Typically we don't do much for welcoming and opening remarks, but I guess I felt it laid upon my heart to not only encourage those that are with us this evening, but I think it's an encouragement to everyone around us that not to take not only these meetings for granted, but the fact that we all get home safely. I read a news article earlier today about a mom and a child who died in a plane crash after the child had received some type of life-saving surgery up in Pennsylvania, although it's ironic and terrible and so sad. I think it's a somber reminder that there are a lot of things important in this life, but much of what is important are the loved ones that we get to share this life with. And so I would just, I don't know. I think we're at such a very peculiar place, not only in culture and society, but we have so much also to be thankful for. And I say that as a husband and a dad of four children, it certainly touched my heart and ways that I can't really explain. But in any ways, welcome everyone. And just thank you all for being here. Prior to the storm that expected completion date was October 10th. So the storm cost us quite a bit on that. Well, I just want to say thank you because you also kept up with DEQ. I know that some of the fears that we all had was the DEQ would continue to. And I'm not saying they appropriately or inappropriately took time to issue permits, but they were cognizant of storm healing and got us through. And I just want to thank you for keeping up with that. Continue on with the last few. As far as the diversion, we've had the same group that was ordained in every person's name. They had a con. I believe we're obligated to pay that we can track it with them to take their waste over five year period and Merser County charges significantly more than we had. And this is this expense should be recoverable by FEMA. The lost revenue on the other hand, we're going to have to finesse that a little bit. FEMA. The reasons that we're asking for that are what do you, I mean, the deal is narrow. It's the nine connoisseurs. So the union is all, there's nothing new to them or anything like this that wanted to be made a year. There's some holes in the building, which seems to be a ship. The cost to, there are no sales services in that area, that's more T3C's as we're required to have a landline found with a Nick each election, so that will pay installation. I mean, it's all to install the one-month service each election here. So a couple hundred dollars. I just used the phone from one day. There, we have communication. Other precincts always has the highest cost per vote. We'll break it down. That much precinct isn't. It was due to the vote trying to outpair. Back to again just $100.00 we paid our collection day and cost of their poll work was there. The cost of the vote, $123.24, cost of the vote for $31.28.00 for the rate of 50%. How does that compare with other precincts? A lot of precincts, it seems like one of the three of us, because it's significant, it's significantly high. So, again, it's almost the turn-up. The plan that was presented here tonight, the look at it map one and the head of your package. That's a problem. That's a problem. So moving on to item number nine, this is a public hearing ordinance exempting retired military or retired police canine officers from rabies tag fee. Mr. Chairman, before we call for a public comment on that, I will go ahead and give a brief overview and presentation with regards to that matter. Most of the time when we have a county ordinance, we have to have state statutory authorization for us to be able to enact it. Everything from major matters all the way down to dog license taxes. Section 3.2-65-21 and the code sections that follow of the Code of Virginia grant localities the power to adopt ordinances for license taxes on dogs. We have codified that in Section 3-26 of our own ordinances. And that license tax on dogs is assessed in following four ways. One, if you have a dog aged five months to one year, it's $4. B, if you have dogs older than one year, you're looking at a $10 fee for the three years. C, kennels up to $20, $25, and D, kennels over $2525 to pay $35. There was a recent revision to the code of Virginia that allows this board to exempt by ordinance the license tax on three categories of dogs. One, police dogs, two, law enforcement dogs, and three military working dogs. Those dogs who are trained to serve a particular purpose for our law enforcement first responders and our military in the Commonwealth. A few other jurisdictions have done this. Most notably I saw one from Campbell County. And we would achieve this by creating a section 3-30E and that would read no license tax. She'll be levied on any dog that serves as a police dog, law enforcement dog or military working dog, however provided that the dog's owner or owning agency shall maintain and provide the treasure of TASW, County Virginia upon request satisfactory evidence that such dog has been inoculated or vaccinated against rabies by a currently licensed veteran area or a currently licensed Veterinary technician who was under the direct and immediate supervision of a licensed veteran area on the premises. So we still have to have the proof of the rabies license in order to grant the exemption. But this is a, this was brought up by Mr. Curwie and we advertise this matter for a public hearing this evening. It's been lawfully advertised and it's before the board to fight for consideration for adoption. So the way I understand it was publicized though, is it for only retired military or police dogs or can it also include current service dogs for veterans or retired police officers? Current service dogs as well. I just wanted to make sure those were included because it sounded like the state statute contemplated that. Well, anything else? Nothing further, Mr. Chairman. These dogs have put in very dangerous situations, especially in the military. I mean, you have some there sniffing for bombs and IDs to protect American servicemen's life and service women. But Snowryville is considered really a budget within its sale, and it is made of state law. So we might have higher lead in different parts of Virginia, just being in some of the company as much. So Snowryville budget as a home for the district or for the state is handled really need to be as good. Any other questions? Yes, sir, Mr. Chairman, I'll try to move this along as well. I had previously asked Mr. Jewel to put considering extending the state emergency on here because I was concerned that our landfill may not have been completed. By this date, but now that it has, I think we could probably let that state emergency expire this evening So thank you all for extending that and to whatever extent it helps us with female or landfill claim I really appreciate you all extending that for last couple of months We received and actually approved tonight the consent calendar a Grant from the United Way they raised $47,000 for flood relief in our name. And the grant requirements are that basically they'd be used for residents of Tassel County who are negatively affected by the storm. And then we provide to them after the fact an accounting of who got that money and what we gave it to them for. It's fairly simple reporting requirements on that grant and I appreciate you all approving it. Now with that being said, it's a very vague grant, so it's basically helped people damage by the storm. Now there are dozens of ways of doing that. I met last week with David Taylor with the SS and Robin Boy with lunch mountain, I mean, a lunch valley community services and discussed what they saw in the storm as far as people asking for relief. They said overwhelmingly it was food loss and the people were coming in and asking for help to restock their freezers and refrigerators and we have a lot of people in the county that are on limited, and can't just go out and buy that turkey again or whatever it is that they lost. We had over $100,000 spent by our local DSS on supplemental SNAP benefits. They were $5 million spent by the state on that in total throughout the affected areas. That was the biggest payout at DSS. Clinch Valley Community Action had three or four people that contacted them about damages to their homes. They're going to try to dig those out for me because they didn't have anything to provide to them at the time. But my question is, and I think the issue we need to talk about, is do we try to help a few people that were very seriously affected, or do we try to help everybody has affected a little bit? Mr. Taylor's won't get for me the total number of people that received those SNAP benefits, but he thinks it may be clipped towards to 1 thousand people. At $47,000 spread over 500 people's 90 bucks. That may help talk to Andy Hanson, who's the town manager in Bluefield where most of the flooding damage was and he feels like he's got probably about 40 people that had flood damage to their homes and probably eight to 10 that had major damage to their homes. Again, $47,000 to try to remedy major home damages not going to go very far. So I was just wondering what approach you all wanted us to take on that just generally. Do we help as many people as we can, even though that spreads the peanut butter thinly, or do you want to try to find the people they're most affected and help them as much as we can. That's sort of two different strategies and if you'll give me some direction on that then I'll come up with one. Maybe based on need, you know, maybe they have a lot significant amount of damage but have less resources to be able to fix their property back to where it can be a way to do that. that's what I liked about supplementing the SNAP program because we already know that those people have a need that is awarded need based. We already know that due to privacy concerns FEMA will not share with me the names of people that were turned down or the names of people that may not have gotten this sufficient amount of reward. I had hoped that would give me a list of those people and I could circle back to them but apparently it does not work that way. We could do that, we could do a SNAP program that might be 50 bucks a portion or something like that. I had thought about maybe trying to split it and do 20 of it for home damage relief to some sort. One option I had thought as we could at least see what the property tax is worth. Those people paid on their homes that were damaged by the flood and maybe do some sort of calculation and give them much of that money back with it as you could. That would sort of give us an idea of the value of the home. We can dish it out several different ways, but some ways are very cost intensive as far as our time. As Miss Jewel can tell you from doing the Bandy Flood You can you can really get into the weeds on this if you can if you want to say I mean how do we even come up with a metric system? I Understand federal and state agencies having entire Government departments that come up with these four minutes one form after another and that's how that data is collected but I'm not sure how we do that here. That's kind of like that's kind of why I like the piggybacking on the SNAP program because that's already been done. Those people have already been identified. They've already filed before and probably didn't get enough then. And Mr. Taylor and we can give him that money and he can turn around very quickly. Told it out. I do know that Andy Hanson was very interested in doing something for people in Bluefield because there was a lot of flood damage up there. I think this is the most widespread disaster that we've had. County wild, they have a lot of damage. Yeah. Where Richlands would normally have flood damage and then we had a lot of wind damage and different things. I know one family that was raining at home and a tree fell on it. So they're homeless now and haven't been able to, I mean, they may have found a place. place but just for an example so how could we supplement it? One and not the other. Yeah. I think that's probably the most cost effective and the widespread health that we can. We already know the needs there. So if you would like to make a motion to appropriate the proceeds from the United Way Flood Relief Grant to the Department of Social Services for Supplemental Snap Appropriation, I can go ahead and do that. It's got about 10 minutes, Mr. Young. Yes, sir. Landfill update, Mr. Dunford gave that update earlier. That was good news. Repair and removal of dilapidated structures. I had a good meeting with the town of Lufield about about dilapidated structures. Some of you be on the board for a while, may remember that some representatives from West Virginia came in and explained to us their program a couple of years ago for removing bladed structures. What we found out in this conversation was they received a $1.5 million grant annually for three years from the state of West Virginia that actually paid the landowner to remove The dilapidated structure that's we don't have those kind of resources here So it's going to be much more difficult to do. It's also easier to get them to voluntarily do it if somebody's paying for it. With that being said, that doesn't take away our problem that we have here with these structures. And this comes up periodically from time to time. I asked Dave White, I think two years ago, to give us an estimate on what he thought it would cost to fight this problem here as they have in West Virginia and we needed a one full time person in about $800,000 per year to try to address it. We feel as though there probably is at least a thousand structures in the county that would qualify for this that would need to be torn down. So that's a significant long-term kind of a fight. The way to approach it would be to assess them all, rank them in order, like we did paving the roads, and then just eat you or take whatever money we've got, and start taking them down. How fast we proceed with that would be just like pressing the accelerator, you know, put the gas in it, it'll. So I have right now in the draft budget we're working on a quarter million dollars to pay for this year. We had that in there last year and we took it out. We had that in there two years ago and we took it out. So we'll fight it if you all choose to fight it, but I know we have a lot of other issues going on as well. So it's up to you all, but I do want to bring that up. Not enough, Mr. Presley, anything he wants to say about that. I'll talk about that in board concerns. Okay, but that's what I got that there. Mr. Chairman, we need to accept our DMV money from for dog and cat sterilization. This is a program that if you have a specialty license plate that you purchase for the SBCA for dogs and cats, then we get a piece of that money that comes back to the county. We're required that, required to use that to spay and neuter stray animals. We have a discount program with crab orchard veterinary services and essentially if you doff an animal at the animal shelter you can go there and you get a deal on it that you won't get anywhere else because we're using this money to subsidize it. But when we switched to twice a year billing, we have to set the rate earlier in the year. So the treasure can build the first half of the year. He really needs that number in March. He could probably live with it in April but March would help him. Based on our early indications on the budget I do not see a need for any increase to the real property tax rate. Mr. Chairman, the Code of Wows, this board to membership of an IDA member. We're upon three consecutive absences or four absences within any 12-month period. In the in the in the in the in the in the in the in the in the in the in the for comes here. It's a lot of opportunity. I'll talk to Miss Brandger again. It's like a note of where the draft. If it's a trouble with the time of day or the day of the week, if she'll talk to the IDA, they can't. Mr. Chairman, the Code of Virginia was amended in 2019 to allow this board to enact a Mule's Tax by resolution of this body, upon advertising of the public hearing. We held a referendum in 2018 on enacting a Mule's Tax and it failed, I think it was 51% to 49 it was it was extraordinarily close The reason we did that in 2018 is that we were in some pretty dire financial straits We're somewhat better than we were then but not much We have talked at some length about having to do something about the lack of resources for fire and the EMS services in the county. We also have discussed with the Sheriff's Office their fleet and its aging, the cost of this equipment, fire apparatus, sheriff's vehicles, ambulances is going up much faster than our ability to pay for it. What I'm asking for the board is the board to consider holding a public hearing to enact a meal stacks. What I would like to do with that tax is to annually fund fire apparatus, ambulances, sheriff's vehicles, and most, Mr. Brooks presented a plan to this body last year for a part-time fire department. Our population is declining and our population is getting older. It's harder and harder to recruit volunteers. People that we do have usually drive longer distances now to commute to work. They don't have the time to volunteer. Both parents work on a household and it's really hard to get away when you're sharing those chores at home. It's becoming challenging to staff this exclusive with volunteers. At some point if we don't start investing some money in training and paying some firefighters, we're going to have a bad incident when we're all a little bit. We can't enact the tax tonight, but it has to be advertised for 60 days. And what I'm asking Mr. Chairman is that we consider to hold a public hearing to enact the tax. I don't need to make a motion? Mr. Chairman, I would advise that we hold a public hearing in March and April because we have to advertise it for two separate public hearings, given that it is a new tax under the Code of Virginia. We are past the six year moratorium for the failed referendum, certainly an appropriate time to do so. Were we to adopt the ordinance in April? Or I mean, were we to adopt the ordinance, the ordinance would be adopted in April? We've done a little bit of research, and these counties are very difficult to compare apples to apples. Some counties have more tourism, some counties have interstates, there are reasons that they may have more people eating out. But what we believe is that this should consistently bring us about a million dollars a year, maybe a million two. This would not be in addition to any tax imposed by any town. If you're in a town right now in Tazzle County, you're paying this tax. If you're eating a restaurant in that town. This would not be on top of that. This would be only applied to restaurants and prepared food, located outside the corporate limits of any town. So, to me, rather than coming here and ask you annually for increasing the burden on property owners by increasing the real estate tax or increasing their vehicle tax or increasing some other assessment on our people, this is our only opportunity to tax people from outside the county that come through our county and stop for Hamburg or Obiscus or whatever it is. Also, it's a voluntary tax to some extent. You can choose not to eat out if you don't want to pay the tax. But I do think we need to find a revenue stream going forward for our public safety through the school board numbers growing, services numbers growing all these other numbers that we've talked about many times year after year these budget presentations over which we have no real control are going up and up and up and that's just increasing the burden on property owners here in the county if we can diversify our tax, that will give us an opportunity to fulfill some of these long-term obligations. Mr. Chairman, if I may, in terms of consideration of the rate this board has the authority to impose a rate as low as one half of the percent all the way up to the statutory maximum of 6% on Meal's taxes. Yes, I think we need to, before we go, I think we should go ahead and set public hearings. We need to have percentages based and see what we can do. But these fire fires, and especially to the Sheriff Department, we might not get funding for the SROs in the future. The investment cost is $100,000. So if I need to make a motion, I can make one. Mr. Chairman, the only thing I would like to add is to understand the the need of the mills tax and I can definitely sympathize with the financial situation However, we can continue to see inflation impact our citizens and rising cost And I think this would just be an additional burden on our citizens. That's all I would add. I think the second thing I would add to that having served on budget committee last year. And we're in a different spot this year, understand the crunch, particularly with the revenue streams that have typically been devoted to first responders and agencies outside of the county umbrella that we also help fund. But for me, I think that there's two options though that should be potentially explored. I think to give prior boards credit where it is due, they solve it to do something by public referendum. I know maybe different people disagree with me on the principle of that matter. But I think that allowing the people to exercise their right, their constitutionally protected right to vote is something that is important to me. It's a tough decision. Certainly I'm not up here criticizing those that would support it because there's a wisdom in wanting to ensure longevity in designated, particularized revenue streams that this county, albeit dwindling, where that's coming from can be used to protect our first responders and their equipment and their buildings and the personnel that we've got. But that's just kind of where I stand on. Mr. Chairman, it's my understanding that the ability for a county board of supervisors to request a referendum on this issue was amended by the Virginia General Assembly in 2020 to take that out of the hands of voters by referendum and to put it in the hands of the county board of. So state government says we can't even do it by referendum anymore. Correct. Well, I just know the fire that the EMTs and everybody have been lacking the money they need for years. So we have to do something for them. Hopefully in our budget we can find and help people more. But this issue should probably be fixed back in the early 2000s, whether they're funding or their equipment. And the good thing, I can talk from experience about mill stacks. As a bluefield Virginia, we had a report done, and then we were talking about raising property tax doing this. And basically, you want to mill stacks as a transient tax. You keep the burden off to your taxpayers in our town by having a mill stacks. That's why we did it. Because we bring in so much money from our Walmart, our lows and our sands and people eat out, majority people there, not local people, bring in other other monies there. So it's a good way to keep the burden off your taxpayers too. That. That's what we found out when we did it. And you're 100% correct Mr. Presley and either to keep the services to the county we either have to raise real estate taxes or we have to enact something similar to the mills tax. Either that or we cut services. And that's why I say look at it over a course of five year rate so it doesn't hit everybody home. And it's unfortunate. And we did one, we did two, one, to send increases while I was on town council to help us tremendously with our pay for our police officers. I hate paying taxes. I really do. I hate to do it. But that's just the fact of life. But we have real issues. that people don't understand here. This year, the sheriff went up the Richmond, was a October 1st and had to talk to Glenn Youngkin, because they forgot to put money back into the budget for SROs. So that was going to cost us if they did fun about 300,000. So if they don't fund us from the future on every year, that's going to be about 100 could it be 300,000 per year on top of each other? If we keep it up. If we don't get any funding, so we could potentially look at what, 1.2 million, for just SROs in the future four years, if we stop getting funding every year somewhere around there. And that's huge. Hey, I think people would pay a tax knowing that their kids are safe and they're getting fine resurfacing their house. I really did. So. Mountain. I think it's two, six years, we did put this on the ballot. The citizens of Taisal County rejected it. I understand there are many reasons they may have voted no, but our citizens have spoke on this. And I'm not sure their minds have really changed over the last six years. I would just like to say, has a former small business restaurant owner, I hate this tax? I felt like it was a penalizing people for eating in town, but at the same time, I've been watching the fires in California and how they were not prepared for that emergency. And that is something that we have got to move forward on. I feel like I've been looking at the whole county. You know, it's kind of like a New Year's resolution. And what I perceive as our biggest weakness in the next 10 years is our lack of funding for our fire department. And I mean, I voted no on that referendum several years ago, but I just don't see how we have an option. We have to move forward. And I have to give a shout out to Tazzle County Fire Department and dad fire department the school started flooding on Friday Tazzle the public schools had a small pump and it had not moved all day and I called In a shout out to Barry. I should call Barry Brooks and he showed up and several members out there showed up and they spent their Friday evening that they could have spent with their family helping us save our school and it did not get in our school and I'm completely convinced it's because our Fire Department showed up and that was not there. That was not their call. Many of them. I think I see Scott. Scott said he wasn't going to get to tell his four-year-old goodbye before she went away for the weekend. And that's the sacrifices that these people make for us on a day-to-day basis, as well as risking their lives for us and for very little. And I think no greater love has a man than his friend that he laid down his life Well, I guess I said that backwards, but you all know what I mean and we are you all are greatly appreciated Go ahead and they're undocumented V dot workers too. They do lots of for free Rustos that they do they do work that V dot Yes, and I would also like to add our sheriff's department to that as well. But they do get a little bit more funding than our fire department. So I really just want to lean on that fire department. And you know, heaven forbid, we have a big problem like California having, but I want to make sure that we're moving forward and being prepared. So that when it does yet that we are ready for. Is the emergency services committee ever passed a resolution recommending this as a mechanism to fund? far departments or I don't know that they have that really how we come up with the money generally is not within their share. It's chairman I think one of the saddest days I've had in this job is Barry said you're gonna ride with me and I'm going to show you the state of our fire department buildings and they're old. I mean they're just old and we don't put any money into them. And to our guys are getting older too so eventually your nukers are going to be less and these guys are not going to have equipment. Who wants to do it? If you're not, hey, we'll take care of you guys, we'll take care of you. We have to do it. The impression this can't do long down the road. It's not quite clear in Washington whether or not there are. Last year we made several earmark applications. These are earmark as a slang that we use. It's directed spending and last year we were awarded a significant grant for congressional directed spending for first responder communications about 3.5 million 7 million I can't remember exactly and we're working on that grant we also applied last year for a grant for a small earmark grant for War Halt Park. We applied for a grant for manhole replacements in Dorian to replace the manhole so that we don't get rainwater in our superplant. And we also applied for monies to help the clinic that we're building here in TASA. So those did not make the cut. They were all put on their list by our respective senators and congressmen but the committee whittled them down. We got the real big one that we need it so I can't really complain about that. But that season to apply for those grants is coming around again in March. And I reached out to Miss Cordell and asked her if she had a more concrete figure on the manholes. She applied for and received a grant to pay for a study. That's one of the things that hurt us last year, so it really didn't have a, this is how much it costs per man whole kind of deal. I still don't think they're gonna have that study in time, so I don't think she's gonna be in the running. There's a different grant program called BRIC, which is building resilient infrastructure that we can apply for in the fall for that money. So I think we may do that, but I was looking for ideas for projects, for earmarks, I we may do that. But I was looking for ideas for projects, for earmarks. I can tell you that I was told when I went to Washington that they aren't really interested in feel good, warm, fuzzy projects. They want hard core kind of infrastructure projects and I would say that's more the case now than in the past. So if you have any ideas either that you have or your towns have that things that they would like to do let me know and I'll see what merchant Mac and Kyre can do but we really need kind of products that have sorted all part numbers with So do you think about that Costadio contract Several years ago we had a reduction in force in our custodial department of about three people and we contracted out custodial services for this building the Commonwealth attorneys building the building inspectors building Mr. White and I have looked at that we think we've made some efficiency improvements in the personnel that we still have in those positions and we believe that we can hire a part-time person and fulfill that contract for basically the same amount of money. But what that then gives us is a person that if they need extra manpower to courthouse for some wax in the floors or something like that, we can pull them into it in a way that we can't with the contract. So what I'm looking for is a motion to not renew the sparkle and shine contract for custodial services and then in the budget process that same money will show up in the payroll for a port time position to try to perform those services here and help elsewhere if needed. The custodial contract, how many people are utilized under that contract to perform services? I would have to add, I will tell you it seems like it's a different face every time somebody shows up. They've had a really hard time staffing those positions and they've struggled at times frankly to perform. I mean, I mean, people once they use, I don't know. I don't know if they have one lady that's here all night or if they have three people that are here for two hours, I really don't know. And this is the early morning's here, I think evening and building inspection. Is it evening here Susan? Yeah. I guess what I'm getting at is that might need to know whether or not I need to abstain based on who the people were. OPO, the Abuse, Bateman Committee update. Mr. Chair, we solicited advertisements for companies to provide residential rehabilitative housing somewhere in Tassel County. We received three proposals, the committee that you appointed a subcommittee to interview those agencies at length about their proposals. we've informally ranked them, unless something comes up in the interviews that we aren't expecting. We think we're going to have a pretty good proposal for you probably in March. This may, well, I would hope this is a softball question, but having been involved in a project with a impatient, you know, people staying in one place type of facility, are we confident that the three proposed groups are not under any type of state or federal investigation? I haven't done any background stuff yet, I can't think through any of those. I just know I can't remember if it was Dickinson or Wise County went very, very far in a impatient facility project similar to what this subcommittee is doing. And I mean it just hit the news. I think it was a few months ago, I can't remember how long ago, but they ended up in some pretty big trouble. And the proposal we have, the leading proposal is from Fairview Housing. They have one of these facilities in Abingdon, that they just opened, they also have one in Bristol, Tennessee. They had a very good, perform a financial model. That's the important thing. We've had several of these groups come to us and one of the reasons we issued the advertisement is we weren't going to base it on just who showed up at the meeting and asked for money. And they have the only financial model that did not require an ongoing annual subsidy from this board. For example, one of the proposals included an annual payment from this board of $250,000 just to make them payroll. But this group, what they are asking for as we interpret proposal, is a one-time contribution capital that helped them modify an existing building so that it can house these about 40 residents. So if this works, it could be news. It could be something pretty good for us. Where's the building at? I'd rather not say because they don't know that they've acquired an interest in it yet for not. Okay. I'd rather not say because the price of it's going to go up immediately. It's going to go up or whatever you've got in the bank. I'll talk to you. Consider advertising for feasibility study of natural gas extension in the Western District. This is a DHCD grant. Yes, Mr. Chairman. In this year's state budget, we were awarded a $100,000 grant to do a feasibility study on a natural gas line from pounding meal to the Russell County line along the 19-Cordor. And I need a motion to authorize me to go ahead and advertise for firms to conduct that study. I don't know that $100,000 grant is gonna cover it all. We'll see what we get from the proposers. But the feasibility study is basically going to look at a ballpark estimated cost,, ballpark revenue, and what's going to be required from grants, hopefully from the state, but probably from us as well, to get it built. So I do know the Lane Group did this for the PSA back in 2012, and did an excellent job. Unfortunately, they had them look at from pounding mill back to Tassel County through Baptist Valley and that did not cash flow because residential revenue is very small compared to commercial revenue. The amount of gas that for example consolidate steel would use will be far more than 200 homes in Baptist Valley. So does solid A still not still want to have gas? Niffs there. Dating. Yeah, that's a major impediment. That's the western end of the county. Yeah, it would be huge for us down there. I don't know why. I'd say for a ton of money put back into the business too. Sure, Mr. Robotica has approached me as a member of our airport authority, advising us that the airport authority is looking to borrow an amount not to exceed $500,000, which would assist the airport in financing the cost of capital improvements to the airport, namely new hanger facilities there at the airport. The airport authority will be borrowing this money through the Virginia Resources Authority. They have a Virginia airport's revolving fund that purchases those bonds. As we did last month with the PSA, the terms of those bonds require that the county enter into a non-binding support agreement, which is essentially a moral obligation as the county itself cannot borrow money. But the RA wants to know that the county will back the airport authority and the event that any repayment of that $500,000 is required. There are two actions that would be relevant to tonight for the board's purposes. The first would be a resolution authorizing or the adoption of a resolution authorizing the execution of an agreement providing for non-binding obligations of TAS will county Virginia to consider certain appropriations to the Towswell County Airport Authority and agreeing to certain matters related to the issuance and sale of revenue bonds of the Towswell County Airport Authority, to the Virginia Resources Authority. That would be the first motion I would request that the board entertain. First, let me give some background there. I'm not sure if it was through the build back better, B.I.M.O.L.O.L.O.L.O.L might correct me on this but what we were like $580,000 I believe, that we were awarded the FAA and Virginia Aviation to go towards capital improvements. This additional money here would go in hand with that. I don't know that anything has really been done to the airport since last hangover was probably built in 2014, maybe 2012, the big hangar there. And we're at 100% capacity now and there's still actually a little waiting list for new hangar. So as far as getting the loan and getting the notes paid every month, I have no doubt that we can make that happen. So anything you all can do to support us with. Great appreciate that emotion. We get more waste from that convenience area than we do anywhere else other than the Cedar Bluff transfer station. It's coming in fast and pure already. Have two dumpsters there and that can hardly keep up. It is unmanned. There's nobody there to see who comes and goes, what they don't. Of course everything takes money and everything affects the budget. Is this the same issue with the judges when they feed the police to their job and get people with money, they're not prosecuted in the way they should. I think that's part of the issue. I think if you fix that, that'll help. But still you have to increase the probability that they get caught. Oh, I'll say we put cameras in the camera roll. But we had cameras before the ticket went away and we just sort of gave up on that. Mr. Chairman, I will say to that in, the Community Criminal Justice Board meets the morning of March the 12th, and I have contacted Crystal Kraus and had us put on the agenda for a discussion with our judges as to that particular issue. Make sure someone also reaches out to Care and Alice, and I think she's the chair of our board right now. And I know there's logistics for that board will will have shifted with the passing of Alicia who helped run those meetings. So just make sure Kieran is included on that. I'm sure Wilm is true. No, I think something needs to be addressed. I know I've reached out in the Shares Department. Shares, very receptive of, you know, not becoming a partner. They've always been a partner and a necessary party to this. I just know, at least with my experience on this board, more complaints have come up in the last six months than they have in the last three and a half years a half years, so far, three and a quarter. You know, I know with regards to Baptist Valley, Jimmy McGuire had reached out to me. I never got a response from him, but he said that he has seen several people out of state at the one and Baptist Valley. I don't get near as many complaints as they used to be. I would just say is there any possibility like when you go like out of town and that they now have those like like toe lanes that you just drive through and they take a picture of your drivers your license plate and then send you the bill Can we not get their license plate and send them a bill and have it posted? I think they're being out of state. I don't know if we'd have jurisdiction. Right. Town of Bluefield recently finished their contract. Now it's fully operational. The picture tickets. And they just had their first docket a couple weeks ago, as my understanding with those. And at least in Virginia, there was a lawyer who's running for House delegates seat on the other side of the state but he ended up finding a lawsuit in those state and federal court challenging various things about those and ultimately they were all held to be completely valid and I think misplasters on to maybe something that could be utilized as negotiating with a company that has those to simply set it up at the convenience areas. And you know, if you're not a, I mean, I don't know how you regulate non-Tazel County but Virginia residents, but at least out of state could be captured that way. We could try that we could look in this technology. I mean, then that comes back to ultimately the judge back. Well, we got to talk to the judges. We got to start embarrassing those fools. I mean, we can't stop. I'm sorry about that. I'm sorry, but can you just not send them a bill and then if they don't pay the bill, they get a collection. I mean, the town's do that. Towns do that, but I don't know. I think we're being too nice to these people that are doing it. We got to start America. That's just my- Well, the problem with fines and costs now is that the courts and clerk's offices had much of their authority stripped about four years ago. So they can no longer issue a show cause. If someone fails to appear on a traffic ticket, that's fine. They'll just try them in their absence. But then when they go to assess the cost and say the judge issues a fine for you not wearing your seat belt or your Speedon or whatever it is. There's very little that the courts and clerks can do to collect that money because it's It's only particular cases where they can drag your rear end back into court when you When you don't do those things and I think the other issue with the camera system is what happens if you're dropping your group, you live in Bishop or right over the state lawn and in West Virginia, but your father lives in Virginia and you go pick his trash up for him and you drop it off at the convenience location or if you're borrowing a vehicle or a lot of people don't switch their registration over. So I think you're going to have to prove that that person does not live in Tazel County or in Virginia. But I think my biggest concern, of course, people are breaking law. I want to see them prosecute and brought justice. Only at Baptist Valley, in particular, the only concern I have is if they're not going to dump it at the convenience location at Baptist Valley, they're going to dump it on dry fork. They're going to dump it on grassy spur. They're going to dump it off the side of stony ridge or go over on mud fork. And I think's my only concern is that They're put into a dumpster at Baptist Valley if they're not put into the dumpster Which dumpsider they're going to be creating and then we're going to have to go and clean it up and then try to Locate new dump sites and then try and identify who's doing it that that increases the burden and And then even once you start identifying, okay, they're dumping at this dump site, the moment you go after someone gets caught, then they're going to find a new dump site. And then we're going to have a lot of back roads in that area with trash. So I mean, I think either way, you're dealing with trash issue, but I think the question is, do you want your trash put it in a dumpster or do you want to put it or do you want a dump side on one of these back roads? That would be my only concern with the Babs Valley location. So, but is it your position that you think it's cheaper for us to take out of county or out of state residents trash for free. Do you think that's cheaper? I'm not saying that, it's necessarily cheaper. I'm just saying that if they're going to dump anyway, they're going to have to go to the dump. Yeah, if they're not going to dump it in a dumpster, then we run into the problem. They're dumping over the hill so you have issues with, what if that's your property that someone's dumping trash on, what if that's near your house, and then, you know, for tourism and other, you know, reasons that you have a bunch of more, you know, litter and stuff. And then also the resources to catch someone doing that, you know, you're putting cameras up at the dump site Our code of force officers doing an amazing job already and our litter enforcement. They do an amazing job But when you keep it's just gonna add more and more of these illegal dump sites And then once you get one shut down, they're just gonna create another one. I think that's my concerns It's not it's not necessarily whether or not it's cheaper or not to take out of state trash. It's that would you rather it dumpster would you rather it on the side of the road? Is there no way these laws are going to change that we can start doing part stuff to people? Well I don't think the issue is the law and you know our Commonwealth term does a great job prosecuting this and our sheriff's office does a great job building the cases. I think the issue lies in the interpretation of the law by the judges. And when we did a mass roundup, I think five or six people were charged in it. Or major Hankins could may have more knowledge on me than we charged. But I know we charged several individuals. It went to court. And the judge said, well, yeah, you did not put in a dumpster, but you were trying to, you threw it over the fence. Although the gate was closed, you threw it over the fence. And there was right next to the dumpster, at least it wasn't on the side of the road. So then, so now you have, you know, a case where the judge is saying, hey, the wall doesn't apply in the situation. I think it depends on the conduct. I mean, we're limited by, with a lot of this stuff, we're limited by what punishment our current ordinance contains. It's been a long time since I've actually looked at the ordinance, but last time I remember it basically reflects what the state statute maximum is. So we haven't limited it ourselves in any way. What about today? Is that a classical mismainter change? It is, mismainter change. Well, if it's just, I'm not sure that dumping out of state. If you're now a state resident putting it into into a dumpster here It's not a misdemeanor. It's only the legal dump side. I think it's a misdemeanor, but it's a lower grade misdemeanor But but it's just lettering yes Yes, if you just dump it wherever you want to that's a it's a plus one the issue particularly bad as Valley is it it magnifies a problem, and I hear what you're saying. I mean, they'll just dump it somewhere between there. I get that. But most of these sites, we've contracted with these property owners to take trash on these sites. And it's a mess. For whatever reason, I don't know if it's a disposable world because of COVID or what it is, but there's just a lot more trash than there was a few years ago. And these property owners are getting fed up with having all this garbage there. And the reason that we can't handle it is we're paying to have that pulled and cleaned. And if we wanna do do two dumpsters instead of one, then that's twice the cost of having it pulled. And then if that dumpster fills up, it's one of these things. However many dumpsters you put out there, you're going to fill them up. And that's what worries me is eventually some of these property owners are going to be saying, you know what? I mean we had one last year in the Southern District that we had to get on our knees and beg him and bleeding to keep it there because he was just tired. There's businesses coming in to follow smells and stuff. Yeah, that's the problem too. You need to find out. Yeah, I also contract as you dodge our landfill fees by dumping in these dumpsters and we see shingles and and construction supplies dumped in there. The other thing is West Virginia charges everybody to get his landfill. They're saving bucks. I guess my point to what you're saying Mr. Crouy is that I think we are beyond the analogy of don't let one bad apple spoil the bash. There's a lot more than just one in the situation. But I mean, I understand your concern. I made, maybe I was foolish in doing this. Last year I remember trying to get some type of mindset around, well, what would do it a do her countywide look like? And I got met with a lot of pushback on that, but I was, one of the things I was reminded of is 70s or 80s, something, somewhere in that time period, they did have some do it to do her service. But the trash in some of these more remote areas was a significant problem because those that either wouldn't put it out or maybe they didn't have a route that ran at a convenient time and it just put it on the side of the road somewhere. So I'm not saying your concerns are valid. Well, and you know I don't know if creating a man's station or I know that's costly at Baptist Valley. Yeah, and I think that's a nod I did to look into. And I'm not saying that other areas that, you know, meaning or doing some kind of enforcement action, my only concern is when you're dealing with out of state trash. You know, if you're dealing with a county, the citizens, you know, they're going to be less likely, I guess, to want to dump their trash somewhere they're going to be driving every day, right? But if you're coming out of state, so it's not just it's not your can, it's not even your state and you're coming over, you know, you might not have as much concern, you know. So I guess that's where my issues lie, but I don't mind trying to enforce it if the judges are on board. I just wanted to address my concern about the potential of illegal dump stations or dump sites. You have more trash dump hills like in Bluefield. Yeah. One thought that I've had and discussed with Ken a little bit is, and this is not popular, but if you consolidate it and went to fewer, then we could reduce the fee we're getting charged to pull them and use that money perhaps to pay people part time to man the ones that we do have. Because what happened was there's a period of time from about 2010 to about 2015 that we just sort of put these everywhere. And there weren't particularly well-bought-outers conceived who's going to man them and how much it's going to cost to haul them from, I mean, a haul from Tannersfield is not cheap, you know. But anyway, I mean, that's one thing to look at because we've got so many that you can't man them. You talk about 15 people that we'd have to pay. We could pay one person and just have them do sort of a rotation. Like every day he draws a spot out of a hat and he goes into parks there and sees what he can be. You know, we can look at it that way, but I think we need to address this in some way and I think ignoring it is just going to be a worse. I think this is one of the biggest complaints that you all get. I may be wrong, but it seems like just from what I'm here and the roads are much better than they used to be. like the the trash is really kind of the complaint that we're getting and we need some money somehow to go around and I've got my in-game goal for me would be whether or not there's a recognizable difference in our trash volume that we end up with at the landfill on an annual basis. Because if we put in some kind of enforcement mechanism to better protect the assets that we provide our residents, and then we also save money on an annual basis because we contract that, well, yeah, we're actually below average with what we're getting from these convenience areas. And I mean to me, it's a no-brainer, but I'm not confident that that information can be tracked. It would be very difficult to really illustrate that. Before we go section 17135 for Hivitz the disposal of waste outside Towswell County or from outside Towswell County And that still is a class one misdemeanor as it codes really interesting. Yes Is that gel wool where it is a class one or one of those specials? Yeah, it was hamper. So if you find a you charge them and then they don't show up the court can issue a cape? Mr. Chairman, I'm glad that Mr. Collins brought it interrupt me because I had overlooked a couple things here. I received a letter from the Extension Office asking for help with the 4-H camp. They're looking for scholarships. There's $195 fee per camper and they're asking us to sponsor campers. I've got that in the mail, I'm going to present it to the board. I don't know if you all are interested in getting what? When did they, when's that second? July 21st through 25th 2025. Pass that over to March maybe I reach out to. Sure. Susan if you could add that back to the agenda for each funding request. And the second one I received actually after lunchtime today from Gigabene. They're applying for a BED grant application for funding to extend Internet service throughout Tazzle County, which I think is interesting, but they didn't tell me where in Tazzle County they intended to do it. I really don't have enough information to tell you whether or not I think we ought to support this. So what I may do is I may contact Mr. Wirtman who sent this to me and I may pull you by email. So the Abel-Ajian Power Rate Reduction Act passed the house today that is going to be a house bill 2621. So that was the bill to deal with AP with their, I think it dealt with freezing rates and also deal with the rate increases to try to prevent those from happening in the future But that did pass the House delegates and we'll go on to the Senate and I just wanted to thank Adele get more filled for his leadership In getting that bill passed I thought the Senate bill passed too. I think so For I think both well senator haquer is the Senate. There was another one. Yeah, there was a second one. Yeah, so there was a second one. Now the first one failed with the second one. There were several bills and I think they've got to combine into one. But I would also like to say Senator Hackworth too for everything he did for us on the Appalach Power. Bill's. That's all right. Supervisor Robotik. I was going to piggyback on this plaster's flooding issues at Richlands Elementary School. And Mr. Yombe, you have any updates on when the big fix for the flood events the waste plant? You know, Mr. Chairman, I thought about that over the weekend and over the course of probably 10 or 15 years we have basically built ourselves into a hole. We built up the football field, we built up the practice field, which is now with baseball field, and we built up the softball field, and we built all around Illinois and school and put it in a hole. The big factor was when they excavated and used the practice field as a spoil area there, we kind of crushed a pipe back in O809, whenever they reconfigured the football field. And so we've had drainage problems there since. We approved in our budget in the spring among that list of items we approved for the school board for $480,000 for them to fix that because they said they already had a contract executed to proceed with that. And they did so, they didn't go through some hoops for the Roach and Sediment Control Permit, got delayed. So that didn't get fixed in the fall. We applied for in the meantime for a million dollar grant to fix the broader issue which is once you take the water away from the elementary school where is it going when you do with it. And this was to build a small detention pond and then to improve the ditch works along US 460 as once we cross that property along with two restaurants. So that is underway, that's under designed by our engineers at RES right now. We were awarded that grant in July and we signed the agreement on that grant I think in September so we're pushing for the bigger picture fix and I've asked Dr. Saci for an update on where they are on what we decided was when we met with the mayor and Town manager on what was going to be the interim fix down there We're having another phone conference later this month to see what can we do To keep this from happening until we get the big fix done But one issue you have is you really you just can't dump that out on 460, you know, we won't really have problems So but that's that's in the works. That's underway and the good news is we had a million dollars in state money to fix it So yep, yeah, well I've got one more night Yes, sir. I know the landfill has been a big issue and it's kind of taking a lot of your focus and energy. Our transfer station there and Cedar glove though I know we had a plan to work on fixing that and making that a walking floor station. I didn't know if you had any updates on that. I should have asked Mr. Dumpford about that because we kind of got distracted by trying to get the landfill open. And I spoke with him and what we're going to do is we're going to go ahead and get proposals for design on that. He's going to approach a couple of engineering firms we know. Hopefully if the estimated costs is low enough, we don't have to go through any kind of advertising process on we might try to design it the spring and try to start working on it in the summer or fall. We had hoped to design it in the fall winter and build it in the spring but I think we're going to be off about those four months but that's still in the works that's still in the budget.
