Again, what Colin James Welles. Yes, and commissioners brought this item forward because we have a Denton County in our upcoming bond sale. We have an opportunity option, potentially to use a new type of bond instrument rather than our pure permanent improvement or general obligation bonds that we have issued many times in the past. Build America bonds are part of the American Recovery and Reinvestment Act of the stimulus plan. They've been marketed now for about a year and the authorization for them runs through this year. They are different debt instruments in some ways. They cause they have part of the interest payments on them are subsidized by the federal government. They offer us the potential to save a considerable amount of interest expense on this upcoming bond issue. But there are also some risks and some additional work that goes into them to ask our financial advisors from Southwest securities and our bond attorneys from Fulbright and Jaworsky to be here and give you an overview to seek your permission to structure the deal that include these and they'll explain more in depth the differences in the both sides of it to the county. So John Martin from Southwest Securities, along with Bob Drancfield. It's a little red button is up at the microphone. I'll turn it off. Now we're on. Good morning. I'm John Martin with Southwest Securities. As James indicated, I'm going to start out and then Bob's going to kind of follow up and we'll try to make this brief. Now you've got other things to consider. Really all we're doing is James said is we are still issuing permanent improvement bonds as authorized by state law. These were the voted bonds that had been authorized over a period of time in 0408 and so forth. We're taking some of that authorization, organization towards their projects that we, towards the projects that we promised the voters that we would do and they authorized us to do. Part of the stimulus plan allowed for entities to issue taxable bonds rather than tax exempt bonds. So what we're doing here is those taxable bonds then get a subsidy from the federal government of 35% of the interest expense. So you can play a game in terms of the bond yield of the tax exempts. What's the tax exempt rate at the time you're getting ready to sell the bond and what's really 65% of the taxable rate. So that's the balancing we do. Right now what we've come up with is the savings to the county is about three eights of a percent lower interest rate so the stimulus program could benefit us tremendously there what we're trying to do is we'll tie this in to get to a attractive and promised tax rate that we've been discussing all along in terms of remember this is the INS tax rate separate apart from your general fund and maintenance and operations this is for voted bonds. So we'll be back to you on June the 8th that court date with a proposal from the underwriters this will because of the kind of different nature of this we recommend these bonds be sold on a negotiated basis so there'll be a team of five underwriting firms that will be serving the county to sell the bonds rather than do it as a competitive sale like we did last year where we took the the bids off the internet and that sort of thing where they came in this is a little different in trying to tie in the tax exempt piece and the taxable piece and make sure we get the most bang for the back right at the moment the bonds are sold. Yes, ma'am? The downside is what I'm gonna let Bob talk to you about. So, you know, what we're gonna have is, you know, there's any time, you know, and as you can, in the stimulus stuff, there's costs versus benefit. We have to weigh the options and make sure that the eyes are dotted and tees are crossed and so Bob's going to tell you a little bit about what additional requirements are put on you in order to take advantage of the program. So any other programs on the end any other programs? Oh, yeah. Thank you. The ratings, the bond ratings, so we're getting ready to go out and reapply as we do each time. We've had a triple A from Standard Importers, which is best you can do. Can't get any better than that. Moody's, we've kept kind of kicking them along, which is best you can do. Can't get any better than that. Moody's, we've, you know, kept kind of kicking them along and they've been in the AA1 and we hadn't been able to give them to that triple-A level. Well, with all the pressure from Congress and the securities markets and so forth, Moody's and Fitch ratings have recalibrated their ratings to get everybody on the idea of being to get everybody on the same level with Fitch, Moody's, and Standard and Pours. So as a result, we got upgraded, sort of kind of, as a result of the recalibration. So we got upgraded and we didn't really have to do anything to earn it, it was part of it. But so, then we have already earned it, Judge. That's a great point. But the nice thing is, is we won't be selling bonds with split ratings any longer. So it'll be a pure AAA across the board, which is awesome for that. Thanks, Judge. Thank you. Yeah. Me too. Good morning, Your Honor. Remember the court? My name is Bob Drance, filled with Fulbright and George. You're appearing before you this morning as your bond counsel. I'm pleased to have that nice introduction that I can tell you about the downsides of Bill of America bonds. But Bill of America bonds really, as James indicated, have to be issued by the end of this year into the current law. So they were issued an authorized, they issued an 09 and 2010. From your perspective, they have to be done for the exact same purposes that you would be doing bond issues if you're doing tax exempt bonds. So they've got to be governmental bonds in that sense. But the main difference is they are taxable obligations that you get a federal subsidy from the government that is equal to 35% of the interest payments. When they first started doing build America bonds, those payments subsidies were sent to you by check. And some of those issues got, you know, male delayed or whatever. So there were issues a little bit with some of those mechanics. They've changed the process now, so that's all done by wire transfer. There are certain requirements that you, as the county, have to go through, some filing requirements for example, you have to file a notice with the IRS before each interest payment date no more than 90 days before that no less than 45 days before that, tell them that you're ready to go and get your money and you give them that bank account number where they wire it to. So that's the so-called AD38 CP. There are a few other mechanics that are different from what your customers are doing. What you've done in the past with your tax rent bonds have been issued the bonds, put the money in the bank and really kind of forgotten about it. You filed an AD38 form at the start, which is one of those federal tax forms. It's really an informational filing. You still have to file that type of form, but you now have to go on a regular basis, and it's the county's responsibility to go ahead and file before each interspanement date to get that. The mechanical issues are associated with this that are pretty straightforward in that perspective, very manageable. One of the trickier parts that you need to be aware of when you deal with build-america bond subsidies is the federal government reserves the right to offset that subsidy against any other issue they might have with you from the federal dollars point of view. You see this in some cities that have involved with HUD for example, or the EPA or other entities where they have a dispute. There's a process that you're supposed to go through, the federal government. It's okay, we're having a dialogue with you, and we think that you owe us $10, and you think, no, we only owe you five, and they might try to offset that amount, that difference. So, you've got to be cognizant of that, as part of that process. In your case, and in most cases, the federal subsidy is not pledged as the security for the bond. and I want to make the distinction between pledge and actually being used. These bonds are intended to be just like your other traditional bonds backed by the ad-vlaw and tax capacity of the county. Period at the end, from a security perspective, as a bondholder perspective. What makes the economics work and what makes the yield type of thing work is that you expect to take that subsidy and use it to the payment of the debt service. But that's not pledged to the payment of the debt service. It just can be used in that fashion. So the debt service from a bondholder's perspective is going to be strictly based on the ad war on tax capacity of the county, again, period to the end. But from your perspective, the mechanical side of it, if you will, you're going to plan to take that subsidy. This should you like to do build America bonds and apply that towards the debt service. And so that then reduces your actual borrowing cost, if you will. So the mechanics are in place now for doing these. They, as James indicated earlier, these have been used now pretty much in common place towards the earlier part of this year and towards the end of last year. So build America bonds now are very much in vogue for a lot of issuers. They first started out with transactions that probably were at least $200 million. And that's now eroded self-waived down to where, you know, I think we did one the other day for $2 million. So, you know, a lot of communities, counties, hospital districts, those kind of governmental issues are looking at build America bonds as part of their alternative. These, like every other bond issue you'll do, are going to be driven a lot by what the market's telling you is in place. You very well may say, yes, go ahead and pursue that. And when it comes time to price these bonds, it may be that the market isn't very attractive for build America bonds. So it's important to understand that by just saying yes, proceed, that's not telling you that you absolutely are cast and stone to use Bill of America bonds. But if it makes economic sense at the time, you very well may do that. I'll give you a quick illustration. Some of you may have read it was going on in the financial market at the end of last week and earlier this week where they had a pretty good downturn on Friday. The market people that we were talking to, you know, we're pulling their hair out saying, the world's coming to an end stop, don't do any kind of pricing whatsoever. The news over the weekend with the EU kind of helping things out, boosters that up so they say, well, come on early on Monday because we're going to try to price these things as quickly as we can. So it just shows that the market is going up and down, depending on how the reactions are in that particular day. In the transaction that we have is pricing today out in West Texas, they ended up saying Bill the America bonds proved to be a very attractive alternative for them, and it wasn't attractive alternative on Friday. So it just shows you how the nature of the beast moves around from time to time. With that, I'm happy to answer any questions you might have, but fundamentally, it's a lot of the same rules that you would be actually, in some cases, move more conservative in terms of yield, spreads, and so on, but they have to be done very much like you were doing a tax exempt bond issue. There is a 2% limitation on cost of issuance that won't be an issue for you all with this size that you're talking about doing, but, you know, so they have a few nuances like that associated with build America bonds but from most practical purposes it's going to look a lot like what you're accustomed to seeing although it'll be a taxable bond versus tax example. I would imagine the deadlines for you James not only makes for more work but pretty important. I can't imagine, I don't think I wanna know the penalty for not complying. Well, again, they have the provide for office. You don't wanna have, the luxury for the county is that you are not dependent upon the subsidy to make your debt service payment. If you were, you'd have a whole different thought process and dialogue I would submit to you, but you're not. And so if the worst case scenario, if, and there's been speculation about, well, these subsidies could be just eliminated by Congress in 2012 or whenever to pick a date, the likelihood of that happening with the amount of vines been outstanding so far, I think is very, very remote. Can it happen? Absolutely. I've got the power to do that. But I don't think they'll cancel the subsidies they've committed to pay going forward. And in fact, the speculation seems to be that they're likely to look at extending this program because it's been so popular. Whether it proves to be that or not, I don't know. All right. Are there any questions from members of court? Totally so. Thank you, James. Thank you, commissioners and judge. Again, we have researched this and beaten this back and forth and we might, I, the recommendation from my office that based on the potential savings, which is very significant, as Mr. Martin said, and the fact that the subsidies on this issue would be approximately at the start, $1.5 million every six months, that would be about 2% of our overall debt service. So while the timing of receipt of the subsidies, it's important, based on our overall debt service, even if one of the payment is late or delayed, it's not going to be a problem. We will always have that much money in the debt service fund. The pay will make our payments on time, so then it will just be a late reimbursement. We don't have a lot of exposure for offsets. We get a very small amount of direct money from the federal government, scrap grant, the criminal justice assistance grants, never had to repay any of those. So we have very, very small, we have had an offset once before actually over in the insurance, based out the insurance fund on the Medicare subrogation claim. Again, those things are not gonna be big enough. I mean, again, if we even suffering off said, it's not gonna be a lot of money even in response to the potential reimbursement. So, the recommendation is to, as the wording of the agenda item is to go ahead and give authorization for our financial advisors to use these if and knowing it always they're going to structure the best deal best financial structure for the county at the time based on the market and other things. So with your along with your recommendation, is there any savings or any change in the amount of tax rate that we'll have to increase in the next year's budget or tax savings to the taxpayer by us doing this. Thank you, Commissioner. Just see on your agenda book on pages 10102, the two pro forma that service schedules you using regular permanent improvement bonds and the mixture of permanent improvement bonds and build America bonds. And the bottom line is this, you know, this, which is, you know, preliminary for it, for example, purposes, shows about a $350,000 annual savings to the taxpayers. That represents what, as far as our tax rate and any kind of savings. It's a small portion of the cent. Small portion of the INS portion of the rate. So it is a savings and, you know, of course, again, our debt rate is only a few cents to begin with. It's five cents or so. So this is, but again, this is a, it's in the portion, it's in like a tenth of a cent or something like that. It's all, more of the overall dollar savings are over the life of the bonds or what's more attractive. You know, it's a percentage of the annual debt service is not a lot, but the potential for saving up to $8 million of the life of the bonds is what more attractive to us. Will you be bringing back? Will you be bringing back to us? What? I mean, you're saying that. So, I'm going to get the words here. So, are you saying there is a tax savings? Absolutely. And will you, when you present the budget, will you reflect that tax savings and what you're asking for as far as the... Again, this is absolutely the trackiveness of Bill America bonds. The reason it's worth going, you know, doing more work, doing more compliance is that, again, our debt service on SLABBY, thank you very much, will be actually- will reflect $350,000 less of a tax rate that we'll have to raise. And that'll be for next year and many years subsequent. I'm gonna be lowering amount after that. But the savings will be realized over a life of bonds, but that's absolutely the reason we bring it forward. Thank you, are there any other questions? Okay, we have a motion to second on the floor. For the record, Michael Morris, Director of Transportation at the North Central Texas Council, Garmin's Judge, Commissioner, is very nice to be with you. In your agenda, 13C, I would like to highlight a joint resolution or a minute order and resolution type format. Let me first present the context, then the resolution, and then a recommendation to you. When the 121 project was being done, our particular staff recommended the region at 75% of the revenue that comes off the 121 Tolroad project, the same Rayburn now named, would reside in Denton and Colin County. It's still 121 here. Okay. But it always be state highway 121 in Colin County. It's still 1-21 here. Okay. But it always be State Highway 120 in my mind. And it was really to commit to the elected officials in this part of the region, the commitment they were making to that particular project. And Dallas County received not a lot of money in that, even though there's lots of EMT and lots of congestion in that particular community there's lots of EMT and lots of congestion in that particular community in the Regional Transportation Council and the Commission and the Legislative Budget Board all have approved those particular projects. What we have here is a review of what projects need what and the best way to describe this is a cash flow analysis. You have lots of very needed projects in your particular county. Interstate 35E is just one of them because there's a network of other improvements. And there are other projects within the rest of the region all buying for their ability to go to construction. What we're proposing is for you to give $57 million worth of cash flow selection authority for us to complete the LVJ project to yourself. In exchange for getting that amount of money back, plus interest for that particular commitment. And let me walk you through your resolution. Section one talks about the $57 million loan. It's all resides within Fund, six at TechS. In order to reduce risk, staff is recommending to you that we pay you back half of that by 2014. So you're not sitting there nervous between now and 2016 with regard to the payment of all of that in 2016. I suggest to reduce risk, we pay you half in the 24-14 timeframe. We then pay you the rest of that by 2016 deadlines, so we're talking about a near term timeframe, not something way out into the future. We also have in section four that the number one priority in 2016 will to be pay you back. Now we very much may pay you back in 2012 or 2013 or 2014 all of it. This would be the furthest out it would be, which is why I think section four is important. And then we would pay you a percent and a half greater interest than what we're currently accumulating. Our funds and funds six, the RTC asked for special legislation, where all the interest on those funds is allocated to our region, which the legislature had agreed to. So we're suggesting to you, right now you're getting, I think we're getting roughly a half a percent. Interest, annual interest. That of course will go up in the coming months as the economy improves. Our suggestion is we would pay every month whatever the interest rate is to the fund, we would add a percent and a half for what it is you're doing as part of the particular region. So the proposal is you would get interest at four times what we're currently accumulating this month, but you'll always get a percent and a half more than what the rest of the region gets. The format is a minute order or a resolution type format that you would use, and to make sure this is a true partnership instead of a staff signature, I would go Thursday to the Regional Transportation Council for their approval of this document where R2 officers, the chair and the secretary would sign this particular piece of paper as well to make sure you understand that this is a commitment between you as elected officials. Let me summarize why I think this is in your best interest. One, is you get interest at four times what you're currently getting, but you will always get a percent and a half more. The second question would be, OK, let's talk a little bit about risk. I'm not sure you're in a very risky situation, given the Regional Transportation Council has access to $2 billion, plus all federal funds that we have access to. So your risk, even though you're getting a percent and a half, is very minimal. I tell you the risk you should worry about is what the legislature may do to the revenue in their tough times. So by you getting $67,000,000,000 in my opinion, you're reducing risk because you no longer have the legislature potentially holding back your $57,000,000 because now you have a partnership with the Regional Transportation Council. I think you should encourage us to do more to tell you the truth, even though we're not requesting it, because going into this legislative session, you as elected officials have been very insistent that the legislature cannot block these revenues because these are not state funds. These are user fees collected from toll users over the next 48 years. Third, you have a great partnership between us and the RTC on the 35E project. I know that's not all of your projects and I'm trying to say that's the only one of importance to us. But the Interstate 35E is a key one and we have gone for a special allocation of planning funds from the RTC for a million dollars to make sure every day we wake up with an aggressive team of people working with you getting the interstate 35 E project reconstruction as soon as possible. And then the last item and I'll take questions, is this in no way reduces the network of transportation projects that we have anywhere else in the county? That you're helping Dallas County out as part of the original commitment on the 75-25. You're reducing your risk because you have a stronger relationship with the Regional Transportation Council given the state budget cycle. You're being a partner within the region at a time when it's good to have a partner in the region as interstate 35 E gets a major focus And you're collecting additional revenue to build more transportation projects at a higher interest rate as part of the particular program I know no other county. I would wish to stand before to propose this suggestion than Denton County You've been a strong partner since day one. When Bill Hale and I came to you and said, look, we got a different vision that could create a billion dollars with a revenue to build projects in your county. That we foresaw at the time correctly that the state of Texas could no longer participate in. And I think it's the greatest decision that we ever made and you were on the ground floor For that to happen so judge Let me stop there the resolution I think speaks for itself. We happy to take any questions that any of you have on this topic Sure commission Mitchell Michael. Thank you for coming taking time out of you. This is scheduled to come and talk to us about this issue and for coming, taking time out of your business schedule to come and talk to us about this issue. And as you know, over the years, I've certainly been a partner in regionalization and still AM. But I'm torn about this item. And because, and the reason I am is when this commission was called voted to Total 121, it was to make sure that our 35 was done. We had some other projects around the region that need to be done, but the main item was I-35. And the city of Louisville also, main object was to make sure that 35 was done. Now, $57 million is probably dropping the book at most people. But when I'm thinking about 35 and you're saying this is going to be paid back maybe 2014, 2016. And I'm thinking about 35 needing to be started. And I know it's been said that we had the $435 million for the right away of a 35. My concern is that this $57 million could still be used on something on 35. I know it's a $4 billion project and probably going up every day. But I'm, I'm really torn about the fact that we would loan my money to any county, not to Dallas County to anyone. When we're needing to get 35 done so badly and I know you realize that and I know you've been working on it and I appreciate that. I appreciate the OTC. I know they know that 35 is important to this region. So I just need to, for me, I need to understand why didn't County would loan money to any county when we needed so badly for 35. I need to ask the next one question. If we could proceed with construction on Interstate 35 now, we would, but we can't. We need an environmental clearance. We've been putting a lot of pressure on lots of people to get that. There is Now, we would, but we can't. We need an environmental clearance. We've been putting a lot of pressure on lots of people to get that. There is $500 plus million of regional toll revenue on this project. The RTC has something like 60 million already on its own in growing. There's nothing in this particular agreement that is going to slow down our commitment to the interstate 35E project. In fact, we're already taken in RTC position to aggressively move out on that. I don't mind amending this particular position to reassure you that this particular position in no way hurts our ability to deliver 35 E if that makes you feel more comfortable. The reason we staged it the way we did is as we work out on when the environmental clearance is going to occur, as we move out on right away, as we had three meetings with text out in the last 30 days with regard to developing what will have to be some public private partnership to build it. We get to go take $500 million and build a section now. That's not going to meet the needs of your customer or our region. What we're trying to do is use that seed money to leverage a several billion dollar project with the managed express lanes on that particular quarter. And we think we're going to be able to accomplish that. Now, we've got work ahead with us on getting environmental done, getting the right away, done, getting the engineering done and of course moving out on a public-private partnership. If you feel more comfortable adding a section that the Regional Transportation Council in no way will permit this agreement to hurt the ability of interstate 35 moving ahead. That is a underlying foundation to this particular initiative. I'm more than happy to. Certainly. I'll listen to the other comments before I make another. I have a few comments. Great. Here comes. Thank you for coming, Mr. Morris. I'm glad to see you. I represent the great majority of I-35 and I'm kind of surprised that you waited so long to come see me about it. I would have thought that you would have come to talk to me about it earlier. And I guess it's one of these deals where you now seek money. So, you need to talk to me. Well, let me personally apologize if I didn't take the time to personally speak to you with regard to this project. I'll be publicly apologize to you. I-35 is a big project and I agree with Commissioner Mitchell. I've had long discussions with John, our transportation consultant. And although I think we may disagree on the methods to get there, I agree with him and probably with the other members of the court that it's a project that needs to be completed. How we get there I guess is going to be a different matter. I've tried to attend all the I-35 transportation meetings and get up to snuff but I know it's a very important project for you and I just thought you know at some point you would have wanted to come talk to me about it. And let me publicly apologize for that. The other thing is I notice that we're you're asking for $57 million and I represent along with Commissioner Eads, the you know the big rural part of Denton County. And frankly we have a lot of transportation needs. These are projects that I had asked about with Commissioner, with a, it's going's gonna call him commissioner poster With John Polster and I even talked about it this morning with him You know, we've got three seventy seven that goes through my precinct and both and he's precinct right now Thanks to judge horn. It's been programmed with RTR money for lane Expanded for one lane to the three lanes basically But that's still a very dangerous highway lane, expanded for one lane to the three lanes basically. But that's still a very dangerous highway. We're about to, we're doing engineering at some point. Hopefully we're going to proceed to construction. These are funds that I would like to apply to that to maybe expand it to four lanes either way. I have FM 455. It's a very dangerous highway. There are hairpin turns out there with bad corners where people are dying. And I'd love to get that project pushed up. We've used this RTR money to help the DCTA, which I think is a great project to help get people off I-35. I don't know if you read in the paper, but the Lake Cities, in my opinion, the R community college is in desperate need of the train station. That would really help a lot of, well I know, I mean, you know, it's one of the, it's, I agree, but you know, that one of the things is they, you know, they didn't at the right time decide to join, but now I think they found that they are regretting that decision, but they need seed money to help them with the train station and perhaps help them with the back payments that were owed. These are all needs that I can see that need to be addressed in our area. And I don't know if it would be prudent. I'd love to program this money to other projects in Denton County. I've had and Mr. Polster has made very good points, I think on your behalf, I guess he's discussed with me what your points would be that these RTR monies are to be programmed through the RTC and a lot of it in that manner and that there is a way for us to access them. Access them and that's something I'd like to do and consider, I mean, I definitely want to be regionalist and approach. I know that if you help Dallas County with the I with the I635 LBJ project that'll help relieve congestion and didn't I mean we don't live in a vacuum. I just I'm just reluctant I guess to or I guess I don't know if I've been convinced at this point, seeing that there's such need in Denton County that we would want to do this. And I guess I also had another thing I wanted to ask you. Now these RTR funds that you'll pay back with interest, would these go back to our fund 6RTR account, or would they be paid back directly to Denton County? They would go back to the RTR account for selection. So the number of net still be subject to being swept by the legislature itself. But really, that's why we're getting legislation introduced. Senator Davis introduced it last time. That's why we will get legislation reintroduced for all the funds and funds six to be transmitted to local banks within our particular. And that sounds good, but I think it's, you know, I was, that was one of the points I was sold on that I thought if we could encumber these funds and thus protect them possibly from legislative action due to the, their need of funds that they would be paid back directly to Denton County or program directly to the cog But I don't know if we're actually protecting them if they're going to be thrown back into the RTR funds Which as you say can be then swept by the legislature anyway? Well, that's why we're introducing legislation I think there's three questions there. Let me respond to them first with regard to adding a station That's that's a conversation that you don't take to me. You have to take that conversation to the Denton County Transportation Authority. There's a huge equity issue that you're proposing there. One being cities like Louisville and Denton have paid in, other cities haven't. And now we have a city in between that has made their citizens have made the decision. Where you're proposing to bypass an equity position which has to be first brought to that particular commission. I just think it might need to be a price. I got cities all over the region that want transit tomorrow. They just haven't paid the equity price like the cities within Dyer who paid a penny. And we have other cities that say I'd like rail. But there has to be some principle of equity. And I'm not saying you don't have an important transportation project. I suggest you take it to the Denton County Transportation Authority. The second with regard to any other transportation needs that you have in Denton County, I would love to hear about it. The Regional Transportation Council has set up a process or a partnership with you as elected officials. That those items are brought to a task force and we hammer out those particular details. And if there's anything else in the mix that you think can either move faster or should be constructed appropriately, I would love to hear what those details are and measure that against all your other colleagues in the county who have transportation needs and maps those up and see what we can do to respond to those particular items. You do not live in a vacuum. Interstate 35E is a NAFTA quarter. The reason why the legislative budget board is involved in this process is any funds coming off of this particular initiative have to go to other transportation projects that have this regional context. You can't take these funds and stick them in a driveway around the corner. Because the taxpayers that are the toll payers that are paying the system are users of a regional system. And if you have other needs like that, I would more than happy commissioner to review them. And again, I apologize that I didn't personally come to visit you about interstate 35E. I assumed it was an important project in your districts. One of the most important for everybody. That's probably my error. The great majority think runs through mine and Commissioner Mitchell's areas. It was mine everybody. The great majority of the one twenty one. It's important to be in generating from and I don't take offense It's a matter of time. I just want 21 runs through all of my precinct also right I just and I don't want the funds to be used for other projects I want it to be used for 35 what what we discussed in the beginning. That's correct I just think it's a good idea to have good communication and you know, I'd like to Have a voice. a voice at some point. Just had some one little bit of clarity on some of the fund transfers. The money that Michael's talking about paying back the region with are the monies that the feds give directly to the regional transportation council. The RTC controls those revenues. It's those funds that they are committing to put into the RTR account because we have on system projects that those funds can be used on. So the legislature could act in 10 to try to sweep those monies, but they couldn't get it Michael's money until 2014 and 16, because it's not coming till then. So there is protection in the way that we're setting it up. Second is that on 9.35, we don't have to have the money in the account to pledge it to 35. If we've got an agreement saying that in 2016, we're getting X amount of dollars, we can pledge those funds to 35 and so we can pay it forward if that's Will of the entire group. And the reason why the 2016 was selected is, as we look at the takedowns for the construction of interstate 35E, 2016 was still in the window of that construction sequences, which is how we pick that. Mr. Williams. Thank you, Judge. As you all's RTC representative, I think, envisioning with all of y'all over this last year, I believe it's didn't counties position at 35 is our number one transportation priority. Am I correct? Okay, okay, we're in unanimous agreement upon that. And I've voiced that numerous times the RTC and to the members and they realize that that is our number one priority. I believe Michael said at the best when he talked about cash flow, that this is a cash flow issue with the 35 E project. And how do we preserve our 57 million to go ultimately to the project? Do we need that the money on the project now or can that money be reallocated? We receive more money on it than if we kept it in the account which could be at risk. Or do we reallocate it? Increase our position and standing in the metriplex and also preserve the money and have the money repaid when it is needed. If they could use the money today, this minute on the project, we should not do this. It's my understanding, and visiting with Mr. Morrison and Mr. Polster, that money could not be spent today on the project, the stage that we're currently in on the project, as projects mature and grow and evolve. The current stage that we're currently in on the project as projects mature and grow and evolve. The current stage that we're in is funded. And so Commissioner Coleman, I agree that we all have priorities in 377 and I've got a couple of segments in my precinct. I know you've got one as well and we would like to get all those constructed today. But if we use this $57 million on that today, we are removing the funding ultimately for 35. I mean, by reallocating any of this money to other roads here in the county, that is removing the money ultimately for 35. And I think that's our number one priority is to make sure that 35 is funded and looking forward to the region working and with Techstar to the county on some kind of process where we can ultimately have 35 created that we can use as a model for 35W which is going to be at capacity by the time we get around to constructing it. So, I think there's risk involved in keeping the money in the account, but there's also security in ensuring it, which is the way I view it, as an incumbrance to be repaid. And I'm especially appreciative of the item four, which is didn't can be repaid first from any funds. Not what's left, but anything that's made repaid first of any future allocations coming to the RTC. I respond. Yes, commission. I agree with you. I mean, commission needs. Those are well spoken words and I take them with great weight. I guess my concerns is, you know, we all kind of, like I've talked to you before, we all kind of go from our own background. I'm concerned, you know, regarding the specific wording of the resolution. I'd like it to be drawn up tighter, more specific. Frankly, I would rather have the money be specifically programmed for Denton County out of the federal funds that are going to be done as opposed to repaid into the RTR funds. I do like the concept that, you know, we are protecting these funds for being swept by the legislature. I'm just concerned that this Meccanation is not really protecting them at some point. They still can be swept and I like that concept If I could judge to clarify this particular point in Commissioner Coleman you're absolutely correct and I was thinking that the Regional Transportation Council would be looking at one source Which would be existing Regional toll revenue funds that would either be coming from the 121 project or from the 161 project or the 20% gross revenue we're getting from the George Bush extension. The other funding source and the RTC isn't picking it is go ahead and using our federal funds and putting it directly on a particular project as John suggested. What we're doing is leaving the funding source flexible to increase the range in which we could pay you. We may end up paying you in a combination of regional toll revenue funds and federal funds. But if they're federal funds that we pay you back in, they would not go back into the account that could potentially be swept. They are protected under congressional rule that the elected officials on the Regional Transportation Council have the final selection authority for those particular projects. I just don't want to have my handcuffed here today indicating it has to be federal funds or it can't be RTR funds. I think you should give us the flexibility that whatever funding source comes back, we certainly can measure what risk by 2014 should occur. I feel pretty confident we will have the money out of fund six by 2014. And it wouldn't matter which of those particular sources of revenue were used. I don't think we're in version. I mean, I think that's a good point. However, I mean, you know, the whole game changed when we sent off, when somebody sent off for an attorney general opinion regarding these funds, and then they all got reclassified. When, then that would happen at one point with the attorney general opinion actually gives us the roadmap on the words we need to put into the legislation. So the attorney general said, look, because of this particular word, in current legislation, that gave the ammunition to Senator Davis to actually write her legislation so we can overcome any particular restriction. And there's no question. These are not tax proceeds of the state of Texas sitting in fun sticks like a gas tax or a registration fee. That's why you've all been very firm on getting these funds returned as quickly as possible. That's why I think I'd like to have it tightened up to be more specific. Because- Which part? Probably. And instead of any, should we say any funds to include and then spell out the different funding sources? Yeah, I think so. And I mean, do we want to specify 35? Yeah, I'm sorry, but I'm just back to 35 and it's no way going to ironclad. And the thing is I talked to Mr. I'm sorry Ron, I didn't mean that. That was my point. I said if you're going to tighten it up and you're going to specify when they come back in what they're used for, we've already, I think unanimously said that it would be used for 35. And I said, right, and I said, right, many other projects. And I, some of my heartache has kind of been delayed because I've been told there is additional RTR funds that I perhaps, you know, with everybody's consent can access to perhaps build a bridge between the Lake cities and DCTA and the community college. And, you know, some other stuff that Judge Horn and I know about dangerous areas that she probably has good insight to, you know, things like that. So I just want to. There is interest. I want to. There is interest. Fill it down. There are interest earnings in the account. There are interest earnings if that's what you're. There are under-combert funds that are still in the account. And I sent that information to you all. Don, can you over do the microphone thing? There are under-combert funds. And I sent that to you all the other day. The only thing I want to recommend is that I truly believe that Michael's right, that he should have the flexibility, we should have the flexibility on what type of repayment that is when the time comes to stride because we don't know what's going to happen in the next couple of years. But I do think that you could and should say that these, because I've been worried about 35 from day one, that these funds, when they come back into the RTR account are not unprogrammed funds that they are specifically a airmarked for I-35E. Why can't we do that now? Okay, hold on a second please. Commissioner Marchens, we need to ask you. That's good. When the 1.5 plus 1.5% interest is accrued, but if we reach this agreement, is that deposited back into the account that were back into the funding account and those interest be distributed to Denton County to use for any transportation project. Every month we will record what interest we've gotten our pot at a percent and a half. Keep track of that. And then depending what funding source we give you, the amount will be increased by that particular amount between now and the month in which we pay you back. And then the conversation I had earlier is if people are nervous about Interstate 35E, you can add a section to this resolution that says our direction is that whatever funds come back into the Interstate 35E project. And I'll say it includes the interest because one of the things that people not hearing me is that this is a four to half billion dollar project. So if we can turn 57 million into 62 or whatever it ends up in, I say you put in a, I just wish I had a thought of it before, is to stick in a number six that says these funds will be returned or reallocated or future encumbered for I-35-E. Because what Michael saying is, if he pays you back in RTR, it has to go back into the RTR account. But if he pays you in KET-2 or KET-5 or whatnot, then he can simply black-I-35 as the project and then no one ever has to touch it. I mean, I mean, the job would, excuse me, just say, number six, you're suggesting that these funds be dedicated, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh, uh job would excuse me just say, number six, you're suggesting that these funds be dedicated or the I have to do it. What if we did any repayment? Any funds repaid to Ditton County's RTR? Count Shelby's been on 35 E construction. I think you just say rep repay, because we may not pay a back in RTR funds, we can pay a back in federal funds. So, if they spent, say, program towards. And also, these funds, this loan does not affect the R35 construction anyway. If anything, any funds repaid to Ditton County's account shall be programmed on the 35 E. That's correct. Project. Add my statement. Okay and then tell me what you see Bobby. This loan does not affect the construction of about 35 microeuroxyceg. Negatively exactly. Negative Italy. Yeah. Negatively. Negative, basically. Yeah, this agreement in no way negatively impacts the construction schedule for interstate 35e in Denning County. Okay, here we go. Stage number six, if I can read my writing. Any funds, repaid to Ditton County's account, shall be programmed on the I-35e project. This loan does not negatively impact the construction schedule of 35E. I, as to we, okay. I can turn it landing and you might want to ask Mr. Morris about this but you said into our account because they may not get paid back into our RTR account, correct? I mean that's my concern is I would not mind loaning the RTR money as long as we, to me, correct me off I'm wrong, RTR funds are a danger of some legislative sweeping away, correct? Which is why you should do this, right? I understand. But I would like to commit these funds if possible to be repaid in a manner that if we make this commitment these funds are not subject to being swept by the legislature. What you know what I would like to have in there. I'm sure I'd like to do that even if it's not. Well, I mean, let's go ahead and put it in there. The reason why you don't want to do that is if I have RTR money to pay you back and I'm ready to hand you a check for 62 million, but five years earlier you passed a resolution that you didn't want it in our TR money I've no other way to pay it back. So you don't want it. I don't want to do that. Okay. But the RTR I think is fleeting at best sometimes. I'd rather have it back in you know, fundable hard dollars. I mean, I'm willing to compromise, Andy. I want you to read the- I think that's right. I would move for approval of the agreement between Dyn County and RTC concerning the use of Dyn County Regional Toll revenue funds. As presented with the addition of a paragraph 6, any funds repaid, a Dyn County shall be programmed on the 35E project. This loan does not negatively impact the construction schedule of 35E. Thank you judge Thank commissioners now that you are all wore out from the previous one This should be real easy Last month the court entered into an agreement with opportunity regional water district to assist in household hazardous waste recycling disposal for the residents of Denton County, all the residents of Denton County. I want to make sure we get that in there. This grant opportunity that we have is to be able to expand the program faster and cover more of the county. The grant is not a guarantee. It's a one-time grant. And the grant covers the cost of expanding the program and does not have any cost associated with personnel or adding personnel or equipment or anything like that to the county. I'm page 143. The only item that I would change the wording in this is that will not restrict the program to only those, the county will not restrict the program to only those that live in the unaccomparated areas.
