And whereas the Governor's Committee on People with Disabilities presents the annual Lex Is That Freedom Employment Awards, named for the Disability Rights Champion Instra Metal in the Adoption of the Americans with Disabilities Act, and where is the Mayor's Committees across the state nominate individuals or businesses with their municipalities or across their counties for this annual award, recognizing businesses, individuals, and organizations dedicated to maintaining an exclusive workforce, and whereas Denton's Mayor's Committee for persons with disabilities nominated three outstanding business organizations to thank them for their strong support in providing and maintaining employment for persons with disabilities within Denton and Denton County. And whereas the Governor's Committee recognized big lots of Denton Texas as a leader in providing employment opportunities that are critical resources to those individuals who seek to achieve independence and to become an active integral part of the Denton community. whereas big lots has for several years carried out specific outreach activities designed to encourage persons with disabilities to apply for positions within their business organization and have provided special training and reasonable accommodations when necessary to create a team atmosphere for all those employed by the organization. And I must say, for those of you who are not familiar, the Lex Freedom Award was named after an individual who was very instrumental in the Americans with Disabilities Act, passed into legislation in 1990. And so big lots has gone to represent us here in Texas as a small business working towards meeting the needs of individuals with disabilities. We've worked with a lot of the schools and everything Right and a matter of fact here and just a little bit will have a group coming in that of our deaf students That'll be coming in to to work with our our associates and work with our folks there and it gives them a great baseline As far as some different things that they can do to further themselves, as far as further themselves throughout their rest of their life. Gives them a good strong work base and everything gives them some familiarity. And everything, it's just a great program. It's wonderful working with the kids. It's a win-win for both sides. Like I say, it's a real pleasure to have all of them in and work them with them and helping them to develop because the kids are our future. So, I want to appreciate your time there as well. Michelle, are you going to be speaking or is it going to be state? Both. Okay. Good morning, State. Good morning, commissioners. Judge, I'm actually not going to speak to be speaking, but since it's got my name on it, I thought I'd have a comment and introduce it. Michelle will be presenting this material. All right. Good morning. I'm not sure if we can make a decision. I'm not sure if we can make a decision. I'm not sure if we can make a decision. I'm not sure if we can make a decision. I'm not sure if we can make a decision. our tax year, I thought it would be beneficial to come and explain what went into actually beginning the tax year, what went into actually getting us to this point. And so I wanted to give you all a bit of a presentation about what occurs from July on and to get us to this point. First of all, as you probably know, Ditton County collects for 72 jurisdictions and that includes four public improvement districts, assessment districts. We began calculating July 26 for right at 64 of our 72 jurisdictions. Typically, whenever we start the calculations, it takes us about three days to get the calculations completed and ready to go. What we do is we actually do all the calculations first, then we release them. Otherwise, if you do a calculation, release, calculation, release, you have all the people that you've already calculated for starting to call you and you can't get all the rest of the calculations done. So just by policy, we started doing that several years ago. It is important to note that as we're doing the calculations and as we are assisting our jurisdictions we will by policy and by contract actually publish the effective and rollback rates in the newspaper for all of our municipalities. We do that so that we make sure that those publications that are all important get into the paper timely and efficiently. We also will assist our many of our municipalities with their notice of public hearing as well. We do assist them, we ask that we will, we request that we assist them. Some of our municipalities will go ahead and perform that function themselves. But we, all over all, about three quarters of our municipalities, we do assist them with that. Same thing with our school districts. We will assist them with that as well. Some of the school districts will go ahead and do their own notifications, but most of them, they have us go ahead and help them with their public hearing and their notice of budget and tax rates just because we have so much of the information at hand and you know those publications, they have to have the exact wording, they have to be composed properly in order to comply with law. In our interlocal agreement, we asked that all of our jurisdictions turn their rates into us by September 15th. Not everyone could do that just simply because of their budget calendars, their workshops, and some of our jurisdictions were unable to make quorum early enough to be able to meet that deadline. Something that we're going to continue to work with our jurisdictions over the course the next several years is trying to get those rates in a little bit sooner every year because obviously the sooner that we can get the rates in the sooner we can go ahead and start the processes that we need to do in order to create those tax statements. The tax rates are all after they're adopted they're reported back to us and to the appraisal district by a survey. They have to be signed by a proper authority at the taxing entity. A lot of times we have to call our jurisdictions repeatedly asking them to get those surveys in. You would think that most of the time, our jurisdictions would be very quick to turn those reports in, but they're just as busy as everyone else is, and a lot of times they just forget that last step. And so we do often have to contact our entities and tell them, we need your rates, we need them now. We did have one jurisdiction that they adopted their rate September 28th and they had their meeting at 8 a.m. that was the last rate that we got. They had their meeting at 8 a.m. we got their survey by 8.45 and we were off in trying to actually completing all of our processes to be able to get to this point. Now, when we get those tax surveys in, those tax rate surveys in, there's several things that we will do to ensure that everything is as correct as possible. A lot of times when the jurisdictions turns in those surveys, their total rate, they will write correctly, but the components between the M&O and the INS, they may or may not have that correct. And so we actually- And up. That's exactly right. So we will actually manually add up the components of the rate. We will actually check every piece of that rate survey before we commit it into our property tax system. We will manually add up the rate, we'll enter them into a spreadsheet to make sure that they add up. We'll enter them into the tax software program, and then those rates are checked by probably four or five people within the office. The last check goes to me and I checked them usually three or four times before I decided that they really are correct. Michelle, I think it might be helpful for people to understand the intensity of all this because it absolutely, positively, has to be right. There is no room for error. Because once it's entered into that software system and you start doing the calculation for preparation and mailing the statements, it can't be changed. Once it's in, it's in. And there's a 20 year statute of limitations. It has to be right. It's a little intense. Indeed, indeed, you're exactly right, Judge. And it's not uncommon for each one of the rate surveys to be checked a minimum of 15 to 20 times. And usually after I've checked all the rates, I usually get to a point where I have to just file everything up, put it out of my site. Because if I see those surveys, I'm going to worry. Did I really check them right? So there's an enormous amount that goes into verifying that the information that's been submitted is actually correct. Now, while all of this is going on, we're also working with our tax statement vendor. As you know, we have a new vendor this year. And so Patty Bonner, in our office, has been working directly with our new tax statement vendor to compose the tax statements, to work through all of the information that has to be on those tax statements. We're composing the masks of the statement and getting everything exactly right on those statements so that whenever we are able to release that statement file, the vendor can simply insert the data and we can move on. There are 16 separate items that by law must be on the tax statement. And of course we check all of those items before we ever get to the point of actually releasing the tax statements. Also, while all of this is going on, we're also working with what we call our certified loads. And what that is, that is the appraisal role that has been delivered to us from each appraisal district that we work with. Didn't County works with seven different appraisal districts. That's seven appraisal roles, that's seven formats of data. Out of those seven appraisal districts, three of those appraisal districts have their own type of software that is different from the other four. So you have a different report to have to work with. You have different. The data is not different, but the way in which you arrive at the data is. So all of that is going on at the same time that we're doing tax rate calculations and survey checks as well as working with the tax statement vendor. When we go to actually load up those roles, what we have to do is we actually have to load up the Denton appraisal district data. We balance that. We then move on to the next appraisal district data. Balance that. Then balance that to the first one, go to the third one, complete, and repeat seven times in order to get our final role. It is important to note that with our software that we have now, we are able to do an enormous amount of functions all simultaneously that we were not able to do an enormous amount of functions all simultaneously that we were not able to do with the previous software. With our previous software, we had to shut down anywhere from 10 to 21 days. And by shut down, I mean, we had to get off the tax roll. And we could not post anything to the tax roll. And the only way for us to be able to accept payments from taxpayers was manually in writing them out, a manual receipt, and holding those payments in our vault until we actually had an active tax role again to use. We do not have to do that with this software. Previous years, 10 to 21 days, we were down this year, we were down about three hours, and that was it. So that is very, very encouraging, and of course that allows us to be able to continue serving our taxpayers, which is what we are here to do. The new software also allows us the flexibility to manage our statement files more fully. We were able this year, this is the first year we've done this, we were able to create separate owner statement files, one with mortgage companies, one without mortgage companies, and then the agent files. That way we can tailor those tax statements to where those people who are going to be receiving a tax statement, who have a mortgage company, there will be a comment on that statement that says duplicate provided to your mortgage company. On those who do not have a mortgage company, that comment won't be there. So that is something that we were very excited to have the flexibility to do as well. Just to give you a rundown of the way in which we where we are right now on September 29th, which was a Saturday. We did all of our end of year balancing. Our general ledger was rolled over the 2012 tax year. Starting balances were initiated. We balanced out the 2011 tax year without any problems, balanced in the 2012 tax year. On Monday the first, the tax roll was available for viewing and for accepting property tax payments. Even though the tax statements had not gone out yet, we had a live active roll on October 1st. On Monday, on, sorry, on Tuesday through Wednesday, the final pieces were being done to complete our role for our print vendor tax ashrow was applied several different things that we have to do internally before we can actually create that tax file to send to the print vendor we're done. We had to apply a name and address update that had 32,000 accounts that were updated and applied 14 appraisal district supplements to the role before we ever created the past two years. I figure probably by Friday to Monday the tax statements should begin hitting mailboxes. So with that I appreciate the opportunity to come and share what we have done. I do have to say that this would not be possible without dedicated and diligent staff and I want to publicly thank Stacey and Patty and Karen and Yacco for everything that they did in order to get us to this point they've done a fantastic job and if you have any questions I'll be happy to answer them and I appreciate your time we have yes we have Yes. We have. Yes, we have. Is there any outstanding issues with that? If it's no, there is not. Right. This for comparison. And you'll notice she said we're collecting for 72 jurisdictions at this time with all the special districts and stuff. When I first started the tax office in 1993, the county collected for eight jurisdictions besides the county. She's doing an eight times better job than you. She is. I think her presentation today just kept anybody from running against her in the next election. They just began to understand what all was going on there. And just having been there, I had a little different perspective on this, of course. But when she talks about being down so that all the different processes can take place with the system and working with the new role and everything, we had to be down essentially our clerks couldn't help customers for two to three weeks. So somebody had a property that they were selling. And the title company needed to come to the tax house for tax certificate. We couldn't produce it for two to three weeks. The sale of that property would be postponed for two to three weeks because we had to be down in order to get the new role in the system. And there was a cause of other things to be difficult for other people because we had to do this. So this is vast and purely known to be in down three hours. That's fantastic. Glad to hear it. Oh, okay. I just like to ask if, as those issues been resolved regarding the minimum qualifications? Thank you. No, they've not been resolved. Okay, so... If you vote in the affirmative, you can bring the issue back up. If you voted against it, you can't. So I didn't know if we wanted it. Would it be your record? I think it's the other way. Mr. Marchant, Commissioner Eves, any thoughts on this question? If you had another week, you would be able to do what? We would be able to revise the job description. The DA's office has notified us that several of their job descriptions have, I guess they would say, inflated requirements that they had not noticed at the appropriate time and they recently brought that to our attention and were going to send us more accurate requirements for their jobs, but we haven't received them yet. So there's more than this one position that's being worked on, is that correct? Yes. Okay, well, commission. So one more thing. Mr. Felt, I know this kind of puts you in a difficult spot, but regardless of what the commission's court does, I mean, we can't really tell, you know, regardless of whether they're qualified or not under our conditions. Mr. Johnson gets to point this fellow or this young lady, regardless of what we say pretty much, isn't that correct? Well, I think that the commissioners court has a say of how it applies its policy and I think that the district attorney's office has every intention of following the Ditton County human resources policies that have been adopted by this commissioners court and I think it is accurate that our office did ask for the side of to be pulled so that things can be worked out. But I will say, even though I wasn't asked this, but you know this particular position is a part-time position, but it is for protective orders for victims of family violence. And this position has been vacant for some period of time. And it does spread the prosecutors then to cover this responsibility while the position is vacant. So this is a position that is of utmost importance to the administration of justice in the district attorney's office, so it is quite important. So I think if you all would be willing to give it another week so that all the details could be worked out, I think that would be what Mr. Johnson would ask for. And I think that would be the, what Mr. Johnson would ask for. And I think that would be probably the best interest of the public safety. Okay, well with that. I made a motion for the, okay, but I'm just going to say just to clarify, correct me if I'm wrong Miss Phillips. But I guess Mr. Hernandez's concerns was that the person selected didn't meet the minimum qualifications? Was that correct? It was the concern. And we would, I guess if the department feels that they requested that we pull this, we're not aware of that. We would have preferred to delay it until we could revise the job descriptions. And so it sounds like there's been some miscommunication there. But I think it sounds like both departments would agree that it would be best to delay this for a week. I just wanted to know just as a matter of procedures. Generally, when they don't meet policy, don't you usually pull that from the consent or do we? We typically put it on consent and we notify you so that we can pull it. Mission's court can pull it or the department can tell us ahead of time that they would like us to. And one of us should have pulled it. And then we pull it. But if the department doesn't ask us to pull it we put it on for your consideration Okay, great and then is the solution to this going to be we're going to revise the minimum requirements for the job description Yes, that's my understanding or the requirements basically I think we would revise them to About the level I would think about the level that they were about the level, I would think about the level that they were prior to them being raised. And what we're proposing, the committee's proposing, is to move ag extension into the cariboulti in certain areas. And basically what they're asking for is the first floor which is the elections department. They're asking for the fifth floor elections training room, or IT's training room. Then they're asking for the six floor IT where their offices work for storage. The Constable is asking to move into the, I guess it's the CSCD Department on the second floor, which is suite 229. And then HR is asking to take over the space on the fifth floor which I believe. I had listed as 501 502 504 505 and 506, but that's actually 502 and 504. My plans didn't reflect some remodeling that we had done. And that was on me. That would be my next question. How much remodeling are you going to have to do to accommodate all those moves? When we met with them, it was discussed that there would be very little remodeling. That very little could be from $1,000 to $50,000. The only thing that was discussed that I'm aware of is in the elections, that big conference room, training room that elections has, they have a very, very small break room and we talked about putting up a temporary petition wall there so that they could enlarge that break room and I believe that's all that I'm aware of.
