was heard in Austin and thank goodness the judge sided with the taxpayers. Just imagine suing your own taxpayers. Then I'm sure you heard about how over $2 million were stolen from a city account that held $5 million provided by RAC space and it had been placed there for infrastructure at the Old Windsor Park Mall. But because the council had allowed the city manager and city mayor to oversee the use of these millions, funds were electronically transferred from a city account to an account of the developer. The city never got those funds back. Rackspace, fortunately, never pressed for reimbursement. The streets we have over at Rack Space are all the city was able to provide with those reduced monies. These are just a couple of instances in Winpress history where when a council decides they know best or they are uneasensual to the business of the city, bad things can happen. I know the city manager and city attorney have been busy trying to convince you that you're just a legislative body. Unfortunately, this first started when the city attorney was allowed to amend our charter. That is when we lost a small town way of doing business and became more like San Antonio. If you read the charter, particularly the section that is mentioned in this resolution, the word that is restricting you is orders. As long as you don't tell your employee what you want them to do, you can talk to them, ask them questions, interact with them. Your voters expect you to be involved with city business. In a good business, you would be able to reach out to any employee to have conversations about their job, how any of their projects are going. Do they have everything they need to get the job done, and what can the people expect? You are our representatives. All of these people work for us. And we have asked you to keep informed, be involved, and make good decisions. The City Manager is a contracted employee who is there to make sure that your wishes, which should be our wishes, are being met. He is not there to tell you what you can and cannot do. The council is responsible for the hiring and firing of the department heads. Oh, but way you can't talk to them unless the City Manager consents. The City Manager is only here to do the day-to-day business of the City not to tell you who you can talk to. So then I have to also ask why now does he want to impose this restriction on you? Is someone finding out information he does not want you to know about? How are you going to protect that whistleblower? Sounds really suspicious to me. Please vote no to this resolution and don't give up your responsibility as an elected official to someone who is hired by you. Just doesn't make good sense. City management department budget completed 94.83%, then again this is due to 700,000 that were paid during the termination, termination of Rex Space Agreement and the capital department budget completed 92.1%. And this number actually went quite down after the budget amendment was done. And we're almost at the end of purchasing capital items for that department. If you don't have any questions, I would recommend to approve an audited finance report for July 2024. I have one question. Yes, ma'am. The asset seizure, the federal and the asset seizure state, you show you have a current cash balance in both of those. Do they ever roll around into the general fund? The Texas Election Code 61003-85.036 dictates electioneering by candidates must occur outside of the 100 foot marker. the election and election and election and election and election and election and election and election and election and election and election and election and building being used as a polling place may not prohibit electioneering outside of the 100 foot marker. However, the entity may enact reasonable regulations in regards to time, place, and manner of electioneering. Texas election code 6103a1. Only a court of law can determine what is reasonable in terms of time, place, and manner. However, an example of a reasonable regulation may include prohibiting, electioneering on sidewalks or driveways to keep them clear of protestions and traffic. Finally, we recommend that all regulations be content neutral. If you have questions, we suggest that you contact your attorney. That's the unquilt part. No, do you not understand the meaning of contact neutral? I suggest you look it up. This advisory from the State of Texas Secretary State indicates that your proposed ordinance is invalid. Your reasonable time, place, in manner is not contract neutral. If you are not authorized to take this make this decision only a judge can. I again urge you to abandon this course of action because it's against the law and all citizens first amendment rights. And I'm going to last note I'll see you all in the parking lot. Lissy Herbs. Good evening, ladies and gentlemen. I'm the council, City Council. Councilman. I wanted to address the amended election hearing ordinance and give you 49 reasons why it's a bad idea. My it's going to be regrettable. First of all, it's going to be a lightning rod for litigation and lawsuits. And it's going to be a lightning rod for an expensive law firm to come in here and sue the city. To represent the residents of this city. The way it's going to go down, there's going to be a law firm coming in here to sue. It's going to be, there's going to be two lead attorneys charging $500 an hour. Other attorneys, ancillary attorneys, charging $300 an hour, looking at probably maybe $1,00 to $2,000 an hour for legal fees. Much so that you can have the residents that you represent. And the argument is it's going to be that the ordinance as amended in fringes upon first amendment rights, free speech and assembly. And then the law is applied, it's going to be strict scrutiny. And strict scrutiny means that the city has to burn and prove not the plaintiffs. You've got to burn and prove to show that this is a compelling state interest to keep people out of, keep the vote, the candidates out of the parking lot. You have to show that it's a compelling interest and you have to show that you're way of, way of monitoring this was reasonable and the most less intrusive way of doing it. It's called strict scrutiny. And what's going to happen is going to be something called discovery. Discovery is half the day of it. It's going to be discovery discovery is going to be after David's depositions, requests for production, requests for admissions. And they're going to start asking all kinds of questions that you really don't want to answer. And then they're going to be discovery fights and court. One of the issues that's going to come up in the law soon is if there are issues of safety and hazards to pedestrians in the parking lot, why did we have to wait? Why did the city wait five years to more to implement our address it? and if there is problems with the hazards to pedestrians, cities, you're going to have to come up with documentation. If there's no documentation, it never happened. And documentation has to be contemporaneous with the alleged event. So you can have a problem with documentation. You can have a problem with showing that you have a compelling interest. You have a problem showing that you addressed the issue with the least intrusion to the fundamental rights of the candidates. You can have a problem. And it's going to mount, and it's going to be be very expensive and you're going to have to explain to the residents of this city why you didn't anticipate what I'm telling you right now. And possibly on the next council meeting, we can put a line item and say the committee from the council is going to be three council members and one from Parks and Rec. But however you decide, and we even have the little slide where you can include citizens in there. The one we did for the pool, we could say we're going to have one citizen to be part of this committee, plus for the selection of the, for the selection of the RFQ. City Council, have you discussed a May act on development of city and implement plan regarding infrastructure improvements? Yeah, so, did you get that? Yeah, so Mayor and Council, what I did, Mayor talked about, been about four or five months ago, and we were looking at, do we have a clicker? And I can pull up that slide for you. And so, the Mayor had talked about, you know, so what is the, what is our city looking like right now, you know? So I got with some folks and you know it was kind of named, well this is a branding thing. No, we really wasn't doing branding that in fact we was kind of leaving that to the EDC. We just wanted to get a quick snapshot of what the city was looking like, developing us a problem statement, and then just have a conversation with council. So obviously this is where we at. What the city looks like, we got 2.15 square miles. So what we did was we were looking at all of the thoroughfares through our city, the major thoroughfares. We were looking at crash waves, eagled crash, and obviously, Walsum Road. Walsum Road, we did have a textile, and we all aware that textile is going to resurface a wasm roll wasm roll as we know is our business district. How are we going to get competitive is is that we got to do and council members to select it had mentioned it before in fact she issued some she gave some books out to some council members about painting the house. If we want our city to be competitive enough to attract businesses and things of that nature, we're gonna have to paint the house. Here's our problem statement. You can take a moment and read that. But the bottom line, what we wanted to kind of illustrate, not only to our council members here, but to the general public, is that we haven't done any major infrastructure of repairs, bills, or anything like that in the past 30 or 40 years. Didn't we resurface under the bond? No, no, no. I'm not talking about roads and grounds, what I'm talking about here, and we'll get to it in a minute here. I just wanted that problem statement to count the sink in. We've been doing extremely well with roads and grounds and things of this nature. So what I did went through and we started looking at some of our problems across the city. So, getting to roads and grounds. So, roads and grounds are pretty good. However, what we have is we got puzzling problems in several spots throughout the city. This is actually after a rain, and this is three days after the rain occurred. Various locations across the city, probably. And we all know what that does in the summertime with mosquitoes and so on. And what we need to do is one of the suggestions was to develop some type of good drainage plan so that we don't experience these type of hazards in the city. Can I ask a question? Yes, ma'am. Mr. Young was here last meeting and he said we had some failures from the with these. Some of these will be addressed but if you all recall our our drainage system is above ground. Okay and when we move we call these a.k.a. bird baths. What we do is when we come back, we'll resurface this or repair this. When an hour we're gonna do is shift it, two or three streets or two or three houses downward. And it's just based on the topography of what we have. Okay, so it's, you know. You've been taking into consideration when they redid those streets? Yes, but remember, what we are doing is just resurfacing and reclaim them. That's what we're doing. We've only have totally reconstructed. I'm going to say maybe three streets, which one of them was Sun Haven and then the one next to it. I can't think of the name right top of of my head, that we totally reconstructed. Is it fair? Fair press. Next, next, so I'm gonna say North. Not anyway, not South Carolina. But we've had, Mr. Young has had these discussions that all we do is move the water from one area to the other. And again, this is just a snapshot of some of the things that we need to kind of think through, you know, engineering and so on. It's not a hit on, you know, any particular, you know, council, cast a present or a future. This is just one of the things that's plaguing the city that we need to think through and solve. It's a problem. We need to solve it. Going around the city and we're looking at a lot of, we all know we got a lot of those wooden dilapidated fences that's going down. The problem said is that these are along our major thoroughfares. And so driving into the city, you know, it's not that vibrant, aesthetic look that we tout and we want for the city. And so this is why we looking at a proposal to get something done about, you know, areas like that. And we've all seen them. Now, the bottom two is a safety concern because what we have is if we have these overgrown trees that have overgrown into the power lines. Now, we had that freeze a couple of years back, and that calls power outages and things like that because the trees essentially Way down the power lines now One one of the suggestions that came up was that we can partner with Our energy companies and they can come in and cut the trees on the front side of it to free the Power lines and then on the front side of it to free the power lines. And then on the backside, that's something that we would probably look at investing in doing that for the city along our major thoroughfares. Guys, a couple of questions on this because I've had a neighbor since moving into retirement home. And the fences was a big thing for him. And the response that he always got was, these are private fences. How do we as a city do this without interfering with their private property? And we talk about the trees as well. So I mean, City East, yes. City East, is city East, miss what's the response that I got? And if we get down to it and I can give that that's what's wondering because some of them are close but yeah some of them are walls are so far back the same with the trees were sure yeah the trees are a problem I when we moved into our house you know there was a line laying on one of our lines and the only advice the previous home one guess is that was the city winchress tree you make them cut it not you so but for many of these they're front yard there they're true there's an electrical storm something happened the tree catch and don't fire and a house catch and don't fire then is our fault yeah I just comment I thought I just read something worse um CPS had kicked up the trimming of trees that they were doing in San Antonio to reduce the potential of what happened in Houston with the last hurricane that came through. And I know on the block next to mine, they've come through a couple of times recently and recut because it's only the top line that CPS those lower lines aren't electrical. And they don't cut they chop. And they won't. Well yeah. And what we wanted to do, we just want to make sure that we mitigate any possible hazards as we go along and look along the major throwfares and then inside of the city. Again, this is just snapshots of some of the things that we have control over and we should be able to get at. Okay? But just to be clear, we're not cutting around any power line. No, no, no, we're not. But we can, we can, we can, we can. We've asked before. We can, we can, we can, we can request it. I'm like, we have a conversation with that young man. No, it's not because of him. Yeah, that time to cut a tree down. Yeah. I'm just saying there. saying they're. But those are just some of the things that we get partnered with and get at and see. The CPS. So on the side walk tripping hazards and things like that throughout the city. We have obviously you know we have an agent community, and the wheelchairs, walkers, canes, things of this nature. We just got to get at, and do a good assessment on sidewalks and things of that nature. We're doing a really good job at repairing sidewalks and things like that, but I know that to sit, we can't, we don't see everything. And we need to help from the residents to help us identify some of these hazards so that we can, you know, apply a solution to So this is this is Walsum Road and this is what we were looking at the medians in Walsum Road and so I think about a week or so maybe a couple of weeks ago we had the send in I had that conversation about clearing out Walsum Road clearing out those medians out there and because they're just collecting trash some of our transient population you know that bottom picture there that's a tree in the medium and somebody set a emptying soda cup in there could it walk across the tree trash or just throw it on the floor but this is kind of stuff that we're dealing with. This was something, I don't remember our conversation, but that I went to EDC a couple of years ago about the end because this is the entrance right up to 35 at all. Awesome. And there's other less that would cause less work to try to keep them clean. Totally zero escaping. Yeah. One example, if people haven't seen it, is on Kitty Hawk in front of, um, like you. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. Yeah. So, Dusty was telling us that, you know, this is, this here is a wrap, but just look at some of the, um, the vitors that, that ran over, you know, uh, missing and so on. This is the type of stuff that, you know, we can, we can actually, uh, apply a solution to, Dusty has already talked to it. They are all over it. So, but again, driving into the city, looking at moving in and around. When I see cars driving in the city of Wincrest, I don't see the vehicle. I see commerce. I see people buying tires, getting their oil chains, having lunch, getting their car repaired buying clothes buying shoes That's how I look at it. So If I want more that if we want more that we got to paint the house We got to make sure that the business has the aesthetics that's pleasing enough for me to come in and spend my money. So how can we look? Imagine that second photo there, down by the pond area, all over Montgomery going into the entrance of Wincress, cleaned up over our chain gateway to the city of lights. Our business parks and things like that, don't necessarily have to have those type of markets, those pillars there, but something similar. Designating, laying it out when folks know that they're in wind press, just like when you go to lock and tear or something like that, you know what you are. Same thing could apply here. Adam, this is what we were talking about as far as offenses. If you look at these stone fences, these stone fences last 50 years. You don't have to paint them. Unless somebody running into them, you don't have to repair. It put up really well. Imagine having those fence lines up along the city easements, not bothered, a private property set it on city easements. In front of those fences, all we around our major thoroughfares, Cretçway, Ego Cretç, Walzum Road, in those areas where we can put offense like that up. These are things that we can actually undertake and do capital improvements. Walzum Road. Imagine Walzum Road, and this is what Cindy was getting at. Looking at the zero escapes on Walzum Road. Bricket tile it up, brick it up, put some nice planners in there. On the lights have us some banners up there for every season, especially doing light up. These are things that's achievable. So the intent was to take a look at this here, have the conversation, and then from that conversation, develop what we refer to as an IPL. A basically it's an installation, plan installation priority list to do certain things. We can call it a simple, a city priority list, a city implementation priority list on what projects that's at a 25 meter target that we can get done, next target, next target, next target, over the course of 18 months, two years, three years or whatever the case may be. We do know that once Walsum Road is complete, that we'll be able to, at a minimum, get rid of those mediums and clear out that brush and count up zero escape that, you know. Similar to what Kitty Hall, yes or like. Our business park, and we talked about the International Wincrafts International Business Park. Imagine we had our city of lights crest on the corner of those buildings there. Talking with the EDC and having those businesses, they were game to name it, you know, Wincrest International Business Park. I don't think they will have any issues with, you know, Wincrest's torch up there on the core of their businesses. And then as we look at our business parks and our shopping centers where you would normally put, you know, for example, you know, Chipotle's or, you know, Buffalo Wild Wings or something like that. At the top of that, we'll have a Wincress torch up there as well. That's a bit of the branding, but it's more of, you know, say it, hey, you're in Wincress. We're proud of our businesses. So is there a next step? So the way I look at it the next step would be as we talked about developing with way finding, with some infrastructure projects, put it together and tell the master planners, the planners. Hey, this is our vision. How much would it cost? What's the timeline? And then kind of, you know, you know, step one, step two, step three and develop that city implementation priority list, you know, obviously the close targets as the mayor mentioned, like zero escaping, that would be one that we would do. Obviously the stone walls would probably be four or five or further down the road, because that's when we'll need the professionals engineering to come in and do the analysis, determine if and where, yeah, if and where those fences can actually go up along city easements, surveying has to occur, et cetera, et cetera.
