We need to go to item 4A, which is a public hearing. 4A is a public hearing on the proposed county tax rate of 0.24 8 per $100 evaluation, which would increase total tax revenues from properties on the tax roll by 3.16% for tax year 2009. In schedule and meeting to adopt the tax rate for Tuesday, September 8, 2009 at 1015 AM. At the courthouse on the square in commissioners courtroom 110 was decreased, second floor, commissioners courtroom indent in Texas. First, we need a vote to go into public hearing. This is our second public hearing on the proposed tax rate. We had one last week at 10 a.m. here in this courtroom. The budget process, as you all know, begins for us early in March. After a long summer process and a tough budget year, three weeks ago, the commissioners court wrapped up the process and voted unanimously to propose the tax rate that we're here to discuss this evening. The budget itself will have a public hearing on next week, but just to give you an idea of the overall budget increase this year for the county is $2.9 million. Also, as a reminder, the majority, all of the increase was related to voter approval debt. In fact, almost every department's budget in the county saw some major reductions in order to keep the rate that we're proposing tonight. I do have some handouts here. If anyone from the public would like to see, it's also the slideshow that we'll be showing as well. Just as a reminder, the Denton Central appraisal district is the governing body that is charged with the responsibility of appraising property within the district for abelorm tax purposes. So we always like to list the chief appraisal, their address and contact information for those individuals that are unhappy about the individual appraisal on their property. Truth and taxation requires that any time we propose a tax rate that is increased above the effective rate that we hold to public hearings. These have been advertised and posted according to the provisions of the property tax code. We have run a quarter page notice in the Dinten Rekker Chronicle on Sunday, August the 16th. We also posted notice on the main page of the Dinten County website on Friday, August 14th. And notice was also provided to our local free access cable station, which is charter communications. On Friday, August 14th, it's required that it run for 60 second periods five times a day between the hours of 7 a.m. and 9 p.m.s, at least seven days prior to the first public hearing. This is a summary of our tax rate information. Our current tax rate at the county is 0.23577 per $100 of value. The effective rate is 0.242153 and the rate that we're proposing to support the budget is 0.2498. This shows that the current tax rate is just under 1.5 cents less than the rate that we're proposing. The variance with the effective rate is 0.007647. That equates to a 5.95% above increase above the current rate or 3.16% above the effective tax rate. The effective tax rate can be a little confusing, so hopefully this visual will help explain how this works. The effective rate provides the taxing unit with approximately the same amount of revenue it had in the year before on properties that were taxed in both years. As you can see there's an exhibit there that came from the Truth and Taxation Handbook that shows how the effective rate is calculated. You take the prior year taxes, and then you have to reduce that by the taxes on the property that were lost this year. You divide that by the current value of property and multiply that by 100. There are several, one time, or first time exemptions that have hit our tax roll this year. Anybody that's over age 65 exemptions, those come off of the role. As you know, Presbyterian Hospital in Denton sold to a nonprofit and that in itself, we lost over $300,000 for my role from that one property as well as personal property. This chart will show just some samples of a home value. We've shown it in 100,000, starting with $100,000. You would pay currently paid $235.77 on that home based on the rate that we're proposing. You would pay $249.80, which is an annual increase of $14.03, or a monthly increase of a $1.17. You'll see we've listed $125,150, 175, and 204U to see. Again, this chart assumes that there's no increase or change in the valuation on that individual's property. The next chart will show you that same information using the effective rate, which we talked about just earlier. Same situation, $100,000 home. You'd pay $242.15 with the effective tax rate, or $240.80 with the proposed rate which equates to $7.65 per year or $6.4 per month. This chart shows the property taxes for the average homeowner that resides in the city of Denton for Tax Year 2008. The average value in Denton County was $211,710 and you'll see that 62% of that homeowners taxes are for school taxes, 28% for City of Denton taxes, and 10% for Denton County taxes. We are using for this visual the tax rate of 2,3577 for Denton County taxes. We are using for this visual the tax rate of 2, 3, 5, 7, 7, for Denton, for this county of Denton as well as Denton ISD and City of Denton's current rates. This chart shows that same property owner, if their house value went up by the average increase, which the value this year on a home in Denton County is $2,000, $12,370. You'll see that that person pays again the same percentages that it does today. The taxes would be $5,110 on that home with only $531 of that or 10% being your county taxes. This visual just shows you that same home broken down on a monthly tax basis so you can see didn't county taxes on that home for the month would be $44. School district taxes are $264. And the city of Denton tax would be $118. This chart shows a 15-year history of the tax rate in Denton County. You'll see that during this period there were four years that the rate that was adopted by the court was actually higher than what we're proposing to hide. So you can see also from the next visual that that tax rights been fairly consistent for the last 10 years. This next chart shows a comparison of the top 10 Texas counties. This chart shows the county-wide tax rates. Some counties have other tax rates for hospital districts, community college districts, port authority, they have emergency services districts. So what we've done is shown on this chart what each entities countywide tax rates would be. And in Ditton County you can see we are well below all the other top 10 counties with a rate of 2, 4, 9, 8 and in Hidalgo County that rate is 0.7, 9, 3, 2. This chart also shows the same top 10 counties showing the tax rate versus the employees per capita. You'll see in Denton County we have the lowest per capita rate of per 1000 county residents at 2.33 and you'll see in some counties even in Harris County the rate is 4.41 employees per 1000 population. This shows a tax bill comparison for the surrounding urban counties. I think it tells a pretty telling story that shows didn't county to be $531 per year. If you lived in Terrent County with that same home value of $212,370, you would be paying $1378. Dallas County would be $1214 and in Collin County, $704. This chart shows the revenue summary by function. You'll see that 71% of our revenue comes from property taxes. Fees and fines total 11%, auto registration 4%, fund balance, intergovernmental, and so on. This will help, this next chart will define what we consider public safety. We have county roads and bridges. We provide the criminal justice system, which includes JP courts, district courts, county courts and our DA's office. We have debt service, which is long term debt that helps pay for our roads and bridges and county facilities, as well as other large capital projects. Health and welfare includes our Health Department, Clinical and Environmental, CPS, Indigent Care, our Financial Division and General Administration as well as Facilities Management. This next chart shows the expense summary by function. You'll see our budget that we're proposing is 184,505 108. 32% of our budget goes primarily to public safety. 18% for debt service. 15% for our judicial system, including judicial legal, 6% for road and bridge. This next chart, we're going to talk about just a few of the major changes we're seeing in the budget this year. As you all know, the major increase in our budget this year is for increased debt service payments. Voter approved projects were approved just November of 2008, which includes a $5.2 million increase in spending to make our debt service principal and interest payments. So again, earlier I mentioned our budget's only going up $2.8 million and $5.2 million of our increase or the budget is for voter approved debt. So we made major reductions in other areas of the budget. We have health insurance and retirement increases that we had no choice of over a million dollars. New employees requested this year total 32 while this budget only includes 10. Primarily those are for jail expansion and other additional positions. We have some increase in gasoline and utility expenses. I think the question came up last week about gasoline expenses and that's primarily for diesel fuel expenses for our road and bridge precincts Building maintenance increases We have some computer related software and lease payments Of course, we all know post-digious increasing each year Our indigent care expenses are increasing. There's a water conservation district that we are now a member of. And with that came some hard choices of some changes we had to make in the budget. We did delete three vacant positions and we transferred 6.5 positions to non-tax funded departments. And then as I mentioned before there were reductions in almost every department's budget. The next chart shows the number of employees per capita in Denton County for the past 10 years. You'll see in 2000 the per capita rate was 2.83 and it has continued to decline each and every year and this year it's at 2.33. That concludes the presentation I have on the slideshow but we can certainly open the meeting up for any questions or comments and invite the public for any input that they may have. I don't have any public comment forms but I do want to extend the opportunity for any member of the public that would like to address commissioners court concerning our proposed budget and proposed tax rate this would be the time for you to take the floor if you'd like to speak. So anyone in attendance that would like to address commissioners court concerning the proposed yeah I'm sorry proposed budget and proposed tax rate. We have one for the record sir if you'd state your name. Tim Trilovich live in Plano in the South-West, southeast corner of Denton County. spoke with Mr. March in a couple of weeks ago and twisted his ear for a little while. So I don't want to say too much. I know quite a few of our neighbors have things going on tonight. Football practice and other things and couldn't make it. But about 10 of us, we're going to get together and come up here and again, they weren't able to make it. Came with one of my neighbors and we would appreciate it if they didn't raise the tax rate. We'd like everybody to live within their budget. I know that's difficult right now. Businesses do it. Home owners do it. And again, I don't want to bore everybody, but at least 10 of us in our neighborhood decided that we should make our comments heard. Thanks. We appreciate your being here tonight, sir. Commissioner Marchion, I'm assuming you had a chance to talk to this gentleman and... Little over half an hour or so. And you understand my comments, I believe, and you understand. I'm going to talk to this gentleman and over half an hour or so. You understand my comments, I believe, and you understand. I hope you heard from our budget director that the overall I added to our budget for the debt that we incurred this year from some new bond issuance that were voted approved, that are debt increased by 5.2 million. But we reduced it. We explained it to you.9 million, and $5.2 million of the increase was for the debt projects, and which shows that we reduced the budget significantly in other areas too. Because we were anticipating that property values were going to be changing and we knew the rate was going to be increasing. So we made some significant cuts in the budget for all departments. That was what I was trying to explain to you earlier that we did have voter approved debt that we added this year. But we did, as you said, when you have businesses that have, as well as household that have to curb your appetite if you would and have to make sacrifices. We did make sacrifices and we did cut a lot of budgets in a lot of areas within our departments or we would have incurred the entire $5.2 million worth of new debt and had to raise taxes even higher if we had to cut back and have that. And so I feel pretty confident that we've done everything that we possibly do other than incurring the new debt to try to hold back our expenses and to try to keep our tax rate low. I need to know also that, excuse me, we had not done across the board salary increases for employees. We did make some adjustments where I think we needed to make adjustments. We had a couple positions primarily in law enforcement, jail health, where we were running into a situation where employees were being enticed away from us, not only in higher salaries, but signing bonuses and all this sort of business. If you don't do what you're supposed to be doing and you know, do diligence in that area, then you're talking lawsuits and then you're talking about paying lawyers and things like that. So we had to take a special notice of some areas that needed some attention in the way of salaries, but no across the board increases for anybody. And like they were saying, everybody's budget took a hit. And concerning the voter approved in debtiness, the bond election that was on the ballot last November, I made like 19 presentations myself and had a whole spreadsheet for people of Denton County's current debt. And if the voters approved the future debt at the rate we planned on hopefully borrowing the money and what we wanted to do with it. Worst case scenario, I told everybody at the time worst case it would be about a penny on the tax rate. Well, we've absorbed more than that. It's barely over, it's a little over half a penny increase on the tax rate. So yes, it is about a half a penny increase. You're exactly right. But I think it's also important for us to take advantage of things like, well, economic times are tough for everybody. It's also a good time for the county to be doing these projects because you go out for bid and they're coming in. The bids are coming in 20 to 30% less than they did a year ago. So you're getting a good bang for your taxpayer dollar. You can get more projects then. So you may have to weigh all that as the reason I'm telling you all this. Yes, you can get more projects then. So, you can get more projects then. So, you can get more projects then. So, you can get more projects then. So, you can get here fast enough. So it's just what's going on now. And what I saw growing up there was California would, the legislature would get together. They'd pass a law that said we'll have a 1% increase and the little sunset after three years and then at 11.30 at night, the state legislature would meet in Sacramento and they'd say, everybody's got news to it. So let's somehow never sunset it did it. And so I understand the situation that y'all are in. The thing that concerns me is it's a little bit of creep here with the county, it's a little creep city of Plano is considering doing that for us. And then of course, you know what's going on with the federal government. And so I would like to make sure that you get a copy of the presentation that she the PowerPoint presentation and believe she's got it on the counter there and you will notice a one point not one thing to even though this proposed tax rate is about a half a penny increase if you will take a look back it's still less than her tax rate was five years ago and I appreciate that that was another question that I had was I'm hoping that as property values go back up and the county has more money coming in That they'll lower the tax rate. I know that Plano's done it twice But in the situation that we're in now just the country as a whole I don't know if that's if there if anybody will ever look at that again and side like I think historically we this court This immediate court and prior courts has had a track record of being pretty visibly conservative and I don't feel like we've done things in a vacuum. We've been pretty honest with the taxpayer. Yes, this is what we think we need to do. This is what we think it's going to cost in order to achieve this. This is the rate we're going to have to set and that's pretty much what we did in November. Now we're doing it and I think the benefit is there like I said because it's a good time to go out for bid for a lot of these projects. Commissioner Ease, did you want to say something? Well, I think if Donna could put up the 10 year tax rate history, it's about a little over I think what halfway through the see what the history of the right is done. I see it on page 6. Ten year tax rate history. There you go. Benton County. I've got it. There's also a chart on it. It's a 15 year transfer with his due too. It hasn't been a steady increase. So and I appreciate that. I was shocked when I talked to Mr. Marchant about the increase that he said I was the first person in two and a half years that ever said anything or called but as soon as you cut services everybody complains. Well, I'm going to come up and maybe not complain, but just let everybody know that people in our neighborhood are concerned about that. Well, I appreciate people not only trying to have a public hearing, but emailing or calling because there are certainly legitimate questions and they certainly deserve an answer. Thank you I think I'd like to say is no Andy and I work really hard on cutting our budgets for our road and bridge departments almost 1.2 million dollars and I even let we even cut a position over in road bridge east I Think that's you know indicative of how we hard we work to make sure that we could squeeze the bond money that we're going to be out paying for into this budget. The infrastructure is needed, the voters voted on it. We just can't, I think it would be fiscally and responsible to go out and want something but not want to pay for it. I mean, that's just what you have to name. Anybody else that would like to speak, any member of the court or anyone that attended so would like to address commissioners court on the issue? Commissioner Eanes. I have to mention for the benefit of our guests. I said this last week, kind of using an example about building our infrastructure with the bonds that we issued at May. Construction costs are low. Our bids are coming in lower than we anticipated, even from last summer when we put together the bond election. And Robson Ranch Road, which we were anticipating to be about 4.9 million came in at 3.3. And so the court had to make a policy decision back in the spring. How much money do we issue knowing that times are tight? And the court decided that because we did have the money, we did have the voter approval, overwhelmed to do that. And because construction prices were down, because we're in a better situation than a lot of other government agencies and a private sector. And so by building things now in a recession we're saving we're ultimately saving tax dollars because the projects are coming in cheaper So we weigh that out we go ahead and press forward with these with these plans and and and get things done Ultimately for immediately cheaper and then an out years cheaper as well And that's what that's what the court decided to do. So we're paying more, yes, right now, but it's gonna be cheaper. I had a question for you. Would it be correct to say that our maintenance and operations amount of budget has really gone down? It's just really the debt service that's gone up? That's correct. Eventually we'll hopefully, we'll pay it off right So that'll that'll reduce his time. Actually We really haven't expanded our Our you know at the house always say my wife's and charge of maintenance and operations But we're really not upping our budget for what our ongoing processes are. We're really just using the money to buy capital. Actually, we decreased it to be able to absorb some of our debt rather than having to increase the rate. Not right now. 5A is to review and approval of the annual audit report from the Denton County jail commissary and again, will come James Wells. Thank you, Judge. The annual audit of the jail commissary operations is required by statute. This is the report for the actually the 2008 fiscal year. There's a lot of explanatory material in the briefing memo. And I see that it actually printed out real nicely this time, but I'll just hit, unless we want a lot of discussion, I'll hit the very highlights of that. The important things on the jail commissary are that it is strictly under the authority of the sheriff to run the commissary, as he, within the statute, sees his fits, not actually a commissary or discretionary item or oversight item. Sheriff can run the commissary with his own staff or he can contract it out. Our sheriff has chosen to contract it out and actually got a meat. And then there's requirement every five years to take, for the sheriff to take bids, not getting off the commissioner's quarter of the county to take bids. And we did, he did award a new contract, a new vendor that's proven very successful and more, remunerative to the county. The commissaries really like running combination of a store and a bank altogether. All of the financial transactions were handled by the vendor and the jail staff as prisoners do not have any cash whatsoever. There are, and then so the rule running the commissary is up to the sheriff and the vendor counting for the money as best as you and actually then when there are profits from the commissary, which this year did total $346,000, at $150,000 increase from the previous year, much of which is due to the much better contract with the new vendor, Keith. Keith comes from a network and the previous vendor, it just pays the county more money. Once that profits are earned, there are only five specific areas of money can be spent on. Even though the sheriff totally controls it. That's what our audits about. So our audit goes in to look at compliance with the law for the way the commissaries run, like selection of the vendor. And also we look at the balances of all the inmate accounts. So it looks like 1200. It's like a 1200 member bank over there. Ever, in that version they have $2,000, they may have $2,000 or $10,000. It runs the gamut over there. So they really have to strictly account for that money and the money that things they purchase come out of that and pay the vendor and then accounting gets a percentage. That's in a nutshell, and we also check to see if the profits are used according to the statute. We will see if all the records are right and in order if the vendors pay in the sheriff's office, commissary, the correct percentage. When Commissioner Coleman was counsel to the ADA one year, we did find that the vendor was not paying us to the correct amount for the contract. We were able to convince them somehow that they owed us considerable amount of money. Not going to ask. A considerable amount of money was recovered if we had not audited would not have been without the company. Ask your aunt. But out the help of the VA's office too. And so that's the audit in a nutshell. There is again a full report here that will be given to Yolve and it's sent to jail standards. Really the law says Yolve received it. You don't remember? Pretty good. Well the bottom line is we did find everything is in order. The commissary has been run in this manner. Through this administration, the previous administration, they have always paid a terrific amount of detail to safeguarding prisoner money in the accounting for that. We very rarely have a loss over there from that That's a puts our our jail way ahead of most They do run the commissary financial operation strictly by the law We find no variation anywhere From the anything approved by the law so we and it again. It's a There was a book lots of quite a profitable enterprise. And the bottom line is if the commissary's profitable, then it does take, it takes a load off the county because things they spend on commissary money, stuff that they otherwise might be asking the county to find. That's our report opened any questions you might have, but again, have no no findings to report whatsoever everything in compliance as it should be.
