First I'd like to go to item 3D on the agenda which is approval of the Proclamation recognizing the Denton County Alternative Dispute Resolution Program on its 10-year anniversary. We have a nice Reclamation I want to read. Whereas October 1, 2014 marks the 10th anniversary of the creation of Denton County Alternative Dispute Resolution Program, also known as DCAP. The result of the partnership between the Dent County Commission's Court, the Dent County Judiciary, the Dent County Bar Association, and whereas DCAP, a 501C3 entity, was foreign for the purpose of providing low costs and no cost mediations to low income families in Dent County, to find themselves involved in the civil and family court process. And whereas this was made possible by the award of a contract from the Denton County Commissioners Court, using funds from court filing fees, airmark for alternative dispute resolution. And whereas the support of the district and county judges, DCAP, opened its doors, began to establish a reputation as unique and highly efficient part of the judicial process, whereas volunteer attorneys from the Denton County Bar Association donated over 1200 hours per year, pro bono, serving as mediators at DCAP. And whereas this community outreach program has not only resulted in assisting the efficient administration of justice for Denton County citizens, but has also been responsible for removing an excess of 2,500 active cases from the docket so the Denton County Court system. And whereas as part of the DCAP's commitment to the community, college students interested in pursuing a career in law or alternative dispute resolution are provided an opportunity to shadow and experience mediators. A monitoring program made possible by working in cooperation with Texas Women's University and the University of North Texas. And whereas the Denton County alternative dispute resolution program has been recognized statewide, it was named as an outstanding community partner by the State Bar of Texas. Now therefore, on behalf of the Denver County Commission's Court, you take great pride in the accomplishments of the Denver County Alternative Resolution Program. As it continues to serve as an outstanding example of what can be accomplished when the individuals behind the resources come together for a common cause and congratulate DCAP on its 10th anniversary. I wanted to just give a brief update through the month of September on what the Denton County employees have already raised towards the United Way campaign. 62 individuals have donated, pledged, or actually given cash for a total of $10,460. That's great. That's great. We've already beat our 2011 totals given for the entire year. And I have to say that juvenile probation is the reason for the majority of that money. During their pay setter campaign during August, they raised $5,365, which was $1,900 more than they had raised the year before. And that's due to Lydia and her work with juvenile. So anyway, I just wanted to say that. If anybody is interested, there's a lot of different opportunities in the city of Denton. They have September as live United Month. If you go to certain restaurants, you can say that you're wanting to give a percentage of your tickets, that you're already eating out on to the United Way. If you want to do a one-time donation or if you want to do a payroll deduction, you can always fill out the forms and send them to the Treasurer's office. But again, just make sure that you're telling people about United Way and about the services that they can provide because you never know You may know somebody that needs their help. We would like to leave it each day, but it would only require electricity in the evening because that's when you're supposed to light the menorah is in the evening. And it would only be lit for that evening and then we would, each night we would just remove the bulbs so that way nothing gets broken or anything. And that was a concern that was discussed about leaving it up overnight. We don't personally have a problem with it, but if there is an issue, we can certainly address that. This morning I'd be glad to answer any questions. I don't believe it conflicts with anything. My only concern was the safety of your menorah. Right. The holiday lighting event, which is when we do light the Christmas train, we have 10,000 people on the lawn, is on December 5th. This isn't the first of many, is it? We hope not, but I would like to briefly explain this one. In our contract, we did agree that the county would be responsible for any repair start towers that may need to be made because if they're destructurally will not hold the new equipment. So Motorola's responsibility was to do an analysis on the towers. Then at that point when they find efficiencies it's our responsibility to have those repaired. By using the same subcontractor engineering firm to do the design documents for the repairs there are some efficiencies in that. So this change order will allow them to give us the documents so that we can take bids or quotes to get the actual repairs done. If you'll remember, there was quite a bit of contingency left in the actual funds. And I mentioned when we awarded it that we were responsible for towers and the fourth site that still have not happened. So those repairs will come out of that. So this is for, there's a change in the generator, which is a little bit of a savings, but the rest of it is for engineering services to get documents to bid the repairs. Thank you. Mike Knowles has been on there for a long time. And one of the reasons I think we need to get a different face on there is if you remember during the I-35 expansion, he had at least visited with me expressing that he was representing some financing people in regards to helping put together a financing coalition for I-35. And at that point, I thought he'd been doing a good job but I determined I didn't think I would want him to serve on the board anymore and I also would like to have somebody who is on the eastern corridor of the county who lived closer to the tollway who might be a better representative. So I would like to open this up for additional candidates that can be considered by the court. And I also would like to have it where before we just reappoint somebody for something like this that we at least asked the court whether we would like to have the change. And I've talked to have talked previously about that. I checked my email. I did not see that. I was thinking that an email did go out. I searched my email in your name and case. I did not see it. I've been mistaken in the past, but regardless, I would still like to consider other candidates. I'm okay with my nails. He wanted to be reappointed and so I'm okay with him being reappointed. Commissioner, I'm sorry. I don't recall. I do. The reappointment has come up a couple of times. We had gotten an email quite early, like, June, I think, about the possibility of needing to reappoint somebody or appoint somebody to the board. Excuse me. Commissioner Marchant had sent some information in about a possible appointment. I can't recall and if you didn't find one then you know I'm gonna say no I didn't send one out. I know there was a lot of conversation and I've talked to a number of different people. I just don't recall if there was a single email saying this appointment was coming up. Well, I will tell you. I know that you didn't talk to me about it. It goes through the precinct I represent and also Commissioner Mershance. I, you know, I would like to be asked about stuff like that when it comes up. It's a court appointment now. The court's appointment and the desk represents the whole county even though the Toro does go through yours and Commissioner. Apparently they only spoke to you guys about it, not me. Commissioner Coleman, I'm sorry it would have been I know that I spoke with Commissioner March and I spoke actually extensively with Commissioner March and we had emails going back and forth. I did speak with Carrie Rogers within TTA. I don't recall if I had spoken with Commissioner Mitchell or with anybody else. I know that when the judge said, have we done this, I said this is, Mike Nol's wanted to be reappointed. So he did apologize. Oh, that's not a problem. I mean, Kate, it's trust me. No, normally we try to put those out commissioner, you're right, that we try to put it out saying this appointment is coming up and some so wishes to be reappointed or they don't wish to be reappointed. So that was an oversight. But in my speaking with excuse me, in my speaking with Mike Nolz, he did state that he would like to be reappointed and be. They are two year terms and he did state that this would be his last turn to serve. I understand the conversation that you had. I had the same conversation with him. I think his objective was to move the I-35 project forward. I didn't take it as a negative, apparently you did. But I think he's been very beneficial to Depp and County serving on the NTTA board and for that reason I'm in favor of appointing him from another tier town. Yes, no, yes, you ask him to call us. I did because he was my candidate that I profored last time. Right. So I did tell him to be on there. So now I know that he lives in shady shores, but he was originally a precinct to resident. He's he's a precinct one resident now. Yeah, but you served with him on the city council. Correct. Yeah. I think it was 15 years ago, 20, almost 20 years ago. years ago. The reason I got involved in it, I didn't even know it was up for reappointment and then I was contacted by John Mahalek. It's also candidate that I profored last time as well and then in discussing it with Kate through email and I even believe I talked to you Judge didn't I? And found that that Mike wanted to be reappointed for at least one more term than I spoke to Mike candidate and he he thought it was going to be an open seat and that Mike was not going to seek that. And so when he heard that Mike was, then he backed away and said, then I'll take a run at it the next time that it comes up. But I think what the commissioner is saying here, I think that if Mr. Mahalek had not called me, I would not have known. And it's right. So, and would not have known. It was just him knowing it, a citizen knowing it before I knew it. And so I think that we can solve that in the future when these come up again is having poor knowledge and then open it up to the public for even if we are reappointing open it up for the public to make application for this because there may be somebody out there that would better job. I'm trying to represent the area that I know that it's a that is a county wide area. Like 35, you know, I represented before redistricting a great portion of I 35, yet I was not involved with that. Only on a tangential basis, you know, commission or eads was the lead on that. So I'm just wondering, you know, how do I get to participate in any of this. I try hard, I work hard. I would like to have input on this. I know that there's a lot of historical stuff on this. And I really tried hard to get a representative from Frisco on it the last time. When David left, I'd offered a candidate. I thought he was going to be appointed. The candidate from Highland Village was chosen. And I would like the opportunity to proper somebody who I think would be appropriate for the area that I represent. I also agree with you, Judge, that we need to think not only precinct wide, but county wide. I just think sometimes some people, you know, we all think precinct wide but county wide, I just think sometimes some people, we all think precinct wide in one circumstance, but then county wide, when perhaps it's, we pick and choose when we do our views. And I understand that, but I would like to be included. I would like to be given input. This precinct one has another appointment on the opportunity regional water board right below here There you had a appointment there. You know Andy. Why don't you make that a precinct one? You currently have a there's already a precinct one of pointy Mr. Nell so I mean And your point is is that because I get to appoint somebody to get on this committee that I'm saying that's not the point. And your point is is that because I get to point somebody on this committee that. I'm saying there's two. We've got two precinct. We've got two precinct one appointees on here and so that's my point. Right. I think we have a motion. We have a motion in a second. I'm not finished discussing. So your point is that because he's a precinct one person, I should not have input who's from precinct one.
