The work that goes above and beyond the call of duty from both our police department and our fire department. We alternate each month between our two departments. We have police with us this month. I'd like to introduce to you officer Caleb Caves, who's initial assignment to our district was in mid-November. And this was his first solo assignment from Recruit Class. And in just a short time in a month and a half, his investigative skills and hard work paid off when he located a stolen truck. And not only did he find the stolen truck, but he also had the enthusiasm to go ahead and draft a search warrant for the truck Which was like the first time this has happened in our district in the three years that have been out there Executing the search warrant on the truck and also his investigative skills in connecting criminal activity to just connecting crimes in the district. And I'm really grateful and excited to see this next generation of you bringing all the skill sets that you've learned and putting them to use for the benefit of our community. First of which is Christie Duarte, testifying on Resolution 26-25 to be followed by Sandy Ma. Christie, when you begin, you have three minutes if you could just reintroduce yourself. Mahalo, Chair. My name is Christie Duarte, and I am the Chair of the Hoi Ihomburg Task Force, created by Act 32, 2019. I'm also the board president of the Hoi Ihomburg Collective, an organization with the largest voting membership of licensed midwives and licensed birth professionals across the state. We are in full support of resolution number 2625. I would like to point out that in the five years that the Midwifery Licensure Program has been in effect, out of 40 licensed midwives, zero are native Hawaiian, and only one is born and raised here. Massachusetts just passed the bill, almost four months ago that allows for exemptions for Native American traditional midwives. It also allows for an exemption for traditional birth attendance, and it recognizes the same licensure pathway in our bill as a pathway to licensure. Our bill is in alignment with Massachusetts and the goal is not to narrow but rather promoting access to midwifery care and out of hospital birth options. There are three ways our current law needs to be fixed that this bill seeks to address. Number one, there's a need for Native Hawaiian traditional and customary practices to be protected. It needs clear statutory protection, so the burden is not placed on practitioners to prove that their constitutional rights apply. I would like to note that the court ruled in favor in July and blocked the law from criminalizing native wine midwives. Number two, there's a need to expand access to licensure for the Kanako Maui community and others who want to be a clinical midwife. The court also found in July that the current licensure pathways come with unreasonable barriers. The licensure pathway in our bill is used in 27 plus states as a pathway to licensure, and the North American Registry of Midwives, who is the only body to certify these midwives has stated that this is a legitimate pathway to certification and licensure. Number three, lastly, let us not forget our Konakomawty families and others, along with the next generation, to be able to choose who they want at their birth. Chair, your next testifier is Sandy Ma, testifying on Resolution 27-25, and then we can close out with our Kona testifiers. Sandy if you could just unmute yourself you'll have three minutes if you could just reintroduce yourself as you begin. Thank you. My name is Sandy Ma. I'm with the legal clinic. I am the community and policy advocate with the legal clinic. The legal clinic is a nonpartisan Hawaii non-profit and we focus on providing free immigration and legal services for low-income immigrants in Hawaii and we also advocate for immigrant justice and fair immigration policies and once again I would like to thank this council for allowing me to testify with very little notice. The legal clinic is testifying on resolution number 27-25 and we have some concerns and reservations regarding this resolution authorizing the mayor to enter into intergovernmental agreements with the federal and state partners to support their continued cooperation with the Hawaii Police Department for the safety and the County of Hawaii. While we understand the intent of this resolution, we do, like I said, have some concerns and reservations with this recent incoming federal administration and the rhetoric surrounding immigrants. We're concerned that this resolution does not have enough guardrails in place to make sure that the immigrant community in Hawaii County, which comprises over 12% of the population is properly protected from overreach by any federal agencies. And so we want to make sure that the immigrant communities, which are part and parcel of Hawaii County population, is adequately protected and is not subject to harm our fear. While we understand the intent behind this resolution, we just want to make sure that all the aspects are fully considered. And we would like to put our concerns on the record at this time. This morning we have April Bailey in support of Resolution 2625 to be followed by Rachel Kernel strump, both in support of 2625. April, go ahead and state your name for the record and proceed. You'll have three minutes. Aloha, my name is April Bailey and I am a home birth midwife a traditional midwife a traditional birth attendant. Whatever label you care to put on me I've been practicing midwifery since 1978 and I am here in support of bill, sorry, resolution 2625 and the expansion of access to midwifery care for birthing people is super important to limit a woman's options at the time that she gives birth is criminal. And to criminalize traditional midwifery does nothing to support the community. I have practiced outside of the United States in indigenous areas. And this kind of care is important and all women should have the care that they choose in birthing, not just what is limited by law. So I really ask your support in the resolution 2625 of a decriminalizing traditional birth attendance. Thank you for your time. I'm going to be able to take the time to do that. We are very much in support of the regulation of the midwifery practice as a whole, but when the bill was passed, there were some fatal flaws in it, one of which my teacher April Bailey was criminalized as of July 1st, 2023. Also, there was no pathway protected for the native Hawaiian midwives, or any of the cultural practitioners from all of the vast number of cultures that are represented in Hawaii. We really need this current legislation to be changed. And as the bill sun sets on June 30th of 2025, we are excited that Hawaii County and Maui County have overwhelmingly supported our attempts to rectify this wrong. We are very much in support of Resolution 26-25. We appreciate all of your time and efforts on the birthing people of Hawaii, the Native Hawaiian practitioners, the other cultural practitioners, and those of us who are able to obtain a license the first time around. We really need to expand maternal health care, especially in the neighboring islands, as most of us are in very rural situations where we don't have a lot of options. So midwives provide these options for the communities that are the most underserved and lowest income. So this request would afford the Hawaii Police Department to sign, as you can see from exhibit A, a plethora of different types of agreements, MOUs.A.'s, M.O.U.'s, kind of anything and everything that the police department generally does with state and federal entities and HRS 46-7 require such. So I'm just doing a little bit of cleanup to make sure that they have the appropriate authority to sign these going forward. So fairly straightforward, I know there's a lot here, but this was kind of an evolution of a continuing discussion between myself and HPD and Corporation Council about how to bring this before us with sufficient information so that we could make a decision. The intention is to have this kind of be an annual thing, allowing HPD to have those agreements officially in place, abiding by the policies that require council approval. And I trust them to really protect and not be entering into agreements with the federal government that would harm or cause a lot of extra fear in our community. But I did just want to slow that down a little just so the public had the normal chances they get to weigh in so it will go through the normal process of going through committee first and then coming to council. So I don't know if, Major Bird, you have anything to add. You weren't in that meeting, but I did have a very good conversation with them. And you heard one person testify that they had some concerns. So this allows us to partner with them should a civil disturbance take place as it says on or adjacent to as far as the explosive ordinances, if it's able to be transported there safely and they have the means for us to dispose of the ordinance there, that's what this agreement is about. Okay. Well, sometimes we have situations that are on the highway that might enter into Polhakalua trading area, and that allows us that access in there as well. Okay, and then this 146.7, this is a general MOU between us and different agencies, but this one would require 180 days of written notice prior to. That's for termination. Oh, prior determination. Right, so that third column provides you guys what the notice how they would be terminated so some of them are going to be ongoing some of their some of them are going to be for you know maybe an undisclosed period of time but this is that third column tells you how and when we could terminate so and that was done to provide council the assurance that if there were concerns, if something became a concern partway through an incident occurred that called into question the nature of how the MOU or MOU is actually being utilized. This tells you how the county could terminate that particular agreement if we wanted or needed to. So in this case, it would be 180 days worth of notice. So we have to cancel something, cancel the MOU for that specific line item. We have to provide written notice within 180 days or 30 days, whatever it's stated in this resolution. That's correct. Okay. And who writes that? It depends. These are order agreements that I didn't participate in. So if and when they come up again for re-, I would be reworking them. 180 is kind of a long, uh, lead time. I'm used to seeing 30 days. I would probably recommend something more like 30 days. So there's a little bit more fluidity in the, you know, if an important need arose. So, but I didn't work on those. Yep. Okay. So I'll be up to the different department that wrote the original contract with corporation councils. Oversight. original contract with corporation councils overseas. It would be police department, these are all police department agreements so it would be police assuming I'm still their attorney I would be reviewing and working with whichever attorney represented the other entity. And are testifying to our opposition of Bill 219 and the Heal of Benny of Medical Center intend to purchase to develop one story 36,000 square foot health center located next to our subdivision. We received three notifications of graphic images proposal to change of zone and subdivision via mail. In all communications it references a 23 lot subdivision with lot sizes of no less than one acres on two TMKs. We were confused about how the initial TMK, 29.7 acres at the time of purchase was subdivided in the two parcels, one seven acres and one 9.7 acres both under the 20 acres, which it is currently zoned. Upon investigation at the planning department, we found that a mapping change in subdivision was approved under Hawaii Code, section 23-11. Never once did they mention their intent to sell to HBMC and construct a medical facility. Graphic images misled the surrounding community by not disclosing this information. Because we were misled, majority of the Oloho residents have not opposed to this subdivision through the review process. On November 14th, the Hawaii Tribune Heritage and the Front Page News article about the intent to construct a medical facility on this property. That's the first that we learned about the proposed project. There are multiple impacts to this project, which given the time, I'm not able to go into details, but I'm available to discuss this further in the future. They include traffic, schools, water, field standpipes, noise, lighting, safety, increased visibility and vulnerability to our neighborhood, et cetera. And there's the possibility that needs change and we end up living next to an emergency facility. The county created PUNA Community CDP Action Committee. The purpose of the committee is to be proactive community-based, toward responsible for implementing resident driven solutions from the CDP that positively transform the community. The proposed project is outside of the Kow, regional town-center boundary, and encroaches on areas identified for agriculture and residential. There are currently three urgent care facilities within one mile of the proposed project, and so is there really no need for another urgent care facility? There are documented needs for PUNIT to have an emergency room facility to accept 911 transports. A facility of this nature and magnitude is needed and should be located in a suitable area designated by the PUNIT CDP, be transparently proposed and developed, allowing for public and community consultation and comments. WHO should develop the a Kiau village conceptual master plan. They are identified areas and designated in this plan for commercial use, which is where a medical facility should be developed. How would you feel if you were misled through the process and the proposed facility was to be constructed behind your house? I'm a resident of Ola-Hoa States and a parent of two sons who've attended the Kale School district schools for the past 13 years. I was born in Hilo and have lived in Punafor over 35 years. I'm here today to oppose the rezoning of the subject property of which the subdivision approval has already been given. Are you aware of the status of the Kialbini Off Medical Center? Are you familiar with the proposed location and the impact of the surrounding schools and residents? Recent disclosures indicate that information pertinent to this project has been withheld or presented in a misleading manner. Furthermore, we are aware that the subdivision application and approval was granted prior to any zoning approval, which raises concerns about procedural integrity. Notifications concerning this developed mailed to the surrounding neighbors by Darren Array planning consultant for graphic images dated April 8th and July 10th of 2024, only reference a 23 lots of division. To our dismay, these letters along with the attached maps appeared to both be incorrect and misleading. In addition, a letter dated November 7th from John Pippin of Land Planning Hawaii revealed that he represents he will be any off medical center in regards to the draft environmental assessment. This communication marked the first mention of the medical facility in relation to our community. Furthermore, the Hawaii Tribune Harold reported on November 14th that plans for the KL-Bany Off Medical Center was our advancing, detailing a 36,000 square foot medical center that would include both clinical and behavioral health wings on approximately nine acres. This is the most comprehensive information that we have received regarding the proposed development and it came from a newspaper article rather than direct communication from the planning department and developer. Our key concern is a safety aspect regarding the potential surge of vehicle and pedestrian traffic on the old Kielpoho road, which fronts the subdivision and leads to Kekula O'Neva-Hio Kalaniopu, with three schools located within a quarter mile of this proposed site and a fourth campus in an additional half mile away. traffic congestion is already a pressing issue. The road servicing these schools become heavily congested during morning trough buffs and afternoon pickups, children frequently cross these roads and traverse between campuses. And any additional traffic generated by the medical facility would significantly exacerbate an already challenging situation. The general plan designates this parcel as extensive agriculture, which raises further questions about the appropriateness of a medical facility in this location. I chose to purchase my property in this serene agricultural community under the impression that it was appropriately zoned and would not be adversely affected by a medical facility less than a thousand feet from my front door. While our community does support and established establishment of a medical facility in KL in the KL area, we are adamantly opposed to its construction in this specific location. There are numerous alternative sites that within the KL Village Community Plan that provides suitable access, ample space, and a room for future expansion. I've invested emotionally, financially, and I love, absolutely love where I live. And I oppose the introduction of the Calbeniaf Medical Center. I think that'll bring, it will not be beneficial for this location. I think it will be beneficial for the community in another location. Excuse me. There are many things that are in the environmental assessment that I feel are valid, but I also think there are other assumptions that are in the environmental assessment that I feel are valid, but I also think there are other assumptions that are in it that have not been items taking into consideration because the community was not involved in any of this type of planning. All of the communication that we've received has been for a, excuse me, has been for in addition to our neighborhood and so we were receiving all of this communication from Laurie Higashi and Roland and asking us to find friends and family who would be interested in purchasing one acre lots. And so, you know, I got my brother, hey, on board in three years, you can purchase a property, maybe. And we can be neighbors. Now with the introduction of the medical center, he is not interested. So now, something also that I've invested financially in will be looked at as something that's not as valuable in the sense if I did want to resell other people may not want to live there as well. But I think some of the biggest things are right now. I love that property because it feels very secluded. It's nice and quiet. That was some of the peel for the area. And we have a school, the Navahee School, and the children run PE, the teens for sporting warm up on the street. And I can't imagine more cars being introduced into the neighborhood. In the EA it states that there are about 50 employees that will be hired with the health center and they're expecting at least 100 patients or more to come into this. No outlet road. And so every day when a kid they're picked up from school, the traffic or the parents have to line up all the way to the end. So far, this bill has been moving smoothly through, but there was a number of community members who showed up today as well as who's been provided written testimony against the project, and it is worthwhile to discuss why. I wanted to speak on behalf of the community. Is there a representative from the planning department here today? There we go, Mr. Darrell. Thank you for being here. What is your what is the correct title Mr. Darrell? Correct title at this time is acting. I would disagree you are the planning director unless this comes so So, changes. But you are the director. Okay, we'll go with acting director. Jeff there, don't think you've been here. And then maybe the land, the consultant, Mr. Wright, if you want to come up to. So let's just walk through the process a little bit. So there's a number of different things that were presented, both letters from the applicant, as well as with the community provided. So we have a subdivision approval, a zoning change. There's also a concurrent EA running. And we have some concerns that were run up by the community. So I just want to walk through them real fast. So in order for the facility to be built does the zoning need to change from what it is currently? I can't say. Aloha vice-chair-in-ava. I'm sorry. Starting off with a bang. Ouch! There you go. Obviously I'm nervous. How do I do that? Oh boy. Cherry, now the vice chair, Onishi, and all the new council members, congratulations. Jeff Dereau with the planning department. So, the zoning previous or the zoning proposed could accommodate for the proposed medical facility. The permitting would not be through zoning, it would be through a special permit. And so, whether it's state and agricultural, 20 acre or family agriculture or one acre, it's still in the state land use agricultural district, which would allow for the submittal of a special permit. Okay, so with Ag 20 they could provide the subdivision as requested whether with the facility or not or they have to have the sorting change to add one to the subdivision to. As mentioned by one of the testifiers, there was a subdivision under subdivision code chapter 2311, which I would have to look back at that, but it appears that they were applying a hospital for that particular subdivision. There's certain allowances in the subdivision code that allow for smaller lots when there are proposed types of structures, public type structures, and right of ways and utilities. So it appears that that was what was applied for the less than 20 acre subdivision. But moving forward, if that didn't happen, let's say that they didn't proceed with the 2311 subdivision. Then this proposed rezoning would change those lots to one acre or family agriculture one acre at that point They could come in and subdivide out seven acres Having seven acre one acre lots are seven one acre lots Okay, so some of them subdivision was already approved in the operating department, correct? Correct. And Bill 219, if it didn't pass today, what would happen to the Subdivision? If the proposed medical clinic goes forward and gets passed, it would appears to still be applicable because it's for a public type facility. Okay. So regardless of the zoning change, the subdivision can still occur and move forward. Correct. I can't speak to the intention if the proposed medical facility doesn't pass at that point, and the action would need to be taken to revert. Okay. So the vision approval, what was the date of the approval? I'm sorry, I don't have that information with me. Good morning. Darren or I, I'm just consulting, assisting graphic images. Just to provide some clarity, I don't have the exact date of the subdivision approval. It was earlier part of this year. And as Director Darryl mentioned, it was approved under the public utilities and public facility per requirements of the subdivision code. That subdivision occurred for a specific purpose. It was to allow for an opportunity if the medical center was successful in securing a special permit. These lands can be assigned to the Helo Medical Center in order to pursue the construction of that project. But whether the existing agricultural 20 acre legacy zoning remains or the proposed FA-1A zoning is approved, that's that lot already exists and there is an encumbrance that would prohibit any other use aside for public purpose, meaning that they cannot carve it up and sold as individual residential lots. There's an encumbering on the property that was required by the planning department in the approval of the public purpose subdivision. So if the special permit for the medical clinic is not successful, then that lot can be assumed by the, the rezoning should it be approved and the 23 lots of division can move forward as currently proposed. If the rezoning is denied, then obviously they cannot subdivide these properties. The property has remained just one single property. The public purpose will then have no value unless another type of government facility is proposed on that property on the seven acre site that currently exists. So there are two distinct processes going on here. The changes on that's currently before you under bill to a 9.2 is specific to a proposed 23 lots of division. Nothing more. There's a separate process and I'm sorry, and the applicant graphic images Hawaii. All they're doing is saying, if you're interested, we have set aside these seven acres, possibly nine acres, for you to pursue this public purpose need. And if you're not successful, then fine, we will carry on with the 23 lots of divisions should build to a nine-draft to be approved. So two different purposes, two different processes, the concerns that you heard this morning in testimony and in communications presented to council did not speak against the proposed rezoning and the has a separate process that they're currently undertaking, which is the draft environmental review process, and eventually when filed, a special permit hearing process before the Windward Planning Commission. So they will have opportunities to testify and provide comment and due process has not been compromised. When did the year start? For the property. The publication occurred in October, I believe, on November. And there was like a 30-day comment review period that ended December 6th, if I remember correctly. And now a final draft, a final environmental assessment will have to be compiled by their representative and submitted to the planning department at which time a director Darryl would decide whether or not to accept that document as the final environmental assessment and whether or not he will issue a finding of no significant impact. Only upon that conclusion of that review process can the applicant then prepare and submit a special permit application for the medical clinic. Thank you and before we go further I just want to make sure we are staying within the scope of the rezoning. I believe what you're discussing right now is not what we're here for regarding bill 219 so I want to make sure we're staying within the context of this bill. Thank you Mr. Garnie Lee. Okay so I'm seeing three different processes that are interrelated but that all affect the outcome of the property and the proposed facility and occurring in different areas. But I mean, something that caught my attention as I read to the different documents that have been put in front of us is a letter from you, Mr. Rye, to the council. And I said, I'm going to summarize this sentence, second paragraph in, notice the surrounding property owners did not disclose the medical center. And that really does highlight to me. And I shorten that sentence down. But that is really that sentence in a very clear form that it did not disclose. And I think that's what I'm getting from the community is that they didn't know. And what's bugging me is with a facility like this and its impact on the nature of the neighborhood and I respect the developers because what they build is beautiful and the community is actually saying we love where we live. That's the first part of this subdivision that you created in all the whole. The second piece that we're considering right now, which is both built 219, the EAs and the subdivision approval that already happened, that is going to affect them as well. And so I feel like there was a missed communication aspect of this where a subdivision approval happened in EA was submitted, but not until the paper on an article on November 14th, and then a letter arrives to the individuals in the community that says, by the way, we're looking at doing a proposed medical facility. That to me is concerning. And that's where we missed the opportunity to discuss with the community what is coming and what they should expect as neighbors of this proposed facility. Is it okay if I respond? Yes, please respond. Is it okay if I respond? If you look at that same paragraph toward the bottom, I mentioned that we did not disclose the proposed medical center as it is not the subject of the changes only request and it would be improper to present these proceedings as a proper forum to discuss the merits of the proposed medical center. And that speaks directly to what Sherry just mentioned, regarding Bill 219, your F2. In the application itself, we did make a brief reference to the proposed subdivision and the proposed medical center. And that was just to try to make a sense of disclosure. During committee meetings, we also spoke about the proposed medical center, but we thought it was improper because of the substance of bill to a 9.2 to go any further into providing that level of detail. I get, as I mentioned, this bill is just for a rezoning in the hopes that it will support the subdivision of the project site into 231 acre lots. Thank you Mr. Arriba. Mr. Clinefather, I'm going to give Vice Chair on the issue of Chants. Now Vice Chair on the issue, please go ahead. right because they're getting confused where their thing e-fos are coming in also proposing that medical center working with the B&E operations, right? But that's too separate. So you're here now just to subdiv or get the reason to have your project. But also there's a parcel that e-fos are willing to, I guess, agree or to sell to the medical center to operate their facility, but they would have to come back to the county to get their approvals, right? But until then, nothing can be built, correct? Until the special permit is approved, the medical center cannot be constructed. And so what's in front of us right now is basically what the developer graphics, how I want to do with their 23 lots. Right? Now, if we do approve this today, does that portion that you folks have set aside would that be included in this proposal? The seven acre currently set aside is part of the lands to be resolved. So we prove that you folks have that seven acres on the side. And if things don't work out with the medical center, then you folks do are the owners. Correct. Yeah. And so to ensure, I guess the council members during that special permit, if they come in front of us or in front of the county. Will the council have a say to it? No, maybe the director. What, I think the director. Sorry. Thank you, Vice Chair. The special permit is approved through the planning commission, so it would not come to the council. Okay. So how could we assure the community through the planning commission so it would not come to the council. Okay. So how could we assure the community that's next to this project that I guess as council members we can help protect them on their concerns? The process includes a similar process as rezoning in regards to notification. It may not be as extensive as rezoning notification where it goes out a thousand feet, but it will proceed 500 feet from a proposed project site out for notification purposes. And then they have to post a sign. I'm sure that based on the fact that the surrounding property owners are aware of this with the recent news article of the release of the Environmental Assessment, they can participate with comments within that process. In the special permit process, they can also participate possibly in a contested case proceeding if they're very opposed to the project. So there are avenues available for public participation through the special permit process. And then also, I guess council members, we could do a resolution on our part to the WinReplenium Commission that we could be opposed to this project. And that's where we could say as a council and as a body that we were against and helping protecting the community over there, back there. And so that's an option that we can do too. And that's how we still can get our voice. Mr. Ray, have something? I'm just worried about separation of powers. Special permits by state law and by county rules, assigns that authority solely to the planning commissions. But it's just a result. Yeah, I understand. It's not binding by law, right? It's just very quick. Yeah, maybe a council. So, Vice Chair, on issue, can you restate your question for the record, please? So, Mr. Trens, so, with the council, well, if this project moves for after we pass this bill, if we pass this bill, and we move forward. And then when it comes to, I guess, the proposed medical center, they have to go to a Windward Planning Commission, would the council or the body be able to do a resolution? Maybe not in support of this project? Is that possible? Elizabeth Trans Corporation Council, thank you for that question. And the short answer is, I'm not sure. You know, I hear the concern about separation of powers. And so, the authority appears to lie within the administrative administration, executive branch of government. And so the propriety of the body to chime in as a body is the policy issue- Okay, but if the council members write our own personal as a council member, to the Windward Planning Commission opposing this project. I think the, or opposing the special permit. Yeah, so that, that's the issue of governmental function and whether it's something that the electric would expect council members to chime in on. And so, you know, councilmembers do periodically appear before the planning permission, particularly involving projects within their districts to to weigh in. But whether this body can or should weigh in, I think is a different issue and something I wouldn't want to opine on off the cuff. So we could prepare something for you, but I don't think that in answering the second part of your question that you would be prohibited from raising a concern as an individual council members because I think the research that I've done on this is that you know there's a catch all about governmental functions and whether or not the electorate would expect their elected officials to weigh in on issues of this regard. There's very little guidance or case law on that issue and the practice with Mr. jurisdiction is to provide the council members with pretty broad authority to go in and weigh on in on a whole host of issues that are lie within the jurisdiction of the planning commissions. Yeah. Well, I just want to see where maybe this body can assure the community that we're looking out for them too. That's what I want to see. And I don't know if, like for me, I feel a resolution is not like a law. Like it's just like, I guess giving our opinion or our comments on how we feel about that project so if we did it as individuals or we did it as a whole I don't see any difference. I'd like to look into that a little bit more I mean you had a resolution earlier today on supporting state legislation which arguably is outside your authority, but it's something that you're asserting on behalf of a kind of a stated opinion by this body. And so, you know, I've just hesitant to come in with a hard yes or a hard no on a question that I don't have a clear answer answer to. Well, the only thing is we have this build in front of us. That's why I saw I would hate to postpone it. But maybe but I don't know if we can maybe jump it to the end part and then you can go and try to do some research within an hour or 30 minutes or so. Well, you're a tough one. I mean, but Yeah, because I don't want to see them coming back. Yeah, I think I don't take a couple of minutes. Even to come in, I don't want them, the neighbors to come back again. And so we just want to get everything clear. And so that way we can just move forward. Understood. Thanks, Chair. So if, and I'm just asking you to stay there so you can correct me if I'm wrong, thank you council member Onishi for your recognition and determination and creativity in trying to find a path forward for the council to reflect our hearing and support of your request, but also the balance of not holding up something we're already in second reading for. I find this really concerning that the neighbors found out I read it in the newspaper and was like, what? When did this and the fact that it's now attached to the legislation that we've already had two readings on is confusing to me. I do hear somebody saying it's not, but in the process of land use zoning changes planning, what not, there are a number of nuances that it can be stated they are separate, but in layman's terms and to the common person, they are not separate. They are a means to an end in a land use planning system that historically has been in favor of people who own the property and have people they hire to help them navigate a system which is fallible and has loopholes. And I sit here and see a community that is literally begging for us. This is our last stand as a council in my experience here for us to vote on something moving forward that has the potential to really negatively impact this neighborhood and it feels a bit like a bait and switch and so I understand how you guys feel and the legal jargon can become overwhelming and the eyes and the teas can be swapped and whatnot but to me it comes back down to the value system of people that live on one acre ag lots in a rural community having the potential and historically when we say yes it's gonna go to the next line of series for a special permit they're going to say no if we say yes. Significantly in the history of all of these kinds of projects very, very rarely. Does it get a no if it passes through council? Whether or not it's connected or not. The people who serve on our Windward Planning Commission were nominated to serve there. Some of them are extremely qualified. Some of them are just willing to participate in a really challenging system and sit there and make decisions. I won't be supporting this today because I believe that if we say yes, there's a probability that a 90% chance that the Medical Center will get built here in this rural ag area and change an entire neighborhood and Hospitals and medical facilities are very needed on this island, but their placement is imperative and while it's it's wonderful that the developer would be willing to offer this property, I also know that there's an extreme value to the property. So as noble as that is, it's also a business opportunity. I just firmly believe that our authority and opportunity to devote on the behalf of the people is here today. And unfortunately, it's at second and final reading. The irony doesn't escape me that that's because it ended up in the newspaper. And I'm grateful for that. West Hawaii doesn't have a newspaper reporter. So there's a lot of things on the West side that we don't get exposure that I think would be helpful to community. So I humbly will not be supporting this today. And I ask my colleagues to take that into consideration that this is the one time it will be before us. And if we have concerns about the community and the neighborhood that resides around this area, we question whether or not this is a proper potential placement for a major medical facility. I yield. Mr. Rye, when does the, I'm sorry, Chair, but because these are all interlocked and we're having a general discussion, and I understand this is bill 219, but there's a lot of components here that the community is trying to understand that tie in together. So I need to ask some questions that are two and nine related but do relate to other things that are happening at the same time. Please just be mindful because I don't want us to be confused about what what we are approving today and that's whether we're going to grant rezoning that would allow for a 23 lots of division. Go ahead. Mr. I, when does the EA have his open period of the planning commission? Or when does the EA finish then done and then when will this hit the planning commission? The public comment period ended on December 6, I believe, so it's closed. The consultant preparing the EA will deliver it, the final version that includes all of the comments received during that process to the planning department and at that point the director will determine whether to issue a finding of no significant impact or whether additional processes need to occur under the environmental review process. Only upon completion of that process can a special permit application then be filed by Heel Medical Center and that would then start the special permit process which is about 90 days to hearing. Okay so relatively estimated we're looking at summer next year. Um, it could you could see a filing as maybe early as Marge. I got I have to be careful. Well, I'm just just I'm just going to ask man. I'm not going to I'm just guessing what they're doing. Um, it could, you could see a filing as maybe early as March. I got to have to be careful. Well, I'm just just, I'm just going to ask man, I'm not going to, I'm just guessing what they're doing, you know, so I would say maybe early as March, you may see a special permit application if everything tracks very, very expeditiously. Okay. And then just to really nail, nail the point that we won't see this again the bill passes this bill to a nine would Pass not pass we have no part to play And understanding what corporation council is outside researching We will have a part to play in the EA or the planning commission hearings. That's separate of the county council Um director planning director if you could answer that question please. That's correct it'll just stay with the planning commission. Okay. I have one last question. If 209 was not needed, then why is it in front of us? So I'm getting I'm just kidding. I'm trying to track this down a little confusing if we didn't need two one nine two Move forward with the subdivision then why is it in front of us? Two one nine is specifically for a proposed twenty three lots of division that's it It has nothing as we mentioned and been Stating has nothing to do with the medical clinic. Okay let's take the medical facility off the plate. Can the subdivision proceed without the passage of bill 219? Oh okay that's what I thought. I heard something different when it first started maybe I misunderstood. So 219 is important because without 21.9 the subdivision can happen. Although it's already been approved from the planning department through the subdivision process. I see what you're I see where the confusion. So regardless of medical facility, 2.9 is the carrier for both the subdivision and maybe the medical facility in the future. No, director, please read. So I think the confusion is with the 2311 subdivision that occurred to break off that portion that was set aside for a potential hospital or medical facility. The remainder is everything is still zoned to agricultural 20 acres. So they cannot break them up into one acre lots. They need the rezoning to be able to do the 23 lots of division. So if, I mean, again, we're not getting into the weeds here, but even in the background recommendation that was provided to the Commission and the Council on page two under the objectives, there was a clear direction of regarding the relationship between the proposed rezoning, the future subdivision, and the medical clinic. And it clearly stated that if that does not get approved, then they were gonna proceed and use that area as part of the subdivision for the 23 lots. Okay, thank you. Thank you. So this is where I'm at. Community is concerned. I like all the whole. It's beautiful. It's a very nice subdivision everyone I know who lives there likes the subdivision you have access to care. Oh, you have access to Navajo colonial pool It's a beautifully laid out area and the nature of the neighborhood is beautiful I believe the medical facility will impact that nature of the neighborhood and you have some obvious concern from the community. They do not feel like they've been in the know about what's happening whether or not it's been put out whether or not it's been noticed appropriately. I'm not questioning your process. I'm just saying as of right now I can see there's a disconnect. Medical facilities are needed, but I like the statement maybe not in the subdivision. So I don't want to kill this bill because I understand this bill needs to happen for the subdivision to happen and we need more housing and we need more lots and I think this is perfect for the one acre lots that we talked about. The medical facility is offering some concern. So because we have more components of this rolling in different areas outside of our purview, I would like to ask the council today to postpone this. Perhaps that gives you time to talk with community. We can't go anywhere right now because we have things working outside of the council. I'm not saying no today, but I am asking for a time for you folks to reach out to community, have the discussions and nail down how you want to proceed. I think it could have been done better. So I'm going to be requesting a post-pulment from this body. I would like to know if there's a date that you would be interested in seeing this pushed until. I don't want to hold up the development. I like where you folks are having what I think we have to alleviate the community concern that has arisen. Thank you. If you just think about that and we're going to go on to the next council member Kagiwata. Thank you chair. So, sorry sorry I feel like we're beating a dead horse here but just want to be very clear. If we say no to the 23 lots for the subdivision, can the special use permit for the medical center still proceed in its own arena. Yes. Okay, that's what I thought. So does not matter what we do for these 23 lots has no bearing on if the medical clinic medical center thing can proceed or not. Correct. Okay. So in that case, it sounds to me like there's no objections to these 23 lots. I'm very much in favor of not postponing this, but passing this today. I would be supportive because that has nothing to do with stopping or allowing a medical clinic to be developed. Correct? Correct. Okay. Thank you. And I just want to point out that at our last meeting we had this report from the planning commission and it very clearly states in there that there's a portion of the rezone area parcel 81 as the site for proposed medical clinic. This is not the first time that we as a body are hearing about this. We did hear about it. We talked about it. That was the reason that Council member Kim will recuse herself. We definitely talked about it last time. It did not, I think, resonate in the way that it's resonating now because we hadn't heard from the public about that specific issue. But I do want to be clear that it was talked about and we did know about it. It wasn't sprung on us. But I can hear that it was felt like it was sprung on the public. So that's a different thing. But to me, these are two separate things. And if the council members that represent those districts would do a really good job at getting information to the public, as the potential clinic goes forward, I think that there's a way to support your communities of getting involved and having their voices heard. So that would just be my thoughts on this. I'm happy to support the rezone in order for them to do the 23 acre lot development. Thank you. Thank you. Vice Chair Onishi. Thank you, Chair. So Mr. Array, so this project is like 20-something acres, correct? The last six acres. Yeah, the parts that itself is just over 26 acres. The subdivision will consist of 23 lots. One acre lots. So that's going to take 23 acres of the 26. For the lots, the rest of it is just roadways. Right. Okay, and then so that separation of the other piece of property, that is another seven acres? No, it's actually a portion of the 26. Right, so you have a little over 26 acres. They're setting a size 7 to 9 acres Which would drop the balance of the 26 acre parcel down to like 17 okay, so if we the council the body says we want you folks to build the 26 a 23 lots and we approve that Is that okay? The zoning is doing exactly that by approving the zoning, you're you're affirming that this 23 lot subdivision is the right project in the right area. Correct. And so and then that way, if folks would have maybe another two and a half acres because you got to have roadways and so for rights, so that's going to take some of the 26 correct the roadways yes yeah okay and so I don't think what like what we heard before of the seven something acres that was supposed to be the proposed site for that other place I don't think we'll be able to do it. And so if we do approve this bill, and having them stick to the 23 lots, there'll be 23 acres of land that's gonna be used, plus the roadways and so forth. So they might be using like 24 acres. And that leaves maybe two point something acres left left correct? Because the project site encountered by this rezoning request is little over 26 acres, if hilo medical center is successful in getting a special permit for the clinic, they would then consume about seven to maybe nine acres of the total 26 acre projects. That would leave a balance of like 15, 16 acres and then whatever lots they can carve out from that balance is all that. It's right. It's Kagiwata had mentioned earlier. Okay, this build is for 23 lots, one acre size in front of us. That is the proposal for the entire. And if we pass that, that's, you guys, like, be allowed up to 23 lots to build. This owning is a more of a function of minimum lot size. be allowed up to 23 lots to build. This only is a more of a function of minimum lot size. So it's all it's saying is that you can carve out the land into lots, no less than one acre. How many lots you can carve out with whatever land, piece of land you have, that's all you can do. So, right. But your proposal to us is you want 23 lots. For the entire structure. So you guys telling us, and that's what we were, we're gonna be approving, right? That you folks say that we wanna sell 23 lots. Correct, correct. And so anything else, it's whatever, but you guys are saying we would have 23 lots. Yes, Right? That is the purpose of the, yeah, the rezoning. Okay. So, I mean, to me, it's like this cog your water mission that that's what we are here for is a 23 lots, right? And then you folks are going to be obligated to the 23 lots if we passed this. No? Director. Thank you, Chair. As Deren was mentioning that the, you folks are approving the zoning. Right. Whether or not they utilize the zoning to create one acre lots or not, that's the ability, that's gonna be the outcome of the subdivision. If the medical facility gets approved, that will not be subdivided. It'll just remain one lot, whether it's nine or seven acres. The remainder of the land left will be broken up. So there's nothing in the zoning ordinance that I'm aware of says you have to do 23 locks. So can we put a condition? Let's see. I mean I think this would help the council members knowing that it will help with their decisions. Equiperation council, I think the question being asked right now is whether a condition can be added to a change of zone ordinance that forces up proposed use. There's varied multiple uses within a zoning type. I think I know the answer, but if you can come and stay on the record. Good afternoon. Morning Elizabeth's Trans Corporation Council. The condition of zoning would have to bear some nexus and proportionality to what's before you. What I've heard today is the desire that this county has to restrict a use on this property is not tied to the rezone because that special permit process is already available to the lot. And so by tying a restriction like that to the re-zoning, there isn't really a connection between what you folks are seeking to do and the rezone. You have a larger and different issue about the type of use within this type of zoning, regardless of the bill before you. And so, the proposal doesn't really make sense, and it could be subject to challenge. Okay. Okay. Thank you. Well, Mr. Wright, so hearing from the council members that seems like they're not, well, they want to postpone it or they're not going to support it. I mean, how would you folks be able to satisfy their concerns. The concerns are one of maybe a better communication with the community members. That's what I'm hearing. The concern I have is that so much of it revolves around the medical clinic. And it's something that the applicant graphic images, cannot really speak directly to because they're not the ones proposing the medical clinic. It's a lot of medical center. So we just don't see how postponement of the bill can help facilitate that discussion because that discussion will hopefully occur by heal of any medical center when it goes through the whole special permit process. And if council members are able to find an opportunity where individually, you know, they can participate in the comment process as part of the special permit, you know, maybe that's an opportunity there. But we are the, of the position is, the graphic images are why we was simply providing an opportunity and they thought it would be helpful, you know, for the broader community. At least giving Hilobinion Medical Center the opportunity to look at this property to see if it's the right location for a medical facility. That's all that graphic graphic image is how I provided just an opportunity. They're not making a promise that it will happen. They're simply saying, if you can't make it work, here it is. I'm just going to, I'm just going to, because the holiday is kept. Not opposed to the subdivision. The community is spoken and it's our job to listen to community. I think that a post-pony would be good. It's not saying no to the project. It doesn't put you off that far. If we look at them two weeks, two a month, it gives you time to reach out to them. There's been no output from the Banyoff Medical Facility to date about what they're doing. We have an impending when we're planning commission meeting coming. So if you're open to the idea of postponing, it walks us into the near, it gets us through Christmas. It allows everyone to have their holiday, takes a stress off. We work on this in the new year and we start this off fresh at that point. And I cannot speak highly enough of the old-ahole subdivision. It's beautiful. But I think there might be some room for listening to community as well as tying in the Veniath Medical Facility to the discussion and having a broader discussion with everyone and seeing what the thoughts are in January. Are you open to that? Can I take just a moment to confirm with the applicant? Yes, please. Sure. And before we do entertain a motion for that outspiel on Bill 2 and 9, it's before us. Just wondering what the plans are to meet the affordable housing requirements of this bill. I believe it's a 4.6 credits that are going to be required. So how do you vote to intending to meet that? I know we had this discussion briefly. Right now, there's nothing really on the table and how to satisfy. We also were well aware that council was considering amendments to chapter 11. So we sort of like kept that open, knowing that whatever is put into place when the subdivision for this project proceeds for that at that time, they'll simply have to comply with whatever requirements are in place. Is that true corporation council where my understanding is that the current chapter 11 would apply because that's what we we we passed this ordinance on the current chapter 11 so it wouldn't be what chapter 11 is at the time of subdivision approval. Or director if you have anything to add there. I would believe that it would apply to the condition that is approved in the ordinance. Meaning that it would be the chapter 11 at the time the ordinance was passed. Thank you. All right. So no plans right now or commitment to a certain avenue of meeting that before it was in requirement. With that information that was just shared, I'm well aware that there's a lack of like credits available in the East side, so that kind of limits those opportunities. Again, because I had a different impression of how chapter 11 can apply, you know, we didn't have that discussion. Okay. Also, I'm trying to understand in the case of the separate process that's going on, we have a final subdivision approval within 10 years for this specific ordinance. It's approved. How does that work if the medical center process does and that going through, does this zoning then would be revoked in 10 years because the conditions of this change of zone would not have been met because this medical facility is there the subdivision didn't occur. How does that play out? so the Overall Project is much larger than not much larger, but it's larger than the medical proposed medical facility area. So they will be required to meet the conditions of the ordinance relative to the area that they are going to be subdividing. Okay, thank you. I just wanna point that out, you know, this council has made policy decisions regarding change of zone in making sure that conditions are met or it's automatic reversion and if extensions are needed it will come before this council moving forward. So I want to make sure that the developers are clearly aware of that if this is to pass. I'm in support of this bill. I clearly hear what community is saying and we'll reach out or we can talk story about how that special permit process would work before the WNWRIT Planning Commission. But this is a separate application and I do support a 23 lots of division as proposed here. What's being proposed elsewhere we can take up and happy to work with you folks on that. And so the fact that the community has asked for a pause and is looking for some confirmation and some greater understanding of the long-term plan, I am willing to support the postponement today because I think there is wisdom in that. We're going through the holidays and I don't see an immediate need for a rush to push this through. So I feel that there's wisdom in taking that pause and allowing for those conversations to happen. And allowing also the medical facility management team or planners to hear the concerns from the community. The Benioffs have been incredibly generous and gracious to us on the Big Island. And we know how much need there is for medical help. We also know the need for housing and affordable housing lots. I have some, I just have a lot of concerns, so I believe there is wisdom and it does more good than harm than to take the pause. There is no downside to taking the pause and allowing the conversations to happen to remediate some issues and allow for whether or not it's Cheri Naba or Council member Connie Lee Kleinfeldr because this is in his district, but to all sit down together so that moving forward, the subdivision could be something that could be celebrated. And if or when or how a medical facility goes in, that could also be celebrated instead of feeling contentious. So that's my mnall for today. I yield. You know, as a young college student, there was a time where I thought, oh, should I go towards policy and politics or law? To be honest, I chose correctly going into law. But not for reasons that you might think, you know, I over the last four years, my respect for the work that you folks do has exploded. You know, you don't have easy jobs and it's been a pleasure, a challenge, you know, you know, just so many words that I don't well express to be able to serve the community I love in this way to do my work, that's to support the work that you folks do and the work that the county does. It's just been an immense pleasure. You know, the concept of change is really baked into our political system of government. And it's just been an amazing process to watch how that takes place every two years and now every four years. And I've had the honor to serve this community in a couple of different capacities and I've just been really and truly grateful. And just really want to thank all of you for the opportunity to have worked with you. I've worked with an amazing group of attorneys who will continue to be working with and you know with the change in administration there's new opportunities and challenges that I look forward to hearing about for all of you but just thank you so so much for the opportunity to have worked with you.
