Kim and I are delighted to be here this morning to present to each of you the first in a series of three books. We are writing on Denton and Denton County history. It's called Images of America Denton. It's appropriate that the book was delivered at this time of year just in time for holiday sales and you know how important that it always is to me. But more importantly it's an expression of Kim and my appreciation for all the Denton County has done for us and our families. The writing of this book is our way of saying thank you. This book features in historic photographs and text the dynamic culture, people, lifestyle, history, and celebrations that are Denton. The second book, which is always already at the publishers and will be out in the springtime, will feature more of the history of the county through historic postcards. Images of America Denton is available in the museums and at all major bookstores in the county. I was excited to get an email yesterday from the publisher that they're already ordering the second printing because the first one after a week of being out on distribution is already sold out. This year, the Dickin County Museum celebrated its 30th anniversary. It also celebrated its 10th anniversary under county control. Kim and I recently celebrated our 11th year together as the director and curator of collections of the museums. It's been our privilege to serve the citizens of Denton County in these capacities. The third book will celebrate the African American citizens that made Denton County a diverse and vibrant place to live and work. I promise Kim that we would not start to work on this book until after the holidays. We hope you enjoy reading images of America Denton as much as we've enjoyed researching and writing the book. About 600, 700,000 is from the general fund. That includes monthly payments from office rental for various county offices for about $50,000. Payment of 90,000 to our link with tax attorneys that I've point out really is not county or even you know, not county funds being spent. And again about 50,000 a week for an in-genic care, which is very much above what we usually expect. Now, that's all the corrections I have, but that's approval of bills. Thank you. It states here that the DA's office determined that the proper place for this position was in the treasurer's office. What made you determine that and what's your legal reasoning behind that? Because I remember I asked about why I was being placed under Frank at that time. We're not on that. We're not on 7A. I beg your pardon, yes we are. Yes we are. And now y'all decide that it's properly with the Treasurer's office. What's the legal reasoning behind that, Kim? Cindy Brown raised the issue again, or this time, I don't know if she had before or not, and after looking at the bond and trying to be sure that if there was some sort of a problem, whether or not the bond would cover it, we were down to making it an employee of hers as opposed to leaving it where it was. That's probably the best scenario. I think it could have also probably gone under the Sheriff's Office, but we felt like it would be better to move it to Cindy's just for bond purposes. Wasn't this officer still a share of stepping? He is not commissioned by the sheriff, but he is not one of his deputies. I mean, he's not an employee, I guess, also of that department, but he is commissioned. The county treasure does have a fiscal responsibility constitutionally. So this we've ultimately, I believe, it was considered that covered all the bases. I'll talk to the sheriff about moving the position. To him, I don't, a Detroit Frank would have to answer that. He was talked to about this deal and have Frank come to the microphone. Judge and commissioners commissioners. How better? There you go. I did not speak with the sheriff. I spoke with Chief Hale and Chief Hale had no problem with it. He said it actually served the same purpose under the Treasurer's Office or our office or wherever we chose to put it. And either offices. He didn't express a desire for to be in his office. He just said it for their purpose. It really didn't express a desire for to be in its office. He just said it for their purpose. It really didn't matter. And you're saying the legal reason that it wasn't proper under previously that it's better under the treasure now or for the provisions of the bond? Is that the deal? We just reviewed it. A city was worried as to whether or not it would be better under her department for bonding purposes. And like I said, we looked at either, and kind of, Frankie, I mean, he left it with the department, with the department heads. We more of it, a lot of research on this, trying to figure out the best way to do it. Who's bond? The deputies, the sheriffs, or the treasurer's bond? The treasurer's bond. And for carting the money around, I guess if any law enforcement action had to take place, the sheriff's bond might recover it since he is commissioned by the sheriff. I don't remember what Morris sent you on that, Frank. I'm sorry on that part. We didn't pay for execute a separate bond for this fellow individually. The Treasury or by theutes is the responsibility for the depository and her bond we even call the AG's office and ran the scenario past them and what if this person's in another work for another office even though that he's performing a function for the treasure with the bond covered this would the treasure's bond cover this person in their opinion was no, it had to be an employee of the treasurer. I guess my point is I kind of brought that up when you originally did this and you all have determined that it was a really bad to be under the county judge just trying to figure out why it's been switched now. I mean what precipitated the switch? The switch was the question from Cindy Brown. I don't remember that specific question before about Cindy's bond, but I guess it's something she had pondered. And actually, we were, the reason this whole subject came up is because as you know, I'm moving to elections and I've been his relief and he would not have a relief once I go to election. So, my first idea was to move it back under the sheriff, or to move it under a fire marshal or a constable, some other law enforcement agency, so they would have relief when he was on vacation. That's when Cindy actually brought the question up about the bond and that started our research and really after talking to the AG's office, that's the only place it could land. Fortunately, the Fire Marshal has agreed that, you know, when he's on vacation or if he's sick or whatever, they will accompany one of Cindy Brown's employees. I mean, it even got down to portion at to that level that the AG decided it was concerned because I'd originally thought it should have been under Cindy in the first place. And my idea was pooped. That was my question is, who was going to deliver the money when this employee was on vacation and would Cindy him rounds. People. One of her employees will go and the farm offshore will. Well, that's it. That's it. Correct. Okay. I'll compliment him. Okay. And the sheriff, the sheriff covered the bond. I mean, the character commission before it, didn't he? Yes, he carries it now. And we'll continue. He carries. He hasn't changed. Okay. He wears a sheriff's step. He uniform or anything. Yeah. Just plain clothes. He's not wearing uniform, but I'm hesitant to discuss a lot of this security on in this format. It is publicized. Are there other questions? I don't have any further questions. You may remember in February, we revised the family medical leave policy to reflect changes in the family medical leave act at that time that included special provisions for active military, provisions for active military reserve and caretaker leave and qualifying incidences. They're further revisions just recently and we're recommending further revision to our policy to reflect those changes in the act that you see before you what it does is expand coverage to all active military as opposed to just National Guard and also caretaker leave us expanded and we're recommending approval today. Again, we'll call and thank Amy Phillips. Thank you. I'm recommending a revision today that would address a situation that several departments have had this year, especially in the last few months, when they've had an employee who was promoted or because of some other change, started experiencing some performance problems. And they wanted to keep the employee, but when training and other attempts to make the employee successful and their current assignment were not successful, they were looking for another option. We previously didn't have another option for a demotion to a position which they could perform competently unless there was an appropriate vacancy in the department. This revision would make that process a little more flexible and allow them to post the position within their own department so that other employees could apply for it and possibly move one employee, promote and demote at the same time. More recommending approval. Well, that would create a vacancy if they demoted them. And then they would have a program. Then they'd ask for, they could promote someone in the department. And then would they put that employee in that position that other employees come in from? Yes. I did put language in the policy that they were going to be working with human resources to determine an appropriate slot to demote to. This is something that would be real important that we work closely on. Just as right now if we demote somebody, we know that a lot of our employees have civil service access. We want to be real careful with these to make sure that they would be prepared for that kind of action if they were to take place. The idea I'll move for approval. Opposed, sen. motion does carry. 13A is approval of contingency allowance authorization number 8, inclusive of change orders numbers 27, 30, 32, 33, 34, 35, 36 in the amount of $5,657. I do this, but I'd really like to have our construction manager come up and explain this to us. Just kind of tell us what the morning really going on. There's seven different items on this contingency allowance authorization. Six of these are really added value to the project. We're adding some waterproofing at the windows and some other locations that it was basically determined that it would help in the long run. It's not that the detail was insufficient to start with, but this is just an extra layer of protection. I think we all know of some waterproofing problems we've had in the county and want to go bump behind to make sure that there's no problems in the future. The one deduct is for door hardware of $13,349. During the bidding process, we weren't sure when it was put out to bid exactly which manufacturers and suppliers were going with. We know what we wanted. So as we refine that, we're able to choose some different options that give us the same quality. So that's the deduct that we had for that. Some of the other items like the gypsum board, we changed that to moisture resistant. It's really an epoxy paint that's going to help on the wear and tear and long term maintenance of that area. The fire extinguishers, as we got into the process, we added some fire extinguishers throughout the building. And we actually had some of them as semi recessed and fully recessed, which have to meet handicap accessibility issues. So that's in there as well. But all these prices came back. They're good prices for the work that's been performed. And I support this one. Thank you, they're the further questions. Yeah, can you explain to me a change order number 36, where it says it provides secondary flashing at the window jams per CPR number 16? What are that? That one we had some primary flashing on the window is the size of all the windows. And again, that's an issue of, that's a good standard detail, but it gives us a second layer of protection for water infiltration at those areas. When you're dealing with some of the pressures that you're dealing with and wind, water can, you know, wickets way up uphill even sometimes. So it just gives us an add layer layer protection to keep the water out. To decide whether we need that added letter and why wasn't it included at the beginning? It's not necessarily that the first detail was a bad detail but collectively the architect and the facilities and myself looked at it and the contractor even as well and decided this was a better option long-term. The original detail probably wouldn't have a problem but we're more sure that this one won't have a problem later on. You can never be 100% sure but it's just just a little bit better detail. An extra layer of protection. By detail what do you mean the plan? Yeah it's basically this decides of the windows that we're talking about and it gets repeated for every window because there's basically one detail one way of doing it one way to flash it for all the windows so we made that change throughout the project that's why that amount is there. Okay, this is resolution in support of a nomination to the Urban Counties Board of Directors, whereas the commissioners court of Denton County as the governing body of Denton County is charged with responsibility of nominating the candidate to serve as an officer and board member of the Texas Conference of Urban Counties, whereas the Texas Conference of Urban Counties was established approximately 34 years ago to represent the interests of the Urban Counties of Texas, and is relied on member participation to continue to be effective in impacting state policy decisions, whereas Dent County has found participation to the the urban counties to be a great benefit to itself and to urban counties in general. And whereas the Texas Conference of Urban Counties membership is recognized the value of including the County Commission's Court courts in the nominating process for urban county officers, whereas Denton County wishes to ensure that the Texas Conference of Urban Counties has officers who have the complete support of their respective commissioners court. And whereas the committee has expressed an interest in representing the commissioners court of Denton County as an officer and board member of the Texas Conference of Urban Counties. Now therefore, it is resolved that the commissioners court of Denton County hereby proves the nomination of the body of the committee.
