the city. We will start with the first. We will start with the first. We will start with the first. We will start with the first. We will start with the first. We will start with the first. We will start with the first. We will start with the, Madam Clerk, please call the roll. Yes, Mayor Fernandez. Present. Commission of what niche? Here, the mission of Cyan. Here. The mission of Rodriguez. Here. We have a forum. Thank you. If we could please rise for a brief moment of silence followed by the Pledge of Allegiance led by Commissioner Boniche. Yes. And again, we'd like you all to keep in your thoughts and prayers, the family of Lucas Azuna who was tragically lost this past weekend. Madam Commissioner. I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God. Individual with liberty and justice. Crawl. Please be seated. Madam Clerk, we have a couple presentations this evening correct? Yes, we have. You could read item E2 for the record. Yes. Cure, CC, fibrosis, kickball, turn, bench, trophy presentation, Jerry, soccerman, co-founder, Cura, CF, Miami. Mr. Soccerman, welcome back. Floor's yours. Welcome back. Thank you. That's right. Welcome back. I guess you'd like it when I come back. Yes, sir. Winning is good. Yes, so thank you. Thank you very, very much for having me. It is my honor, as we did on March 8th, when our tournament took place to present the city of South Miami with both the tournament trophy and our community champion trophy as well. We create a separate bracket for the municipalities. And so the city of South Miami for the third time in four years. And for the second time in the last three, one, both of these trophies defeating the city of Miami firefighters, village of Palmeiro Bay and the village of Pinecrest Police Department. So congratulations to you all. We can't thank you enough for your support over these years. This year's tournament was our 12th takes place at Palmetto Bay Park. And this year we raised over $82,000 thanks to municipalities like yours and the support of those teams, businesses, families, and other sponsors, which we are incredibly proud of. And we can't thank you enough. This trophy stays here at City Hall for you all. Jerry, before you go out. Jerry, what did you raise money for so the public goes over? Yes. So, I'm from the Curecystic Fibrosis Miami Foundation. So we are a local family foundation that raises money and awareness in support of Cystic Fibrosis and the Cystic Fibrosis Foundation. My goddaughter Delaney has Cystic Fibrosis. She's 14 and a half years old. It is a genetic disease that affects the lungs in digestive system in really any organ in your body. Unfortunately, she has a genetic defect as do about 40,000 other Americans that produces a thick sticky mucus in her body that coats all of her organs, primarily the lungs, causes digestive issues as well. And so it makes it difficult to breathe over time. And people will see a far more susceptible to infections. And that does long-term damage to the lungs. Fortunately, there have been some miraculous advancements in this last decade and a half since she was born. And there are medications now that can treat the symptoms and the genetic cause and the defect for about 90% of people with CF. It is not a cure. There is still permanent damage, it's still long-term and it is a debilitating disease. Delaney is her pancreas doesn't function so she is insulin dependent. It's a special kind of diabetes called cystic fibrosis-related diabetes, not type one type, too. It's completely different. She also has difficulty with adjusting food and she has a feeding tube as well. So it's incredibly challenging for her, but she perseveres and so do so many others with CF and so we are incredibly honored and proud to be representing her and all of the other people with CF and to continue fighting for this cause until we find a cure. And we will continue to do that as a matter of fact, tomorrow morning I'm heading to the National Volunteer Leadership Conference in San Antonio, and I'm running from here to a meeting that my partner in crime who is Delaney's grandmother, Bonnie, who's the co-founder of our foundation, is currently monitoring for an event that we're gonna be having here in the city of South Miami at the South Miami Elk Club. It's actually a problem. So it is an opportunity to revisit that nostalgia, sans chaperones, and for you to experience it actually with your significant other of today, because I would venture to say I could probably on one hand, guess the amount of people that would attend this event with the same person that they may have attended, they are original problem. So it's, and the South Miami Alculeb is doing a fabulous job, giving us a hand with that. So we are appreciative and honored to be hosting it in your wonderful city. So thank you all very, very much, which really appreciate the support of the entire community and congratulations once again. Jerry, before we go, when is the event next year? And how do people get involved? Okay, so March 14th, I'm actually going before Palma de Bay Council next month to request the date. So once that's all signed up, and they can contact us at info at cfmyami.org or cfmyami.org, you know, www.curs. www.ccfmyami.org. Our website is under some maintenance right now, but it will be operating very shortly. Anybody can participate. You just need to put together a team. A team is anywhere from as few as eight, although that's tough to as many as 12. And the initial you can add up to six more people. You can bring guests. There's a whole opportunity. It's really an entire community event. You know, we have food all day, sponsored by some incredible food sponsors. We have a barbecue public's help side with that. We, Gierdonna Salads, does their salads. My name is Best Pizza. Pub Grill has also been involved. And so we provide people with food and water all day long. People can eat to their hearts content. And it goes, it's a long day. You guys were in until the end and obviously came home with the trophy. I don't know that you guys know that some people leave at like two, because you're always there to like six or seven. Hopefully we won't figure that out any time soon. No. It doesn't appear so. I mean since day one you guys have been incredible and you know you get you get some and you're not bringing ringers either you're bringing you know. Real South Miami. Yeah. You know employees. Yeah. Yeah. Well and commissioners for commissioners. Councilman you know I know Steve has played. I think the mayor has maybe gone to that one. I tried to play. I tried to play. This year I mean a special guest appearance. So give your city managers play to assistant city manager. Chip has the skin needs to show it. Sure. And assistant city manager was there in spirit this year. Yes. I don't know. It lovely cut out of her was there. Where is it? Where is she? Well, Jerry, congratulations on another great event. If you've not gone to anyone in the audience, it's a wonderful way to support a good cause. And really a great family environment, playing a game that we've all played since we were kids. And it's funny how we take it probably more seriously now as adults than we did when we were kids. But it's a wonderful day. And more importantly, I just like to say congratulations to you for your hard work. I know you put in a tremendous amount of time to raise this hard earned money for a very worthy cause. And again, to Brian and Bonnie and Brandy Binker, who are also part of the Heart and Soul This Organization, and have overcome many challenges in their lives. My congratulations to them as well. But why don't you present the trophy to our team captain, Alfredo Riverall, and we can all come down and take a picture. So we're all right. Thank you. Thank you. Thank you. Thank you. You're welcome. Thank you. Mayor, if I may, just point to personal privilege, we do have employees in the audience that participate it and ranging from all our departments. So I want thank them for going to such a well. Let's bring it up on the picture and if Mr. Riverall would like to recognize them on the record as well We'll let him do that if you recognize the team Alfredo bring it I want to thank everybody for coming out like the officials for supporting the college. It's been fantastic. We have such a great time. All of us, all different departments are recognized and are available and participate. And it's fantastic to spend the day with the whole staff and for this great cause. So thank you so much for everybody and for the number one again. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. everybody in for number one again. I don't want to hear that. I don't want to hear that. I don't want to hear that. I don't want to hear that. So please Yeah, so you're interested. Please get involved our promise coming up. Anybody wants to participate in that as well I don't know. I can put a phone number in for the record does that work at work? at work? Let's get you a Sam and Brandon maybe we can get some information about the event happening here itself. 596-3881-305-596-3881 call or text. Let's get you a Sam and Brandon. Maybe we can get some information about the event happening here at South Miami on our social media as well. Okay. Terry, thank you again. Thank you guys. Have a good evening. Okay, without, if there's no objection, I'd like to skip ahead on tonight's agenda. And maybe we can open up public comment and then take a couple of items where I know there's some action items that are here, people that are here in the audience. So without objection, let's open up public comment at this time. You can get the list, thank you. If there's anyone else, anyone who's here who'd like to address this commission on any item, please come forward at this time. If you have not registered for public comment, we do have a list at the back of the chambers. You can also sign up here with John at the front. the to the record. Good evening. Hello, my name is Jason Lopez. I live at 7730 South with 65th place. I believe that I am here in error tonight. I thought this was a zoning and planning board meeting about the, the lot on the corner of Manor Lane and Atheist Street. But that's you guys are here. It's on the agenda. Oh, fantastic. If you'd like to speak, when the item is called up, we will keep wrecking it at the time as well. Are they going to give their presentation before public comment? We know, no, they are not. It would be after public comment, but you can, we will open up the public hearing on that item as well if you like to address us contemporaneously with the item. Okay? Anyone else who would like to come up for public comment? As well as good evening. Good evening. I'm a definitely need more than three minutes for what I have to discuss tonight. I am tired of y'all cost me money at this point. I am tired of the amount of time that is gone by and my community has yet to receive an apology for something that clearly has to be a directive that has to be coming from the leadership with South Miami PD. So I'm going to break down my issues that I have not only with this department but with this government at this point because you guys are failing us. I need to make this very clear, Mr. City Manager, something has to get done and it has to get done. Now, one thing I do not play about is my seed. That's 16 hours and 43 minutes that I put in on that. Yes, a college educated young lady. I'm a product of this community and what I will not have is having police now targeting her based on a sign that we asked the previous mayor, I think it was mayor's starter at the time, to stop Larkin Hospital employees and students from taking up all of the parking that was in the Marshall Williamson's area. And so to get waking up for the last three weeks and a row on stupidity, that's a direct result of violations that this police department that I already came to you guys and spoke to you about that is still continuing to happen. So explain to me how my daughter can rent a car from enterprise that is a reputable company and now now all of a sudden, allegedly, the tag is coming back, not there. When there was no reason for her to be what was her offense, being home. Then the story changed. And this is why I recorded. I definitely recorded. And it's out. Got thousands of views at this point. We should be tired of our city being targeted. We should be tired of college educated, people who are actually doing what we raise them to do, which is to be a productive citizen in this community, to get an education, to give back all of the things that she is actually doing. But instead, what was she harassed by the police? And you know what? That encounter, as soon as I came out the door, if they were in such the right, they would have stayed. They would have tried to continue on. If somebody has an unregistered ag allegedly, like come on, like I'm tired of the games. I am tired of the games one of my mom's friends lost her son You think that's the ideal time to now come and disrupt a funeral a funeral It's getting ridiculous and I've had enough I need you guys to be interested and I need action I want the after-action report for what happened after the black history. And I also want to know I have yet to see the community officer. A lot of things can be resolved. Listen, in the North, they have those type of problems and relationships with the police. We've never had an antagonistic type of relationship with our police, which tells me there's a directive. They have to be carrying out someone else's orders and that typically comes from the head. And here's the thing, the assistant chief came out and met with the community. I don't want to hear the excuses of oh we didn't realize it was private property. I want that apology for Miss Tula. I want that apology for my mother. I want the apology because it's clear and you all know that over 20 plus years we've been a private community and none of you have yet to apologize to what happened to the seniors in my community. None of you have apologized to even me for what I've witnessed. None of you have apologized for what took place with my daughter this past Saturday. It's ridiculous. There's no reason for police to be harassing people who are not breaking the law, people who are doing nothing other than just arriving home. Broke no laws, none. I'm sick of it. And I'm asking this commission, I'm asking you mr. Mayor before this things has to escalate You know even further because I promise you if we want to turn this into Mississippi burning and we want to be the latest city on the on the news I can do it. I think you don't know who my pastor is and I think you guys don't realize like what's waiting We gotta do something about about your time is up I we fully hear you I'm gonna use my mom We fully hear you. Is she here? Is she here to give it to you? Okay? Okay? Okay, so that's fine. So if I could if I could address your comment so as to the after-action report for what happened to Lee Connem idioms for the benefit of the public as well, the chief has retained outside investigators who have conducted interviews in the community about the event. They're compiling a report. Those interviews I think just concluded this past week. I've been sharing the information as I get updates with Mr. Ford at the NAAC LACP, so he's aware. We will be providing a copy that reports to the public. If an apology is owed, we are going to provide it. Okay, we're just going through what are the steps to understand what transpired. So we get a full perspective from everyone in the community about what may have happened that was improper, proper, but we'll have an accounting of the facts that we will happily share with you and everyone else. I believe the chief has gone out and met with Lee kind of an in-board. I was not advised on meeting, or I would have been there personally, happy to go. When the report is completed and persists at the findings of the report to the community and have a conversation about it, okay, sir. If, what do you mean if? what, man? What do you mean if an apology? See, that's my issue. Man, man, I have my own opinion about what happened, which I will share at the appropriate time. I'm allowing the police chief and the department to do their work. Right? I don't, you know, we're here. We're here to do, we're here to discharge an obligation, which is first and foremost to keep the public safe. Right? We all only have an opinion about what happened at the incident, but we have to allow there to be a compilation of the things. We're here to discharge an obligation, which is first and foremost to keep the public safe. Right? We only have an opinion about what happened at the incident, but we have to allow there to be a compilation of the facts. That's what's happening right now. It's not an issue that's being ignored or brushed into the rug. I don't want to give anyone that opinion. Okay, the chief has undercaken to expend resources to have an outside group of people. Okay, do an investigation understand where we may have failed, okay? In our management of that particular event, and where that encounter may have gone in the wrong direction, okay. Full acknowledges the possibility that something wrong was done, okay, but I'm not here to judge it until I'm giving it a counting of the facts. Okay, but I'm telling you I witnessed something. I'm not saying that your perception is not anyway wrong. I've seen all the videos you've posted. I've seen that other videos have been posted by people of community. I've observed them, I have my personal opinion, but I'm waiting to get a full perspective based on that investigation. So there isn't accounting that's, there isn't accounting the fact it's underway. Again, if you have a question about it, I'm not hiding from anyone. My cell phone is on the city's website. You can contact me anytime to ask me about the status of it. And when the report becomes available, we made widely, it'll be made, we made widely available to the public so everyone can digest it, criticize it, confirm it, and we will take as a body the appropriate act of time. And it may include an apology. Yes, ma'am. Yeah, I definitely want one for myself, my mother, Ms. Tulan, all those residents that were there, that were told to go into their homes, unjustly go and ask the right to do that. We understand. My other issue, see here's something that is very clear to me, is when there's smoke, there's usually fire somewhere around the premises. I'm trying to understand what is the purpose specifically, and I want answers to this question. What is the purpose of us trying to now change the zoning across the city, citywide, as you brought up Mr. Rodriguez that hasn't passed yet, but you guys seem to be gung-o on this. I'm trying to understand what is wrong with our current zoning and the legislation and everything that we have, you know, taking place as is why do we want to do a city-wide thing if there's no intent to get rid of those, you know, houses that are on 64th Street? Because something, in my instincts, is telling me, if you're going through all of this, there has to be a purpose and no one has told me one good reason as to why you're attempting to do that and the last thing is I want to understand why are we even considering trying to turn the Marshall-Lumson's area into a concrete jungle? That was not the purpose of what that land was given for and I want to understand why you all are specifically targeting this specific area. I want answers and I want them so. Ma'am, as you know, because I think you were here when we announced that we're having a community meeting for those who do not know. It's this Thursday evening, April 3rd at the Bethel Gibson Center at 6 p.m. We have, as we said, we would, we put out a community survey, which is being compiled right now, to understand what the community wants us to do with, I believe, referring to the mango lots. Just a- Yes. Okay, correct. So, as we've shared before, I believe you were here, the CRA, which is now extinct, had a plan to develop a portion of those lots for affordable housing. We all recognize that the situation we we may have changed, we were advancing a plan to preserve a portion of that lot as a park where we've decided to honor the first African American mayor in the history of the city, which was Dr. Anna Price. That has been approved, so a portion of the park will remain a park. The question is what happens with the rest? We've put to the community, and I think I speak for all of us when I say we will be guided by the community's feedback. So if you'd like to participate this Thursday at six o'clock at the Bethel Gibson Center, please come out and you can share your opinion as to what you'd like to see happen with that piece of property in the community. The prior desire of the community, as we understand it memorializedized in the CRA plan was to redevelop a portion of that lot for affordable housing. Okay, that is what's under question. Do we preserve it as a public space as a passive park or do we develop a portion of it consistent with the CRA plan and that's what we're hoping to hear from the community and serve as what their preferences are so we can move forward concurrent with the wishes of the community. Okay. I just need you to know, I was left out of that investigation with whoever called Hyde. Yes, Mr. Rodriguez, your recognize. All right, Shantau. In reference to the mother who lost her son this weekend, I was with her today. I was not aware of that situation as she just told me today. You know, again, from offering the condolences, I gave her my business card. I told her, this is my number. Email me. She informed me of what happened with those officers parking in front of her house. We've had a crazy day. We've been here since four o'clock. I haven't had a chance to update them and speak what happened. First I hear a bit so thank you. Okay. First I hear a bit so thank you. Thank you. I'm sure a bit so thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. just as well once they understand what happened. First I hear a bit so thank you. Okay. Thank you. For the public comment we have on the list Mr. Levi Kelly you're recognized sir. Anyone else like to speak please go ahead and register with John here at the front. Thank place. Pass it back to John. Brandon. Leave by Kelly. 6250. Southwest 6.0 Avenue. Good evening, sir. Born and raised in the city of South Miami. Just to give you a little context. As a right now, I think. From individual standpoint, I would like to lower the temperature as we discuss some important issues that we have to deal with. I think that in the first part of the discussion, there were some things that happened that shouldn't have happened. But those things have been discussed. They've been investigated. There have been community input in terms of talking to the investigators. I've known for a fact that there's going to be a finished product that's coming aboard. I personally had conversations with the chief and the assistant chief. They're committed to doing what's right. And I just want to make sure that everybody in this community know that this is not going to be overlooked and it's going to be done decent and in order. I think there's too much estate for this city, a good city and I think that we as a community and as an elected government have in the past had a good working relationship. And I think that relationship is still there. I think there's a real need to Peel back little bit of the anger and the anxiety that happened before and just discuss it in a civil manner. I think that yeah, there are some things that made me angry. I'm not going to burn down City Hall. I'm not going to get to the point where I'm going to be pointing fingers at individuals because it's a collective effort by all of us that need to happen. I think the fact that we as a community have an obligation also to make sure collectively that I've voted to heard clearly and that in totality not by a few. And based on that, I think that we need to keep that in mind and move forward with what we need to do as a community. I know this manager has committed, I've talked to him, to make sure that everything is going to be upright, up straight to the point, no hidden agenda. And the fact that the chief has made a commitment also, that his officers are gonna be looked at pretty clear-eyed and where there's improvement need to be made, he's gonna make those improvements. So that's on the first issue. The second issue is it relates to the affordable housing complex area. I served on a board with Anna Price. Her commitment was to have additional affordable housing. And the part of that plan was that area facing J.R.E. Lee. She wanted that to happen. And it would be... And the part of that plan was that area facing JRE Lee. She wanted that to happen. And it would be very appropriate at this time to make that happen, but part of that meant recognizes a passive park for her as she overlooked that development for us, so to speak. I think that's something that should happen. It shouldn't be a debate on that. I think those who have served the community in some capacity understand that we are somewhat losing the ability to tell our story as a black community. Because of the fact we don't have the necessary housing, I've talked to people every day that's down south. I wanna come back to South Miami. My family, my uproots, everything is here. I'm down there with strangers. I don't feel comfortable. So I think that we need to keep eye on the prize. Make sure that we understand what we're asking and why we're asking. And I'll just leave it at that. Thank you, sir. Appreciate that. Thank you. For their names. Thank you. Miss Fisher you're recognized. Good evening. Good evening mayor. Good Good evening commission and good evening staff and fellow residents, citizens, I should say. So good to be here tonight. The reason I'm here is that I want to make sure that everyone who lives in the Marshall Williamson community, and even the rest of the city, who may be very interested in this situation with the new project that they be given a very good opportunity and a thorough enough opportunity. Fisher just to clarify for the benefit of us and everyone else which project are you referring to? I'm referring to a project that's being proposed on facing Southwest 64th Street, a One acre project adjacent to the Marshall Williams in Lod. I'm sorry, I'm sorry the mango law. The mango law. In my mind, yes. Okay. Okay. Okay. The Marshall Williams in sight. Thank you. Okay. I know the history. Appreciate it. Thank you. Okay. Okay. So that's the project and I was invited when I came here to the beautiful event for Martin Luther King Day, a young lady at the end. A young lady invited me to come and attend a meeting called a CAC. She didn't tell me what the name of it was. She said, come attend our meeting. You should go in the senior center on the third Wednesday of every month. So I went to the last meeting. I was very happy that I did. I learned a lot. I learned that it's the CAC and Dr. Joyce Price was the moderator of the meeting and I connected with a lot of people. I hadn't seen for a long time. It was great. And I want to make sure that everyone gets proper notice and there's like a char at. I know there's a meeting this Thursday, but when this project actually becomes comes before the commission and everyone is hearing about all the legalities of it, is there going to be a land use change? Are they going to get variances? Are they applying for variances? When they get into all those legal details, I want the citizens to have a great opportunity to express any concerns that they may have. And I think we need something like a workshop with the commission, or you could call it a charade, a workshop, whatever, but something more than this that is only three minutes. Because I spoke to a citizen over there, very close to the very, very close right in that immediate neighborhood. And she talked my ear off for at least an hour. And I had, and she's a brilliant woman, I had to listen to everything she said. I said, I've got to get to the commission meeting. I've got to speak at public remarks because you have too much to say in three minutes. So I just wanted you to know that. So and also it wouldn't hurt. You could call it a town hall. Maybe we should start having town halls here. It would be a very positive thing for the city. And that's all I have to say. Thank you so much. Thank you. And again, you may have missed it because I think you arrived a little bit late, but we've taken your advice. And so there is a town hall on that very lot tomorrow, sorry, Thursday evening, at six o'clock at the Gibson Center. So we will be soliciting public input as to what we should do with anything with the mangle lot. Whether it should stay a passive park or whether we should develop a portion of a consistent with the CRA's prior plan, which was to have a full time. So it has to what we should do with anything with the mangill lot whether it should stay a passive park or whether we should develop a portion of a consistent with the CRA's prior plan which was to have affordable housing on it. And that will be in the community center. Correct. Yes, ma'am. Six o'clock this Thursday. I'll be there. Look forward to seeing you. Good evening. Good evening. What am I supposed to say, my name? Your name and your address is a record, please. Thank you. My name is Ashanti Smith. My address is 6102 south west 68th street. So on March 23rd at 11 p.m. I was in my 7th and 3rd of the parks kind of mediums. So there's a dead end circle and I had a car at the I was a rental car at this time and I had parked in my car and I was probably you know sometimes you just sit in the car for like a few minutes after you like, so that was me. I was there for like 10 minutes and I'm sitting in the car, the car is still running and then I see a bunch of flashing lights in front of me and then up on the side of me. Somebody not going to door. So I was confused. I'm like, okay, what are you know? I wrote down the window and and they said, it's just your car, it's just registered to, like where's the registration? And I'm like, what do you mean? I was like, this is a rental. He's like, oh well, you're parked illegally. Or like, he first he said that the car wasn't registered. Then he said I was parked illegally. And so I felt harassed. I had three cops surrounding me. I have the pictures and everything surrounding me in video of them surrounding me. I gave them the registration. And then he pursued on saying, oh, where's the rental agreement? Because it's not registered. Well, first of all, it's Indiana. So we're in Florida. So obviously, it wasn't registered in the state. And then he just kept switching up the story about why he was there then. When I said, OK, he first he said it was about the sign. And I'm like, there are so many cars that were parked on the side of me. So what about that car? What about that car? Everyone that lives in Lee Park, Conminyum, in that dead encircle that's extra parking. It's been like that for years. That little red sign that's been there, you don't even know if I've been there for two hours and I how my illegally. We all, everyone that lives in Lee Park condominiums and that dead in circle, that's extra parking. It's been like that for years. That little red sign that's been there, you don't even know if I've been there for two hours and I how my legally park. And you see that my address says what it is on the ID and they were just given attitude. I have their, I also have their card numbers as well. If you wanna write it down. Yeah, so I think I saw the video posted on Facebook. Yeah. And if I'm not mistaken, I sent it to you, Chief, correct. And I believe you review the body cam footage. And I believe if you want to share what the origin of the call was, if it's helpful, Ms. Mitz you understand what the background was and how they ended up interacting with you? Because I was not, I don't believe it was targeted at you. It was unrelated instance of. If you could just, so we can get the sound of the record, if you just yield the microphone to the chief, and we'll bring you back up with some more time. Chief, go ahead. So the original call was a robbery call. the officers were in the area looking for a robbery suspect. From my understanding at this point, the officers encountered a vehicle, assuming that it's her vehicle that she was renting. It was parked under a restricted parking sign. The officers ran the tag on the vehicle. The vehicle did not come back on file. Officers investigated the driver of the vehicle who was parked in a restricted parking spot in the cul-de-sac. They identified themselves. She identified herself. She provided the rental information to the vehicle. Officers let her go. The encounter was cordial. Sorry, before you go, just to ask this question. So, from her perspective, I can understand that having three officers respond to that call, to what seems to be a parking enforcement matter would be a typical correct. If it were just if it were just about the parking enforcement issue. Yes, sir. Okay. But if it's a call related to a robbery, is it a typical for three officers to arrive in support of an officer trying to identify the vehicle? It wasn't necessarily identified a vehicle. They were actually looking for a known person. Correct. But they found the area. Did the vehicle match the description of the vehicle that was used in robbery? There was no vehicle mentioned in the robbery. The officers were there looking for an individual on foot in the area and countered the vehicle that was running, ran the tag on that vehicle, unbeknownst to them. She was occupying, said vehicle in a restricted restricted parking spot. They investigated that and moved on from there. I think it warrants us having a conversation offline so we can explain what the standard operating procedure is because we share the body worn camera with them so they can see it from their perspective from the officer's perspective as well. Ms. Smith, you, you recognize again. I would like to say to please get the story straight because you're saying it's a robbery that you said restricted. The thing says two hours. I only been there for two minutes. So how is it restricted? How is it restricted? And there were three other cars that were parked right there. And then my neighbors, they parked right on the, so how's the restricting? I've seen the parking enforcement's come to that dead encircle millions of times. And not one has everybody got it in the ticket. You don't even know how long I was sitting there. Yeah, I think what I think, again, I'm just trying to distill the information that I'm hearing from everyone, because I saw the video posted online. It seems that what tripped the interaction with you was the fact that they observed the car that was legally parked and they ran the tag and the tag did not register on their system. How was it to be in the park where they weren't even there for two hours? Ma'am, I even know the time was running illegal. How's he legal? So if it's illegal, then why is it still available for people to park there? The sign literally says two hours. I wasn't even there for even an hour not even 15 minutes. Understood. Okay. then why is it still available for people to park there? The sign literally says two hours. I wasn't even there for even an hour. Not even 15 minutes. Understood. OK, let's let me rephrase my statement. OK. So you happen to be at the location. They ran with tripped. I think the further engaged it was the fact that they would they observed the car running. In an error, they were looking for a suspect. they ran the tag and the tag came back unregistered, right, which will lead to them interacting with you. So again, it's an unfortunate circumstance. And it's not fun to have lights shown into the joining home or into your car. My house is on a watch order because I'm an elected official and I hate when they drive by and they flash their lights through and it comes through my glass panel But I know they're doing it because it's just part of their typical protocol So I don't think it was a targeted event to you I would I would invite you to have further conversation with the chief So you can you can get all the facts that you like if you if you're not satisfied from that conversation conversation. What I would ask is you can contact any one of us. My cell phones on the C's website. I'm happy to follow up if you're not satisfied. Okay. So if I'm not satisfied, okay? So if I'm not satisfied, what happened? You can file a complaint, and that complaint will be investigated, and it'll be over record, and we can, and the chief will take whatever action it aims to fit based on his review of the record, okay? Thank you. Thank you. Okay, Ms. Tiffany Irving. Good evening. Greetings, elected officials. I'm here on behalf of the Chanteay and Shantay. I want to discuss what I've seen as a resident of South Miami. While we appreciate development and growth, we also understand re-gentrification. What happened to a Sh Smith is deplorable. Is she not happened to anyone, let alone a young black woman, where three or four officers show up to detain a citizen of South Miami? Is inexcusable, in fact, as a member of Delta Sigma Theta sorority, over 400,000 members strong, as a member of the NAACP, with contacts and understanding while we want growth, while we want development, we can't push out the old to allow for the new. Our citizens do not deserve that. There are families that have lived in this area for over 50 plus years. My grandparents moved here in 1973 in Lee Park, Condominium. I have recently moved back to this area and so that you have for the record Tiffany Irving's 6111 Southwest 69th Street, South Miami, Florida, 33143. I've recently moved back to the area and was very disheartened and amazed to see the quote unquote growth of this community, the University of Miami students parading around with no clothes on, regentrification, the citizens being harassed in this area because of regentrification, we do not deserve this. We can all coexist, but not at the point of pushing out the old to develop and embrace the new. We should not have stood up for it. I remember at GRLE Community Center, we used to link up bikes and skates, and skate through what we called the creek. Now I see advocates, new citizens, playing tennis, overdeveloped by what was the senior citizen community. Individuals sitting in a park and being told they have to leave because they don't belong there. Who says? We do not deserve this. We do not care for this quite frankly. And when one of mine, because the shanty is my sister's Goddaughter, is harassed by law enforcement. My dad is blue, but he'll always say he's black. There's no blue or black. When one of mine Mine is her rest, quite frankly, I am now taking off time from my job because I work 11 to 8 by the way. To speak about the injustice, I saw the bought party, I saw the uni, I saw what it was supposed to be. I saw that we got a little bit excited and crashed in the streets and we came and spilled over and that made a little bit of people feel uncomfortable. Because we were doing what we always did and always do. I saw it. But quite frankly, there needs to be an embracement and it doesn't have to be with harassment. We can all co-exist. We can all embrace re-gentrification, but not with someone's life being possibly in danger. That situation could have gone a different way. And we will not stand for it. That is my time. Thank you. Thank you for your comments. Is there anyone else who'd like to address this commission on any any item? Please come forward this time. Mr. Rikki, it's good evening. But even if it's not... Good evening everybody. James McCants, 6-2-10, South West 6-3-3-3-3-3-3. I've just sit back there and I was saddened. I have to learn about the incident where the Sante from Sante and the back of what happened. The chief did call. We have a very good relationship with the police department. And we did speak to some investigators. And was pleased with that. We gave our recommendation of what we saw to them. And I look forward to sharing this with our community here in there. So I'm not gonna speak to that case. Okay, I didn't see the film, but I was told by the chief that some things need to change. Now, with the Unity Festival, we saw film that had to be discussed. So that report will come to you guys. And I think the working together we can make a positive change for next year. I think that we should be on a better speak in term with the police to iron out these things and mistakes. And sometimes with the young officers that are not familiar, we need to deal with that in a different matter. And I'm going to stop it there we can, I can go on with that, I'm gonna stop it there. But I wanna go to the to the apartment for Marsha Wemmes in apartment. Over 23 years with the CRA, we gone through planning, we begged residents to come speak and be a part of the planning process. We saw businesses go, we heard of businesses go, we saw apartments torn down, we saw shotgun homes torn down. In my office personally before the CRA was stopped, had numerous folks coming to me wanting to move back to South Miami for whatever reason they love. So part of the strategy and the planning was to always use the back portion of Martian Williamson's property to try to bring back folks. The original part of that was to be connected to the original Madison Square project. That's why we bought that as an agency that was short-change with us. We lost within a 10-year period 189 housing units. Just think about that 189 housing units. And we're not talking about just one family. We're talking about grandmothers and then granddaughters and then children. So we wanted a place that we can actively have people come back and have a chance to come back and South Miami. So that we can live to unify and fight for another day. I believe that the young people like Sean take coming aboard and others, that they can have and maybe do things a little bit different from us to make it better so that community can actually come together for a positive change. And that's partial was you was meant to be used for it. So I hope you take that and strive and we're going to talk about it again on Thursday and everybody just have a good night. Okay. Thank you sir. Further comments please come forward. Good evening, my name is Terry Vierker 6104. I was 60-X-G screen. I'm a Florida 33143. I wrote the original email for those signs to be put up in the back of our leaf. The signs was originally supposed to be in so that Locke and Hoss Spiller were not parked back there. I also spoke to the mayor when he put those signs up saying those were the wrong signs he put up saying that it was only for us on the singing citizen in Washington William Park for two hours. Is there any way we can have those signs taken down because now we do not have lock and hospital a park there. They have a park a lot that they park in. So, Mr. Vickers, I think what we can do is have Mr. River All Runs our parking enforcement program for lack of better way of describing it. What we can do is if we want to make that our residential parking zone, so it benefits the Abundant County of many association, we can certainly sign it that way as we have in some other neighborhoods. And so Mr. Riverall, if you can work on having a conversation with the association and figure out that's something they would want, we can certainly go ahead and change the signage out. We've done that for in other areas They're adjacent to commercial, like a hospital where there's spillover and often people that are working in the adjacent visible park in the residential area. We strap into the axiom people can park curbside, but only people that have a residential parking decal. So that would be one way to kind of help, I guess mitigate any potential conflict there. Okay, then I have a two question And the second question, but Quentmate can answer this question since he's the director of the park. There's a corner sack in the middle of the park where used to be swings. Our kids in our neighborhood does not have a swing set on our park. I go to Danny Fesele, I go to, especially I don't even wanna talk about there about it. Park over there, y'all spend all that money over there. They have all this new stuff but our kids does not have it. What is coming into our neighborhood for our kids as far as park and recreation? Okay, he's quite in here. I'm sorry. Yeah. Could you even come up? What is the history on the swing set that was there? And why was it removed? If it was removed at all? Good evening, Mayor. Good evening. A couple of my arrival about 11 years ago, there was a playground structure underneath the power lines. Also, underneath that playground structure structure is the main water main extension that goes down was at 68th Street. So upon my arrival we were looking at replacing the playground structures which included a swing. It was deteriorated at that time it must have been about 13 years old. It was time to take out the old bringing the new. We brought in two new structures. During the permitting process, we could not put that playground structure at that same location. Again, underneath is a water man extension that goes all the way down 68 and above are the power lines. So for those reasons, we had to place the two new playgrounds that are there now in different locations and that's where they are today. Okay, so I think we are working on a Park's master plan as vickers. So we've, our master plan is over 10 years old at this point. So we're going, we're just starting that process now. I think we can work with the parks department to figure out if there's a place where we can actually locate or a placement apparatus. If you think it's worth having a conversation with some of the adjacent communities to figure out what they would want, we can do, we can kind of repeat the exercise queue that we're doing right now around the mangle lots and kind of figure out what people would want to see. And what kind of age is we need to serve us? Cause I will speak personally. Dante Fissell has got a new swing set, but I will tell you for kids that are a little bit older than nine years old. We had there before it was fantastic but we have there today it doesn't engage older kids so it's not just about replacing it with something but also replacing something that gives kids from toddlers to pre-adolescence an opportunity to kind of still use that space. So let's follow up on that conversation. They can do to bring it up though. They look at this. They look bad. Is that an area, Mr. Manager, or a quentin that we are charged with maintaining, or is that county right away, who's got jurisdiction over that space? What are you talking about? Mark on the area. It's the it's basically the the cul-de-sac where there's not a through street is basically where the streets impeded. So the parts of the north but the area that's south of the park adjacent to the economy and that's here you're talking about, onto the power line. It's enough if you were to run the street east to west, we would run right through that section. I don't know if that is our right of way or someone else's. I will walk it tomorrow with the park director. Okay, we'll walk from end to end. If someone can get his vikers number just so we can follow up, But at least we can keep an open line of communication with someone in the neighborhood about what is not going to happen there in the short term. Man, four yours again. Did you have anything else you want to add? the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the public and the My name is... I'm going to ask you to ask me to ask you to ask me to ask me to ask you to ask me to ask me to ask you to ask me to ask me to ask you to ask me to ask me to ask you to ask me to ask me to ask you to ask me to ask me to ask you to ask me to ask me to ask you to ask me to ask me to ask you to ask me to ask me to ask you to ask me to Shanti. This situation, I don't understand how when we come down and we do something, it changes because as Terry said, she's the one that did the email for that sign. Miss Scott was the manager and lead part for years. She explained to me on her retiring that that area Miss Scott was the managing lead part for years. She explained to me on her retiring that that area where we park at because I'm her neighbor. That area the city knows that we're allowed to park there that it has not been a problem. People have been parking there I park there every night. So I don't understand why the, well I heard what the chief said or the captain, but why harass a young female like they did that night. When I saw I can see the lives from my wonder when I saw all of this going on. I'm thinking that they're after somebody and I grabbed my phone and her mother's's on live, and I'm looking at what's going on, and I couldn't believe it. So we said in the last meeting that some of these police officers need training. They need to know history of what's going on in South Miami before they attack. What if they're a shot at her or something, thinking that she's somebody else in that car? She lived right there. I mean, she's in and out. Every police should know her. The police is sitting there at night. Why would they have to do something like that to her? Secondly, with the park thing with Quentin, I spoke to him a year ago about that because of that open space there. It allows for other people to be out there that don't live in a Lee Park with their dogs and their animals. And our kids, when they go out and play, they're stepping on dog poop and everything and their shoes and things. And he explained to me the easement, but what I tried to explain to him is that that street used to go all the way through when Lee Park was built, 6th A street went all the way through. The park came later. So. This figure, do you know what the street was closed? I'm just curious if you have a history or Mr. McKance. The part that was built, it was built to extend the park or is it? No, the park wasn't there. The park came after Lee Park was built, the kind of minions was built. Then the park, so when they built the park, that's when they did the coldest side. And they closed that portion of the street. Okay. So, and my question to Quentin, last year, if you remember, we met at the, when they put the stature up for my Williams. And I said that to him then that I, our kids run around because they don't have anything to play. It's an area for the younger kids, but what residents have done is taking that area what they removed the swing sets from and made that a dog area. So I have emails from him telling me where the dog park is. I'm not interested in a dog park. I'm interested in a place for our kids to play. And I understand about easements and how far you have to be away from an easement. it should be a way that the park department could put something there for the kids so that it could be a enough space between the easements. I know some easements you have to be seven feet in a way and everything I worked for the county in the building department for 32 years so I know that there's a ways around that if you have to put something smaller or whatever. So nothing has been done in over a year. And our kids have to go to the bigger part. When they get to the bigger part, they're met with, oh, you can't play here, this is going on here. They're bringing other people in. So they charge your dollar to get into the gym to play. So you're just running our kids away everywhere they go and what they should have somewhere to play. They don't because it's been removed and he was supposed to send me the survey, sure, and the easement. I never got it. I've got letters about they put up dog signs and everything. I'm not interested in that. We need, it's a park, Marshall Wilson gave it to the community for a park, then we should have something if we have to redesign it or whatever, so that the smaller kids have one side and the larger kids have a side. I don't see why that's such a big problem. Doesn't sound like we can We can get a fix. Now that we know that's an issue we'll take care of. Thank you. And then we're on the issue with, I guess what you said, you had to meet with the police chief about the incident with Ms. Wells. It shouldn't be an issue. They should know what they're doing. Yeah, I think just on that issue, again, to Ms. Smith, I mean, I apologize. I don't think the intent was to harass you if that's how it came off. I read the video, I believe from what I've observed. Yeah, there were people that should be arrested. They were arrested in Hasiden, has been harassed. They were responding to a call and they identified an unidentified vehicle and that led to the interaction. I think what I'm hearing though is that we need to have, and I don't Mr. Ford is in the back. I think we need to figure out and we'll speak to the chief about some sort of a community conversation that's structured So we can actually do something and we have hired 10 new officers in the in the past year. Right. There probably is a good opportunity for some more dialogue, some more integration of both the police department and the community. So we will we will put our heads together. Right. And we'll have a conversation about what we can do to kind of bridge that gap. Now what I would would ask is, I think, to a person on this day, including Commissioner Cory or the vice mayor, who's here, we're not afraid of having these conversations. But I certainly would prefer to have them one-on-one to start, as opposed to people having them here at the day, because it's very hard to have an earnest conversation and get through our business when the first time we're hearing about something is here something is here. So, I would ask, our numbers or contact information is available. We're typically, all of our office numbers are going to please call us. Sir, and I feel the same way. As I said to you, I'm the president of the association. My door is always open. The police department brought me signs on a holiday, not going my door and delivered signs. So, I mean, they're not afraid. They can come anytime. And I believe the whole community in our association. We welcome it, but we don't want to have closed meetings. We want you out. We had two officers. What was the name of the officer? Corbett came and sat in our association meeting in our last meeting. And we didn't scare him anything. He sat there through the whole meeting. In fact, he knew everybody but me, and I've been there 50 years. So it's not that we're afraid of the police that we hate the police. It needs to be some communication, okay? And as I said that last year, when the shooting, when the game banging was going on, and I called Jane McCann, and he was in a meeting here. And when I said that about the shooting, James and this guy came over. They said, how many shots did you hear? I said three. When they finished, it was about 40 shots. So they he stayed out there with us half of the night. We're not afraid. We want to communicate. We want our community to be nice. We wanted to be a place where you can walk the sidewalks, the streets and everything. We wanted to look nice, but we don't want to be harassed. We all feel the same way. So we're like mine. Let's have a conversation. I'll call you to that because please, that's you're the mayor. Sure. I'm looking for that. Okay. And I just want us to have the same opportunities as other areas in South Miami. we do as well. And I've heard some comments about gentrification. Some of the development for folks understand we don't control right there are the public housing project is one that's beyond our jurisdiction. We do as well and I've heard some comments about gentrification. Some of the development for folks to understand we don't control, right? There are the public housing project is one that's beyond our jurisdiction. There's some student housing that's been built on the periphery that I know people commented about. We don't get to say grace over everything with respect to the mangle lot, which is the subject of the community meeting. What we're trying to do there, if that's the will the community is find an opportunity to provide some replacement housing, because Mr. McCants is dogged in trying to remind us of what we've lost in terms of women. trying to do there if that's the will the community was fine and opportunity to provide some replacement housing because Mr. McCants has is is dogged in trying to remind us of what we lost in terms of inventory and that that was a place where it was all it was always the intent of the CRA to provide that replacement housing. So we'll have that community conversation Thursday at the end of the day if If the circumstances have changed and people want us to preserve that as a passive park, we're happy to do what people want. We want people to feel that as a passive park, we're happy to do what people want. We want people who feel comfortable in their community and see themselves reflected in it, because the African-American is an important part of that history of that neighborhood. And speaking for myself, I think for my colleagues, we want to do what we can to commemorate it, which is why we started with naming a portion of that park in honor of Dr. Price. So thank you for your comments. If we can, we'll move on. Okay, thank you. Anyone else? and we're going to be in the next meeting. We'll be back in a minute. We'll be back in a minute. We'll be back in a minute. We'll be back in a minute. We'll be back in a minute. We'll be back in a minute. We'll be back in a minute. We'll be back in a minute. We'll be back in a minute. We'll be back in a minute. We'll be back in a minute. 12th place, 9-4-331-7-0. I come again based on my responses as to what in a couple of things. I'm going to put in a couple of things. I'm going to put in a couple of things. I'm going to put in a couple of things. I'm going to put in a couple of things. I'm going to put in a couple of things. I'm going to put in one of the things I often looked at when I go into situations is what was the catalyst? What was initiating action that spurred whatever transpired? And even though we talked about the community meeting and what happened with that whole situation, I've not heard what led to police feeling the need to respond at that particular event. Not that it has to be answered today, but I want to make sure it's a part of the report. Second, as a relates to this young lady in the robbery call that went out, did their vehicle fit the description? That's one of the questions that's ringing in the back of my mind. And then the other piece that's most important to me is, did you catch the suspects? I heard nothing. So that is a priority to me. You got dangerous individuals who just committed an act and are focused on a certain amount of resources. Not on how many resources you had on that particular shift. But a good number was dealing with a situation that I felt was less of a priority than what should have been the priority. So I want to make sure that that stays a focus as it relates to the housing situation. As you and I talked, affordable housing basically is robbing taxpayers. Point blank period. developers end up owning the property and doing whatever they want to whomever still getting the tax breaks they look for the loopholes and now guess what your community is not one level better. So if we're going to talk about housing let's talk about a Ford but home ownership. Let's have that conversation. Unfortunately I can't make Thursday but I'll definitely be able to, you know, because I have an WCP meeting on that evening. So I'm already booked. And last but not least, I want to encourage every person in the sound of my voice and every person that may see this online. If you're having a police interaction at any level, ask for the badge number and the name of that officer. They are required to give it to you so that we can only, without information, we don't know if we got a pattern, a problematic individuals that you all may need to deal with. So I want to encourage everyone, and definitely I want you to encourage you all to promote that as well because again you don't stop it by just saying Let we'll look at it. We'll investigate it and we'll come back and see later because if we're not identifying who those individuals are And making sure we make the proper notation of that We'll never be able to get to the root cause of the issues and the actions in this and this city and in this community. Thank you Thank you, sir Ford Mr. Dean. Oh, sorry, Miss Dean. Sorry. Miss Dean I'm here no problem. That was my fault. Sorry Good evening. Good evening. Welcome. I'm up here to talk about this weekend. I lost my son on March 17. And I called and spoke to Sergeant Corgan about an escort from my Commissioner Baptist Church and he said that they didn't do that anymore, but he told me to reach out to Sweetwater and the city of Miami. But at that point, the front-on, which is Paradise Enriched My Heights, told me that they were handled. So they did, they took care of it. But on Thursday night, as my family was coming in, we were sitting out there playing music. The volume problem was like one or two percent, because we didn't have to scream over each other to talk. The radio was real low, and it's 5'30 in the afternoon. We were talking, and then all of a sudden, we seen all the police is coming up with the flash. So we saw for a minute and then I seen them jump out they car at that point. I got up and went to the gate and say, man, I hope you. They say, well, we got a call saying that the music is too loud. I said, well, you all are here. Do y'all hear the music? No. We don't hear the music. But we got to do our job. We got a call. We got to come out and check it. I said, okay. So they left. They comes back again. The music is still at the same volume. And everybody's just sitting around grieving. We were grieving because my son, death, was not playing. He was on an operation table when he died. And he went in just for coughing up blood. So at that point, my whole family was just tore up. So after that day, the next day, they come back again. So I'm like, what's going on? You can't even grieve in your own neighborhood. We live at my mom's house. We've been there since 1970. And I'm still in South Ma'am. I'm not at her house, but my house is on 68th Street in my own house. But that's what we celebrate. That's what my son asks. He's there every day with her. So at that point, my mama come out, what I know was going on. Why did officers keep coming? We're just grieving. Nobody wasn't smoking anything. Everybody was on the sidewalk, just communicating. Family was studying coming in, and I told the officer, I said, if y'all coming out for these people that's on this street now, and the whole block was loaded with cars, I said, wait till Friday, I'm gonna have over 200 family members here. And it was, and the funeral was, 200 plus people. That's just how big my family is. So the thing is that we need to get these officers together. When people are grieving, they don't need to be intimidated by these officers. You know you come up and tell them to stand on the sidewalk. Don't stand in the road. Everybody's grown. Brought daylight. You can't stand in the streets. Ain't no cars coming. I just want this to be on record. They really need to do something because if they did it to my family, they're going to do it to somebody else. And thank you. Thank you. Or condolences again, man. And Hoffman, if you're spoken yet, good evening. Good evening. I live very close to the empty lot at 66 Avenue and 80th street. And I understand I couldn't make it the last time so it's supposed to be addressed at this one right? Yes ma'am if you'd like to we're going to have a public hearing in conjunction with that item I'm going to call it up here fairly shortly. I think there's two items where we have applicants here. Okay. So if you'd like to speak when we bring the item up I'll recognize it at that time. Okay. Thank you. I have Mr. Jason Lopez on the same subject. Yeah, okay, so great. Anyone else in public comment this evening? Seen no- I'll recognize you at that time. Okay. Thank you. And I think also have Mr. Jason Lopez on the same subject. Yeah. Okay. So great. Anyone else in public comment this evening? Seeing no one. Yes, ma'am. Yes, you're recognized. Hello, Tiffany Irving again 61 to 11 Southwest 69th Street, South Miami, Florida 313143. I understand that these are public comments for recording and that you are accepting our concerns. Do we evoke Robert's rule of order in these meetings? So how do we understand what actions will be presented and moved forward with the commentary that's being provided? I understand that the city manager talked about doing a walkthrough of the park area. How do we know that these actions are going to be acted? So do we need to make a motion from the community perspective to do that? No, ma'am, the motions get made up here, but we certainly have. The manager has, I think, we've worked together for a while. I think the manager stands when we ask a question, I would we had another item is Vickers mentioned about parking so. Everyone everyone and we will have minutes that are reduced in writing by our clerk so. Those will get reused as well so we will have follow-up action on these items except you're interested in any particular issue. We will follow up on the issues of the clerk so those will get reared as well. So we we will have follow-up action on these items except that you're interested in any particular one Please let us know we're happy to keep you updated Well more importantly interested in the protection and safety of our citizens of South Miami But also the fact that I do agree Please if we can keep comments. Sorry, ma'am if we can please Please refrain from speaking in chambers because we can't hear the speaker here at the microphone. I appreciate it. Thank you. Yes, ma'am. Thank you for your politeness. That we are concerned that our, I don't have kids. I am a sister to Yorkie, quite frankly, but I have got children galore. And we want them to have appropriate places where they can play and interact and not have to go to Dante Fassel, not have to go to Tropical Park in order to be able to interact and I did see because I do welcome trying to exercise my health and well that the swing was missing which was an intricate part of me growing up in that area and that coldest act that everyone is talking about and it is a desolate empty space and wondering what is going to be done to beautify the area. I see a nice conversion play that's there but it's the only thing that's there. Quite frankly so my concern is about that as well but making sure that sure that the citizens of South Miami, long-standing, old and young, are protected and are being heard, but also wanting to make sure that when we speak in these areas, and it's just not speaking, that we are heard, and there are actions that are being presented, and I only way I know that actions are presented is through Robert's rule of order and emotion. Yes, sir, you recognize? I think that one of the things that we do and try to reach out to the community as much as we can is give our phone numbers office hours. I mean with countless residents and we talk about issues, we come up with action plans, we come up with meetings, we have goals oriented and we move and execute on a lot of these type of programs. So I really tell the community everybody to get involved by giving us a call, coming to our office meetings, and just having a chat so we understand and come up with a plan. So coming up with a plan is verbal. What are we putting in writing so it's enforced? We need to come up with a plan. Ma'am, no, so if I may just reclaim the, reclaim the, the gavel. On with respect to the items that were raised, as I mentioned, I think the manager knows has our direction as he was a river all in the parks director. We don't, we do not act that little formality except when there's an act of this on the agenda. So he has our direction at a future managed report which we get every meeting. I'm sure he will update us on the items that we're discussed today and how they're being dispensed with and I have no doubt that all of my colleagues will have an interest in any number of the items that were discussed. I certainly will be following up with a police chief on these police items and you know we will have we will ask for individual reports that we can share with the community as were discussed. I certainly will be following up with a police chief on these police items and you know we will have we will ask for individual reports that we can share with the community as well man okay thank you for your time let me let me okay mr. McKenzie got up and I'll recognize you again as well yes sir just wanted to make this important announcement the martial Williamson scholarship is available. It started last week, and the due date is the 25th of this month. The scholarship for any variety that wants to go to trade school that lives within the city limits are college. And I want people to take advantage of this please. So it's available right now on land. Or you can get fly yourself from the community center, okay? Thank you for that reminder. Ms. Walls. The evening of my request will be brief, Shantay Wells, 6102 Southwest 68th Street, Marshall Williamson's area. I'd like to go on record and request for you all to remove the signs that you did at per our request initially, so that it can be returned to the way that it was prior to them being erected. The problem was solved. The parking department was never involved in it. It was something that the mayor's office did with parks and recreation just to help us as residents. The other side of the park where there's parking, it, as you'll see, there are no signs because there is not enough parking for those areas. And our residents are primarily seniors. So it's always been included in that that so we're just simply asking for you all to remove the signs and return it to the way it was. Thank you. Anyone else who'd like to address this commission? I see no one else in the chambers madam clerk is there anyone online? Anyone on zoom please raise your virtual hand? Yeah, okay, so we'll close both of our marks. the . . . . . . . . . . . . . . . . . . . . which I believe is the manor lane parcel. So Madam Clerk, if you could please you need item eight for the record. Yes, item eight in ordinance of the Mayor's City Commission of the City of Southland for the many of the zoning map of the city of South Miami to change the zoning district are properly located at 6540 menor lane from Duplex residential R.T. six to town, residential R.T.18. Thank you. Mr. Manager, is there a presentation by staff? Yes, Mr. Attorney? Yes, may I read the quasi-udicial? You may. And Mayor, this would apply to items four and eight on this evening's agenda. Item four is a final flat application. Item eight is first reading of a rezoning ordinance. The clerk has read the title of the resolution prior to the public hearing on each, the public hearing will include presentations by staff and the applicant and public comment. The commission may ask any questions either before or after public comment is closed. Following public comment, the commission may deliberate on the item. The quasi judicial procedures require the commission to consider the evidence presented to it and base its decision on the applicable law and primarily on the evidence presented whether by the applicant staff or members of the public. The staff report and the resolution provide the applicable law and criteria for approval of the final plan in item four and section 20-4.2 of the land development code with item eight, which you're going to hear first. This is the first of two readings of the ordinance to consider the applicants request to rezone the property. The criteria to consider is Section 20-5.7. which you're going to hear first. This is the first of two readings of the ordinance to consider the applicants request to rezone the property. The criteria to consider is section 20-5.7. And generally, the consistency of the proposal with the comprehensive plan and the compatibility with the surrounding area. The evidence considered must be substantial confident evidence. This means testimony or other evidence based on personal observation or relevant expert testimony that reasonable mind would accept as adequate to support a conclusion. It is not a popularity contest. It cannot be based solely on nonexpert opinions no matter how fervent those opinions might be. Anyone who seeks to speak on an item should be given an opportunity to speak during the public comment portion of each hearing. If you intend to provide testimony on either items four and eight, you should be sworn in before your testimony is taken. Please know if you do speak, you may be subject to cross examination. If you refuse either to be cross examines or to be sworn, your testimony will be considered in that context and given it to do wait. The general public will not be permitted to cross examine witnesses, but the public may request the commission to direct questions on their behalf to either staff or the applicant. At this time, if you wish to speak on either items four or eight, I'd ask that you please stand and raise your right hand. Again, so please stand for items four and eight and raise your right hand and be sworn, please. If you intend to speak. Okay. Do you swear or affirm to tell the truth, the whole truth, and nothing but the truth? Thank you. Thank you. Thank you. Please be seated. Madam Clerk, can you confirm that the advertising and notice requirements for these two hearings were complied with? Yes, there are. Thank you, Thank you. Please be seated. Madam Clerk, can you confirm that the advertising and notice requirements for these two hearings were complied with? Yes, there are. Thank you, Madam Clerk. And then last order of business mayor and commissioners, have any of you had any x-part date communications with the applicant or any member of the public either for or against either item five? I've had none. No. Okay. Everyone said no. Mayor, thank you very much. Okay. Thank you, sir, for that disclosure. With that, I guess we have a presentation from staff on item eight. Start. Good evening. Hi, good evening. Hi, good morning to you all. I'm Mark Slyphos, I'm from Miami. On behalf of the city, we have Covangier, Don, and Associates, who are the consultants who were here. Thank you. Hi, good morning to you, Marcus Lifewood, City of South Miami. On behalf of the City, we have Coventry Ardon and Associates who are the consultants who reviewed this application here. Mr. Craig Pender is here to give a presentation on the item. Thank you, Mr. Lifewood. Mr. Pender, you're recognized. Thank you. Good evening, Mayor and Commissioners. Again, my name is Craig Pender, senior planner with CalVan to your Daniel and Associates. And tonight I will be presenting the application for 6540 matter lane for the request to resume the property. So on your screen now you can see the location map on the left side of your screen showing that the property is located next to Southwest 66 Avenue Southwest 80th Street to the South and Manor Lane to the North. So the question for you is to Amanda City zoning map to resume the property from RT 6 which is Suplex residential to RT 18 which is townhouse residential. The property is approximately 0.38 acres in size, or just a little bit over a third of an acre, or approximately 16,528 square feet. And the current land use is residential. So on the left of your screen is the existing future land use map. So we need existing future land use designation. And on the right of your screen is the existing future land use map showing the existing future land use designation. And on the right of your screen is the zoning district, showing the zoning district map, showing the existing zoning district. So the property is currently, excuse me, the property currently has a future land use designation of townhouse residential. To the north is single family residential. To the south is the metro rail right away with Miami-Dade County. To the east is single family residential and the metro rail right away. And to the south sorry and to the west is business office. But it's only district. As mentioned earlier it is currently zoned as duplex residential which is R.T.63 is located to the north, which is low density residential. GU, general use with Miami-Dade County to the south. RS3 and GU to the east. And RO, which is residential office to the west. So the property had to meet six, a total of six review criteria, which include multiple properties, city initiated application, intergovernmental notice, rezoning reapplication, application requirements, neighborhood awareness, and the application did meet all of the review criteria. In addition, the application request is consistent with the following comprehensive plan goals, objectives and policies, including the future land use goal one, along with the objective 1.1 and policy 1.1.3, future land use goal six, along with the objective 6.1 and policy 6.1.1, and a housing gold 1 and the policy 1.1.1. So for the proposed zoning district, what exactly will it do for the property? How will it affect the property? It will increase the maximum density and the allowable height. specifically the, the density will increase from a 6 dwelling units per acre to 18 dwelling units per acre. And what that means for the site is that the potential maximum number of units that can be built on the site will increase from two dwelling units to a potential maximum of 6 dwelling units. The applicant has provided a conceptual plan that proposes a total of six dwelling units. And I'm a stress that the plan is conceptual and it will have to go through the city's design review board prior to building permit approval. So that's site plan is not being approved through this action tonight. The maximum allowable height will increase from 25 feet or two stories to a maximum of 40 feet or three stories. And the conceptual site plan submitted by the applicant proposes two stories with the main roof height indicated at 31 feet. So on your screen is an example of the conceptual site plan. You can see there are six units. There will be parking and culminated on site, a total of, I believe, 12 parking spaces, five of those being garage spaces for five of the units, and also proposal for some on-street parking. But it's important to note that all of the required parking can be accommodated on-site based on this conceptual site plan. Sorry Mr. the . . . . . . . . . . . . . . . . . . . . as it's outlined there seems to be that the spaces would encroach into the travel lane. Right, so again, this is a conceptual site plan and that will be fully vetted through the review process. But that is about the question, so thank you. So the site recommendation is for the City Commission to approve the requested application to amend the official zoning the official zoning map to rezone the 6540 minor lane address from twoplex residential, R T 6 to town else residential R T 18. The planning board, sorry, the meeting went before the planning board on March 11th and receive unanimous approval with the recommendation that the conceptual plan be updated to demonstrate all of the required parking on site, which was demonstrated with the plan that I showed earlier. With that, I am available for questions as well as markets. Colleagues, questions of staff and our consultant. Give me questions, Bill. I'm curious to see if we can recognize it. Thank you. I see that the planning board had the exact same question as our mayor, but I find it interesting that that was March 11th. We're here in April. It still hasn't been addressed other than to say that... Well, remember the site plan is not binding. Yeah. But I find it curious that we're still then seeing this come to us for six townhouse units that we would be approving kind of on the, it feels to me almost like on the fly. Am I wrong? I mean, do you, am I the only one that feels this way? Mayor, do you want to follow up? If you can, let the city attorney who wants to say something, let me recognize them if he wants to add something. Or you want to? I would really like to suggest you may want to hear from the applicant to see if they can address something. Yeah, let's just ask questions. Let's ask staff's recommendation first. Any questions about staff's recommendation, sir? Well, I just wanted to understand the parking requirement what actually was because I wasn't sure. I think I think he stated that the parking requirement is met with the parking provided on site. I think there's five garage spaces and then six or seven spaces. So the whole street parking does not reach there. It's two spaces for each unit. Is my understanding for whatever the staff report and they're providing 12 on site. And I think they were proposed on this conceptual site plan four on street, is that correct correct? Yeah, okay. Thank you No problem. If you can go back in your presentation to The land use criteria use for approval I think it was the last sheet. I had a question about that If you can go forward one slide. Oh There you go perfect., so how does this particular project advance housing goal number one? Because that that goal speaks to affordable units are is there representation these units are gonna be affordable? So specifically this is this is the goal within the comprehensive plan, but it meets the policy below which is to utilize the feature-line use plan as only map to a short diversity of housing type. So you are getting a townhouse product, which is another housing type within the city. Okay. So specifically for affordable housing, not to my understanding, but it is set up that way to reflect your comprehensive plan on the presentation. Thank you for that further questions. Sorry, just to go back on the parking. So it's two parking spaces per unit. Correct. So are these seven parking spaces? I guess I would call the east side of the property. Those are part of the project, no? They are, yes. Okay, plus the five individual parking garages, why do you need that on-street parking for? You do not need the on-street parking to meet the parking requirement. If you're showing, I'm imagining they're showing it because they want their, the possibility of having additional parking to service the development on-street. Correct. The required parking is met with, I believe, with the proposed garage spaces and the surface parking spaces operating. Yeah I was just wondering why. Yes that's correct and another reason why on street parking maybe desired is to also help facilitate any guests that may visit the future unit owners. Mr. Leifat? Mr. Dancer, Commissioner Rodriguez's question. This the zoning district for RTA team when it was amended last year they added a provision for properties that are 5,000 to 12,000 square feet in site that they provide on-street park for accessory dwelling units or location of a required spaces. So that could be a reason why there's on-street park and the conceptual plan. I'm sorry, in the conceptual play, I didn, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry Any further questions of staff? Seeing none we will hear from the applicant then we will open up the matter of public hearing okay. Is there here so we have a half the applicant? Good evening Good evening and thank you mayor commission and staff My name is Nicholas Fonds represent the representative for the applicant so me underline with 6540 man or lane Thank you very much for the presentation So SOMI, on their line with 6540 men or lane. Thank you very much for the presentation. So we are here, obviously asking for a rezoning to RT18 to bring us in line with the longstanding future land use of townhouse, townhome residential. Our intent is to provide a housing product or housing product type that is not necessarily in abundance within the city of South Miami. That is our goal here. Regarding the parking, the question that was asked, the intent behind the on-street parking, parking we were actually under the impression that the city would would be looking for that based off the staff recommendation or comments from the planning board we have offered to provide a covenant regarding the two parking spaces per unit on site and remove that Austrian parking regarding any other design questions. We also sorry so just to clarify there's there's as a covenant been offered formally so it has been they have been working on a covenant they have not formally offered a signed version it, but I think they intend to speak about it and we'll have it ready for second reading. I want to speak for them. But thank you. Yes. OK. The intent was to obviously provide that, especially at the time for obviously site plan approval when we came for that based off. I'm sorry. Based off Zoning Board boards comments. Anything further? Mr. Font? Good evening, thank you for the opportunity. Have you ever fought also something like, underline? So two quick things, the covenant that we will be proffering is to provide at least two parking spaces on site per unit to limit the height of the town homes to two stories, as opposed to the three stories that's allowed under the current zoning or the RT18 zoning, and we would be more than happy to proffer that we will not build the parking spaces on street. We do not prefer the parking spaces on street. If you look at the design that we have done, we have purposely tried to create the best street front that we can, right? So we've done the little stoops in front of the townhomes, we've done the little front yard, we're stepping them up to a three feet, just to give it that great feel. So if we could get that area that is shown as parking today as landscaping, we would definitely prefer that. So, and we also think that this plan, having one way in with all the parking sort of behind the units works a lot better than if you were to have your typical duplex with, you know, three or four cars backing up into the street from the front of the house so we think that this is a much nicer urban infill than a couple duplexes would be there. Thank you very much. Any questions we'd have to address? Shikai you're recognized. I'm not sure if it's required or not just a request. Is it condo or Oh, is it going to be sold individually? Or is it going to be rentals? I think at this point we're thinking rentals. OK. For the questions. Can we help you with that? Yes. I do want to help you with this. Do you want the site plan back on the monitor? If you could please put the site plan back up, John. If you can speak into the microphone, thank you. I appreciate it. Why speak to all of you when I could just speak to the mayor? I am trying to figure out these parking spaces and this back road that would access all of these garages. Concerned about impacts of the neighbor. Exactly. So I think where exactly is it in regards to the next door neighbor? It does happen. So this is a very tricky property in that as we know, it's a it's a pretty busy corner, right? There's no way you're coming in off of US one and the underlying, right? There's no way to come in off of AED, so whatever access you have will come in off of the western street, right? 66. So we have had conversations with the neighbor about the the driveway there and we do feel that one point of access is much better than having as I said before a condition that you typically get when you do these smaller lots on the busier streets bird road go, where you've got the traffic backing up into the drive. And it also happens along 67th Avenue in some places. And we realize that we've got commercial to the south of us. We've got an office building to the west of us. We've got US one to the east of us so it's you know We think this is a very nice transitional product between US one the Metro obviously is a big impact on this particular property We think it's a good transition from US one you know north to the to the residential partials So, is that an answer your question? So the answer is the driveway to end all the parking spots about to the neighbor? So I think the driveway about the neighbor, I think the parking is oriented south and east. Into that corner? Into the corner. So when I looked at this, one of my concerns and we'll have some more conversation. When my concerns was evening access and headlights. And so obviously this of the orientations that I could try to figure out, this at least had the more optimal effect of orienting headlights back towards the right of way as opposed to directly east into the abiding home. But we can have some more conversation about that. Further questions of the applicant? Okay, Mr. Fulton, we'll get back to you. Okay, let's go ahead and open up the public hearing. There's anyone who would like to address this commission on item eight. Mrs. the public hearing, please come forward at this time. I had my sign in sheet Ms. Hoffman, would you like to address us on the side of now? Mr. Lopez. Thank you. Good evening, ma'am. I would like to thank you. My name is Ann Hoffman. I live at 6611 southwest 79th street. I can see that property from my front driveway. Frequently the cars stack up trying to get out to 80th Street and they're stacked up way past 66th Avenue, even past 67th Avenue sometimes. My question is, okay, first of all, has this been approved, this change of zoning? No, man, that's what's before us tonight. And we'll be, before us again on second reading one more time. So we'll have a second public hearing on the side of us. Well, I'm sorry. In order for the zoning to be approved, it has to be approved twice. Today is an initial vote with the public hearing and there will be a second vote next month to discuss the same application again and here from the public on it as well. Okay, and the vote is with you all. Yes, ma'am. And not the community. And it requires, I believe, four affirmative votes. Correct. Four out of five. Four out of five. Correct. I'm sorry. 3 out of 5. My apologies. Only 3 out of 5. 3 out of 5. Okay. 3 out of 5 tonight. 4 out of 5 on second reading. Okay. Sorry. So I heard you all discussing the parking. And then I wonder has the issue of the congestion in that area because I do live across the street from a very busy office building. So has that been addressed at all? The traffic situation and the fact that if it's 18 and there's six units, what is it? Yes, so theoretically what that means, the designation would allow 18 units an acre. This is about a third of an acre. Okay, a third of an acre. And therefore no more than six units could be built. Okay. So there's something that says six, eight, seven, six units on it. I want to go on record opposing the change in zoning. I would question why it would be needed to change the zoning there. That lot has been empty since I bought my house in 2000 so that's 25 years. I understand they'd like to develop it. It makes sense to use it for something. I mean, we walk our dogs on it sometimes. But it seems like there is a move toward maximizing profits over the city of pleasant living, right? The idea of living being pleasant. Because when you have traffic stacked up and you can't move, you can't get in or out of your residents, that's not really pleasant living, is it? So what would be the reason is it just the revenue? It's just they're gonna make money. Who else makes The city makes money is it just that or do we talk about quality of Life quality of living in the neighborhood so What's what's the reason for needing six? I think this is not an application that we are sponsoring as a city. It's being brought forward by a private party. I believe it owns the property and so that's the right to make the request. The question I would have for you, if I may, while I have you here, is between zero, which is there today and six, which is what they're asking for, is there some level of development you think would be appropriate on that site? Yeah, I think. I had thought when this property was at one point in receivership, that would be a great thing for us to try to acquire. As a park, unfortunately, that did not happen. So knowing that that's not the realm of what we can do today, I would ask you as a neighbor between nothing that is, you know, at times that I drive by it is poorly maintained on occasion, right? Yes. And something, what would be the something that you could think would make for a harmonious existence? Well, I think the current zoning that allows for what, one or two? Just two units, yeah. Two. Two units. Okay. So that would be acceptable, I think, for two units there. But anything that you put there, so I want to increase the traffic. So just the bigger, you know, the more spread out, the higher is not optimal because of the congestion that already is there and also because of things like beauty trees, for instance. Okay, so thank you. Thank you for coming. It was often. Mr. Lopez, you recognize. Hello, Jason Lopez, 7730, South was 65th place. I've lived in South Miami most of my life. I grew up here. It seems to me that you guys have two neighborhoods asking you to control the development in front of you. Pretty clear here that the residents is the residents, the people that live in the residential neighborhoods are struggling with the folks that are coming in trying to make a dollar off of us. That was very clear in the previous conversations we heard. And I can tell you that in my neighborhood, this proposal that was put up is not taking into account my actual neighborhood It's it's taking into account a bunch of lawyers speak and a bunch of stuff on paper that people can make money off It's the entrance to my neighborhood. It's always been there the plan that they're proposing is going to cut every one of those trees down But both royals, which are as old as the city of Miami probably All four mango trees are gonna go. The pointy end is gonna go. And then most of all, it's dangerous. They're going to be putting up this monstrosity on a corner. And I was very glad to see that they took the parking off of that initial road on the backside as you enter manually, because the previous proposal they had had six driveways backing up. But now it's all going to the back of that property. When you build a two and a half story building because remember they're raising it up for it to look better, you are going to be creating a blind spot around that corner on manually. And I can tell you living there now it's already dangerous. Rush hour comes, both directions, we have people piling through there. And so this facility is going to make it so that it's not going to be 12 cars. It's going to be 18 cars. This is Miami. It's a three bedroom house. Could be 22 cars. We don't even know. They're going to end up parking on the street. It's not a safe place to park. It has never been used for parking. People used to park further on the interior of the property. But since that sidewalk was put in, it's no longer used for parking for the professional center. And so I imagine the trash trucks that come by. All of the different services that are going to be included in this property are not taking into account the actual flow of the space. I respect that they want to make money, but it is our neighborhood and it is an entrance. They're saying it's keeping with the neighborhood. It's a single family residential neighborhood that they're entering into and they're getting by on a technicality because there's a professional center across the way. This is an entrance to single family residential neighborhood. And I realize, Sid your South Miami needs to make more revenue, but there is a middle ground. This thing that's being proposed is greedy, and it's not taking the residents into account. I ask that you consider the residents in your decision making. Thank you, Mr. Lopez. Is there anyone else who would like to address this commission on item number eight? Yes sir you're recognized. Come forward. Jim D'Shane I'm also Jim if I can get your address as well for the record please. Thank you. If I can get your address for the record please. 66 a lot of salt plus 79th Street. Thank you sir. Yeah. I would like to make a plea for your understanding the fact that this is all just a residential neighborhood. There's kids and cards, people walking their dogs all over the place. It's a sweet neighborhood and it's all residential and they want to put this thing up there. For a money-based money maker. And it's gonna affect the safety. They got a stab sign on 79th in Manor. They just blow through that thing. It is just a decoration. It's dangerous enough there. It's a cutthroat. They cut through manners, a cutthroat thing. Traffic's bad. It's dangerous enough already. You know, people on bikes, it's restantial. Put a two-unit thing there, you know? It's not healthy for the neighborhood. And it's a sweet neighborhood. Just, you know, it just, it doesn't make sense. You know, it's just common sense, you know? I mean, they're out to make some money. You know, so, that everybody else is dispensed. I mean, none of the residents want that there. You know, so that everybody else is expense. I mean, none of the residents want that there, of course. Who would want that there? You know, so I just, you know, that's my feeling. Thank you, sir. Appreciate it. Is there anyone else in the public who'd like to speak on the side of me? So please come forward. As well. Good evening. Shantae well six you one oh two southwest six a street. I will reiterate on record my concern with this type of zoning because I feel as though if you all move forward with this this is going to now set the precedence for you guys to do the exact same thing that's being proposed on our side. And I do not want to see that happen. This is supposed to be the city of Pleasant Living. We are an all-American city, and the quality of life matters, the heat index matters. We don't need to increase the capacity. I am definitely someone that is pro business, I'm pro money, but not at the expense of the safety. And I've been through there. I went to a Luttle Elementary School. So I go to big chief, like this is an area, many of the residents we all go through. And you can't like unsee like the concern and the safety issue that's going to be about, like he said, people blow right through that stop sign. It's like a suggestion. And my concern is that we're not fully taken into account what us as the residents, those of us who have been here and our families have built the city and invested in the city. Please do not turn this into a concrete jungle. Please do not allow our city to be overdeveloped. Thank you. Thank you. No clapping if you want to show some support, you can raise your hands and shake them. Thank you, okay. Anyone else who'd like to address this commission? Anyone else who's Zoom please your vote your hand. Okay seeing no one else in the chamber and no else online we will close the public hearing. Colleagues any discussion? You recognize sir? Me, Mayor? Yes, I'm, sir. Look, the quality of our neighborhoods are all integral of what we're trying to go do. You know, I think that we're all trying to protect our neighborhoods from a little bit of expansion here and there. I think Miami-Dade County and Miami and South Florida has suffered a lot with the amount of demand that we've gotten down here. Right? So what happens when we have so much demand, the prices go up. It gives you the ability of people getting priced out, right? This is a tricky situation because you're literally right next to a business center, you know, an office building that has during the day crazy amount of parking. My kids go there to have worth the doneness appointments. It is nonstop. But there's already part, there's already parking issue there. I think the city, I think, I think we should welcome the ability of having more neighbors in specific and smart areas. Be welcome to to our city. We're talking about a difference of two units versus six units. In that corner, the traffic is not going to be crazy more amount because of those four extra units. The traffic that's already going through is coming from the south. It's not something that we're controlling, right? We already do a decent enough job of enforcement there, no left turns, trying to make sure it's hardest possible for traffic to get through there. I do agree with the concrete jungle. We're all not big fans. Historically, on the record, we do not love trees being cut down. So I will try to make sure that we work with the architect to make sure we keep as much landscape and tree scape, especially the mature trees in place. If we need them, we move then we'll figure that out. But those are the three comments I really wanted to touch to because I think that we're struggling as a South Florida, you know, community, not just South Miami, but a community in general where, you know, we want to protect, but then we get upset when prices go up and people get priced out and people leave. We have to find a balance. This is a very specific lot that might cater to that. So, you know, that's my opinion, particularly, on this particular lot. For the comments. Could you start, do you Can you have some? I have a commission you recognize. Okay. I'm having a hard time with this. I continue to look at this one way and the other. And anyway, I look at it. I can't make it work in my head. I'm looking at six units that feel like they're crammed into that property. When I look at the impervious space, I just see, I mean, I understand it's not the shape of a diamond, but I see essentially the shape of, you know, whatever that is, where it has a little strip of grass, a little strip of grass, a little strip of grass. I'm not sure if I'm reading this zoning chart properly when it's saying that each dwelling unit is going to be 2754 square feet. I don't know if I'm reading that correctly. My mark is correct me if I'm wrong, please. If you know or the developers, if you know, it just I think we might be looking at an unintended consequence of a zoning change. And I'm sorry, I know your first name, but I don't know your last name, Shanti. And she continues to bring it up. And there's, while I might not agree 100% with what you're saying, there's a kernel of that that continues to stick with me. And when I see this, it's what I think. There's, I feel like we're trying to fit square pegs into round holes on some of these properties. And this is one of those for me. And I think it's great that they want to stick to two stories instead of three. It is in character with the area. I you know the shifts and grooves that the developer is talking about wanting to make simply makes it agreeable with the rest of the area. But I think there's some work to be done here and I wouldn't want to be the one to say what that is. I just know that the way it is right now doesn't work for me. Like there's some parking spaces. They don't fit. We'll figure it out. There's not this. We'll figure it out. I can't do that. Shardry, yes. So I guess, again, I'm like mayor Bonich. I, sorry, sorry. I meant to say vice-fair. Commissioner Bonich. I'm trying to see how it fits. I mean, I'm in the world of construction. I understand. and I also understand what Commissioner Kaye is saying. I'm also thinking that, you know, in other areas in our city, we use this concept of town homes to separate the commercial district from the residential district as a buffer. So that's how the whole city's playing. We're doing it in downtown. We're looking at 60-second Avenue. And the brownstone concept is actually what we're trying to get from a lot of these builders or people who want to, who are on these properties of the product that they're trying to put together. So I understand the neighbors and the residents of what you're saying. The stop signs. I don't see and trust me, I've walked this. I know that how everybody walks their dogs and how everything goes in this neighborhood. The concept, again, I say it again, the concept that we're doing, this is not just for this lot, this is something that we are trying to use townhomes to avoid buildings and avoid a concrete jungle. We're not trying to do buildings, these are two-story town homes where two stories that the developer says that they were going to two stories. So what you see here will be less. Is there work to be done? Well, this is not the final product. I think in my opinion, also the trees. I do agree. We have some of these trees that have been there for a while. In the footprint of the building, there's no way those trees are staying there. I mean, it's just logical. So, what can we do? Can we relocate it to the back of the property to give shade? I don't know. I just, I'm in the place where I, the product is what, again, what we're looking for to buffer into the residential areas. I mean, that's what we're trying to do with town homes. Or someone buys us and tries to do a building. That would be worse, right? Exactly. So, I just think it needs to be worked. I think the owner of the property of the architect needs to work this out, show us where the trees are gonna go, fix the parking of what you're gonna do, bring it down to the two stories and give us what this, because this is not what we're looking at right now now is not going to be what they're going to apply or submit. So we would, I don't know, I would need to see something before we, I proceeded with changing the zoning. Yeah. So from my perspective, you know, I ran with the idea that we would grow around our town center, right? Our downtown, either the transit station. So I'm a big believer of growth and doing whatever we can to drive development there because I think that's where it's most appropriate. With these applications, I see the opportunity that the applicant is asking us to kind of walk down the road with them on, but I share the trepidation of a lot of the neighbors because it's a transitional area where a rezoning without any commitments certainly portends a lot of negative things, right? It's the same way I feel colleagues, we talked about the air south of 74 street we were talking about the rezoning for the town center. While we know a lot of good thing could come from that possible growth, the possibility for conflicts that are very real with single family resentful neighborhoods. And I kind of feel that this property is the same way. I always imagined that this would have been redeveloped with a small, you know, something like an office building, two stories at this site that would have seemed to me to be the obvious development. I think town homes here could work. What gives me the most discomfort about the applications is presented is it's not presented with a site plan. And just like I had mentioned before in that other area south of downtown, I would love to I love for us to consider rezoning when there's a site plan in front of us so that we have a sense that we're not just approving the rezoning but a project that actually functionally works on the property. So I think, you know, I want to commend the team. I know the people that are, I know the people, yes, I'll recognize you, if you like. I'll finish the comments. I know that Mr. Font and Font Family and the team that are here and we're still at the point are good people. They are well-intentioned. I frankly like the design aesthetic that you are moving toward. I mean, it's just the French Village Project, just in high pines, a very nice aesthetic. It could complement the single family there, but what I don't see here is a commitment to doing it. Right there, you made representations that there would be a covenant to be preferred, but I think there are a lot of conflicts still with preserving canopy that we don't understand based on this conceptual site plan. There may be a better balance to be struck I terms of the total number of units. You know, it'd be something shy of six would be better suited to integrate with the balance of the neighborhood. So when I think we're probably the most prudent thing from my perspective because I think I, you know, I saw Mr. Lopez shake his head in the back there. When I saw this site come onto the market a few months ago, my thought was, God, that would be a great site. It's for us to pick up. We didn't have the bond. We didn't have the bond approved to do it, so we didn't have the capacity. We don't have the capacity to do it, but I would have loved this happen 12 months from now, 18 months from now, it would have been one of the first things want to pick up a way of land acquisition. That's not the world I'm living in. So, but I think the current zoning clearly isn't adequate because something would have happened here in the last 25 years if someone could make the economics work. the world I'm living in. So, but I think the current zoning clearly isn't adequate because something would have happened here in the last 25 years if someone could make the economics work around the land costs with two units. I don't think that's reasonable. But what I think would probably be the best thing for us to do, and Mr. Fawn, if you're meanable, I would like to move to defer this item maybe for 30 days and allow the team to maybe work on a binding development concept, have some conversations with the neighbors, and see if we can get to a site plan, to an approval of a site plan with the rezoning so that, or at least a profit covenant to a site plan. So if we approve a rezoning, we know that what we're getting in exchange for, and the neighbors have a sense that there's a commitment being made around the product that's going to be developed there. So those are my thoughts, colleagues. I don't disagree with what you just said. I just, in the character of being fair, the transition spots that we've always spoken about between business and residential, having the opportunity to have these opportunities, these opportunities to have these type of homes in this place, fits this character here, right? We were doing it throughout all South Miami in very specific areas, very smartly put in places that we think the transitions apply. Manor Lane historically has always had the transition between residential homes on the north side and businesses and apartments on the south side all across Manor Lane. There are some few homes obviously on the south side of that but historically it's been there right so this this does not for me complete the out of character with the area. I'm a big fan of green I'm a big fan of keeping our our residential. It's just this specific spot fits the character. Commissioner, I don't disagree with that observation. I think that it's, again, I'm just a sugar with the earth either. No, the geometry of the site in particular makes the execution of the project more challenging than a square rectangle, right? I think here, you know, the the, you know, I think, you know, to the applicant's credit, I think it seems, it sounds like, because I haven't seen a prior site, and they've evolved the site plan to bring, you know, the traffic to the back of the lot. I mean, when I looked at this, again, without the benefit of talking into one, my first thought was, okay, people are gonna access and circulation and some functionality issues are probably worth exploring. I think there's reason for the neighbors to have some consternation about what's here. My consternation comes from the fact that there's just not a binding site plan. I think if I had product that was designed at two stories, maybe something less than six units, that kind of address these conflicts that had for me a survey, a tree survey, and said, here's how we've mitigated the conflicts to preserve the canopy. I would feel much more comfortable approving the rezoning, but we don't have that information right now. We're being asked right now on first reading is to adopt a rezoning without any commitments. I know there have been representations about future proffers. I look forward to those. I would think, again, I don't know if there were three votes to support it tonight. If there's not, my preference would be rather than send a well-intended developer away. It sounds like development team away. Let's give a chance to kind of work on some of the issues and bring something back that strikes a better balance. Yes, ma'am. I would urge the right side of the day to seriously consider the mayor because as it stands right now, I would be a no vote if we don't vote to defer. So if that helps, doesn't help you guys make a decision. I just want to give it to you. I said, I think we need, I think the developer needs to work this and bring it back with the two stories, not three stories show an actual depiction of what's going to happen. Maybe, maybe six doesn't work, maybe five works. Where are the trees going to go? Like the mayor said, an actual site plan showing us what it is. You know, again, like Mr. Kaya said, like Commissioner Kaya said, and like we've said, are looking our look to transition from commercial to residential. We've always spoken about the townhome's product because it's residential, it's smaller, and it doesn't impose on you like a building would. Because if we put there an office building, three or four stories with lighting all over their parking, you know, you're not gonna like that because that's gonna just, at night, you're just gonna have these parking lights, dwelling over your house. So this is a much calmer, nicer looking, possibly increased property value, but at the same, so there are things we need to work out, but as of right now, the way it stands right now, I think the developer needs to go and just provide us a side plan, show us where things are going to go and bring us what's actually going to be there. So Mr. Fought, you wanted to be recognized to say something if you'd like the opportunity to let you add a few comments to the record, sir. Thank you again. And if there's any way that I can ask, if we can put back the land-used plan that was up there before. So first, to address the commissioners, no, the land-used plan. There's no work working here. That one right there. So first to address the commissioners concern, we would be happy to defer the application. We're here to work with staff and with neighbors. I have been, I'm not a resident of South Miami today because I've moved a little further south, but I grew up in South Miami from the time I was eight years old until I moved out of my parents' house after college. So, it's a city that I've been in a long time and we want to do something correct and right. And we are architects, so we do want to put out a product that we can be proud of and the city can be proud of. If you look at the plan on the left-hand side and I know it doesn't show below us, but everything below us is Dave County and it is a commercial zoning. And I am sure that that property, which is a beautiful corner piece right is going to end up being some RTC development at that point right. If you look the office building which is in the sort of purplish color and then look at the orange that you see there that's not something that we've done to accent the property that is the land use that has been with the property since day one. So somebody a long time ago said this is a transition piece. This is a piece that needs a little more density than the yellow to the north of it, right? It is a transition piece as Commissioner Coye pointed out. So we do feel that this property deserves a little more than a duplex. The city did not have a zoning in place at the time to accommodate that. It does today. We think it's a great product for the city. We've seen it go down the street on the Dave County side and how successful that has been and how popular that product is. And that's what we would like to bring to the city. more than happy to work with staff to get this to the point where we've got all the parking on site which we do like to bring to the city. We're more than happy to work with staff to get this to the point where we've got all the parking on site, which we do now, we take off to parking below and to keep it to two stories. We will work and we have to mitigate whatever trees we take off, right? So obviously, as you all know, that's a huge process. We find out how big the trees are, what we need to take down, we need to replace them with a certain amount of canopy, et cetera, et cetera. We're happy to do so because that will benefit the property as well. So hopefully that address some of the concerns that you guys have. We're happy to defer this for another 30 days. Okay, so I think the deferred would be to a date certain which would be our first meeting in May. Do we have a date for that meeting? May six. May six. Is that acceptable? It is. Okay. And again, if you could speak to a couple of the neighbors and you know, obviously evolve the concept again. Thank you for bringing forward. We do want to see this kind of transitional product all the edges and neighborhoods which want to be sure it's executed. So it has the, I guess the greatest benefit. Okay. Thank you. Thank you. I'll move the deferral to May six. All seconder. Okay. Okay. Any further conversation on the motion? Seeing none, Madam Clerk, if you can call the roll, please. Yes, commissioning, how you? Yes. Commissioning on Rodriguez. Yes. Commissioning on needs. Yes. Mayor Fernandez. Thank you if you can read item 4 please. I don't for air wills we should the Maran City Commission of the City of Southland and Florida are proving or denied an application for final plan puts one to a section 20-4.2 of the land development code seeking to survive a property within within the low-density single-family residential RS3 zoning district located at 5865 North Kendall Drive and the residential modified state EU zoning district for the village of Pinecris for a located at 5865 South Wales 88th Street. Thank you Madam Clerk. Colleagues just looking at the hour, has everyone had a chance to review the application? And do we need a staff report or staff presentation on the side of? No? Okay. Any questions of staff on the side of? No. Okay. Is the applicant here? Ma'am, good evening. Would you like to add anything for the record? Yeah. Okay. Thank you. Just if you say you're in the anything for the record? Okay, thank you. Just if you say your name and add to the record. Sorry about that. Veronica Barba 5865 Southwest 88 Street. Thank you for being sorry for the delay. This is a public hearing item. So what we will do is we will open up the public hearing on item four If there's anyone in the audience who'd like to address this commission on this approval or an or an aisle of a final plat at 5865 North Kendall Drive. You are welcome to address this commission at this time. So you know what in the chamber Madam Clerk is there anyone online? Anyone on zoom please raise your first your hand. So you know online or in the chamber we will close the public hearing. I might only comment to the city manager, you know, every time we see an application along this corridor, I have a heartburn for the people who live on the stretch of, you know, land that's divided by two governments. It's hard to deal with one of us. I can imagine dealing with both of us is tough. I have processed a number of plots in my life. I would imagine it's gotta be doubly difficult to do it when there's two jurisdictions. So I apologize. Mr. Manard, I would just say, I think it's worth, I think we talked about this show, I can leave before, but I say it sincerely now. whether it's really worth us having a conversation with Pinecrest about maybe the annexing and having them at annex this portion of the Kendall Drive Court or because I think just from a practical perspective, probably can deliver better police service and basic services than we can given that our men and women in uniform have to traverse a canal to respond to calls. And again, there's just joined jurisdiction here, so it can create substantial confusion. So I just wanted to tutorialize on that. We probably should have a discussion about it at some point, but just wanted to add those thoughts to the record colleagues, any further thoughts? Yes, ma'am. I wonder if everybody else agrees with you. I know I do. Yeah, I do. You always want more. Yes, ma'am, you're recognized please. So if into the microphone if you can, I do your name and address again. Veronica Barba 6031. Well, my where I live, 6031 Southwest 88 Street. So we live on that street. My in-laws live on that street. All of us are in there. And I have to say the police are super responsive when we've needed them. And just as recently as Saturday, so that's one of the things that I did want to say is that I do enjoy being part of the city of South Miami. But I can see from an administration, it's probably difficult. That quarter, like my house, 6031, I think is all South Miami. I mean, as it gets closer to 57th, it kind of... It's right down the middle or more portion of the lot. Yeah. But this particular lot, 5865, only has like a little pineapple or a little pizza cut out, like less than 10% of the property is that the village of Pinecrest. But again, South Miami, I enjoy village of Pinecrest. I have no idea. But I do know that we've never had a problem with the police or the services that we've been given. And I've been living there for over 20 years. Appreciate the feedback. And it's my comments were not a reflection. I was not wanting you. Mayor's kicking you back. I don't want to kick anyone anyone out, but we're not wanting it's fine because it's all I just think I look at the map and I wonder how this happened right from the beginning Yeah, you would think it would be down the down the down the middle so look at her man There's a conversation that seems to me that needs to be had about how we how we how we either how we saw this issue because I feel badly for people to go through two jurisdictions to get their platform to improve anyhow thank you but I must say that your family is like the mafia of 88 street when I was campaigning it was like scooter barbuck scooter barbuck and I come off you but there's like 6,000 of you on that street. Or at least it felt like 6,000 of you when I was campaigning. We welcomed you to the city, not with us, telling the comments. Thank you. Yeah. We don't want them off you and stuff in my head. Exactly. There you go. Thank you again. OK, colleagues, for the comments. It's fair. is there a motion? Oh, is it a closet? It's a word that we close the public hearing, we just let her come up and say. Okay colleagues for the comments. Sir, is there a motion? Oh, there's a quasi, do we have, it's a word? We close the public hearing, we just let her come up and say nice things about our city before we apparently try to kick her out. I'll move it. Okay, thank you. Motion by Commissioner Boone, second by Commissioner Coye. Madam Clerk, if you can call the roll please. Yes, Commissioner Boone. Yes, Commissioner Rodriguez. Yes. Commissioner Cagui. Yes. Mayor Fernandez. Yes. I know pass its forward. Congratulations. Thank you. Good luck. And we love you. We just redo. Thank you. Thank you. I'm so happy to have some ideas. Thank you. Okay, we'll go back to regular orders. Our motion to approve the minutes of March 5th and March 18th. You skip the presentation. I'll move it. Oh, sorry. Let me just do this quickly. We'll go back to the presentation. Okay. Go ahead. I'll move it. Great. Is there a second? of March 5th and March 18th. You skipped the print. I'll move it. Oh, sorry. Let me just do this quickly and we'll go back to the presentation. Go ahead. I'll move it. Great. Is there a second? Second. Okay. Madam Clerk, if you can call the roll on the approval of the minutes. Yes. Or show them a approval without objection. Thank you. Yes, thank you. Okay. If you could read item E1, please. E1 is a summary park parking lot design update, MNJ engineering DPC. Thank you so much. This is Dr. Harlow. If you could read item E1, please. E1 is a parking lot designed update, MNJ engineering DPC. Thank you so much. Mr. Director, how are you? The park director comes up. As we've discussed over time, that the parking layout at that park is very challenging and it was always the intent to take a look at that and identify some improvements. We had a lot going on at the time so we're bringing it forward. As you know, we have somebody that's taking a look at that for us and so there's an interim report of where we are and get some feedback and certainly we're going to be doing some more work but just want to bring you into the loop of what's going on with the review of Parking Operating. My only criticism of this report is this picture. That's it. Yeah, it's the old picture. Yeah. I knew you were going to see it. Thanks. Mr. Rector, you recognize. Good evening. Good evening. Thank you, manager, and good evening, again, mayor and commissioners. So joining me this evening is John Shrek, who's Senior Vice President and Project Manager is attending virtually and here in person is Miss Karen Files' feet. The least, not the least, the least, who's the Project Engineer. So just wanted to introduce her, or come on up, and she'll give a brief presentation on where we are today. Thank you. Thank you, Quiz, and good evening, everybody. I'll try to keep this short and sweet for you guys, because I know you've been here for a while, and I'm part of one of the home. Thank you. So I am glad to be able to give you guys the update so far what my firm has been working on for the city of South Miami. This is a very popular park, especially with all the improvements you guys have been doing. We've been looking at expansion of the parking spaces where it makes more sense, but also the safety of pedestrians and the kids. So as of the end of March, we're only about 55% complete. So total overview of the project is the expansion. So we're thinking about adding 60 additional official parking spaces. We know that the residents and the visitors kind of park where they're able to be fit. So we took that into account as well. But we're also focusing on safety, accessibility, and just connecting visitors all throughout the entire parking area. So for the parking spaces, currently you guys have 90. We're proposing an additional 60, making it entirely 150 parking stalls. In order to do this, we are thinking of expanding the north corridor portion of the park, so that would have, and repurposing the median on the southwest 58th Avenue. This would have an environmental have an environmental impact of removing 27 trees, but we are proposing an addition of 38 trees all within the parking area. So this is a quick run during of the park. You can see here where the median on the east side of the park is repurposed to have parking sols on both ends. We kept the ADA accessible parking spaces kind of within the same areas, but on the west side We added an additional ramp towards the middle For lighting right now we are proposing 15 new light poles all with LED lighting. That's more cost-efficient, but also overall overhead costs. So this is the existing photometric plan of South Miami Park, just the parking lot area. There is a single pole towards the entrance. You guys have a lot of games at night. It's not very safe for kids or petitions. It's perfectly safe for the record. Okay. It's really black way. Is anybody in case anybody wants to sue us it's perfectly safe correct? Mr. C. Attorney? It's quite safe. That is a very, who meets every building code and life safety co-sender. I do not want the record. Can I strike that for the record please? Sorry. So for the proposed photometric plans you see here it has elimination all throughout the parking area specifically where there are also ramps with very little overhead spillage over to the neighboring residents. For the pedestrian safety and access routes we wanted to dedicate pathways connecting pedestrians all throughout the entire parking space, not just focusing on the parking areas and kind of where they're adjacent to, and also include traffic calming devices like speed humps. So in this plan, if you see illuminated in the light blue, it's kind of where pedestrians are able to access and come into the park. So right at the beginning towards the entrance, you have the extension of the sidewalks that come into the park on each side that go down a proposed sidewalk towards the east. That's adjacent to the elementary school and also a whizing path that goes into the playground. There's also a proposed path where we're trying to connect the playground into the athletic field. This is an area where people naturally just walk up the berm. So wanting to actually visually delineate a space for them, as well as create an accessible route where everybody can kind of also connect to the current construction project of the restrooms. So this is a rendering of what that ramp will look like towards the middle, where it would have steps, and then also wrap next to it. For security, we're trying to do the Turing video system. It's integrated with the design of the entire parking area. It can capture vehicle images and also license plates. And you can have real-time surveillance also a CUB based system. So you're able to review footage 24-7. For the enhanced entrance, this is a rendering of what we're proposing. So you have beautiful columns cladded in the keystone. That's something that's kind of carried throughout the park. You have it in the picnic shelters, but also on the exterior building of the restaurants, a black aluminum picket fencing, and an artway along with the South Miami logo. Before landscaping, the project will meet full tree mitigation requirements. That's set forth from South Miami, but also Miami-D County. So that would include the planting of 38 hardwood trees that are all native to South Florida. And additional vibrant shrubs and flowers. So some of the hardwood trees and shade trees that we're proposing are what's currently at the park as well. You have live oak, gumballimbo, silver buttonwood and wild tamarind. And these are a couple of the native low maintenance shrubs. There are also salt tolerance that we're thinking about planning throughout the landscaping. Over our cost. maintenance shrubs and there are also salt tolerance that we're thinking about planning throughout the landscaping. Overall costs within our design progress we're thinking of range from anywhere from 850,000 to a million. That is that number inclusive of design costs or is that just the hard construction costs. Hard construction. Okay, so what do we have to add for design? Design cost. We have a contract for 134. 134. Okay. Okay. Questions? Good. Thank you. I think I can be sure to go on each first. We'll see you second. What are we looking at timeframe? Why? Time frame for construction. We're looking anywhere between four to six months. That's something that's more methods for the contractor. But we are proposing where the parking lot is fully operable just shutting down particular sections at a time. And you're part, you said you're 55% complete with design. In the progress. When do you envision that part being done? That part should be done in what June? Yeah June. So then you're talking June plus. Okay thank you. Thank you. For the questions commissioner Guy. Yeah can we go back to the slide where you have the parking rendering? Well the side planner. Yeah I think the rendering of the side plan for parking. Yeah this one This. Go back up. No one will work this way. Yeah, so what's your thought process on how we're going to have dual lanes on some of these areas here? You know as as we've struggled, especially some of these parking spots on the on the west side of the parking lot there. They're very tight Do Dual access going back and forth on traffic is difficult and you're gonna have that same problem on the east side of those parking spots as well. So actually it's hard to see here, but Southwest with the avenue was widened. So it comes more into the green space of what's actually existing. I think currently right now that road is only between 19 to 20 feet and here we're proposing what you guys have in the other areas which is 22. In terms of the turning lanes where you're more so on the medians around, we're proposing mountable curves. So you see them a lot and on like traffic circles and highway applications where if there is a need that's more so for turning vehicle access for fire trucks they're gonna be easily be able to maneuver throughout that area. I would just look at the traffic clothes that we have currently it's it's very difficult to come in back and forth or drop off for the kids you mount a cars that are stopping. When there's not that much, like when it's at capacity, it's gonna be very difficult. So I would suggest that we go ahead and look at the traffic location to go all the way through on like one way. Oh, one way, okay. So yeah, I want to ask, to clarify, see, you want them to examine a one way traffic circulation pattern supposed to dole the rocks in one moment, okay? It's a good idea. Hi. Hi. So I was actually my daughter plays at South Miami Park, so I was dropping. And on the South side, people park along, which would be the skinniest road there. Park along the South side of it. It was a fire truck there the other day. Fire truck was telling Robert because the cars were coming all the way to the curb where they couldn't turn. Yeah. Some kid got hurt. It ended up not being an emergency but I was there when with Robert when the guy told them like I'm going to take the cars out next time you know if we have to get out an emergency so how do we address the people parking along that? And I know they were giving tickets and all that, but people still parked there. Yeah. Some contract. I think something that we can do as a design firm is that we can put entire no parking striping along that entire South corridor. We do show it as a one-way, just because we know that it's used for parking. That's why we didn't expand it into also include parking on that area except for that small portion where there's a maintenance access. So that is something that we can include. Yeah, I'm just letting you know that that was an issue that it came about recently. I know that's the biggest issue right there. So I have a couple questions regarding this. I plan my biggest concern is this park is pretty under landscape generally. You know, to, to Quentin, I think one of the complaints I've gotten most about what we've done is that the existing shade structures over the bleachers really do not provide much shade when you're sitting more than above the first or second row. So if you probably need to look at not sure when we designed that whether we looked at how the sun travels across and they're actually structured by here that they get very hot Prepare to are out there on the weekends So my concern here is the biggest thing is we're moving 27 trees. I'm not sure are those are these mature specimen trees that we're removing I mean, we are nine that are mature specimen trees. Okay, so I mean, and where are they located, if you can highlight before? Most of those are located towards the north end, where we are expanding. Okay, so I mean, how many parking spaces will we lose if we kept those nine mature trees? 22. 22. So we would basically net 38 spaces as opposed to 60. Yeah. Okay. Um, you know, I, uh, that's a conversation we should have, frankly, whether it gets ma'am. But realistically, where those trees are, would people be sitting there? Would they don't hope anybody where they're at? No, but I mean, they do, but I mean, again, the point is we want to just, I mean, again, lower, lower the general, we made the decision for operational purposes to turf the play field, because we have 900 kids in that program. And so I just want to make sure that we're not creating more of a heat island there. Do we want to then instead of, I don't remember the numbers so don't kill me, but instead of like 38 trees, do we wanna maybe put a little bit less and get bigger trees? I always think of you when you're like, I don't wanna tree that's like two wide. Yeah, that's correct. Like I don't wanna tree that my grandchild will, you know. So that's, so that's, so that was the good of me, the core layer of my comment, which is, I think there's a conversation about keeping them or are these nine trees candidates relocation into other areas of the park. And then for the 38 hardwood trees, I certainly do not want to see two inch DPH or four inch DPH trees. I want something that's close to mature, right? So that we're getting shade day one. And I think, you know, we had talked about this before when we were out there for the opening, the air is right now in between the playing fields. So if we need to expand the scope, and on the west end of the park, closer to the playing fields, are there opportunities to add more canopy trees there as well to just kind of, again, soften the condition? I mean, we made this decision to turn it for, I think very valid operational reason, but I do not wanna be a cavalier about getting rid of specimens trees and creating more of a heat island effect there. The other thing I don't know if we've had any conversation or if you've looked at if there's a way for us to optimize our use of the adjacent parking lot and integrate it into the operation of this facility, you know, after hours and on weekends, I do believe there's an actual parking lot just across the fence line right next door. You know, I don't know what the inventory is there. If we've analyzed that again, this is one of those opportunities, I think Mr. Manager, where we can immediately go to the school system and say, hey, we're gonna upgrade your parking lot. Let's have a cross use agreement for that facility. And maybe we can still create 60 spaces of inventory just not all on the footprint of our park, right? So, you know, I would think if that's something that the design isn't so far down the field that we can look at that as an alternative to maybe removing some of these specimen trees that would be something I'd like for us to consider because I think we've had a lot of discussion about trying to see how we could integrate this park with the school and this might be the first opportunity to start some tangible progress towards that goal. I will be able to personally answer that for you but definitely go up to my supervisor and we can have conversations. Related questions in terms of the cost not to you but to our staff. Mr. City Attorney, you know, we to the chagrin of my colleague to my left enacted a school zone camera enforcement program and you know there are this is a park that is in many ways a safe route to the neighboring school. Is there any way that we can use those resources which are very limited in terms of their application, to actually build some of this connectivity, you know, through the park to David Fairchild Elementary, particularly the perimeter enhancements, you know, I think they show some intersection or, you know, speed mitigation elements on the periphery of the park on the west side. I was imagine that was at the image on the west side of the park. I think the one you showed that had the kind of the track the street and the speed hump. That is actually for the east side of the park. That's adjacent to the school. So again, I'm just wondering whether there's a chance we think about how we fund this because I don't think this is in our capital program as much as I would like it to be and we can do it right away. But is there an opportunity for us to leverage some of those resources to pay for portions of these improvements, particularly the pedestrian connectivity parts. Since we do know that we did get a lot of requests to keep the fence on the northwest side of the park open so people can actually use the park to get to the school off the grid. So, okay. Yeah, we'll do that. Did something for us that I don't need an answer, but just something to think about. Yes, ma'am. That actually sparked something in my head, because when I was looking at the sign that said, South Miami Park, I was thinking of Marshall Williams in Park. And there's a school there. It's a head start, correct? The preschool. The preschool. It. The head start. The state albums. Is that the one? Is it can the funds from the cameras be used next to a head store program? So federally funded program. So again, I again, I know that we know that the statutory authorization for how we use them on these very narrow. I certainly know recall that we can fund school crossing guards. I thought we could fund certain pedestrian amenities that enhance connectivity to schools, but I think it's a, yeah, I think it's the extent that we can. It's not a terrible idea either. So yeah. Maybe we can use some of it for the safety stuff that we might need for the park. No. Okay.? No? Not have... Do we not have any money set aside for the construction of this? No. Once that by the time. Okay. Further questions to the consultant. Thank you. Okay, so you know, thank you for the presentation. I feel good to work. Appreciate it. you the . . . . . . . . . . . . . . . . . . . . . . . . We have a couple new programs in parks and rec. We have a women's self-defense class. It's being held at the community center every second Thursday. The residents get that class for $15, $30 for non-resident spaces limited. So people should sign up quickly. We have youth flag football that begins April 6th. There's also a 10% resident discount on that program and they'll be playing games on Sunday at South Mamie Park. Early summer camp registration is also open right now just for South Miami residents through April 20th. After that, it's open to the public. That program is $50 a week. Anyone with small kids knows that that is a great price. That's for South Miami residents. On the event side, we have our last so many second Saturdays of the season. Our next one picks up in October. This is April 12th and it'll be country night. So everybody's invited to come out for that. It'll be our last one. This Saturday we have the Easter egg hunt at Dante Fassel Park at 11 a.m. This is a free event open to the public. And as mentioned many times tonight on Thursday at the community center, we have the community meeting, having to do with the future of the mango lots that begins at 6 p.m. The end of the manager's report. Thank you questions of the manager anyone comments? Yes question So we're off for the summer on the second Saturdays. We come back the second Saturday and October and October why October not September? I'm just curious. Rain. Rain. Yeah. Yeah. This season we started earlier because we wanted to make sure that something was going on in that so we district area, but it was a very hot. Yeah, yeah. I remember I was there. We pick up at the beginning of this year. OK. For the questions, I can see no thank you for the report. Thank you. Mr. City you. Yes, sir. Since we filed a complaint last Thursday. I know I asked you this offline before. Do we have a sense of what the timing for this process to plan will be? We know if the initial part of the process, the process will be done. I have one question for you. Yes, sir. Since we filed a complaint last Thursday. I know I asked you this offline before. We have a sense of what the timing for this process to plan will be? We know the initial part of the process the we are in the process of serving The governor and the and the attorney general. Thank you And we should have that I'm sure completed by the end of the week and they will have I believe they they have 20 days to respond. And that's where it will proceed from there. Okay and typically what's our expectations is just something that's decided based on briefs filed by the parties. Is there or a argument that scheduled? How does this? Our goal will be to coordinate with the Attorney General's Office and the General Counsel's Office to agree to some kind of expedited schedule and I'm sure we both sides would like a fast resolution so that we have a clarity that we're looking for. That's why I'm asking so. Okay. Okay. Thank you. Comments, questions? Okay. Moving on. Discussion item. Summer Commission meeting schedule. Madam Clerk. Clerk. Yes, Alfredo wanted me to bring this because of the budget hearing schedule. So Alfredo, you wanted Mr. River all your dates. Good evening, sir. Good evening again. As you know, budget, we're starting the budget process. We're about to begin meetings with our budget and finance committee. We have our core and we have our five members. I'm excited. They're all the same. One of the main and one of the first questions that they have at all their first meetings is, what is the budget schedule? You have summer coming. I believe in the summer. Everybody takes vacation, obviously, your kids and things of that nature. So the idea here is there's one crucial meeting in July, which is setting the millage for the trim notice that goes out in August. We have it proposed on the 29th of July. And then we have the two hearings in September. We can now have our first budget hearing until, and this is by Florida Statute, until the 3rd of September, you have the first regular meeting in September on the 2nd. The idea is you can have two meetings, the regular meeting on the 2nd and come on Wednesday for the first budget hearing, or you can reschedule your September 2nd, and just have have moved it to the Wednesday after. That's an option. And that's pretty much what it is. To coordinate your calendar for the summer, which again is the peak of our budget and our CIP workshop, is scheduled or hope to be scheduled for June 3rd. I'm back from vacation from the middle of July to the end of the year. So there's no conflict for me on the day to identify. And when July 29th, he wants to have that meeting so that means we need to move one of those July meeting, July 1st or 15th. So I'm planning on traveling this 21st June through July 12th. So I would suggest I think of meeting July 1st, that schedule, which is our regular first and third Tuesday. Just looking at the calendar, is that correct, Madam Clerk? Yes. So I would suggest that we move the July 1st meeting to July 20th. OK. And then we have one July meeting. Correct. So, would you like me to be July 15th? Which would be our regular meeting. But would you? I would be back. Okay. Yeah. So, would you like 15th would be? So, would you like 15th. We have a regular meeting. But would you? I would be back. OK. So July 15th would be the July meeting. And then the 29th is the. Trim meeting. Trim notice meeting. Yes, sir. It'll be the budget workshop. Yeah, the trim notice. Correct. And the setting of that resolution of the trim. OK. of that resolution of the trim. Okay. I'm fine with all of these dates. Yeah, July, July 15th, I'm not going to be... So I'm here at the beginning. I'm a little opposite to you, but I will be back to 29th. Okay. That's probably the most... That's the big one. So... Right. Anyone else have a conflict with the dates he suggested? No. What about June? meetings in June. We have June 3rd and June 17th if you want to. I have no conflicts on those dates. So I'll defer to the rest 17th, if you want to. I have no conflicts on those dates. So I'll defer to the rest of the board if you want to. Do you have a meeting or not? You do your June 3rd. Okay. And June 17th, you're gone. No, I'm here. I don't leave till the 21st. Okay. I tried to avoid as much conflict as possible. possible. The July meeting always gets me. The first July meeting. Okay, so, are we- We wanna leave both June meetings open right now. We can leave them and I'll always cancel one if we need it. Okay. Okay. Yeah. In August meetings as well. Yeah. I get all keep them because as our city attorney works through the schedule on Seahaw, we meeting those dates to kind of have some discussions on that item. I would suspect in August that's some point I'll be gone when I take the kids back to college. But I don't know what that is yet. We are allowed to have a single meeting in August. Are we not? Yes, June July and August. Okay. So I mean, I would we could probably you can let us know the earlier one would be easier for the council with a later one. If you give me one minute I'll look at it. Okay. So June we have to decide we're gonna do one. We're gonna... You can let us know the earlier one would be easier for you to cancel or the later one. If you give me one minute, I'll look at it. So June, we have to decide we're going to do one. We'll leave both for now because we may give in some other items, need them. But we can always choose to cancel one as we get closer. Let's table that. If you'll let us know if there's a conflict, no? I'm dropping them off somewhere around the 18th. So okay, so you're clear both dates in. Okay. Is it if you can read item one for the record, please? It's item one, a resolution of the mayor and city commission of the city is something. So it designated mayor, hobby, or friend and as the city's director and vice mayor, Brian Corey is the alternate director with the Miami-Dade County of the cities. Thank you. Is there a motion on item one? I'll move it. Okay. Is there a second? Great. I'm glad you can call the role, please. Yes, commission. Call you. Yes, Commissioner Rodriguez. Yes, commission. Well, yes, mayor Fernandez. Yes, I'm passes for you read item two, please. Item two, their resolution approval of the rising of the way we're certain they're related fees and costs in amount not to see $2,255 for soon to the section 15B6 of the city code for a special event known as community yoga on rooftop municipal parking garage presented by complex so many LLC, DBA complex health and wellness to be held. Once each month beginning on Saturday August 5th, September 25th at the Minnesota Parking Garage. Mr. Rivell or... Well, it's a special event so... Got it. I'm sorry. Park director. Yeah. Mr. Director, you're recognized. There's a number of parking revenue there, so that probably what you were thinking. The parking garage is still having nightmares about it so that was associated with Alfredo. So I'm sorry Mr. Rovell. Sorry I'm sorry. Good evening good evening again. The applicant complex Somi LC is requesting to host a yoga event monthly on the rooftop, approximately 40 people to attend a class. It's a free yoga event. This is in conjunction to a run event that they do every month. So prior to the run, there do yoga, then afterwards go for a run. The applicant is requesting a full waiver in the amount of 4510, which includes an application and administrative costs, city staff is recommending a 50% waiver fees in the amount of 2,255. What are scheme I did not review the item. So what are the costs there that make up the full $4,510? The special event application in ad man feed is $160 and the parking fee is $4,350. And again, this is over a six month period between starting and April through September. Okay, and again, the parking fee is for for leasing the empty parking spots. Okay. Yes sir, you're recognized. I'm afraid what's going to kind of out of his mouth right now. Sorry. Is there a specific time? Can we allocate a specific time for this particular event? Or have they just specified that or not? Yes, their actual yoga will be held between the hours is 7.30, 7.30 a.m. to 8.30. And that's written plus in the application? Mm-hmm. For the question. No? Is there a motion? I'll move a motion to give them the full benefit of the parking. So have given the full 44 or 43, 10, whatever it's called. This is where you're recognized. I apologize. Quintet, this is the 44,000. That's for all six months. That's for all six months, yes sir. I would agree with that motion. Okay, so there's a motion and I'll take yours as a second. Okay any discussion yes. Give me some one each. What are the actual fees for your work? To $160. Which by the way if you want to withdraw what I will happily do is pay it out of my expense. Expense fund. It's fine. So either way, happy to cover it. You want to pay $160 for it? I'll pay the 160 bucks. Yeah. They've been a good partner. They're trying to create some more activity in the district. So I'd love to support. I don't, I somehow thought the answer was going to be more than $160. And they're doing yoga on a rooftop on the hottest months of the year. Yeah. Okay, so go. They can bring them water. They'll say people are going to go have breakfast, somewhere. Okay, well, I think there's a run after that, isn't there? Is that? After their yoga? Yeah. They're going to be dying. Okay. Okay, so let's, let's, you want to, would you accept them? You don't want to take out the $160. That's the only hard cost, correct? Yeah, that's a pair of... Okay. Okay. So let's, you want to, would you accept an amendment to, you don't want to take out the $160. Okay. That's the only hard cost, correct? Yeah, that's apparently. It's the only hard cost is $160. Okay. Okay. So we have motion in second. Okay. I don't have anything else. Okay. Let's call the question. I'm quite giving color roll, please. Mr. Kage, give me some money. Yes, give me some Rodriguez. Yes. Mayor Fernandez. Yes. I'm passes. Thank you. Thank you, sir. We can read item three. the motion. Thank you. Thank you. Thank you. Thank you. Mr. Riverwell. I think this is yours. Y'all better say yes now. Good evening. What this resolution is doing is incorporating. We had our first hearing for the ordinance, not first hearing, but our first reading of the ordinance at the last. We took our eye took back the comments that was made. I incorporated them into the schedule of fees to accompany the ordinance that I hope at second reading and final hearing today is adopted. So what you're seeing before you is the fees that were discussed. I made some modification by including a rooftop, not during yoga, obviously, but a rooftop permit fee if somebody is interested to pay for that to park their car in the hot sun. Questions of Mr. River all know. Mr. Kaye, Mr. Rodriguez, any questions? No. Only question did we, is this, did we address the parking turnover timeframe for overnight parking in this resolution? as far as the 72 hour 40 hours. Yeah, yeah. What we envision, and we're going to, this is something that's handled on the regulation side, and we're going to be modification space on it. We've spoken Mark from Adelaan Matterfactorys. I talked to him earlier today. He said we couldn't be on the last meeting. He was going to be on the seat. That's why he that's why he is he's here to support me because he knows that I need As much support as I can get so we've worked it out and we've talked about a rationale somebody those on vacation sort of like a credit card You notify your credit card that you're going out of town We're going to have a program in place to make sure we address those that are going to be long-term out but at the end of the day Our goal is to have that as a public parking and to be moving so so the answer is it's not addressed. No, no, sure Yes, so we're staying with our guns, which is 72 hours. I'm gonna be you know that on the scooter Is there a motion? Move the motion is there a second Mark is your emotional so important is emotional support animal. Then medical or call the role please. Commissioner Boone's yes, Commissioner Rodriguez. Yes, Commissioner Calle. Yes, Mayor Fernandez. No. No. Yeah, I don't want I want want that's got to be garage. It turns over. So any. I don't pass. Zero. Three. One. Thank you. If you can read on five, please. I don't five. for implementation of the city, code of audiences to establish a single residential permit parking zone, permit eligibility and issuance of procedures for implementation of the program. So we're only want to present any modifications since the last time this was heard. No modifications. Just for clarification, clarifications were staying with the 72 hours after 72 hours, we will be citing, in other words. I know, that's why I voted no. Oh, because you wanted to be what? 24? Well, 48. Oh, 48. Yeah, I, again, I, I, I, I, I, I, I, I think, you know, again, like I said at the last meeting, I don't, and again, we're not on the item, but I'm going to indulge you, which is, if people are going to park in that garage, there'd be the secondary reservoir for the building across the street, right? It should be the car that they're used most frequently, because I don't want to have cars sitting there for extended periods of time on the upper levels when they should be available for businesses in the district during the day. So that would spread right now. I apologize to Mr. Sharib everybody else who may be offended by my no-ho. Thank you. Questions on item five? Six. I'm sorry, item five. Questions on item five. None? Is there a motion on item five? The public here. Oh, sorry. Thank you. He's throwing me off now. Is there any member of the public who'd like to address this commission with respect to item five on tonight's agenda regarding our single family residential permit program, modifications, seeing no one in the chamber, Madam Clerk is... the commission with respect to item five on tonight's agenda regarding our single family residential permit program modifications. Seeing no one the chamber madam clerk is there anyone online? Anyone online please raise your virtual hand. Seeing no one online we will close the public hearing is there a motion on item five? I'll move it. Before I do the motion just a quick question. Yes. We spoke about the roundabout today on the Martha Marshall Williams in the area. There is a portion there that's already residential on the south side of that street. I'm sorry yeah on the south side of that street. So are we gonna extend that now or what what or are we just kind of thinking about to see what we do there? We're walking out there tomorrow at 1 o'clock to address that. You're 100% correct. That's the purple. Right, right. That's right. So that all that residential on that street already exists as a purple would it be extended to the I I have to look at it. We're going to look at it tomorrow. It's going to be under advisement obviously. This is a second reading correct. Yes. Do we need to have? Yeah. Okay. I don't think this establishes the map. Correct. You can establish a district without off-saking any action. Correct. Correct. Do we need to have? Yeah, okay. I don't think this establishes the map. Correct. You can establish a district without off-saking any action. 100%. Correct. It's not going to prevent that from happening. Okay. Thank you. Thank you for the question. Okay. For the questions. Are the strategies are good? Good. Okay. Did we have a motion by Mark Clark? No. Okay. by Raidriga's, then clerk, please call the roll. Yes, commission and kaye? Yes. motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion by motion of many chapter 15 offenses and miscellaneous provisions article one in journal section 15 that 63 mobile vendors to permit special events featuring mobile vendors for religious institutions and established regulations and permit procedures. Thank you Madam Clerk. Commissioner Rodriguez you want to walk us through any modifications between first and second reading. I don't believe there were any modifications. I think everybody was good with. There was one. One. Yes. City Attorney. Yes. Thank you, Mayor. It's on lines 134 and 135 and 136 and it was just to expand the city manager's authority that was a discussion at first reading. Oh. Basically to put a maximum cap, if necessary. On the number of people. On the number of people. And the number of vendors. We have it depending on the size of the lot. Yeah, the manager has brought authority to a fixed additional conditions. He already has that. So the catch all condition, you think covers that as well. Correct. Correct. OK. Is there a motion item? Would you like to move it, sir? Move the motion. Okay. Is there a motion item? Would you like to move it, sir? Move the motion. Okay. Is there a second? Second. Second by Commissioner Kaye. Move by Commissioner Rodriguez. Madam Clerk, please call the roll. Oh, sorry. Public hearing. Item six is a public hearing regarding mobile vendors to permit social events on religious institutions on properties, Mr. Kelly. Would you like to address the item? but it did a little late for me, but I just want to thank you for some time with the control cap on the number of attendees at a possible event. So, with that by way of public comment is there anyone else in the chamber or online? Madam Clerk. Online please raise your hand. We will close the public hearing. Madam Clerk, if you could call the roll please. Yes, Commissioner Rodriguez. Yes, Commissioner Calle. Yeah, Commissioner Bonneesh. Yes, Mayor Fernandez. Yes, I don't pass it to 40. Thank you so much. If you could read item seven, please. Item 7, ordn ordinance and many section 15-82 prohibited noise of article three noise of chapter 15 of fences and miscellaneous provisions of the city hold of audiences to revise the noise or regulations within the city. Thank you Madam Clerk. Ms. Cabrera do you want to quickly address any modifications from the last time we saw this item? Good evening. Good evening for the records that I'm a Governor at Development Services Director. So we went back to the decibel reading stuff we had originally and we modified the the limits of where this applies so that we're not affecting. I don't remember that part because I was the Tony section of the modification. The TSD area. The different subsets of the TSD area. So based on your input, on first reading, the TODA, which is the most central part, and the TSDA have identical exemptions. It's 9 a.m. to 12 a.m. that they're exempt Monday through Sunday. And then the TSNA district, which is the neighborhood, the outskirts, has slightly different hours of exemption, 5 p.m. to 10 p.m. Monday through Thursday, 5 p.m. to 11 p.m. on Fridays, noon to 10 p.m. on Saturdays, and noon to 9 p.m. on Sunday, with one exception, the commercial uses on properties, fronting 74th Street, are exempt until 12 p.m. on Fridays and Saturdays, basically to account for those. On the south side that are facing north. We have yeah, these would be on the south side. Okay. Yes, any questions, comments? Yes, sir. So when we made this motion, um, we discussed it, but it got through the, uh, through cracks and through the cracks. Thursday, right now in the commercial zone, calls to eight. We had said about going to set up the on the commercial use to set up the on the commercial use to set up the on the commercial use to set up the on the commercial use to set up the on the commercial use to set up the on the commercial use to set up the on the commercial use to set up the on the commercial use to set up the on the commercial use to set up the on the commercial use this over.m. is Sorry, I was looking at this over. Oh, oh, oh, oh, oh, oh, in the chart. That's what you're looking at. Yeah The these are so are you are you saying outside of the TSD area outside of the transit? Supportive area downtown and all that yeah, so where you see how it goes Friday Saturday We changed it from 10 a.m. to 12 a.m. Those are not those are not the standards for the these are taught in. Okay, and these are the general standards. The general for the whole balance the city sir. Okay, all right. Yeah. So that clarification you're following? I mean residents are gonna I just figured 8 a.m. But okay, I mean if everybody else is good with it if what everywhere else I mean residents are gonna, I just figured 8 a.m. But okay, I mean if everybody else is good with it, if everywhere else, I mean to forget, no, you're right, you're right, it's mine. That's fine, no, it's okay, we're here to get clarification. So if you feel you're good. No, no, we're good. Okay, is there a motion? Oh, sorry. Cause this area here, Monday through Thursday, we go to APM, yeah. Okay, so with that, we of a summary of the modifications, this is a public hearing item. If any member of the public would like to address this commission on item seven, which is a modification to the city's noise ordinance, please come forward at this time. Madam Clerk, is there anyone online? Anyone on the board? Anyone on the board? Anyone on the board? Anyone on the board? Anyone on the board? Anyone on the board? Anyone on the board? Anyone on the board? Anyone on the board? Anyone on the board? Anyone on the board? Anyone on the board? Anyone on if you can please call the roll. Yes, Commissioner Cyan. Yes. Commissioner Rodriguez. Yes. Commissioner Moniz. Yes. Mayor Fernandez. Yes. Item passes for zero. Thank you. If you could read item nine for the record, please. Yes. In an ordinance providing for a moratorium on the enforcement of section 3.6 W of the city's the end of every call relating to red smithure requirements for solar but about the systems provided for best of rights. Thank you for that, Madam Clerk. Commissioner Boone, this is your item. Anything you'd like to say by way of introduction? And so, I mean, I just clarify for the record that a commissioner Boone is the sponsor of this item. Oh. So is the agenda. Yeah, that's why I said she's the sponsor. This is just making official the discussions that we had a group at the last meeting. So we are essentially placing a moratorium which we had effectively already done taking into account the discussions that we had for Surami to then follow the suggestions that the mayor had had in looking at other incentives and coming back to us and Commissioner Kaye and Commissioner Rodriguez, everybody's input so that we can have a more effective way of dealing with alternative energies in our city and that we don't have edicts down like if this was a monarchy we will have incentives and we look forward to them and that's what this is. Okay, any questions just sir? So question to Sudami or to the manager. We were talking about it I just wanted to confirm this. This may also or does also include re-roofing projects. Where you were supposed to do that. Yes, that's our interpretation of the ordinance. So it also included, I don't think we didn't talk about that last time. No, I think there was mention that. Not re-roofing. Our analysis had not included the re-roofing permit numbers or the remodeling and renovation numbers. It was the construction, but my recollection of the presentation was that included new construction, construction by Lutheran Tharshal and re-roofing projects. But that was just my takeaway. I spoke to you after that I read the ordinance work clearly. I went to Tony to see if his interpretation was what I was reading. If it included reruves or not. And we both agree that it includes reruves. You got a preview information. I wasn't sure at the last meeting. Okay. No problem. I discussed it with you. I've conflated in our conversation. So anyhow. So no, just to make it so. So then that number is going to grow exponentially. Yes, I have the numbers that have been provided to the city of managers of the sector and we have memo. Commissioner Boni Chas to put solder on her house. That will never happen. Okay. Understanding how I made the comment the last time I looked before and getting an accounting of what transpired and understanding how we ended up in the situation. And it's the nicest I can put it. So, very, you weren't here the last time, so I'm grossly disappointed with how this has played out. So. No, I met with a director, we spoke, and she had done some research. She provided a memo this afternoon, of which I'm going to take a look at and share the information. Part of the research was capturing those categories that were mentioned, reroute, and try to get some numbers behind it. And then, historically, what happened as a result of enforcing this? And it seems like it goes back actually all the way to 2017 where there are inconsistencies throughout that time frame. And certainly from 22 November 22, another confusion as to where there was a moratorium in place right now. So that's part of her research. And I'm going to take a look at what she shared. And if there's more research involved, we'll do that. And then share it, give you something. So I just want to say this as a corollary to this, which is, when you and I first met, I think, would my conversation conversation about this opportunity was, I want to make sure that we have the best department to handle, you know, small single family and two-plush projects and terms of our capacity on staff today. You know, certainly if you're less confident about that, today than I did 24 months ago. You know, today's presentation on the one project that we had that we discussed, I was surprised to see that was handled by third party consultant, given the size of the project. It's a pretty small project. I think the kind of speaks to the fact that we kind of really need to grow the capacity of our in-house staff and figure out how we're going to get to the balance of what's going to be handled outside, you know, our typical review process. So, you know, hopefully between now and the end of the year we kind of figure out a plan so that going into our budget discussion if we do need to add resources or make some modifications there, that we do that. And I have now had a couple of experiences and elect officials seeing things and identifying gross deficiencies and people's understanding of the code. Internally, that, you know, it's not a reflection on you, because you've really just gotten here. But I just think we really need to grow the capacity development services, particularly for what is our core function, which is permitting homes. And the better we make that experience, the better the quality of the interaction, I think obviously it serves the city very well in the long term. So I'll just say that by way of editorial. And if there's a motion on the item, I will entertain it. I'll move the item. Okay, is there a second? Second. I'll just say that by way of editorial and if there's a motion on the item I will entertain it. I'll move the item. Okay. There's second second. Okay, any further discussion? Seeing none then Madam Clerk, if you can call the roll please. Yes, Commissioner Boenne. Yes, Commissioner Rodriguez. Yes, Commissioner Calle. Yes, Mayor Fernandez. Yes. I have just passed his court to personal. Commissioners, we have commission reports. I have just one piece of information I want to share on an item. Regarding Dante Fistalt Park and the new building we've been trying to get permitted where we had the fire access issue. Had a lot of conversations with Rodney Mandelstrom about granting us access off his parking lot. He has agreed to do that. So hopefully we'll have a solution, we'll bring an easement forward. He is looking for us to also, he's had some concerns about his zoning rights on that property for some time, is looking at making some modifications. So I've asked to see attorney to bring forward a settlement agreement in that lawsuit. That would basically provide this consideration the form of engagement. And we would then take a promise to take affirmative steps to modify his pud, correct? And possibly then entering to a development agreement would give him some entitlement guarantees for the maximum statutory term, which I think is 30 years. So that's where we are in that conversation. We've made some progress there. Hopefully that'll result in us being able to do that building permitted. So just wanted to share that point of information. Anybody else want to share anything? Well, your commission reports? Yes. I just want to say thank you for that. Thank you. That's great. Thank you. Okay. Oh, uh, yes, sir. It was Brian Corey's birthday this past week. We didn't say anything. It was a happy birthday to vice mayor. You want to say what happened, birthday? No, I'm related. Happy birthday, Commissioner, our vice mayor. Excuse me. Anything further? Okay. Seeing no further business before the commission, we stand adjourned. Thank you.
