From disease outbreaks such as COVID to severe weather like tornadoes and flooding, we have always stood strong and this time will be no different. We will persevere in the face of this uncertainty. Essential services will remain operational and emergency plans are in place to protect our community before and after this storm. We have coordinated with the necessary agencies to ensure that resources are ready and available when the blue skies return to Sarasota County. Our safety is, your safety is our top priority. Please stay informed, follow official guidance, and take the necessary precautions. Together, we will get through this storm. So it is very likely that I will have to bring something similar to these two because I'm going you now if we get hit by it I'll do a similar waiver of the fees and the disaster declaration for debris collection as it relates to melting coming. The other thing I just very briefly, we've had employees working since the storm in June, Debbie, Helene, and now Milton coming. We have a very dedicated workforce at the county out there every single day trying to do what they can to prepare the community for the worst. We train for it, we practice it. We have a dedicated team, not just in the EOC. Out in the field, the folks who are out there taking the grief in the three hour line on the sandbags that people were out cleaning the stormwater ditch or preparing the lift stations. All our employees across the county are dedicated to preparing the county the best we can for what might be the worst natural disaster we've ever had. The way the community can help the county employees is to listen when we give evacuation orders. We've already given a, a, and b, and very shortly they will be announcing c and everybody should listen. We don't do this lightly. We don't ask people to leave lightly. Nobody's coming to arrest them. But once the winds get up we won't be able to come to help them either. And we don't want people to lose their lives over whatever the reason is they choose to stay in their event. And in some extent it's not fair for all the county employees who have to deal with it on the back end. There are a dedicated group of people and I can't appreciate them more than I do. I also want to say to the board the great discretion that you give us to be effective. You're constantly wanting information so you guys can be out there informing your constituents. I appreciate how each of you approaches that and we'll continue to try and keep you informed as we go through this and in the aftermath, which if we get hit by the worst case scenario, we're not just talking months, we're probably talking years of cleanup. Two boards were identified as needing county code amendments to realize this board policy. They were the Board of Zoning Appeal and the Planning Commission. The board would like to move forward. We would need a motion authorizing the County Administrator and County Attorney to prepare amendments to the County Code, removing the phrase for cause regarding the removal of appointed board members to the Board of Zoning Appeal appeal and the planning commission and also providing authorization to advertise the necessary public hearings. I won't be on the board to take advantage of such power and authority, but I think it's absolutely necessary. Those advisory boards serve at the pleasure of this body. I won't be on it anymore. I think that's just good government for you guys to be able to move forward with folks that can advise you the way you see fit in the fashion that you see fit. So with that, it cuts in your motion. I just just one item and with all the confusion this week, I had asked Megan to give you copies of what was sent to me. This has to do with some property that's being purchased by the Dreamers Academy, but there's three parcels that have an incomprance on it that require affordable housing and According to county staff the only way to remove that requirement of affordable housing on those three parcels is For the board to vote for it vote on it and so I so I'm bringing it to forward for your consideration and possible vote to just remove the requirement on these properties that the forable housing needs to be put on, built on it. Commissioner Smith, or maybe it's county attorney. I just have a quick question. This is the one where the taxpayer property was given to a third party to do affordable housing. Then they sold it and put money in their treasury. Then the new owner is coming about and wanting to do something different. Am I close? There's a couple different ones like this out there where the board puts a deer restriction on there based on it being built for affordable housing or some other contractual agreements we had. Fast forward through time it doesn't happen. Now you have another person that bought it with that deer restriction on it trying to do something different. So it's a yes, you're... I think that's what I said, but that's a lawyer version. Yeah. So where the 160,000, it was $16,000, wasn't it? It was like $160,000. I don't know the exact facts of this one in particular. Okay, so is the $160,000 coming back to the taxpayer or the third party kept it? Under the scenario that is just raised, if any monies that exchange stands would stay with them under the scenario that was raised. I would suggest in any of these, if the board is going to consider changing the deed restriction, rather than removing the restriction on affordable housing, maybe the board would also consider if you're going to go down that path just adding schools to it. So that way it couldn't be used for, they couldn't then turn it and sell it for something else without the deed restriction. I don't know that you guys want to do it at all, but if you were going to do it, I would suggest to maybe limit that deed restriction. Well, I swear I'm not trying to be disrespectful on it, but I am going to challenge it from it. That's what they did. They literally put the deed restriction on to say to do a certain thing. And so like, hey, let's do it again. Couple other, just saying. Take a couple other things could be whatever the fair market value of the property was now or at that time. To get it off of there, there could be something where the board could have somebody going into the Affordable Housing Fund. Or rather than voting on it today, I could get you a quick summary on it. We could bring it up for discussion at the next meeting. Will the board commissioner? I'm sorry, commissioner Rainford and commissioner Cuttsinger. Yeah, so in all transparency, I did meet with this customer. They explained the scenario. So apparently this was not, did not come up in their title work when they purchased it. So whoever sold it and had that on there, that's surprising, but it's essentially a doughnut hole within a much larger property that they intend to build a school. So technically, they could build that school probably in part of the parcel. And then you'd have this little part of the parcel that is kind of an outlier. If it wasn't to be a school, if it was to be some other use, then I would probably have more angst to it, but I do think that they've got a great school going already and they're looking to expand that we just need to solidify this. This is essentially a title work issue that happened on behalf of the current owner. And if we have to be made whole in some way in regards to that, I'm OK with that. But I think that we just need to try to clear this up. This is in a current transaction from my understanding. Commissioner Kutsinger. I'm okay trying to clear it up, but I am certainly not okay moving forward today on this. I think this is something that requires a little more time. I think, again, school, great, but the way this has moved forward without real clarity for me at least, I'm not ready to even vote on it yet if we could take a little more time as Jonathan mentioned, perhaps come back to us with a little bit more information about the process and also considering the way we move forward with there's several properties like this that might be affected. I know there was another case here recently where there was a property that had an incumbrance and it just got completely overlooked. And that was, to me, just didn't take the time hadn't been taken to look at it properly. So I've preferred it, especially today. This is something I don't want to spend a lot of time on, so I think it would be good for us to ask for this to come back. Commissioner Nernunder. Yeah, thank you. I'm also in agreement with having this particular item scheduled at a later date. I think there's some more information. Oh, that being said, completely supportive of the project in the Dreamers Academy with what they're trying to do. I think it fills the need here in our community, but I think this one we should take a little more time, get a little more data and see how we can work this out. Okay, no one else on the board. I could easily support a delay. It sounds like I've been negative about this and not. It's procedurally a little concerning to me. You went to the taxpayers, they're properties properties, their money, let's say. And then all of a sudden it was presented as a certain way with affordable housing. And now it's just kidding. We're gonna do another venture there, which again, you could argue is a public purpose. I'm not begrudging that, but here we go. Now you're going down a slippery slope. It's a charter school. It's my understanding, which is a for-profit organization, maybe. I don't know the details, so I could easily support coming back another time, even if it's beyond my tenure here. I just think it's good business. But I have no one else on the board looking to speak. Would that be a consensus for to bring back as a board assignment. Jonathan is that what you need is it fine with it? What I'll probably do is I'll just do the facts behind this particular one and rather than doing a full scale agenda item I'll bring it back on my report because then I should be able to do it for you know a very quick meeting and then you guys do whatever you want to do it that. I don't think they's a lot of public input to this, but in today's interest of what's going on. Okay. You guys are back so you can make the decision. Okay. Great. I just want to take one moment here, you know, with what's impending and what Jonathan said as our administrator. I just want to thank our team. They've been working very, very diligently within the EOC and out on the streets from the previous storms and I know that they're tired. I know that they are serving the community well and I just want to thank them and encourage them to keep going. We'll get through this and we have the Lord on our side and I just pray that everyone would be safe and that they would heed the advice of the professionals. This is a serious storm. Water is nothing to mess with. We realize that in this last storm. So please this isn't a tough guy award. If you have to get out of town for 24, 48 hours, then you come back. So he'd that advice of your professions. Great, Commissioner Nunder, agenda number 40. Yeah, thank you, Chair. I'll just kind of echo Commissioner Rainford's comments. Thank you to staff. Hopefully that your families are all tucked in safe and ready for this cataclysmic event that we are likely gonna have here in the future. I did take a little bit of time to go through my district on CS10 Casey Key. If anybody is out there listening evacuate, evacuate now, evacuate yesterday. The surge out there is going to be quite significant and I think we could all agree that to be out of the past that storm and let county resources be used in a greater usage throughout the community when there's real, real emergencies, there's no sense in being there. Just get out of Dodge. That being said, I wanted to bring back one quick item and see if we can have some discussion on funding early learning coalition for this fiscal year. This is a time sensitive issue. That board has three new appointees from the governor's office had a little time to speak with one of the newly appointed board members there in Kevin Cooper. Had some really good discussion. Some issues that I was not aware of and that this particular organization is somewhat of a quasi governmental agency in nature. So my ask is to see if we can bring this back for discussion at a further date, to see if we can make this whole. This is a little time sensitive for the budgeting on this particular organization. So Jonathan, I don't know at what time if the board wills that we can come back and have a little discussion on this. But that is my ask and I think we do have the 300,000 monetary amount ask. And I do believe we do have some funding left in Hsac and B-HAC to cover that. So that's what I got. OK. Commissioner Cuttsinger, 41? Chair, that may chair real quick. Yes, sir. Yeah, I still need, I mean, I guess Jonathan and maybe Josh, I don't know. Do we need consensus on that? I mean, if the board doesn't want to bring it back, that board doesn't want to bring it back. But my ask is to bring this back for an agenda item. Do you need us consensus, motion, et cetera? Yes, sir. Sorry, Commissioner. I mean, to cut that short. Yeah, I mean, sorry. It was, I have no problem with discussions at all over on any topic, let alone this one of, you know, there's, I'm glad we're laying it a little bit. There's some variables here, which state money versus local match. And there's been some legal counsel to this board of what that legal match is. And I'm curious why the foundations haven't funded this and what their reasoning is behind it. You know, the taxpayers already in on this at the state level. Is it supposed to be in on it again at the local level? Yeah, I mean, there's lots of questions. None of them aggressive in my thinking, but I think it's definitely worthy of discussion. But yeah, I personally wouldn't have an issue with any further discussion on the matter. Commissioners, if they're okay, can I move on to Commissioner Smith for a comment on that? Sure. Yeah, commissioners Smith. Yeah, I'm an agreement with commissioner and under, I think, early learning coalition is incredibly important and they do need our funding in order to get some state matching funding and you can't overemphasize how important those first early years are in the development. And so I'm all in favor of us bringing this back at a later date to discuss further. Yeah, that's a great example. For example, I don't, I'm not sure if that might have been before you were on board. I don't remember. But we have guidance, legal guidance that it does not require a match from us. It is any local match. It does not need serosotacounty taxpayer money. As a matter of fact, again, the taxpayer is the money's coming from the state, and then the intent is for a local match. The leaping jump was that it's another taxpayer match. And that was asked an answer to the past meeting. So again, I'm totally fine with it. Continuence and a discussion at it. I would like to see very clearly from the early learning coalition is were they asked, did they ask the private foundations and the community foundations to fund this locally and what they were told specifically in detail Was there an ask and was there an answer and what the answer was that would be something that I would find meaningful and helpful in this discussion But I'm not muscle in it. I'm just There's just again. It's a continued conversation from last time on this Then with that Jonathan. I think we have a consensus right is there anybody opposed to moving this forward and having a deeper discussion at another meeting. I see no opposition. And so my intent just to be clear would be to bring it back with the facts of the application the scoring and anything else that was relevant to that and that's it just retie it up for you guys. I really appreciated Nichols prayer this morning and Chair I appreciated your comments. I was really thoughtful and certainly echo the request for our nation and those looking at us to send up those prayers and then whatever ability folks have to kind of put together teams and come down last time for Ian and others and through the volunteers have made all the difference. After Helene, I saw my neighbor who was living alone, six neighbors were over there the next day, helping her clean up. And so it's a neighbor to neighbor thing. And I'll tell you the spirit is very positive. I think when you look back and we've been through Debbie, we've been through Helene. And now this is coming. Our community is shell shocked. And we just need to pull together, everyone try to do their best to keep a very positive attitude. I want to express my sincere personal appreciation to the extraordinary work that our team here has been doing. All of our employees have been activated, they've been trained, and they are making sacrifices to their own families and their own needs to be able to help our community. And so I hope that when you see them at work, you will let them know how much you appreciate what they're doing. And be patient. There is so much work to be done, and the scope of this is so wide that it's going to take a long time to recover. And I pray that we will have the patient and the presence of mine to try to keep a very positive spirit. We will get through this. We know we will. We've gotten through the recent storms. I think it was left with maybe a consensus to support the program, but maybe not support the funding request, but I'll leave it to the board for the will of the board. Commissioner Rainford. I was just gonna say, I have to let those sentiments I would support supporting them without the funding component. You're mic. Yeah. Sorry. I would support supporting them with the endorsement but without the funding contributions since it didn't go through the process like everyone else. I could support that any consensus from the board and alternative thoughts to that. I think it was more of a precedent setting discussion on money. I'm not putting words in anybody's mouth. Could you tell us maybe a little bit about the history or Josh or Jonathan about what we've done in the past? Yeah, so since it's been in place, the county's never not supported it. The donation is, I talked to the executive director after the commission meeting. That's not his primary concern, his primary concern. This started across the country as chairs or mayors doing public outreach to education campaigns to help feed the homeless in a variety of different ways. And the county's never not supported it. So he was more worried about that than he was the money. So it does include things like we help promote it with the utility billing stuff or in that kind of thing. There apparently is a massive federal movement related to litigation and there's already been a settlement as my understanding related to what they call forever chemicals that was back in the 1950s, there was many consumer products that had some type of chemical that was in the products, in the consumer products, that ultimately went into the systems of cities and all sorts of counties and municipalities throughout the country. Again, there was a settlement on a federal level related to this. It's very, very, very large dollar amounts. And it's my understanding these monies are going to start flowing as soon as January. There's lots of things that need to be addressed to have the ability to get these funds for our constituents. My ask here today, there's no decision that needs to be made here, but apparently, since we're represented by council, we're represented by council as our county attorney. Other folks, these are basically massive attorney firms that deal with this litigation. They're not allowed to educate this board or feature boards on this without getting authorization from our county attorney. They're not allowed to talk this directly unless our county attorney authorizes our county or your administrator and other stakeholders in this building to help with that. Again, these are huge amounts of money. So there's no decision this board will make or any future board right now other than directing our county attorney to let those folks talk with our staff and county administrator and maybe even all of you to see what options are for us related to this. With that, that would be the only ask. It's not asking at this point to get part of litigation or the part of requesting settlement that would be just to get educated at this point. Commissioner Smith reached on the board for this one or was that from last one? Commissioner Smith and Commissioner Rainford. Yeah, this has been a big topic both at the state and the national level. The PFAS chemicals that are in every bit of waterproof clothing, fire protection clothing, and various other things have gone into our water supply. And I guess my, what I've heard from going to both the state meetings with the Florida Association of Counties and also the National is that it's going to be almost near impossible to get this stuff out of our water. And so I guess what my concern is or my is that whatever money we're given, I don't want to put the county in a spot that we're accepting this money to get all the PFAS out of our water. If you know what I mean. If this is just dollars just for us to help in the purification of our water, not tied to a guarantee that the PFAS is coming out, I think that's fine. But I mean, again, I'll confer the our attorney but this is this is a nationwide problem that's why the settlement's so big I don't want to take the money with the understanding we're going to solve the problem here in Sarasota County. Commissioner Reenford. Yeah no I'll certainly certainly echo that I mean County Attorney are we Do we envision this going somewhere to like what the opioid settlement type of situation was? Yeah, and I know Yes, and I know our office has been in communication previously looking into some of these Discussions with these lawsuits for the ones that we've had discussions with are kind of not qualify I'm not sure but exactly this one is if it's the same thing or something different. But I have no problem with talking to another other attorneys about do we qualify? What are the restrictions? What are the requirements? Things like that. I would just limit the direction to just maybe me and the county administrator and then let us kind of dictate who we want to talk to these folks from there. I know Dave Pierce in my office, he was also involved in the opioid litigation. He has had a lot of background on this, and so I want him involved in that as well. Again, just to see how different this is from the previous ones we've already discussed. And our office would not do anything without coming to this board first. So we wouldn't come and say, hey, we have all this money for you, but there's all these requirements. We come to you first saying, this is the kind of strings attached to it if there are any. And I appreciate that. I think that obviously, as Commissioner Smith said, this kind of the front end of it, he's done some due diligence on this. But I do think that when it gets to that point time, the board obviously needs to look at it with a lens of, you know, are we regulating ourselves in a way that we can live up to, to take the money or so. But if there's money out there to Commissioner Moran's perspective, we should get our share. Well, that's exactly right because it's my understanding is that this is already a settlement. These funds are sitting there and they're going to be dispersed. It's just a question to who? Using a harsh word, it'd be borderline male practice if we're not at least getting educated on this for our constituents of whether we're worthy of those funds to Commissioner Smith's point. And what the intent of the money was for and whether we could meet that intent, whatever I'm just suggesting is that I don't want any bureaucratic log jam is that there needs to be a lot of communication going on here with a lot of smart people, whatever it takes. And so it's my understanding the ask today if I'm hearing you correctly, Josh, is that it would be as soon as possible direct the county attorney to give authorization to these folks to be able to talk to our county administrator. And whoever else the two of you want that you think could be meaningful to this conversation. And I'd be happy to pass the gavel and make that motion.
