Motion carries. 6D is approval of the intent to execute a master lease purchase agreement with PACR financial group for the purchase of 4 2016 Kinworth T800 dump trucks from MHC Kinworth through the Cooper purchasing contract. Number 430-13 through byboard in the amount of $484,892.80 with the down payment of $150,000 with funding from line 9 and 2067-25850 lease payments and we're going to call them back funding. Good morning. I did want to bring to the court's attention attention we're not actually approving the actual contract, the finance agreement today. Our negotiations with PACR have been lengthy and a little bit difficult and I wanted to give full disclosure of what we are approving. We did have several issues with the negotiation of the contract and we've been working on it since October. But the first issue had to do with we intended to trade in for vehicles and that really complicated the financing of it. And so eventually we did consult with Rodden Bridge and they agreed that we could auction those vehicles. We do believe we'll get about the same amount of money. So we did pull the trade-ins off of the actual purchase. And so we'll handle those once the new trucks come in. We will auction those off and put the money back in the account. We also had some issues with the actual contract. And I wanted to make sure court was fully aware of those since since that contract will be presented at a later date. Packard, I guess a civil DA was wanting Packard to warrant the defects in the trucks and Packard of course would not do that. The defects are covered in the purchase agreement with Kinworth. So it's my recommendation that we allow PACR to not agree to that type of language and so it's a business decision on the county to not agree to that language. Okay, so in other words, when I purchase the four trucks from Kinworth, they have a full warranty of all defects. And there's not a need for the finance company to actually want those defects. The other issue has to do with some of the default language. We had some compromised language that will come through in the contract. I do believe there's minimal or very unlikely risk that the county will not pay financing in subsequent years. And so I'm recommending that we approve as the compromised language that will be acceptable to the county. So I just want to full disclosure, it has been reviewed by the Civil Deals Office. They're not in full agreement with all the language, so I'm recommending approval of a contract that's not been fully approved by the Civil Deals. Today you are not approving the contract, but I can't order the trucks unless you approve intent to approve the contract. Those are the issues. Other questions from members of court? We have a motion by Commissioner Ead. Seconds the motion. Seconded by Commissioner Marchant. There no further discussion on favor, please say aye. Aye. Opposed, any motion does carry. I'm I'm moved for approval, but I have a question There was a wreck and fall of 2014. Was that our call through was that the other person's fault? That was the county's fault and this was the previous constable. I know. I don't have to. And I chose not to do anything with the vehicle until the new administration took over. I'm sorry say the new they chose not to pursue replacing the vehicle at the time and so over. I'm sorry, say the year. They chose not to pursue replacing the vehicle at the time. And so the new constable was given the opportunity to look at that and review. The vehicle assessment committee did review that and they're recommending approval as well. So it definitely was, the county was at fault. So as you know, we're required to replace or repair the vehicle. It makes sense. But they just didn't include it in the upcoming budget. I don't have to replace it. Well, it was right after October. After October. That's good. OK. OK. I believe we have a motion by Commissioner Coleman, second and back commissioner Mitchell. He's approval of a Denton to the local cooperation agreement for law enforcement services between Denton County, Texas and the Denton County Transportation Authority. Motion by Commissioner Eads. Second. Second by Commissioner Coleman. On favor, please say aye. Aye. Opposed to the need. Motion does carry 13 a is approval of legislative policy statements and or resolutions. In discussion or approval of other matters related to the 84th legislative session. We're going to keep this on our agenda until the session ends. There may or may not be items for us to take up, but I have a few for us to consider this morning. And there's a legislative policy statement approval of opposition to House and Senate Bill's proposing legislation which will remove local oversight of NTTA, which could negatively impact its ability to make policy decisions that are physically responsible and accountable to the NTTA system and at 6.5 million customers or any legislation which could significantly limit stability to leverage NTTA's successful toll system financing model which is delivered more than $7 billion of toll and non-told projects in the North Texas region. Is this outright through that and that's language I'm supportive of but is this directed at those builds that were filed by a representative, sheaing, this is the system wide financing, the ability of a commissioner's court to approve tall always. This is more directed, well it includes that, but this more directed to, there's a move on to put in TK under sunset commission, which is in my mind ridiculous, they're not a state agency. There was a push to do this a few years back and I actually went back to the 1997 legislation that created NTPA, which was co-sponsored, that bill was co-sponsored by Senator Nelson. And interestingly enough, I went to the, an out bill analysis of that 1997 legislation, and it very specifically emphasized local control. Local control. The four counties created MTTA, the four counties should have oversight as we do. And so this is really, in my mind, more directed towards local control and not putting it under sunset review. We, the four counties in TTA do not receive state funding for NTTA and it was created to be locally controlled. I like the fact that the County commissioners have appointees to the NTTTA board. And in fact, we have local control based on that. And we do. Everybody gets what they want. And to me, you know. When these bills come up specifically by bill number, I'll be glad to bring them back. Okay, because to me, there's, you know, I'm a fan of the NTTI. I think they did good work. The concept of system-wide financing is interesting when you try to explain it to the general public that we've got the North Dallas tollway and then that's generating a lot of funds. But then that fronts money for other projects in other areas. And they always remind you of I-30 which used to be be a toll lane was paid off and then made a free road. To me there's got to be a healthy balance. You don't want to have everything done in a system wide financing but then you also want to keep the ability to take one profitable roadway company. Also with this statement by commissioners court I've put a copy of a letter that the four county judges are working on all signing and sending and I think it's interesting to point out that prior to NTTAs formation in 1997 local toll tax dollars collected in North Texas were being diverted by the state to projects and feasibility studies outside the region. That was a big driving force for creating NTTA so we could call it local control. Oh yeah, definitely. So, and our target. But I just didn't want to do all this without everybody knowing what I was doing. And y'all, you and the other county judges were instrumental and very active and I review a couple of years ago. Background. Practices and so forth. Am I right? Yes, sir. People also forget that once I, 32, way, Dallas, what we're termified was paid for. There was no government entity willing to take it on their back to maintain it. He can. Yeah. What are the words? government entity willing to take it on their back to maintain it. I realize that. Yeah. What are that? Pig gardener who's going to take it now that it was paid for. That's why I'll pay those roads for this city if they need to take them over once it can pay. So I understand our concept. But I think everything in moderation, you don't want to have everything system-wide. You want to, I've got like four of these. You want't want to have everything system like you want to I've got like four of these you want to vote on them individually or you do okay well I'm gonna move for approval of this commission's court statement and authorizing me to go ahead and sign the letter that's in your backup material that the four kind of judges are working in signing this is and directed in any particular bill not yet Okay, so we have a motion by myself and seconded by Commissioner Marchant for the discussion You're none all in favor please say aye aye Posting motion is carried the next one I have is Approval of opposition to proposed legislation relating to the calculation of everworm, rowback taxes and the procedures for the adoption of an everworm tax rate, particularly Senate Bill 182, Senate Bill 766, and Senate Bill 767. As such caps would be devastating to county government. These involve going from that. Sure, well, these involve going from the Senate Bill 182 in under current law to calculate the rollback rate. You separate MNO from IONS and add 8% to the MNO portion of the tax rate. In other words, you can always pay for your debt. Standard and Poisson Moody's kind of life's that. Under 182, the M&L and IS is amounts are stayed together and instead of going up 8% they will go up 4% and should you go over the 4% it requires mandates and a countywide election. Elections are very expensive. I can see for a very small taxing jurisdiction that this could even force a higher tax rate just to pay for the election. But there's items in 766 and Senate Bill 767 that are just as damaging. I'm trying to remember now. I've not read so much legislation. I'm getting brain-scramble. But all of them are carried by New Senator out of Harris County, Paul Benton Court, who I couldn't disagree with more on these issues. We were all prepared to testify tomorrow and quite honestly. The legislative budget board came back with financial impact. They know that they couldn't determine financial impact, whereas the Senator Betancourt very much wished for them to express a huge tax the state. I think it's a very big issue. I think it's a very big issue. I think it's a very big issue. I think it's a very big issue. I think it's a very big issue. I think it's a very big issue. I think it's a very big issue. I think it's a very big issue. negative impact to cities and counties. School districts are exempted from these pieces of legislation. It would just be cities and counties and special districts that would be affected. So anyway, all of our agencies, the Texas Municipality and the UC and TAC, they're all opposed to all of these. In the working zone. I'm mission statement to take to the state to let them know that we won't vocal control. I think it's funny that we all are asking complain about control from Washington. Yes, yes. They are twenty-six years ago yesterday. Yes, they are twenty-six years ago yesterday. They signed a letter complaining about the federal government telling basically telling the state of Texas what to do. Really? Okay, so my motion is to approve opposing these three particular bills. Seconded by Commissioner Marchand other further questions or comments. Hearing none, on favor please say aye. Aye. Opposed? Signing. Motion does carry. Okay. I got three more to go here. Okay. This is approval of support for continuing the road county road grant program through the next two fiscal years. This is. Denton County supports continuing the county road grant program through the new next two fiscal years. The grant program has been approved as a one time appropriation during the 83rd legislative session of providing for $225 million for county road grants. The study by the Texas Transportation Institute concluded that $1 billion would be required to properly repair and rehabilitate county roads. However, this is a little garbled there. Yeah, we're going to have to straighten it out. So, therefore we ask that the members of the Senate Finance Committee and House Appropriations Committee and the entire of the kind of legislative delegation support and appropriation to continue this program. We want to provide that and bring it back to you. Yeah, well, we'll, we'll, we'll, we'll, we'll edit it to make sure it makes sense, but the intent is there. We have a motion for approval by Commissioner Eans, seconded by Commissioner Mitchell. All in favor, please say aye. Aye. Opposition A. Motion carries. Okay, next is approval of support for House Bill sponsored by Representative Ken Parker proposing legislation which relates to conferring the ability to acquire construct finance and maintain roadway improvements by districts creating created by special action the Texas legislature. and the role of the program. And I'm going to go to the program. I'm going to go to the program. I'm going to go to the program. I'm going to go to the program. I'm going to go to the program. I'm going to go to the program. I'm going to go to the program. I'm going to go to the program. I'm going to go to the program. I'm going to go to the program. I'm going to go We have motion by Commissioner Eads, seconded by Commissioner Marchant. Hearing no questions or discussion, all in favor, please say aye. Aye. Posts in e. Aye. Motion carries, four in favor, one opposed. And last is approval for support for proposed legislation which relates to the powers and duties of Kennew calls municipal utilities district number one a Denton County providing authority to impose attacks and issue bonds. I think no matter what promises they make to you regarding fire and police, it's never enough for the high density for residential. I wish that, you know, I don't like them at all, but I think a healthy compromise is to do an MMD much like Union Park development on 380 with Little Elm, where we negotiated with Hillwood that had take place within the city limits. And instead of them getting the full dollar dollar they got a portion of that dollar in the city Incorporated them and then he had municipal police and fire and they had library and they weren't holy dependent on the county for their services. This legislation, it's going to be in the underpants. Of course, legislation and enraged powers to the district based on commitments that such districts will execute contracts for enhanced public safety and local public safety service providers. I understand. I've seen those contracts, but it's just we do those with Savannah, Paloma Creek, Frisco, Ranch, and the president still don't believe it's enough. Further questions or comments? Do we have a motion? We'll leave we do though. This yet. Okay. We have a motion by Commissioner Eans. Seconded by Commissioner Marchant for the discussion. All in favor, please say aye. Aye. Opposed, Senin. Motion carries four in favor. One of those. That's it for this time. 13V is approval. Ronnie Smith reappointment to the transportation citizens board. This is approval of Senate Bill 5 and Senate Joint Resolution 5, which relate to allocating certain motor vehicles sales tax revenue to the state highway fund. And to the uses of that revenue. The purpose of Senate Bill 5 and Senate Joint Resolution 5 is to help cover the shortfall in the State Highway funding program. A constitutional amendment is needed to dedicate these funds so that TechStyle can reasonably predict and plan projects six to 10 years into the future to replace, should be replaced, should be replaced, should be relieved, congestion in preserve our system, the proposed method protects general revenue for the first approximately $2.835 billion per year. It shouldn't be protects, projects. I think auto correctives are enemy here today. It projects revenue for the first approximately $2.85 billion per year in the early years, but also allows growth in general revenue in later years as the motor vehicle sales tax So the motion is to approve supporting Senate Bill 5 and Senate Joint Resolution 5.
