On Saturday, September 21st from 9 a.m. until 12 noon, the city of Torrance will host the annual coastal cleanup at Torrance Beach as part of the International Coastal Cleanup Day. This global event unites millions of volunteers from around the world to remove harmful debris from beaches protecting marine life and promoting a cleaner coastal ecosystem. Locally, the volunteers at Torrance Beach will help to keep the shoreline free of pollutants contributing to both environmental preservation and enhanced tourism by maintaining clean and safe beaches. Participants, including students, can receive up to three hours in community service credit. Just last year, more than 7,000 volunteers signed up across the Los Angeles County region with Torrents being one of the most popular locations. Throughout the region, more than 16,000 pounds of trash was collected along 97.5 miles of beach. But before I do that, I would just want to read a couple comments here. Through 10 months of patrols, there were 11,222 total contacts, 11,222 total contacts with 186 unhoused contacts. This alone tells us how much effort or staff with the collaboration of this agency that we do to prevent homelessness in our city. And I just wanted to acknowledge and thank our staff for this. It seems like there could be a lot of things that these, I guess, these contract security folks can help. So I just want to see that, you know, if we need to help in any other items that come up in the after hours, potentially even helping code enforcement, is that even the possibility? I'm just thinking since they're already out there, they're in a very, very laid out. If they're through, it allows it. On a high-quality imagine, that is a specific scope. I'm not aware of any major challenges requiring their support on the regular routine for PD and court enforcement. This item essentially is requesting council to adopt a resolution that would authorize a dig restriction to be recorded against City on property, commonly known as Magiorena Marsh for a 2002 grant opportunity that we received through the State Department of Parks and Recreation. Community Services staff is currently working on executing this grant project essentially to establish an outdoor educational facility at Madrid, Rotemarge. However, in order for us to request this person to grant funds, a D restriction will need to be recorded against the property for a performance period. And then from that point once we got the direction or the authorization to proceed with the grant agreement, our staff has been working with the state on providing the necessary paperwork, as well as providing progress support towards being ready to proceed with construction. However, there has been delays of course with the pandemic as well as staffing shortages. So we're now at a point where we're ready to proceed with the project. However, in order for us to be able to get the grant funding so that we're not relying on the general fund, we want to be able to use the grant funding first. We do need to record a deed restriction. I will note that during the time period that this action originally took place in 2017 and now there's been kind of a shift of saffonies even in land management. So that's where land management kind of comes into play with this item even though it's a community services project. Land management handles all the property documentation. So at this point, we haven't received any funds. We still submitting the paperwork. That's what the case or. So the only thing that's pending now is to record the deed restriction. As soon as that's recorded, which as soon as we get the authorization council tonight, we'll go ahead and proceed with recording. We can request for the dispersements or grant funds. So it also states that educational opportunity, does this mean we'll invite our school districts and others to take advantage of this educational and provide. On June 24, 2024, the Armed Forces Day special standing committee convened for an after-action meeting to review NSF's, the events held from May 17 through May 19, 2024. This year's celebration marked the 62nd annual Armed Forces Day Parade and celebration, and included a series of activities designed to honor and celebrate our military. The events for this year's celebration included a welcome reception for military dignitaries, military exhibits that were open to the public at various times over the armed forces day weekend, a luncheon, and a dignitaries dinner, and also the Highly anticipated armed forces day parade, of course. Unfortunately, the Friday night military concert was canceled this year due to challenges in securing an available military band. We recognize the disappointment this may have caused and are committed to addressing this in future planning. During our after-action meeting staff provided a comprehensive overview of the event highlighting both successes and areas for improvement. I am pleased to report that overall the events were well received by the public. Importantly, we did not encounter any safety or security issues. That's, I think, by far one of the most important things about having these events. Looking ahead at 2025, we have an exciting opportunity to celebrate the upcoming 250th anniversary of the United States Army. As a result, we proposed that the army will be the featured branch in next year's celebration. If the City Council elects to proceed with the planning for the 2025 Armed Forces Day Parade and celebration, this will mark our 63rd annual event. In summary, the 2024 Armed Forces Day events were a success. And we are enthusiastic about the potential for the 2025 celebration. At this time, the city is currently experiencing significant development interest with approximately 600 residential units, and over 600,000 square feet of industrial space proposed throughout the city. While new housing and development will help boost economic activity, new development will also come with increased service demand request for the city. As the council is aware, the city currently applies development impact fees to pay a portion of the cost identified for public infrastructure and facility improvements identified in what's called a city's needs list. However, this one time funding for infrastructure and facility costs cannot be used for operational costs and therefore restricted per use in narrowways. A recurring revenue source to recover the increased costs related to the influx of new multifamily residential developments such as public safety, park services, recreational programs and street maintenance can be achieved through the creation of a CFD special tax. On January 23rd, 2024, the City Council approved an item presented by the Finance and Governmental Operations Committee recommending that we move forward with the creation of a CFD. The first step in affecting the council's direction is to add provisions to the TMC regarding the mitigation of project-related adverse impacts through the fire by the yellow. And the areas that are identified throughout the city that are adopted by the city to be appropriate for heavy manufacturing or not are already part of the city's general plan. So for 10 years. So basically how the report was created was it took the number of square feet and units that are currently being proposed at this time. So essentially it's a snapshot in time. So based on the number of units, so for example, based on the 1383 multifamily residential, 255,000 commercial general and the 507,000 industrial light square footage. And the projected build out time of these particular units. That's how much the revenue would ramp up over time because in the first year whatever that may be you know that would only be 284,000 and then as more units are added in each individual year, the revenue will increase. Gotcha, okay. So in the table at the top, for industrial heavy, there's no annual revenue buildouts. That again is because this is as a snapshot in time. So this won't, it's not an exact number for what we will actually see. So for example, if CDD had gotten an application for a project for industrial heavy tomorrow, then they would be assessed at the proposed rate of $30 per square foot. But at the time this, as of the date of the report they used, we didn't have any being proposed. That's why it's zero. So your formula for single-family residential is $560. Correct. So it had to be calculated because according to the law, we can't exclude certain land uses. However, what we can do is designate, I guess, parameters for which projects will be eligible. So while we can't exclude single family residential, what we can do and what is proposed here is that we will only be including those that are five units or more projects that are, which are essentially considered multi-family. For future. Correct. And just to remind you, this would only be for new projects after the CFD is actually created. With five or more units. Correct. This item doesn't even create the CFD. It just allows us to then put a requirement under there as a conditional approval that a development either annex themselves, so they have to opt in to annex themselves into the CFD or provide some sort of one-time payment to be able to mitigate the additional costs. So it's negotiable from this point on. It's very flexible. Is it good deal to pay num sum in advance or huge difference or? I'll give you an example. So actually have an example. I imagine in Michelle can chime in because she has experience with these Developers that the majority will still opt in to do the annual because the annual to them is not very material. However, Justin is example for a 40 unit multi-family that elects to make this one-time payment based on a present value calculation. The annual tax for the 40 units is only $11,364. If they wanted to do a one-time unit and get it done and over with and not have it on their property tax role, they'd have to pay $1,136. Yeah, that makes sense. OK. I mean, it seems like it's not a lot burden on new projects. It's just to make sure that we meet, like you said earlier, the development, the infrastructure, and kind of thing to make sure that we meet, we don't go under because of the new projects. That's correct. The proposed rates here, the reason why they appear to, I guess, be affordable and they're also low compared to other cities that have a CFD such as the City of Carson is because the direction of the City Council was to use the methodology in which we also incorporate the revenues that are so much more than any cost of the project. So what do you want to do? I think we're really visiting this. I'm pretty sure it's going to be a good time. So, the next item that we have come into is the actually Identify a project that we We'll come back to City Council and then on page four of the items, this is all of the action that's going to be needed. So this is really just the initial step. And then once it's formed, once we have that property, every year annually we could, if Council directs, come back annually with an audit report, let's say, where we're tracking all the revenues. We actually have to track the revenues and the new costs that we're basically using to pay this war because we're not allowed to use it for existing services. But every year the Council can give us direction to either not charge, to charge under the maximum rights that are proposed, Council can direct not to charge them at all. Council can also change the parameters by which the eligible land uses or even the number of units that are eligible would be then required to do so. So there is flexibility on an annual basis for council. Actually not even on annual basis. And at any time council can direct to make changes. But I think my point is that we should analyze in a way that at least we break in when we don't go under. So do we have any plan to revisit that in six months or a year to see what data tells us? Is that the proper formula, the amount which is charging, is that the proper no direct correlation between a specific development or let's even say a number of developments, the direct correlation between that and increased revenues. and the additional costs. What we, I mean, we'll have like certain KPIs or whatnot. So for example, for public safety, we can track, has there been an increased number of service calls over a certain period of time? I believe that's something we already track. And we've already noted with the increased development just over the last several years, those calls have increased. So we can track stats just as that, but like I said, it's difficult to correlate specific developments with increased costs. I guess it sounds like it's hard to see the crystal ball. Let's just maybe help clarify. For example, we have a few development that we already approved in the past. Let's say, the coldures in your living just pretty much, they're moving in already over the former cable. Those were approved, so they will bypass this so as a legacy to under unit department over there next to culture. But let's say the next one that will come wherever it comes for us. the the I get that right. This should not deter any new development projects. If you said earlier about the other neighboring cities, they are charging similar. The neighboring cities that have a similar structure have a significantly larger, I should say higher rate than we're proposing. And that's likely because they're charging somewhere close to what their, their consultant has calculated as the maximum cost. So for example, our average, so for us, what's being proposed here is about $560 per unit for single family. City of Carson is charging $1,233. $233. Corona charges 627. Bear field charges 900. So in the range of anywhere between six to 1200 dollars is where we're seeing cities with a similar structure charging. I think I have a very good summary with the analysis. It's very detailed, very good. What I'm saying is that the two things we want to accomplish, number one is that there should be a way to adjust the numbers if we find a mechanism in the way that we do. you know I'm going to use the same method as the other side. I don't know if CDD has anything else to add to that. Exactly. Yeah, I'm sorry Michelle, you were going to say something. I'm sure Mayor's Community Development Director. Yeah. I don't believe it would defer deter development at all. We have a very high demand of development going on now and you have to remember that these developers that are coming in here are making money and they are doing it at the expense of all of our infrastructures and we need to ensure that we collect those funds to be able to protect that. Not only that, I agree with you. And if in case in the future we want to come back and see if we need to adjust, we need to charge more. There should be some kind of back of support. You know, these are the reasons we're not meeting, but we thought. So that's why I was just proposing tentatively what's your schedule for bringing back with your KPI study of something. Councilman, I don't want to buy a city manager. Once we establish the CFD, we can come and provide you during our finance and government operations in part of our budget what the findings are. And we can also track what the rate impacts are in the market and make adjustments as necessary. But I don't see a scenario where we're going to be in negative since this will generate additional revenue as a result of demand to build in towards. Well, thank you. This is a recommendation of city manager and finance director that City Council conducted public hearing and adopt a resolution authorizing user and regulatory fees. Is there a staff presentation. In addition to myself, I am joined by our consultant, Terry Madsen, of Clear Source Financial Consulting, as well as representatives from participating departments. Item 10C is a recommendation of the City Manager and Finance Director that the City Council 1 conduct a public hearing, a modified user and regulatory fees, and two, adopt a resolution approving user and regulatory fees presented. The last comprehensive user and regulatory fee study was completed in April of 2023, and in this analysis, specific fees were reviewed in a limited scope, along with the cost of service and cost recovery rates to determine appropriate fee amounts proposed by departments to offset the services provided. Terry Madson from ClearSource will allowing me to participate on this topic. As mentioned, my name is Terry Madsen and I'm here from Clear Source and we have assisted the city over the last several years as it examines and updates, user and regulatory fees. I know you've had a full agenda so I will do my best to be brief. I have about a 17 slide presentation but I will make my best to be brief. I have about a 17 slide presentation, but I will make my way through it quickly City clerk is the presentation coming I'm also happy to just walk. Yeah, I can just walk the council through it. Yeah, you could do that number two, which provides a brief overview on agenda. We'll be talking about background for fee setting in Torrance, an overview of this update and the driver of this update, some fundamentals and terminology that affect fees and charges in California. We'll identify the proposed fees and discuss next steps with the council. I'll move to the next page of the agenda, which is just the background intro. And now I'm at slide four, with says background on the top. And this is just a reminder that the city, staff is part of normal course of operations. Do review fees on an annual basis, and you periodically perform what we'd call a comprehensive study. The last comprehensive study was performed in 2023, and in between those studies, the partners and test a new patient here in New York. You have any sort of one-off adjustments that you can consider to be a patient with a patient, or when you're operating or thinking for notice. That's something I'm moving to in slide. Six, total people, total staff dates. and then you can see the behind the entrance line. This is the seat of the people's house that leads and that is the pipe of this seat. So you have your pipe in this seat. You can see the pipe in this seat. This is the seat. This is the I'm going to have to go to the head. The reason we examine the reason we don't just arbitrarily set these is because we do have legal requirements. So we want to follow in California, the California Constitution, and the California Government Code give us direction about how to identify costs of providing service and set fees that are linked to that cost of service. And so that's why cities perform these types of updates. And then also this idea of when we recover our cost of service, it helps us continue to meet the service level expectations of the community. So I talked about the idea that the California Constitution and the government code do give us direction on slide 10 and that direction is talking about one more slide please slide 10. Oh yeah, here we go. The idea of cost of service so for regulatory fees, we do want to identify our cost of service and that helps inform fees for the city council to consider. The full cost of service sets are our maximum fee and we can charge less than the full cost of service sets are our maximum fee and we can charge less than the full cost of service but we don't want to exceed our cost of service. Because these are fees, they are approved by the City Council at the conclusion of a public hearing. But we do follow those parameters outlined in our legislative guidance. So finally, the list of proposed fees, you'll see that I'm on slide 13, please. You'll see that the, you know, it's a very limited number of fees, but it applies over a broad spectrum. There may be some fees that are led by the building team at the city, some fees that are led by the planning team. There's fees that are associated with your transit services department. So just a broad spectrum. But these are the areas that were identified by your staff as either areas of service that we're providing without an offsetting fee or areas where we feel like the current fee could be modified to closer reflect our current costs of service. So in your agenda packet you have details regarding each of these fees, but I'll go to next slide, please. This is the final page. So just about 36 fees that are considered as part of this item. And what you'll find is in the regulatory world, we typically target full cost recovery in the city of Torrance. We followed that pattern unless we feel like there might be an issue with compliance or there might be some overriding community goals and values that would make us think to target something less than full cost recovery. And in the user fee world, you may target less than full cost recovery again, just like as a community goals and values issue, but in the regulatory few world, you primarily target full cost recovery. Next slide, please. So the item before the city council this evening is to conduct a public hearing and to consider whether to adopt these updated fees. If the fees are adopted, they would be included in the city's master fee schedule in future years and they would be part of that annual review process. So they would just be incorporated, they would use the same annual inflationary adjustments and they would be part of future comprehensive studies if any need arose to refine them or readjust them. His son Derek is going to carry forward the Concord the Bridge when they had the opportunity to do it again, probably not for another couple of years, or the bridge is being refurbished, but it was actually an honor to be there to represent District 2 resident and his legacy.
