For the use of an activity of our limbs to be able to walk into, there's a meeting tonight to be able to see familiar faces, line one of my one purpose to make your city lake out for the event that we just pause and we just say thank you from generation to generation you are God and you have been good. So we thank you for our crew that's serving right now. We thank you for the new crew that is coming. We thank you all for your providence, your sovereignty, your goodness and your mercy. Once again, just by this meeting tonight to be everything that you want it to be, bless our young people, bless our, I will call it in my, grandparents, our veterans, thank you. Now like that city manager and our city attorney for their announcements first of all city manager Ryan Levy. Thank you, Mr. Mayor, from April 7th to the 11th which is starting today on City Lake Opera. We've got a large bulk items that would be cou couches, chairs, tables, etc. Curbside, hazardous materials. Can be dropped off at the Public Works Facility which is at 515 West Haynes Boulevard during normal business hours from 8 a.m. until 4 p.m. The next Ridge League of Cities dinner will be held in Arcadia this Thursday, April the 10th at the Turner Agro Civic Center beginning at 6 p.m. So bring your cowboy boots if you've got them. The next city commission meeting will be held on Monday, April 21st at 7 p.m. And then just a quick update. If you notice the roof there at the public safety building, that's then done. They've taken off the old shingles and we've gone to the metal roof there with the forest green color. As we update facilities and the bank building and admin, we'll probably look to match the colors. Even the library expansion when we eventually do that, it's kind of like a mint green color. We'll try to match it and have that hunter green look which is very, very like Alfred for us. Also work is being done on the parking lot. I thought it was taking a couple days ago. It is actually progressed quite a bit since then. And so as the commission approved that several meetings ago and this is the connect the bank parking lot to admin, we out of the bank rolling. That renovation is going underway and so just connecting the two and then also doing some work there to sequester off the public safety parking lot. So quite a few projects going on in Lake Alfred. We should be breaking ground on the new playground here in the next few weeks. pretty aggressive timeline there, hope and to have that ready for going into the summer as when we're looking to have that up and running. So onwards and upwards, we have the cleanup day, this past Saturday. So I appreciate everyone for coming out. I'm always a good community involvement there. And for our thanks to the church group as well that came out. I have quite a few volunteers this year and we will continue to try to expand upon that. And in case you didn't know, it was my birthday on yesterday. And so I'm the guy that goes to the restaurant and I never tell him it's my birthday and I give the EboI to all my family and I'm like no one better out me I don't want ever-whole wait waiters and everything singing and clapping for me so y'all got me and and I appreciate that so imagine my shock when I came in and I was like oh my goodness and then Blassey know, you're to a vice mayor daily on this, but we received a generous donation from a family to build kind of a teaching pavilion out at McCuy. And so that's kind of an update before or not quite after, but progress that's being made on constructing that out at the the MacKey preserve. Nancy, if you'll all yield to you just if you want to expand upon that and the family that made that contribution. There are family of paul fellers who was a local environmentalist and a very agaboder and he used to bring his dogs out to walk the trails very often. And when he passed away, family had a celebration of life at Semekai House and they asked for donations towards and outdoor education of Pavilion to further pause. He was a very avid education opponent and so they're going to have lip-villian with some benches so they can do classrooms. We can use it for our field trips but also for home schoolers who are using it. And then with an accent on birding, so they'll be planting some bird-friendly plants around it and butterfly-friendly things just to have some more educational opportunities for to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to the kids and to some more educational opportunities for kids and to get them involved with nature. And so that will be, we're so kind of in construction now, but that will be open to the public as a part of the trail system. Then we'll have a dedication sign out there to kind of commemorate the generous contribution. And with that, let me yield to the city clerk for the update on the municipal election. Thank you, Ryan. The total number of ballots cast in the 2025 units full election was 563 of which two were blank for a total of 561 ballot ballots. That was 383 or 68.03 ballots were cast at the precinct and 180 or 31.97 were cast by vote by mail. There were no provisionals or cure affidavits and the total number of eligible voters was 4,719 constituting an 11.93 which includes the blank ballots voter turnout for the election. So the certification was as follows. Brenda Arnold received 193 votes or 13.34%. Nancy Z. Daley received 325 votes for a total of 22.46%. Mack Fuller received 302 votes for a total of 20.87%. Wandsda Maltsby Daily received 182 votes or 12.58%. Ronnie Robinson Jr. received 229 votes or 15.83%. And Michael T. received 216 votes of 14.93%. Very good. Thank you Linda and just the translation of that so the two incumbents retain seats and then the additional member on the commission would be Ronnie Robinson Jr. and he would fill the unexpired two years of the term, the seat that Mr. Malspie's currently in, and so that, there is. And I just wanna congratulate everyone that ran, just the act of putting your name out there and running for election. I mean, that's a bold move, and I'm just appreciate all the community involvement on that. But again, thank you Linda for the announcement of the results. The terms commence, it'll be the first meeting in May, as is the commission, the signy die, and all of that that the city attorney usually does. So that commission will be sworn in at the first meeting in May. There is a meeting tomorrow with the canvassing board. That is correct. It's a post-election audit and it's a manual count of the ballots to verify the tally machines tallyed them correctly. And that's here, here at three o'clock. Thank you. Very good. We come here before you tonight for a heartful of vision and a request for partnership on our project that will greatly impact our community and our beloved city. We recently acquired the Duke buildings where 65, Blessed Sharon's Avenue, which many of you may recognize. Our goal is to transform this property in a vibrant hub of hope, health and healing. With the fully renovated community, center and also a worship space that serves not only the church but the community in large. My husband is a veteran, I'm also a part of the military family and so as I go, it's to touch the lives of not only the veterans, the youth, the seniors and those that need resources and support in the community and the power men. This bill that is not only just a wall and a roof, but it's an opportunity that life can be changed. It is our goal that we want to provide after-school tutoring program, also an educator as well. Mentor-ship programs, what we want to do, we want to be able to get food from the communities or the community that are struggling can buy a whole lot, where they can buy health. We also want to provide mental health for our community, wellness, support for our community. We want to provide workshop for financials or those that need to get that credit together so they can purchase a home and be able to hold a shop. There's so much that we want to do and so what we would request is for the community to accept us and and also be a partner with us in this community. Thank you for your time. Thank you. This may be the only time this may get surrounded with applause. Carl has served the City of Lake Alfred for five years of service as Code enforcement officer. Code enforcement officer is one of those positions where needed but you got to walk the line between being affected and being hated. And so Carl does a pretty good job of it's a balancing act, but has done a lot of good over the past several years bringing different properties and compliance and really just trying to dig in. Lake Alpors is a small town. It's not a big bureaucracy, like dealing with the city of Tampa or something like that. We work with the citizens and with the violators there and we're to gain voluntary compliance and really it's about participating and being a part of the community. So far all you've done a great job at that. Also got employee of the quarter in 2023. So prestigious accolade there, especially as again, code enforcement officer. But Carl does a good job for us. And please give him a round of applause and recognize him. I would only say it's from all the head of the directors and everything that had just made this possible. This is not just a little city, it's not a place of employment, it's more like a big family. My wife and I have really enjoyed myself being employed here and I'm gonna be around for a little while longer. But you got the rumor about there's no such thing as retirement here, right? You're going to go down here to Mr. Moles. But you got the new one about there's no such thing as retirement here I'm going to get the You have to have back to bed. I love it. OK. All right. Resolution number 08-25, a resolution of the city commission of the city of Lake Alfred Florida making findings, confirming the acceptance of of improvements infrastructure and dedications in favor of the public City of Lake Alfred as noted on that certain flat entitled Silver Lake Phase One recorded in the office of the clerk of court of the circuit court and and Ford Polk County Florida and flatbook 195 pages 21 through 26 of the public records of Polk County Florida authorizing the release of the security posted to guarantee completion of infrastructure and improvements within the Silver Lake Phase I subdivision, accepting a maintenance bond and accordance with requirements of the City of Lake Alverdeonified Land Development Code for certain items of infrastructure and improvements within the Silver Lake Phase I subdivision. Providing for the incorporation of recitals, providing for conflicts, providing for severability, providing for the administrative correction of the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school and the school Okay now I'd like to ask city manager to present the analysis please. Thank you Mr. Mayor. On October 17, 2022 the City Commission approved the final plot from the applicant Silver Lake Phase 1 and the Silver Lake subdivision. The approximately 62-acre subdivision is located west of county road 557 at the intersection of WGTR Tallah Road. The subdivision was developed utilizing a master plan in community cluster provision within the green swamp area of state concern. The development includes six and a half acres of wetlands and 18.4 acres of open space. Phase 1 includes 214 lot for the density of 3.89 units per available acre. The city of the construction plans on July 15th, 2022. Cities received all state permits and the site is in the final stages of construction. The owner applicant has submitted the infrastructure estimates for completion of the infrastructure and has provided a performance bond and the amount of 120 percent of the engineers certified costs for all remaining improvements to be constructed or $7,052,680 in two cents. The proposed resolution allows for the release of the performance bond in the acceptance of the $463,687.11 for the maintenance bond. The number has been amended and updated following the packet that was sent out. So just showing that as an update and amendment to the correct number. City Attorney has reviewed both bond instruments. Staff recommendation on this is to approve of the illusion 08-25 and staff would be happy to answer any questions. Thank you, sir. So, City Manager, at this time means that in later in terms of that phase is very close to completion. The Remain that's been provided and the performance bond is released. That is an indication that the property owner or developer has completed all of the infrastructure and improvements. So this is on the, this is more ministerial than anything else because when we approve the plats we usually do that conditionally and that's because not all of the infrastructure is fully completed and accepted by the municipality. So this is on the back end. It means everything is pretty much done and And we're releasing the performance. Sure. We've bought the car and now it's under maintenance warranty. There's a performance warranty. I want to do a compliment. So really subdivision on their appearance from the road and their their burn and landscaping. I feel like they went over and above what the city had asked for. And I really don't want to appreciate that they didn't just turn it into a wall tunnel down the road like some of them do. Item number two, public hearing. Resolution 09-25, Lowry Hills vacation right away. And now I'd like to ask, let me see, city attorney to read resolution 09-25 into the record. So that easy to forget about me. Nobody would. Resolution 09-25, a resolution of the city commission of the city of Lake Alfred Florida, vacate, inclusion and abandoning certain portions of unimproved, unplatted and unmaintained rights of way and the access easement for the Lowry Hills cemetery, providing for the equal presentation of the titles, providing for conflicts, providing for severability, providing for the administrative correction of the script of his heirs, and providing for an effective date. Okay, and again, I'm asked to announce that this is a public hearing, so that's what threw me off there because that's normally down the way. I'd like to ask City Manager to present the analysis, please. Thank you, Mr. Mayor. The committee has received an applicant initiated application requesting the vacation of easements in right of way in the Lake Lowry area for the Lowry Hills residential development. The general location of the easements in right of way is north of US Highway 1792 near the intersection of Lake Lowry Road and Old Lake Alphur Hain City Road and includes the access easements to Lake Lowry Cemetery. City staff has reviewed the request and determined that it meets all statutory requirements in addition to the City's Unified Land Development Code and comp plan. No portion of the rights of way or easement was required for a required for a state or federal highway and there were no objections from utility providers including Tico, Polk County and the City of Lake Lake Alfred. Vacation of the requested right away in the evening will not interfere with access to the property, and they are not needed by the city where other associated public interests and notice of the proposed vacation was published in their local publication and accordance with the applicable law. You can tell by the map there, again this is kind of the based on the plot map, but the Lake Lowry Road, which kind of splits the development into, there were just old antiquated easements and right away back from over 100 years ago, you know, with some suggestion that there's might have turned into roads, they're really just not needed. And so that's where through the site review plan process or the development review committee. They've just determined that we don't need these so staff recommendation on this is to approve resolution. Oh nine dash 25 for the vacation on the city attorney does have a caveat to read in there were a couple things that the applicant was trying to iron out with Tico. So you have parcel releases from them letters were sent that I don't think the exact mechanism is exactly to the standard that the city attorney is looking for so we will be requesting a conditional approval but I will yield to him for the exact language on that. Yeah and this has been a marathon just to let the commission know this is not something that due to anyone's negligence when neglect that we are still waiting for two items to wrap everything up. There's about 20 to 30 different rights of ways and easements that were being addressed for this particular development. There are I think two remaining that we need to either that we, the city needs to get a partial release or a release Of easement from the provider whether that be Tico or whoever that easement would run in favor of So the conditional approvals what's being sought so upon receipt and review by count I mean by city staff and by the city attorney's office Then the effective date of the resolution would be the date that we would have received those releases and then staff will move forward with recording the resolution 09-25 document with the clerk of court. So if there's any questions, that's why we are requesting that the conditional and not recording it right away. I'd be more than happy to answer that. But the developer and property owner, they've done the Yomans work and pulling together all these different interests. I mean, these are dating back to the 1970s, 20s, 30s, 40s. I mean, it was a lot of work to identify each one of these interests and to be able to get the proper documentation. Okay. Now, we have this being a public hearing hearing we have an opportunity to ask people to come in speak your questions or your concerns if any. If you have anything to say please come forward and state your name and your address. Okay seeing none I'll close that option. Now I open for city commission comments please. As I've been a bit has been dressed very well I will go with the motion that we approve resolution 09-25 Loury Hills vacation of Rodaway and just for clarification for the record that's it can condition a conditional approval to the explanation provided by council okay we have a motion in a second all in favor say aye aye any opposed okay the motion has carried thank you okay item number three one of Mr. Roadway access project And I'd like to ask City Manager to present the analysis, please. Thank you, Mr. Marshal. The VISTA Drive is a north-south road that runs parallel to Shin Bowboard through the downtown area. When the Florida Department of Transportation went to the Split Pailes through downtown and created Shin Bowboard, many of the sections of one of this to drive in that area were removed to limit through access. Limited sections remain for residential non-through traffic, but no section of the one of this to remain that had access to a side street. That access Shin Bowboard will be exception of West Peer Street. And so what I'm referring to, there's little what I what I'm referring to is, so that's Shin Boulevard that came in and you can see that's one of the sections of Buena Vista that actually connects two peers that have access to Shin. If you look at the overhead map, all the other ones that might be interior to neighborhoods that don't then have access to to Shin Boa Board. Part of the issue with connectivity to one of this to on a street that had access to Shin Boa Board is that when the parallel road is so close to Shin, it causes a potential safety concern with access. When the method of strokes requested their use approval for a school, staff was concerned about the potential impact of the additional school traffic for pickup and drop off through one of VISTA. As a result, staff evaluated possible safety enhancement including the closure of or limiting access onto one of VISTA off of West Pierce. The site development plan concept was presented to the planning and zoning board for consideration on August 8, 2024. The board approved the conditional use to operate the score at 130 South Pennsylvania Avenue and the site development design concept to be evaluated and approved at the staff level. One of the other options was turning this into a COLA SAC. And then, like, totally removing the SAC, one of this access. The church wasn't receptive to that. They've got a church-strict store there and they were just concerned about visibility and access there and so we went back and forth with the city's engineer to kind of provide other alternatives and settle on just limiting the kind of access to one of the alternatives. I'm working with the method of church and further evaluation by staff and the city's engineer proposing a limited access option which were calling one of this as the alternative. I'm working with the method of church and further evaluation by staff and the season and the year of proposing limited access option which were put one of this into a right in only and one way. So right now you can put in, you can come down peers and if you're familiar with it appears backsock a lot now because we've got plenty of traffic coming from the Albondale area. Traffic's increasing southbound that's where all this citations are coming from in the morning and we know the cars are booking it down there and if you try to get across to then go up Lake Shore and go out 557 that's a bit like playing you know progress out there so the concern is the the car is turning here and they go in well Well Bacarus coming off of Shin and turning, there could be a potential impact. Now we've been lucky. We really haven't had too many accents there, but with the church increasing or the school has increasing some access there and as traffic continues to deteriorate, we just have an additional concern there. You know, additionally folks that are, so again, if you're coming across or you're coming down, you'll be able to do a right way in. We also don't want cars coming down this road and then exiting for the same reason. Because now if you're turning there, you know, you've got to look now all the way behind your shoulder to see who's coming off that turn there. Likewise, we don't want people coming out here and then trying to turn into the queue right there at West Peers, you know, and again, potentially having a car turn and then with that queue. So it's just going to make it a lot safer to make it a one-way in, right in, and that's kind of what the engineer has designed there. The proposed project includes the access improvement, signage milling and resurfacing of the section of South Point of VISTA Drive and the public alley that connects one of those to the South Pennsylvania Avenue. Funding is available. We complete the project and the city's paving and complete streets line item and the general fund. The city has received the following bids for the project. Triple A top quality aspect gave a bid of $58,740 and so that is going to be for that's their bid. And so the action item that you're considering tonight in the city commission is this action item right here. And so that total is $47,425. You've got a grant action item for consideration as a part of the CRA. We'll cover that, but that's the cover of that section. That's private property. And so that's where the CRA grants coming in on the ADA access improvements with Haney Cat Parking and the like. So this is kind of a two-puck project if you will. The other amendment, so the total bid on it was the 58,740. It approved the section that you're approving tonight that is 47,425. The second quote we received was from G&G, and there's an updated quote there. The total was actually 106,2744. We had received an updated bid from them. And then landlord proposal, which was $79,325 and 53 cents. So AAA asphalt, you know, really came in competitive on that and we're getting a lot done for a reasonable, a reasonable quote. So the staff recommendation on this is to award the point of this to access project to triple A top quality asphalt when they amount of $47,425 and that will be to do the improvements right there and that highlighted blue section and also then the intersection improvements right there to make that a right one way and a right and only. And staff will be happy to answer any questions. Thank you, sir. Okay, so from public hearing and I would like to ask anybody that would have questions or comments on this item. Mr. Mayor, it's great work with partners and getting things done for safety is absolutely good. If you're one else, I think you know, we saw kind of first hand the we were picking up trash and Ryan explained to us kind of what the policy wasn't to see exactly what we were proposing really made sense. So I appreciate that extra effort you brought. But I don't think it ever made sense the way they broke kind of this up into pieces along there when they put in the Shinbo Vardin. I never thought it was the best way. So hopefully this is going to be an improvement there and we can look at the other sections. Yeah, and when I look at that overhead and you look at every other section of one of this that remains, none of the other ones connect to a side street that connects directly to Shin. They're all tucked in interior neighborhoods and it's like, okay, that kind of makes sense. This is literally the last one and I think they just kept it because of the church access and the like, but that is not commented DOT. They would never allow you to have access that close to their state highway. I mean, you can't get, you can't get driveway access from FDA, no no matter what and they're certainly not going to give it to you that close to the turning radius. I have to put a comment and this is more I know a long term. I thought when I think it was FDOT did a presentation I thought they were eventually going to turn through this like in the heavy traffic signal. Like you said it's kind of it's kind of a I'm not going dodgy, trying to get a cross. They will. I've got an update that I'm working on to the commission, but I've met with the district already in January. We've met with DOT staff out at McCoy Bowelburg. We're using the data from the citations to press them. We had a meeting probably two weeks ago with the consulting that that's doing the PD&E on the corridor study. So they're evaluating that downtown study. So I met with the DOT rep on that project and the consulting team. And so they've been getting an earful from study staff on short-term impregnance. And so we're leveraging everything that we can up to including using some of that revenue that we've received from that citation program to fund potential short term improvements like a signal. But FDAT is so problematic is that you can meet with one group and they're receptive to it and aren't going to test it as frustration. And then when you put it in the oven, then something else comes out completely different. I don't know if we didn't say that or you got to go through all these things. So we're trying to co-alve them and get them to commit, just getting them to commit to do short-term improvements is going to be a win even if we have to help co-fund it. So that's what we're focusing on now and we're contacting the DOT secretary and we're trying to use the PDME project as for the overall court or study. That's going to take them three years to complete that study. And then you've got to get in the funding program to do the main project. So that might be another five years. So it might be ten years until we get the real stuff done. And that's probably the short range. But as we all know, we can't wait that long. So we're trying to get the district to allocate some of that PDNE study money to identify short term improvements that they can greenlight now and basically navigate the bureaucracy of FDOT so that one person doesn't say yes and then it goes to traffic operations which is basically like their engineers and that's where all things go to die, basically in FDOT. Once you get a traffic op, it never sees the light of day. We did a traffic warrant, we did a signal warrant, didn't meet warrant. So that's the battle. We're fighting the good fight now. And so that's the overall goal there, Commissioner Eden, is to get exactly that. A signal, I've advocated for peers. We've talked about Cummings. Peers just seems to be the years ago, I think Cummings was more of a hot button item. But Pierce now has getting all the traffic from the Auburndale developments and water ridge. And I guess my concern, which is I think you answered, is just as long as it aligns, you know, I don't want to at the kind of rate, when do it, as long as it aligns with how things are going to be in the future, then that's fine. It wouldn't. Now, when FDAT comes there, they may have an opinion on one of this, you know, outside of that, but we're improving the condition that's fine. It would now, when FDOT comes there, they may have an opinion on one of this, you know, outside of that, but we're improving the condition that already exists. I don't think a signal inherently interferes with that, but as FDOT looks at that entire intersection, they may, if anything, that are what we're doing now may actually help them from doing something more draconian. Thank you. Well, I know the city also is mindful of the DOT manual. All signalization, whether it's a state road, county road, or locally maintained road under the city's jurisdiction. Signalization meaning not just stop signs, but speed, alteration devices. type of device that's used in a public street that has the effect of maneuvering traffic as considered signalization has to be constructed and designed for suing to FDOT requirements and it's manual. I'm sure Clifton is well aware of it. I'm sure other city staff is so when Ryan is talking about that, whatever signalization is being provided at the intersection, it will be constructed pursuant to FUTU guidelines. I can give you kind of a simpler justification. Between the hours, you know, basically eight o'clock at night until like I don't know six o'clock in the morning it's probably okay to cross. Anytime number, anytime in the 20s that it's, you know, like I've been telling you a clap in the morning, it's pretty tough to call. So, it can't be unless you just time it right. Whatever pressure you guys can put on, I appreciate it. So, that's great. Yeah, we hope to have an update. Mekai is actually, we're working on that permit now. Now, there's not going to be a miracle solution there that we're not going to get a signal, but we will be able to close the left turn out. And then that kind of forces people to do a right hand turn and then do a U if they're going towards Winter Haven, all of them down. That's what's going to increase safety. Because even in the 10, even the 20 minutes that we were out there, we were in the old funeral home parking lot with FDAT and art was out there. And we just in the 20 minutes we were there watching. We saw about two or three near misses and a tractor trailer turn left out of Mackay that just swept across three lanes and just clogged the whole thing up. So something's got to be done there, but we're, again, navigating the FDAT process. I'll have an update on that if and when we go through the permitting process there'll be public notification and things like that as well. When you talk about the 557 coming into town and ultimately when we take down growers Is that one of the first street that you can come to, that dead ends right there? What's the story, what's gonna happen with that? I think that there's homes there that are gonna like between one of this and the main road. I think whenever that DAT comes through, the county's not gonna touch those because the county's just going to for lane it and basically dead ends into Shimboverard. But after that, when the state kind of evaluates what they need to do with that intersection, I would be surprised if those houses make it. They're probably going to take those houses, close it down, and then take whatever's left of one of this to in order to reconstitute that intersection to make it work. There might be still have to do stormwater offsets and things like that. So one of this might be a stormwater pond and those houses that are there, and again, 10, 15 years as those most likely be gone. The same thing for the building, like almost like a bandage structure that's been there. Is that the many, many years? That's the same area. The old attorneys office, I think that's pretty clear. That actually is supposed to be a pharmacy and they're actually working their way back through the DRC process I spoke with the owner there just the other week and said they might actually be pulling a demo permit here before long to tear that down and then build the pharmacy. Okay, thank you, sir. Now our city manager to present the analysis. Thank you, Mr. Mayor or Mr. Chair. The Wake Alfred Community Redevelopment Agency's capital improvement grant program partners with the business community to promote investment in not only the downtown area but in our commercial districts. The program incentivizes commercial billion owners and tenants to renovate and update the experience of in commercial iningures of commercial properties located within the CRA by providing financial assistance. The program is designed to provide a matching reimbursement grant for these improvements by offsetting the cost of these projects. The CRI have to incentivize visible enhancements that would improve building and site aesthetics thereby improving the marketability and value of existing businesses and attracting new businesses, residents and visitors to the area. The program is periodically amended based upon feedback and experience implementing the program in order to improve the effectiveness of the program. Notable changes in the proposed amendment include lying the COA board to hear variance requests based upon deviations or discrepancies within the program, and the subtle issues and elements that may not have been contemplated within the program as needed. Additionally, it cleans up other uses and provisions consistent with previous provisions. Sometimes we would see something that was contradictory, but we had changed them one section and just needed to carry that through to others. So really just to clean up in nature, based upon previous revisions and intent. Also requiring that quotas for work to be performed are itemized. We do have language in there about quotes, but just take them out extra seven, wanted the details and then itemized quotes for these. And also to extending the additional application deadline from December 31st to January 31st to allow additional time following the holidays. And so again, similar to the personal policy handbook that we bring back every so often as things come up or we learned best practices and lessons learned, the same things happening with the capital improvement Program. As we have additional applicants and interactions, we're just continuing to improve the program. So staff recommendation on this item is to approve CRA Resolution 01-25, and staff will be happy to answer any questions. Thank you, sir. Okay. I'd like to ask the city manager to present the analysis please. Thank you, Mr. Chair. The Lake Albert Community Reader Development Agency maintains a capital improvement grant program. The program incentivizes commercial businesses to renovate and update exterior facies in not only downtown but other commercial properties. The program provides a 50% matching reimbursement grant of up to 50,000 for eligible expenses. 100% of ADA improvements up to 25,000. There are additional matches that go beyond the initial 50 for larger scale grants. By offsetting the cost of these projects, the CERA's goal is to incentivize visible improvements that will improve building and in building and statistics, thereby improving the marketability and value of existing businesses while attracting new businesses, residents and visitors to the area. And again, just to kind of explain or expand upon that because it's a community redevelopment agency, we're able to do things up or not able to do in the general fund. And so the underlying impetus of the grant is if the CRA is there to address blight and to make improvements. And so that's kind of the, that dovetails back to the original CRA plan as to why we're able to do these grant projects within the CRA area. The application process currently has been on October 1st of every other year, and it closes on December 31st with the most recent amendment that you just did a couple of minutes ago. That will now change to the end of January. Applications received after the formal application period closes may be considered subject to available funding. The Board of Terms application approval in the amount awarded. We've already kind of awarded several grants earlier this year in the Millenus cycle. So these are grants that now have come in after, but we still have available funding. So you can see the applicant here from 130 South Pennsylvania. This is for ADA access and handicap parking. The request in is 11,315 and eligible because it's ADA and access improvements before the mountain is eligible, since it's under the 25,000. And we also have an application from 720 Lakeshore Way. This would be for parking lot improvements and facade improvements. The total request there was $71,651 and the eligible for the grant is $35,875.50. The application for the ADA access and parking improvements was for the Methodist Church. It is designed to work in conjunction with the Bonavista Roadway Access Project. If approved, the work will be performed by the same contractor and the 11,315 from the CRA. It will be a portion to fund their grant requests related to the ADA improvements, which are eligible for 100% coverage by the grant up to 25,000. The applicant's eligibility requirements have been met, and it has been determined that the applications are sufficient to be transmitted to the board. 200,000 has been allocated in the current fiscal year budget. The first round of approvals in February of this year allowed for approximately 43,700 in grants, leaving sufficient funding. So you figure the additional 46,000. That'll put us right at 90,000 total for the year. So we still do have some funding available, but we're in good shape in the program. Staff recommendation is to approve the proposed grant work west applications. And staff will be happy to answer any questions. Thank you, sir. I imagine other places have done really well with it. So they just, I don't think they get it. This came out, I think, my running joke, and I don't think that's not even a joke anymore. It's bad batten probably ninety five percent all the bad legislation comes out of south order yeah so take take uh... take up that what you will but i think i might see just wild legislation i'm like okay which county is is it but you know there's a date is it before or where's the company and there's about ninety five percent i would say we're just wild stuff comes out of there. So yeah, just trying to close the CRA. So if that passes, it doesn't allow you to do, you can't form any CRAs, you can't initiate any new projects. I've talked with some of the local city managers. If that were up at you can initiate any new projects come up October of this year. So what will happen is if that passes there will probably be a resolution prior to October we're going to initiate every single project we can think of under the sun. It's going to be a list of 152 projects. And we're going to allocate $1 to each of them and that's how we're going to play the game. So, you know, that's what we're going to do to me and so if that does go through, then what will miss if they have their own advocate at the county meetings then? Well, we'll see. I don't think we did that for a while. They might have, I mean, really it shuts down the creation of new CRAs. we created ours over 10 years ago. It would just take away that option. Further attack on home rule. Why the state has such a strong opinion about CIA? There's got nothing to do with their tax revenues. There's got nothing to do with their policies. The county, all charter counties have the right to approve it. So the only one that will have an issue with the CRA should be the county that's why they're taking tax revenue from the county although the county argument to that is where we invest in tax dollars that are generated from the CRA back into the CRA so that the county doesn't have to do county initiated projects in the city they in the city, or as they never do. So that's kind of the counter-argument or the counter-balance, is that we know better what projects to fund in like Alfred better than what Bartow does. Kind of like how Bartow knows better to do what projects in Bartow than Tallahassee does, although Tallahassee hates when Washington tells them what to do, but then they're more than willing to roll it down to bar-tile in the local, you know, cities. So it's just, it's wild to me, we roll the punches though, and the only thing we can do locally other than advocacy, which is what we do do, is if they do that, we're going to have to initiate a ton of projects. You know, just get them on the books. Which again, we park master plan projects, freaks, scabbing projects, these things are already on the books. Good thing about street scabbing projects and part projects is they almost never end. So we will have petules, street projects and things like that for the next 20, 30 years. Thank you. Yeah, so if I share when we were there in my legislative, there was a committee meeting with the Senate. Now we had a couple of the senators that just basically told the writer, have you seen the 200 CRAs in the, basically kind of said no? And he says, well, we had this amendment from 2019 that said the people that are not doing the right thing, you audit them. And that's exactly what the city of New York is saying. It's a bad apple. So we spoke with our local delegation, and that was a suggestion that we made. If the legislature has problems with what CRA is responding the dollars on, you know, it would be far more appropriate to try to, again, do not personally they should do nothing and just stay out of it. And if there's an issue with the CATE Quirrel CRA, let the CATE Quirrel voters deal with the CATE Quirrel CRA. It's a big state. Key West, the Pensacola, and everywhere in between. You know, it's not one size fits all, but that's what you end up with with Tallahassee. But it said a throw into baby out with the bath water, more restrictions on, you know, what the funding can be spent on. And that was, that was a narrative to our local delegation as if you work around the county, Auburndale, R-C-R-A, others, we use it for its intended purpose. Grant programs, you know, helping businesses, just what the action that you just approved now, investing in local businesses and doing projects in consistent with the mission of the C-R-A. There's like one of the bills that's like a supernova, right? Like I don't ever expect those to make it through, but there are a number of bills that are in the coffers moving through this year that scare me much, much more. And it is, please watch it if you'd like a legislative update. I have about 112 page document that identifies all the different house and senate bills that are out there. But you'll lose sleep. If you read through it, you're gonna lose sleep. It's an interesting session, but I do not anticipate, and now watch, I say that, and then it actually goes through. But I don't anticipate this one making its way through. But if you would ever like to discuss any legislation, please give me a call at the office. We'll talk baseball. And if you'd like a copy of that legislative update, let me know. All righty. It seems to be that those in Tallahassee or, well, Tallahassee right now, they're looking for ways to take away revenue from us with you know reduction of property taxes or stuff like that and it just you know, what do they think we're gonna get our monies if they start withdrawing all those types of funds? Well, that's not a question. I think they're way about answering If you look at the legislation, I don't think they would be happy until the government is nothing more than a permit issuing authority but I I do them the permits. They don't take me up on that. Okay. So we were closed on that one right? Yes, you're right. Number three. Capital Improvement Grant Variant Request. And I'd like to ask city manager to present the analysis for item number three, please. Thank you, Mr. Chair. On May 15, 2023, the community development agency approved a capital improvement grant of $21,999.38 for 520 East Andrew Reen street. And so that would have been on a total project cost of them at $43,988.75. And requested a 50% reimbursement, which would have been the 14, which would have been, well again, the half that amount, the 21,000. So if you've been working with the Mount Cormor, Holiness Church, the minister of the grant, The church has submitted an invoice totaling $28,773.33 and requested 50% reimbursement of that amount, which would be the $14,386.67. However, the reimbursement cannot be processed at this time as proof of payment is required. The church has indicated that it lacks sufficient funds to pay the contractor upfront to facilitate the reimbursement through the grant. So again, it is a reimbursement grant, so you've got to spend the dollars first in order for us to reimburse through the program. So without that critical step, we really can't do, you know, the reimbursement without there being something to reimburse. A portion of the approved work has been successfully completed, included exterior door replacement, soft repair, exterior pressure washing and pain. Upon reconciling the completed work against the original itemized quote, which was included in the grant, the completed amount with total $18,238.40, which would result in a reimbursement of $9,119.20. So you can see there up on the screen, that was the original quote. Right, here that we received is a part of the grant. Well, it's like getting my letter to work. Place your pointer. So the ones that were highlighted, which were completed, we did. We inspected the work, the building official included an opinion letter which was a part of this attachment. Here's a spreadsheet that I did of the ones that were completed. Again, we have to go back to the itemized work. No different than if we had received a grant for something, they're going to go off of the original submittals. Even if there were a cost increase and things like that, the grants are always going to be based upon the initial amount. We've seen that with the fire, the fire engine. You know, if you, if they approve 400,000 or not, you know, you get a million dollar fire engine and it's, they'll give you a half million on the grant that the fire engine between when you got the grant and when you committed to it. Now, all of a sudden, it's 1.2 million on the fire truck. The grant's going to stay at the 500,000 from the quote that you submitted and then you would just be, you know, I'm a hook for the additional there. Right, and that's consistent with all the grants and so that may have been what happened, but we've got to go right through the itemized bid just so that it's all readable and we can reconcile back. The request before the board is for a variance, so because we can't facilitate a reimbursement, there is a variance request here from the current program guidelines to accommodate these circumstances. The board may approve, deny, or modify the request at its discretion. But the staff recommendation on this item is to approve the variance and make a direct payment to the contractor in the amount of $9,190.20. Based upon the work that was completed in the original quote, staff will be happy to answer any questions on this. Okay. This is a public meeting and I would like to invite anybody that has questions or comments on this item to come forward. Seeing none, I'll close that option and open for board comments. Does the church say that they have been when we repaid the rest of the contractor? No, they just said that they didn't have the funds available and they're not. Of course, we're on us in the sense that it was a requirement of the program, but I don't think even though it says reimbursement grant, we didn't have the specific waiver or form in the paperwork. We're going to correct that going forward where they have to provide like a letter of credit or something that shows like a balance there and in that way they can't kind of paint themselves in a corner so to speak. So when we met with the representatives of the church they said they just did not have the funding to complete it and that might have been, you know, I think that's why some of the work was done. I think the contractor didn't want to get too far down the rabbit hole. Good relationship there between the church and the contractor, the contractor is connected to the church and so they're wanting to help out and make it work. But that was a request. I came back to staff and rather than just deny, you know, and that's a thing too. We got to look at it from the audit perspective. The way that it was written and the way that it was presented to me, we had to deny it. But that's why we changed. We amended the program to allow for variance request. And so that's why it's auditable. We can go back to the original bid. It's been inspected by the building official. That was the work that was completed. So the Board board approves the variance based upon the updated program, guidelines, everything's above the board and where it needs to be. Okay. I'm going to make a comment too. I mean, the spirit of this is to obviously to not be able to do it. You know, it's called spirit. And I just like kind of figure scale. I've not approved one church's thing, and not another church, you know what I mean? That to me, to me, doesn't make sense either. So I mean, as long as it's being paid directly to the contractor, I think that I think I think that's a good shape. Yeah, that's a compromise. It is. It's a little bit outside of the norm up parameters, but like with any of the terms that are just right as well, I'm that's the part of the zero program too. That definition is that they made an improvement there. You know the comments? Yeah, I like the Michael Morrison that they have a improvement, but they. Okay, we have a motion in a second. Oh, it's going to be a couple of weeks. Our elections and the things that come with that was just so proud to see the city. First of all, our parks and recreation got the library sped up and they said that it just had a lot extra work to help us get ready for our cleanup to city efforts this weekend. And so, Emily, thank you for all your people's help and stepping forward to get that done. We had a great turnout and it's always nice to see the city come together and participate in those kind of events. I had an opportunity in addition to the elections this week, attend water school, and I had no idea about that, but when I was told that it would be something that I would benefit from, I absolutely feel that was the best decision I've made in a while as to attend that. And our new associate, Bren and I sat there and we really took in a lot of things that was being presented to us. I think it's going to come in handy when some of our repurposing of some of the assets that we are working with and trying to make our city look better uh... we saw some really impressive things and this next Friday we have another full day so it's a two-fold day uh... presentation and it's just a great information that we received from that uh... i don't have anything else other than i'm just i'm ready for a good night sleep sleep and I'll be wanting to watch much of that game tonight. I've done it many times and all of us, it's a honor, but there is a lot of work that's involved and I just commend all of you that ran in the support that you got. Just looking forward to coming up this weekend, to Saturday will be a Easter celebration at the first extra church. And the, yeah, the ridge will be coming up this Thursday. So I'm just looking forward to everything, and thank you for everybody that's here. What were there? What were there real quick? the East Rack Hunt? Right, that's the East Rack Hunt. But that's the truth. I'm sorry, I didn't mean to pass it on you, but I didn't have it on you. So there's actually two East Rack Hunt going on. One of the churches is doing an East Rackvianza and then a lion's club is also hosting an Easter egg kind of lion's park. So the park's the park and it's not holding. Okay, so I just want to make it. There's already so many fun events going on. So we're going to let the church and the lion's club do theirs traditionally like they do. Perfect. I just want to tell you, is it, do we know the dates? I know the church is this weekend. Yes. The Lion's Club is the following weekend. Right, the fourth, the Easter. OK. Thank you. We know the dates. I know this the church is this weekend. I kind of had double-duty inside the shoes when the local literally football team had a camp for the kids. Saturday at the same time. So we had a really good show. There was about 50 kids who showed up. I also had a, when you come in, I don't know if you would, my answer in this, I kind of want to do discussion item, but I know it's better to get out and watch the games I didn't want. It's been too much time. But I spoke with one of the other city attorneys, I think Mr. Murphy, and he didn't have an objection to this. So I was just curious, this is just more of a discussion in the future. I know we can get this meeting, what's it along with it, but a lot of the meetings are long. So I was speaking with him, he didn't have an objection. I would like to potentially move the meeting to start at 6th instead of 7th. Just so we do have those land meetings, we can still get out of the distant hour and at 10-11 midnight. I'm not in the, I think, Jax working in the picture, but did you have any objection? Mike, can maybe start at 6 since you're going to be here in the future? No objection. I don't know if I have anybody else but to me that's kind of like a good idea. I thought that was better than maybe choosing a different day. That is purely a policy decision of the City Commission. He's adding the way here to serve. You know, I thought that'd be easier on everybody else. And I'm working from work coming from Lakeland, but I can make that. So you're putting that on a fan? Okay. Any particular reason you're in there? No. Okay. Anybody else's discussion? No. I'm's what we work, a lot of us work, but would you be able to make it both fits? It just varies. There are many times when it's difficult for with other things happening. It's just I think also for the residents who are coming in the meetings because the meetings aren't just about us. There are people who have to come home for work and get ready and maybe feed the family or whatever. I feel like six o'clock is a detriment to the public. I think that's how it stays all, then that would be great. Well, I'm personally on my family and I'm traveling. I don't see the problem at all. I would post a different day out of the ghetto, but we can talk about this at a different time. But I think the more for the residents, I think they'd have a trouble staying till 9 to 11 o'clock at night versus the Clank book In the past there's an injection in the city center in the Staff is staff is here to serve. It's a policy call most of us are here working on a agenda prep anyways So that's not really a consideration You know, I think wake wonder the county they do at 10 a.m. You know, so it's purely a policy decision. What I could do if there's an interest from the commission and always looking at it, what we've done in the past is kind of research. You know, where other cities far I can distribute that to an update and then if the commission wants to have a more formal discussion item going into May, we can put that on the agenda if that's satisfactory for tonight. Sure. That would definitely be in favor of doing that. Thank you. I'll do some research, perhaps on social media to find out what our residents would like to see. We could do a poll. Sure. And I was very careful of success in the world. We tried to do our best. And I think it was time for musical 25 years. We got two more meetings to get out of you. But now I will tell people that he is celebrating a birthday later this week. Yes, I'll be 94 years old. So we're going to get as much out of as we can these next two meetings and turn your loose. Okay. Probably got some things planned a bit. A family going to be grateful to have you back full time. All righty. And wrap it up here with Vice Mayor Daly. Thank you. I just want to congratulate everyone for a fair and con-election. Absolutely. I want to especially thank Linda, our city clerk clerk for her help with all of the different ins and outs and questions and it's a process. If you've never run for office and when you go to see Linda for the first time, I say, how I want to throw my hat in the ring. She handed you a book with this hat and it's got everything in it you need to know. I've seen people look at that and turn around and walk out and I'll come back. and then with all the other steps you have to go through and she would send out with money does and you know and not come back. So, and then with all the other steps you have to go through and she would send out with money, those and let us all know, make sure that we didn't cross the wrong tier back the wrong eye because it's a definite process that you have to do everything exactly by the book. I also wanted to shout out a thank you to Sherry Parker and Stephanie because they were like our little election cheerleaders. They were posted on social media and trying to get people to come on a vote. I mean, they were amazing. And they were trying to make the city understand that elections are important and the decisions that we make affect people's lives. And so they need to come out and cast a ballot and check out the different people who are running and see what they stand for. So, and with that, I also want to thank the other people who ran. I run for commission now about six times and I've always been at the polling place on Election Day. You know, this one was a little rough for me because of my shoulder accident and not being able to be here, but I want to appreciate everybody for voting for me. And also for helping me with my signs, putting them out and bringing them back. If you see any that are around, it's one of my pet peeves after election day when you see somebody sign. I saw one out on the country road that just I watched it deteriorate like like Frankenstein's monster over a whole year because nobody came and collected it. So, if you see any of my signs, please let me know so I can go get them and make sure that you know they don't get out polluting the area. And I don't know that that's all I have. As far as elections go, you know, when you get the people that are running for a position together and You can ask for a better group of people that are I think Everybody is wanting the same thing and that's just the best for this city and Nancy you were here Nancy. I'm not I'm not violating here for but Nancy was out here first thing that morning. And we put her signs out and we picked them up. I know several of us volunteered to get those picked up where I've got to pluck it for a little bit in my place. And you're right, I like to be out in the next day and I was out for about four hours. When they picked them up. And so I've got some of yours and I'll get them back to you for the next time you want to run. But no, it was a great opportunity again to represent the city and to welcome our new newest commissioner. My name is excited and proud of you for engaging and I want to tell you your family, thank you for the show up they all showed up his whole family showed up this weekend to help clean this city streets of flake outwards.
