I'm talking again about having the monument removed on the square. Each week that I come and present, as you can well imagine, well you might not imagine, but people talk to me about what I've said. I didn't think anybody looked at this time. It was a surprise that the people who look at this me here. By the way, if those of you who are looking to complain complaining want to help call me. My email is husbandwd at gmail.com. A lot of people have better complaining. Okay. I'd like for that monument to be removed. And I want some more African Americans to be hired. And some, I called it administrative positions and I found out after asking for the information that they're called different positions. Wherever they're, I want people hired that's my color in places that make decisions. That decide who gets hired and who gets fired and who moves up and what their responsibility is on. I swear I like some African Americans to be in his banks. Just in this room today there's only two of us. Two. There's almost never anybody else at this court. But just us two. Something's wrong with that. I guess what you'd say is it's the people. No, it's not the people. It's something else. But we'll talk about that later. Let me just talk about one of the aspect of what that monument represents for me. When you look at it, it represents something different to you. I'm sure. I guess. What it reminds me of is some of the really difficult times I had growing up. My father was two generations removed from slavery. So his way of disciplining me, because his father's father grew up in the slave was his corporal stuff. I mean really it's what they call now child abuse and I survived that. Well nobody taught me how to do it. I came from that this is slavery what slavery does. Why take so long to get it fixed. Nobody helped me. I doubt if any, I just wonder. Let me wonder aloud. How many African Americans have you had over for dinner? I know what I say. Well, anyway, and I want to break this point. If you see a problem with that monument on the square, it's what some of the other people have told me. I didn't do it. I didn't do it. If you see that it's wrong and you see this the problem and you do nothing, you're just like the people who put it who did those things. So back to my story. My dad used Corporal punishment. It was bad. It was real bad. Well then I have children and I didn't know what to do. I did the best I could do. I lessened the Corporal Punishment some. My kids would say to you, no he didn't. But I listened to Corporal Punishment some and now with my grandchildren I know exactly what to do. I've learned by myself. Take that telephone. Take that phone. Take that computer. Worths, wonders. I don't have to get upset. I benefit from it. I've learned that. Took a while. Now you all can help the other people too. Take that monument down. It's quick reminding us of the way things used to be. All right. Item 3a is approval of a resolution for claiming November 6, 2010 to be Denton County Veterans Legal Assistance Day. And now we have some guests with us this morning and I will read the resolution and we'll vote on it and then anyone that would like to add comments, you're welcome to do so. The resolution supporting the Denton County Veterans Legal Assistance Day, whereas Denton County citizens have joined our nation's armed services and have defended American lives and liberties with unwavering devotion. And whereas, didn't county would like to honor these servicemen and women with deep gratitude and admiration for their bravery in protecting our independence and safety. And whereas, it should be known that didn't county will not forget those residents of our county who have protected our country for the greater good. And whereas an appreciation of that service, the Denton County Bar Association and legal aid of Northwest Texas will recognize and honor the Veterans Actions by providing qualifying veterans with legal free legal services on number, I'm getting doubt, I'm'm sorry free legal services on November 6, 2010. Therefore be it resolved that the Denton County Commissioners Court of Denton County, Texas does hereby recognize that November 6, 2010 to be declared Denton County Veterans Legal Assistance Day in Urge All Denton County lawyers to participate in pro bono services and remembers of the members of our armed forces who are given so much to this great country. I mean witness there have we said this six day of November in the year of our board 2010 to be Denver County Veterans Legal Assistance Day. The chair will move for approval. I want to thank the Commissioner's Court so much for passing this resolution. This is being done in conjunction with the Denton County Bar Association in legal aid of Northwest Texas. And not just the veterans, but their spouses and spouses of the deceased veterans are also eligible for this. I didn't, we didn't happen to mention that, because the families give up a lot also when someone's serving in the military service. And so it's gonna be this Saturday and I just wanted to express my appreciation for this resolution. Thank you. Thank you for doing it. We appreciate it. We're doing everything we can to advertise this because we need to get as much publicity as possible, right Joe? So we can get that people out. That's correct. And it's going to be a quarterly, it's going to be done quarterly. This is just starting the program. So the first time may be a little bit small, but we're going to continue it to make it on part of our regular schedule. Okay. Great. I don't see anybody from the record chronicle here that I know of. I'm asking if you've done press releases with them. I've got someone handling publicity and yes, we have contacted them, contacted friend cheese and all the different veterans organizations. And so we're getting the word out. Like said, we're like we're learning ourselves. So it's great. Appreciate it. Right. And I wanted to thank you, kind of judge and commissioners, for taking the initiative to do this. I know it's always great when we give back to our veterans. I did want to mention that it is probably going to take some time to get veterans used to this because once upon a time there wasn't a service like this offered. So we have had veterans come into our office before asking for legal aid particularly for family law Issues and we've had a tell them that there's not a program available to them and what we try to do is we try to network I was going to SMU for a while So I try to network them down to SMU law school Which does provide some pro bono work and some other law schools around the area that provide pro bono work But the problem with that is they have to be from that county. So if they were from Denton County, well SMU isn't Dallas and then we have another law school that's Texas West and over in Tarrant County, so they weren't seeing Denton County, so it's good that we have this now and we will try to get that word out there. And it's, they're having, it's this Saturday, correct? Saturday, November 6th. And I know we don't have that in record chronicle. They're probably covering election day things, but I will try my best to get that word out to them. Hopefully they'll publish something. So this is going to be court-a-way, correct? Yes. Quarterly? Order, waving, dint, and kind of his right to issue ARA recovery zone bonds allocated by the US Treasury. James. 5B. The recovery. The recovery. The recovery. The recovery. The recovery. That is the state agency in charge of administer administering the federal Recovery zone bond program that was authorized by the American Recovery and Reinvestment Act 2009 Why this happened is based on 2008 unemployment they allocated these these these new and limited use bonds to the larger counties in state of Texas and you see we had an amount authorized us, they're going to expire at the end of December this year since the Libyan No Dis of using these or any designation of a recovery zone in which the name projects We've been asked by the Texas Bonne Review Board We wave our authorities so they can be reallocated to other local governments that may have projects Can add that we've got a request Same line from the county judge, ABER, from Fort Bend County. They're the only county in the state that actually has a project they're putting forth. And they have identified a project. Actually, it's a private activity project. And there'll be issuing these bonds. They would like to issue these recovery zone bonds for a what is an effect, a private activity that would not otherwise qualify for tax-free debt for job creation in their county and they need considerable more amount of money than they have allocated. So they've also asked that the Denton County considering waiving their authority if we have no interest in our no plans to issue these bonds the next two months. So, and what this needs is that it needs the vote of the court and the signature of the county judge on the waiver on page 119 of the packet and it will be transmitted back to the Texas Bond Review Board if you so wish. Rich Mitchell names could cities request that these bonds be used. I guess I'm maybe I'm the only one that I didn't realize that they could be used for what can they be used for? Can they be used for considers requests that we do something in our name if they have some areas that? Yeah, you'll see on the use of the bonds, somewhat explained in the backup material on page 117, this letter from the Texas Bond Review Board talks about the overall allocation and the types of bonds. That's the second paragraph. And it ends the second paragraph by saying, well, you know, list of recovery zone authority for certain Texas cities and municipalities can also be seen. So cities, some cities actually have some authorized too. And you know, if, you know, it says in there, the total amounts of programs subdivided by the Treasury for certain counties and large cities population on the 100,000 based on unemployment formula. See, I'll take you there. I saw that, but do they know that they can use them? Because if we don't tell them, do they get the same information that we get? You know, I would just assume they did. This information never came to me directly. This was this bounce around. This is for actually, I don't know who the actual notification was mailed to or notified on this. I'm going to leave you an email and I believe I forwarded it to you. I mean, but really, all I really heard of it was people wanted to wave our allocation for it So it's just up to the up to the wishes of the court will point out that at this point There are less than two months remaining for the official desert and you know the county Anybody would have to designate a recovery zone and state the methods but would have to designate a recovery zone and state the methods that are used. I mean, it says here, the recovery zones can be designated by city or municipality in any manner. They choose appropriate, but then everything actually have to be issued by December 31st. So this is what this month is lost. It's now. This month is lost now. This month is lost now. I mean, I just, you know, I'm going to ask repeatedly and by more than one source to bring this to the court and just for your consideration. I have no recommendation one way or the other. I don't think it's going to hurt us to go ahead and approve this by the I received numerous emails over months concerning different recovery activities. If I can, I'll just I think this will add some information on some response to the commissioner about whether anybody else wants it. This is from Judge Robert A. Barry's, County Judge, and Fort Man County. And this was an email from middle last week. And actually requesting didn't county wave our rights for an allocated recovery bond, recovery zone bonds. And it goes on to explain what they are. And this program counties enlarge municipalities, our eligible issue these bonds, and then expires. And he says a $45 million private activity project in Fort Bend County has requested to sell recovery zone facility bonds. It actually would be used to build a facility with tax red debt. Under this program, as you can see, the tax list for Fort Bend County has no allocation. And the way our county can access this program in this project, for the 120 new jobs, ask other counties to weigh their rights. He says as of this date, which was October 27th, our project is the only application formula on file with the bond review board. So I really don't think there's any other interest in the state on this. Certainly none has been filed with the bond review board and that is the agency that has to be notified of any of a designation of a recovery zone and of any intent to issue the bonds. You see that so. Because they don't know about it. Everything I see there's no other interest. Again, that's you know, step through court. Are there any other questions? Are my, and my assuming correctly that in order to participate in this, whatever jurisdiction it is, they have to put up some matching funds? No, not necessarily. No, and these are going to, these recoveries, there's too many recoveries. I just have the ability to bother tax free. Yeah, but actually These bonds are available again. So this this particular project is private activity project very similar to the votes the commissioners towards been asking the past for by these health facility corporations Somehow exist here and we don't know anything about also the corporation ask us we had to authorize bonds for school dormitories. But actually these bonds the county could issue these themselves for their own project and where we had a recovery zone that either was and we wanted to do a project for our own facility that we think would, you know, would again spur the economy because it would hire, you know, would hire a contracting firm and put people to work. We could, the county could designate their own recovery zone and issue these bonds. You know, we, of course, have authorization for already on hand for all the projects we have in our capital improvement plan. So these would not nest, I mean, we end up just paying for these. If they're private activity bonds, you know, again, I generally have to go that private activity, whatever that corporation is, ends up forming a tax-free corporation and actually own a facility and pays for the bonds. Again, so I think the Fort Bend County would be one where they're going to up forming attacks free corporation and actually own a facility and pays for the bonds. Again, so I think the four of them in county would be one where they're going to authorize issues of bonds or they're going to probably have no financial requirements on it. But it actually could be it appears they could be issued either way. Okay, so we're not hurting ourselves or hurting any of our jurisdictions in Denton County. And there's a two-month deadline on it. It appears to be no, again, no others. Of course, county, we've not been discussed, no recovery zones have been designated at this point. And we've started, don't appear to be short of funding for any projects we've already identified. Cities within the county like Carrollton, CD of Denton, Lubbock's not in County, is it? Those look like to the two largest, I don't see Luz, alone here. Have their own authorizations in different amounts and smaller than ours. Again they don't appear to have designated any recovery zones and put forth any projects either because again Judge A. Baires letter says there is only one project in the state and that's the one Fortman County would like to put forward. All right. Well, I'm going to move for approval of this item. As you know, Denton County's Benefit Plan allowed for covered surviving dependence of retirees to continue the deceased retirees to continue in the plans in the medical vision and dental plans, and each year the court approves premiums for those individuals that we call sponsor dependence. The rates are in the packet that we are recommending and we're asking for approval today. Questions from members of the court? Yes, are these the same as they were last time last year or are they going up? The ones in the first four columns would certainly they would not be because they're based on retiree rates and our retiree rates some of them changed for 2011 so they won't be exactly the same as last year. These are dependence of retirees. Endance of retirees will change? Well yeah retiree premiums you've already approved and those did change for retirees over 65. Those did change and these are based on those rates and so these change also. Okay but for the pendants of current employees they haven't changed, correct? That's correct. That's correct. First of all, I thought we had discussed before we reappointed somebody that we would put on item on there that said discuss the reappointment and List the position as opposed to just posting the person and that's the practice I would like to do in the future Why didn't know who You know how the only reason It was your recommendation the only reason we posted it as it came through my office Commissioners. Because I mean, I didn't know off, you know, I know that Bobby, did you have an appointment to the DCTA? Well, it was my recommendation to the court. OK. Because I know that in the past, we've had just people put on there. And you know, we don't have an item that says we've got an opening or a reappointment. You know, does anybody else have a recommendation? There are two other positions that are coming up, sir. Right. Well, that's what I think we should do is when we have appointments like for the NTTA. I didn't have a problem with Mike Knowles being on there. But we reappointed him without discussion. And the, I mean, I'm not sure who did it, but it was just put on the agenda. Maybe in the future if we instead of just posting this as approval of the reappointment, we'll say discussion and possible approval. Right, I think what we should do is just say, look, you know, put an item on the agenda that says, look, we've got a new position. And then we can have a discussion and say, do we want to reappoint the person who's on there? or do we want to consider somebody new? Because you know, I don't want to embarrass somebody by having them on there and then object to them, you know, what I would like to do is have the agenda item on there and then discuss do we want to reappoint the person? Do we want to try somebody new? What has gone on past in the discussion with that board? Bobby and I both have the DCTA run through our precincts. There's a lot of issues that we have going on right now that I'd like to discuss with some of our DCTA people. I've asked to be, you know, CCED on a lot of the meetings that are going on there. I did ask for that. They CCED me on their emails and let me know what was going on there and then they've dropped off again. Particularly, I'm very concerned with weekend service and night service from the DCTA. I'd like to be able to talk to our representatives and get a feel for them on that position before I go to reappoint them. But, you know, I just caught this on Thursday. them but you know I just caught this on Thursday and wanted to know you know how's this person feel on those positions not that I tell them what to do I just want to know what their flavor is what's going on I just think that's a good way to do it. Commissioner Martin I just I mean I would appreciate the opportunity, because it's so confusing at times, whose appointments these are. I mean, if it's a tire court appointment, I think these are entire court appointments, not a recommendation did come from, so you need an unincorporated area appointment when we did the DCTA, and that's what's all the career. So all I would like to take it, is if there is an all court appointment that we need to be aware of it and then place it as a general item for discussion then a recommendation would come for approval probably at the next one. I would appreciate it. Yeah, if it's possible. Most of the time there's time to do that. Sometimes there's not. I can't see. I understand, but I mean that. But if at all possible, that's a reasonable way. I didn't know that this was an appointment for the unincorporated area. And that's what this is. So that started way back. I had a I know that I mean Andy and I represent the unincorporated areas There's a little unincorporated area in both the all jurisdiction, but mainly Andy and I do that You all want to know in the court at the time Well, I mean things change Bobby. Well, I'm not saying that you shouldn't be aware But I'm saying the the appointment happened before you that on the court. I understand but I don't know that this is the appointment for the unincorporated portion of the county but I don't know that this is the appointment for the unincorporated portion of the county but I Think if there's future appointments Who it vacancies right all need to have a heads up? I think that's what the spirit of what you're saying Yeah, you use it. We need to have him a heads up in the future vacancies so we can all be putting on our faking cap and knowing about who's what holds that we're going to need to fill. I'm just saying that's not too long. And DCT has urban, you're correct, Judge. And DCT does have urban appointments and unincorporated parts of the county appointments. Unlike the CPS, it's just a general commission or appointment that each of us have. I have to belabor the point but you know I ran for commissioners court and now I'm on the commissioners court and maybe I don't particularly want to reappoint the person my predecessor reappoint pointed. Maybe I'd like to have somebody I could appoint on there so maybe I don't just want to unilaterally automatically reappoint people. Well, and that's understood, and I believe commissioner, when it's been a specific commissioner appointment, we've, I've had to identify that and contact commissioner in advance. No, I understand, but even if it's an appointment by the commissioner's court as a whole, I think, you know, I'd like to at least have some discussion before we automatically, you know, do it. That's what we're doing now. Right? I understand, but I don't know. And I've read with you. And I thank them for service. It would be nice to have known a head of time that we have to vacancy. I'm not arguing that. I know. Yeah. I'm glad. It brings me to the point of there are two other positions that are coming up for a reapp appointment and one of them and I'm coming to a hard time remember his last name Larry, the Roo or whatever. Are they urban or none? Are they rural or are they? Urban or are they? The problem is they can't reach him. He's not showing up for meetings and they can't reach him. They can't contact him. He's not responding to anything. So we need to be thinking about a replacement there. Who is he? What is the urban or rural or how does that matter? What's that? I don't know, but I'll find out for sure and let you know. I mean, I definitely, you know, I would commend Mr. Correll for his service. I've never met the fella and I'll be honest, you know, the DCTA is going to be a big issue. It's coming up. We're fixing to open up the rail station. And I will tell you that my staff not only when these appointments, reappointments come up, it's important that DCTA or whatever organization it is, happy with this appointment, but also that they want to serve again. So, you know, we do qualify them on those issues. I know. I know. And I appreciate that. I think the DCTA needs to understand that these are appointments by all the court, not just by one specific person. If you remember the last appointment that was made by one of my constituents at a pilot point that I think you recommended, Judge, I went and had breakfast and talked to the guy beforehand because if you remember, I postponed that appointment a week because I didn't have the opportunity to even speak to the guy before you put them on the agenda.
