Brown. Thank you mayor Oh and Devlin senior planner for the development services department is gonna make the presentation on Resolutions 80 and 81 2024. Thank you, Mr. Devlin. Good evening, Mayor and City Council. My name is Owen Devlin, Senior Plano with Development Services. I'm here to present an application for the property located at 64-0-3 West Roger Circle. The approximate two acre property is located on West Roger Circle, just south of Clintmore Road, the property is owned manufacturing industrial district, M-Trey, with a future land use destination of manufacturing industrial. The property is also located in the South Congress Industrial Center Masterplan that was approved in 1985. Prior to the PNZ board meeting on August 15, staff was recommending denial. It was staff's opinion that what was being proposed, resembled out of a car agency, which is not a permitted use in the M-Trey zone district. Factors included the historical regulations regarding car agencies within the city, the approximately 490% increase in total neck trips. The breakdown of the parking calculations that include a large portion of the building assigned to use is not related to auto repair. The applicant's narrative of the proposed use as a club like experienced the proposed floor plan design, which in the city's opinion at the time resemble the traditional car agency instead of warehouse or storage use. And the proposed facade changes that included display windows, advertisers and the proposed facade changes that included display windows, advertisers, and signage. Since that August 50th meeting, the applicant has worked with staff to address the concerns that were presented at the meeting, which was a recommendation of the PNZ board. As of now, the applicant is requesting conditional use, pursued into section 281124b, Code of Ordnance, to authorize the storage, service and repair of motor vehicles and a site plan, amendment to modify the existing building facade, interior floor plan, and site modifications that will include changes to the existing parking lot layout and additional landscaping to accommodate the mentioned condition conditional use and storage for vehicles for online sale. The APKIN has also requested the approval of one technical deviation, specifically from section 28, 1655, call of ordns, to reduce the required number of vehicle parking spaces from 70 spaces to 56. The APKIN is proposing 11,365 square feet of dedicated automotive repair, restoration, maintenance of high end luxury vehicles. The entry, zone and district as part of a conditional use approval allows any use which will store service repair or clean motor vehicles or motorized equipment. The applicant is not proposing any changes to the existing building footprint. However, the proposal includes increasing the overall building square footage by expanding existing Mesoline by approximately 4,000 square feet. The applicant is proposing modifications to bring the property into compliance with the city's call of ordinance, which includes the addition of parking islands, ADA spaces, and additional landscaping. The applicant also includes off-site improvements, then includes the addition of a six foot sidewalk along West Roger Circle, and also the insulation of street trees on West Roger Circle. As stated earlier, the applicant has questioned the technical deviation to reduce the required number of vehicles parking spaces from 70 to 56. The applicant is also pros in additional 18 spaces inside the building, but these are not included within the overall parking count. As part of the previous submittal that went before the planning zoning board, the applicant had also required approval of two additional technical deviations from section 2319D, called of ordinance, for the design of the Northern driveway along West Roger Circle. The technical initiation was to eliminate an additional required 12 foot wide egress lane and to eliminate a required four foot driveway medium. Due to the updated trip generation that has been submitted after PNZ, the two technical deviations are no longer needed. Just for some context, it is important to note that under warehouse or storage operations, there are locations in the cities and duchos on the district, including the M-trees on the district, from which vehicles are sold online. The basic concept being that warehouse-like storage of vehicles does not become a commercial resell use, or in this case a car agency, simply because vehicles are purchased online or by other remote means and shipped to their customer. This is generally the way that all warehouse operations function similar to other uses within cell rogers industrial center that contain showrooms or storage for material sold online. The industrial center that contains the city has issued certificates of use approving such operations in several incidents since at least 2016 as I said included in the M trees on industry which is the same zone in district as this application. In such cases, the certificate of use restrict operations with the conditions on screen, and I guess you guys can read them for yourself. It was staff's initial view that 50% of the building was being considered motor vehicle sales was excessive and did not comply with the M3's own district requirements. After clarification was provided at the P&Z meeting by the applicant and staff have reviewed the updated parking calculations and site plan. It was determined that the motor vehicle sales room, no label as vehicle inspection area, will only occupy 7.85% of the overall floor plan. After discussion at the PNZ meeting and clarification from the applicant, it was understood that the ITE classification of new car sales was an inaccurate classification for the proposed use and the traffic should be based on each use in the facility rather than classifying the whole facility as one use. The applicant has resumitted an updated traffic study that the city have reviewed and have no objections to. The table on screen provides a comparison between the existing use, the original application, which was new car sales that was presented before the PNZ board and the updated application, which is labeled updated use. As it can be seen in the table, the updated study had reduced the number of daily trips from 1,152 to 296 significant production. The Appian had resumitted after PNZ, an updated floor plan that correctly defines the distinct uses within the facility and clearly identifies areas that are employee only or off limits from the public. As stated earlier, the Appkin has also updated the classifications of the use on the floor plan to be consistent with the new parking study. The motor vehicle sales room has been reduced in size to 6,963 square feet. And now resembles a showroom similar to other properties within the Cell Congress Industrial Center. The original application proposed to make facade renovations to the existing building, where the appearance of the building would change from a typical industrial warehouse building to a building that appears as seen on screen like a car dealership, including the installation of large glass display windows, relatively large building wall signs, and branding elements meant to bring attention to the property. The app has redesigned the proposed facade to be more consistent with the industrial warehouse design of the center by minimizing these elements. On top you can see the new application. The bottom one is the original application that went to PNZ. On screen is a proposed revision by the applicants to the condition of approval number 12. This revision was reviewed after the package was sent out so it would not be included in the package you received. City staff had reviewed this and have no objection to the change. At its August 15 meeting, the planning is only board recommended approval of the project with a vote of 4 to 0. The main point of discussion at the meeting focus on the use of the facility and the layout of the floor plan. Four members of the public spoke in opposition to the proposed project. The main point of contention being increased traffic and disagreement with the use being compatible with the district. The development service department recommends approval of this application. And that's the end of my presentation and I'm happy to take any questions. Thank you Mr. Devlin. Council members, any questions? I have one small one. On slide 10 you showed an increase in intensity of 4,000 square feet roughly. The building exterior is not expanding. Where did the extra 4,000 feet come from? So there's a existing mezzon, which has been expanded. I see, thank you. Which is the 4,000 square feet. So the building footprint itself is not changing, just the mesoleon has been extended out. Very well, thank you. And then on slide 11, since you have it up here with this purple, what I'll call, I guess, a driveway, are there any special provisions for venting out exhaust from the vehicle? A granted, you're not driving very far there, so it's not so much, but what are they planned to do? I would leave that to the applicant. I presume that is where all the work gets done. So I would presume that the industry standard is to have some kind of ventilation. Yes. But I don't know the exact answer. Very well, thank you, any further questions. Then at this point, we'll open up the public hearing. We'll first invite the applicant to come forward. Please give your name and address. Good evening, Mayor, Council. David Milage for the record. Fourteen South East, four street, Boca Raton. Thank you, Mr. Devlin, for your presentation, and I'll go through the presentation that the applicant has prepared. As Mr. Devlin mentioned, we're requesting a conditional use pursuant to or of 281124 subsection B to authorize the storage service and repair of vehicles with incidental online sales. Minor site plan amendment is being proposed as well as the technical deviation relating to the reduction in parking spaces. As Mr. Devlin had mentioned, the technical deviations related to the driveways no longer are needed based off of the revised traffic study. Again, this property is located at 6403 west Roger circle, it's two acres within the M3 zoning district with an IAM land use and it's existing warehouse storage. This is the location of the property, south of Clintmore along Roger Circle. This is a zoom in perspective of the property. There's two access points based off these two driveways and the applicant is proposing a new sidewalk along West Roger Circle. This is a big-tometry image on the left that shows you the existing conditions of this building and then a street view of the building as well from Roger Circle. As Mr. Devlin had pointed out, the elevations have been revised since presented during the planning and zoning board meeting. Again, as Mr. Devlin had mentioned, is that the previous proposal had more of an appearance of a traditional dealership, more modern looking with more retail glass, more glazing. Now the revised elevation is more in keeping with the surrounding properties. The floor plan was clarified based off of the proposed uses. Really the areas in green are for storage vehicles as well as part storage. The orange areas are for service, minor restoration, refurbishment as well as minor service like your oil changes, your tire alignment, tire changes. Then there's the vehicular use area as well as the indoor parking and then it's more of the customer facing area outlined and red which has your bathrooms, some office space, and then an area to inspect the vehicles and a waiting area. Mr. Mayor, as you mentioned, the additional square footage is relating to the Mezzanine. This is the floor plan for the Mezzanine. The Mezzanine has office space. It's got your employee locker rooms and additional storage. So breakdown of all the square footages, the showroom area that customer service, you know, really activate activated area is close to 7,000 square feet. However, it's important to know that part of this area is still restricted from customers from accessing such as the offices. So really effectively, only 13% of the overall square footage for this property is open to customers. I'll be happy to answer any questions that the council might have. Thank you, council members, questions? Oh. Yes, I'll ask the one about, if you know anything about the venting, what's standard? Yes. So, it's 100% fresh air. It's all under A-C and it is, would be consistent with Florida building code. All right. Thank you. Questions? Ms. Ankliss? Sure. Thank you. And I had spoken to Mr. Milage before, so I just wanted to clarify this. The conditional use approval is for storage service and repair of the vehicles. And you just mentioned for things like tire alignment and oil changes and simple repairs like that. One of the conditions of approval is no test drives. So I just wanted to make sure that the technicians who would be working on the vehicles would not also be doing test drives. Correct. So one of the conditions of approval, it's number six. It says no test drives on the property that would include the technicians and customers. So there will be no test drives of any vehicles on the site. So technicians will not be taking the vehicles off site to do a test drive. Thank you. For the questions. Before you, just one I want to, on that point, it actually says no test drive shall be permitted from the property. So it's not just on, you can't go off the property either. Correct. Mr. Wigter. Thank you. I presume to our conversation earlier, in terms of the test drive, you also mentioned something that customers were not permitted to pick up vehicles at the location that they have to be shipped to or transport. Correct, yep. Sorry to interrupt. Correct, there are a handful of additional conditions of approval related to the online sales. It's online only, all the transactions of the any type of purchases would be online. All vehicles are have to be stored inside of the facility. There's no outdoor display. This is for the service, and for any other activities happening in this facility. It's by appointment only. No walk-ins, the general public cannot walk into the facility. They have to have an appointment, and appointments are going to be given out freely. I doubt I can call them up and get an appointment for myself. So this is going to be pretty restrictive. There's also a condition of approval saying that there's no more than 10 sales employees on the site. And then as we just discussed, there are no test drives on the site regardless of the use, whether it's service or sales. Follow-up, Mr. Mayor. And I think one of the conditions is that the applicant is not as a conditional use is not permitted to get a dealership license. That's right. It's yes. So for this property, the owner cannot seek a franchise dealer license from the Department of Motor Vehicles. the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the list of the facility. That would need to be obtained by the owner. There's also another one relating to independent dealers. You said appointments are limited. Do you know the amount? the . I'm just thinking broad strokes that I'm sure they're going to scrutinize those people who are seeking appointments. So I don't think that they're going to restrict appointments. I mean, if they have a qualified vetted buyer or you know has a vehicle that needs service then they will schedule appointments. But unlike a traditional dealership like the one in Fort Lauderdale anyone can come and go they can come in they can look at it. The majority of people who actually come into the Fort Lauderdale dealership are tourists for lack of a better term. They're not qualified buyers. They're looking at the vehicles, they're seeing what it's like. The qualified buyers are very limited when they come into actually coming into the Fort Lauderdale dealership. So this operation, they're going to be probably asked various questions to make sure that you know they should be making being having an appointment made for them. Thank you. Thank you so much. Mr. Leard. My name is Thomas Leard I live at 285 Royal Palmway, Bill Gritone. I've been a resident of Booker Tone for 50 years plus I'm a retired professor from FAU. I thought real estate and finance of 32 years. It's an honor to appear before the City Council, which is the only body that represents all the citizens of Booker Tone. I'm present the South Congra industrial Industrial Property Owners Association and have been for 40 years. I was the lead person of our team who spent a few years working with the city staff and officials such as Mayo Conrad and New York and others. And I am the person that wrote most of the master plan in a little history. Before we annexed into the city of Boquerton, there was a full automotive repair shop in South Congress and Dosto Center and it was located on the building on Clintmore Road. It was a disaster with people driving their cars. Now repair people didn't test them, but the car people tested them. Of course, they went off-site, they come back, it was a disaster. So several of the law donors asked me as we were getting rated annex on the city, can you get that auto repair shop out of there, that retail auto repair shop? I said I think we can, so we worked with the city staff very diligently and we worked out a word or phrase that would eliminate auto repair shops we thought forever. And that was 39 years ago. And it's worked well every since. And I hate to see that change. And the phrase was no retail sales allowed in the industrial park. We have some bad traffic problems that it is right now on SCIC. You probably saw those pictures in the package. It's difficult to get out of there, and it's unfortunately not always safe. Now those pictures were taken on Monday evening, August 26, 502 to 512. The third picture is showing East Rogers. The others are showing West Rogers and the traffic on West Rogers was so bad. It went all away from the traffic like down to Portationers' property at 6403. Now you can look at those pictures, and I consider that a real traffic time study, because it shows exactly the traffic at that moment. No disrespect to the petitioners that was a very well, very brilliant written report, but from a lot of my academic study and research, unfortunately I don't believe most of it. It's all guests and what their future is going to be. We don't know because there is no auto dealership or retail service center in the industrial park. They distribute artificial joints to every hospital from Key West all the way up to the beach that you drive on in Central Florida. So if there's an accident in I-95, and the first thing they're going to do is call Zimmer-Bio, man, to ask him to bring some artificial joints to maybe one of the bulkware-tone area hospitals. If the traffic is allowed to get worse by auto, retail auto repair shop, I think we might be putting some people's lives at risk because it could delay them 10 or 15 minutes. We have a serious traffic problem on Roger Circle. I've commuted there every day for the past 14 years, also is a significant distance. I have trouble believing that the applicants revised numbers are actually genuine, considering I run a sales team at our company to have 10 sales people, or up to 10 sales people, and only 200 plus daily trips per day seems very surprising. Those salespeople are doing in-person meetings. They're not inside salespeople. They're, well, they are inside salespeople, but they're doing face-to-face meetings. And those face-to-face meetings, if you have a busy day, you should have at least 6, preferably 7 or 8 meetings in a day. So that's going to be well in excess of the number of daily trips that they're guessing that they're going to have. As I said, I don't think it's an appropriate use or variance for this site. We are a manufacturing company, I should say. We store and manufacture thermal printers and we have printing presses and we work with companies like Disney, Universal Studios throughout the world. So our use is in line with what the traditional use has been on Roger Circle and it's a concern primarily from a traffic perspective. Mr. Laird, he didn't point out in his comments, but he raised a good point outside of the session when I spoke to him. There's a school right across the street, a Montessori school. I would be concerned if I were a parent sending my kid to a school with a Ferrari dealership next door. And for all intents and purposes, this really is a dealership, whether it has a license or not. I have the pleasure of occupying the space at 1060 Holland Drive for going on six years now, which we use for administrative purposes in the storage and maintenance of entertainment equipment related to fireworks show production. Tonight I stand before you in opposition of the proposed changes to allow uses within the South Congress Industrial Center, which would allow the petitioner to operate what is essentially a retail card dealership in automotive repair shop despite alternative claims within the petitioner's updated plan. First, as many others have already spoke on, we must consider the inevitable increase in traffic. This is clear based on the traffic study which was commissioned. The estimations reflected in conjunction with the initial plan were breathtaking at over 1100 additional Bayley trips. It's hard enough as it is to get out of this industrial neighborhood as it is at peak times. Based on the study it will become unbearable if the proposed changes are allowed. Furthermore this poses a threat to nearby schools and educational facilities with the safety of our children, which should be our top priority. Increased traffic near schools raises the risk of accidents and jeopardizes the safe passage of students. This also hits close to home for me. As my 16-month-old son is currently enrolled in classes at the Florida Swim School located at 1082 South Congress Circle. This is not the kind of development which would encourage and close proximity to schools and educational facilities. Additionally, this rezoning could set a precedent for more dealerships to move into this area. And we'll find these issues even further. Car dealerships to repair shops often bring increased noise pollution as well from test drives and deliveries I know it's already a test it to that there won't be test drives with these these cars will be passing through this general area Many businesses within the SCIC including the one that I represent maintain creative departments Which would negatively be affected by potential additional noise pollution of the high end supercars. In conclusion, the proposed use changes would place to this proportionate burden on existing tenants within the SCIC. Create the potential for increased safety risks and detract from the established professional community environment as it currently stands. And I don't know much about the traffic studies or any of that, but I do know from personal experience, there was a high-end exotic card dealership across the street on Clint Moore Road. It's recently closed up I guess about a couple of years ago. And I can't tell you the number of times that we've heard vehicles traveling at high rates of speed up and down at Clint Moore Road. It's only a 40-mile an hour zone, but you can tell when these cars are opened up pretty well. My big concern for my staff and myself is that the vehicles as they're coming out from service or even for sale, somebody's going to want to test these. It's hard to convince anybody that driving a couple of hundred thousand dollars sports car, nobody's going to want to get on it. So my feelings on it is that they very well may wind up going down Roger Circle circling out onto Clintmore Road and then coming back down onto East Rogers or worse yet making the quick right hand turn going down Holland Drive. And I leave between noon and four o'clock. And guess what? It's like that all day. In fact, someone who mentioned that they have properties on Holland Drive last week when I came through there not only was Rogers full, but there were eight cars waiting to turn right to get to the light to get out on Clinton more. So it's not an exaggeration in that respect. The other thing I did, and I've taught in colleges and business and been president of many companies, and I decided to do a little analysis on the internet. And I found a lot of things. I looked at, well, how big do car repair shops, body shops? What's considered to be a large one of those? 7,400 square feet. And I found that in multiple places. I think this is 48,000 square feet. I look at how the space is proposed to be used. Reduced the showroom to 6,900 from 18,000 and increased storage, another 10,000. Guess what? The storage probably could be used to put cars at some point in time. Storage in repair shops, again I found stats online, about 10% of the work area for repairs is set aside for storage. Okay? Big, big difference in the situation. Now, if this truly is a car repair in a body shop, I would consider it to be a big box repair and operation. When you think about big boxes, it's best buy in other people with hundreds of thousand square feet. If this is 48,000 square feet, and a large repair shop is averaging about 7,400, this is a big box. And I think you all know what happens with big box in the terms of traffic and other things that come to them. So you can't just think of this. Well, it's only 48,000 square feet. It'll be the largest one in South Florida probably. There are ones, some of these things in Boca Raton. None of them come anywhere near the size of this. The other research I did is people who sell used exotic cars and antique cars usually don't repair cars. They're showrooms. So I'm always suspicious when I see these things. I see in three days after they were turned down in terms of what the staff had identified, that everything changed, the use of the space, the traffic, suddenly changed. I'm suspicious of that. Again, I hope that you really think this through and don't open this up to the ability of other people to come into this development and to Disrupt what has been a great resource for mid-sized businesses in Bokeh retone the storage facilities. And they filed for their conditional use and is seeking approval. In the past, other businesses haven't done that. They've taken occupancy. They've done what they needed to do. I think that what this city has done to me and my property, my business tax license for a business that was allowed to operate still hasn't gone through as of now. They're requiring a son-biz address change for this business, which is unlike anything I've ever heard. They're asking for a BTR tax license for the county, which doesn't come until after the city approves it. So the things that they're asking for is Ascenine. So again, though, this bill getting back to this property, there was, and the company who was trying to think of as exelato, they were there. The police are on this road. If there's an issue with speeding and noise, that should be addressed. If there's 10, 15 salespeople, I know office buildings. If this is 48,000 square feet, that could fit a lot of employees. And there's a lot of trips that that causes. So the main thing for me as a business and a property owner is I hate restrictions and government intervention and the reality is is this is a conditional use. If you approve it that's that's it's allowed but with your approval. There are retail. The M3 is bigger than just this park. And I know that there are show centers for furniture and design. I know that there are holistic pet retail that's in the M3. So first off, to the drawing, looked beautiful. I know there are gyms, red con, that's on South Rogers. They all bring a lot of traffic and I think that there could be worse applications than this use. And if there are traffic concerns that exist now, those should be addressed frankly by this city that should improve the life and the enjoyment of all the businesses around there. But I don't think that limiting this property and this application, because there may be a few trips is rational to be candid with you. There have been auto dealerships in M3, I believe Excel was in M3, so and they did similar business. So again I think that's what enforcement's for. If they violate this, if you're seeing these cars on the road. Enforcement should be there. They should have the ability as neighbors to to file obviously and they do to file code enforcement. If they're seeing test drives of these exotics coming out of there. So there should be things in place to make sure and to police this. Just want to reiterate and then add to some of the concerns that were raised by the speakers before me. Now, I'm connected to this type of an industry. I was a mechanic for a while. And I did repair it to cars. And I know that it was said that test drives will not be made after cars are worked on. I find that hard to believe being that how is a technician supposed to know that repair the repair was made correctly if the car is not tested afterwards. Okay. I also understand that these exotic cars understand what kind of capabilities they have and I understand the technicians are sometimes take these cars to the limit to make sure that the test drive is performed and that the repair is made and then everything's working fine. So my concern is that some of these technicians and I've worked with a bunch of them, maybe a look reckless. We have a gym in the vicinity, CrossFit. We have people who are regularly jogging out in the street during morning hours, during evening hours, and sometimes throughout the day. And that creates for potential injury, maybe even death, with the additional traffic that we'll be seeing from the technicians, their test drive, test drive these cars, from the additional traffic, from the employees they'll be working in this facility, as well as the customers who will be test driving these cars. Now I know the customer being that like exotic cars myself, when I get into exotic car, I really want to test drive it. Okay? And I'm feeling that these customers will be doing just that is kind of, you know, making sure they get the most out of their test drive. Additional traffic creates more congestion and we already have plenty of congestion in that area from the Amazon facility that's there and even some of these Amazon truck drivers are a little bit reckless you know when they're out delivering packages or getting out to their route. Reiterating what some of the previous speakers have said, I find it very hard to believe that the reassessed traffic figures are accurate. If you take a 48,000 square foot building, it was already stated that there would be 10 people on the sales floor. Let's assume maybe another 10 people in repair. Let's call it 20. Just for them to come back and forth to work each day. Okay, that's 40 trips. If they go out to lunch and back, that's another 40 trips If they go out to lunch and back, that's another 40 trips. How we get 100 and so trips out of that, just it's not a reasonable expectation of the increased traffic. One of the problems that we have on Holland Drive, we refer to Holland Drive right now is Holland Speedway. There's very little enforcement on Holland Drive and right now there are people that race cars up and down there Constantly I can only imagine what it's gonna be like when we have super cars being repaired right around the corner We're probably 300 feet off of where that building is when you turn on to Holland Drive The thought process that people are not going to be test driving these vehicles after repaired is ludicrous Nobody's gonna spend that kind of money to have a car repaired, especially a car like that and not know that the repair has been made. My other concern that I have is people have to make an appointment to drop their car off. We're talking about oil changes and tire rotations here. Are we saying that every vehicle is going to be delivered by truck for oil rotations and tire changes? That doesn't sound reasonable either. The amount of traffic increase on that is going to be significant. My biggest concern I have is for our employees. We have employees that walk to work that have to cross over both these rogers and west rogers at rush hour and at lunchtime whenever they're going out. Frequently they're sitting there waiting as I pass them as they're trying to get across because the traffic is significant. The other problem that we have is on Holland Drive. There are no sidewalks. So as the speaker before me was discussing about the gym that has people running up and down Holland Drive, if we have people speeding up and down there it's only a matter of time before we have a catastrophe. They went out there, they did driveway counts, they determined exactly what is happening at the world's largest Ferrari dealership. He is able to use that information and provide the study before you today. It was reviewed by the city's traffic engineer who has agreed. This is a, based off of this use, it would be a reduction. A more intense use that's already available by right within M3 or within on Roger Circle, such as a school, a swim school, a personal training facility, a dance studio, lashes and beauty of florists, even a musical instrument retail use is available in this area. This use will have a lesser traffic impact than all of those uses. As it relates to quality of traffic, it seems like everyone assumes that a Ferrari owner is just irresponsible, or that inherently these owners are irresponsible. It's hard to believe that every single Ferrari owner the next issue is related to what I've heard is retail. Is this a retail use? Again, there are other true retail uses existing within the park. This is by appointment only. A report appointment is required unlike other users. This is by appointment only. As it relates the size of this facility, we are not cramming cars into the facility. There is more space. Our architect here can testify that the spacing between the storage and the lifts and the other apparatus within this facility are more spread out, so it needs more space. And then four, there was a mention relating to the service. This is basic maintenance. Any type of extensive repairs are being transported to the Fort Lauderdale for our dealership. Again, oh, and I will say one more thing, based off of real numbers, the world's largest for our dealership only sells between 20 and 25 vehicles a month. This application is service and repair on one side of the building essentially and storage on the other side of the building. You know, there was a lot of reference made to the application as it was before and to us, even though it was representative, it wasn't retail. It looked like retail and had the characteristics and after the planning and zoning board meeting the applicant has revised the application in a number of different ways to ensure that it does not appear to be in and will not operate if it's operated in the way it was represented to us will not operate as a retail operation. Could you, I may be for benefit and maybe for the benefit of the folks in the audience, can you reiterate some of those changes that they made at staff's suggestion or request to address the concerns that were raised? Sure. So, Mr. Devlin was earlier mentioning the architecture. The form architecture looked a lot like a commercial operation, like a car dealership. Primarily, we were looking at the floor plan. The floor plan, as it was previously, had the look and feel of a very fancy dealership showroom, the cafe, and it looked like places for customers to walk around and look at cars on the floor. Those sorts of things, large areas like that, offices that looked like offices that you would talk to the finance guy when you go to the car dealership, those kind of things. large areas like that, offices that looked like, offices that you would, you know, talk to the finance guy when you go to the car dealership, those kind of things. Those floor plans were revised extensively to, the applicant would say clarify, I would say change, how that floor plan operated such that, you know, the vast majority is not even allowed for its employee only. So areas that previously looked like they were for customers to millenile look at cars are now designated as employee only. Those kinds of changes, the traffic study previously was based on a car dealership use, it's now not. That's why the number of trips dropped so dramatically in the revised traffic study. The square footages that were used to calculate required parking, those were revised, those sorts of things. And on the traffic study, I know some folks made a point of questioning that. It wasn't the situation where the traffic study, I know some folks made a point of questioning that. It wasn't the situation where the traffic study was just revised because they said, let's call it something else. They had changed the use and the floor plan associated with their application. And you were satisfied that the traffic study reflected what the new use and the new floor plan would suggest, right? That's right. So the traffic study was revised, it matches the new floor plan. And just for background actually, the applicants explanation to us was when they went to the county for the concurrency approval, they, the county, I may be getting this slightly wrong, but between the applicant and the county they use new car sales. The way the applicant looked at it was a conservative way to do it, because it was way more trips than reality. But for us, it told us this is something that is not allowed here. So, you know, the new traffic study makes that more clear. Excellent. One more question, if I may. And I believe I heard a lot of questions raised about, well, they're applicant saying this now, but they're going to use it for something else. Or I find it hard to believe that they're going to use it in this way or that the certain space is going to be used in the way that's represented in their application. If that's true and if what is represented in their application doesn't come to fruition and if they use it in a way that's not consistent with their application or if conditions that we apply on them aren't being complied with, what would the remedy be for the city? So we would pursue code enforcement case. And like any business, they could be doing something different than what they tell us when they apply for their business. Correct, that property will have a actual sidewalk too. Correct. That property will have a sidewalk. Unfortunately, we can't do all of once. It's kind of like a step process. So from a recollection, the northern property has a sidewalk, but the southern one doesn't. So it might be a sidewalk to nowhere, but in 50 years, hopefully, we'll have a full sidewalk. All right. As we talked about also, there's uses that are appointment by only or supposed to be, and there's uses that are kind of, I don't want to say retail and nature, but that you can go whenever you want, right? There's a couple of self-storage facilities there. We are not regulating when people are going to go to their self-storage unit over there. They can just go when they want. We're not regulating when a truck goes and picks up a bathtub or any of the other supplies in there as they do. So there's general traffic that are not by appointment only. It seems that the restrictions here, in this particular case, are alleviating a lot of those problems. Everything that my colleagues talked about are really show that the staff is, paid very careful attention to make sure that this is managed properly. And as someone said before, I think of Mr. Ungen and Mr. Thompson, there's enforcement mechanisms as there should be, not just for this business, but for all businesses in the area and in the district, to make sure that people are, to make sure that people are abiding by the conditions that they agreed to when they made this application. And I know our development services teams will be on top of those things. There's a second aspect to this, which is what the city can do. A lot of the concerns that our residents and our business owners made are not really applicable to just this person. This is not a building, we're not building a brand new building from the ground up. There was a 40,000 foot building here, or 50,000 foot building here already. That was, I assume previously occupied and there was working there and there was trucks there and there was people there, right? So now there's just different type of people. And so, you know, in the real estate industry, you know, what we see happening here is an adaptive reuse. It's a reimagining of existing buildings given today's time, given today's innovation, given the people that live here. And I see this as an innovative, adaptive reuse of this property rather than I don't want to use the word pigeon holding, but saying this building can only be used for the storage of stuff and that's it. And we've allowed that to occur slowly in the park over the years. And I think that's organic, that's what's happening. Like Mr. Devlin said, I do hope the sidewalks connect. I do hope because that shows that the adaptive reuse is occurring. So the fact that now we have sidewalks that just stop and go, show that it is only partially redeveloped, but it is happening. It might be something that we, the city staff, the city, we need to look at. It's be hold upon us to look at, hey, if the traffic lights are an issue at Clintmore, that's not this business owner or any business owner's fault, it's something that we have to look at saying, hey, maybe we need to have more, you know, AI-based traffic lights on Clint Moore, so the timing can work a little bit better. Maybe we need to speed up getting sidewalks there so people can walk to the swim school or the barrel of monks more safely. Or go dancing. But needless to say, if there's noise and sound ordinance issues, if we do traffic common devices, those are city-based initiatives we can do. And like I said, so I think there's a great adaptive reuse happening here that will benefit the city. I think it can be policed. And I think there's some larger issues that we need to look at also. There are issues in that area, the sidewalks, the speeding, the traffic lights, all those kind of things. So now we know we need to work on those. I, and they're very often though because I have daughters who go to gymnastics on Roger Circle. I have two kids who learn how to swim at a swim school on Roger Circle. My, several of my kids have gotten music lessons, piano and guitar, I think, at a music instructor that's in that area. I, tomorrow, have to go pick up my baseball teams uniforms from a baseball equipment store that is located in there on Hollins Drive, and I'm not sure I'm gonna have an appointment to do that, but I say that to me, I'm there often, at least twice a week between all of these things. And you all raised a lot of skepticism as it related to some of the representations made by the applicant or whether things would work out the way the applicants suggested they would. And I think we've discussed tonight that the failure of the applicant to use this space as they now have represented that they will be, for example, whether they're going to be using it as showroom space versus storage or whatever. Those are issues that are addressed properly through a code enforcement process. If conditions aren't being complied with, like with respect to whether chest drives are being made or whether people are buying cars and driving them off the lot, those likewise can be addressed through code enforcement. The city has a process to address that. Noise, if that's happening there, of course, are being driven loudly, or people are speeding there, that's addressed again through law enforcement. And I recognize having been there as often as I am, that there are traffic buildups on the light at Roger Circle and Clint Moore. Well, there's a way to address that too. The city has its the traffic management system. Maybe it's worth having it looked at whether the timing on the light in particular can be improved. I have seen especially in the PM peak hour that the line does back up there to turn left or right on to Clipmore road. I'm with you. I think a lot, maybe the most underlying thing is that a lot of the issues that folks came out and expressed skepticism about had to do with changes made by the applicant in their application. After our staff had raised concerns about some of those things. The applicant, because of those concerns that were raised by staff, the applicant went back and redid its application and made many significant changes to how they're going to use this property. I don't view that skeptically. That's actually how the system is supposed to work. If our staff identifies problems, the applicant to their credit went back and changed in what I'm hearing in a pretty significant way, the things that had concerned staff. And so it's not some sort of, you know, ropedo, or the applicant fudging things in order to secure an approval. I don't see it that way. I don't think the staff sees it that way. I think the staff is satisfied. That's why they recommend approval. If the staff is satisfied, then I am satisfied, because I trust our staff. When we have a problem, your HOA have come to find out. And I'm sure it's been addressed here before, but I have to have this on record, two things. VRBOs, Airbnb's, whatever you want to call them, vacation rentals, or real problem. I'm having to spend my time, and I work full time, PS. I've just spent my time going on these websites, getting the listing, sending them to one, and let me tell you, one is fantastic at his job as a compliance officer. He's easy to work with. He's responsive. He helps remedy situations. I'm doing all this legwork. Unless somebody complains, it's not a problem. It's a problem. When I have a constant change of people coming in and out of my house, I mean my neighborhood, it's a problem. And then I've been bullied by property owners, right, the owners of the properties, and the people who are managing their listings. Say I was to call the person who has it, some attorney I'm not going to say anything. I get bullied into that is not the law. Well, and this kind of made me think about what you guys were just talking about with these rogers. It's getting, you know, ask forgiveness rather than permission. So these codes are here and these ordinances are here and it seems to be next to impossible to get these things to stop. The most important thing that is recently happening, people are buying homes, I live next door to two FAU houses. On a regular basis, I have seven and eight cars, parked on my street in front of my house. The visibility, thank God my children are grown and out of the house. But there are a lot of new families coming through and they have toddlers and the visibility is horrible. I walk a dog, same thing, more concerned about the children quite honestly and the traffic. I'm not a great driver. I'm 55, but I have three sons and I know how college students, they're late, they're distracted. I don't blame them, but it's happening in a family neighborhood. And there's no course of action to take, because I've spoken, and all we can do is say, well, you need to get a copy of the lease. I get a copy of the lease, and now, Laura Lee Longstaff is keeping the deposit on the children who rented the house from her illegally. There are four names on a lease. It's supposed to be three family members, right? Four or more non-family members cannot have their names on Elise. And it's becoming tremendous. We now have five of these in our neighborhood. You know, Sunday football's back. Fantastic. Spring break's back. And they have poles. It's not my liability. It's not my house. I would imagine that these people should be more concerned that they're giving these children and they are children. They're you know, my children are still children at 20 and 22 years old. You know, they've been on top of the houses on 4th of July. They it's just a really irresponsible way of people running a quote unquote business. And I've been bullied that I was interfering with Laura Lee Longstaff's business because I was speaking to her tenants. They're my neighbors. There's a dead cat on their property. The idea of code enforcement is to achieve compliance as quickly as possible. If getting a building permit is their next hurdle to jump through, why do they need 20 months to get a building permit? Directing the city manager, the Office of Management and Budget Director, to adjust the adopted millage rates and the event of changes in the assessment role and taxable value. Ordinance number 5705, an ordinance of the city of Boca Raton, mending chapter 2 administration, Article 3, boards, committees, commissions Board's Committees, Commission and Special Magistrates, Division 3, Special Magistrates, Code of Ordinances, to delegate authority to the Special Magistrate to consider and act upon applications for co-compliance lien reductions and to establish procedures for lien reduction requests, providing for repealer, providing for codification, providing an effective date. So I'll turn to city manager reports and recommendations, Mr. Brown. I have no reports this evening. Thank you. Senator reports. Mr. Cahler. No report. Thank you, I have a very brief report. I was fortunate to be able to use the new Rutherford Park with my kayak. I want to just commend staff again how beautiful it was. Very easy to use. There were many participants there that were not able to use the water because there was no ramp to launch from. So this really kind of gave them an opportunity and there was a lot of families and people there. This person was just fishing. Derek was just fishing with his new paddle board. So there's a lot of opportunities there and people are just learning about this. It's really a beautiful place. I hope people can enjoy it. Of course when I just started paddling a little bit further you could see nearby residential people are rebuilding their seawalls and their docks. Obviously this happens a lot of the housing in this district is older some of them significantly older and you could see with sea level rise and just age some docks need to be repaired, some significantly. The city's also, you know, the Jeffrey Street sea wall and things like that. We're going to have to be also rebuilding our sea walls and reinforcing them as well. Of course, one of the things that we're aware of and that's been talked about significantly is that there's new construction standards, reinforced sea walls, retaining walls, and new FEMA standards that must be built to certain base heights above the new amount for the FEMA map. So you can see here there's a brand new house under construction, you can see that it's significantly taller in base height elevation than the house immediately adjacent to it. By foot or two feet because this is the new map with what FEMA requires. They're about to adopt a new map. Sea walls can be built in individual community levels. What we have in most of our city are individual seawall heights. So we have a situation where we have varying heights of the base seawall. And eventually as people rebuild the seawalls go up. But of course, if the seawirizes, there will be significant concerns. There's water management issues that each new person has to, each new development has to build and maintain the water that's on there a lot that can't let it flow over, you know, for literal rights and things of that nature. So there's some new complications because of these new maps. But there's real more problem, the significant problems that we have to consider as well. Here you can see it's significantly higher than the adjacent property. As you know, because there's a new FEMA map, the Florida League of Cities, Palm Beach County, there are discussions. One is happening tomorrow in Boynton Beach to discuss the new flood insurance policies and how many properties are going to be affected that because of the new map will now be in a flood zone or will now be new at a new higher elevation requirement and required to get flood insurance that were not previously required this will be impacting 16,000 parcels in Palm Beach County of course like I just you know you there, some of them are in Bokaritone. So if you live near the water or are an affected party, please, please make sure to look at your flood insurance policy over there. There's things that you can do to reduce flood exposure. The FEMA website is very good. It's very interactive. You can get discounts, okay? If you raise your air conditioning, right? You can get discounts. If you raise your air conditioning off the floor because they know that will cause insurance claims. Obviously, if you're building a new house, that will go to the new standard. That will reduce your insurance. So there's a lot of information here, a lot to unpack. My suggestion to people is to contact your insurance agent, your real estate agent, if necessary, your attorney. It can get very complicated. If you do a lot of these things, you can get re-determination letters to show that you're not in the flood zone anymore or that you've complied. So you have to do your due diligence and this is all the homeowners who might be impacted because this is going to happen in December 20th, I believe. So please, please take care to all the homeowners who could be affected by this. As a community, what are we doing? Boca Raton is already one of them. I think Mr. Brown, if I'm not mistaken, in the fall the city achieved a higher rating for our community rating system, which gives everybody in the community a discount on their flood insurance program, maybe in the future we could even get a higher standard to get increased discounts for all the people that could be affected by this. Of course, if we do it as a community, we're reducing and flood damage for everyone. We're strengthening the aspects of the flood insurance program which can help reduce rates. We've seen a significant problem with condominiums, the assessments, the insurance that's going on, the reserve studies, there might be a special session, Governor Santos has indicated that there might be a special session about this where we're all gonna have to be really cognizant and participating to help save some of these significant costs to our condominium owners and our homeowners who are affected by this. In our building code, of course, we're already doing things like requiring certain building requirements when people are building a new house, raising to the new level. We might need to do more. We might need to look at new policies. But given that this FEMA meeting is happening now, I thought it was appropriate to bring this issue up. So anyway, stay high and drive when in Boca. Please pay attention to your insurance, your flood insurance, look at the new Macs, talk to your insurance agent, do it before this comes in because you could save a significant amount of money and do you do the diligence. We had a couple happy incidents happen. We had a child that was lost. We know the police worked diligently, ended up finding him. And then the other thing was I had noticed a homeless encampment underneath the bridge of 95 across the underglades. And I called Mr. Brown about it. He got on it. And the police went out. I think FHP also went out. And the man who was there got help from our police services is now on his way to be reunited with family, I think in Kentucky, because our police were there to help them. So I want to say thank you, and those were good things that happened there. Thanks to the outstanding work of police services department. Yes, so thank you. So I have some pictures here that I just wanted to go a few first, through a few things. I did not get to give a shout out to Ms. Davidson at the last meeting, which was her last meeting. And I wanted to make sure that I did that. She gave the city 41 great years of service. And I wanted to congratulate her while I was sitting up here. I'm sorry I missed the chance at the last meeting but we all got to got to show her some love last week and there was a lot of people there doing that so I was very happy to do that. I want to say thank you again to Mr. Brown and to rec services director Mr. Stevens for making Boca Ratona a little more dog friendly by opening up the Lake Loop in De Hornley Park now to our furry friends. They have changed the ordinance that now allows us to take our dogs on a leash around that lake as well. They installed some new dog spots there, not of you, Ms. Drucker, with this picture. And that's my son, Jake, in the picture with me. We had actually four dogs with us. And it allows you to now do an almost two-mile loop between that lake and the blue lake. So it's a really nice place to go out there. I know my family is really enjoying it. Hopefully others will get out there too. But don't forget to pick up your dog's waste when you're out there. There's plenty of places to dispose of it. Mayor Singer, Council Member Wigdher and I all had the honor of attending the FAU football home opener against Army this past Saturday and hometown hero and Korean war veteran Mr. Lu Shimken was honored there. And there was a unity in our country and of the world in an outrage that I don't see as much today in context of some other attacks. But I think solemnly for September 11th, as we observe, we have to remind an entire generation who was not either alive then of people who are not having a lot of people who are not having a lot of people who are not having a lot of people who are not having a lot of people who are not having a lot of people who are not having a lot of people who are not being a part of our strong and united community and if there's nothing further to come before us we are adjourned at 806.
