And I am here to present the Brighton Crossing filing number seven, Second Amendment Subvision Plan. The applicant is Brookfield Residential LLC. The location of the property is outlined on the map. The 20.90 acre site is generally located to the north of East Bridge Street, west of Mount Beerstadt Street, East of Wooten Avenue, and south of the intersection of single tree lane and Bowie Drive, situated within the Brighton Crossing's development. For anyone unfamiliar with the process, plating is the third step in land development process with the city, based on the number of lots being subdivided as well as the right of way being dedicated. A subdivision plan is required. A final plat will also be required before site development can occur. And when considering the subdivision plan, staff use the review criteria found in section 2.02d1. Now to provide some background, the subject property was annexed in 1986 as a part of the Bromley Park annexation. In 2020, the property was platted as Lot 1 Block 32 and Lot 1 Block 33 in the Bray and Crossing filing number 7 final plat. And a small portion of the site was later replatted under the Bryan Crossing filing number seven first amendment final plat. The property is currently zoned single family detached under the Bromley Park 33rd amendment, which was approved by City Council in 2024. Now onto the conceptual layout of the subdivision. The applicant is proposing the creation of 126 lots for single-family development. One of the main purposes of a subdivision is to analyze a development impacts on public infrastructure and right of way. That being said, all the improvements will occur in one phase for this development. Before going into detail on the required improvements, I would like to acknowledge that this subdivision plan does look different from subdivision plans that have been brought before the council recently. As this property was previously platted, it still remains under the obligations of the Brighton Crossing Filing Number 7 Development Agreement. If this application is accepted by City council. A development agreement amendment will be brought before the spotty for consideration, which will add the specific obligations that we're discussing tonight. The development agreement amendment like I said will be brought before council for approval. With that, the general improvements associated with this subdivision are as follows. The developer shall construct public roadways and provide internal connectivity from single tree lane and mouth-year stat street. These local public roadways will be designed to the standards outlined in the Bromley Park PUD, and will mirror the internal roadways already present throughout the subdivision. Since the adjacent external roadways are already built out, the developer will be required to enhance pedestrian connectivity by extending a five-foot walk along single tree lane and adding a six-foot sidewalk along Bowie Drive and Mount Beer Stat. Throughout the site, sidewalk connectivity will be maintained with five-foot sidewalks front of every home. Next, the developer will meet the water dedication requirements to serve the development under the Bromley Park annexation agreement. This property is eligible to pay fee and lieu of water dedication. The developer will connect to the city's current water and sewer infrastructure in Bowie Drive and expand services to the development. The extension of all water and sewer services will be paid for and constructed by the developer. The site is already met the requirements for open space dedication. However, there are landscape tracks shown in greenish yellow that will be maintained by the existing operations board. Lastly, the development will implement private connections to the existing stormwater infrastructure that was built out with previous phases of bright and crossing seven. Now, and looking at the land use and development cone, the city council and making its decision shall use the following criteria found in section 2.02 D1 in regards to criteria one the property the subdivision but plan will help to support policies of the comp plan. The future land use designation of it be bright in the comp plan has designated this area as single as low density residential which aligns with its current zoning as single family detached. The subdivision plan follows traditional single family residential design patterns, ensuring consistency with surrounding properties in terms of lot sizes, tree alignment, and pedestrian connectivity. This design preserves the suburban character of the area while providing a seamless transition from the existing neighborhood. The subdivision plans supports other policies and strategies outlined in the Kotlin. In the Opportunity Area Policy Section of Chapter 3, the application aligns with policy number 13, Bridge Street Opportunities. This policy envisions the Bridge Street corridor as a vibrant main street with homes, farms, and commercial centers lining its edges. As adjacent lots along Bridge Street are already developed or in the process of development, infill projects should be encouraged to enhance the corridor's appearance and value of investment. Within the Comprehensive plan chapter four on citywide principles policies and strategies. It advances. and value of investment. Within the Comprehensive Plan Chapter 4 on citywide principles, policies, and strategies, it advances a number of these goals as well. In reference to those policies before you on the screen, the property is surrounded by roadways and infrastructure that have already been established through previous phases of development and adjacent projects. This development will integrate seamlessly into the surrounding area benefiting from that existing infrastructure. The developer will pay all applicable costs related to upgrading those public utilities and roadways. In the existing trail and open space amenities within Brighton Crossing, already promote the already promote pedestrian interaction that fosters a sense of community. As a part of this development, the completion of adjacent sidewalks and the addition of internal pedestrian pathways will help to address the missing pedestrian connections. Given that all lots in Brian Crossing 7 and neighboring subdivisions are developed or under development, the property remains one of the last-speaking parcels in an established area. The subdivision plan will promote infill development and prioritize this highly visible site along the road street. In regards to Gratiria B3rdee, the proposed subdivision and... Sorry. Still getting over it like a stuffy nose. The subdivision plan fully complies with the Bromley Park Land use regulations, meaning the lot and roadway specifications outlined in the PUD. Additionally, it addresses utility placement, pedestrian connectivity, and the overall site layout, ensuring alignment with both the physical and functional standards of the zone district. Should the plan be approved, a final plat will be submitted to the Development Review Committee for additional review. As mentioned, development will occur in one phase, which will be a continuation of the previous nine phases of Roy and Crossing 7. To support this, as mentioned, an amended development agreement will be required, which will include a schedule of improvements and set deadlines for financial guarantees. Continuing with the review criteria, E through H, the subdivision plan also outlines the right of way that will be dedicated to the city and specifies the maintenance of common areas by the Brian Crossing Rec Operations Board. All technical reports have been thoroughly reviewed by the DRC and the plan includes the necessary infrastructure improvements to mitigate the impacts identified in these studies. Lastly, the plan aligns with these with the goals outlined in the comp plan and supports the development of adjacent properties. It will not obstruct future infrastructure projects and is designed to enhance connectivity within Brighton crossings. After careful review by the DRC and relevant external agencies, it has been determined that the proposed plan is appropriate and aligns with those city's objectives and requirements. All posting was completed in accordance with the Land Use and Development Code. The dates are before you on the screen. Prior to any formal seminal to the city, a neighborhood meeting was held on June 19, 2024. And as of the beginning of this hearing, planning staff has not received any formal comments from the public regarding this project. The Development Review Committee has reviewed this project. The development review committee has reviewed this project and is recommending approval. The Planning Commission heard this request on February 13th, 2025, and unanimously voted to or unanimously approved the subdivision plan. And staff finds that the subdivision plan is in compliance with all requirements of Landucent Development Code and therefore recommends acceptance. At this time, there are four options before you on the screen. Thank you all for your time and attention. Thank you for your time. Here we are again. Brighten Crossing. Filing 7, Second Amendment. Summer did a great job. So I won't rehash a lot of the stuff that she went through. But just a reminder, Brighton, we've been here since 2003, and this is kind of how our build out has happened over the years. As of March 1st, we have 1700 and 13 units that we call them, our billable homes here, but just kind of a good, good remembrance of how many people live within Brighton crossing. We've obviously built venture center and water park. We have miles of path, we have bark park, we've got a fitness center, and we have nine neighborhood parks in there. So again again, we're as I stand up here, and we're always very proud of what we've developed with Brighton Crossing. In 2025 and 2026, the blue areas are the areas of focus that we have within Brighton Crossing. And obviously our subject parcel that we have for filing seven second amendment here. So as summer stated, we came before you in November to update the 25th amendment, this parcel was zoned for multifamily at 418 units. We, you approved. Thank you for doing that. The 33rd Amendment, which essentially downs on this project to single family detached or 130 units, a 288 unit reduction in this area. And so we have 126 lots that we're requesting for this filing with access points off Mount Beer Stat and Singletree. And the project as it sits within filing seven, one of the comments and planning commission from one of the existing neighbors was wondering compatibility are the land use that we're proposing is some are stated in her presentation and is obviously very compatible with everything else we have around projects. So we're excited to continue to build this parcel out and finish construction from all the homeowners in this area. Can you remember it? So Bowie and Mount Beer Stat both allow for parking on one side, actually as a part of the previous phase of development, we did require the developer to install no parking signs on one side on the west side of Mount Beer Stat and on the north side of Bowie. That hasn't been the case with single tree so in terms of like having any sort of striping that would prevent parking People could effectively park on either side of single tree and what's the width? I don't have any particular objection to this development, but I was curious what Gives them the fee and low of the water. What are we doing there because this certainly isn't low in housing So how do they qualify for the fee and the Yes, so they actually qualify they've kind of been grandfathered that Anxation agreement has been in place since I think 1986 like when the Bromley Park was annexed and so you know obviously Bromley Park is huge and so at the time you know in 1986 the like water conditions were a little different and so there was the allowance for them to be able to pay on the fee in lieu they They can still dedicate water obviously. They don't typically do that. But that agreement has just been in place for a long time. Obviously that's not what we do anymore. Thank you. I just wanted to be clear of why that was happening. Just a bit of background information on how we got here why I'm here this evening in 2023 council approved a waiver of solicitation for flea vehicle purchases response to unstable market conditions at the time. Later on in 2023 council also approved a waiver of solicitation for the entire duration of 2024 for the purchase of fleet vehicles and equipment. We are no longer in the same market conditions as we were then and this evening I am presenting to you an alternative method for the procurement purchase of fleet vehicles and equipment. It is rather simple. We would like to propose the collection of three competitive quotes rather than going through the entire RFP process. That is all I have for you, so I'm open to your questions. That could be read and that would remind everyone of the desire to keep the holiday lights up. If there are any questions about the resolution or the proclamation, I'm happy to answer them. It was a strategic planning meeting and I think they really kind of agreed on a focused direction for the future of that organization that I think is going to pay us some dividends in the future. Of course, the state of the city, I think it was your best one yet. Congratulations on I was nice to attend the consult strategic planning session. There is a great direction from the staff for the city there. I commend the city manager for that. I also attended the concert for a cause on Saturday. That is the flood by organization. It does some really great things. It's by the rematch professionals and some of those real estate agents there and this one was for the Richard Lambert Foundation and it was just a really good time at the Armory and I appreciate them doing that. Council member Green myself to manage Martinez. It's got Wilson. We're in attendance to your technical support as if we needed help of note. We did approve a change order or in which the professional services with aqua engineering this is a just just no cost as a explorer opportunity or options rather for expansion and then we approved a couple of fans very expensive fans not to exceed I don't know 400 some of thousand dollars and it's's really a mitigation strategy in the interim until they have a long-term solution. Feel really good about Scott and Michael attending. And I feel like we're in a better place than we have been. No, the last six months or so, their staff commented on our staff working with them towards the solution. So thanks for your attendance, Councilmember Green, appreciate that. And I just feel a lot better about where we're at. One of their, one of the members, whose name will this gave me, brought up their water rates, which I kind of, I made that motion months ago. I think they're going to, we're going to ask them to chase a new study. And I'm not sure where that's at looking at Scott, but I'm not sure where they're at on app. We that went away three months ago, four months ago. And we did have a gentleman that mentioned that the other night and we'd still like a better study, I think. So that I'll close. Chris, like Tom Brady just come out of going to be the council member. Thank you, Mayor. I attended the CML legislative session on Thursday and then on Friday. Went to the policy committee meeting and in thanks to Tom for just following me. We had 64 bills. We went through and so I'm going to let you all sit here. Why go through all 64 of them. I've got them written down. This only take about four hours, don't worry. Gotta get even with him. No, honestly, I'm not going to do that. But there were a couple bills that we do need to be concerned about. House bill 1232 wants to make all building owners responsible, liable for preventing any person entering their building with a firearm, which would require restaurants, bars, office buildings to have metal detectors and security. So we are going to do everything we can to kill that. Un the Fundamentate, man. We had a presentation by the municipal judge from our vata. And she gave a couple of anecdotal stories of what they're going through in municipal courts with shoplifting. The state law says that if you get caught in a capital crime like that, you have to see the judge within 48 hours. So the police have to automatically release you on a PR bond. And when you do see the judge, she has to release you on a PR bond. And she gave an antidote of one lady that's been in front of her eight times, released on PR bonds. She's only appeared two times. She's never appeared on her own recognites since every single time she's been brought back, it's been another charge. So they're trying to get a bill passed where our municipal judge will have some authority the second or third time to say no more PR. You've got to come up with something, some money, some capital to give you a reason to come back because the shoplifting over $1 billion in the state of Colorado last year, along just the state of Colorado. So we definitely have to change that. Another building, they're trying to pass a law that we can no longer collect city taxes for vaping and tobacco. And they're going to fight that. That's, you know, we need our fun and we need our money. The other thing they're trying to pass, which would affect us. And I don't know why they're going after things like this, but they want to limit the turf that we can put in residential areas period. All the houses, no matter what you're building, the state wants to decide what our limit is. And they voted 60 to zero to oppose that. We need to decide that we all live in different areas. Some of us have land, some of us don't have land, and artificial turf is not a good solution. So they're going to fight that. And then the other one, that's really crazy. They wanted to immediately update all the energy performance standards to the 2040 projected standards effective immediately and remove the exclusion for public buildings. And so they're going to try to fight those those were the things I thought you'd want to hear about that were the most important. Oh, there is one more. Utility, consumer protection. They want to make it that from November to May, you cannot shed anybody's utilities off for any reason. If they don't pay that whole time, you can't shed them off. That's crazy.
