All right. Good morning, everyone. I'm going to call to order the March 5th Charlotte County Code Enforcement Special Magistrate hearing. We walk you through a little bit of the process here because I hope that this is the I hope this is your first and only time here. This is a evidentiary hearing process under chapter 162, Florida Statutes. It is a civil process. What the process is is you have received a notice of peer possibly for a notice of violation, maybe for an affidavit noncompliance. What that alleges is that there is a violation with respect to your property. Either the Florida Building Code, the Charlotte County Code of Ordinances, or the International Property Maintenance Code. This could be a variety of items. It could be high grass. It could be failure to do work without a permit. It could be junk like conditions. In every case, whether you're here for a new case, which is the first time the case has been heard, or you're here because of you received NAFTA of noncompliance, which is a case that has already been heard by myself, or one of the other special magistrates, and found in violation. And when that violation was not cleared, this is a hearing to determine whether or not fine should be imposed. And either of those cases, the burden will be on the county to prove to me by proponents or evidence, which is more likely than not that the property is in fact in violation. So I'm going to ask all of you to do is I'm going to have you swear in in just a moment. The county is going to swear in. I have not talked to any of the county staff regarding any of these items as each case is called The code enforcement officer assigned to that case will come up. They'll present the case They'll show photographs to you. You'll ask you to review those photographs and identify if those are in fact is your property And please look at the photographs at the bottom of the photographs. They'll be the date the photograph was taken. So oftentimes, the photograph will show maybe a bunch of junk in the front yard, some hurricane debris, something like that. That'll be from the date of the violation. Doesn't necessarily mean that's the condition of the property today. When you signed off on those photos, they'll be presented as evidence. You'll be allowed to present evidence yourself. but what I'm going to ask you to do is allow the county to complete their entire presentation. Don't break into jail, okay? If I find the county has not met its burden of proof, I'm going to dismiss the case. If I find there has been met the burden of proof, then I'll ask you to come up and rebut that evidence to indicate how the property has been cleaned up, whether there is no violation where you maybe you had a permit in place, and there's been a mistake, it happens. It also happens that sometimes it's the wrong property owner. The wrong property has been cited. So at that's the point where I want to hear from you. If everyone's in agreement and the evidence shows that there's a violation on the property, The next thing I'm going to ask you is how much time you need to get the property into compliance. Okay, so that's my that's my promise to you. You tell me what you need to get the promise the property in compliance. If there is if that is a reasonable request, I will give you that time. At the conclusion of that time period, I will I'll All the county go back out, rein spec the property, and if the property hasn't been brought to compliance, only then will find start to be accrued against the property. And so if you're here for the affidavit noncompliance, you've had a property that was previously found in violation, that time frame has run. And now you're here because you've got notice that there's going to be an imposition of fines. And so again, county has to come up here and show me evidence that on the date, the order was to be comply with the property had not written to compliance. So with all of that, I'm going to ask you now to all stand be sworn in. Do you solemnly swear the testimony you're about to give is the truth, the whole truth, and nothing but the truth? If so, please answer. I do. Okay. All right. We have, we're going to start with the oldest case is going, going first. First, old case is COD 22-02181. The ribers and Mr. Stedman and Poole. This is. I reinspect that the property on January 22nd, 2025 and found the violations substantially still exists. This is the second ANC which is a 90-day fine and the amount of $4,520. Okay, thank you. But the issue is these properties are in a special habitat zone for an endangered bird. It doesn't mean't clear the property but you need to go through a process to do that. One, you pay the permit fee to clear the property and that permit fee is a special fee that was worked out between the county and the U.S. Fish and Wildlife Service to allow people to do this within their county without having to spend 18 months trying to work their way through getting specialists and all sorts of stuff. So essentially what's happened is the county said residents in this area where this bird is, we're having to go up to think is Viral Beach wherever the wherever the location is for the Fish and Wildlife Service and they spend months and months trying to go through this process for each individual lot so the county worked out a process an agreement with the Fish and Wildlife Service in order to let people come in and get a permit locally to clear the lot without going through all the hoops so that there's's a fee associated with that because the county takes that fee and goes out and buys land to preserve on behalf of the bird. There's also a penalty associated with someone who clears property that's subject to this rule ahead of time. So there are two steps that need to be addressed. If I missed anything, I'll just roll over. Okay. Okay. And so what has to happen for this property to get into compliance and I suspect the next property is you're going to want to sign, you'll sign an agreement with the county and they'll pay a fee and they'll be a penalty. Well, we finally got through to somebody that listened and we got that done just yesterday. Okay. So the lots are killing combined. And then you can get the storage and authorization Yeah, I just ordered Billing okay, did I get put everything in then you know That is outside and open Right, let's have a sec. If you've ordered it, if you like, ordered a metal building or a trust building or something like that, and you've got the plans for it. Go ahead and submit for the permit for it. Once the permits pull that you're going to be okay. Everything's going to be cleared up because they know it's coming. So I'm going to give you 90 days to get that, get it all squared away because you're going to have to go through permitting and they make, you know, not the lots of combined. They may want you to move it certain spots and everything like that. And there's sometimes there's a little back and forth on that. It's not as, I know you could maybe do it in 30 days, but I'm going to give you 90 days to do that. After that, it would be $50 a day and the county would have the right to, you know, the property or remove the vehicles, clean it all up themselves. And the only thing we've ever seen that they might sometimes allow would be certain grasses that would still allow the water to flow but that's not typical either. They want a clear, they want a clear right away. Right. The water flow is not the problem though, correct? No, it's the- Can't say that for sure. It's the occupation of the 10 feet. It's the occupation of the 10 feet with the item itself. So we can cut it back to the 10 feet and we can keep the rest of it correct? Let me ask questions.
