So the narrow givesays at times did not run the third public hearing ad that should have been in the paper this past Friday, August 2nd and per statue, 45-24-53, the notice requirement for zoning ordinance amendments is three successive weeks prior to the hearing which did not happen with the August 2nd ad being missed. So with that we also will be pulling item N1 which is the first reading. Okay. Good evening, members of the council. Public, you have the seating in those of you at home. There's a few updates for this week and throughout the month. Some activity, a lot of it involving some of the staff and all good. Parks and Recreations had a few incidents. You may have heard of the one at the beginning of July, where about 9.30 p.m., a fight broke out in the Cabana area and beach security responded led by one of our security officers, Tim Clark. As Tim approached the area of the fight, an unidentified man came up to Tim and advised him that one of the youths involved in this was fighting had a gun. Tim approached the area of the fight, approached this individual, he observed the individual drop a handgun into the sand. Tim immediately went to step on the gun when the male subject picked up the gun and fled the scene. CSOs are unarmed. They're not law enforcement officers, but Tim takes his job point seriously. He alerted the police to the fleeing subject and that it may have had a gun and requested the dispatch assist. Tim and some of the CSOs attempted to capture the suspect, but subject and that it may have had a gun and requested the dispatch assist. Tim and some of the CSOs attempted to capture the suspect but he ran north to the area of the dunes. The PD responded and were able to locate the suspect and make the arrest. It turned out to be a pellet or a BB gun but certainly capable of doing harm and causing distress and injuring someone. It's interesting that Tim is a recent graduate of Salvea Virginia University having major administration and justice and he's seeking a career in law enforcement. Sounds a good choice to me. And someday if we have an opening, I will be applies. Back in July, Michelle had reported back that we had a significant rescue in a Gensitown Beach. A man was observed in severe distress. And a lifeguard captain, Anna LaCroy quickly acted and was able to bring the man to safety. The man had told him that he was caught in a bad rip current. And he had taken, basically taken his last breath when he was rescued. And he was very appreciative of Anna, Captain Anilokroy's response. Also Pox and Rex. Lifeguard games competitions started tonight at the Niagara Institute town beach at 6.45 and then and tomorrow and Wednesday at Roger Rillett, State Beach and Thursday at Newport 2nd Beach and Friday 1st Newport beach and Saturday at Scarborough Beach. The guides have been champs for 36 years and let's make it to 37 and I'd like to show a little appreciation for our lifeguards and Anna LaCroy and Tim Clark from Boxing Rex. Jim, could I ask your question to update certainly the roads with the loose stones people have been asking can you just give a some update I know Riverfront has stone on the streets and I think there are a few more what's the status of that just so the public knows I would be doing for a while it's it's it's an industry standard it increases the life of been doing it for a while. It's an industry standard. It increases the life of the roads. It's a smaller chip than was used previously. I haven't received any complaints on it. A couple of people mentioned it to me. But once it's put down and the other sealant that's put on it, it settles for a while, then they go back and they sweep it all up. And that's the system. It's no delay on it. I mean, we were hearing Labor Day is that correct for finishing those roads? After Labor Day, they'll start doing all the sweeping. It takes a while to settle with the heat and the traffic going over. We just encourage people to use common sense and drive 15 miles an hour on. It's a significant savings to the town and adds a significant life to roads that are not in deplorable condition. They just need some little lovin' tend to care. That's what DPW does to them. And we appreciate it. That end on that one? Yeah, that's correct. Thanks. Fight apartment. 31-year-old female was at the beach at Roger Williams. I mean, Roger Williams stayed beach over the weekend. And she had a medical incident. And the NFD responded along with DEM lifeguides and staff and some members of the public. The mother of the patient was impressed by both the DEM staff and the compassionate and professional response to her adorato, which is, she is fine now. She asked not to be identified, but she wanted me to publicly thank the members of the staff at St. O'Cove and also the compassionate and professional firefighters from the Eriganso Fire Department that assisted her daughter. And again, she stated she's fine now. The police department. I'm pleased to share with you the deneriganso police department has selected to receive the award of Crisis Intervention Team Department of the Year. Congratulations to them. The award notice read as it was addressed to Chief Corrigan, Red, to Chief Corrigan. We are thrilled but not surprised at all. You and your department have been leading in CIT field even before the Rhode Island program began in 2019. You exemplify everything we look for in a CIT department and have been a leading example for other departments across the state. The number of offices trained, the partnership with the Providence Center and Alley Turner, your network with surrounding communities, including South Kingston Police, and your track record of being a thoughtful leader, who always evolving and improving policies and practices. We had over 57 nominations for the award this year, including several for CIT Department of the Year. To the Nareganc Police Department and Chief Corrigan, they said thank you for being a leader in this work. And we all know how mental health is affected many communities and the police have a very different role in policing over the last few years. I want, you know, she does great work for the town, but I would wish that she can go to, speak to the North Kings town, Pox and Rec Director, Pox and Recreation Director, see who put that playground in. Also they have new candy cap beach mats which go all the way down to the water. I would also like to see that incorporated in our town beach. I spoke to Autumn Reigns, she says that she reached out to you guys, so hopefully you guys can look into that. I am asking for the town to stop it, to put on hold, it stopped for signage on Ocean Road. September 3rd is the next meeting. September 15th, those signs, I can be valid for a whole other year. So I spoke to the people who are running, 9 out of 10 candidates who are running our polls to signage. One's undecided. So obviously with the election forthcoming, I wish everyone the best, but if you aren't reelected, to me it's a full hearty for us to go through. I have to go up there and argue against the town council, the town councilist, town manager, they're paying me to do that, paying me. I'm much rather fighting proxy acted pale in our, where we don't have a hotel, where it's costing us hundreds of thousands of dollars in lost revenue by not having that hotel there. And look at what we have, we have an ice wall there, they're violating our town zoning and comprehensive plan and we're not fighting them. I'd be on board 100% to fight, I'd be on your team, but it pains me to go and fight against you trying to stop the sign. So please if you put that on hold the seasons all over so let's just say we're going to table it we'll wait to after the election and after the election if you guys want to pursue that if you all get elected then we can consider that but it's going to pain me to have to go down there again and have to present my case. So I hope and pray that we don't have the signage, because to me it's a money grab idea. I go down Memorial Square, Kingston Road, and the other area roads where they have two hour of them assigned, and you have Cospop bumper to bumper. We are not new poor, we are not provenants, we are not the Hamptons. As you said, Councillor President, you grew up in Patekut as an Polish young lady, a girl, your humble beginnings. So we have to keep that in mind. We have brothers and sisters, but if they want to save $10 or $15, let them do that. Let's face it, though. All of the restaurants on Ocean Road were against it. Catherine Celebrado, 48-year-olds club. Part two, who is funding the 4% budget increase? Think I've established it's not the commercial property owners. Only one category left, the residential property owners. So I've been trying to figure out who's absorbing this burden. I'll tell you right now, it's not the town council members. And maybe that's why you didn't pay attention to the numbers that was submitted. The average assessment increase among the town council is 42% and your average tax bill increases $65. Our tax bill increased $850. So I've tried to parse down who could be paying this. The historic properties in town, they have really get killed. Most of them have pretty much the assessments have gone almost up to 100% over last year. So they've doubled in other words. And then the rest of them, this is really difficult. But the student rental owners, who everybody wants to pay more because they're running businesses in residential zones, they're not. You know why? Because about 80% of the rentals are assessed at 700,000 or less. And since you lower the tax rate so much, none of them have experienced a tax bill increase. In fact, George Knownis, his tax bill for his four bedroom rental and Eastwood look is going down $28. And I've looked at a number of them. Greg Mattson, for example, I'm just picking up the ones that you know, keep yakkin. Greg Mattson, he owns nine rentals. Remember, Greg Mattson, first three student, ordinance hearing, he limped up to the podium. He had a huge bandage on his head. He looked like he had just come from a bar fight. Anyway, he owns nine rentals. And across those nine rentals, the average tax bill increases $150. So the goal I thought was to kind of shift some of this burden onto the rental owners who are Using their houses as businesses, but that's not what happened I will say that the peer I think really good hit and I didn't realize that until People started telling me about their increases. I have a neighbor has a two bedroom one bath cape It's on a crawl space. The house is like 900 square feet. She's assessed at $765,000. And so it seems that the peer is absorbing a lot of the increases. And then I can go on, but there's tipping points, if you've got a home set exemption or not, and the amount of assessment. But bottom line is, I think the residents are solving too much of this increase and it's not fair across the board either. Thank you. Thank you. Anyone else? All right. You know what are hands? So moved. Second. Okay any discussion from the council? Yes, I will. Okay, just let me introduce the item just to give some background because this has been on here and pulled so. So this came before the sewer policy committee which Stephen I Councillor for Andy and I are members of. It did pass to zero. So it came before the council. There was some additional information that was requested. And it was pulled. So the information we had received. And so I was satisfied with all the information that was requested. All right, Councilor Farandhi, would you like to say something? Yeah, thank you, Eva. I just wanted to go over, a lot of people don't really understand the sewer policy, the current sewer policy, and the wave of them. What I try to do since I've been on that is really kind of dig into what's happening here with who gets the sewer, who doesn't, what other parameters and that kind of dig into what's happening here with, you know, who gets the sewer, who doesn't, what other parameters and that kind of things. So initially we were going to heard this application. It was a two bedroom home and it was a two bedroom septic. Now, and I asked Wayne if, especially if it's on a septic system because, you know, we don't know if it could verify exactly what was in the property. So come to find out it ended up being a five bedroom property. So somewhere along the line, bedrooms are added. That's what happens a lot of times. And in the meantime, this would be granting eight or nine other properties property's sewer extensions also. Because I guess the way I have to configure it has to go through properties that don't have a sewer right now. Some may have a complete septic. So what I asked Wayne to do is see if we get in the house to find out and it finds out that there are five rooms in the property, but the owner is claiming it's there's only a two bedroom home. So I believe he did some background work on when the building permits were taking out and there was no other bed, there was no bedroom permits taking out, taking out for this property since its inception there's only one permit taking out in 1977 and that was for a deck. So somehow these magically appear. I think the owner's had us since 1998. He wasn't sure how many really legally were or not. The bottom line is that, you know, I just think the town and I thank them for doing this. I don't know how much diligence it would be done, been done with these before, but this is serviced by the West Mall and Plant, which is basically at the 84, 85% capacity. So because of the delay, I guess, and maybe some of the rain we've had, we're now over the capacity of 85%, we've exceeded it the last several months, the 85.1. So we're right there. But that requires an additional waiver to the sewer policy. So I'm just trying to look at it. And I think the town should kind of look at it as just to do as much diligence as they can is to find out, especially if there was an initial septic system. Because a lot of times what happens is the applicant will ask, well, my sector system just failed. I need a sewer. So it's a little more than it involved in it. And I've been working with John a little bit to kind of look at some of the elements of it. And maybe some of it needs to be adjusted. So this one's kind of now just precipitated another sewer waiver, section 7-8, because we're over the 85%. I believe the owner wants to tear down the house is what his plans are. I know he has other property close by, I believe. I think you said not that you have to engage. But so, you know, I guess in that capacity, you know, it probably would be better because he could only put maybe a two bedroom septic in there, replace it. So I just wanted to bring that information. It's just not quite as straightforward as a normal one. And I did vote against it originally. We did pass it to second time until we did another, you know, look at it. So just sort of council has all the information about this particular one and the ramifications of nine other properties were already at the 25, 85%. Some of which have an existing septic system in working order. So, you know, another issue is I think people really feel that, you know, if it's septic system, it's bad and everything else, you know, that's not, it's a little bit of a misnomer. Perfectly working septic system, there's nothing wrong with it if it's engineered correctly. This one's a little different, you know, maybe it was overloaded, maybe it wasn't, it really couldn't be fixed. So with precipitation of knocking it down, you know, it might make a little, maybe make a little bit more sense, but it's still going to be over 85% threshold at this point. Thank you. Okay, thanks. Yeah, so I thought it meant the immacere policy. That's why we have that buffer. And I think it's fine. I don't know if any other council members have any issues or questions about it. So, Steve, are you saying that you'd like the sewer policy committee to maybe look at the policy itself and maybe make some suggestions not about the specific property but about future? Yeah, I mean, it's a little bit convoluted, but it's just it's probably about 15 pages So it takes some work to look at to see what might not meet the reason your answer It has changed over the years it used to be you couldn't go more than 200 feet was bump up to 500 feet and lowered So it's good in the way it has a lot of legacy of all the sewer systems that would add it on before So there's some real positive things or just you know, just just to simplify it or dig into it and maybe see the results. So you're satisfied with the responses you received your questions. Yes. So you're OK with the property. But you're going forward. You want to take a look at the policy itself and simplify it. Let me do that. I can't really point here. I'm a little confused. So this house is it too better than five better? It's units does too. So they are. So Mr. Pimentel inspected it, and there was a email correspondence which was, you know, it answered the question. And I'll just read it just so that you have the background information too. So on June 12th, you know, Mr. Pimentel met with Mr. Urban on site at his home and his spouse, they did purchase the home in 1998 and the original owner, as we mentioned, added three bedrooms to an original two bedroom that he purchased in 1970 without any permits. And then again, in 1989 and so that was added before 1998, before Mr. Urban and Miss Task purchased the home. So it's currently being used as a two bedroom and it's in compliance with the original proofs to bedroom septic system. Again, the septic system failed. It's part of what the sewer policy allows us to give the waiver. And there is that buffer. It had to be added because we had all the rain. And so now it's 85.1. And it's the 85%. So again, we've had to pull it a couple times and to get more information. I think we could move forward and work on the sewer policy in the future. But for me, I felt that this was being on the sewer policy in the future, but for me, I felt that this was, you know, being on the sewer policy committee, I was fine with it. I understand that. My, so, do I also understand that this also opens up the possibility that other homes would have access to the sewer system as well, even though we're at the 85%. So if anybody, any of the other homeowners wanted to use it, they would have to get a waiver as well, correct? They would have to come before and get the waiver. And there's, so the issue of the two versus the five bedrooms isn't really relevant for the sewer piece. It was for the septic system. Right. So I mean, I guess my question is, where do we cut off? I mean, we have a cut off and it's 85% and I Assumed there's a good reason for that. So their request was before we had like, you know, that next period was, you know, the April I think we had all the rain so it just bumped it up But it was when they were originally requesting it and then we were asking for all the information, it was below that. So that's kind of where it's like now it's like, you know, 0.1%. But okay, so if one or two or three of these other homeowners came forward and said they would like that waiver also, how would we proceed? So if we would hear at the, it would be referred to the sewer policy committee and then we would have to make that decision, if it's, you know, especially if it keeps on going up, whether or not we do. But we're setting a precedent here. Yeah. So that's a concern. OK. Any other questions? I believe the government has a hand up from the audience, Miss Elberto., I'm not going to the public yet. Does any other, any other questions or concerns from, from the Council members? And from the public, Miss Elberto, 48-year-old's court. You don't see like a hundred different things wrong with this. In the first place, that lot perked for two bedroom for a reason. And then somebody added another three bedrooms. So they were using five bedrooms. He caused the septic system to fail by his own use of the property, misuse of the property really. And I didn't see anywhere on any of the paperwork where he called, like, Brick, well he has breaks, to determine if a new septic system could be put. There's all kinds of septic systems out there now, you know. And you can pretty much perk any lot and put a septic system in, but I don't see where he tried to do that. Also, this capacity thing at the West Mall Implant, right now, Narragansett, we have used all of our capacity. We're buying capacity from South Kingston, URI. So the taxpayers are paying to buy capacity, because we're overloading the thing, right? So I mean, this nonsense that is only 85%, we've used up our share already. But this is absurd. Now, another nine people are going to hook in. Really? There are so many places in town that need to hook into the sewers. And you're just whittling down 10 here, 10 there. We call it Bonnishaws, hooked in, remember that? Their whole beach club and everything hooked into our sewer system. You can't keep doing this. You're just preventing plants that need to hook in. You're preventing it, like Harbor Island. There are other sections in town that need to hook into the sewer system. And this is a egregious, really. He misused his property. He had illegal bedrooms. He caused a septic system to fail. And he has not tried to put one of those new fangled septics in. So I would say absolutely not. Thank you. And there's no way to somehow limit this to just that house as opposed to now that it has, you know, it has, there are other houses that can be added on. That's what the summary report, the staff report, indicates in there how many houses, depending on which way they go, there's two different routes they could take, but they'll probably take it straight down. One street, it's eight or nine houses, but by ordinance, once you have the sewers in front of your house, you have access. So some of these people, they won't, they won't connect right away, because they may not want to pay But the property owner has the ability for a ten-year cost recovery to to recoup his money back From the construction of that will do a cost analysis to see how much it is per lateral And do that but it's just that the way the the ordinance is is that you have if you have so-called house you have access and Accessibility so the waiver is waiver is to grant the extension. And the waivers are needed because we can't approve things at the staff level, whether it's that light that is extension or the element. But the ordinance could be modified, right? At some point in time, which is what Steve wants to do. Yeah, that's some point. So, okay, so that makes sense to me. And effectively we're between a rock and a hard place here. Is that right? In regards to this gentleman who has a two bedroom, I mean when he put the silver in can you make a six bedroom, seven bedroom, eight bedroom there? I mean we're talking about having control over these people, we have the bulk zoning markets. talking about having control over these people, we have the bulk zoning ordinance. So if it was a two-bedroom property, then it should stay a two-bedroom property. That's why we had the whole purpose of the bulk zoning. So we don't want to have these two or three-bedroom houses become many mansions, especially, you know, it's just against the characteristics of the neighborhood. They want to build a mansion by a plot on Ocean Road. But if all the other properties aren't there, two or three bedrooms, don't have this guy put up a five or six bedroom. Thank you. This is first to waiver, so it's not bedroom side still. Any other quick question for Mr. Tierney? Should this be granted, this way be granted? Does this eliminate the bulk zoning ordinance or would they still have to apply to the bulk zoning and follow all the zoning rules. That would be a legal question. Mark you have any input on that?
