The WPD, our Westminster Police Department, will be hosting their second tip of the copy event next Wednesday, March 19th, from 4 p.m. To 8 p.m., the event will be held at Outback's Stakehouse, located at 549 Westminster Mall. There will be photo opportunities. The chance to meet our canine Thor and other officers and SWAT team members. Police equipment will be on display and you can also meet some special and big athletes. proceeds will be donated to Special Olympics. So come on and join us and support a great cause. Next we have a senior center, St. Patrick's Day lunch coming up on Monday, March 17th from 11.30 AM to 1.00 PM. Join the festivities with lunch, music, and activities. Tickets are still on sale for purchase for $5 over at the senior center front desk. And as you know, we had rescheduled our Tony Lam park playground ribbon cutting due to Inclement weather. So we will be hosting that on Wednesday March 26, so two weeks from today. Other ribbon cutting ceremony will be celebrating the new playground at Tony Lam Park. And this is a special presentation and before we recognize there are a way I want to read the special presentation and after that we'll ask each of the council here, your head, and speak on about the person that you chose to recognize tonight. So this is a presentation, a talk on mission for National Women's History Month. In 1980, President Carter declared the week of March 8 as National Women's History Week, which was later turn into National Women's History Month in 1987 by Congress. 2025 National Theum is moving forward together. Women's educating and inspiring generations, celebrating and recognizing the influence of women who have dedicated their lives to education, mentorship and leadership. Westminster is proud to honor the sacrifices and contribution of women in our community throughout our state and our nation. Now, therefore, I, Chief Schollingwin, Mayor of City of Westminster, on behalf of Vice Mayor Carlos Menser, and Council members, Amy, Frank West, Mark Nguyen, and Namquan Nguyen. Do hereby proclaim March 25th as National Remunst History Month in the city of West So we are honored to do tonight. Well, thank you. Let's get in together. So we are honored tonight to present this proclamation to the Barbara City Women's Club, we will come down to take the photos shortly. Let me go ahead and read the second recognition for the women's 25, 20, 25 women, these things and honours in February 2020 for the women's 25 women, this distinction on the east. In February, 2024, the Mays and the City Council unanimously adopt resolution number five, two, four, three annually recognizing March as National Women's History Month. And as establishing the CDYed Women of Distinction Recognition Program. We receive a total of nine nominees highlighting the positive impacts that these women make in our community. Each nomination was reviewed and considered by the entire City Council. And each City Council members selected one nominee through honor this evening. So at this time, instead of going by the list here, I would like to go with Council Member Mark Wynne, why don't you go ahead and honor your awarding. Thank you, Mayor. My nomination is for Mrs. GGVOL. Mr. GGVOL has been a member of the community for 30 years plus and she is a community advocate for the community. Not only does she cook ethnic food for community meetings and for the Justice Senior Center, her participation in it. But she volunteer numbers of hours and for the last, I would have to say 15 plus years into helping the community understand what's going on in the little Saigon area and just her enthusiasm of informing the residents and the council of the vibes and the sensibility of community is invaluable. And with that, I nominated Mrs. G. G. Fall. Thank you. Next discussion, member West. Thank you. I nominated Eileen Wilcox and I appreciate and thankful for all she does for our community with sports. It is very important for our youth to be able to play softball, baseball without being kind of hinder because that's very, very good for their health, but also community aspect. And I really appreciate Ms. Wilcox doing that and I know that she's not shy from any challenges. She go head on and she takes up every challenge that is brought before her. If anyone needs help, she's there and take it on. Also, she has an amazing husband and two boys and it is perfect for her to give back into our community with what she does, giving back within the sport arena. First of all, I want to say we all had all great nominees in every single one of them with much deserving for this distinctive recognition. But we were able to just only choose one. Laura Rose, which is very unique here, is born and raised here in Westminster. So she's a longstanding Westminster resident. And if you've been here, you know who Laura is. I've come to being honored to have known her and I know she gives back to the community in many, many ways. Besides she's a very, very busy person. She, with her career, her family, she still finds time to give back to our community and And that is a big deal here because we all live busy lives, but just to find that time to give back is very special. And I very appreciate what you do for our community. So thank you for that. She's for years, like I said, she's born and raised here. I just want to feel the things that there's many. So we can't, we don't have all night, but I'm just going to name a few that she's done. And I've even taken advantage of some of these myself. I know she was also involved there in a general plan, a men and committee, years back. And this she was very, very involved and did her homework and a lot of great input into that committee, which shaped the general plan that we have today. And that's basically the blueprint of our city to be able to progress. So she did that. She's been a planning commissioner. She was seemingly out there. She does a lot of, she was an ambassador to our chamber. I won't put, she did that. She's always done annually. She does her holiday extravaganza party at the park. She does her summer movies in the park. Hollywood're all lucky to have her in our community. Thank you very much. This is Dr. Goon Mary Hansen in the house. All right. Since taking over as the superintendent in the Westminster School District in 2023, Dr. Hansen has literally transformed the climate and culture of our city's local school district. The parents and community of the Westminster plays extremely high value of education, recognizing that a strong elementary school experience lays a foundation and pathway of success in life. As a proven leader, Dr. Hansen has re-eknite a passion of learning throughout school district, working with community partners, staff, teachers, parents, and revitalize the district. I can think of no one who has had a more profound impact on the community than Dr. Hansen. Through the example, C. Hans said, except nothing less than very best for our city's youth. Her leadership has set the example of her commitment to excellence and has proven to be inspirational. Please strongly consider. This is the right up by her nominee. I wanted to thank you for honoring me with the other women tonight as a Westminster woman of distinction for 2025. I am a lifelong resident of Westminster for those that are wondering, that's 45 years. And I'm a property owner in the city. I was raised by parents that instilled in me a deep sense of community service. As you saw in my nomination, my entire life I've participated in various forms of community service and sat on various boards. I've also served on multiple city committees for the City of Westminster, including the General Plan Citizens Oversight Committee, and the subsequent Westminster Mall specific plan oversight committee. Most recently, I'm serving as a city planning commissioner. My business is based in Westminster and I continually host community events, some that are fun and others that provide a service, all intended to better enhance the lives as the community of my neighbors and the neighborhood that I live and work in. I've always been an engaged and active member of the city and I look forward to being reappointed to the City Planning Commission tonight for a new term. Thank you. Vice Mayor and City Council members and City Attorney also the the manager and my special officer, the police officer, who make a lot of effort to make our city safe. Thank you for you. He put a lot of effort to make city appointments great and great all the time. I came here as the first of all I have been working voluntary is commissioner of city of Westminster on many positions like Park Recreation, Traffic Commissioner and Planning Commissioner. So today I would like to say that I appreciate all of you have a chance, let the people have a chance to work as commissioner and especially if we choose the people they can perform for the people and make the people safety all the time. So today I know know that our city, we will call it American city. That means we all work for American, not for any special group. So what does it mean, American? So I come here with the letter American, okay? And in front of me is American, the first A is abundant of material and matters and mind. And E is energy and R is resource. That means we have abundant of material and resource within our city. And then we have to integrate those things together with the compassion, communication, and A, our appreciation for the contribution of all the people within our city. So, that the last end is nature. The nature of our working is for compassion and appreciation. So, in all, our letter American is very helpful. Meaningful. That means we have abundant up resource on mining, matter energies, and we incorporate with compassion and appreciation resource. April has soon come again, and it, my main of us, the criteria that we all have experienced some 50 years ago. This year I represent the 7 association in the City of Westminster and in Garongrove and Little Saigon to organize the 50 years anniversary of the Black April. We would like to do that on exactly on the evening of April 30th. We have done this for the last many, many years, properly more than 30 years, also at the same location. We, once it is being approved and permitted by the Mayor and City Council, we will then send our invitation to the Mayor of Charlene Win and each member of the City Council, I will ask many other leaders to attend the event. In the past, we normally do not invite politics to speak at the podium, but this year's, because it is 50 years anniversary, it will be an honor for us to have the mayor of the city of Westminster, the main city of the Los Saigon to speak in honor of the Vietnamese community and in recognition of the tragedy that we have all experienced. We hope to have the permit from the city so we can go ahead and plan the 50 years anniversary as soon as possible. In fact, we already did a lot of the homeworks, but we cannot proceed unless we got the approval from the mayor and the city. And today I hope that you will approve it. So can city manager update a little bit, I know that the purpose of this is to bring back business, were you guys able to talk to potential developer business people to bring them back here? Yeah, basically our focus of that, of our attendance at the conference was twofold. So we had a booth that we set up. So any developers and interested vendors who want to do business in the city, they would come to the booth. So we did have a booth that was set up. On the other side of that, we also had staff along with council members, rotated council members, who would also meet with us and developers at meetings at their booths, or we would have prescudule meetings that were arranged prior to our attendance. So there's a combination of that. Some of the concepts that we provided to the developers generated interest in which we've actually engaged in subsequent conversations regarding opportunities within the city. So, yes, so we've made progress going out there and so we would be looking to do the same thing this year. Okay. I would like to add that I was there last year and it was a successful event. We have a number of, make a number of connection with the vendors. There was a lot of, you know, it was a busy three days that we were there. We meet back to back. We have back to back meetings with vendors after vendors. And there are positive outcomes for the event. So I know that there was staff, staff was there, the city manager and also ACM, the city manager was there along with me as a mayor and the vice mayor at the time that was Councilmember Menzel and also councilmember and was vice mayor, right? Vice mayor, committee hall. And I can see, it was the first year, It was the first year for the attend the ICSE. And I'm glad that we are prepared for this year. And with the successful that I saw there, I can see that the advantage to have me as a mayor to attend the event because I can see throughout the number of meetings that they appreciate to have the mayor there. And with that, I think that I would appreciate if I represent the city this year if the council decided that way. And at the same time, I know that there was a number of engagement that from the vice mayor, MENZO to the vendors that we met. And I want to take an exception to think the city manager and also city manager to line up order in the meetings, which I know that they have to work up front with vendors so that they can get the meeting going. So with that, I think that it benefits for us to go for me and Council for the vice mayor, Manzo, to continue with this effort for this year. Because this community knows they are assets to our community, but you don't and you don't care. You don't care who you appoint as long as it's your friend. You go and find a friend to apply right after the deadline. I gave you copies of the ordinance. That's a law, folks. That's a municipal code. Are you following it in your appointment policy? No, you are not. This is a wake-up call for this community to understand that these council members, all of them, have discriminated against women for these appointments. There is absolutely no reason that Laura Rose should not have been reappointed. She's not your friend. You only called her Mark because I gave you hell and you called her like a perfunctory call of, well I said I did call her. Did you really look at the qualifications of your friend and Laura Rose and look at him on paper and tell me that you made the right decision for this city. The Planning Commission is going to be hearing every single mall development in the next two years. We need competent people on that council, not others that are not. So 9.1 is update on sidewalk vendor's enforcement activities. Mr. Mayor got everyone excited. That is a subtitle for the item. I'm sorry about that. Okay. Thank you for reminding me. Mr. Mayor, we were all so excited. So thank you for coming out and present your update about the vendor enforcement. Good evening, Mayor, members of the council. I'm Sherry Van Reducen. I'm the interim director of community development. And it's my pleasure tonight to introduce to you, Sergio Fereno. He is starting week three as the interim code enforcement manager. Sergio has about 18 years of experience in management and supervisory roles in the code enforcement industry. He comes to us from the firm of Wildan and has spent most of his time with the city of Santa Ana in their code enforcement department. He's also an adjunct professor at Santiago Canyon College where he teaches courses in code enforcement, public administration and criminal justice. And Sergio is bringing fresh eyes to our code enforcement program. He's developing policies, standards, and procedures for the code enforcement division. And it just so happens, he has a lot of experience with sidewalk vendors too. So you'll probably be hearing from him tonight if you have any questions. So please join me in welcoming Sergio to our city. Welcome. Okay. So over the course of the past few years, unpermitted open air food vendors have proliferated throughout Westminster. State laws have severely limited the authority of cities to regulate sidewalk vendors. Cities cannot ban sidewalk vendors and any restrictions must be limited to those that address health, safety, or welfare concerns. State law view sidewalk vendors as entrepreneurs and as such, city cannot, sorry, have to turn the page. The city cannot restrict the overall number of sidewalk vendors allowed to operate within the city. We can't require sidewalk vendors to obtain the consent or approval of any non-governmental entity or any individual before selling goods or merchandise. We can't require sidewalk vendors to operate within specific parts of the public right of way. And we can't require sidewalk vendors to operate only in designated neighborhoods or areas. The City of Westminster has adopted an ordinance that regulates the time, place, and manner to which sidewalk the cost of the cost of the cost of the cost of the cost of the cost of the cost of the cost of the cost of the cost of the cost of the cost of the an exclusive restaurant concession, the Civic Center, within 200 feet of any public or private school, place of worship or childcare facility, within 200 feet of an area designated for a special event pursuant to a permit issued by the city, within 200 feet of a farmer's market or swap meet during the hours of those events, or within 100 feet of another sidewalk vendor. sidewalk vendors are required to obtain a sidewalk vending permit from the city in addition to a city business license. To obtain a vending permit, the applicant must provide a copy of a government issued identification card, evidence of general liability insurance, a California sellers permit number, and evidence of a permit from the Orange County Health Department. Many of the vendors operating a Westminster do not have health department permits or city permits. We've received numerous complaints from citizens and legitimate licensed and permitted businesses regarding these vendors. Unfortunately not all of them practiceenced with enforcement efforts and issues citations to non-compliant vendors. Translators have been on scene to assist with any non-English speaking vendors. City's regulations have been on scene to assist with any non-English speaking vendors. City's regulations have been on scene to assist with any non-English speaking vendors. City's regulations have been on scene to assist with any non-English speaking vendors. City staff have been joined by Orange County Health Department and staff who've been able to issue impound orders for the unpermanent sidewalk vendors equipment and perishables. City staff then transport these items to the city yard where equipment is stored and perishables are disposed. Following a hearing, the Orange County Health Department may direct the city to return impounded equipment to the vendor after 30 days or to destroy or recycle the impounded equipment. Staff from code, staff from code enforcement, public works,, the Police Department, and community preservation have conducted ongoing sweeps since mid-November of 2023. Although City staff have been able to discourage many and permitted sidewalk vendors from returning to the city, there are a few that continue to set up and bend without proper permits, and some new unpermitted vendors continue to try to establish themselves in the city. As you can see in this table we've conducted 49 sweeps. We've issued 98 citations during those sweeps and we've confiscated 92 items from vendors. These items include canopies, grills, generators, food and other items. Many cities in our area face the same challenge that we do. Conducting swabs as vendors seem to have an endless supply of equipment. And we continue to collaborate with the health department to impound equipment from these unlicensed vendors and actively enforce city regulations. We know this issue is important to the council and to the community. I want to acknowledge the terrific support that we receive from our police department and from the public works department as well as the Orange County Health Department. If you have any questions, Sir Jean, I would be happy to answer them. Thank you very much. Thank you very much for updating us about voluntary enforcement activities. Can you go back to slide number seven, please? I know there's a lot of efforts from the code enforcement that the number of sweep that you have been conducted is about less than 50. And the number of administrative citation and vendor items is double hundred. So what I interpret as each time that you went out there, that there will be two citation and two items that we impounded. Am I correct? By looking at this? No, not always. Not always. Then what are we looking at here? Can you tell us? Well, sometimes when we do swabs, we don't find anything. Okay. The vendors sometimes have a little network and they'll call each other. Average, yes. That's the correct one. I should say that. So, with the numbers that we have there, and we stop on January 25th, can you let us know why we stop it there instead of a continue or disafford? we do have additional sweeps a plan but that was the day that I had to stop click. Can you let us know why we stop it there instead of a continue this effort? Well, we do have additional sweeps planned, but that was the day that I had to stop collecting data so I could write the report. Okay. And even though there are a number of citation issues, let's say average two H-swip, then I can see still a lot of vendors still out there. Can you tell us why there are still a number of vendors still popping up at different locations? Yeah, good evening Mayor. You know, dealing with illegal vendors out in the city of Santa Ana and in other cities, we're seeing this often. It's a rotating basis that we conduct the sweeps with orange county health and all our assistance with our police department and they continue to come back. The one benefit that I see that the city has taken is that they've taken a proactive approach and they have an ordinance in place. But we are seeing a rotating type of business where we go out, we confiscate, we issue out the citation, we issue out the fine. Orange County Health educates on proper procedural ways to get permits and at that point they leave following week they're back. So we're seeing that often. We're seeing that in all cities. So this. they're back and so we're seeing that often we're seeing that in all cities so this is something that the majority of the cities are having problems with. When you say that you see it in all cities I know that you speak of a city of Santa Ana what have you staff have you have a a chance to look at different cities, especially the city of Valais, because with my own eyes, I saw that they did the choice at one location, just a week apart. So in order to that, they confiscated, empowered the equipment. The next week, and next week, it happened the they went out and do the same thing. So I think that we have the ordinance in the city if we can't enforce the ordinance then I don't know what the council should the council continue to talk about the ordinance, put up the ordinance. I think we should have a way of enforcing the ordinance that we put out. Do you have any idea of? Sir, I've been here, as Sherry mentioned, I've been here for two weeks. Coming on board, what we've done is, we strategize with Orange County Health. We've added more enforcement efforts, not only at night, but also in the mornings. The last task force that I attended was probably the fourth day that I was here in the city of a West Minister to see the operation itself. So currently we have one scheduled this week and we try not to announce when we have them scheduled. But I'll be keeping an eye on one, you know, how many we have out there, how many complaints we receive reading up on the ordinance and building up on our strategy for right now. We do have a quite three to four scheduled in the next couple weeks. One more comment for me and then you know, would you or to the council member. I just want to thank you. I'm not going to put on spot. You on spot, but at the same time, I appreciate and I hope that staff will continue this effort to enforce our ordinance that we already adopt. Okay, next customer member, vice-member Menzo first. Thank you Mayor. Thank you, Sherry and thank you Sergio for coming out here for this presentation. I understand very well that it's a very difficult thing, very difficult job to do and force that there seems like it's just never ending. You whack them all, then you whack here, they pop up, you hit there, you pop up over there, I understand that. I guess we're asking, I know you're doing a lot, but unfortunately we're always asking for more. I've been out there with them myself, I know how difficult it is. And sometimes it's even emotional as well as you're dealing with human emotion, the folks you're contacting. But it's something that, you know, it is negatively impacting our city. There's a lot of different points of views, but when you talk to members of the business owners there have a restaurant or something of the same thing that they're out there on the street. I mean, you can say they're pretty much taken away from, you know, their business and their losing money because their overhead is a lot greater than the folks who are on the, bending on the streets. It just, we need to do it more frequently. I understand that it's hard, but it's something that we need to find a way to do more frequently, find a way to put our heads, collective heads together, and find a way to, you know, how we can tackle this, you know, what works best. I understand you're here. And thank you for coming on board. And we're lucky to have you. And we're going to pick your brain and take advantage of your knowledge. But we need to find a way to get a better handle on this. And, you know, staggering, alternating the days, and make sure we're not always going out on the same day of the week. If there's a way that we can get more manpower, you know, wake out there. But it's a very, you know, it's really negatively impacting, you know, not just when they're out there, but when they also when they leave, you know, there's they leave a lot of trash behind and they're also staining, you know, they're dumping, you know, oil cooking, no other chemicals on the street on our streets, our sidewalks, our grass areas. But if there's a way that you can get to that with the team, you do more assessments and come back. And I would like to hear from with our ACM, what do you come up with as far as which you can do differently or to make try to hit it better. So thank you. I look forward to hearing some good news. And if I can be in the assistance, let me know. I'll be there. So any ideas that I can bring. So thank you. Thank you, Vice Mayor. So next is the customer. What's the thank you, miss mayor. Thank you guys for being here tonight and welcome to the team. Sergio, thank you. I understand, you know, the state of California, especially in the state assembly, when they pass a bill, SB 946 and SB 972, it ties your guys hand and the city's hand to do anything about it. And I understand that in our government code, it doesn't really favor our city to clean up this situation within every city up and down the safe California. But I noticed that you mentioned the two things that we have problem with those vendors is that they don't have business license number one Number two that they don't have the health department permit and I know that you guys mentioned that you guys host twice To committee outreach workshop, right a month You guys do enforcement ongoing enforcement activity every week about every other week. You guys impound equipment when they have several warnings. Now I know that the council concerns is to make sure we don't take away the businesses of the people who already have in our city here and And they pay tax. They pay everything else from their pocket and their employees and everything. And I understand the hardship and the complaint that's coming to us. Now, I know that you guys said they don't have business license and health department. Are you guys giving them one warning, one citation, two citation, five citation before you impound? Or do you guys do more than just citation? The health department is the agency that is allowed to impound their equipment if they don't have health department permits. And then we issue citations if they do not have the appropriate city permits. And may I ask how steep is the citation? The citation is $100. There's also a provision in state law that indicates that the person receiving the citation does have the right to go to a hearing officer and have the citation reduced to about 20% of the original amount. We haven't had anyone go through that process yet, but we don't have people paying their citations either. Okay, because $100, I know those vendors, I've heard stories, I bet you have to. Is that they make about 10,000 a pop a night and $100, not nothing. So it's like a slap in the hand. But are there a way that you guys increase them out? Like the first citation maybe? If you don't mind, if I jump in, my understanding is that I think this for the second citation, the number is increased. Yeah, so what I'm saying the second citation can be maybe 500. The third is a thousand. Remember the ordinance that we put out. So state law says that the initial citation can be a hundred dollars. Second can be 200. Third can be 500. I'm sure that we can expand on. At the same time, at the time that we are tapped, the ordinance, I think that we already have that in their ordinance. One of the problems we have, if I may be candid, is that a lot of these vendors do not carry ID. And so we don't know that we're issuing citations to a particular legal name. And so the next time we see them, I mean I could say my name is John Doe and then the next time you see me I could say my name is Jessica Rabbit. So we don't know who we're issuing citations to. So we can't necessarily escalate the citations. So Ryan Salz, our senior management analyst to help launch the program is here tonight and he actually has the documentation in front of him. So I think if we're going to get into the specific questions of our ordinance, he's the person that we could look to to answer some of those questions. Is that okay, Mayor? Yes, please. Good evening, Mayor, Vice Mayor, City Councilmembers. Reading from the portion of the ordinance 8.0690 penalties, there can be different fines depending on whether they do have a valid permit or not. So it would start at $100 for the first violation if they do have a permit. However, if they do not, then it could start at $250 and then escalate to $500 to $1,000. And for the, if they do of a permit, it would be the normal administrative citation process for other normal administration administrative citations in the city, which is 100 to 200 500. So if they don't have a permit, we can escalate faster and it can start at a higher rate. So if we can have a surgeot elaborate on how that plays out in the real world, because that is our policy, that makes a lot of sense, but then there's the reality of what's happening on the streets. So that's probably answer your question, customer, but West. You know what, I was wondering though, there's many ways to enforce, like increasing the price, but is it legal for us to take a picture of who it is? So the next time you see the picture, you know who it is, you're giving the citation to. I think that's a city attorney question. If they're in the public street, we certainly have the right to presentation too. I think that's a city attorney question. If they're in the public street, we certainly have the right to take their photo. Perfect. I think that will be a good bookkeeping check of who it is. Thank you so much guys. All right. A couple of us. Yes, not how to ask a question, maybe the city attorney. I've heard of others. If there are any, if they have a vehicle a vision to the person who's the vehicle's registered to, is that something they've heard? I've seen that happen in the past. You know, we've practiced it. Sometimes we've been unsuccessful. But just to kind of give you an overall summary of what happens during task forces is that Sherry was correct. We go out with Orange County Health. They have primary jurisdiction. They provide the cease and desist. So we actually ask them to partner up with us, collaborate. They take the assistance and a lot of times sometimes Orange County Health says, I'm going to take their food. Sometimes staff may say, well, not this staff, but sometimes people may say, well, let's give them the opportunity. Orange County Health is a primary jurisdiction. They offer that cease and desist. We have PD there for safety issues, because there's plenty of individuals walking by, plenty of cars passing by saying, hey, let them sell. They're just trying to make a dollar. A lot of times when we go out there, there are times that vendors leave. They leave the premises. They don't want to be ID'd. They don't want taking pictures. If we do see a vehicle, that may be an option. Have it ran by the police department, but we have to identify that vehicle is being used. So that is kind of like the real of what's happening out there. And that's why it's rotating. I think we're right about going out there often. I think we're right about going out there and confiscating and taking photos. But the real enforcement is just that. Is that we go out there, they're switching people, they're not the same people, they're not providing us ID, and we're stuck with, okay, cease and desist, and we withdraw the items. So that's the situation that we're dealing with out there. I have a tag. Councillor Member Mock. I just want to say thank you Sherry and Sergio Perbiniar and Wilhelm Borg. I know this is hard work and we're a long way from solving this issue. But thank you for the report and the presentation. All right, Councillor Member Wers. Thank you, Mr. Mayor. Just follow up question regarding, so what I was thinking, you know how you can take picture to kind of associate the face with the next time you encounter them. What about also, as your complaint was that they don't have, most of them don't have business license. So for us, taking pictures, getting their information down and say, you cannot come here, if we see you without a license, you have to make an appointment in line before you can go out there and be on the street and sell again. When we don't see you with a license this the second time, then you get whatever, right? So I was thinking, saying in order for you to be out here, make appointment to get a business license. And then once you got your business license, then go ahead, you know. So can you guys do that and say that? I believe that we have a few outreach meeting already and then we've gone through this training already and I don't know from that training or outreach meeting do we have anybody respond to that? Well I think Sergio can add a little bit more regarding what's occurring out there day day, but I know that our outreach efforts began as just outreach and then they went on to be enforcement, but we're still doing outreach and enforcement every time we go out there. So we're not just there with the hammer, we're also there with the rule book and explaining the rule book to them. And what I'm hearing from the Councilwoman is a modification to the way we operate out in the field. And I don't know if we're at, if this is the right forum to be able to modify the practices that are task force that are currently doing, we'll definitely take that into account and can elaborate on that at a later date. Well, I guess my question then will, I'll modify it. Then basically with your training with what Mr. Mayor was talking about in your training and outreach. Do you guys have where an application there for them to apply for a business license? Well, our application process is online. We certainly could refer them to the online process. The application for the sidewalk vendor permit is not online yet. That's a paper permit. So we certainly could hand that out as well. Perfect, thank you. Thank you. I'd like to add right. And to speak to what the Assistant City Manager said just about the process. And what Cherry just said, I think that the communication is that they need a sidewalk vendor permit and that would involve coming into the city working with us One of the criteria of the sidewalk vendor permit is getting a business license at advance of being approved so that's one of the You know things that they need to get before they move on through the process and the sidewalk vendor approval So that is something that is clearly communicated to them and One of the pieces that they need along with some of other things like insurance, OC health permits. So all of those things are kind of in culmination to describe to them before they are going to be approved to operate legally in the same. Right, so I guess you guys have it online. So instead of only online, can you guys bring to those outreach event the paperwork, just the hard copy. So in that way they feel like it's easier for them to fill it out. Can they just fill it out there? Is that possible, George? I'm sorry. Sorry. I will add to, because, you know, Sir, just been here a hot minute. And same with the, we see much, Sherry. In during our outreach effort, you know, we did have paper handouts that we provided, but we also know that some of our PD personnel also had that as well. So as they saw, some of the vendors that are passing that out, I'm not sure that our current code enforcement as they're doing the outreach of their still passing out those same paper documents, but they did exist at some point. So at this point where we can certainly just re-initiate that there were a lot of documents that we had provided. But we've had success with that outreach effort though and with the sweeps. We've gone out and there are some people that legitimately were like, we didn't know that this was the process. And they have come in, they have been in compliance. I think what we're struggling with now is we're at a point where we have the vendors that just blatantly don't want to comply. And that's really, it's almost like a whack-a-mole situation at this point. So yes, we can certainly have more information and we can provide all the outreach that we could possibly do But you know, but we are a situation where where we have just folks that don't want to comply Yeah, I understand that I know some doesn't want to comply but to Pick it back on that one. I think since city, man Just say they used to have packages and went not so if you can reinstate that but as we all know a lot of vendors Don't go to city hall and get that package so with your outrage if we're gonna make sure they have business license You know the insurance ID whatever it is, you know with their Health Department compliance then if you guys have that package easier for them to comply and they they have no excuses because you have that hard copy package there for them to fill out because they're not going to come to City Hall. So yes, we're going. Thank you Mayor. I'm pretty familiar with the what's when we wrote this house. So our city has done very, you know, when we before we wrote up this ordinance, when it was adopted, our staff, we'd had gone out there to the community and make contact with these vendors, made them inform them about this, the process, and also inform them about the workshops. And for them, there was gonna be be multiple workshops and they would hand it a folder with all the proper applications and instructed of the process. Some of them from what I understand, they did attend the workshops. But at the end of the day, they're not able to comply with the regulations from the county health department in order to be able to operate sanitary-wise safely for the health safe and health of the with the products that they're selling so they cannot cannot obtain a city permit Because of that because first they need the county health department Certificate prior so they can accomplish that. So that is the crux and they know that and they continue to operate. So our city has done that. They have done the education first before we did enforcement. I was out there, they went out there and it says all about education for months, three months, and then eventually it became citation and with the citation for a while, and then I eventually became confiscation. So it was a process, it's not like we just went down to just hammer, hammer, hammer, no, it was the humane thing, but now we're in a situation where we got to do more to clean up our city because it's really taken a toll. So thank you. I know we're not going to solve everything tonight, but let's just keep it going and keep finding a way to get this thing accomplished. There's no doubt that this is very difficult for everyone of us and for the code enforcement as well. But you, I know that you have done your best and you continue to strive for your best. And there's a number of questions in the council tonight. You can see. And the reason that we have that because we have so much complaining, you know, to the council and to the mayor and that's why we want to make sure that you understand that too. And we rely on you to see, you know, what you can do. And I understand we trust you that you continue to strive for the best. So I want to, on behalf of the city council and the city staff, thank you for the effort that you put in. And hopefully that we can help the next update, which is more promising. Thank you, sir. I just want to make sure I want to advise the body here that I will be relaying the information back to staff. This will be a focus point for us. But you know, the major element of all this is that your correct is that Orange County Health requires that permit and a lot of the vent and there's a lot of the requirements and washing, elements and propane and fire, which kind of makes it very difficult for them to obtain permits, business license and city permits, even us educating them on our process. So that's the challenge is just that, making sure that they have all three permits that are required here in the city. But I will be relaying the information to staff and we will up our strategy and get more vendor task forces out and educate, be a portion of that also. want to relate that is a concern from the city council. And so if there is anything that we can do to help by all means, bring it to our attention. And we... is concerned from the city council. And so if there is anything that we can do to help, by all means bring it to our attention, then we will decide together. Mr. Mayor may ask one last question about the health. So city manager, is it easy for us to get the health department to come out with us when we do outreach? It is, okay, we can get them out there and do everything once, kill 10 birds with one stone, you know what I mean? Yeah, no, we, because, you know, as Sergio mentioned, when we go on the outreach, the health department has the primary jurisdiction, so we don't go out without the health department. So it's really just a matter of the health department's availability and of course, we're down for code enforcement officers at the moment. So trying to manage the seven days makes a little challenging but we can certainly see how we can shift the schedules around and make this a much larger focus. Perfect. So, Sergio, last question, you're from Saniana and I know I know there's a lot of vendors, street vendors over there as well, because I drive down Harbor and I see it. But what did you guys do that kind of help? Because now I see less. So what did you guys do? What do you guys implemented? Just we ran three task forces a night, a week, and they were coming and they kept on coming, and they kept on setting up, and we just kind of ran three or four task forces a week. So we were at 12 to 15 task forces a month, working from five o'clock to 10 o'clock downtown San Ana doing a 10 o'clock PM to two o'clock in the morning. So a lot of manpower in that, but it was just continuing to go out there. That's why I say this is a challenging task because of the permits that are required, not city permits. We're very friendly when it comes to that, it's challenging for them to obtain those permits. Sorry. To provide some context, how many were in your task force at a time? Typically we ran a one unit that's two police officer with two police officers in it. We had three trucks of two four six staff, six staff, two units, one Orange County Health. So total of ten. But at night we were at the city that city was doing 16 to 22 pickups a night and there were always at the same location. Pretty much. All right. Thank you very much. Thank you for being here. And that's when we escape on the fishing boat. So this holiday is very important and dear to my heart. And I am excited to celebrate, meaning not excited, but to memorialize, to remember those who have sacrificed their lives and the loved ones to fight for our freedom, our family, and our way of life. And I really appreciate that. All the Vietnam War veteran from the Vin Mi Sai and the American Sai, I want to say thank you. And then also I want to note that if you guys, since we're having that recognition, we will be doing certificate. But if we had different rules, bigger committees, commissions, maybe we can do a point more, but we only have one per five, just the same as us up here. Sorry, not everybody agrees with our choices, but for me, I do try our best to choose the folks who I know that would do a good job. And I feel confident that folks who I chose would do a good job. Thank you, Vice Mayor, and so, as for me, I want to thank you, each and every one of of you for taking the time to be here tonight and voice your opinions. We value, we take it into consideration and at the same time we ask you for your understanding that there are decisions that we have to make for the entire community. And with this, I'm fortunate to come to United States in this year is going to be 45 years. And this is the city that I landed here when I come to United States. And ever since, I very much live in the city. So I know very much about the history of this city. And as a member of this community, I appreciate is rich history and I'm honored to represent the good people of Westminster. The stories of remarkable Westminster residents are probably displayed throughout our community. Just at Amanda's park, you can see that you can learn about the civil rights struggle to deseguate schools in California. To the dedicated work of the Westminster Historical Society at the Blakey Historical Park. We continue to learn about the history of the area. So next month, which is marks the 50 years of since the fall of Saigon, since the fall of Saigon, much of Westminster's history has expanded to include new type cultural influences. As we continue to honor the history of Westminster, I think it's important to look forward to find ways to preserve the stories and artifacts of our history, as well as developing a place where we can encourage and inspire the next generation to continue learning about Western history and people. So at this time, I would like to direct a staff to research the feasibility of establishing a cultural center at the Blakey Park. So with that, I would like to have a staff to prepare and have it for the next agenda. Is that okay?
