Our Secretary will now call the attendance roll of code board members. Mara. Peter Roland. I have said very well this. President. Karen's candidly. President. Diane Narcora. I word saying hilarious. Kelly Wapi. President. can't leave with me. Present. Francis R. Is that you? No. Oh, the new member. She's a new member. OK. So, Cathy, you want to sway the people in? OK, to all that's about to testify, please stand. Do you solemn if swear a firm that the testimony about to give tonight is the truth, the whole truth and nothing but the truth? They say I do. Okay, thank you. Thank you. Okay, we're ready to begin the hearing calendar, please proceed. Hold on. We've got to do minutes. We've got to do. Yes. Yes. Do we have anybody have any? Mr. Chairman. Yes. I hear by make a motion to adopt the consent agenda of ratification cases presented on this hearing date with the exception of those cases personally heard by the board tonight. Do I have a second? Yes. Oh, my favorite. Hi. Mr. Chairman. Yes. I move to accept the minutes of the February 20, 2025 meeting as stated in the attached amendum. Motion. I motion do I have a second. Second. All in favour? Aye. Okay adopted. Thank you. The first case, please. First case is agenda item number one. We're just case CCC RES 25094 Co-compliance officer Denizil Inspector property address 7 6 North East 170 second street on a sort property is Santa, Natalia Rodriguez. This is a homestead property ownership was termed by tax record. Property was cited for driveway maintenance and notice was achieved by certified mail and posting. Good evening, co-born members. Code officer Jude Denizel, city of North Miami Beach. The property was inspected January 14th, 2025, reinspected January 29th, 2025. And the last reinspection was April 9th, 2025. No compliance, city recommends 30 days. here to interpret anything for you, man. I'd ask that we adjourn this matter for the next hearing and we can try to have an interpreter available. Or so. I don't know. I don't know. I don't know. I don't know. There's nobody here to interpret anything for you, man. I'd ask that we adjourn this matter for the next hearing and we can try to have an interpreter available. Or so she can have due process in. But we went through that once before and it was decided that if somebody can't speak English they have to bring their own interpreter. Was that the case in this particular matter? No, not this particular matter, but in other cases. Where people couldn't speak Spanish, that didn't speak English. In this particular matter, I'd like to adjourn this for the next meeting so that this woman can have the benefit of an interpreter so she can understand her proceedings. I'll make a motion to table. A second. All in favor? Hi, so what. Yes. Table to the next meeting. Table to the next meeting. Next. The next. The next. The next. The next. The next. The next. The next. The next. The next. The next. The next. The next. The next. The next. The next. The next. The next. Okay. Thank you. Thank you. Thank you. Thank you. I don't to say. Right. She has to bring one. So the next item to be heard on the agenda is a genitom number four case CCC C 250016 and a genitom number five case CCCRES 250017. Code officer Denizelle inspected property at 17180 North E. Second Court owner of the property that time cited is Mr. Vladimir Rodriguez. This is a homestead of property owner supposed to turn by tax record and notice was achieved by posting in both cases. Point of order. Maybe be cold board. Point of order. Yes. There's two cases also on our agenda, two and three. Is there a problem with those? I think they should still come in front of us for compliance. In the past, if something's been complied with that was on the agenda, we usually will say it's complied with and we will give the Inendum that if it happens again that they can be fined that's what has happened in the past. I brought this up many times before. So if they're. If they're on the agenda, they should still come in front of us that they have been complied with and then we give the the agenda that they've been give the motion that they've been complied with and the agenda if they were to happen again You're allowed to find immediately without us having to come through the code board again Am I right mr. Attorney? correct So where do we stand with this? The case. The case. The case was never supposed to be on the agenda. Because it was in compliance. So if it's in compliance, I say we just move forward as if it's been resolved. Right. Correct. And now we know going forward. Yes. We can handle it accordingly. Correct. Yes, it's an error with the system, the intergov. No way. So we can treat it as resolved and complied. That's two and three you're talking about, right? Right. Okay. So we're going to listen to four and five. All right. Okay, go ahead. Good evening, co-boy members. Court officer Jew Denizel, City of North Miami Beach. The resident, the property was inspected January 9th, 2025. Reinspected February 12th, 2025, and the last reinspection was April 9th, 2025. There was no compliance and the city recommends 30 days to come into compliance. Is that for each? For each. Okay. Is the person here, this is Vladimir Rodriguez? No, he's not. Okay. So do I have a motion on this? Through you, Mr. Chair. Yes. You were able to find Mr. Rodriguez on two of the cases where he comply. And you saying that he never made any type of? He never for the roof and the paint, the front door, he never took care of that. But the landscape, he took care of that because it was blocking the sidewalk. So he took care of that. So did he have a conversation with you? He never had a conversation with me, but he did take care of it. And you try and you never locate him. Never located him. I left my card, low response. OK, thank you. We have a motion on this. I'll make a motion. OK. On case number four, violation exists, bringing to compliance within Valiation exists bring into compliance with then 180 days of following an order of noncompliance at a subsequent hearing a fine of $200 per day would be levied there until compliance and when the repeat not to exceed $100,000 I Actually Your honor the city would move for 30 days 30 days, okay the city reason I'm doing this is because he hasn't been able to have a conversation with him. We're dealing with roof. And we don't know if insurance is involved. The interest is so long to get back to these people back and forth. Now we're in raining season. So the city is not in the business of really trying to, is trying to make sure they comply. So I'm giving him enough time the same way he came and complied with those two items to give him enough time to see if he would comply and do this. So respectfully, Your Honor, for the very same reason that you just stated, specifically because it's rainy season, It's incumbent upon the city to make sure that this is resolved as quickly as possible So for that reason I would ask for the 30 days and then we can we can take a a more gracious tack in 30 days when they come back But at very least that will give the resident the opportunity to hear the urgency of the issue and update the board as to what's been done up to that point and it'll also give the board another opportunity to give grace if that's what the board wants to do but I do think that it's important for the resident to be in front of the board within the next 30 days to update us on what's going on with the roof. Through you Mr. Chair. Yes, go ahead. The agenda I'd like to make is that the 30 days should be required to apply for the permit for roofing versus compliance of the whole roof in 30 days because I'm right now going through a roofing process. I'm in through 45 days on the, I'm at 45 days right now on the permit. So it should be 30 days to get the permit applied for. I agree to that. Yes. Thank you. So what do we do with number five? Motion to approve as amended. I'll second. I want to favor. Aye. So ordered. In case number five, violation exists, bring into compliance within 30 days or following an order of noncompliance at a subsequent hearing of fine of $50 per day. Would be levied until compliance, not to exceed $100,000. Someone to repeat. Do I have a second? Second. All in favor? All right. So ordered. Thank you. Let the record reflect that Mr. Dubie just arrived. All right. Next case, please. Next case is agenda item number six, which is CCCRES241114. Co-compliance officer Lorenzo inspected property address at 1-880 North East 173rd Street. Owners of the property is Beverly E. Wallace. And Chantelle Row and Filma R. Wallace.'s a homesteader property. One ship was termed by tax record. Property was cited for derelict property. And notice was achieved by posting. Good evening, both board members. Working in the rental city of November. Reach co-compliance. Property address 1-880, Northease, 1-73rd Street, and violation for derelict property. Violation was observed on September 20th, 2024. First reinvestration was January 22nd, 2025, and the most recent reinvestration was April 7th, 2025. My request is for 20 days. The person isn't here or the people aren't here? No sir. Okay. Has there been, through you, Mr. Chair? Has there been any contact? I've cited them before for a container. They removed it. And now this time I'm guessing the building department got involved in the game of violation for illegal construction as well too. And this is a home-settled property. For those green things, or I can't really tell what they are. That's a wood. Sometimes those green things are like septic tank covers. OK. Multiple septic tanks on the same property. I don't know if that's a wonder. Motion violation exists. Bring into compliance within 20 days. Ad signing this order. We're finding a. A thing of noncompliance. Find of $200 per day would be the heavy thereafter. Not Not to exceed $100,000 same on the repeat. Do I have a second? Second. All in favor? Hi. Thank you. So ordered. Thank you. Next case, please. It's the final case. To remain the cases are all ratification. Oh, these ratifications? Correct. OK. Are the people here? No, sir. Really? Very. Yes. We did the ratification cases before we started hearing. Oh, OK. OK. So, um, So we have a lot of things to do with the new and the new and the new and the new and the new in this, do we have any old business? Yes sir, good evening. Okay, good evening. Good evening Mr. Chair. Mr. City Attorney, in our last meeting in February, you were following up on your partners, my request to your partner previously, to investigate about the signs that were being placed on properties to the political signs that were without permission, what kind of ordinances were coming up, and also to cite businesses that are outside of the city that put up signs that we can't find because they don't have a city license. Is there any further on that? Nothing further report on that, but I will follow up and update as soon as there's something to report. Thank you. Thank you. Any other role business? Anybody with old business here? How about new business? New business, Mr. Chair, yes. We have construction going on in their neighborhood of Eastern shores, excuse me, Western Sunray West. I'm trying I'm trying to remember the name of the company right now, but they're installing new electric poles, the mosque construction now that I remember, mosque construction, installing new electrical poles. Down the alleys right now, they've just finished up between 172 and 173rd, 16th Avenue, 19th Avenue. During this process, they're parking very heavy trucks along the sidewalks. They're people's customers or residence houses, and they have broken the sidewalks. What will the city do about this? Because I actually fell on Monday on one of these sidewalks, and I've injured my rib. I'm not holding the city liable. It's part of my problem, not paying attention. I knew the sidewalks were already broken, walking my dogs. But we need to, I did put something on, fix it NMB three or four weeks ago. I was not been responded to about it. And I did ask to a Texas morning, who can I contact. I don't know if you were busy and didn't see it. That's what I reach out to, try to reach out to you this morning because after going to the doctorate I do have a cracked rib. So, mosque construction is damaging our sidewalks and it's causing an issue with people that are walking them that could trip and that causes liability to the city and that's something we want to prevent. Thank you. While I don't have access or immediate recollection of the specific terms of the contract between mosque construction and the city, I can state with a pretty high degree of certainty that there's an indemnification provision in that contract, which would obligate Moss to remedy whatever damage is done in the course of their performance under that contract. So rest assured that to the extent that there is damage that it will be remedied by mosque construction. So to the extent that you find that there are some issues, please do continue to report those so that they can be addressed appropriately by the city. Is the contract with the city or is it with FP&L? Well, again, I don't have specific knowledge of that contract that I can recite to you reliably offhand. But I would imagine that irrespective of who the party is, that there is some sort of privity and indemnification on the part of the city. Irrespective of whether that would be with F dot or with the Moss. Thank you. Another point if somebody can take a picture of the moss truck on the sidewalk. It's on it's on fix it nm b. Get it get it to me. Okay. I'll get your number after the meeting Jay. I believe that moss has to own insurance. Like I did when I was a contractor for the city. So, any other new business? Go ahead. Go ahead. Okay, one other thing. I've been noticing the Nova Southeastern property. The looks like they're getting ready to do the demolition on that. I've had a couple of residents in the area around my location in Sunray West, 171st and 17th Avenue. They're concerned about possible traffic issues that may come up with people construction trucks going through the neighborhood, up 17th Avenue to leave the property, and then leaving through either a local street or 171st street. And their concern is that that should not go through there should be used, 19th Avenue should be used in and out of that property area. I don't know if that was put into the licenses or permits that were given or if that's even legal to do that because as it is now we do have cement trucks that do go through 170 second street not even stopping at 17th Avenue. I've already made my complaints to the police department about it. So they're going through there. The trucks are coming from sunny Isles, believe it or not, turning westbound on 170 second street at street at the railroad tracks and continuing down one 70th second, not curving over to one 71st to 15th Avenue, and then going north to Miami Gardens Drive. And we don't have any signs to say no trucks, so it's legal for them to do that, but it's not the right thing to do. I've reached out to Ozinga, who's one of the companies, And I can't remember the other company. And both of them had said, good luck in forcing something like that. So if there is something that we can do to let to tie the construction traffic that's going to happen at Nova, South Eastern area, there's 167th Street between 19th Avenue and 16th Avenue. That'd be great, because the residents the area are concerned about these trucks coming through and they have kids, they have dogs, they have cats, they have animals that are, you know, that roam the area and they don't want to have issues with that. Thank you. Thank you. Is there any more new business? Okay. Okay. I just like to be clear about what happens when the police are called about illegal dumping, because I have been regularly in touch with code enforcement who have been wonderful about violations, because I don't want to live in a ghetto. Okay? Nothing gets it the word ghetto, but I don't want to live in a neighborhood that looks like a ghetto. There's trucks parked there, if they park on the sidewalks and everything else. But what happens is when you call the police what they're doing is they're telling the residents and they're saying that these problems are the concerns of the code enforcement. I don't think that's fair. If we're going to maintain a beautification committee and we're going to have the neighborhood look good, we need to make clarify just what it is that the police do to combat these violations. Because everything's on the back of the code enforcement. I don't think that's fair. I mean, he fell on the sidewalk. I fell in the alley because the woman who has her house rented behind me has a tree that refuses to cut in all the, and I'm not exaggerating, you can go behind my house and see what I'm talking about. That alley is disgusting. It's got broken fruit with bees hanging on it and an old, discolored alleyway. I mean, who's going to pay to repay those alleyways? The alleys are disgusting, no matter what street you go down. Every single alley looks like trash city and we really need to get the police involved and get more enforcement here. I mean it's ridiculous. This used to be a beautiful neighborhood. I don't know what happened. You know I mean these poor poor code enforcement, they're dealing with all kinds of situations and they need help. They need help. They need more staff or more ordinances that they can enforce. Things I just, I don't want to put any more money into any of my properties because I just feel that The neighborhood looks so bad That's the way I feel about it. Sorry. That's why Ketley and I are on beautification You know, okay on the new business okay, you know, I have new business there. Oh, okay Where's the where's the police officer tonight here? Yeah, we're supposed to have one or two police officers in the boardroom. We'll find out from the chief. We'll have been some confusion about the scheduling. Yeah. Well, and in the meantime, when we're not being protected by the city, like crazy can walk in there with a gun. Okay. We'll be taking care. All right, thank you. Go ahead, Kathleen. Good evening, everyone. I would like to thank Ali-Zone Commissioner Jay Chernov for coming to our meeting. We're glad that you are Ali-Zone. May 8th, no. It would actually be on June 14th. 12th? June 12th. June 2nd. June 2nd, Thursday. Yes, four of our code officers are going for training. Yes, a week long training, and so it would not be available. Okay, so June the 12th, 2025. Yeah, man. Let me say that all over again. The next Cougtenforcement Board hearing is scheduled for June the 12th, 2025. Now we have a motion to adjourn. Motion. Second. All in favor? Aye. So ordered. Thank you, everyone. Thank you.
