And this Sunday from beginning at two o'clock, that's February the 9th, we will hold a public forum to discuss the installation of solar panels on historical buildings and within designated historic districts. This is just to inform the city of Ditton has the most historic districts and we're starting to see this issue pop up, not only here but in other communities around it and county. So we felt this was important. We go ahead and address this now. It will be in the commissioners courtroom and it's available to anyone in the area. We've got people from McKinney who want to come, so that's great. And we will have the entrance on Hickory Street. The South entrance will be available, and we'll also have our handicap accessibility available. But time? At two o'clock on Sunday afternoon. It'll be up from about two to four. This Sunday. Members in consideration of our guest time, let's first go to item 3A on the agenda. 3A is a presentation of appreciation for the Denton Community Market and approval of building use request from Denton Community Market to use the parking lots between Mulberry and Sigmore Streets at the historical park of Den County and at the Joseph 8 Carol administrative building on Saturdays beginning, I'm sorry, April 5th through November 29th, 2014, from 7 a.m. to 6 p.m. for the purpose of public having access to locally grown produce, creative crafts and food vendor food trucks. And I asked these nice ladies if they wouldn't just do a whole little presentation for us today so that everybody could see what all is going on over there. Good morning. Thank you for being here. Oh, thank you very much. Morning, commissioners. I'm Vicki Oppenheim with the Denton Community Market. I'm here with Katie Trice and Sarah Baguieri as well with the market. We are very pleased to be here this morning to just thank the county for all their support to this point and also to just really talk about our success and our excitement about the market. Our mission as an organization is to strengthen economic opportunities for local artists, businesses, food vendors and food producers to contribute to the vitality and livability of Denton. And we believe the market has really done this to this point. As you can see on average day, we have food trucks, we have all sorts of vendors and visitors that come to the historical park of Denton County. It's really become a tourist attraction, an area of vitality in the downtown on Saturday mornings. We have local produce and artist goods. We really, as I wanted to mention again, we're very appreciative of everything the county has done. This partnership has been vital to our success to this point. It draws visitors to the historical park. And it draws visitors to Denton. And I'll tell you more about that later. The basic benefits of the market, we believe are low startup costs for new and existing businesses. We've last year regenerated about $215,000 in sales, and that was just for the day of the market. It's definitely a very important gathering place in the community. It promotes local agriculture. We've had a real surge in local farms that have been created because of the market. The creativity, there's lots of businesses that are focused on creativity. And sustainability is very important in our operations and our goals. And we also believe it will attract development to the downtown. So again, here's some of the items that are sold. I want to point out that Noel quilts on the side there, it was sort of a riddle, and it's definitely a very talented quilter that's part of our market. Our project for public spaces is a national organization. They talk about the benefits of public markets. We believe we fulfill all the basic benefits in creating a vital economy and local culture. Again, an average day on the Saturday. Our typical site map, which, you know, have vendors around the square of the historical park and in the central will be a lot of activities and people gathering. Again, we have all kinds of activities from yoga for kids to music. Dentonradio.com regularly comes and has local musicians perform. People just hanging out and having picnics with their families. We have local music on a regular basis and this year we'll be having music every week. And we also lots of local produce all locally produced within a hundred mile radius, most of it from Denton County and about half from the city of Denton. Another image. So we are now a Texas non-profit corporation. We are under review by the IRS for our 501C3 status. We have a steering committee and all of our members, the vendors vote on all the major operations and decisions on the market. And we also have green vendor requirements. All crafts must be handmade. They are all 100% locally produced, and within 100 mile radius, and we have these requirements. We generally have about 500 to 1,000 visitors per week, but up to 1,500 or so, we do do weekly visitor counts, and our budget is about 20,000 per year at this point. So we have collected zip code data on visitors and about 25% or more from outside Denton, three even from across the state. Even had some foreign visitors who just happened to be in town, from Hungary and other countries. And they really enjoyed the market. And again, as I'm saying, it brings a lot of traffic to this historical park. We see a lot of people going to the museums, people asking about the market. And again, as I'm saying, it brings a lot of traffic to this historical park. We see a lot of people going to the museums, people asking about the park. We provide information on a regular basis about the park. So we are also identifying the city of Denton's sustainability plan as a major goal in promoting and supporting it. And just showing you some more local produce. So local farms didn't even exist before the market. Cardo's farm project that was in ponders now moved to Denton and one reason being because of the market. And have about almost 80 vendors on average. Majority are artists, but we have had a surge in growers and onsite food vendors. And we also host community groups. So these are general vendor trends, increased definitely in food and farmer vendors. How important is it? We have a week, a yearly survey, very important for the vendors, very important for the success, and many would not exist their businesses and their farms would not exist without the market. And as you can see on the upper left there's a quilted potholder with the courthouse right in the middle of it. We host special events from Splash Day, poetry readings, balloon animals for kids, bounce houses. We also are participants in the community with twilight tombs. We've developed many partnerships over the years and we continue to do so. Main Street Association member and so forth. Here's just showing we were on the square at one point for the twilight tombs in 2012. And here's an example. These are examples of some businesses that were created largely because of the market. And now are staples of the community. And many have become brick and mortar and other types of businesses. Here's an example of a food truck. It was a vendor booth and now it is a food truck. Earthwise produce started as a farmer at our market and now has a brick and mortar store. And the dime store was a vendor the first year and now they have a store downtown locally produced items. The applicant is requesting a variance from the ordinance requiring a minimum lot size of at least one acre. of a lot size of at least one acre. This subject property already exists via the Ruben-Beeby abstract, so it's not a new lot that was created out of a larger parent track. The lot size is 1.04 acres rose, 0.97 acres net after the right away dedication. Leaves it about 300 of an acre short or about 1,300 square feet. We sent out seven public notice mailings, we received four responses on opposition, mostly concerned about overcrowding, disturbing the rule setting, type things. The plan, the only meeting was held on December 16th to consider the request. The commission voted six to one in favor of granted variants. The people that protested this, did they get their questions answered or their concerns addressed? No one showed up at the meeting. No one showed up at the meeting, okay? So basically you would have been in compliance but for the fact that we have a right of resignation. Motion does carry. 8A is approval to discontinue use of payroll deduction or legal shield of volunteer employee benefit. Here's a half comments on that. Take a head. Do we have any of those employees, Amy, that have asked for this to be discontinued? Now, this was a request from Commissioner Coleman. Okay. Commissioner, why would you want to discontinue the employee 7S? Well, I was here when the person proposed legal shield. You know, frankly when I've been approached by people at the Sheriff's Department, I always told them that when they were being sold This they're always worried. Well, what if I get sued at work? Well, I would tell them there's a statutory requirement for the county to provide you with the defense. So legal shield is really if you need something for a traffic ticket or a simple will. Cumping personal. Yes. If you look at Darryl Ramsey and other people who advise people financially, it's really not a good deal unless you get a tremendous amount of traffic tickets. Or you can probably get a simple will if you actualize it out. It's $300 plus or more a year. You can probably get a simple will prepared for you for that amount of money and just pay for it once. To me, I don't mind if people subscribe to Legal Shield. I just don't think we should offer it as a benefit by the county. If you also look at the people who sell it, it's multi-level marketing as well. And so, to me, I mean, I know it may or may not be analogous, but do we also want to have an exclusive AMway dealer for the county? To me, if people want to use legal shield, they should buy it, but it shouldn't be a benefit offered by the county because there's no discount. We just offer them to buy it. And so that's the reason. Well, we offer like additional insurance benefits like AppLac and those different benefits. And my problem with it is that the employees that are actually using it have not asked us to discontinue And I think before we discontinue we need to at least have a conversation with them and see how they feel about it to Before we discontinue me how many I signed up with she Last time I checked there were 63. Look if there's stuff, they say it's portable. Even if you move the county, you can use it. So I doubt if we discontinued offering that, that they won't take them as customers. But have we talked to those employees? I mean, that's my question. If we have not talked to those employees? That's, I mean, that's my question. If we have not talked to them, employees think, I don't think we should discontinue it until we have that conversation. And they may say, yes, go ahead and discontinue it. But until that happens, I don't think we should discontinue it. I would hate for you all to decide that I have to have my paycheck to read the deposit without talking to me about it first. I disagree. I just don't think that it's a good purchase. And I don't disagree with that, but I just want to talk to the employees. We want to have an exclusive to sell cancer insurance. We want somebody to have an exclusive to sell AMway. To me, if somebody wants to have legal shield. I'm sure we do offer cancer insurance. Oh, and if you look it up, people have cast, you know. No, I have cancer insurance from Applett. I just don't think it's- Being called a benefit, is it a- Does it cost us anything, Amy? It doesn't cost us anything that burdened on my office and the Treasurer's office is negligible. The employees do receive a discounted group rate. If we talk to the employees and they decide that I'm fine, but before we talk to the employees, I don't think we should go forward with it. No, I just don't think we should have lot of members here, we use our past experience to argue certain points. I would tell you that my experience as a J.P., I had several people represented by attorneys within my court that could not afford an attorney unless they had this type of insurance. And most of those had to do with subrogation lawsuits that had to do with auto collisions that the insurance company weren't going to pay X amount of dollars so they end up suing them and so they have an attorney that would either from the insurance company or from from this type of legal aid and so I'm with Bobby I I would appreciate a survey and see if I would like to know how many people have you even used it? How many people of the 63 have even had to use the legal shield? It would be interesting to know to how their rates would change if we just continued this, would they no longer get the group rate? I can double check that. I believe it would go up a few dollars a month. Let's gather that information and take another look at it. And be sure to ask the employees that are using it if they want to discontinue this. That's very important to me that we make sure those employees that are using this service won't continue to use it, that service people, we discontinued it. So we don't hold this for, right? Okay. Yeah, I think she's probably going to need more than a week to communicate with everybody and get responses back.
