There's been some recent bills in the NC House and Senate that have some troubling language as it relates to zoning and the ability for citizens and their local elected officials to determine what kind of homes and businesses are going to be in their area that they live in and pay taxes to support. So the council may know, but I feel like many fellow citizens do not know about language in these bills that want to turn local zoning into a quasi-judicial process. What that means is that they want to limit the number of public speakers on behalf of the citizens and use mainly experts which usually only the developers can afford. Now, what this does is it takes away some of the responsibilities and duties that we've elected our local officials to do, and it also limits the voice of the citizens brief when they limit the number of people that can speak at zoning hearings. Maybe the most heinous part is the idea that our local elected officials can be held liable, monetarily liable, for decisions that the developers are ruled in favor of in the courts because they find that the decision was arbitrary, which usually is the responsibility of the zoning board. So what am I proposing? So these people in Raleigh, whether it passes or not, are not conservatives like you and I. They're Project 2025 aligned people who have taken this state overreach a little bit too far. So what I'm proposing is we temporarily change our voter registration to unaffiliated. There's two things that politicians understand. It's money and votes. By temporarily changing our voter registration to unaffiliated, we'll send a signal of our It's pleasure and they'll come running to find out what's wrong like my dog when I put out his dinner. This Saturday we had our Wheels and Squills event. It was a bit chilly but it ended up being great fun. The Twin City bike collective was a great addition to this event. They are a team of students and teachers from the summit school who refurbished donated bikes and give them a way to those who need a bike. So they came and gave away some bikes. It was great. Doug Moore, our planning director was able to give away some free bike helmets through an NC DOT grant initiative. I want to say a big thank you to public works for spending their Saturday helping with setup, take down and showcasing the village's vehicles and for building a pig pin for the day. Thank you to those village staff and council members who came out to help and support our event. There was a small pig snafu on Friday night, so I want to say thank you to everyone who helped find pigs for the big day to fill in in the last minute. It really showcased a spirit of community. For upcoming events, we have the Transportation Summit on April 24th at the Clemens Library from 3.30 to 7pm and Clemens Community and they kick off to the Farmers Market season is April 26th from 8.30 to 2.00 the Jerry Long-Wy MCA. We've been requested to look at, I guess, some of the existing streets so that still retain a 45 mile per hour speed limit. I think, she's working on pulling it up for you so I can kind of give you an idea of which ones that do. I think it's been something years past. We had a section of Clemens Road reduced. It was 45 that was reduced to 35 within this full limits. That was near Tanglewood. So the first one up canemun road still maintains a 45 mile an hour speed limit. We can, or possibly have it reduced to 35. of a portion of Harper Road is highlighted. It basically is from the roundabout at Peace Haven to the 158 or Clemens Road, it's still 45. Metalbook Drive from Clemens Road or Clemens Road 158 to Idles, it has a 45 mile perfire-hour speed limit and as well as Lewisville Clemens Road. Most of it through Clemens is still 45. I think the last is Idles Road or close to last is 40 is still 45 which is from basically have to Road down to the county line. A portion of Hampton is 35, but from, I think probably Keith Gale down to Alder Road Extension is 45. There's six in there. And last is, of course, the section of 158. It's from basically Hampton Road to Muddy Creek is still 45 miles per hour. So we're asking you guys to, if you have interest in reducing these trees down to 35, making mostly all streets within the municipal limits down to 35, we can, what have to come from its council request. We have talked to DFT. So it is possible they will determine they have the final say but the initial ask has to come from council. They may not want to reduce all of them. Some of them that are multilane like Lewis Lewis with Limond Road or 158 certainly have multiple lanes we can still keep it 45. Anyway I wanted to show you all this is what we still have at the higher limits. By making the request and then coming back to us will they do an analysis or do they already have analysis completed or what what's what are they going to be looking at if we say yes to all and get back to us. I think basically they'll look at the traffic counts and see if it warrants of reduction probably with its two lane or four lane streets so they'll make a determination if it would be a loud or not. And then if we wanted to what's the right word, debate that further, is that within our purview? Specifically because I'm thinking of Harper Road. Because Harper Road's really changed from what it used to be. It's got those two kind of mini traffic circles. You can't go 45 and then hit one of those little circles. And then we're adding sidewalks and we're doing crosswalks. It's just that roads change just inside lived here in the village over the past 12 years. It's changed dramatically of the way it's used and now how it's designed and how it's going to continue. And with all the school traffic problems, with a lack of busing, you're seeing a ton of walkers now. And so you've got old water ferd and two other neighborhoods right there across the street from Morgan Elementary that all are walking to Morgan, which is great. Just, it needs to be a safe route. I think what I suggest is that we present the ones that we like, to have reduced the D.O.V. and get their input or their decision. And then at that point, I think the last one we did, they did honor our request on 158. So I really had that opportunity to experience a time that we need to have a rebuttal. But anyway, I think we present our case and then let them you'll present whatever their findings are. And then we can go back at that point if we if needed. I don't know the exact answer that yeah and hadn't got that far we haven't had to do that. Yes, Todd. Yes, Todd. Yeah, I might just interject that the timing of this we haven't received all the information back from the safety action plan. Actually the walk audit that we did in that neighborhood they said exactly what you're saying. And people are very concerned about the speeds going down through Harper. And I think that we will see a lot of recommendations come out of the safety action plan related to speed. So if you put this in now, we'll get the safety action plan in June. It will be finished by the end of before you in June. And so that will probably come at the time when NCDOT, if they want to discuss it any further, we'll have that document with us that will help support what you're talking about. Perfect. And I mean, I hate to. I mean, that's why we're doing that plan. I love it. And I agree that That'll come at perfect timing then. We'll be doing our research while they do their research. And then we'll have an opportunity to come back together if need be based on what DOD says. So what's going to be the best way to go through this? Are you guys just going to name the road and have us give consensus? Yes, now? Okay. Well. Okay. If we need to go back to the maps we can. I just want to make a couple of comments. I think first of all, you know, all the work that we're doing with the safety action plan in vision zero makes a lot of sense for us to consider this. I think timing is also important. I would like to have some public input on this because we all do not live in all of these areas and we may not all traverse these roads all the time and there could be you know things that we don't know or see whether positive or negative and so I think we're going to consider this, it would be worth our while to open that up to the public to either come and make public comments or to be able to provide some sort of feedback because they live in these streets and drive them, right? You know, I don't necessarily want to make decision on areas that I may not visit too often. I'm in favor of obviously safety and reducing speeds that do that, but I think our manager also made a good point that all of these streets do vary in what their purpose is, whether too lame, fore lame, divided median, et cetera. So I do think that that's important for us to consider. It looks like this is a list. And I don't know if I'd love to hear how did this generate was it from staff is it from the safety action plan how how did this I know I brought up to you about Harper Road from our walk audit but some of these roads are not a part of that walk audit. Well it was we got to hit from several different directions. Possibly one for council look at it, such as you. There was a citizen that I think contacted another council member about the reduction of speed. And we've had multiple, I guess, calls on certain streets in the years that about the speeding, more of the higher speed limits on some of the two lane roads. And Bradley, I wouldn't disagree with you. I would say that for me, I've heard from enough of our community to feel confident in speaking to one road. And I guess I would hope that, I feel like I could speak to two. Pretty confidently but I think that among the five of us we probably all have a pretty good sense of what our neighbors and friends are saying with these roads. And DOT is going to come back and tell us we're nuts. If for some reason we all think we've heard something from the community and they're just like, that just isn't so. I'd rather get the ball rolling. I mean, I know Harper Road is one that I hear about a lot and travel frequently. And so it would save with all confidence that I could not imagine anybody being unhappy with that being lowered to 35. Now that said, I don't drive on middle-borker time. So I would look to you and Rogers to speak to something like that. And you guys have lived there and are more familiar with it and have friends that are there. have more friends that are on that side of Clemens. So I would think that you guys be able to speak fairly confidently to that populace. Yeah, we'd also like to get the information from our officers also as far as accident rates in some of these areas. You know enormous amount of accidents caused by speed or is it not a problem of some of these roads? Especially like 150 ACO for many great deal. It's 5 lane, so it's pretty wide open. And 45 seems reasonable for me. I mean, people pass me when I'm doing 45. But that's... You know, great. That's great here, man, driving. That's going far so slow. Yeah, but Bradley, it was because of Harper Road. But I said, you know, we did a big audit a few years ago of the roads and then lowered all of the subdivisions to 25 from 35. And so my question to staff was, you know, what roads still remain at 45 remain at 45 just so that you know I'm hearing Harper wrote a lot but I didn't want to leave out any of our fellow community members and this way people would know based on what they live by and they travel frequently and what they're hearing from their friends and neighbors so that they could confidently speak to this today. When we submit our request, what is the timeline do we need to provide evidence as to our reason or know? Because I'm hearing in June's when we get this back if we need some sort of evidence, obviously the mayor just brought up having our officers chime in. So if we submit a request now, is it an immediate response or do we need to be able to provide that documentation when we say, hey, this is what we like to do? I don't know their timeline. How quick? How quick? If you can immediate response from DOT, we're in trouble. What are you never in a... there is a new engine in there? Yeah, I'm not a traffic expert and anecdotally, I think we've all heard people's opinions on what they like and don't like. And I'd be in favor of starting the ball rolling because let the experts and do traffic counts and number of accidents and whatnot. Because that's just not something that I feel like I'm qualified to step in and say we have to slow it down or keep it where it is. I think we'll let the experts take a look at that and then come back with recommendations. Very good. Do you just want to consensus? I understand. Before you is a draft resolution expressing your opposition to changes to the local planning and zoning statutes now being considered by the North Carolina General Assembly. The title of the Disagenda Item is two bills, but this resolution talks about 14 bills that would reduce your authority to wisely plan for future growth and development. And the target has changed since the resolution was written and now there's more bills. I can't possibly list all of the things that would be changed by these bills. I will mention a few. They would require a mandate five to eight dwelling units per acre in every residential zoning district. they would mandate residential at some unspecified density in all commercial and business zoning districts and that's not defined. They would eliminate your ability to require off street parking spaces. They would mandate one or two additional dwelling units be allowed in every single family dwelling without provision of parking or setbacks from the property line. You know, I could go on and on for quite a while. You get the flavor of this. I think the two worst things from my perspective are the bills greatly increase the provision where the town might have to pay attorneys fees if it's sued by a developer, but the grounds of liability for the town are unclear. And the other one, there is a provision in one of the bills that would make the members of this board, the planning board, the board of adjustment, personally liable if they made a decision that was not permitted by statute. And again, taking together reading all these bills, I don't know what's permitted by statute anymore if they were to be adopted. So this resolution is for your consideration. And I'll just say this also speaks to the issue brought up by the gentleman who spoke early in the meeting. Thank you, Mayor. Thank you. All right. Councilor, questions of attorney finish off or comments? You're on the mission. I'll offer a comment and a recommendation that hopefully leads. We had a, we met earlier, I'll offer to you and thanks for the comment of the gentleman during the public comments. There are a series of five bills that I've been looking at that are so bad and so harmful that if passed they will fundamentally, and it's not hyperbolic, they will fundamentally threaten the existence of Clemens as we know it. Because they are designed to remove the ability of this council and every council like us to make basic planning and land use decisions required by 160D. Haven't said that, I would offer to you that I would recommend that we accept the resolution but regarded as essential but not sufficient and that we convene, we do two things. First of all, we convene a special meeting of this council to deal with this subject alone so that we fully understand all the implications and can devise both the strategy and some tactics to counter it. The second thing that I would recommend we do is in accordance with our ordinance that we passed, I believe is last February, charter our mayor to be our principal spokesman and hit the road and engage other municipalities and towns around the state to generate a call to movement, similar to what we did in 2023 to defeat those bills, and give him all the authority and charter whatever is required to energetically and forcefully convey the message that this is all hands on deck, statewide to preserve municipalities' authority to fulfill their charter for 160D over. Yes, and we discussed earlier about having all the mayors and for Scythe Candy Son or ordinance. And then we would get it onto the list or there's a list or the lead. I don't know if it's not the model. I'm sorry, it's a comment. If you haven't had the opportunity to read House Bill 765 and Senate Bill, I believe it's 688-495-497, The House Bill 765 is 22 pages, 14,000 words. There's a lot of bad this hidden in there too. And like I say this is a five-alarm fire. Thank you. Any other comments or questions concerning municipal bills that are pending? I think Attorney Benchoff for his diligent work. I think obviously there's lots in this as Mr. Condes said. There's not just one bill, multiple bills and I appreciate your summary. I do know that other municipalities in Forsyth County, I'm sure, across the state have adopted similar resolutions. So I know there's a lot of opposition to this and probably much would join our effort to do what Mr. Convests said. So I also know that there's been several articles in the lead to municipalities that have also mentioned the impact and threat of these actions by our state legislature. So I support it as well. I do too. And I think silence is not the answer. Sometimes people just want to walk away from something like this. But as Mr. Convest had said, this can fundamentally change clements. And boards like ours, councils like ours throughout the state. And do we sit back back and do nothing or do we do what is within our ability and power and desire to see that this does not pass through? And I'd be in favor of that also in having our mayor, be our point person on that. And one of the biggest things is holding us personally liable if we make them a second. How would you get other people to serve on any board in any town throughout North Carolina? Well that's the point. They take it all over and then we don't want to be a municipality and that's just one giant state. I mean that's just part, that's just a step in the process. Next item is planning the community development director's report. Planner more, please. Mayor, thank you. And thank you, Councillor Mayer, for supporting that resolution that drastically impacts what we're able to do here. So I appreciate that. I wanted to come before you tonight with a request to the grant world right now for federal funding is all over the place. But as we were hoping, they did release a notice of funding for another round, a 2025 round of the safe streets for all planning grant opportunities. asking we had actually written for a demonstration grant under 2024 but we wrote the grant in the last cycle and they had run out of money and so we weren't awarded funds. But what we were asking for funding which we planned to ask for again would be to build demonstration projects that would be in support of the projects identified through our Safety Action Plan, which was the 2022 funding and all with that. And so demonstration projects, as it's been explained to me in the past by the Federal Highway Administration folks that hopefully are still employed, that they would, demonstration project may be used or left in place. You can do some quick builds that would just be a weekend, but we could also do some that would leave the action in place for a while for us to really look and understand how they're working and gather data related to that. And so we would look more towards the latter to do longer projects to help implement some of those actions that come out of the safety action plan. So we're wanting to write for a $300,000 grant which would essentially be a $60,000 match. Now we probably would like to include some of this as in kind work, because we may very well need to rely on some of our public work staff to help implement and do some installation on some of the demonstration projects that we would propose with it. So I might give you a quick update. The safety action plan that will be providing those possible projects is moving along really well. Actually, if you'll see we've got the transportation summit coming up. The questions and some of the questions that you asked earlier, the data for the accident, we have that. That's part of this plan. You just haven't seen it yet. It's gonna be presented here at the transportation summit. So in addition to covering the two SS4A projects that we've got, there will also be an update, the information of booth for our safety action or our safety, our master transportation plan update, sorry about that. And then we've got all these different agencies coming from around the state to join us here at the summit. In fact, in CDOT division nine will be sending representatives and they will have a booth at our side. So, you know, with it. But right now, again, our request is to be able to write for a grant for 300,000 for the 2024 SS4A for a demonstration grant. It's a short one about the wheels and squeals. First the outdoor event, a little chilly, but we had a good turnout and it's nice to get out of the house so to speak and get together as a community and lots more on the agenda so check our website but it was nice to get out and see some familiar faces and meet some new folks too so good stuff. Thanks for the planning and all the work that goes into it. Linette's not here, I don't see her here but anyway and all the public works folks that got all the vehicles out and cleaned up and everything else we had a good time. Really did. And it was wonderful to you who was able to find a couple pigs to bring. Absolutely. I missed the baby pigs. But yeah, but Glitzi and Glitzi and who was the other one? Brow. They were amazing. They were really sweet. And I thought it was really outstanding of the woman who brought them. She goes, well, when I heard you want to have any pigs, and your squeals and wheels, I thought, gosh, I just have to help. I was like, OK. So it takes to the rescue. But it was really sweet of her. And I mean, Prestlin, that was able to find pigs within 12 hours. I'm glad it worked out. It was a lovely event. A ton of kids were there. Obviously, a ton of adults and families. Great job as always. So, and thinking more in elementary and the school system for letting us use the space. Yes, when I saw the post on Facebook that she needed some pictures. I thought we were just going down to have some unusual post on Facebook. You just thought of another note. You know, it's times like this when we talked about the resolution. It's times like this that we're doing our job and looking out for our village and looking out for our residents. And it's times like this that helped define us as a board. And I appreciate our attorney and every hand on deck that's going to hopefully shepherd this thing through in our favor. Nothing's guaranteed, but we're here for a purpose. And this is a big part of our purpose. It really is. It's a defining time. And Matt, thank you so much for coming and speaking. We don't have any direct access. I hate to break it to anybody.
