And then we will be receiving the five-car and temporary, more important part of the city. This is the city of New York Road. Great. So you are one of the very most ready to start their action count part. And there's very very strict guidelines that must be achieved in that. So, city county has been the standard, city county has been the best service we can for to be. That's great. Great. I recently contacted the HRC all of the things you can do for these Dallas people work. And I was interested in getting a watch change this session that we don't want to e-report with the county first off. The law was very specific in which industry could e-report. We were the very first county in the entire state of Texas when e-report our real estate documents. And now we, e-report will be the first county to state it to e-report class in a partnership with the state. So the be the first county to be able to work in a partnership with the City of Texas. And then once it's approved in the public hearing and Judge Horne is ready to sign it, that it's an electronic signature that's placed on that document and then sent to our office so that the flats aren't rolled up and hand-wacked back by either of the IR Ashley. And so we're gonna work on that this coming year as well to have the internal mechanism in place. And then we'll be getting Michelle on board, hopefully, to see how we can add the plat certificates to that process. So it's complicated, but it's certainly not impossible. The infrastructure is there through both our recording system as well as the county's infrastructure. So it's certainly not anything out of the question, but it'll just take some coordination. And where Ms. Peggy-Annlo has always added to the county working environment by doing countless unsolicited acts of kindness. And where Ms. Peggy-Annlo is a valued employee and a co-worker who has served the citizens of Denton County in the Encounse Pable Department and will return in November 30th, 2013 after 17 years of service to the County Auditor's Office. And I am so glad to introduce you to some of the guys that it made it happen for us. Captain Tracy Murphy and Lieutenant Rick Clark. I'm going to let the lieutenant come up and kind of explain if I'm going to put Neil Spar and kind of explain it if I'm gonna put in your own spot when we go roll with it. He has done an incredible job putting this partnership together for us. I can't say enough kudos to him. And you guys, he'll give you about one minute of it and then you guys are gonna love this. But it's a great partnership. We've all put together with UNT and I'm just going to be more proud to be up here introduced in Lieutenant Rick Clark. Good morning. Thank you for being here, sir. Good morning, ladies and gentlemen. This concept and others has been talked about in Ditton County and at UNT for many years. We are fortunate enough to have good partners and good friends at the University that have consented to work with us on the CMOU and furnish us with secure, very adequate, certifiable lab space. We have, well, $300,000 worth of scientific instrumentation that will fully outfit a drug analysis laboratory. This has not been at the expense of the taxpayers of Denton County, not one penny. It's all been purchased with drug seizure funds. Excuse me. We just don't have a physical facility at the Sheriff's Office or within the county that I've been able to identify where we could adequately set the centralmentation up and get the necessary certifications that wouldn't need to go forward as a certified laboratory for the analysis of illegal narcotics. So UNT has considered to give us a secure, certifiable lab space that we'll meet that need. One thing I'd like to make very clear is this MOU is only for one year. It is a startup MOU. It has two purposes. If it's approved, then we can physically move into the lab space and get this instrumentation set up and running. The certification process will take the rest of the year. It's a very complex, involved testing procedure. Test of machines, test the analysts and multiplicity of other areas. But with our good partners and friends at UNT, they're very familiar with these certification processes and they will help us in these uncharted waters that we're about to embark on. But I'd like to introduce some of the folks that are here from UNT if you'd like. The first gentleman I'd like to introduce is Dr. Art Govin. Dr. Govin is the dean of the College of Arts and Sciences. Good morning. Thank you for being here, sir. The next gentleman I'd like to introduce is Dr. Guidod over Beck. Dr. Burbeck is a professor in the chemistry department at UNT and has been my direct contact during these negotiations on the MOU. Thank you, sir, for being here. We appreciate it. Let me ask you a question. I'm assuming that ultimately this will allow us to get some testing done to speed up the process instead of sending things out of Denton County Hopefully be conducive to getting things through our court system faster if you have the forensics done. Am I thinking along the right? Yes, ma'am. That's one of the one of the intents. Didn't kind of share its office as well as the other law enforcement agencies in this county currently use the Department of Public Safety, Crime Lab, and Garland, both for evidence as well as the testing of illegal narcotics. That's a half-day job for us because it takes two investigators to ensure the integrity of the narcotics evidence to transport to that facility and then the administrative end processing takes another period of time. So I only have four people back there. So that's half my strength for a half a day. So that's very labor intensive. This facility will be located on the UNT campus that will be much more accessible to the law enforcement community at large. It will have to be a layered approach and so far as the analysis, once we achieve the certifications, we have to have an ASCLAID and ISO certification in order for DPS to designate us and authorize laboratory analysis facility freely in our context. Is this a lack of a better term, a teaching facility for UNT? Is that the benefit to UNT has granted us the opportunity to have two graduate analysis analysts assigned to the laboratory. These people already have their degree in chemistry. They will be currently enrolled in the graduate school and they will be selected by the UNT faculty and they will be background investigated by us and that will be they'll be paid by UNT. Certainly do we have any any employees that are in the forensic lab that does any preliminary investigation or preliminary analysis of any drug case that we have in the county? Or is it just a matter of procedure when you do have a drug case that it is procedurally just given over to text dot driven to their facility? My point with that is at any time after the MOU if this if it does look like we're going to get all our certification. Well, we be looking at employees on behalf of this sheriff's office to also work in that facility. That's correct. That's correct. The sheriff's question is do we currently have any analyst on staff that that can handle Can handle that and get certified? Yes, sir The sheriff and the command staff have kindly Assigned deputy filiplanah to me on a temporary basis. He's assigned to another division but he has the academic qualifications and credentials to be the lab manager slash chief analyst. He's been trained at UNT on the instrumentation. He has a master's degree in chemistry and microbiology, a master's degree in those two areas and also as a master's degree in microbiology. So he will be the manager basically making sure a chain of custody and all those procedures are basically acquired and for five of the evidence, right? That's correct. I have a evidence, right? That's correct. Now at some future point, if we get totally inundated with cases, we may have to come back to the court for funding for a full-time analyst. I can see that if it becomes successful and the partnership becomes successful, there's no reason why other local law enforcement agencies cannot use the same service. But at that time, we'd look at probably a usage fee to help underwrite any expenses for any more employees or any future purchase of equipment? Yes, sir. Currently we're working with the District Attorney's Office on a procedure for restitution. The procedure for restitution would apply to anyone who's arrested for drugs who pleads guilty or is found guilty at court. We'll ask the judge then to assess that amount of money. At the end of this first year MOU, UNT will bring in their analyst actuaries and they will do a cost analysis study and they will consider maintenance cost on the equipment we're inter on the equipment salaries at InfoNight. So we'll have a justifiable dollar figure to present to the Court for Restitution. We'd rather charge the bad guys and the good guys. Thank you. I had a couple of questions. After the first year, are we going to have any additional fees that are going to be due to us or that are required or other than what we would pay in DPS? As I know, it's a one-time fee and it talks about in section 11, you just referred to, that there will be a restitution fee set by the court. I guess we need to let our fee committee know what that's going to be. And but that's that's supposed to be determined at the end of the contract. It also talks about that additional services will be paid for on a fee for service basis. I was kind of just wondering if there's any recurring fees after the initial grant of the $300,000 by the Sheriff's Department for upcoming basis. I was kind of just wondering if there was any recurring fees after the initial grant of the $300,000 by the Sheriff's Department for upcoming years. That's one of the things I know Commissioner Mitchell has been concerned in the past is that we enter into agreements, but then it's kind of at a zero cost to start with, but then the, you know, kind of the hidden cost amount year to year. Do we have any kind of estimate for that? Or I mean, those things, it's my understanding, will come about in the second year. Those will be the things that will be negotiating with with the University on the second year, I know, year after we attain certification. Without that certification, we can't go forward. You plan on committing forfeiture funds to compensate for those or money's already abudged it for lab expenses or how do y'all plan to budget for that in the future? Because I think this is a good idea but I think this has kind of been an idea that's percolating in the past for several years but I just want to make sure before we jump off into this that we plan for the future not that we invest a lot of money and then not without planning how we're going to pay for it. Are y'all expecting the commissioners board to pick up the tab? You're going to continue it under your current budget. That's going to be budgeted. What's y'all's plan for the future? Because this is only a one year agreement. That's correct. The first year will be funded out of Article 59 drug seizure funds because one of the requirements placed on us by UNT with this document is that we pay for the maintenance contracts on the instrumentation of those contracts. The first year of the cost will be in excess of $18,000. That's my understanding from the sheriff that we will pick that up through drug seizure funds. The second year's maintenance fees will be just a little over $25,000. We will put that in a budget request to fund a position, a paid position for the drug lab manager. So to follow up on commission of the coal, you are going to have, going to use some of those funds, but you're going to be asking for additional employees to fund, I mean, to staff that lab, that jug lab. Is that correct? One person at the outside. Okay, but you can use some of those forfeiture funds to offset some of the expenses. Until we can get some of this restitution money in the pipeline to help to free some of the expense. Until we get an idea of what that's gonna amount to then, we can't address what's gonna be leftover. I reiterate my motion for approval. That's not a couple of questions. Oh, sorry, sorry. Okay, I'll give it again. That's all right. Sorry, sorry. Okay. I'll admit again, Ed. That's all right. Mr. Wells, in regards to the fee, I know you may not have looked at that. Is that something, do you think that's something more appropriate for the fee committee or something that we would as the auditor try to figure out what is the appropriate fee? It says the government code 102, the code of criminal procedure in any other applicable authorizing statute or per agreement with the offender. So I was just trying to figure out exactly you know what the restitution fee would be and to, that's fairly vague. Well, actually, 102 has lots of... Right, two different. ...as many, many fees payable by defendants upon conviction. Right. So we need to know the exact statute and exactly which defendants it will apply to. We have a year to do that, don't we? Well, it says that the very least one to that I guess. But one that, I mean, there's a restitution fee for a general restitution fee, administration fee is limited to $2.00.00.00., the expendable salaries and other necessary items. As I said, the only, the only, the only, uh, restitution fee listed in 102.072 is a very last actually, uh, section on an administrative fee. Uh, just, and it says they can accept any officer can assess 1 0 in 1 0 3 0 3 you can assess the administrative fee for each transaction. So that's actually our transaction fee. Right. So there's not there's not a trend of restitution fee specifically listed in 102. There are generic there's some generic fees for services of peace officer. So, I mean, the need to find what exactly what authorizes this fee and how much it would be and how much it would be who would be assessed on. I would think. Mr. Felt. I mean, I know you may have not looked at this recently, but I know we're engaged in some fee litigation currently. And I would refer you to that Amigo Bel bell bonds versus some in the ego case that I think you and I had discussed previously that talks about there's certain punitive actions for which the county charges a fee that we don't have authorization to do. I think what the intent of this agreement is that ultimately when defendants go through the criminal system and they plead guilty or they're found guilty and their case is disposed of. And the judge signs that were probably most likely in cases where they receive community supervision. is that the offender will repay some or all of the portion of the analysis fee as part of their resolution of their case. I mean, it's part of court costs. I don't. As far as right now, the lab's going to have to get accredited before we ever even have any lab analysis. I've go forward where a case would go to court. And I think the language was left as general as possible to, you know, not block us in to one certain position at this point. Because there was discussion back and forth between the school, the university and the Sheriff's Department, as far as what specific provisions needed to go in that section. And that's something I think could be honed when it's if and when it's renewed in a year from now but for now you're not going to have any cases going to court until the lab gets accredited and that's going to take sometime I guess it would take a year or so should not be an issue. And the process has started. But you can't do it anyway, because you're not certified. Right. Right. It will give us a chance to put an ID together. We want to put it off a week. And then if it's not necessary at this point, we can strike that provision. And then when the MOU comes up and the one for the year, and when we can strike that provision and then when we agree to and the presentation is done in the budget and we can make good gas as to what we're committing ourselves to. I think that'd probably be smart. I have it. I have no problem backing it with the chapter 59 funnel and anything just to see our first year to make sure we're successful. probably be smart. And we will consider it in the upcoming budget. We're going to need a, you know, we're going to be doing another MOU in another year anyway. So that's not going to be a problem.
