It requires conformance with the state statute regarding investment of public funds. It provides a general outline of permitted investments in accordance with statute. And sets a standard of prudence and ethics to be observed by the investment officer. The policy should have a term of one year and I respectfully ask your approval. A resolution of the common council of the city of Lafayette, Indiana, authorizing the participation of said city and motor fuel budgeting program in the Indiana bond bank. Members for Council, Mr. President, this resolution will allow the city to participate in the Indiana Bound Bank Fuel Budgeting Program as we have now for several years. Participation is offered to qualified entities in the city qualifies as a political subdivision. The program offers budgetary protection in the case of extreme commodity price volatility, which we have experienced in, well, it is recently as 2022. The program's index to 9x commodities for gasoline and diesel and uses a price cap structure, allowing hedging up to 100% of our reasonably estimated fuel usage. However, the city normally only hedges 50 to 70% of expected usage. The program entails an administrative fee of 15% per hedge gallon and this administrative fee essentially serves as our insurance premium that we're paying for our budgetary protection through the program. The mayor and I will determine a final hedge percentage in the very short term as final confirmations are due this week and I respectfully ask you to approve the city's in the very short term has final confirmations or do this week. And I respectfully ask you to approve the city's participation in the fuel budgeting program. Thank you, Mr. Deal. Appreciate that. Is there any comments or questions from the public? When prices are not volatile and they don't exceed the price cap, this is straight insurance premium paid. This administrative fee is when prices are volatile and exceed the cap, we will get a rebate through the program for the gallons for a given month that are hedged. We've done pretty well over the years, right? In 2021 and 2022 we had a net rebate of 2022 I think it was like $85,000. Okay, I mean with experiences like that the folks on the other side of this equation or you know they're taking their lumps but they're changing their their estimations for subsequent contracts. Thank you Mayor can even Mr. President ladies and gentlemen of the council first of all thank you for suspending the rules and voting twice on that other Ordinance those have been around a long time though that is an extreme rarity for us to ask to do that It almost never happens, but that's what an important piece is Jackie explained with the contract timing for payroll and everybody be properly paid and not have to go back and try to redo it which can be a big mess. So we certainly appreciate your Support on that and then that was 20 that is money that's in the 2025 appropriated budget. But I just wanted to thank you for that. Before you we have the first resolution is the contract between the fraternal order of police in the city of Lafayette. I first of all would like to thank our negotiating committee, which consisted of myself, city clerk Cindy Murray, city attorney Jackie Chasnick, our HR director Amber Schaeffer and Jeremy Deal, our city controller. And also I'll just thank the FOP and the Fire Union at the same time, the negotiations went very, very well. They are as they should be. They were thoughtful, spirited and professional. So that's what you hope for, right? And we work through several issues and got wonderful contracts, I think. Everybody's happy. The FOP, I don't know exactly what their vote was. They do it a little different. The fire department was 92 to 1. So we figured that's a pretty good measure for us. So some of the major, I'm just not going to go over every piece of the contract, but some of the major things starting first with the FOP and we'll vote on that and I'll do the fire. We did remove the salary lines from both of them. We're going to do salaries one year at a time. It's just too volatile. You're not sure what the state's going to do and what the rules will be. And so we're're going to do salaries one year at a time. It's just too volatile. You not sure what the state's going to do and what you know the rules will be. And so we're not going to do multi-year salaries anymore. We're going to do those one year at a time. For the police department, the city agreed to purchase one external vest carrier for each sworn LPD officer until all officers equipped with the United Shield Vest. This is a one-time purchase and is an addition to their existing clothing allotments. As you heard from suspending the rules, we made adjustments to specialty field compensations. We updated our long Jeviti pay as we indicated. And we did a few things with when guys and ladies retire. And that's really about it. That one was a little fire department. It's got a few other things, but that one was, we kept it pretty close. So we would appreciate your affirmative vote on approving this contract between the City of Lafayette and FOP, Arm and Lodge. Mr. President, ladies and gentlemen again, this is with the fire union and some of the primary changes that we made in that just a few of them all go over rules and regulations. The fire chief and or deputy chief may now attend all labor management committee meetings that was previously limited to the fire chief or designee. And then in addition, we added language requiring union appointments to any new committees representing the fire department members. That part is a type I want the information I gave you. Okay, all right, thank you. Well, that's a good thing, good thing we said that, right? And then we've talked about the wage schedule. We've taken care of that. We cleaned up the holiday pay and some bereavement leave for everybody. We did change the emergency family leave. Now emergency personal leave and we changed that from six hours to 24 with the battalion Chief's approval. Uniforms and protective clothing, FD members will receive their clothing allowance but will no longer need to provide their own bunker, coats and pants. Those now will be supplied by the city. So that was a big one. So we did some things with recruit training and some new language on a bid system. So again, the contract negotiation spirited, thoughtful and professional, I'm very happy with where we ended up and we're looking for another good four years under these contract terms. And the reason why I wanted to address a council is that I wanted to congratulate the actions of a public official and also explain why his actions were important. And on Saturday, I went outside my house and there was a police car sitting in front of my house. And so the thing was, so I was leaving. So I talked to the officer and the officer said, I'm here to follow up on an abandoned car that was in front of my property. And the thing was, what I was impressed by is the idea of following up, because following up is caring about your actions. And so, like the people in the Centeno neighborhood, they are trying to fight disorder. And also, if people don't think that abandoned vehicles are a problem, the abandoned vehicles make it difficult for the poorest pavers to be cleaned. And I used to, the floods that occurred from my house used to damage the brakes on my car. But the other thing that the officer was doing was he was fighting disorder, the disorder of having vehicles on, you know, abandoned on the street. That also we've had a few other difficulties around there. And that I've gotten the impression that, you know, the police force is concerned about finding disorder. And this is important to me because I saw an article that was that talked about that disorder is a problem and the way they defined it is, disorder is the domination of public spaces for private purposes. And so you can think of a lot of these disorder things as being important in this way. And I just came back from another college town, and a business owner was saying he closed his business because he was on the main street in the downtown because there was so much shoplifting going on. And so that I actually have this article, I can leave it, but I wanted to congratulate the efforts of that officer because there's a lot of people complaining but you want to, you know, congratulate people when they do the right thing. When I turned off the lights to go to bed and the room that stayed lit, and I thought that's there's something wrong with my electricity. But no, my lights had gone out. There were these lights shining in my window. And I looked out the marathon head-installed stadium lights that were shining in my window shining on my entire property and in fact shining on the brick building behind and they then reflect down into my back courtyard. So I did go, I went to my neighborhood meeting and mentioned it. And he said, well, you should probably take it to the mayor. But I went and talked to the owner of the business. I went in and waited and spoke through the little rectangle in the plate glass and the blue-proof glass and spoke with the owner about this. And he said he would see about pointing the lights down. Well, nothing ever happened. I did write an email to the mayor. He said he would go by and take a look and I never heard back from him. We did send a message to the owner also asking them to adjust them if they were. Okay. Thank you. But nothing. I took pictures tonight if you'd like to see. I can take a picture with after dark, with my curtains open and you can see everything in the bedroom. It's pretty disturbing. So I did write a come ask the engineers office to look into it and and and and and May. And I remember because I went into to file for a building or permit to renovate the bike shop building which had had a fire which I'm all I'll add to Mr. Frascus's comments that the Lafayette Fire Department once they were there I felt much better they're they're great but nonetheless I I filed a complaint when I went to get the permit and didn't hear back and didn't hear back and went and asked again and received an email or that in fact the lights were a public benefit because they protected pedestrians. They're on 9th Street, which I don't know about, but I still have light press trespass on my property. And I guess there is no ordinance to protect citizens from light trespass from their neighbors. So it's something you might want to think about doing. It's pretty inexpensive to go to minards and get high intensity light balls. And I don't know if you all would enjoy having those light shining in your on your house. I can't enjoy my porch or my balcony. I can't enjoy my courtyard because and now we have more than half the day is dark. We have this stadium light shining on our property. Now, the marathon is open 24 hours a day. It's a lot of garbage that I pick up and I've never complained about that. I figure that's just part of living downtown. But when there's this constant invasion of my property, I do think it's a problem and I suspect there's nothing will come of it. I hope something does. But this won't be the last time. We can definitely take a look and have conversations and follow up with respect to the owner and what they're willing to do and what we can ask them to do. Now, the guy who's managing our project over at the bike shop, I mentioned it to him and he said in West Lafayette they make a lot of, they're just little hoods that they can fabricate pretty easily that they can set over those. And then make the light, you know, stop the edge of the power crack. We can definitely bring that through to our attention. We can't force them to do those things, but we can ask nicely, and that's something I can spare head. And I'd love to see those pictures after the meeting if you're gonna be here for a few minutes.
