And lastly to G is approval of building used requests from Kenny Bowman to use the courthouse on the square lawn on May 25, 2013, in September 7, 2013 from 530 to 830 for the purpose of a concert and art show on each day. Two F is approval of budget map request 1, 0, quest 100890 for vehicle equipment for cost for precinct four in the amount of 8,344 dollars. We receive some communications from, well, both domestic and in this budget amendment. Donna Stewart's memo said she was going to give us some information concerning the budget amendment because she was not going to be here today. She thought that some statements on the budget amendment documentation were not quite correct. And she sent him the following email below that she attached the agenda packet. His request will give him $2,272 more than was recommended for the vehicle by the vehicle assessment committee in almost $2,912 more than what was recommended for the vehicle by the vehicle assessment committee in almost $2,912 more than what was recommended for the sheriff's SUVs. Constable Birch sent the email saying I received the budget of my request to transfer funds from various line items including transferring excess funds and cars and small trucks to the vehicle equipment, the background section states that there's not enough money to outfit the vehicle when it came in. This email was sent to Donna Stewart by Constable Birch. You further state the budget of a surge that it would be equipped as previous tojos that had been ordered for your office. I'm sorry, it's from Donna Stewart to Tim Birch. Here's my recollection of what happened last year. You appeal of a funding for your vehicle, which was recommended by the vehicle assessment committee, and was equipped $34,000. You stated in court that you only wanted to receive the same equipment that was on the sheriff's tawholes. You also said that you weren't asking for something that would stand out above and beyond what everyone else received. I explained that the workshop, during the workshop that the sheriff's vehicles were budgeted at 33,360 plus 5,793 for a video camera and tough box which you weren't asking for. Therefore, $34,000 budgeted for your vehicle was actually slightly more than what we gave the sheriff's at 33,360 for a similar vehicle last year. And again this year when your department submitted requisitions for new vehicles, you did not requisition them the way that they were recommended by the vehicle assessment committee and or budgeted by our department as fully equipped vehicles. You have ended up having to process budget amendments in order to order the equipment separately. Unfortunately, when you order a vehicle and equipment separately, it would be more expensive. And then Beth Fleming's email just yesterday said that the prepared and analysis for the equipment requested in the budget amendment for Constable 4 compared to the adopted budget during budget discussions. Constable 4 indicated it was acceptable to budget 34,000 for a patrol SUV with the same dealer installed equipment as budgeted for the sheriff's office. Subsequently, the vehicle was requisitioned without the dealer installed emergency equipment and the budget amendment is now being requested. The attached analysis is an attempt to compare the budget quote for the sheriff's office to what was now being requested with the items compared side by side is very difficult to match all items. Therefore each side by side analysis has light equipment that may be similar in function but are listed separately. As you are aware, once budgets are adopted each department has the flexibility to buy the make model the best suits or needs with the type assigned to the capital item, SUV, van, pickup, etc. For law enforcement, each elected official has flexibility to order emergency equipment that best meets the requirements within this established budget. There is no established uniformity between departments or not necessarily between types of units within the department based function requirements. and function requirements. Constable Birch is here. I guess when I'm trying to get to is, can we in the future not only budget these altogether, but order them all together so that we don't have to do a subsequent budget amendments and it appears that it costs more money to do this way. Am I thinking crackling? Yes, and just unfortunately, you know, we try in the vehicle assessment committee, we have representative of each department that have cars. We ask what their needs are, we assess those needs and try to get as close to their needs as possible. If they change those needs after they've given, after we've recommended something, you know, there's nothing we can do about it. You know, I respect Constable Birch. If he wants to add additional items to this call, get a different package. But the vehicle assessment committee did exactly what they were supposed to do and the request, at the request of the people who served on the committee. Now, obviously every department, lack of official in department has a right to request different items. My concern with the request, I have no concern with the request. My concern was with when he's saying that mine is requested will impact this year's budget and next year's budget and due to the fact that we will not be able to purchase the item necessary when we transfer fund to meet this equipment requirement and so I Have some concerns about that and I'll let you know right up front Confirm a virtue that I may not be supporting when you ask for more money for these because I believe at the time that We requested that call we did what we could to make sure you had all the equipment that you need and if you didn't that wasn't enough Then you should have let us know Maybe you didn't know at the time Come on up. Maybe maybe you didn't know at the time. Come on up. Maybe you didn't know at the time that what you needed. But I think the vehicle assessment committee did their job in making sure that the equipment that was requested. The money was there. I understand that. And I am in no way questioning what you authorized out of the vehicle assessment committee. But what I am making reference to is when I outfit the Tahos that we have in our precinct, I wanted the equipment to mirror that equipment so I don't have to deviate from that. And when we addressed that as far as the package that they were ordering for the Sheriff's Office, when I talked to people within the county, they said, okay, you know, the sheriff's office basically is ordering their Tahoe's the same way you equip yours. Well, when it came in under that package, if that's my mistake, I'm sorry. I'm remiss of that and check that package out completely because I've always entrusted it to the county. They do a very well, a very good job in ordering these vehicles. When it came in, unfortunately, it did not have everything that I have matched up on my vehicles. And that's why I requested the extra amount. When I say it's going to impact the budget, it's impacting me because I'm having to move some money around it. I would have spent on some other things. I can make do with, you know, I can make do with that. And that's why I wanted to move the money around so that it mirrors my equipment. In the future when I requested, I will make sure that everything matches up completely before I submit any request. And you know, it managed me whatever you want to do. I'm sorry, you know, I didn't match it up, but that's what this request is all about. But you know, this is your first time order. And so, there you go. You know, they say it is a high moon period, but I don't give you a high moon period. Hey, I don't fee she's all I can take. I was looking for clarification, constable and I appreciate your being. Yeah, well it's not I'm not blaming this on anybody except for myself because I should have checked it and I should have made sure the equipment matched up and that's why I'm moving it around as far as the amendment and it won't happen in the future. But that makes sense. Obviously we want you to have the commit to feel you need. I was just looking for clarification. I'm going to move for a poll. Good. By Commissioner Eads commit. I want to ask you just a couple of questions to clarify. Commissioner Mitchell, are you saying that we requested one thing at the vehicle assessment committee? And then when it came down to buying it, we asked for something else. We had a package that we put together for each of the cars and that is what's recommended. Now when they order the cars they can obviously order something other than what's recommended. Yes but they have to pay different because we budget that item for each call. And I think we budget 34,000 for each call. And here's obviously cost more. So he's needed more money. And you know, and that's not, that's not unusual because there are a lot of departments that we budget something to decide that they want something different. And if they want to take it out of their, uh, rest of the budget, that's fine. But I'm just saying when you come to me asking me for more money, I'm going to remind you of that. Okay. So, but I guess my question is that interim of time between you ask it with the vehicle assessment committee and then when it actually comes down to buying it, there can be a change of circumstance. Correct. Let me change the price too. Right. And who is, I mean, was this Beth as a result of like market forces, the cars now more expensive? Or? No. Actually, vehicle assessment committee reviewed his request with an unquipped vehicle when it was appealed in Commissioner's Court. That is when it was during budget discussions when it was decided that it would be an equipped vehicle at 34,000. Of course, there's always changes in pricing, but this one actually just has a little bit more equipment on it than what we had planned for the sheriff vehicles. You originally recommended an un-equipped vehicle, he appealed it. No, no, no. We were trying to quit the government his equipment that matches the sheriff and other law enforcement me so what's the difference I mean just what's the addition of about 2000 uh 23 under all yeah I understand but what are you what else are you asking for it's just a few lights that are on there that that that we had put on there based on other agencies as far as I requested them as far as officers take. I feel like it was an issue. And if one of the other packages that might have been a little bit more expensive, if they would have requested that, which I didn't, because it would have caused you more order in that package as opposed to me putting these these aftermarket items on after the vehicles came in. So we didn't change from what the Vehicle Assessment Committee offered offered it was just when that package that package doesn't offer The things that we put on our vehicles and we have for you know years. I think I remember I was supportive of you getting the additional items But I thought I didn't we're going to we didn't requested it that time Commissioner Coleman so that's I think when you appealed it yeah, and that was that was the problem so There's a difference between what you appealed and what you want to purchase? We didn't ever get the amount that was appealed. It was not in the budget for me to use as far as it goes. That's why I had to move things around for the amendment. You see what I'm saying? Right, I'm trying to, I mean, just to clarify, my point is to all, even though I think I was supportive of getting the point, equipped it to me, just as a matter of policy, if we denied his appeal, right? But should we then allow our people to kind of, well, I hope this doesn't have a negative conversation, but like kind of, you know, game the system to then reallocate funds within his budget for the stuff we said as a body that we shouldn't, that we don't think is appropriate. Well, but I don't think that's, that's the only person has done this. I mean, many people that we deny something that's been legal and then later on down, and later on down in the year, they transfer money to the line item so they can buy what we denied in the budget. So this is not. Okay. And I think purchasing in the budget office do a good job of identifying whether or not that's taking place. Yeah. Beth, is there anything else you want to add? I'm seeking your input. Just one way. No, the last thing is. Don't want to say anything that's funny. The last paragraph of my email, I tried to just state what our policy is, is that there is, you know, if we say that if budget is approved with an SUV, you know, the Tahoe, the expedition, you know, those decisions are made by each elected official. And then the equipment list on each one is also decided by each elected official. So when the requisitions come in, we are ordering what they requisition as long as they're getting the main categories within budget. But I thought. So I think that's kind of where some of the disconnect of thinking is is that the budget is approved in one way and then they're requisitioning that something else. But it's my understanding the elected official has that leeway to do that and so that's how we're processing them. We just determined whether we give them the money to do it. Well, in commissioning. It's not a major issue. I know. I know. And if I would have researched the packages, Commissioner Coleman, and went to one different package, it would have had that amount in there. But when we talked about it in open court last year and you said, okay, let them come in, if it matches up as far as the sheriff's vehicles, it was gonna be fine. I didn't have a problem. But when it came in, they didn't, it lacked just that $2,300 worth of differences in equipment and that's why I requested that. And it's not anybody's fault except for myself, okay? But it's not that I'm trying to, it's not that I'm trying to go against policy, whatsoever, it was just, it was my mistake. Well, it's not particularly this instance. I'm just saying my point, I guess, and I don't wanna belabor the point is, man, we agonize over those appeals, right? And we spend a tremendous amount of time, we have all those hearings, We have a night meeting and it seems like I Guess my comment is it may be a little bit of a you know we borrow trouble over nothing if we say we're not gonna do it And we wind up doing it anyway We have to look at every every department that comes in that we deny something that we have to look at every department that comes in that we did not something that we have 1500 employees plus and that's tough. I understand what you're saying. I think he ordered this and I think the official has. I've argued all sides depending on who's sure exactly. I believe the constable is operating in good faith with the court and trying to file the policy. I do too. And I don't mean to admonish a constable. I'm just trying to file the policy. I do too, and I don't mean to admonish your consul. I'm just trying to get some clarification. I'll be the first to admit this is my first term, and I'm sure I'm going to take some lumps before it's over with. I call the question. I'd like us to. I can hear again. We're inclined to do two consecutive nights. So I just wanted to alert you to that, because I don't think we've had that conversation. Two consecutive nights in a limited area. Yes. And like a half mile radius. Bargit area. CDC says three nights. They're recommending three nights. Initially, everybody was just doing one night. There are entomologists now that are saying two nights is plenty. So we learn as we go. Dr. Perdon, what do you estimate? We have a cost model for the end of the policy. Turn on your microphone. And then we have that half mile. What's an estimated cost of that spring? The estimates we have is about $800 a night. Okay, so we've got plenty of money in... Yes, we're full of wealth. We're making this request now because it's really a perfect time, a perfect storm to speak. Currently we have four part-time GIS technician positions. All of them are graduating and leaving at the same time. So we're making this request to combine two of the part-time positions into one full-time position. So we'll be eliminating one county slot. We'll have, if this is approved, two part time positions, one full time position. The actual number of hours decreases slightly because the part times are budgeted at 22 hours. The full time position will be budgeted at 40 hours. It's a small decrease in the number of hours and because of that there's a small decrease in the annual salary also. Another real big benefit is the reduction of just all the maintenance costs associated with the employee and computer lease payments, software licensing and things like that. So there's approximately about $1,500 a year just in computer and software savings. Also scheduling wise it's much easier to, when we have projects to know that a full time employee is going to be in their seat as opposed to trying to balance the availability of two part time employees and their school schedules and things like that. Just kind of interesting that on House Bill 14 by PITS was laid out for consideration last Friday. essentially killed on a point of order as it should be. This is the one that under the guise of providing more transparency and government, it really just costs a whole lot of money and doesn't accomplish anything. And the man had the best of intentions when they started, but I don't think it ended up that way. It's not to say that it won't be brought back to the House floor this week but as of right now it's not doing well and that suits me just fine. I don't have any other legislation for you to be considering Commissioner Mitchell. Judge, I just want to bring attention to the conference of urban counties. Our staff there has worked tirelessly to own all these bills for us on behalf and so is Jim Allison and Texas Association of Counties. When we can't make it to Austin, they send emails to let us know which bills and I usually call Mary. And she's usually out of these first. And she packed out a letter. I already own anything that I send. I you know share with members of the court. But I want to thank them for all their hard work and they especially worked hard on this one. So I just want to call that to the attention of our citizens. Well, Jim Allison with CUC has been a big help to me for many, many years in trying to analyze these bills. What are they really saying? What is really happening with this legislation? So he's helped me in that way, and I've helped him because I think we are one of the few counties that really responds when he says contact the members of the committee or contact your elected representatives and senators on this issue because they need they need to understand that it's good for this reason or it's bad for that reason or how it's going to affect the counties and I'm sure that's making sure Jim is frustrated because many times he sent those emails and there aren't very many kindies that respond but I assure you we do. The bill that we had asked represented as Simmons to carry that had to do with the traffic regulations that we were asking for the reduction. It appears that it appears that there's another substitute bill, substituted by the chairman Larry Phillips, and Donna Donnelly, representative from Kaufman County, I can't remember his name. His bill is rising to the surface and basically gives pretty much not carte blanche that's wrong word but gives the ability for the special district and the commissioners court without input of the citizens of that district the opportunity to enter into an agreement for traffic regulations. And so with, yeah, I got a call from Representative Simmons on Saturday. They were working on Saturday. They were on the floor. And that bill was getting ready to come up. And he basically said, you know, what do you want me to do? And I said, well, I don't think you're in the driver's seat here. And I said, you know, we need to support anything that could give at least some kind of protocol and county involvement in that regulation. And I would tell you that that that's the only thing you've got to vote on. And vote on, I mean thing you've got to vote on then vote on. I mean, I've talked to- What was the final, I'll come at the end of the day, Dean. He never did call me back, so I've got to find out from him. But if that's the case, the bill that we worked on, this will supersede it. And so now there will be no requirement. If the bill passed there will be no requirement from all those special districts of a petition or any kind of input from the citizens to. But then be handled by an ICA? Yes. So I just want to bring you up to date on it. Well, we're at that point in the session where everything is a moving target and it's really hard to keep up with.
