Scorpius provided their state of the art, pressure max, cryogenic tanks, the first all composite, line or less cryogenic tanks of their kind to operate beyond the Van Allen belt and land on the moon. I'd like to provide an update on the recent announcement by the California Department of Forestry and Fire Protection or Cal Fire. Beginning February of 2025, Cal Fire through the Office of the State Fire Marshall initiated a rollout of its 2025 recommended Fire Hazard Severity Zone map for local, responsible areas or L and the torrents is an LRA, a local responsibility area. These maps are typically updated every 10 years and are based on science-driven models that evaluate fire-likelihood and behavior, wildfire history, excuse me, wildfire history, fuels, vegetation, and when I mean fuels, they mean weeds and vegetation, weather and terrain. These maps categorize areas as being at moderate, high, or very high risk for wildfire. On March 24th of 2025, the Office of the State Fire Marshall issued the 2025 recommended local responsibility area, Fire Hazard Severity Zone maps, which includes areas impacted by the city of Torrance. These zone maps are available for public review at the website of the office of the state fire marshal, which is osfm.fire.ca dot fire dot c a dot gov. The Torrance Fire Department has reviewed the 2025 Cal Fire LRA Fire Hazard Severity Zone map and identified an area where parcels will be affected. The Torrance Fire Department anticipates future building and vegetation management requirements as a result. In compliance with state law, the city must now take the following actions. Within 30 days of issuance or April 23rd of 2025, the updated fire hazard maps must be made available for public review and comment. Within 120 days of issuance or July 22, July 22 of 2025, the city must formally adopt the maps through an ordinance process. To support community understanding and transparency, the Torrance Fire Department will be initiating a series of community engagement efforts including Torrance Fire webpage, social media posts, and in-person, which will focus specifically for the neighborhoods impacted by the changes. Public hearings will also be scheduled to meet all legal notification and participation requirements, which will include before your honorable body. We've already begun internal plannings for a strong public outreach and education campaign. Our goal is to ensure that property owners are fully informed, especially those who may now be subject to the California Building Code Chapter 7a and Defensible Space Requirements under Public Resources Code 4291. In light of recent L.A. wildfires, we recognize this can be an unsettling process. While this is a state mandated process, the city's role is to ensure full transparency, public access, and compliance with all required steps. The maps can be reviewed at the Cal Fire website. Public hearings including virtual options will be scheduled in the near future. Details will be posted online. Every time the trash is taken out, some of it spills out, so at least when city workers come along, it gets picked up. And it's not as though we are offered a good product to maintain. It's mostly weeds, and I would hope that in the future some time that that entire stretch from Hawthorne Boulevard all the way to city limits would be relan escape with low water and low maintenance need plantings. That's what kind of a mayor you are. You don't even know the rules. You don't know the first amendment, Goober. Share on you. I know your time is up. And we don't allow disruption when someone else is speaking. So that violates our code of conduct. There's a violation to what you should speak. So someone else who wishes to speak. People from developing, there's a crime. with the Republican Party held by Donald Trump constantly cutting our rights, our snap benefits, our veteran benefits, our Medicare, our social security, all these institutions that help protect us live at all or even live good lives, having the EPA cut so that we have mercury and water potentially without any oversight from the federal government. The fact that these agencies are no longer able to protect us, and that if we try to act in a way that is not in accordance with them, they will cut our funding. I would like to know what you as the Council of Torrent City will be trying to do in order to protect your own citizenry from these kind of constitutional crisis overreaches from the federal government. And tonight we have a presentation on agenda item 9A to consider the appeal of planning commission approval of a precise plan of development and a waiver to allow one and two story additions to an existing one story single family residence on property located within the hillside overlay into our one zone at 671 Kayamir Mar. This item comes to the City Council on appeal followed by the owner of real property at 285 Viet Linda Vista, which is located adjacent to the project site. Next site please. This presentation will provide an overview of the project that includes locations, site plan, elevations, site photos, and a recommendation by staff to the City Council. Next site please. This slide shows a project location and naming properties along Kyrya Miramar, via Bonita and via Linda Vista. The project site has a zoning designation of R1 zone and Hillsor Riverley, and is bounded by properties that share the same zoning designation and developed with one and two storage single family residences. The project site is highlighted in light blue color and the adjacent property located at 285 L'Ville, Indavissa highlighted in orange color represents a neighboring property owner that has expressed concerns related to the project and follow the appeal that's being considered this evening. The project site measures 6,996 square feet in area and contains an existing one-story single-family residence with an attached two-car garage originally constructed in 1952. The residence is orientated toward the southwest facing Kair Miramar and the two-car garage is orientated toward the southeast, basing via Bonita. The project site features a downslope from the front yard down to the rear yard with properties to the north situated further below along via Linda Vista and properties to South along Kymer Mar situated above the project site. Next site please. This slide shows a project site plan which has been rotated for illustration purposes. The proposed residents features one and two story additions that result in 3,368 square feet of total floor area and would result in a 0.48 floor ratio known as FAR, which is within the allowable 0.6 FAR limit of the R1 zone. The total land area covered by the residents measures 2,300 to 6 square feet, which is also within the allowable lot coverage limit of the R1 zone. In addition, the total usable open space in the front, and rear yard measures 4253 square feet in area, which also meets the minimum open space requirement of the R1 zone. Staff notes due to site conditions and existing layout of the residents and garage. A waiver of the setback requirement is necessary to allow the secondary additions, while maintaining the existing portions of the residents and garage in their current location. Staff is supportive of the requests due to the regular lot shape, site, topography, and the existing layout of the residents and the garage. Next slide, please. This slide shows elevations to the proposed residents. The residents measures 24 feet one inch in height, which is within a allowable 27 foot height limit for the two-story residents in our one zone. In regard to the project design, the architecture demonstrates appeal through modulation, building masses, elevations, and replines that promote visual interest. Exterior finishes are consistent with new residential construction and the vincidity, such as the combination of brick accents and smooth stucko. Additional features and design enhancements include a second story balcony facing northwest, which promotes quality experience and increase value. Next slide please. This slide shows a north view toward the project site taken by staff while standing along Kyrie, Myanmar. As mentioned, the project site features a downslope from the front yard down to the rear yard. With properties to the north, switch situated further below along Fiel and the end of Vista and properties to the south along Kaira Meowmore situated above the project site. Next slide please. This slide shows a south view toward the project site, which was taken by staff while standing in the rear yard of the adjacent property located at 285 VL end of Issa. As can be observed from the photo, the adjacent property is located below the project site. At the center of the photo, a side elevation that existing two car garage can be observed and further behind and above are story poles for the silhouette that represents the second story addition. the request of the property owner, staff conducted field observations of the silhouette as viewed from their perspective for consideration of potential impacts of privacy and sunlight. Staff noted that proposed second story edition would be visible from the property at 285 BL end of VISA. However, the second story edition is positioned away from the adjacent property and behind the existing two-car garage, which reduces the potential for any significant adverse impacts of privacy and sunlight. The secondary edition would also feature a balcony that is orientated toward the northwest and does not face directly toward the adjacent property down slope, which reduces the potential for any significant adverse impacts privacy. Therefore, based on these field observations, in the judgements, the proposed second-story addition would not result in a significant adverse impact to privacy, nor to view light air for the adjacent property at 285 VL end of Issa. Next slide, please. And in closing remarks, the recommendation of the Planning Commission and the commuter-developed director is that City Council deny the appeal and approve the project. Next slide please. With that said, thank you all for mayor and city council for your time. I conclude the presentation and we are available for questions. Thank you for the presentation. Quick question on slide five please. So upper left corner, there's a deck extending from the property and there are a couple windows. And what are the recommendations from the staff about this deck? Are there any concerns from the privacy as far as the deck you're extending out? Councillor Mevershake, what you're referring to is the North elevation of the proposed residents with the second story edition. Is it identifying the project plans as a, but it actually serves as a balcony to the main bedroom at the second floor. That balcony features a 42-inch glass guard rail, and then facing north are bedroom windows, that will appear at low-side, still high, but would be for the bedroom at the second story level. In terms of recommendations for any potential concerns related to privacy or whatever concerns an adjacent property may have, the planning commission did review the project in December. A couple months ago, staff did recommend approval of the project, took into consideration the concerns raised by the adjacent property owner, and did approve the project as proposed without any conditions approval that would address concerns or any aspect of the secondary edition. I didn't get the last part. You're saying are you recommending no change? That is correct. The recommendation that was made by staff and as approved by the Planning Commission would be no changes to the current design of the project as proposed. Okay, I'll come back to those later. Thank you. All right. Any other questions from any members of the council? If not, I'm gonna go to the appellant. Is there an appellant here, whether you have a presentation or remarks, you have up to 10 minutes, sir. Yes, I do have a presentation if we can put it on before we start the clock. That would be very helpful. Thank you. Thank you, City Council and honorable mayor for this time. Next slide please. We're asking that the approve the appeal deny the precise plan and require changes. Next slide please. This is the house location on Calais Miramar. As you can see, it is on a sloped piece of property. As anybody you can tell who walked this property next slide. You want to point out you can see the degree by looking to the garage, garage one, garage two, the house and the second story bedroom sits considerably atop the slope and basically creates a focal point in the backyard of my home. Next slide please. The reasons for the appeal in part is we feel that the city planning commission did not adequately take into consideration and follow its own process and procedures that it violated or whatever due process rights may exist as a result of this and the failure to follow the procedures and the planning of this I think call it into serious question the validity of the planning commission in decision in this case. I would also mention that there was an opportunity for comment. It was supposed to be seven days. It was only one day as a result of the website being inoperable. This denial of due process seems to be an ongoing issue. And I would ask that the council caked that into consideration as to why perhaps members of the public don't have an opportunity to file comment. Next slide please. Again, the seven day period was not followed. Next slide please. So privacy is the principal issue here. The planning commission should be taking into consideration designs that would reduce the loss of privacy in this case. And we don't feel that's been adequately addressed. Next slide, please. Privacy is not just something we imagine, we've been talking a lot here. You just made a whole bunch of people swear no to the Constitution of the state of California. The state of California has identified that we all have a right to privacy, the right not to be interfered with so that we can enjoy our backyards. And there is case law that identifies that a fence backyard is a place of particular privacy expectation exists. The current plan eliminates that privacy. Next slide please. Again, this photo I think documents and identifies really where the direct line of sight is from the balconies and the two windows that are planned. If you look at the plan, you look at where the windows are placed, you look at where the balcony is, they give a direct line of sight. All you have to do is stand there and look through the window. I don't see how anybody can dispute this. They are north facing. My property is north facing. Next slide, please. Again, these are other pictures that show that now the focal point of my backyard is now the upslope to bedroom property that is end balcony that is being designed and approved. We feel it should not be approved. Next slide, please. Again, here is what the exact same design looks like. Here's a straight line from that window, straight line from the deck. That's a right angle. I defy anybody to tell me that you can't look through that window into my house. This doesn't make any sense when a modification, a movement of the windows, a modification of the depth could eliminate this or at least diminish it, that should be taken into consideration. Next slide, please. The two slides next to each other, if you look at where my house is, the two red lines to the left will show you where there is direct line of sight. And I would encourage that for the people who have come to the property and looked, this is obvious. And for people who have gone to the backyard and looked this again is obvious. Next slide please. That is what my backyard looks like at night with the windows open. That was taken standing on a ladder on my fence line from the view that is approximately where their house is going to be looking. I don't know about you, but that is my daughter's bedroom to the left. That is my bedroom to the right. I don't feel that this is giving us adequate privacy considerations. This is my backyard, not my front yard, not my side yard. This is my fenced back yard. And I think that if you are interested in increasing value, privacy should be one of the considerations. Not just building for the sake of building, not just building so that people can enjoy a view at the expense of privacy. One of the reasons that people move to this community is for privacy. privacy. If we have one to live in Hermosa, three feet from each other, I would live in Friggin Hermosa, not in Torrance. Next slide please. Sunlight, we live in a sloped area where you can see from the sunlight right there, the sun is just above the crest of where that is. We're going to have increased mold, increased moisture and dampness, and we're going to have a diminished opportunity to exploit any solar potential based on the positioning of this house. I can't prove to you right now because I haven't built the garage as I'm still waiting for plans to be approved by the city as to the change from my garage. How it will impact it? I can't, but it seems reasonable to conclude that based on the arc of the sun and the fact that we are north facing and that that property is going to have a second strike, will impact the ability to have a solar panel in my garage, on my garage. So if I have to pay more for electricity, thank you for that. Next slide. Finally, the reason for the appeal also is that I felt that the City Planning Commission, staff in particular was unduly influencing the Planning Commission. There was a direct statement that we can't put it onto the next agenda item. Too full. It was a direct statement by staff that we only had a thing for you to approve it. This is not hard. You could have two tick boxes, approve or disapprove. But when you only put one choice before the planning commission, approve and only approve and you tell them that, what are you communicating to these people other than approve it? Don't ask questions to shut up, approve it. I don't think that that is the way staff should be dealing with the planning commission. There should at least be a yes and a no on every precise plan that goes fair before the commission. That is reasonable. Even when you put a judgment before a jury, they have yes or no. This should follow the same basic rule of law. Next. Finally, we have tried to be reasonable. We have been told that no discussion will happen unless we withdraw our appeal. That is what we're faced with. That is why I'm here today. I have made outreaches to make changes, but I do not feel that any of the changes could be discussed because I was told unless you withdraw your appeal, which is my right, I cannot have a discussion about what modifications might be reasonable. Next slide, please. Our proposed modifications at a minimum are movement, opaque, or removal of the windows that are directly looking at my house. These are admittedly north-faced windows. My property is north of their property. This is obvious. That is a direct line of sight and if you stand out on that deck patio you again have a direct line of sight. Next. The relocation of the deck I proposed was scoffed at and dismissed without any reasonable consideration. I don't know why I'm moving the deck around to the other side of the building is such a big deal. If they have to have a deck, if that's what they want, why isn't that on the table, why can't that be considered? Why do I get to be dismissed and told that we can't even have a conversation about it without me having to withdraw my appeal, which is the only opportunity for due process in this process. Next slide, please. In conclusion, it's our position that you should approve the appeal, that you should give an opportunity for proper consideration of our privacy and our loss of sunlight. And that you should deny the precise plan as it is presently and require changes to the precise plan that are more consistent with how this particular historic part of the Torrance community is designed. That is designed purposely, purposely with what? Double setbacks, it has a green scape concept. The whole idea is to promote privacy. Again, if we wanted to live on top of each other, we would have bought in a different city. Matt Hatton Beach is fine for some, Hermosa. If you want to live with three-foot setbacks, great. But that's not this part of Torrance. That's not what we bought into. and you're allowing by ratifying these types of changes, these types of precise plans without any due consideration to the overall impact to the community. You're gonna end up with just another lot lined, a lot lined situation. And I don't think that that's what the citizens of this area want. I don't think it's consistent with the oversight. My name is Christine Fries and I'm an attorney at Beach Studies Law Group. I represent the Pellies, the owners of the property, a D and Brenda. I'm going to go ahead and kind of talk about a timeline and then I'm going to give them the opportunity to speak today. So, Miss Dixit, Brenda's family, has owned the home for a number of years since the early 1950s, and Brenda spent time going there as a child. And in 2009, her grandmother ended up moving to the Bay Area because of her age, and the house has actually remained vacant since 2009. Mr. Roberts and his wife have used to the driveway and have used materials in the backyard for their her business and there was a relationship between the families. Obviously, change is hard and when people are moving in to a house that's been vacant, there are a lot of concerns. A D and Brendainta began the remodel process in August 2023. In July 22nd, 2024, their architect, Matthew Sincere, who is also here today and can answer questions, paid the fees to the city of Torrance and submitted the required application for the proposed construction. By August 2024, the silhouette that has been visible in many of the pictures was constructed. It was not until November 26 that the appellans decided to file a comment with the city of Torrance about their plans. This was two days before Thanksgiving and a week before the hearing. They never reached out to Brenda and Adit before filing their comment. They only filed it with the city of the Torrance and Brenda and Adit did not know about the comment until the day before the hearing. During that December 4th hearing with the Planning Commission, Mr. Roberts noted his opposition to the plans and submitted suggested revisions to Adi and Brenda's architectural plans that were not based on relevant construction principles nor were they architecturally sound. None of the red arrows have been looked at by an architect other than our architect and deemed inappropriate, which I will get to. Specifically, the appellant complained of the windows on the two story and there was a question by a council member. Those windows actually face out over Brenda and Adiets currently already constructed garage. So they don't look directly into the yard, they face out over the garage. Additionally, he suggested plans that were architecturally unsound. The deck and the patio boxes that were present on the previous slide actually go over a already constructed high-volted ceiling area. And so no construction can be done over that area. And so the only place for the master bedroom in the balcony is where it currently is located on the architectural plans. Additionally, the balcony faces northwest to the ocean. Everyone today spoke about the city of Torrance and the hillside overlay and the beautiful ocean views. And that's what they want. They want those ocean views. They're looking out to the ocean. And that's the plans they have, any construction of the balcony elsewhere won't have the same effect. The committee correctly approved Brenda Nadeats plans. And yet, even so, on December 12th, 2024, did reach out to Mr. Roberts and offer to discuss the second story edition and to ease his concerns. But on December 18th, before the appeal deadline, Mr. Roberts responded stating he never saw Adi's email and demanded that they remove the windows at issue, the second story windows, and plant mature hedges along the fin sign. He then emailed them asking why the balcony was not being put on the south side of this second story and at that point Mr. Roberts appealed a deep did respond on December in late December and Mr. Roberts didn't respond to him until March 21st. So there is communication ongoing and my clients really did want to work out a solution but none was proposed in a timely fashion. In terms of this appeal, no due process was violated because there is nothing in the Hillside Overlay Statute that requires a public hearing to be conducted in any certain way. In fact, Article 41 states that the public hearing can be informal. Mr. Roberts was given ample time to present his arguments, and the planning committee has still decided to approve the plans, and a de-enbreda-do request that decision be upheld. This project, this process has significantly delayed their project, and it's caused a greater financial burden, and they hope that the appeal can be denied. to reiterate, the balcony faces northwest. In the bedroom, windows face northeast. The balcony is not a direct north facing balcony towards Mr. Roberts' residence. There will be no impact on the solar arrays. It's already been determined by the Plane Commission and the architect. And the second floor is 27 feet off the property line, not the home, not the backyard, the property line. So the picture of the home lit up at night is a little misleading because the second story is 27 feet away from where the ladder was. Again, I'm going to let a Dean Brenda speak, but we hope that you all determine to deny the appeal. Thank you. Hi, my name is Adi DeLiep. I am Brenda Dixit's husband. I want to thank you to the planning committee for their diligence throughout this process and we hope that you understand our situation. After our initial hearing, we reached out to Cameron via email to find an am solution to avoid the appeals process. The solutions he gave are not architecturally sound and impossible for us to consider. I have a physical copy of our communication thread via email for anybody in the committee who would like to see it. Our only mission is to be a part of this community and build a home for our family. We really are not trying to intrude on the privacy of our neighbors. Hi, my name is Brenda and I also just want to thank all of you for your help and your patience throughout this entire process. We truly do appreciate it and Torrance is such an important part of our family in our history. I just want to reiterate that over the last year, we've worked carefully with our architect, Matt and the Torrance Community Development Department to ensure that we are strictly adhering to the Hillside Overlay stipulations, while also respecting the peace and privacy of our surrounding neighbors. And I believe that it's important to note that the concerns raised in the appeal, they do not reflect the careful planning and the compliance that we've maintained throughout this process. And I just wanna end with the fact that I am, I'm just the most passionate about keeping the integrity of this home, which is, as you all know, it's very historical and very architectural unique. The only problem we have is since the committee came to a decision to accept our proposal when we try to reach out, again, through the committees reasoning to reach out to them to communicate with Cameron Roberts. He still shows not to give us even one single viable option via email to respond to accurately. The best way for me to illustrate this is to show you our email thread that I have printed out and I think it will highlight everything clearly. It's time stamped with everything I reached out. I can read it to you. Thursday December 12, 2024, 3.43 pm. Hi, Cameron. Firstly, apologies for delaying and writing to you since the committee's decision. We've had a lot going on. While they have made their decision, we understand that a second story is not ideal for you. We also understand that the balcony has some concerns for you and most of all, we can relate to the fact that this is a big change for you given that for 15 years, home has been unoccupied and your family has had the privacy of our home without any residents. Great. You don't have to read the whole thing. I already just want to understand. So was there any communication back to you and what was the response? He sent this email on Thursday December 12th. On Wednesday December 18th, six days later, Cameron Roberts responded, a deep Mary and Brenda just exchanged text messages and I just found your email. We will review and reply. The next response was in was on deadline day, Thursday, December 19th, 239pm. Less than three hours left before the deadline was there to file the appeal. Instead of mentioning anything about this, he says, Adit and Brenda, 239 PM, Thursday, December 19. Thank you for appreciating our circumstances and acknowledging the diminished privacy. In the spirit of compromise, while your balcony may not directly face our backyard, the window adjacent to the balcony and slider does. Please take a look at the attached PDF which shows the current design. This is the red line drawing. Would you agree to one have only one window in the second floor master removing the window directly facing our backyard and closest to the slider and balcony? So he gave that. And he said, Plant mature hedges exceeding 10 inches in height along with our shared fence, which is expected to grow to at least 18 feet between our backyard and yours. See, attached PDF1. He then gave us his contact, his cell phone, and he said, I'm available now at 2.39 pm. At 408 pm on the same day, he sent another email, a Deaton Brindar. Is there a reason you're not putting the balcony on the south side of the second story? If you were to do that, you would get your desired view from the vantage point, right? With that, he attached an alternative deck plan, again, an hour before the deadline. Finally, he submitted the appeal. At which point, that's when we responded saying, we don't feel like you're being genuine with our communications. We tried to reach out to you, and you filed an appeal without telling us and you didn't even try to respond and engage with us. And then from there, it was only three months later that we then ended up hearing from him, aka last Friday. So was there any comments that the only way we're going to talk to you if you withdraw your appeal. Yeah, that was the words I have is on Wednesday, December 25th. See that? Yeah. On Wednesday, I just want to make it clarify because it's important. Yep. On Wednesday, December 25th, on Christmas Day, Cameron writes to me, he missples my name, he writes, Umeth. The city's process did not give us much time. I regret that I did not find your email until our wives texted. This man gave us his business card after the committee hearing, saying, email me so we can talk about this to settle it. I followed his instructions. I replied as soon as I told of it, that's what he said. Rather than exchange emails on Christmas, I invited a call back to address any confusion caused by my emails. These are Cameron's words. I am open to withdrawing the appeal and writing a letter of support if we can reach an agreement. I hope you will reopen the door to having a settlement discussion. A city council debate is not an ideal forum. We should work to resolve our differences sooner rather than later. At this point, I responded. We have always been open to having a mutual settlement and agreed to your proposal of putting in hedges for privacy. As we've continually shown, the window plus balcony does not look into your courtyard or property, and the committee committee as well as our architect have agreed and approved our plans. Changing your mind and putting a stop to the approved plan for our home has caused unnecessary stress delays and inconvenience to us. In spite of that, we have been respectful and communicative to your wife. If you wish to have any further discussion with us, you must first withdraw your appeal, otherwise we prefer to have these conversations with the committee and our architect present. As we navigate this unprecedented setback to an already approved architectural design, we request you to reconsider, to consider withdrawing your appeal, and we will in turn ensure your privacy is respected in this long process of renovating our home. This this is the thread and then from then we never heard back from them until Friday. Okay, so you all thank you for that. You also mentioned there's no, the option is given to you they were not acceptable. What is acceptable to you? What compromise are you willing to do? Yeah. My clients at this point don't feel like they have to make a compromise. Sorry, it doesn't appear to be on. But at this point, my clients don't feel like they have to make a compromise. The architectural plans were created by an architect. and they work in a certain way. Obviously, changing the plans, they would have to go through the approval process again, and all the changes would have to be made further. I understand, but I think the question is, I think the Applington mentioned already that he did not agree with some of the options, but is he okay to work with the appellant at this point to work with some of the solutions? Because I visited the property. I think the balcony is extending for me. It feels like there is quite a bit extension. And I feel that you're looking at their house, the bedrooms, it's pretty obvious to me. So I wanna give you the opportunity that you wanna work with together without dealing any project, any delay on this project. Are you willing to change the side of the window or change some of the size of the balcony? I can, we can talk talk we can talk. So I just want to say throughout this entire process, we have definitely attempted to make some, you know, some, some resolutions with him. Like one being we offered to put a cut to, but that's exactly my point. I want to know if any modification was done or not. We just presented it as this. Did you compromise anything? Did you make any change or not? That's my point. We spoke about adding hedges. That was what we put in our email. We don't believe that the balcony, because it's facing the ocean, and because of the nature of a balcony, it's used and enjoyed you know to see the ocean views that the point is not to be looking in his daughter's bedrooms or his bedrooms as he's insinuating and The the window additionally is not you know the The window looks over the garage which is not going to be looking over his his backyard So we don't believe that those two need to be so since there was no change no modification to the property you just stuck with that and just the hedges we said we said we'll we'll modify the property with the hedges with the landscaping so that they're really tall and they block the view. Are you going to live in the property or are you going to rent the property? We're going to live in the property. Thank you. I do not have any question, but I do have some questions from a balance. All right. Maybe you could just, yeah, stand by. have a feeling. Okay, go ahead, Councilman Shake for the appellant. Well, the appellant have a couple of questions. There was some misunderstanding about the communication. Could you please elaborate on that for me? I didn't get the first email because it went into my junk and I found it only after my wife and I discussed it and she texted and was able to do that. I don't think the email is the only way to communicate though and I've asked them to call me and no one ever calls me. So I would say that there is some issue perhaps that could be resolved by a dialogue rather than a series of monologues. I will also say that I'm not implying that anybody is going to do anything weird or inappropriate by building a balcony in a window. I'm trying to say that I feel that the view is direct and that people are not recognizing that And if you stand on a balcony and you go like this and you look you can see my house in my backyard I don't think that having somebody being able to do that as directly and as close as this is is reasonable given it's my backyard and the right to privacy I have in my backyard. It seems to me that their views are more important than my privacy, and I realize that there's a balancing test here. And that's what I'm asking the Council to consider. What is the value? And the communications, the last communication I got was, I won't talk to you unless you withdraw your appeal. So I didn't like that personally. I didn't think that was reasonable. And then I wrote back on Friday and said, look, let's, I give it one more shot. And I said, you know, call me. And no one called called me no one responded to that email and here we are. Thank you for that also you mentioned earlier about setback requirements what exactly are you trying to say on this this one staff to respond on that too. Thank you. I say the staff is agreeing to a waiver of a requirement within the Hillside Overlay. There's a waiver that the garage be more than, I believe it's 10 or 15 feet, and that is being waived in order to accommodate their desire to have a second story and a view. There's a reason for these to be there and I don't think that anybody's taking that into consideration as well when you have to give, I believe it is, two waivers to two Hillside Overlaid Principles in order to accommodate the build. That to me seems awfully generous. Staff, you want to respond to that, please? Can some member with respect to the setback waivers? The waivers are necessary in order to proceed or allow the second-story addition, not because the second-story addition encroaches on the setbacks, but because the existing residents with the configuration of the garage towards the rear property line, as well as the front resident or the resident situated towards the front of the property as well. Currently, although they maintained the setbacks for single story dwelling, with the secondary edition would be considered an encroachment into the setback requirements. So it's not that the second story's addition itself is encroaching the setbacks. It's the existing garage at the rear as well as the dwelling towards the front. So setback waivers necessary in order to allow for the second story addition. These type of waivers are not uncommon in the hillside area where you have irregular lot shapes and difficulties with development, particularly because it changes in terrain. I wanted to just understand this. It's not uncommon. But. to understand this. It's not uncommon, but I still believe that there is a way you can compromise and have a communication with your neighbor and I think you guys need to speak to each other to find a better solution. I personally saw the property from his angle and from other residents' angle. And I see some definitely privacy issues in my views. I see that and I think that can be resolved. And I would like you to consider that, that would benefit to all of you. And from the balcony, you're extending balcony all the way that I can see. You can pick through the window through their backyard and the windows. They're concerning to me. So I will not grant this. I will accept the appeal on this. Thank you. Councilwoman Kalani. So that they still have their own instructed view to if you're looking out the porch to the left the right. But something nice attractive that fits in with the with the design of the house. Kense remember that is correct. It's not uncommon also for Hillside projects when they are proposing a second story balcony to have at least one elevation of the balcony be a solid guard rail, not a glass guard rail, and then also perhaps a higher guard rail that's perhaps 60 inches in height as opposed to a 42 inch high guard rail. Those design considerations should be asked of the applicant and their designer in terms of seeing if it's that something that they're amenable to as well. So if I may ask a question to the applicant, is that something that could be considered? Yeah, that's definitely something that we can consider. We were also talking about this too before. I think we can, if we basically extend that wall, or like you said, put up some nice iron trellis or something like that that obstructs the view to the Robert's home, that's definitely something that we're willing to accept. But not the opaque windows, we won't accept that. I see. Okay. Councillor and if I may add as an alternative to opaque windows the windows still height can be raised to let's say a minimum of 40 inches or 60 inches in height and therefore that may be an option for addressing and concerns related to privacy. That was my next question. Thank you. So is that something that the applicants would consider? Hi, my name is Matt Sincere. I'm the designer on the project. If we're talking about bringing the sill to 48 inches off the ground, I'm pretty as we can tell we're all taller than that so I really don't understand the difference between having the window about bringing the sill to 48 inches off the ground. I'm pretty, as we can tell, we're all taller than that. So I really don't understand the difference between having the window be, you know, 24 or 10 inches. I mean, there are 60 inches. I mean, it doesn't make sense to me. I mean, the fact is that no one's going to be standing at the window staring down at the neighbor's yard. I mean, it, I mean, I mean, I'm going to ask the audience, this is the way we're going to run this. It'll be a dialogue between here and the applicants. And don't we don't, you know, the crosstalk is going to cause disruption cause disruption so we just respect each other this way Go ahead definitely. I'll just say as the person who's gonna be living there that at night We like to close our blind so definitely that will all be closed and and we're not gonna be Staring at our neighbors creepily through our window. That's a little odd It just Feels a bit frustrating that we're all you know arguing about a plan that was approved But I will say that we're in the spirit of compromise, the window and these are some changes that we're making on the spot here. But that's definitely something that we can agree to if everyone feels that that can help us move forward and that can help us, you know, create our dream family home. So I wanted to just add one thing. Yes. We, we've gone through this planning and gone through iterations of this house in so many different permutations with our architect. And I just want to make the point of the committee that Mr. Roberts has not even given us one admissible proposal that's been approved by an architect that's structurally sound for us to live in for us to even be able to respond. I mean, we have gone through our architect for everything. And that's to a huge cost to us. And I just want the committee to understand that Mr. Roberts has not even tried to see if this is structurally possible with any of the ideas that he's proposing. And yet we're all willing to consider what he's saying based on line drawings that I don't even know how to respond to that in an email. I'm not an architect. I passed it to my architect and he said that's literally impossible. And I don't know how to fight a lawyer who's trying to possibly intimidate us and bully us when I don't know what else to do. I also want to reiterate how far the house is back from the property line because the picture that he put up is very I guess damning but it's also from his property up on a ladder. We are 27 feet further back from that. And I mean, the rear yard setback is 20 feet. We are 7 feet further back from that. Let alone whatever waiver we needed to have to get because of a nonconforming garage based on when the house is built in the 50s. So we are more than complying with that second story setback. And so as much as I'm glad that my clients here are happy to make some concessions, I also don't think that they feel like we're being forced to make concessions on a project that's been approved and following the code. I want to just clarify, I'm not forcing you to do anything. I'm asking. I understand and I understand it very much, but I mean, as the suggestions come, they then feel like if we say no say no then we look like we're Noncompliant. Okay, I mean for me. I don't know that I can make a decision tonight I want to set up an appointment. How high is that porch? I Want to set up an appointment for you to have a ladder there for me to climb up and look myself Are you talking how high is is the edge from the ground? So from the West elevation, from the North elevation also shows the bottom of the balcony would be approximately a feet three inches high. Okay, well I've done this before I'd like to make an appointment to climb up a 10th foot ladder and lift myself. Thank you. I actually, you know, after obviously seeing what staff's presentation, it seems to me, and correct me if I'm wrong, that the design, the project is within our ordinances and laws and state laws and such, right? But of course, just, you know, I think pretty much every home shares the same concern about privacy. I mean, my home, we don't have a two-story structure next to us, but they can see in our windows, you know, just because the wall's not tall enough, whatever. But it just happens. You know, we live in a community where their houses are relatively close. I like the idea that's 27 feet away from the property line, the second story. I too probably wouldn't want frosted glass in a bedroom. I mean, that just, you know, it's not just for daylight, just I don't know to me if it would feel kind of odd. I do like the project, I actually would approve it. I do think there could be some compromise on the, I guess, the balcony area. We talked about a possible screen. I don't know what that screen would be made of, but, you know, people on your balcony to look over the property, I think would be a good compromise. If I can interject, we were discussing maybe extending the wall. So the wall physically goes all the way to the edge of the balcony and it's covered. Gotcha. Staff, would that be something that we can do on the fly here? Councillor, it's not designing on the flight, but we can add a condition that would speak to that and to the satisfaction of community development director for their review. Architect? If you can, because you know, we're talking about Billion and Wall. Absolutely. I mean, ultimately, if it's fine with my clients, then ultimately we'll make it work in the design. OK. I think it's a fair compromise. And yes, I would suggest that we make those slight change. And again, I hate to be in these positions because I know at the end of the day, somebody's going to walk away unhappy. And we wish that everybody could leave here with their thumbs up and high-fiving but that's not going to happen. Somebody's going to have to give up something for something. I do believe it's a nice project. I've driven by it many, many times. I know the neighborhood. So yes, I understand the concerns. There might be some there might be some precautions. The neighbors, if it does get approved, window coverings, patio coverings, you know, stuff like that to kind of minimize the visual, you know, straight into it. But nobody can predict, or you know, if somebody's gonna be at the window, nor can we state that we can deny because it could be a guest at the house peeping over the window. So that's just either side I think is a failed argument in my opinion. So I would hope that we move forward and accept the project with the change of the wall extension. That's my position. Prior to I did discuss this with the chair of the Planning Commission to get into the minds of them and hear what he thought was going on. And that's always a pleasure to disagree with Commissioner, but to hear their thoughts. First to the applicant, you know, 1950s home, definitely needs to be upgraded and to the architect. I can't always say that there's a beautiful design but really do appreciate your design and do like it. The second story, Windows, do not issue any concern to me building off of what council member Matucci said. Our master bathroom window looks right into our neighbors bathroom window and we close our windows when we want privacy close the blind. So yeah, we all occasionally deal with that. Asking for the relocation of the deck off of a bathroom seemed incredibly unreasonable to me. And I know that the diagram submitted to us, to in my opinion, and I agreed with the commission on that it was an exaggeration. However, putting all the pieces together, I did see legitimate concerns about the balcony position. And line of sight, I can understand those concerns and do think that they have merit. I like what the council has previously asked and that the applicant is willing to make those changes to fix that. That was my one big concern and to hear that you're willing to resolve that easily. I would support what staff was talking about so that we can make that move forward and get this approved tonight. That would be awesome. So now the council knows where my position is. Thank you. I-I-I-I-I-I-I- I have compassion for everybody in the situation. I am a good neighbor. I have never met my potentially new neighbors, but there is a setback with the setback requirement on the second story. And I moved from her most. I'm a single mom before. And so that's what I'm doing tonight. I would ask that the second story be looked at because and look at that set back the overlay and I'm in favor of granting the appeal that they have requested. They're wonderful neighbors and I did file my notes with the Planning Commission and the City Council. I was able to get that in just at the end of the day yesterday. We came out in support of our neighbors tonight, concerned that they would lose their privacy knowing how life changing it would be to lose privacy the ways proposed for them. And I was a little bit concerned that that could happen to us. Now I'm scared to death that that could happen to us. We bought 30 years ago, we were a young couple starting a family, two bedroom house, needed to add on to it as soon as we could. Understood that we lived in the hillside overlay, knew what the rules were, protecting privacy and views and light. And so when we added on, we cut into the hillside back, into the back of our house, and impacted no one in any way, shape, or form. We would have loved to have added a second story and had ocean views, spectacular ocean views, but we knew we couldn't and that would impact our neighbors. And so we did that back then. What I'm scared to death about now is there's a vacant house next door to us that is now bank owned, been vacant for five or six years and any day now some developer is going to buy that house and is going to want to do exactly what they want and what we wanted 30 years ago but couldn't do. If you allow a developer to do what we couldn't do 30 years ago next or to us, it's going to be life changing like you can't believe. So I live close to actually across the street from the applicant. And I think what they are trying to do is going to improve the neighborhood. The house has been sitting vacant for many years. And what they're trying to do, I don't think that they are asking for too much. First of all, they are less than 40% of the lot size. The waiver that they're asking for, the HELLs, were built in 1952. The waiver back then was five feet. Now with the waiver that we have, it's required at least 10% of the width of your lot. Now that's why what he was saying was that's not uncommon. Same thing with the second floor, even the garage. back then were built much smaller than what what require now so those Those waiver that's being asked is also normal. We built our home. We know that we went through that and We have opposition of the people who are not architect who are not designer who are not engineer telling us what to do and how to do it. Regardless of the desire of the house, these people bought the home, I mean, have the home pay taxes, that's their home. And they should be able to do it without impeding into adding the people. I understand that. 27 feet away from the property line. And, you know, I mean, who has the time to really look into the window, look into the other people's home? I understand, you know, it sounds creepy, but you don't know people that come over. Maybe they rent the house. Maybe they sell the house. Who moves in there, right? So they're like us. We saved and worked very hard to move into that neighborhood. And so the thought of somebody coming in and taking away, whether it's your privacy or your view, is very disheartening. Right? And we've had it done to us with trees. We've had, we just recently did a remodel and we didn't raise the roof because we know we'd go through a lot of trouble trying to do that. to do that and we didn't want to block other people's views. We tried to respect that. So I think it's fair if you deny the application to have them do this work and at least work out a compromise. That's what he's about. He does that for a living. So without speaking to my own problems where I had violation of huge violation of privacy in my opinion, huge violation of light in my opinion, the sun in the winter is going to go down at about 3.30 in my backyard now. And a huge violation of potential wind and air flow changes because of a structure that went from an original 1953 structure my neighbor passed. Unfortunately, it lived there as an original owner. I've lived there for 30 years in my home. And now this This new structure is about 3,700 square feet. It covers within two feet of the footprint that's allowable. All of that is my problem, and now I guess have to deal with it. But I really feel for these folks. I'm speaking to you, you said Mr. Mayor speak to us. I am speaking to you as not as an obligation to the City Council. It's not your obligation, but it really is your responsibility to think about what the lower River Yara was developed as and what it means to the people who have lived here for 30 years. I've lived in Torrance for over 30 years now and I got to say the fact that the Torrance rules of engagement of building have been so difficult and complicated. The fact that they've had to go through this in the first place must have been hurtly in effort. The fact that they have all these things already established have made their case to the city, have it approved. And then for the, the goal of using privacy as a bludgeon in order to silence and deter other people from building life in this community, I find it rather disgusting to be honest. The thing is like I do not believe that the ways in which we have our zoning practices have the best intent for the people of our city. It stops us from being able to grow naturally, to form the communities in which we want. We tend to make these walled-off gardens that make it very difficult for us to actually have that kind of society. If you want a privacy, the thing is like all you would need is a ladder or be higher up on the mountain. All of these problems still are the same. But with the respective project, there are no SB9 units, SB10, ADUs, whatever other number there is out there. Right, I understand that. So this is being developed as a single family residence, which I appreciate. And doing that kind of development helps keep the consistency in the neighborhood versus someone that could potentially go and add an ADU and maybe multiple living structures on the same lot?
