Dan Lill if you would introduce yourself to meet this folks in the crowd that don't know who you are. Thanks ma'am. Good morning, county judge and members of the commission and school. My name is Dan Lillian. I'm privileged to be the executive director of the Children's Advocacy Center for Denton County. And thank you so much for your ongoing support of our agency and also congratulations to all the retirees and their families who are here. I'm here this morning with a couple of pieces of special recognition and I really had my heart to talk to the county commissioners who are about what these two men are standing behind me. First I want to talk a little bit about Cliff. You heard about his many years of service and law enforcement 41 years. And back that 14 years ago, we were blessed at the Children's Advocacy Center in Denton County was blessed to have a man with this heart and skill in passion for helping of used children come into our community. 30 of Cliff's 41 years of law enforcement have been dedicated to investigating, prosecuting crimes against children. There have been many people who have heard our kids in our communities whether it be San Antonio or Cliffwork before or whether it was here in Denton County. And here in Denton County Cliff worked alongside the prosecutors, did careful research and finding out more about these perpetrators. And you know at the advocacy center we have a wall of the people that have been held accountable for hurting children. People are often amazed when they come into our building for a tour because they're like, how did that person get so many years? Wow, which is great. You know, that's good that they were held accountable. One of the primary reasons that those people were held accountable to that extent is because of Cliff's sedital working behind the scenes. He never sought recognition from anybody. This is obviously a big step out for Cliff. And he's not here for recognition, but I've felt it in my heart to let the commissioners court and citizens of Denton County know that they were very blessed to have this man move to our community 14 years ago in helping hold offenders accountable for crimes against children. He's a past recipient of our team member of the Year Award of the Children's Advocacy Center. And we're just happy for Cliff and his family. And now he gets to be with his grandchildren and his family and this time is his. So we have this plaque of recognition for Cliff and it says, in honor of your retirement and service to the children of Denton County, Cliff Setataw 1998 to 2012 and thank you so much Cliff for all you did. I have one more presentation. I've lived in Denton County for more than half of my life. I start when I was 18 years old. And I remember in my first few years of living in Denton County after graduating from UNC, I briefly lived in Pond and I spent a lot of time helping children there and doing coaching and just around a lot of teens in that community. And I remember the kids used to say, I heard the Crow is coming to town and I didn't know what they were talking about. They explained, oh, there's this Toby Crow and he's an investor, the sheriff's office and someone says in trouble and he's going to have a come to Jesus talk with this person and people were fearful. These kids, you know, no, Toby's coming. Somebody's in trouble, but you know what? Toby has had many come to Jesus talks with many juveniles during his time and the impact that this man has made on this community is beyond what you would know. He has served in law enforcement for 34 years and 26 and a half years here in Denton County and there are adults today whose lives were really impacted by what Toby Crow did when he had to come to Jesus talk with those people when they were juvenile's getting in trouble. I've even run into some of these adults in the community whose lives have changed because of Toby. And most recently Toby, the impact I think is very fitting with the advocacy center, him having been a member of our multidisciplinary team. And about two months ago, we went to court on a trial here in Denton County. And there was a man who had left, I would just say, a trail of tears during his time in abusing children. This man, about roughly 60 years old now at this time, had abused children to horrible extents in Dallas County and got away with it. In Tarant County and got away with it. And this was one of Toby's last cases with these children. And he worked this case in conjunction with the Lewisville Police Department. They both had a case and that's the way Toby works with other people very well as a team. And this offender was held accountable for multiple life sentences. And we'll spend the rest of his time in prison. It will not be able to hurt any more kids. This was a career pedophile. But if it had not been in part to the diligent work of Toby Crow, that person would still be reeking havoc and terrorizing children. And that's just one example of the many cases that Toby Crow worked. And even more importantly than that is what I started off with. And that's the lives he impacted in a positive way. The children who have achieved justice and healing would also the children who've turned their lives around in one way or another because of the work of investigator Toby Crow. So I have this plaque to present to investigator Crow. It says in honor of your retirement in years of law enforcement, Toby Crow didn't count ESO dated December 18th today, 2012. I just thank Toby for all you've done. For children and for this county that will impact really generations to come. Thank you, Toby. Thank you very much for being here this morning and sharing all that down. It's important for people to understand that. And Clifford, I didn't mean to cut you off. There's something else that you wanted to say. You have three words. Thank you all. Thank you. We appreciate you. Okay. Now we'll get back on the schedule here. 3H. 3H is approval or resolution recognizing like a Clarice Retirement Commissioner Mitchell Mitchell I believe you have this one. It's been an honor and a privilege to serve the people of Denton County. And after 17 opponents, I finally made it. But I have my Wife here for him. And we'd like to make a presentation to you all to Denton County. I received the Lee Walker award of excellence and Mo Wife wants to say few words. Thank you very much for having us here today. We really appreciate it. It's been such an honor to have John as the Constable in Denton County. The he has gotten so many awards from the President of the United States has a point of light working with 350,000 children trying to keep them off of drugs. And it's been one thing after another. Lee Walker just loved him dearly. He had given him this award, the Lee Walker Award of Excellence, and it was presented to John in recognition of his distinguished service and devotion to the children of Denton County. And since we have a Lee Walker building, I would like to donate this plaque, which is really from my heart because I treasure this. It was the only one given to anyone. So Mary and all I would like to donate this plaque to be put up in the Lee Walker building. I think that's marvelous. That's a wonderful likeness, southern. Thank you. Thank you very much. Well, hang that right along with the awards that we have hanging in the building that talks about Lee Walker and what she's gone for Den County. And I'll be sure to place this one on the wall next to it. Thank you. Great. Thank you. Thank you. Thank you. OK. Okay. I believe of all of the retirees listed on the agenda today, I've covered everybody that's here. Is there any? That correct? I don't want to read somebody out. Okay. We're going to go on here in just a minute, but I wanted to speak to the kids over here a little bit. You know these people are retiring. Yes they're very dedicated to their profession. Yes they've enjoyed working for Denton County. Yes they've received a paycheck every day but it goes much further than that. You come to work every day and all these people, their family. Yeah, I'm sorry, I get choked up too. I've known a lot of these people for a real long time. Never special people. They truly believe in what they've been doing all these years, but they also love working with our co-workers. In some day you'll understand that better. Okay. Okay. Okay. Enough of that. I'm sorry. And we're going to go to item 3A, which is the Ag Extension Office presentation. If you go ahead, I'd appreciate your endurance hero. But we're going to do this. And then we're going to talk about break. We've kept so many people waiting for so long. Go right ahead. Thank you, Judge Horn. It's really a pleasure for us to be here. Our staff is here. And we want to thank you for your take this opportunity to thank all of you for your support of our office and thought we have been able to accomplish this year. We're going to be very brief with our comments this this year. Yeah, and we appreciate that was pretty interrupting that we did contact them. We my gosh We've got 18 retirees and we're not sure how many are gonna be in court on Tuesday So since they had not too long ago done a presentation in commissioners court We asked them to limit their comments today And it's a pleasure for us to see them retire because we know we'll be there one day Yeah, so we'd like to begin our presentation with our four lectures with their presentation points to our commissioners court. So if you're all right to. Hey, this is my favorite part. And we're donated by Tom Roney, one of our local growers. Thank you very much. And this is our thank you to you for all your support. I love it. Thank you. Thank you. Thank you. Thank you. Merry Christmas. Thank you. You have a bless you. Merry Christmas. Thank you very much. We also want to give you our appreciation for our support staff that helps us look good. And so back at the office is Donna Woolf, Mary Campbell, Pamela Hill and Cassie Morgan for their support. Since we were here last year, we've had a couple of changes. We've had two of our faculty retire Eddie Bags and Erlene Johnson who provided almost 40 years of service and we've gained two employees, Lee Stanley and Cassie Morgan, Lee's our ag agent, Cassie's our fortune minister of assistant. And we've had a name change for now the Texas A&M AgriLife Extension Service, another name change. Just briefly in the pen and consumer science area I emphasized last year diabetes education. It's a new area for me because our other FCS agent used to take that on and we have found that as you know diabetes is a chronic disease and people who take our eight-hour classes we've researched. They save about 50 thousand dollars in medical fees so this one program saved us about a one million three hundred thousand dollars in medical fees if they continue their lifestyle changes Myla on them Charles our BLT agent was down here today But she has had a very successful program working with nutrition and low income families here in the county And I'm going to turn them podium over to my co-worker least Stanley Morning I'm going to turn them podium over to my co-worker, Lisa Danley. Morning. Morning. Thanks, Maggie. Thanks, Commissioner and Judge. It's been a whirlwind since I've been here since June. We started as 4-H agent going to the ag position and we're doing both those as we go. Our 4-H program numbers are expanding. Our club is expanding. I think that's a trend as we move forward. We'll continue to do that. Ag Program-wise, great volunteers, great folks that are... Excuse me. You want to take some pictures? Come on up here. It's okay. Save this for... You know, you don't want the back of his head. I'll be in the front of the Commissioner Ead, so you can get a good picture. Okay, I'm starting to interrupt you. problem. In our ag program, the great volunteers were starting there. We're continuing to work with small landowners and deal with a lot of clientele questions of how they can maintain the agricultural part and production in this county. So with that, Janet. Okay. Good morning. We also gave you a book that has got a lot information more specifics about all our programs and it's my privilege to talk about the volunteers. We have a lot of them here with us today and when I kind of call out your group if you'd stand we have the Leadership Advisory Board. We have the Elmport chapter of the Texas Master Naturalist Board, County Master Gardener Association Board. Are they not standing? Yeah. We have four H's, four H parent leaders, four H club managers, we have family consumer science committees and agriculture committees. Is that everybody? That's everybody. As you know, we could not do all that we do, they're able to get out in the community and really extend our outreach. And we like to tally up the number of hours that they've contributed every year. And thus far, we've got a total of 51,000 hours. And we have a nice big check for you, Judge Horn, if you come down and Linda Williams will present that. Once again, it's gone up. And it's over a million dollars again this year. Thank you very much. Oh, no. I heard that not all the reports are in place. Yes. That's true. There will be more. There will be more. Yes. That's true because we have a lot going on in December and sometimes our volunteers don't report quickly, which is fine. So we give them more time to turn in their hours. And just in conclusion, we really appreciate your support. We're looking forward to our new facility in the Carroll Building and we thank you for taking good care of us in that regard and all regards. So thank you. Thank you very much. Thank you very much. We appreciate it. Do we need about a five minute break? Let's do that and seriously five minutes. We're in recess. Commissioners Court is reconvened. We're going to go now to item 4a on the agenda, which is actually it's a public hearing approval, the abandonment of a portion of Prairie Mound Cemetery Road at its intersection with FM 407 to the Prairie Mound Cemetery located in Denkundik, Khmisscher, Prussing 4, and described in attached exhibit C1, exhibit C2, exhibit D and exhibit E. And designation of the alternate route of access has depicted in the attachment exhibit B. I move we go into the public hearing. Thank you. We have a motion for public hearing by Commissioner Ead. Second I like Commissioner Mitchell. All in favor, please say aye. Aye. Opposed to the seat. Motion to carry. Commissioner Ead, would you like to start? Yes, ma'am. Thank you. I would like to visit about a project that many of y'all recall back in 2007. We voted on a project called Belmont, which is roughly in the northwest corner of how we 407 and 35W. It's in the Argyle ISD in the Northwest ISD, I believe. And we're very excited about this new project. Realty capital initially took the lead on that and continued to be very active in the project. And they have partnered with Hillwood, development. We're very excited about that venture and that partnership. We have Tim with us today and they have renamed and reb rebranding the project from Belmont to be called harvest and I'll tell you we met with the developers that's on the property. And I'm pleased to say that they've been very responsive to our request to try to save the structure. And they've incorporated it as a real cornerstone to their development. It's going to be an amenity center. We were out there and I want to thank them for their community spirit. They welcomed our didn't county historic commission members to come onto the property a couple of months ago before they moved it And we got to see the farm house that's about 130 years old and we got to see it in its original setting And we're so pleased that there being a real good steward of that historic structure and have relocated it We're out there a few weeks ago and Ross Pro Senior was behind the wheel of We were out there a few weeks ago and Ross Pro Senior was behind the wheel of the truck as they serimoniously moved it from one edge of the property to the other as we did a ground breaking. So we're very pleased about the new project. As part of that project, we do have a road prairie mount, cemetery road, and it's a country lane. And we are seeking approval of the court today to abandon that roadway. And because they're going to be realigning that roadway with the new boulevard. There's the pray mount, cemetery is there. Most of the land around there is raw vacant farm land, but there is a cemetery. We do want to be respectful of the cemetery number one and the visitors and family members of those who are buried there. And we have worked with the cemetery number one and the visitors and family members of those who are buried there. And we have worked with the Cemetery Association. My office has a posted meetings along with the developers so that we can ensure that there is a continual access to the property, for the cemetery association as burials we take in place through the construction. So at a sum of introduce Tim, he's going to give an overview of the project and then we'll hear from many members. My apologies to, I need to apologize to Bennett how did email me and ask for this to come up a little earlier and I was looking for Bennett. So, and he actually had to be in another courtroom this morning. So my apologies on making you wait, sir. Well, no problem at all. Thank you very much for having us here. My name's Tim Coltott. I'm with Realty Capital. I'm here on behalf of Realty Capital and Hillwood Communities. I've got a brief little presentation to update you on the progress we've been making on our project. But first of all, I'd like to, as Commissioner Eads mentioned, thank the commissioners for the hard work that was done back in 2007 for it seems that there's still only dirt there. We have, that has been one of the pinnacle finance and tools that allowed us to bring the sewer line to flower mound, agar, north lake and to our project. So without that haven't been done five years ago we wouldn't be in the place now we were actually turning dirt and looking to grow the southern part of Den. With that said, formerly Belmont we have spent a lot of time since 2007 on utilities and everything else. Late last year we partnered with Hillwood Communities who is taking the lead on the development of this community and that has been a real asset to us and working with them. They have an incredibly large team, a lot of experience in our supply and communities and so we are working together to bring additional funding and growth to the community. Part of that partnership involved us looking back at what our vision for the community was. And we really looked at the old house, we looked at where the community sits in terms of on the prairie there, if you're driving up 35W on the east side of 35W is post oak timbers and beautiful land on the west side is a little more agrarian. And so we went back through the entire site. We had teams of people sitting around tables for what seemed like countless hours and came up with a new vision that centered more around what was existing there at the time and we really managed to title back to the existing farmhouse as commissionaries it alluded to. And that led to more of a harvest brand, which really focuses more around a community that is really based on legacy, education back to the people who live there on where food comes from, more community spirit, and I think you'll see a little more of that detail here. Who would have spent the last five years creating these principles which they really try to bring to every community? And this was really the founding points of the plan, which you'll see in just a minute. And they have these five principles, one is environmental stewardship, education and enrichment, technology, obviously an important part in these days, healthy living and sense of community. I'll go through these very briefly. Environmental stewardship, We've tried to incorporate that in this community through a number of different things. We have drought-tolerant landscaping, which will be required by every home builder as well as in the amenity package and public parks. We have solar array through a partnership with COSERF. We're going to be feeding some energy back into the grid. All the way down to every home builder we'll have to comply with standards called environments for living, which ensure that the electric bills and gas bills and the house is a very efficient house. Healthy living, you'll see on the Master Plan which has changed somewhat. We have a community farm that will be in the project. It's going to be run by a gentleman who serves the Gayle of Texan and a number of high in restaurants in Dallas and Fort Worth. We also have recreational play areas and you'll see there's a big linear park that spans the length of the development. Sense of community, we think this is incredibly important and typically in a mass playing community, you wait until you have enough residents there that get on board and start creating events that happen in the community. We've tried to do that the other way around. And we will have active social programming in the lives from day one, where we actually involve the community farm with the school district and with the residents to try to create a sense of community. And I think that the harvest brand really falls very well with that. You can think of things like the harvest parade, harvest is such good connotations. Education and Richmond, as Commissioner Ed's mentioned, we are primarily in Agaral ISD. We do have some Northwest ISD, both are fantastic school districts and we actually have two school sites that are already planned for the community, an elementary school and a middle school. And we plan to use the farm as a part of that school district and really try to make the most of what we're putting out there. Technology, a fibre to the home, is recently standard these days. What we are doing differently is we have a partnership with Verizon and that will allow for every home to have home monitoring where you can essentially turn your AC on off, unlock doors, et cetera, et cetera with your cell phone as if they don't do enough these days. Here is an outline of our master plan and you'll see down the sander of the project, that's a big long linear park that essentially stretches from 4 or 7 which is on the bottom of the page and that is 35 on the right-hand side of the page. So we have a unique visibility from Highway 35. You'll see the large lake feature on the southern end, and you'll see I've got a bunch of pictures here, I think pictures always speak louder than words, and if you'll focus on that southern lake and on the north end, is where the amenity center and where the Fort Family Farmhouse is going to be located. This is a picture here, rendering, showing how we anticipate the entry from 407. To appear, you can see we've moved away how we anticipate the entry from 407 to appear. You can see we've moved away from big large tall entry monuments that are made of masonry and in fact this will be an open barn. And we've actually taken all of the old barns that were on the project that were in decent shape. We actually took them apart by hand and I've kept much of the materials and we'll look to recycle those throughout the community. Here's a look from the south looking through what will be the southern end of that linear park that stretches the project and you can see there's a large open green there that's between two amenity buildings that'll be the focus point of the of the project if you look in the background you can see there's an old house there that is the existing family fought fought family farmhouse try to say that five times in a row first and that has actually already been moved to that exact location. In fact, Tom Fortness here today. You also see the two pools. And the two pools and the amenity center that is on the right in the center of the project, they will be built with the first phase. And then as they're looking off in the back of that picture, you'll see the central park that runs the length of the community. This is looking across the event lawn, and we see this has been a central part for the community. And here is the house here sitting on the corner directly behind the houses where the farm will be. And the farm's not gonna be, there's gonna be two green houses, which are really where they operate most of the commercial operation. And then there'll be some plots there as well for the community to use. And they will be helped in that by our resident farmer. And there's a picture of the house right now. Well, that's actually where it was located. That's where we had the first viewing. And it's a gorgeous old house since 1882. It's incredible the number of people in Denton County who have ties to this house. I don't know how many people have lived in it at some time or another, but every event someone's gonna start to tell about it. And we actually used the old farmhouse as there's a carving on the door. And when we came out with the name harvest already and we were out looking for how to brand it, and there's a flower, and I'll show it to you at the end here again. But that's actually the branding for the entire community. So it's kind of nice to see that come out along with the timber from a lot of the old barns and materials. And for a project that didn't have a whole lot of authenticity, I think we've gone at every single piece we possibly could. So onto Paramount Cemetery Road, which we've garnered every single piece we possibly could. So onto Paramount Semitur road, which stretches between FM407, goes north and it zigzags with 90 degree turns between FM407 and old Justin road. And I've tried to highlight it here on, as it goes across our master plan. You'll see that it's obviously not very conducive to planning around. And we've actually already taken the steps to work with North Lake and Agile and we've actually amended their ETJ lines to match. If you can see the road behind it there, it might be easier to see there. That's going to be easier to see there. That's going to be called Harvestway. And that road that stretches down the middle and I guess has more gentle curves to the east. That is now the ETJ line between North Lake and Igar. And so we've gone through that effort. That obviously makes policing and everything else much more simple. And the next step is to start as we build our first phase, which is under construction, you can see that existing Paramount Cemetery Road goes directly through the middle of what will be an amenity lake on the southern end. The plan is to abandon Paramount-Semitary Road on two phases. The first phase will be what's highlighted in green, and that goes to the northern boundary of existing Prima-Semitary Road. Prima-Semitary Road actually goes right the way through the middle of the cemetery. We have met with representatives of the cemetery, and I'm sure you'll be hearing from them as well. And we've ensured them that we will make every effort to have consistent access from 407 to the southern entrance of Prairie Man's cemetery road. And I've got that highlighted here on the next slide. But of course, access will always be open from the north as well because that road will stay as it is for the time being. This exhibit I hope it's not too small here but if you're looking this is the very southern portion of our project and if you can see the lake there remember that from our master plan. The yellow line is the green line that then turns to yellow. That's existing per amount of cemetery road The thought is is that upon the abandonment of the road We will then go through and we own properly on both sides and we will look to grade the green line that goes around the outside of the the amenity like there. And so that will go outside onto private property and then come back onto the existing prayer mount cemetery road. We will then use the material, the asphalt material from the yellow piece to create a temporary surface so that access will be available from from 407. That would happen start of January and we're all prepared to do that and that would essentially add less than a quarter mile of travel to go north it'll be the same exit off of 407. And Commissioner Reeds and his team has obviously offered to help with signage, et cetera. The second phase of construction coming in May, once we've had our streets poured with concrete, we will then look to have a more medium term access, which would be that blue line, which is going across part of our first phase of construction, will be Cleveland Gibbs Road, which is on the west side of this exhibit in blue. And you then come up on a brand new concrete paved road, come north and then head across, right across through the amenity centre, past the Fort Family Farmhouse, and then join on to the existing Prima and Semitur road as outlined on this document. With future phases, we'll be when Harvest Way, which is the north south road gets built. As I'm sure the County Commission has known all too well, these roads are incredibly expansive. The first phase of construction of a project like this is the most expansive. Three years ago we invested $18 million of cash to bring the sewer line there. We have met with the cemetery folks and some of the other landowners as we go north, as pretty much cemetery travels further north. And we've tried to work with them and make sure that we have lines of communication open to ensure that they have consistent access. And especially when there's some certain days of the year when it's most important, they would like to make sure that everything's cleaned up. We don't have diggers and the likes around, right around the cemetery. And so we have, I believe, we have support of our neighbours. We really want to be a good neighbour. And I'm not sure if anybody else has any further questions but I will just show you here the logo on top of Harvest is from the front door of the community. So with that said I know that's a lot of information so please feel free to ask any questions. Thank you. Are there questions from members of the court? I had a couple. What's the proposed tax rate for the district? The proposed tax rate will be $1. Have you already been assessed? I believe that we've already had the election to assess that. The maximum rate is $1.20 per the state. City of Fort Worth is 86 cents. And we have certainly done market studies on what our full boat, I guess, of taxes would be. And we believe that we will be well within the market. Mr. Felt, I had a question for you. If somebody was to abstain with this item pass. That's a good question. Says unanimous vote is required. So I think that means that unanimous vote of those present is required. So let me ask you this too on the petition. What's the requirements for the signatories on the petition? Do they need to just be residents of Dinn County? They can be anyone in the United States? Is that really unclear? There must be eight property owners within that commissioner precinct. They don't have to actually be residents of the precinct, but they're supposed to be property owners of that precinct. Now, in the past, in years past, in some years past, there had been some requirement, just I think through policy and the engineering department on some of the freshwater supply districts on 380, it was plomacreek specifically where the but as the developer has made clear, they're certainly going to do that. I think that the legal requirements have been met, it's really within the sound discretion of the commission's court, whether or not you want to go forward with the abandonment just like any other abandonment, but just from the work, you know, our review, we are satisfied that the legal requirements have been met for you all to deliver it and make a decision today. It's your legal opinion. It's the, it's got to be a unanimous vote of the commissioners present. It's the, it's got to be a unanimous vote of the commissioners present. Well, I can tell you as the, the loss as a unanimous vote is required to close abandoned or vacated public road. So I take that to mean all members present would have to unanimously vote to approve it. Well, you know, I am, as a matter of principle, against additional taxing entities in Denton County. I know there are some of these special districts that are in the office, so I... We're only doing the road to the Viner's vote today. You know what, this has already been established. It's already been created. I understand. I understand, so I think what I'm gonna do is I'll take my leave for a second. And if you all want to take and consider this matter, that's fine with me. OK. Are there any other questions from this gentleman? Motion to close public hearing. But I would. Second. OK. We have a motion to say to close public hearing. Pretty. Excuse me, just second. Would you please rescind your motion, the second exiling to the public an opportunity? That's fine, I'm sorry. Okay, they've rescinded the motion in the second. Does anybody with the public here that would like to address commissioners court on this issue, either in favor of or opposed to the proposed abandonment of the road? Anybody else in attendance that would like to speak to the commission's court on this issue. Thank you. For the record if you would state your name. My name is Billy Fuller. I'm Secretary of Treasury, a per-mountain cemetery association and Tom Fault is our president and we also have three members of our association. Thank you for the opportunity to- If you'll stand in front of the microphone. We can move over there. We're going to pick up your voice a little better. I have just a brief member in them that I've addressed to Commissioner Eage. On behalf of the Prairie Mounds Cemetery Association, we do support proposed abandonment of Prairie Mounds Cemetery Road and that's based on Hillwood and Realtty Capital, sorry, I neglected to list Realtty Capital's commitment to make harvest development seamless for the Cemetery's access and operation during all phases of construction and operation. That commitment was provided to us during a December 10 meeting that included representatives of Hillwood, Denton County and the cemetery where the abandonment and other issues were discussed. My notes from from that meeting are in this packet and I will leave that and they they highlight that commitment. Those these minutes and notes have been reviewed by the cemetery board. They've also been provided to Hillwood, and I asked for any adjustments to those by end of day, yesterday, and received none. And Mr. Coltart said this morning that they were in agreement with them. I believe these notes fairly represent the discussion and a partnership between Hillwood, Denton County, and the Cemetery. And I'm confident in Hillwood's plan and commitment to deliver seamless access to the cemetery and to proactive communication in the event that there's any issues that come up in the future. Thank you very much, William, but did you wish to address the courts, sir? In further records? Yes, ma'am. Stay tuned. I'm Tom Fawt. I'm president of the Board of Directors In further records, please. Yes, ma'am. I'm Tom Fawt. I'm president of the Board of Directors, very much. I'm a cemetery association. I just like to reiterate all that Billy has stated that we have met. We have agreed with this. We certainly appreciate all the considerations you have given us. Commissioner Ead, especially, has been very great to keep us informed. We have met with Tim and his group. They have been very good to us and keeping us informed on what's going on with it. We think they're good neighbors. We think the project will be good for our area also. We're going from a little country cemetery to a cemetery in close by city, but we feel we can still keep our personalities there without changing just because we're surrounded. They've been great and we appreciate that. As a thought family member, I'm very proud that they kept the old house. It's a beautiful house. They spent a lot of time in there. It's a great asset to our county, to the state of Texas, and to all of us. And I appreciate your time today. Hope we can get to settle whatever our legal reasons are, but we firmly supported. Thank you, and we appreciate your being here and waiting all this time to speak. We appreciate it. Okay, is there anyone else in attendance that would like to address commissioners card on this issue? Either in favor of or opposed to the proposed amendment? Motion to close public hearing. Thank you. We have a motion to close with a public hearing by Commissioner Marchand, seconded by Commissioner Eads. I'm in favor, please say aye. Aye. Aye. Opposed, Cine? Motion does carry. Is there anything else that you'd like to add, Commissioner Eads? No, I don't have a question. Let me turn this mic on. I just want to again thank the Association for being here and I will move for approval. Thank you. We have a motion for approval by Commissioner Ead seconded by Commissioner Marchand other further questions or comments. Hearing none all in favor please say aye. Aye. Aye. Opposed Cine? Motion does carry four in favor and one is absent. Not abstention. Absent. Thank you. Everybody for being here we appreciate it. Okay. We're all the way up to agenda item number two. But before we take all that on, a couple things. One, to be there are no inter-departmental transfers to be considered. So there'll be no action on to be today. And on to a for the order makers gonna pull to a nine but let the rest of them go forward for approval. Okay the rest of the consent agenda thank you we have a motion by Commissioner Mitchell for approval of the remainder of the consent agenda. Thank you. We have a motion by Commissioner Mitchell for approval of the remainder of the consent agenda. Is there a second? Second. Seconded by Commissioner Marchin. All in favor, please say aye. Aye. Opposed? Cine? Motion does carry. Consent agenda today consists of 2A, which is approval of order making appointments that is a new hire and 16th district court to promotions within the criminal district attorney's office to rehear and the tax office. Three reheirs in the county jail, promotion within the sheriff's department, 2A9 has been pulled. We have a rehear and council bill precinct 6 and a rehire in road and bridge west. To see is approval of payroll. To D is approval of award of bid for Stewart Road Project, bid number 10122171 to quality excavation limited for $634,486 and $13. To E is approval of renewal of workers compensation insurance with Texas Association of Counties. And 2F is approval of budget amendment quest 100330 for computer equipment for countywide technology in the amount of $11,840. Commissioner Ease is back. Okay. Thank you. I want to go to a nine, which is one of the order makers. And we have our sheriff elect here with us this morning. And also we've received some email communication from our director of human resources on this issue. Let's first go to our director of human resources. Good morning, Judge and members of the court. I am recommending hiring this employee as assistant chief deputy at 16% above minimum, which is 85,276 dollars annually, which is in compliance with your salary policy. Thank you. Thank you. Thank you for waiting, gentlemen. We appreciate your patience. Not at all, Judge. Thank you so much for letting me talk to you, commissioners. My name is Will Travis. I'm the 2013 Sheriff Electum. Looking forward to serving each and every one of you in our public. Let me introduce to you real quick. The my choices that I've picked is gonna be Chief Deputy Rex George, who's coming over from the District Attorney's Office, the Chief Investigator. This young man to your right, my left, is Randy Plymmins, and he's gonna be our Chief Deputy over operations. With your approval, of course. Anyway, he comes from my incredible background and law enforcement. I recruited him from McLean County, because he is no doubt the best. And let me give you a few of those reasons why he's the best. He's got an impeccable service career and has served his sheriff in McClendon County very well for the last 25 years. In the last 13 years, he has been the cheap deputy there doing an outstanding job. The position that's slotted is slotted at $94,000. And that's what I'm requesting because we are definitely getting a bang for our buck with this gentleman. He is a tremendous guy. He is going to service well here in Denton County. He is a graduate of the Secret Service Academy, which you know other sheriff in the state of Texas has ever done. The reason for that, he deals with the Bush family down at Crawford Ranch. So he's very familiar with all that. So that gives, he's also a graduate of the National Academy. He holds a Master T-Close license, so we won't be having to fool with that and worrying about a raise and how to get that after he gets that. He's already a Master holder of that license. He's also an instructor with T-Close. He also holds a FEMA certificate for emergency management which is going to make him work very well with our with Jody and they are already talking and working on some things to get going in the future. So I just hope that you all see me out on this and hope you all will grant the $94,000 and thank you so much. It appears we don't have anybody left in the Sheriff's Department but I know we got two after today. So thank you guys for working with you. Thank you gentlemen. Other members of the card that have questions or wish to make comments? I just have a question. Amy and your correspondence does. You said that he was asking to approve a 92,000? That's the paperwork that we received requested 92,000. It's that a- I just saw that in the budget it was budgeted in 94. That was the only difference. I don't understand. I think she, well she and I had talked earlier and I didn't I didn't know exactly what the what the the pay amount was in the budget and I found out you know through looking at it that it's budgeted you know I'm not asking for an increase in anything. Whatever it's already budgeted and then the Sheriff's Department budget for $94,000 and that's all I was asking for him. That's all I was asking for. I can see here Donna. What do you show? Are you looking? She's looking right now. Let's make sure we know what we're talking about. I'm sorry. Slow to talk to you today. Do you have other members of the court that wish to make comment while she's looking that out? I don't make some comments. That is usual. Well, I think the precedent has already been set with court and agreeing to allow this to happen. But as usual, I am not in favor of it because of the policy. I do try to stay within the guideline or within the policy in which I know we all try to do. So I'm not gonna be in favor of it. I certainly am looking forward to working with Mr. Plimmins. I'm certainly, I'm looking forward, I met him yesterday and I'm looking forward to working with you, but I'm not gonna be in favor of this. I have not been in favor in the past of going outside policy and I'm Have not been inclined to do so today There's any other members of court that would like to say anything while she's looking that up You finding it down. Okay. Miss Donna was that as chief Max Susuz as the chief deputy or the assistant chief deputy. Okay. Because he had gotten a raise right to be the chief deputy or a temporary bump or something like that. That's why I think I had some confusion. Yeah, I was just kidding. I was just kidding. I was just kidding. I was just kidding. I was just kidding. I was just kidding. I was just kidding. I was just kidding. I was just kidding. I was just kidding. I was just kidding. I was just kidding. I was just kidding. I was just kidding. I can't hear you. What was Steve making before Lee left? That's just for information purposes. That's what Steve was making. And that was before Chief Hal left or before blaze or before blaze left. Sorry. It was. It was. I think I did it on blaze. You went up quite a bit on blaze when he came in. I think the number that Donna came in. Okay, wait a minute. Yeah. Amy, go ahead. I think the lower number that Donna quoted was probably the amount before the raise on October 1 of 2.5% that would have increased it. The number that I referred to 92,000 was just the paperwork that was sent to us from the Sheriff's Office. That was a salary that was on the paperwork that we received. Acting Chief Deputy. Yes, he did. Yes, he does. That would probably be the amount budgeted and previous amount. That's before the 2%. Right? probably the amount budgeted and previous amount. That's before the 2%. Well, that, but because I think cheap max is the acting cheap debt. So I don't know if that's like comparing apples to apples. We want to give her some time to research this and, gentlemen, you have a seat. And let's go on to some other things over there looking that out. And we've got some more resolutions even though the people aren't here. I want to go ahead and read them into the record. Let's see here. I'm in favor of the motion in the second. Please say aye. Aye. Opposed, any motion? This carry. You know, I don't think I ever asked for a public input on item one. If there's any member of the public that would like to address the Mr. Corden and item not posted on the agenda, please complete a public comment form. I also didn't tell everybody. Turn off their cell phones and pages, did I so I granted chair of parking a little latitude There because I did hear a cell phone go off but since I hadn't forewarned them I decided you know and it's Probably did that on purpose. He probably did just because he knows he's leaving Donna. How are you doing? You ready? I Don't think your microphones working. Okay, is that better? Yes, much. Okay. The position was last year budgeted at $91,930. And this year's budget is $94,228. When the person was promoted on a temporary basis to the chief deputy slot. The salary went from 91,930 to 101, 123. I am supportive of 91,930. Just like when chief blaze took over for chief how. I always think it's a good idea for those upper level positions that they be paid the same salaries, the people before them. I think that's very inequitable. That's what I'm supportive of. I second that. 91 930. That's what Steve was making, right? That's what he was making in fiscal year 12. But what is the request, Donna? The request? But what is the request Donna? Well, 94,228 is the budgeted amount. And I believe that's what the sheriff elect was asking for. 94,228 is what the sheriff elect was asking for. The motion is at 91,930. And Commissioner Coleman, that was theistent with what we did last time. Yes, and I think that was the The vacant level spots. I think that's fair Just I bet the sheriff will take that 91 Okay, are there further questions or comments or any other information needed? Fisheries. I'm willing to take your input But I think that's kind of how we did it in the past. And I think that's the... Yeah. Well, and I'm certainly willing to grant the incoming sheriff elect some latitude just like we have other newly elected officials. I want to echo Commissioner Mitchell's comments at that that I'm doing this for a consistency, say, but not totally in favor of the practice. It wasn't if, you know, that was not the way we operated when Commissioner Marche and I brought in our staff who had years of outside experience to the county in government offices and they weren't. We didn't request that or was not afforded to us. And so it's just kind of a message for future office holders. I'm doing it for consistency sake with what we directly did in recent history with the Sheriff's Office for the same position. But moving forward, I mean, I did not do it with my chief administrator. I said he was well qualified 20 years into business and so did Commissioner Marchet. So just saying. Those are excellent points. And if you remember how you all said I'm kind of cursed with a long memory. But remember, I think Constable Boyzden came with us with a Kind of similar deal and I was supportive of paying I don't know I'm trying to be consistent. I don't have that works, but it's tough Are there any other questions or comments? Anybody here in none we have a motion for Anybody here in none we have a motion for 91930 for consistency reasons. I said we have a motion in On seconded it on seconded the motion hearing no further comments all in favor of the motion. Please say aye I oppose see me Motion carries for in favor when opposed favorite one opposed. All right let's move on to item number five which is approval of the bill report payments from CSCD Community Corrections TIP, Shares, Trinny Shares, Forfeiture, VIP, Interest, DHA, Check Feed Day, Forfeiture Funds are all presented for reporting purposes only. Good morning, now. Good morning, Judge. Good morning, commissioners. I have two additions to the bill report this week. One from Road and Bridge, one from the Sheriff's Office for Fitcher Funds. They're both to expedite payment. That's all the corrections I have. We have any questions that do we have a motion? So moved. Motion by Commissioner Marchant. Second. Second by Commissioner Mitchell. All in favor, please say aye. Aye. Aye. Opposed, Cine. Motion to carry. 6A is approval of the evaluation committee recommendation to pre-qualified Tignot Perkins and Lamb Star Engineering is the most qualified firms for surveying services for both engineering construction and right away RFQ09122 and 66. We're calling Beth Fleming. Good morning. We did receive 10 responses to this RFQ and the evaluation committee, Nerald, the list and interviewed for those firms. The top two firms were top both on the right away and the engineering and construction. So we're recommending they be pre-qualified. Got a good idea that we get to. I think that'll help us with some of our projects coming up. Thank you for doing that. I'll move for approval. Thank you. We have a motion by Commissioner Coleman, seconded by Commissioner Marchandr. Further comments or questions? You're now in favor, please say aye. Aye. Opposed to name. Motion is carried. 6B is approval award of RFP 08122161 Defenders, specimen collection and drug testing to a layer, a layer, toxicology services incorporated and again we'll call them Bethling. This is a different type of service than we've had before. We changed the requirements quite a bit and a layer did give us the best proposal, Peggy Carr, Director of CSCD has has approved it more recommending approval. We have questions and members recorded. Do we have a motion? Motion by Commissioner Mitchell. Seconded by Commissioner Eads. Did you have a question, Commissioner Coman? I'd like to go back to 6A. Just briefly. I'll in favor of the motion. On 6B, please say aye. Aye. Opposed, Cene. Motion is carried motion on 6B, please say aye. Aye. Opposed to the name? Motion is carried. On 6A, you had a question. I just want to move in forward on some of these. And I think you had a great process, Beth. We've talked about this. I believe that in the future, as I'd like to have a discussion with the court, some future day with Beth about our selection firms and those who are on those committees that we are ensuring that the end users are represented on those those those on the committee so I'll be bringing forward something with after visiting with death. Are you thinking you'd want to have like maybe Manian Robin on the committee? I think the end users should be more involved in this than perhaps the legal department helping to select. I think they could be guardian of the process. I think the end users who actually interface with the performance of the vendor services could probably be more appropriate. Like us? appropriate. Like us? I'm thinking like because I know many when because he's the guy who gets a ride away for us, I think he might might be a good idea is robbing the person who usually negotiates the ride away for probably so yes. I don't have a problem with them being. I don't want to I don't think it's appropriate for the staff to actually deal with the deal with the vendors are probably best to judge their performance and bill of dip pull off the services for the county. I think that'd be problematic. No, I don't. And I've talked to Commissioner Eats about it before and have some policy changes if y'all are interested in looking at them. I think that some revisions would be good. That policy was written many, many years ago. Let's do it. Okay. Moving right along. Seven A's approval of budget may request 1-0, 0, 3-2-0 to transfer funds from non-departmental personnel contingency for contract labor for budget office. Excuse me, in the amount of $13,000, $15,90. But for approval. Motion by Commissioner Marchant. May I move to approve? Motion by Commissioner Marchant. Chair will second the motion. All in favor, please say aye. Aye. Opposed, aye. Motion carries. 8 a.d. is approval of a rejection of incentive discount on the workers compensation premium that is contingent upon the exclusive utilization of the Texas political subdivision workers compensation alliance, the alliance, and authorized Gustavo Hernandez Poole coordinator to assign the alliance election form. We have a motion by Commissioner Marchand. Seconded by Commissioner Coleman, other questions? Here none. All in favor, please say aye. Aye. Posting. Motion is carried. A.B. is approval to amend and kind of aile benefits plan elective January 1, 2013. You have a question? Go ahead. Only the new policy that says the 2013 grace period is removed. Any funds remaining in the health care spending account cannot be used to reimburse claims and carried from January 1, 2014 to March 15, 2014. We used to be able to carry that over. So now you're saying we can't carry it over, right? That's correct. That's something that was discussed I think when Ms. Kahnvick was here doing her presentation earlier this year and it was communicated to all employees during the enrollment period.
