All right. Good evening, everyone. Good evening. We will call the order the regular East City Council meeting Tuesday, April 22nd at 630 PM. If you would all rise for the invocation of the pledge will lead to please. Dearly Father, we are so grateful that we may be here at the same age to conduct the city's business. We thank you for your time, Jesus Christ. I don't know. I don't know. Dearly Father, we are so grateful that we can be here at the same age to conduct the city's business. We thank you for your son, Jesus Christ, and I hope across your salvation. We ask that you give us and grant us divine wisdom tonight, the sense that we can make, the sense of the interests of all of the community, the citizens, the farmers, and the surrounding area which he touches and affects every day. We ask that you bless us as we leave the same name go also to the same name. Can I say these things that may be your son Jesus Christ, we may never keep up. I pledge allegiance to the flag of the United States of America and to the Republic for which your stands, my nation, under God, and the visible, with liberty and justice for all. Right. Thank you, Councilor. Moving into agenda item number two, this is our public comment section. Miss Adele. We have one speaker signed up, Mr. Laura Lichten. Good. Mr. Lty, if you take the lectern, state your name and address. Yes, please. Hello. I am Lauren Lickty. I live at 502 Teri Lane. And I've been a resident of Heath for 39 years. I've been involved in city government for 20 of those years from 1996 to 2016. And I just came here tonight to say thank you to this council for a service and especially to the three council members who will not be returning after May 3rd. Miss Coldwell, Mr. Rufo, and Mr. Weaver. While I made out of how I was agreed with all of your decisions, I know how hard this job is and how much you care about our city in order to spend the time that you've spent. I know that you've struggled with and worried about the decisions you've made. I know that you have missed family events taking time from your work and business ventures and spent countless hours here at 200 Lawrence Drive when you could have been enjoying time in our beautiful city and much nicer places like your yards at social events or with your neighbors. I want to tell you that all the time, what's worth it? Because you're working to help build this beautiful city of ours, the greatest city in the greatest county, in the greatest state, in the greatest nation on God's green earth. I wanted to let you know that your fellow humans appreciate it. Thank you. Thank you. All right. No one else, Mr. Dome? Yes, sir. All right. Very well. Moving into agenda item number three. This is our city manager comments and council comments. If you would. I do have a few announcements tonight tonight It's been a busy time around here Tonight is episode two of the heat city council live stream We explained the last week that we were displaying the screen to those who were streaming And tonight and moving forward for future meetings will be streaming live action in the room using that camera right over the doorway to the hall. So from this point forward, that's how it will be displayed for the public who are streaming remotely. If you are streaming remotely, the agenda for tonight's meeting and the live stream link for future meetings are on our website at heathtx.com under the government tab. The heart of the Heath 5K just happened last Saturday and it was a smashing success. We're super grateful to everybody who helped with this event. It was both a 5K and a family fun run. It was a safe event and a success for over 464 participants. The team that pulled this off includes our special events board and volunteers, our sponsors, the Heath Department of Public Safety, the Department of Public Works, and community development staff members, and members of the Rockwall County Sheriff's Office and Cert. With the severe weather threats that were in play that weekend and new temporary location and route there were certainly some significant challenges to overcome and navigate but as always everybody worked together really well and pulled off another great beloved Easter Saturday tradition for Heath. Early voting is underway. It started today right here in City Hall in the community room right over there. The hours for early voting are eight to five tomorrow through Friday, 10 to three on Saturday, closed on Sunday, seven to seven next Monday and Tuesday, and then of course Saturday, May 3rd is election day and voting will be open from 7 to 7 a day. We're excited to announce that our very own Heath Golf and Yacht Club has been selected as one of the 100 golf courses in America to host the first stage qualifying side for the US Open. This event will be held in May on May 12th right here in Heath and will include some names you might recognize like Tony Romo, Sean O'Hare, and Bryce Reclink among others. You all see follow-up golf, you know, the DSU open as one of the four prestigious major championships and it's pretty cool to have an element of that happening right here on May 12th. The last two announcements are that tomorrow is administrative professional stay. And we certainly want to acknowledge and appreciate the hard work of our staff administrative professionals. They include Kristi Smith in the City Manager's office, Tiffany Ramirez in the Public Works Department and Katie Poteet and Shirley Otto can the DPS end of the building. And finally, National City Secretaries Week not to be left out. Miss Norma wanted to make sure that everybody knew and paid a lot of attention to her for City Secretaries Week coming up the week of May 5th. We are obviously tremendously blessed to have Norma Duncan as our City Secretary. She's been in that seat for over 10 years, right? 12 years. Yeah. And now she has brought on our Deputy City Secretary Logan Petty and is training her up because Norman insists that she wants to retire. That's it for me. Very good. Thank you and Councilman for this time. Do you have any comments? I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I would say that it's been some time to tell. Yeah. And I would echo that. Thank you, Council Members. For your hard work and your dedication, I can tell you it wasn't until I sat here on this day of event to realize how hard you guys were to do. So thank you very much. I appreciate everything that you guys have done sacrifices that this council makes for the city. So thank you very much appreciate everything that you guys have done and the sacrifices that That this council makes for the city So thank you very much. All right moving into it Folks and have some questions that I couldn't answer that I think we should be all prepared to answer Not that we don't appreciate the path to point out but They couldn't find the board members list on the website which I couldn't either. How was it created? What's the goals? What's the financial budget staff support? Was it for the city charter? Did the city council vote on it? I don't remember voting on it. What does it mean? What are the meaning of Genes of minutes? Who determine the number of members? What the terms and term limits are? Where were the volunteer opportunities posted? Who was interviewed when, by who, and what criteria? So I think we should be all prepared to answer that. Should it constitute as normal affordance to you? So you know, it's all right. And it's a steering committee, not a board, but it will be a unique answer to yourness. But I'm just giving clarity and needs to know. I am giving clarity. Thank you, sir. All right. At this time, we'll move into our agenda item number four. That's our consent agenda. So this is sport on eight discussion. actually regarding the minutes of April 15th, 2025. That's a regular meeting. So, I believe everybody is at time to look over the consent agenda. So the chair will move over to the floor to entertain a motion. Make a motion we approve. Okay, motion to approve by Councilor Crouse. Do we have a second? second. Go second. My accounts are pretty full. So the most true is all of those in favor say on. I, as opposed So the most true. So all of those in favor say hi. Hi. Those are both the best. So you can honestly thank the councilman for the old. I'm saying it was absolutely. We're going to have everyone who is meeting the council member and understanding. Thank you. Okay, moving into agenda item number five. This is items for individual consideration 5.8pp202501, discussing considered a request from Carol Consultinger. On behalf of the other three gen contract for the approval of a voluntary plan for a proposed residential development containing 10 single family lots. and being on 14.614 acre track of land situated in the Antonio Rodriguez Survey, abstract number 2, 3, 1, city of Heathrow, all time. 14.614, the acre-track plan situated in the Antonio Rodriguez survey. Abstract number 231, city of Heath, rural, rural, rural, rural, Texas, and so on for PDSF, plan development, district land use is located on the southeast side of FM 549 and across from the Weissamellee. Mr. Consonz, thank you Mayor for the end. Good evening, I'm here with the council. This particular track, you're probably familiar with this. You saw this last year, it was approved in October from the Resum, from the TAC District 2, the plan development district, essentially, what they have been requesting here, is to approve the approval of a preliminary plan. The concept plan, which was reviewed during the zoning process, showed the 10 watts that were approved at this point, and showing you some additional items here as far as the street trees that they were planning on putting in, as well as a 10-foot trail system that runs across along the property out here. There is a trail system that is across the street also for these residents to be able to enjoy. And part of the plan development that establishes you for density dimensional requirements And I'm going what we do for each measure, for standards, for this development. And that's what this represents. This is NSF 43. For these ones, they all exceed the one acre minimum of the available. And so they check out all these boxes for the, for the, what's for the matrix here. This right here represents their tree scape plan. And what you'll see on the tree scape plan is they are removing 40 trees for the development, but also at the same time, that comes to comes to three hundred and four inches, at the same time, you know, for mitigation to, to want to equal that out. They're planting 93 trees, and the 93 trees are the ones that you see here in the, in the red, that are large trees and medium sized trees. These will meet the, take the Swarvescape, uh come through to planting those. But also, they're showing the perimeter trees are going to remain. These are not going to be removed. There are some 900 plus, that are 992 inches. They're going to remain on the problem. There's some along over here. So the person on this particular lot will have the additional trees on this one as well. And so with that being said, they are knitting the mitigation to the zero. And so they do meet the requirements for the tree's cake plant. When you take a look at the preliminary flat, once again, the smearers up with the two-concept plan showing you the layout for the 10-lots, for the 13-header and 50-foot roadway that's coming in here with a cul-de-sac, and they do have the intermediate turn around here, the 600 feet, medium, far-on, torments as well. They do have access to water and sewer from one thing that you take a look at through the preliminary flat process, which the adequate facilities are available. And so those are available in the area for the adequate to, to tap into those facilities. With that 10 units, we do have the in-aloo with land a dedication and also part moment fees. They're associated with this project. 10 allots come to $35,000, $1.00 and $0.30. That would be due at the time of final plant and that would go into the park park fund. Plays on did take two of this on April 1st and they did act on request and they are for a recommendation of approval staff, recommendations are first a law, a plan is a ministerial function and so the Here tonight we will be to either prove approved with conditions or to deny with a specific condition as well with that I'm available for any questions you may have and I believe you have this for here as well. Okay, any questions to be made? All right, thank you, Mr. Goons. All right, so this time council, do you have any questions for staff? Councilor Dodson. Councilor Dodson. So, it looks like they satisfy the trails piece, but I didn't see it today on the chart later. Traffic in time. Is that, is it, is it, is it, is it, is it, is it, is it, is it, is it, is it, is it, is it, It's up to 549. Gelskiy and Dides, if you make sure you find the poll to answer, thanks. Thank you. Yes, the turn to the turning can tell, off to 549. I don't know if that's a pretty question of the zoning. But the name, a TIA or a traffic study is not a bit of a disadvantage to this plan application. It is one plan before this. I think I would like to add a problem. question for water. This has a pond on it, I believe. And when this last came from a council, there was some discussion around being able to maybe use that as a retention pond or maybe use a purple pipe to satisfy the at least the irrigation requirements of these homes, but I didn't see that in this plant. Was that considered? I'm not sure about the reason I'm from Italy, I'm not sure about that. I have to say that was one of the things that was discussed last time. the Right I think the rest of my questions are for the applicant except for the residents contacted or for this plan. I know they were contacted prior to this when this came in front of Council. Were they contacted this time? Or is it only necessary to contact the residents at the time of the prayer purport? Yeah, it's done. So many is what we actually sent out. Notions and counter-acquired with by Stone's book. So many look for a plan. It's done. It's done. No, the case right over for me. Okay, thank you. Thank you. So, I think that's it. So, I think that's it. At the right hand side, I think it's changed. The public and public spaces, which are from the days of time, the public level, and the public is at that point, six acres. The public and public are at the right, and the public is at that point, and the public is at that point, and the public is at that point, and the public is at that point, and then the next one is for the six, and the one is for the eight, and the first one is for the seven, and the first one is for the eight, and the first one is for the eight, and the first one is for the eight, and the first one is for the eight, and the first one is for the eight, and the first one is for the eight, and the first one is for the eight, and the first one is for the eight, So, I think that the two are all the same. The other two are the same. The other two are the same. The other two are the same. The other two are the same. The other two are the same. The other two are the same. The other two are the same. The other two are the same. The other two are the same. The other two are the same. The other two are the same. The other two are the same. So, the next corporation documentation was accurate. The protection in 1.48 hours, the open space of 0.6 acres, the open space of 2.3. Okay, the number is right to the end of the business table and the first one. I'm going to start with the first one. I'm going to start with the first one. I'm going to start with the first one. So we are'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm sorry, I'm going to check in on that and verify the mixture there to complete the correct envelope to be done at the time. It just will be possible to complete the mixture. I'm going to check in on that and verify the mixture that they're completely correct. To be able to get them in time. It just will be possible for each vessel. Check it out there. So the students on this were referencing the line item 8 and line item 11. So you have landscape areas that are served open space to be retained. And then you also have public and private open space speakers. That's what it's referencing as it pertains to what it's identifying on the planet. Okay, if any other questions for South, I got a new question for South. I do hope my staff will say, yeah, I would like to say that I confer with Scott Dodd's and other traffic sign internally. There's an item there, page six, that they recommend you name name change. What was every feedback on the name change to be considered? So divisions had this. I'm sorry I did not hear your point name change. The staff recommended a name change. Board Commission comments, the commission also recommended that they can another street name since there are no streets and number four So, if you consider changing the name on that, as far as staff, it's going to turn out, we don't have an issue that you can name and street, which you like. We don't have a check number 911. Make sure they're okay with that. That's something that the applicant can take. Consider changing them. Okay, so you just ask me, I don't know if any of your response. If not, we're seeing the report. We can ask the government. And that's that recommendation. The staff recommends conditional approval of the preliminary flat is indicated in this report. So to underscore what the conditions are identified. That is from the condition of the PN2. The two conditions that they did make that happen to the either but being initial so I'm not sure for sure. Okay, thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you neither a nor. I don't see either of them being initials on that shirt, for sure. Okay, I can't. It says select only one of the following options, and I don't see either of them. Select. I'm going to get you a little bit more. I'm going to get you a little bit more. I'm going to get you a little bit more. I'm going to get you a little bit more. I'm going to get you a little bit more. I'm going to get you a little bit more. I'm going to get you a little bit more. I'm going to get you a little bit more. I'm going to get I'll be there. So it wasn't completed. And then it did go to the end date. Is that a... Is that concern? I don't see it as a concern, the principal of the area planned. And so I don't see it as a concern to, with all the moving forward with it, how to add anything that was. If the data is on any of the floor. No, they moved it through. We've met the statutory timeline, the shop clock requirements. It was skid, the front date that we received it to the Planning and Zoning Commission hearing date was within the shop clock. The purpose of the second checkbox on here, excuse me, the first checkbox on here is to, for the applicant to give the city the permission to delay putting it forward to PNC if it it's now considered a complete application, or if there are still issues to be resolved to person. So the top section isn't out, doesn't apply to this case. Okay. So you just have the initial, the second. So then on page 16, item 13, request for cold as sack variance approved. We've approved the variance on this already. That was for the trial round for the general assembly process. So what's that sort of variance? So then 15 graduation census NA, no front at 50 foot, J wing side entry front facing CPAC 75 foot. So we're going to have to do that. So we're going to have to do that. So we're going to have to do that. So we're going to have to do that. So then 15 graduation census NA, no front at 50 foot foot J wing side entry front facing setback 75 foot. So we're gonna have some front Facing grudges, but there going to have to do that. So, I think that's a good question. I think that's a good question. I think that's a good question. I think that's a good question. I think that's a good question. I think that's a good question. add that to our board and feature board and service request. Good. The other is we trust, we trust the service, which I think that's it. I hope next time you're good. If you have any other questions for staff, very much. I'm trying to do a step in the switch. I think that's it. So I hope next Thursday you're good. You can also do the other questions for staff. Very well, thank you, Mr. Kuzal, it's time for the app to come forward to the left. Then we'll begin the questions there. You can stay in your name, in your address, please. Pressing Phillips, my home address, your six and. It may take some time. Thank you. At this time, do we have questions for the other Council? No, it's not. Do you have a few? I'd like for a day. Turn away or a traffic impact study. To me, conduct an illness with two states here. We have an emergency state of which 549 is just two planes. We have a future state of 549's expanded. We're in some clear demand to four wings that should consider making both of those pieces of their wings. So I'd like to, you know, I'd like for that to be the one for this piece. The other piece was with regards to the water. to again, when you at all appear here before, there seem to be some energy around utilizing the pump systems that you have, and maybe even from a irrigation standpoint, and then just to help offset some of the burn that are in systems currently under. And take a look at the vulnerability of that and some part of this development. I mean, can you talk about the types of the size of holes that you're contemplating putting in this development? I think that was all on the concept plan before we got involved in the project. I think they have a whole package showing the chances, pictures, everything. So I don't know. I think it looks pretty good for the first. So I'm going to start with one of those. Okay. Did they come around from ASP as well? Every cell in place. Does their target have any information? Okay. Okay. And are you looking at one builder or multiple builders for this? I will leave one builder for one builder for the same thing. Okay. And do we have examples of properties, structures that they build for one, and we can find them? Okay. I'm going to show pictures of the concept, some of the other concepts of the video. And then I'm going to show you the concept, some middle, some middle, and then they pack up their plots and pictures and stuff there. I guess I don't know if they build. So 3GM contractor George Walsh, who is the second tool. So it's a well-chist belt, many homes within the city of Canterbury. Thank you. And I believe that the reference would be, originally, just a... Melchem, okay. Thank you for that. So, again, you know, white two areas of follow-up are familiar with the term, like the traffic impact and the utilization of the local water for irrigation purposes in that development. Thank you. Thank you. Thank you. There you go. Council member, please. Council member, Council member, Council member, Council member, Council member, Council member, Council member, I have a quick question. My recollection is that structure that's out from the double list home. And I believe I saw that in the book. There's no... Oh, is it gone now? That's what I had to look at. No, thanks. Okay. I'm handling the pirate track to my question. I guess he was no one when we surveyed and got started on it. So, for the planning, that was stupid. Okay. I have a question. As far as your water system in this has in here that there are multiple water surface lines that the applicants engineer has available for the site. Do you know if this is going to be a blue system or is it going to be a dead end system? I believe on the beach on the fence, we have water content and it ties in and has a good flush. or is it going to be a dead end system? I believe on the detail that we have the water comes in and it ties in and it has a kind of flush that I'm tied to the sanitary sewer. This is what the next one is going to show on the free state confessions. Okay, maybe an engineering question, because I asked the engineering last time he was here and he stated at that time that they were looking at the end of the coal attack to go out and reconnect and that is my concern to make for sure that it is a blue system and it is not a jet in the system. Thanks for your time. So, I have one set of points required. You can be able to solve some problem that you can't solve. So, you know, from five to nine, back to five, from nine, or comes out to a potential problem. So, I'm going to point it one wrong, and then you're probably going to solve some problems. That's correct. From a normal employer, you guys really Very good. So on page 15, F2, this is staff comments. 1-6-1-6-1-6-1-6-1-6-1-6-1-6 directly into the sanitary manifold with the code to say, that's what was asked for a station on your. That's how to go to bed. It's more work that you read that. Now you can't get your time to sleep in the 15th. I know. 5. 5. E.F. Yeah, I know. Right now. 3. 4. 5. Thanks for reminding me that. Thanks for the test. I would not advise that I don't know what the rules are, that Richard goes by, that he would allow that, but I would caution and try to eliminate, not allow those in the future. I'm sorry, I'm sorry. I'm sorry, I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. I'm sorry. those in the future. There was no further discussion. We're in at length. We're in at length. We're in at length. We're in at length. We're in at length. We're in at length. We're in at length. We're in at length. We're in at length. We're in at length. We're in're going to have to have an agreement with the back end, they were to get an easement to be able to connect. That's very hard to do. But that was the caution and the concern. And the engineer said he was working on that. But according to what that said, I guess they couldn't get that to happen. So I'm gonna think about, is the concerned stagnation of water going? It's just an additional cost to the city and Mr. Creak, to speak to this, that they have to put it in a rotation to flush it so many times. And the city has, you, 61 of these dead end loops and you need us, you want to stop from developing to where your force is that because it just adds extra cost and maintenance when you're doing it needs to be a loop system and we should not allow anything other. It doesn't sound very water-consuming either if you have a deflection. It is not. So what's the discussion I was having before? The note after the F-tyatologist and it just, what information is that given? It's going to be a dead look. Dead end, which is correct. What does that have to do with the dead? Anyone out there? There would be for staff. I'm going to turn it on. David, you know, some day I was in a conference. I'm going to be answering your question. Any comments that you see in here where they advocate as Andrew, stamps of comments, that means that they have no attitude to make sure that they meet that requirement. So they will meet that requirement in time of the bill. The participant is not the requirement. We don't want this. We don't want it this. So, okay, so this is the department. So that department needs to be the trust that we're talking about the food time. And we're saying this is not a look-on, right? That's what that looks like, and making that. So, I believe that would have been picture of the engineering corporation. But that is built that we are looking at online at that time. So that would be a denial, a denial or a conditionally significant tangent to the town. For the attention, it could be a conditionally significant. And it should be a relationship that relies on having to give an easement to different programs. Great. Thank you. Councillor Anya, other questions? Very well. Thank you. All right. At this time, we'll open up into some discussion. Councillor. Well, I think what we need to make the motion for the discussion about the data and what the general public is and the virtual ideas that are not clear and that are going to be the first to be able to stick in with this project and to be interested in the analytics of the data, and be considered as well as a preventive tool. We create the best outcome for the end of this business. This is a good subject that we're going to have to contort it in the end of the year today. And I think we 20% of the lots of work are in the acre half and size. So we'll close another 10% for the acreage We're going to be a couple of examples of what we're going to do. We're going to have a couple of examples of what we're going to do. We're going to have a couple of examples of what we're going to do. We're going to have a couple of examples of what we're going to do. points, if you have a clean assistant. So for the education, that was coming from 15 to 15 here. They can also support this. So I'm going to provide them with some extra information about the area they're just going to work on. and the BLA, the screen and the whole system, the possibility of the project to re-bank and add a new system and production all of form. Yeah, stop. Yeah, I'll let you see that in the back. I'll take care. I'll take care of the other kind of form. and fall into the ice, so it's only 100% fall. Yeah, stop. Yeah, and I like to see that coming back. Okay, okay. Okay, as well as traffic, please. Okay, so there are three items, and things one I heard. And so, yeah, the piece on the envelope, the traffic and the water exploration for birds to's to deer, gaseous properties of the sister and horse wing. And for against the disguise, and complete an advocacy. Right, so forth. Very good. Any other items of discussion? All right, at this time time the chair will open the floor to entertain a motion. So I guess we'll talk to you before we make an opportunity to give you an introduction to all those I'm going to slide over this. I'm going to slide over this. I'm going to slide over this. I'm going to slide over this. I'm going to slide over this. I'm going to slide over this. I'm going to slide over this. I'm going to slide over this. I'm going to slide over this. I'm going to slide over this. I'm going to slide over this. I'm going to slide over this. I would support that conditional approval, but these items will have to come back in front of us. There's a timeline. I think associated with the projectly and the traffic study. Oh, and I think probably's a timeline. I think associated with particularly the traffic study. And I think probably the engineering working on the actual water piece itself. So, so maybe this is a preliminary plan before us tonight. You know, there's a commercial. Yeah, it's a key. So you, and then what Councilman's talking about, coming back in front of you, it's gonna come back in front of you to file a flat. For sure, an answer is gonna be filed to the left and the deep records, and who knows what all of the conditions are. You can't condition a printer. I don't know if the timeline is tabling it, but it's in the shot clock. So, really, you should take action on it tonight. Yeah, one moment or another, so to your point, we're gonna have to go through a couple of moments, and at least from my perspective, conditionally perfect those items, you know, rich and a point, tensed out right and a point at 12, so that's something that I'm not going to do. We've got two more items, the right one, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it, to run it concentration for age traveling, for the marine and investigate and provide information to the council regarding the potential years of of Onside water for irrigation. We're going to put on and air potential spring and air system. We're going to put on the water for the water, the water for the domestic water, be it a possessive, not a flush, but an influx system. I think we're good. We have a motion on the floor. And stated, do we have a second? Wait a second, my councilor, will you call it, whoa. So the motion moves. All those who favor say, I like those opposed. As the same answer, thank you, councilor. We'll be in touch in item five dot to be. This is an item that was said, known as to the general public public hearing, and to be considered however, planning and zoning commission is not in shooting recommendation on this item. That's just due to timing requirements with the state to actually send out those notifications and the PNC had a meeting and the news table. So that's why we still have to keep it on the agenda, but we cannot take action on this item this evening. So at this time we are going to need to table this item. So I make a motion to table 5.B to the next counts meeting. It's like a second. We have a second by Councilman Krause. Before we follow, I have to make sure one comment please. In the end, I think we're sitting in this, this slide has been formed. I think they have to be able to put my feedback in. It's a big, big, big, a local conversion development could be, like I told you, the packet, the computing and the documentation, and not the design standards for the structure of some of the sub-company, or a conversion development that's really useful. And by my level, I'll't know if we're going to act on this today, or just, I think it's probably a bit of a thing because we've got to be able to be able to get some control over the specific design standards as part of the PD and some of the additional functions and giving us some problems that we need to be I'm going to tell way, I would recommend suggesting to the applicant to be adopt the tell us properly. Does that explain to you? It would be a highly ideal. Yes, those exact things have been communicated to the applicant. Thank you. Thank you. Thank you. Thank you. I love an acre. A strip of triumph by the cross-strike. I'm going to have a bunch of good, good, good, good. Yep. Yep. Okay. All right. Very good. So we have a motion and we have a second. Any other discussion? All right. I said the motion moves all those different. Those are both the best. If you need some of the things you can tell us. Looking into agenda item five, not seeing this is the same circumstance. So this has been an item that's been that's been table with P and C and again it's a timing thing. So we cannot take action tonight. So I will make a motion to table five dot C. We have a second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second. Second.C. Do we have a second? Wait a second, my cows will refer to any discussion. Good. Any further questions? So we can look over to the next slide. So we have the information online that is for the candidate. Is that correct? That is the applicant, yes. Okay. Is the applicant pertaining to that, and the request for the department of technical development, what is the status of their building construction? I'm not even been presented yet to the ARB that will be the first step that would be process. Okay, so that's the whole process. We're going to talk about what we're going to do. Yes, for sure. Yes, okay. Thank you, talk to you. step that would be a process. Yes, yes. Yes, for sure. Yes. Okay. That's fine. We have a motion that is very much, but we have another course. Go ahead. This kind of a choice, a choice once and for four. We have a lot of portable buildings on the public schools. So, do our ordinance address time limits for how long those puppies get the symptom? They do not. In the past, you have attached a time limit to the conditionally you can use for a minute that allowed some sensing that one of the schools, but we have not attached a time limit a training to the portable buildings, now we have to. The same boat we're going to be required until they finish the next elementary school. Some July or something like that, that they wouldn't need the fifth school. Portables. Can you say that again on that? If I remember right, they said that they needed the and deportables until they finish the next elementary school as a construction, and then they will be removed because they'll have more capacity. And I think that was July, but I'm not done. July, March, 4, 1. Okay. Any other questions? Discussion? One at the side? All right. Second. Second. So, the motion moved. So, all those in favor say aye. Aye. Those opposed. Passes you now. Thank you, Councilor. Moving into a John Hottie 5.D. discussion of action regarding the end of the recording equilibrium of not to exceed 25,000 with RCA to water supply. To complete a water feasibility study for fossil water supply to the CME history. I hope this is something that is good. This is connected to the water bridge plane. We have the engineer and staff that met with RCH, and they have agreed that we would like to pursue per single water for them after law of the pump station, which is right up here across the Joe Fah, the New York City Semiloam, and we know for a day of recent water to tell our ex-interno in the picture. To get knocked down that study, we're going to have to go to the Greenham Dorsi H to check the flexibility on how much water they can sell to the city of E. It's really simple. The numbers we're talking about is 0.5 to 3.8. So that's what I'm asking for. So right here is the picture of the pump station. You can see our bottom line, come to the end of our 24 inch here. Uh. So that's what I'm asking for. This right here is the picture of the pump station. You can see our bottom line comes in 24 inch here across country and this one, cross rope and then off with cord, or then on the circle. It's 25 hundred feet away. They don't ever use this pump station when they get their new pump station online. And it's also due to the desire of their system. It puts their tower at the very end of their system. So the water will have to be flushed out if it's not sold to someone else. So it's advantageous for our C-H. It's advantageous for the city of ETH. We've met with them in Texas and they can heard the study of the executive committee. I took a little bit of presentations. The cabinet's all been applied and served as a law firm. Good. This just demonstrates the one-line connection from our CH to our compensation for ECR-24 comes down. In test and city of E, the thought was also in the future we may want to. If the Council is in full and we forecast for RCH, we went into the future for the CFP together into a parallel part to have the known association to 24 of the problem become a pair for some reason. We still have a direct connection with RCH that is 990. The 24-inch line. Yes, the 24-inch curve that the problem will do is 10. Okay, sorry, very good. Councilor Coulomb, and that will allow us to maintain 4.20-year-old. Then we have to take the point of the... In input, what did we do in the short error? If we just did the small connection, is what would still rely on a portion of the 20 year old. But if it had a future, should we decide to completely break that old and parallel that we have to train machines and some of that. One along and pull the wire out of the speed and then we see the wire wire out of the 20 year old. You can see the front face, the border blue, the current light. You can appear a little bright from the anti-tank air system. And then we can completely assay the point ass-like 24 without any water. Oh, that's green. And you've ever done that, say? All right, so for clarity purposes, obviously we are still continuing to work with the city of Rumble on water spliger point next to shenanigans we are also working on our bridge plan, which is really well so continuing to duplicate for storage facilities. And then this is a third element of what we're done and sees and maybe you can walk us through that you had a conversation with the context ofners for one or two minutes or so just to end up in a conversation. That is our city. So we've met with North Texas and specifically asked them about a customer to customer relationship. Our CH as a customer is becoming a direct customer. They've been accepted by North Texas. They're building a pump station. It's going to pull off to walk any like and pull back west. This region is actually kind of the end of their system out there where we're at it's long. And when we spoke with North Texas, it is a unique situation when we have a customer, customer, customer. So unique so that they don't currently allow that. They don't currently allow it without their blessing. But we're instructed by their administration and they're being voted this. However, nothing can be brought to the fore. All of us are convinced. So, they get encouraged to take on the study and say things are looking like they would. This would be a good idea. Okay, very well. Any other questions for Stan? Councilor Paul? Councilor Rufon? Sure, just, the water is coming from two different sources. You can go to Spongebob, North Texas. So that's why they'll let us bring it together. Mix it. Correct? Yeah, it's still there for water. It'll be in a lot of cities of our navy to share this water. there is a difference in the alcohol in the other water when you're getting it from wildlife for Texas not something you'll ever really notice in the summer, you're swimming or something like that uh but but uh the skiing Sunnyvale uh often get it depending what's going on their system before we see them to different waters and and it's going to be a bit of a big thing and rock wall will be a would be amenable to this because that's not taking from theirs because we've been going to North Texas through a different, great age or any area, it's part of the great, the great is in the term shape. Thanks Brian. Thank you. I'm sorry, I'm not sure about the council member. So actually this, California is going to like a question to me and I'm going to tell you what is the, what is the route to the venture and is the routes? The transmission line for the feeds of the horse stages. Where is the water? Where is the water coming from? Where is the transmission line? They're correct transmission line for the transmission line. I don't believe I have that on the man. It just roughly comes down to the 205 area. Not less than that 205. Yeah, 205 to law from the same area we pull water from. They share a lot when you first leave towns, and we're right next to each other, except for a long ways. And then it splits off that land. It's going to be a main. Once, or CH finishes their population, etc. There will no longer be any use. There's an up-chay for a federal loan. It could be, yeah, that's the thought process. You would have to catch onto it. I don't know if, I don't know if our CH has distribution lines going back up to a lot where they will back pressure the ad and we can get into the ad so we did bring interest distribution to the ad pressure. If that supply of oil is going to be available over the students who are off that takes point right right that transmission oil is going to be available and if someone has forced an oil it's going to be available or I don't know if they needed it It's a good thing to a big deal. And if someone has forced them, it's going to be a big deal. I don't know if they needed it. It's going to back feed on it because it's their line. So if they could thank God services off that line prior to the law from the home station, they would still have to serve those residents or entities. Somehow, they don't know that line. I don't know the answer to that. In theory, I see what you're saying about the toll runs already there. I just don't know the answer to it. Are they a baby in the entire island? Once an inter-system will be used in the export of the distribution system. That's what I'm talking about. So, we're going to talk about this, especially to their system. To walk into, yeah, so for babies, they're, their systems really count along. It stretches out east to west. And they've been pumping counter from the east, or from the west to the east. The down they're going to pump from the east to the west. And so their time was, their pressure planes built on hydraulics in the water tower. They're seeing it man out this way. And now they're in with the water tower. There's a demo of some push is the water tower. This is the water tower. This is the water tower. This is the water tower. This is the water tower. This is the water tower. This is the water tower. This is the water tower. This is the water tower. This is the water tower. This is the water tower. This is the big water tower me and them. Exactly. Okay. Interesting. Yeah. Very interesting. The windwind just. Yeah. Okay. With a big caveat. One more than one engine. It's got to do it. Yeah. It comes with a nuts to it. So we have the letters from our C-H. The information that they have No, we have a, we want to do this study to demonstrate what their supply is. That's what a mascot would do. Right? I'm trying to get any thoughts on, you know, these guys have been involved in the truck local litigation. And, yeah, I know that they've had a management change over and we want to have you, is that all finished with them and the climate change of the Black lands peace and everything else. I guess what my question is, Brad, is if someone's prone to, you know, those types of activities and behaviors, you know, I'm not sure I'm interested in getting us involved in a relationship with someone where that might be an option. I think that's something that you guys will have to consider about your relationships. I don't involve myself necessarily in the politics of it. For me, we were tasked with pursuing water. This is a natural location, the proclivities for pursuing each other is not something that I took into account. Okay, so we also have access to their storage facilities there until finally we put it for the short term or this mandatory. As long as we were made a customer of theirs. I think they might even be talking about we have to become some commercial ownership. Right? Okay. You know, with regards to overall, with the mobility over the numbers. When we started, we started out of half a million. and their desire for their prostitution is large and they would like to, what we asked, you know, I was free. I was like, I'm going to take whatever you'll be up right now and pursue as much as you will. I was to get to you. You will work up the details with the things we get the offer. And then they start talking about numbers about $3 billion. And this would be also take their pages like we have to borrow. If there would have to be a whole set of one contract in place, right? That is the point. Right now they're receiving $2.1 million gallons a day off of the take point, ground from rock ball. And it's been said that they are on schedule end of 2026 to have the same place and on day one, the rough numbers that I've heard and it's 11 million gallons. Yeah, their post-states have been sired for such a good field now is what they're designed. Part of the study is going to say, well, we want to sell it in a short or medium or long term project, whatever that turns out to be based on the study and how that works out. What upgrades do I mean? We have to do how that impact our system in our design. That's why we need to get out in front of this before they end up getting to for West or country. They post-acid-period over the show. So, I'm going to talk to you question. I'm going to ask you a question. I'm going to ask you a question. I'm going to ask you a question. I'm going to ask you a question. I'm going to ask you a question. I'm going to ask you a question. I'm going to ask you a question. I'm going to ask you a question. I'm going to ask you a question. I'm going to ask you a question. Any thoughts? Rageful pork on what's that, my baby? I don't know, I don't know what they have currently. Um, if we... to time this into key any thoughts range for worker what that might be. I don't know what they have currently. We haven't been exposed to that. So we're having to ask RCH to do the study. Partially states they have to provide all the documentation for the study. For at that point we'll be giving all the technical statements what they'll be doing, what they would do, what they would want, what they would want, what they would want, what they would want, what they would want, what they would want. It would be their water bottle that would be supplied to the city. Right? That they would have it here. All right. Thank you very much, Brian. Thank you, sir. It's been a good announcement of the crowds. Yeah, so then rock ball was okay with us. It's late or he's late and they're okay with it. And we'd see the person that's in there. So they're okay with it. Yes, sir. Yeah, so then rock ball is okay with us. Hey, are you staying in there real quick? We can see the distance. Yeah, I'm very happy to see you, sir. Okay. Then you say, we know where the nobody's going to cause to get this water. What's going to take to go against the people? We don't know. I think they're going to do a study and give you options. You know, if you're only playing for half a million hours, What is this study? What do we get? What is this study? What do we get? What is this study? What do we get? What is this study? What do we get? What is this study? What do we get? What is this study? What is this study? What is this study? What is this study? What do we get? What is this study? What is this study? What is the study, what do we get? What is the study, what are they doing? They're going to water bottle the system to see how much they can provide there and still serve their customers. How much can we afford to sell? In what time frame? You know, can we give? I have a million things work, can we get? You know, in the wing data, how does that turn? It's water modeling by the engineers. And they're so so legal, they're break down. I'm just with the engineering effort versus the legal and cost of the service. I think we have an alley to the beach. It's just a I have the engineering program in study for Water Flows 2.01, the sea breeze, reimburs, arch-caged for the engineers, performers of the feasibility study as well as any legal fees and curfew by arch-caged, associated with the feasibility study. I don't know what that is, but I just need to have their attorney spend the documents on this one. Are they talking to other cities too? Not to my knowledge. I think that's the only one. I think we're all ones in the grocery. We're the ones that make sense. But what I'm kind of leaning to on my issue is to pay $25,000 to see if they can't in desire. Because that says they have to be able to in desire to sell the floor. So let's know right now if they desire the shirt. And remember that. I feel like the Councilman Krause, we were before our study, The phone was something that could bite you more and make sure you can take the phone from the fan. Maybe not if we had a dead end water tower we needed either don't percent. The heads didn't recommend we do anything without a study so I would also like to see these other agreements that are going to come after we pay him $25,000 to see what they can and will. And then in other terms, in conditions that follow, what if we pay this money and we can't, or we don't want to meet these additional terms. It's a possibility. But first, you know what? Would they be willing to share with us with these other terms in conditions? I can ask them. Mayor Pro Tempa, what are you referencing? One section. Are you reading from a document that states what you're saying? Is it, are you reading it from the ILA? Yes, page 23 and 24. The additional terms or references that where you? Okay, so okay. Page 23 1.02. Almost last sentence. Should RCH have the ability and desire to sell order to the city and the future? Can you such order sale will be addressed in a separately negotiated and accurate. That bill also works on tracking that. This is only an integral moment to a water sale. That's it, it is. It doesn't, it doesn't, and I encourage contracts when all the other ingredients are also left to purchase water. That would have been a separate document. And is that a blanket document and a standard? We all are aware of. Can we get a copy of that? So now that we have this, we're in at the time. So this is brand new. No one's ever done an agreement like this before. Hold cell water green again. Sure. But they're different. They're different flow rates for everyone. We need it. every city purchases different amounts of different flow rates based on their water model and availability of so water. I don't know if anyone's didn't be identified. I mean, every city purchases different amounts of different flow rates based on their water model and it may have been only cell water. I don't know, any ones that would be identical. Even post-out water providers who sell to different lakes have different amounts of different flow rates, contribution pool levels that they sell to water providers, they're pretty different. So I guess I'll have to scan it and we don't have a concern of paying $25,000. So I want to know for some terms of conditions that would make our dollars to waste. Many of us are going to understand that this is a step towards policy decision on ultimate water ability to be supplied to the city. It's a step. I mean, I think your point about they go is fees. If you look at the preamble, it's all engineering. And then they say, it's a sentence that talks about little fees in the middle of it. You want to capital-level fees up to $2,000. So the vast majority of the free engineering help them to take that pride, the global wise move. But I don't know that you're going to get multiple answers by the study. You're going to get it. Please. the majority of the students here, they have to take the pride of the otherwise. But I don't know that you're going to get ultimate answers by the study. You're going to get feasibility capacity. And then what that sounds like to me is, then RCA, they're going to have to negotiate what are they going to provide to us. They're based upon an engineer's study on what their water capacity is, and the fluctuation of that. And then they're probably there political oil to provide that. I don't know that. I don't know the policy part of it. So it's a step. It's a step that you almost spent $25,000 to get a long-term potential long-term solution. That's a policy issue that I think is on the table. Maybe I should, but that's why I saw that. It's literally just a tool for us to be able to take just our board and our partner to negotiate all some water contract. So they don't know how much extra capacity they have, but will they? They know how much they're going to get. Well, they certainly don't want to tell us they know where we're going to have the study. They wouldn't be there to sign a consistent writing. They're not known. They're having their episode meeting to tell us that they're having a study. They wouldn't mean they're designing a system. They're having to do their not know-how. They're having to do their not know-how. They're having to be because they know that they're going to have it. So my success. And North Texas, we have water districts team out of that meeting because they have it. So it's a typical system to pay someone to do a feasibility study to see if they'll sell you something. We said the most today water for every person. Should they do that to anyone? Should we have to ice the sack? So I think it's technical. They're water for every They need to do that. Anyone. I think I think the additional impact of what he's asking to do in the poll amounts may request type from that would be a different model than what you might think just for your distribution purposes to your own business. I get to have a current one that you can build on and do that. I'm sure they've brought up that I had a new system. We've brought a twist and we had the last minute, which is, and any content, you can do it. Some of the answers, and the answer is maybe we do. So, we've got to go takes 25% to 20% to the entry time. Two runners, the suspects, we don't have that fact in the model right now. So this is us deciding for all the spend 20% to 20% to see if this is feasible. It's really a big, big, big problem. It's probably the one that's going to be torn apart. Yeah, maybe two drops. Yeah. Just see if this is feasible. To get it in a by-bite, let's call it the problem. Maybe two drops out. Maybe two drops out. That's a potential benefit. The risk of the classroom water. The classroom water. Sources. Let's call it the problem. Okay. Just give this a potential force that we can run away from. It's a three-mail, that would be cool. Because I not happening, that wouldn't be cool. You know, we bought our CCN from our C.A.H. for $1,000,000. Sure, years ago. Yeah. So, we've kind of been sort of in business with them before. Didn't really go well, kind of, just got to play. And we went up by our CCN from both the out of 40. Right? Okay. or CCN from the California lake. Okay, so I guess up. And we want to buy our Seeks and from the California lake. Okay, so I guess I would, so the desire parts to bothers me, we're going to give them money to see if they can circumsure their smell. Let's lay the bodies to that sledge, let's lay the authority to decide what they want. And then you can put them for sure to retain it. Or let's plot some bad politics for them. Rich, if they're having a dump water, when we're in drought, we can't get up to four. There is an infillation there. They have a way to go and take a switch. You put that at 10,000 or 15,000. Tell me what 20 number would you put on that? Well, plus the 6 million, this seems like one of the investments because they're both related. Because dump and water makes you a propryon. And we run the IC it for a simple quote for sure. So the engineering company, are we happy with that? No, but in weeks, consulting us. And it's their own staff engineering company. And do that with any of the other things. Mr. Schuck has a long-term relationship with the engineer and it speaks of big surprise. So if we did this, it would be a $20,000 NTE, but it could be $25,000. It's actually a, it's not an engineering scope. This is an ILA to free first, or C-H, for up to $20,000. Should they go over that they had to bring back the reasoning and request to the city and we have them ordered up to 25. It's a agreement for an estimated cost of 20,000 but not to exceed 25,000. That includes legal. What I said is, I appreciate your permission. I'm sorry, I can't appreciate your question thank you Councillor I would like to add I think the other element of risk is taking action on spending up to 25,000 dollars with the clear that before the litigation with no tax minis water district, that this is not a viable solution. So any agreement, if all the agreements to contract anything with the bridge plan said well, is contingent upon that notion. So I'm very good. Okay. That's taking over all of them. Okay. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. Good. wells and as we've been building for to drill well that will yield under a million gallons. If we could get three million gallons from them, it's also a lot lower cause point to get in. My question is we know that North Texas is also pinched on water as the population of Texas explodes. And we know that there are many years out for even if they can get another water, another reservoir online, there has been talk about them trying to bring water usage down for capital across their customer base. Do we see this as a concern where even if we can come to agreement with our CH, we still So maybe limited down the line just by overall water availability in the whole region. Okay, so there's two questions there. And then I think what I understand is you're saying, is there a regional concern for water conservation? And is there going to be the more acute issue here where we're going to be limited on water in our particular town and resources. Sort of. So yes, we know that regionally they are looking to make water usage to bring efficiency into the water usage. And I'm curious if they're in the U.C. or C. and I'm not like the same, you can have a crystal bowl, you can look into it. But my concern is if we do spend money to procure more water, but then because of water conservation measures, we actually can't use that. I just want to think about that as we move forward to make sure we're bored against. So, you can see how the white stuff takes us to structure the under-water contrast. Anything rock ball contracts with the C&D, yeah,'re not a direct customer comes out of their apartment. So unless there's a drought or something like that where they had to mitigate what's going on with the supplies side, they don't oversell their plants. That their apartment still their apartment does that if Rockwall's bought at 18.2 million gallons at this tape point and on a Saturday afternoon if something happens or whatever the Rockwall use not can use nothing.4, none they can. They actually can hold. As long as the tape point can be that thinking. However, they're not guaranteed anything over the 18.2. It should conservation be enacted that number can be mandated to be lower to the degree if you must take on conservation measures and then lower your work of control. You know, we ran into that into the 6th, we ran into that 11 to where I mean, you know, I know you guys all over this 5 or 6 feet down or whatever. We were walking across like walking in and I made it it was a tear, they drained it to keep up with that. Oh, I see, they went a little bit of a little rip around there so I don't think I'll get it. But, so I hope that answers your question is, it's if the availability to the members is never obscured or never reduced, the members get to take. So that's important when we continue this water bridge discussion actually on whether we're in good health or whether we're taken to law law. Because if the drop walls are members to add us, there's a difference on how they get how water they can took a full over four years, the direct customers, their allocation would not be reduced. their allocation is now their member customers, members or businesses. I think it's really okay to, because what you're running to, so this kind of, you know, you don't have to deal with it. Well, if you sue for taking a shoot, the member person, then it won't take that as the blanket. So, okay, members are not, the customers can't, okay. But I've never seen it, I'll say that. So once the allocation is secured, the allocation is secured. It is taken out of their country. They can't take that back. I think that's my rock also cautious about what they want to get. This is a big deal because this is what we're allowed to take at this take point. What are we down the seas? It's a sea and it counts against another sea. This is wrong. If more Texas says no, he doesn't eat but 4.5 or 5. But Rockwell says, hey, we'll keep you seven. If more Texas says hey, that's only you dedicated seven to the other. We're taking this out of here. This is what you can have in this world. But again members of the whole world. If the war doesn't take you to the flow rates can be banned. And if you're full so much, you should water just to get there. Right, the destination. I know some problems. You know what I'm saying? I'm not sure. You know what I'm saying? The good matching numbers is three million is actually our gap between the wells and rock wall right now and building them. If we don't change our nets, we can do it. So that's, if we, which coolers are group playing just completed from one end to the other. That's all, that's all the wells, right, provide what we hope to do. And we wouldn't have that, I can actually call for a right of that. have to lie to not go on hundreds of doors of heat as a senior councilman and not have an answer to the water. I've blessed this guy. This guy is amazing. All right, very good. Council and other questions. Thank you, Mr. Creed. Thank you for having me. OK, at this time the chair will afford an entertainer motion. I'd like to make a motion that we approve. There are local interlocal agreements for $25,000 with our C-H water to complete the water feasibility study for wholesale water supply to the city of youth With a second my council and council let me reiterate The mystery did Signified that our tax minus water is set, that to get water from RCA to the customer cannot be in litigation. So I just want that to be risk that's addressed. I'm been lighting you up, taking action in the quarter of a field and that is still pending pending so that is what they're referencing is that we are trying to appeal the ruling. So at this time, those of you who are saying aye, aye, aye, those opposed. Okay. Moving into it, you can switch it, to item five, discussion and action regarding a change over four, 209,601 dollars to the public's contract to record the installation for the new water lines to support the city of Peds. Well, number one project. I believe that there's been a update Mr. Cree. Sorry. I believe that. I believe that. Staff recommendation for table. But I think it's important that maybe you explain to us the location of the scope. Yes, sir. So I went out on the side today and I was looking around and I had my change over my hand. And there was some additional items. I mean, I can take that in the weeds, but I don't know that it's relevant because there's gonna be a modified scope brought back. I found some potential savings. In fact, I know what found some savings for some so it spoils all on some linear footage that we get to do. And then after talking with the contractor, it took about five minutes for the realize that we're not ready, we can't reach it back. So, the intimidation is the table that did this. Because the way this is structured, I don't have the correct information to get, to continue to give you a good prize, but I can take a can look. I just thought the clarity was important. Thank you. At this time, the chair will perform an entertainer motion for the question of the next security committee. It's just almost through the high level of what the issue is. So this is the change order. What this is, this is the seat wheel project. So you can have no growth in the side.. If you have the water plants that leave the well, they leave one, but we call it the whole end. You go both directions up the well. Because one's up towards the tower, whether it be the little treatment, the treatment area, if you go on ghost to the pond over here, through your gate, in the park. Part of what we're doing in the park requires them to be able to have stuff when these lands complete with storm, with creating, pick up all the forms and we need to get those lands in the ground so I can keep those guys. If we've been on the stuff, we need to have them moving on from the park so they're not setting up the crew on their dumps. You know, I've got the way they're working but this land is because it lays under some of the stone. Under some of the painting, we don't want to put any in it and then come back and dig it up again. That's terrible. We used waste of money, it's not a good solution. I don't know before. We know about this. It has done per se, it's done per se. This is per se. We need to get in of it, it is not part of the project. It is technically part of the bridge plan. When we started looking at the spools for freight and things like that, they were in the condition for the change over the whole of things like that. And it's not one thing to talk to the other part. And there was an additional fee on the needed opening here. Sure. The DxNoSans, this needs to be scrapped. And then there was also some traction stuff we can do with the shorter distance and the basically your feet. So, so I guess we'll point like this to the close and the way the pack is moving to the source of the waterline to support the waterline basically basically a way. Right, the waterline is going to exist. Right there, you're okay on this way. That's what was the problem. Now that the plane could suggest the current. I apologize for that. It's a system of waterlines, but it's not. No, it's the inside. Correct. It's on the plan, the though. The storm's not even in yet. It would be a conflict with those storm tickets, like seven or eight crossings in there. And I think that's a form. Probably you've talked that you don't dig it up in a twice. On a new field, that's a terrible idea for the contractor. And for us, it's just expensive. and some of this water mine because of the storm water line it's laid in gravity flow, right? So it has an elevation. The water line, there are too much conflicts. So we have to go under, because we couldn't hold the storm anymore. There's a required separation. We have to be not mad. We also don't to shout. So this is a sequencing district. It is. If it's still a design shape, it's out. So it's not. So it's a check-in sequence. Yeah. This was something that was in the original part. This is the well. It's taking out a P238. These costs were never in the original project. 20.25 light. So these call us whenever they are, we're always going to come back. This parking lot is in some form of what you're saying is that you have now found some savings. The substantial amount that I would like to have this out of the table in some materiality. For that it's more of a certain thing. Okay, that's it. So I'm going to put it in your straights and points. It's really interesting. Yep, yep. Great. Thank you. Thank you. Thank you. Number nine, tw on number nine. Twenty-one through eight. One through eight. Fill in the contingency. So we're not contract change orders. This is supposed to be a contract. Any kind of PCO they're doing it like we heard the original plan said to put this poll here for the change order, it's change orders that could be here. So there's a bunch of pieces here. But we're under the same terms and conditions for this well project as we are for the part. We would be, yes, we are working, we have no contract with the police. I'll prove this. I got you to do anything. That's what a table to fix and improve for good reason. Yes. One thing I'd like to compliment is that they're break down of the chart as an effort for two sub-lots. You're really pretty good. And since what they're actually doing for the money, at the numbers old matchup, they charge the 5% versus the 20% more than that. So I have to say that stuff. It is actually going well. That level is being defined because it is a great right now. The final thing. When I saw the hall hall, I was wondering, you were telling me we don't need that anywhere. You know, that's your right. Okay. Good job. So we have the staff recommendation to table. At this time the chair will perform interdanemotion. I make a motion to table this item until I can bring it back in a motion to table two. I mean I didn't even know anybody after. So we have a motion on the floor to table two, the A13 meeting. Do we have a second? Second by Council member. Those are the papers. Say aye. Aye. Those opposed to pass, unanimously. Thank you, Council member. Moving into it. Our honor, I just like to say I appreciate your stewardship. We're looking forward to it. Now we call it roll number one. Thank you. Thank you. Thank you. Thank you. Alright, gen I number six is... All right. All right, Jenna item number six, this is our executive session and according to the Texas government code chapter 5 5 1 sub chapter D, the city council recessed into the executive session. This is a call for you to discuss the following six dot a section 5 5 1 Not sure. I'm just kidding. I'm not really moving. It's your own set of forms. I'm just kidding. I'm sorry. Clearly conflicts with this chapter regardingoso water purchase contract between the city of Rundwald and city of P city manager position Excuse me six dot p section 551 down the zero seven four Deliberation regarding the appointment evaluation assignment duties Discipline or dismissal of the public officer employee regarding City manager position. We are now in executive session at 7.54. All right, agenda item number seven, we will reconvene in open session at 8.18. In accordance with Texas Government Code Chapter 551, the City Council will reconvene in a regular session to consider action if any on matters discussed in executive session. We do have an action item that is needing to be addressed for city manager position. So at this time, the chair will open the floor to entertain a motion. of a commotion to authorize the mayor to enter into an agreement with SGR Over to pursue a interim safety manager if needed. The NSTR is our executive search firm so there was a motion before stated. Do we have a second? We have a second from high councilman Cable, thank you. The motion moves. All of those in favor say aye. I like those pose passes unanimously. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you.
