This is the day the Lord has made. We will rejoice and be glad in it. We give you thanks, Lord, for this day and for the many blessings that you daily and richly provide for us. It is this week, Lord, the Thursday of this week, that our nation has set aside to be especially thankful to you for all the gifts that you give us, for family and friends, for our homes and our jobs, for the bounty that will bound on our tables. Help us to be truly thankful, Lord. And we pray that you would continue to bless us, bless this Commissioner's Court, and the work that will be accomplished here today. Good morning, James Morning judge and commissioners and distances Thanksgiving week. We just got some news that Thanksgiving Week. We just got some news that puts the thanks and Thanksgiving I got to work and I had what was termed as a fairly urgent call from New York. To return I returned it right away and it was Ed McGlaid is one of the directors at Standard and Pours and he wanted to have me tell me very first thing that they had met yesterday without any reviewing several Texas issuers, anything had done on our part whatsoever and they had raised it in county's mind rating to AAA. Fantastic! Couldn't come in as a better time. This, for perspective, I believe when most of us at this official table here started, I believe our rating was B1 maybe. We were very low rating. I don't think we deserve that back then. We have been upgraded certainly obviously many times step by step, you know, from B1 to A to A plus, to AA years, and we were only upgraded to AA plus last year, I'm glad. This does make us the, I don't know if they did other counties too, but if they did not make any other counties, Triple A, this makes a Denton County, only one of only five Triple A rated counties in up to 254 in the state. This obviously will have great effect for many years as long as we keep that rating. Our bond rating is again, it's a measure of the risk of our bonds for investors. It is one of the components of the interest rate that we have to pay when we issue debt. So it will affect. And the great thing about this is, is bond, practice in the past, is to pay additional for bond insurance to get a triple rate rating. And that market, or that actually, that whole market has dried. There are no bond rating agencies, bond insurance agencies anymore rated higher than we are. So we will not have to use that. We'll save money again on every issue, but not using bond insurance, mean AAA. So this is, I think, very big news for us, very positive news, positive reflection on the commissioner's court and the professional leadership in this county. Because they look, there's many things they go into writing there it's a secret formula they'll never tell you it's a measure of the robustness of the economy in the local area but it's also the management the fiscal policies, the fiscal leadership, the professional leadership of the court and adopting policies, both financial policies, budget purchasing, human resources policies, complying with the legal, the legal mandates of the court. They look at all of that and to adopt those and adhere to them and always adopt a budget with sound fiscal practices, reflects in this rating. So it's reflected, it's a reflection on almost everybody here. So I just want to pass that on. Thank you. Well, you're right, James. It is a reflection on everybody here. You know, it's elected officials we'd like to say, gee, wouldn't that great leadership? But really, and truly, it is a reflection on everybody. And that starts with our county auditor giving this great advice and we're smart enough to take that good advice so that's only being I'll give a scarlet for but that is outstanding news and certainly something to be thankful for this week. It's good news for the taxpayers that didn't count II because ultimately it will cost less money to borrow money to do all the things that we Told the voters that we were going to do in the last bond election with that $495 million that thankfully they they passed So it's gonna cost us less money to do that and I appreciate your bringing that this morning. Item 8a is approval of a plaque presentation to the county department that had the highest participation in the Denton County Wellness Program for a fiscal year 2008 is recommended by the Wellness Committee and first I'm going to turn this over to Amy Phillips. And the very first one goes to a department. The department that has had the highest percentage participation because we know we have all different sizes of departments. And I want to compliment James Wells, the county auditor, and his staff because they have the highest percentage participation this year. And I know that's due to his leadership and the enthusiasm of the people in his department and they're working on improving their health. Congratulations, James. Thank you. Thank you. Thank you very much. You did not even know that we were qualified for this. I certainly participate in the wellness program. I did not know how many my employees were, but I appreciate it. They would have all liked to be here, but quite frankly they're working too hard. Actually, this is our busiest time and then short holiday weeks are all extremely busy for us. We'll go to 8B, which is a provolody gift certificate presentation to the county employee or employees who earn the most points in the Dent County Wellness Program for fiscal year 2008 is recommended by the wellness committee. So there was obviously a lot of participation there on their part. I'd like to welcome and congratulate Holly Hallefield and Susan Birchett. Holly Hallefield is with the health department. Come on up, Holly. And Susan Birchette is with the Human Resources Department and I'm happy to give each of them a gift certificate to Applebee's where they have a healthy menu. I know I've talked to many folks at the county that have participated in the wellness program. Folks that have maybe been, like has been communicated, living a healthy lifestyle for many years and now they're being rewarded for those efforts and others like yourself that have noted a lot of improvement and efforts that they've undertaken to live a healthy lifestyle. It is really encouraging to me to see this program going on. I know I've had conversations with Dr. Burton on this and others as well. I mean, individual county employees that have taken advantage of this program. And it is encouraging to me to see not only the difference that help and attention to help and the quality of life and physical fitness brings to individuals' lives. But also, I think as this program continues to go on, the cost that we have is very small. I mean, we are extending rewards to the employees, but that cost is very small compared to the benefits that are accrued, not only to the individuals that protect in this program, but also to the county. And the economic benefits that are accrued to the county in terms of the reduction, excuse me, of the impact on our health insurance. And I know that we all just received an email about one situation where we had an extremely high situation occur. And these things happen, but I think overall in the accumulation of this on the long term, we will see a positive benefit. Many studies have been done. And Amy Phillips has spent a lot of time informing the court members of the positive benefits economic that accrue as well as mental well-being that occurs to individuals. So I'm really excited to see this happen and encourage more participation. I think this is the second year of its being in existence for the county. And I think as it continues to go on, we'll see more and more benefits accrued to the county in terms of individual employees in the county at large. And that benefits the taxpayers as as well so I'm excited. All right well I think we need to do a motion and a second on all three agenda items so the chair will move for approval. Let me interject that that's the individual I was talking with and So, um, individual I was talking with, um, and communicated that to you two weeks ago, and I did receive confirmation that he's willing to serve, um, and communicated that information. And, uh, yesterday he made contact with Mr. Moore. So, um, this is a gentleman that, um, has been involved in development in, in, in the county and other counties as well actually and also serves as a member of PNZ for the city of Aubrey so I think he's will bring a good perspective to and I'm sorry what is his name? Scott Moore. Okay. Mr. Moore has picked up all the information and so. Okay Mr. Moore has picked up all the information Okay, we need them I would move for approval. Sure we have some questions here from Commissioner Marchin. I was reading over the minutes from the last two meetings in particular, the last meeting. And there was some initial comments made. And one of the comments were that the committee members were seeking direction from the commissioners court on I don't know that any particular issue um, and then I had a phone call from my gentleman as well and I've spoken that the the direction that uh, the commissioners court was the direction that the commissioners court was depending upon was you. And so, and the instructions, I mean that the committee was to work with you on improving those rules and regs and anything at that point be recommendation back to us. It's not recommending to you because I have nothing and anything at that point be recommendation back to us. It's not recommending to you because I have nothing to recommend because I'm waiting for your recommendations. What has come from that meeting? Basically the committee has requested from the court to basically rewrite the subdivision rules. Go line by line. Go instead of just a review process, basically rewrite the subdivision rules, go line by line, you know, go instead of just a review process, they wanna recreate the rules. They wanna go from basically a one month committee to possibly eight or nine month committee. What is your, I mean, I think part of the issue, I think it's a good idea because it's been this detail of a review has not been done on the rules since 1999. In 2003, the last time this was done, it was just strictly the engineering section that was reviewed. Now, what's going to come about is the committee will, is supposed to be giving me the next meeting a list of the they don't want to rubber stamp anything, but they're afraid the court will not follow their suggestions. Well, first of all, they have areas of recommendation committee, and we are going to be the ones that's going to make the final decision. And if they have a problem with that, they don't need to be serving on the committee. I understand that. And you need to let them know that. The final decision does rest with the commissioners court. And what they do is they recommend they don't make the final decision. And basically the feeling from the committee is, many of the committee members are former developers or current developers in this county and many of them feel some of the rules are unfair to developers and so they will be bringing those pasts to life basically. I'm thinking that while I'm glad that they are willing to take a look at the whole thing line by line and it's it's not a short document as we all know There are some points that We don't need to wait eight months to make a decision on I'm thinking one by one For lack of a better term, maybe the more controversial ones or maybe the ones that, I think there's some things that we need to go ahead and make some decisions on. That's why I had them. And I kind of like to have them bring those items to court, maybe one at a time. So we can have some dialogue and maybe come to a decision on some things. And those decisions will ultimately be incorporated into the final document that will be complete eight months from now. But I think there's some things that we maybe should go ahead and make some decisions on it this time. Commissioner White would like to add something. And let me just, I expressed my concern to Bennett after reading the minutes myself. Certainly, I think it is beneficial for us to receive comments from folks who are involved in development and the impact it has on development. And I mean, I think that's productive. I think that can be productive. I think though however that this as Judge you communicated this particular division for this particular exercise in reviewing of the subdivision committee, the subdivision rules and regulations was not meant. I don't think the vision was meant for an all-out overhaul of the subdivision rules and regulations because that would take much more time, quite a bit more time. It was my understanding that the vision for what we were trying to accomplish. At this point in time were some immediate issues. Several of those are, it could be classified as administrative, not substantially changing rules and regulations, but cleaning it up and trying to clarify and simplify ideas and concepts that are already encompassed within the document. There may be an appropriate time at a later date once we get those immediate issues that we need to resolve covered so that we can have a clear and concise document out there in the public. I mean, as was communicated to us by Bennett, the last overhaul was at 98. 99. 99. That took eight months. I mean, I think we were envisioning accomplishing this by the, I mean, a couple meetings, maybe, you know, two to four meetings with the agenda kind of preset of the things that we were going to look at to try to bring some clarity and simplification to the document by Bennett and looking at those things. I think at another time, I mean, there may, we may want to look at the document as a whole and subtitively look at the rules and regulations. I don't know, in my mind, that that's what I was trying to accomplish. And maybe y'all can give me your understanding of what we were trying to accomplish? Well, I mean, there's a certain amount of questions I have. First of all, I assume that you went into this process with an agenda. And that agenda being addressing some issues within the current policy that because of time, because of situation, because of circumstance needed to be addressed and this committee to vet those issues with that this committee to look at it and say yeah that's fair, that's reasonable. Yes I see where you're going with that. We recommend that that's the way you want to go and this is our input. I'm not using the word concern as strong as it might imply but to allow them to set the agenda on issues like four or five or whatever issues that they see that you have not seen. Now if they jive with you I can see that but to utilize the committee the way that I in the scope of work that I thought we were going at when they were addressing issues that we had and they were either affirming those issues, not necessarily expanding on those issues. Now, because we set the committee up as a will temporary committee to go further than that, we'd have to put a actually re, I believe, reappoint them in a permanent rotation kind of thing like we always do with the other committees and give them a scope of work. And at that point, then the idea of it just being a developer, builder committee, we would, I believe, need to put citizens on there to counter and make sure that the will of the people is not diluted by the desire of the developer tells them if they don't get, and this last minute half the committee told me that if they weren't able to do a full rewrite, then they're not going to participate. They've basically thrown down the gauntlet. Then you're the leader, and if that's the way they feel, tell them to hand in their resignations. I mean, you can't go into a committee and decide that I'm going to get my way about it. It's not going to be a committee. You have to go in and work within the parameters of the committee and as Ron said, you know, this is what you would like to see happen. And I expect you to take the leadership on that. And if they you've got some that say is, especially if it's mine, the point is that I have that say, you know, you either give us our way or we're not going to do it, then you suggest that they contact their commissioner and let us take care of that. Because you, I mean, my envision of this committee was like runs that they would come in and you have some issues that you had and you want them to take a look at and see if there's a better way to do it. Right. Let's do this. When we started this process other than the appointment process you sent us an email and we had on the agenda some specific concerns and you gave us information about how some other counties were doing it. I would like to have a decision made on those items. Okay. And then there will be discussion, I think, on this commission's court, how we want to proceed from that point if it's a whole review of all the subdivision rules and regulations Yes or no and if we in fact want the same committee to be doing that task But right now job one is to do what was originally outlined for this committee to do and I would like to see that accomplished because there are some important things that you brought to this commissioners court that we need to have some clarification on and some decisions made that will have an immediate impact on development in Denton County. And whether or not we go forward with the whole rewrite of the subdivision rules and regulations those decisions need to be made now not At the conclusion of eight months of study. I would like decisions made on the items that you brought forward to court the real reason that this committee was formed in the first place Then let's us have some discussion about proceeding from this point. I am not opposed to taking a look at the whole package of the subdivision rules and regulations. I think since it's not been looked at since 99, that does need to be done. But that's not what this committee was charged with. This committee was charged with the items that you specifically outlined initially. Let's address those first. And members, do you have an objection with proceeding that way? What's your feelings on reviewing all those subdivision rules and regulations after these initial decisions remain? I think we discussed that after the decisions are made on these because, first of all, this doesn't just affect the developers, this affect the citizens of them. I want the issues that you brought to us addressed. And then when those are taken care of, if we decide that we want to go back and look at the the total Paggich and then that's okay, but I'm having some concerns with the committee being in the driver's seat Well, and I'm a little bit as I've already mentioned. I'm a little bit concerned myself, but I am curious. I mean I did ask you for concerns myself, but I am curious. I mean, I did ask you for a list. And after I've been out of time, but after I've read the minutes, I saw the list of those involved in the committee. I mean, I have one developer and a prior commissioner that I appointed. I mean, it would be interesting to see them. I mean, I know there's a couple of engineers on there. I know, well, I do not believe, well, I haven't received any conversation from the people that I've appointed that they're looking to do that. And specifically, I mean, they talked about some just a few issues, but they're looking to do that. And specifically, I mean, they talked about some, just a few issues, but they're pretty big issues. I mean, as far as development goes and going down, you know, to what kind of minimums on land size that we're going to require. So I would be curious to know that makeup. But yes, I think we need to proceed with the agenda as was originally intended by Commissioner's Court, which was laid out by Bennett and the different issues that, I mean, there were a few issues that he brought forward as well as cleaning up some administrative issues within the document. And I think that should be the focus. And those that I don't think you should be put in the middle, you should be the leader of the group, but you shouldn't be put in the middle. And if they're laying down the gauntlet, thrown down the gauntlet as you state, then they should be referred back to the commissioner of that appointed them to, for those discussions, to take place between that commissioner and those that appointed and those of them. Okay, well one mountain of the time, Ben. We'll take up the issues as originally outlined and then of course we're going to need in the holiday time here too and that makes kind of hard to have meetings. So let's take care of the original objective and then we'll address the second issue. I am not saying that it won't be done because I personally think it needs to be but let's take care of the original objective first. All right. Thank you. Thank you. Okay.
