Thank you for having me. Well, we got you there. Why don't you introduce who's with you today? This is our daughter and her name is Dana Irwin and she is a resident of Denton County and works in Denton County and this is Mike Raleigh. My husband of 32, great years. Thank you so much for being here with us today. This is a resolution honoring Donna Raleigh for 25 years of service to Denton County. Denton County Commissioners Court, Denton County, Texas during the regular session on the 17th day of March 2015, considered the following resolution. Whereas Donna Riley originally began her career with Denton County in 1989 as a purchasing clerk in the purchasing department and progressed to a senior buyer in 1990, where her hard work, dedication and attention to detail were always appreciated as she lent her expertise in the purchase of road construction materials, vehicles and equipment among many other commodities and services. Whereas Donna, excuse me, contributed to Dent County's fiscal conservatism, by meticulously managing the county's contracts assigned to her and protecting the county's interest both legally and financially. And where is Donna earned her CPPB? Okay, you're gonna have to tell me what all that stands for. That's certified public purchasing bar. Good. Professional certification in 2008 and continually enhanced the effectiveness of the office through ongoing professional development. Whereas Donna have settled in advancing the profession by serving on several local and state public procurement associations as a board member and most recently was honored by over 500 public buyers in the state of Texas by being elected as president of the Texas Public Purchasing Association. And whereas Donna delivered professional customer service to the department and supporter she serviced and always presented a positive attitude in friendly atmosphere. And where's Donna will retire on April 6, 2015 after 25 years of dedicated service. And she'll henceforth dedicate herself to traveling and spending time with her husband and family. We congratulate Donna on her well-earned retirement and extend our best wishes to her for continued success, happiness and good health in the years to come down an open court the 17th day of March 2015 Cheryl some move Signed by Commissioner Mitchell all in favor please say aye. I oppose any motion does carry I know Beth would like to say a few words. I'm going to say something before she has a chance. It really has been an honor to have Donna work with me for 25 years. We actually kind of started back when the purchasing department started back in the 80s. And she's kind of helped me form the department over the years. And I really trusted her judgment. And I've enjoyed working with her more than she even knows. I've thrown a lot of challenges at her over the years and I know she's probably felt like I've put her on the end of a plank and poked her with a long stick at times, but she has taken those challenges and ran with them and I've been very proud of the things she's been able to accomplish and she really is a trusted leader in our department and I don't know how we're going to manage without her. So I do wish her the best and she doesn't know how much she's going to be missed. Would you like to say sure? Well, it's been a pleasure. I've enjoyed everything. I've had a great ride. I'm glad for it to be over because we have big plans. Good. I said I wasn't going to do this. I'm just happy. I'm happy I've had the opportunity to work here. It's been good for me. It's been good for my family. We've all of our retirees after we do your resolution. If you'll wait just a few minutes because Cheryl's busy going to be framing them and we want you to be able to take them with you. Thank you so much for being here this morning. Thank you for your service, Donna. Happy retirement. We're not. We to stay there. There we go. Go ahead. If you want to go ahead. Did you want to say something? I know. I know. A nice nest. We're halfway done. Not that he's anxious or anything. Okay, well you're right. We're going to go to 3B next and I've asked Commissioner Ead's to read this resolution. And although I'm very happy for you, Mike, I'm dreading this agenda item for a quarter while. This is a resolution honoring Mike Riley for 22 years of service to Ditton County. The Ditton County Commissioner's Court, Ditton County, Texas during a regular session on the 70th day of March, 2015 considering the following resolution. Whereas Mike Riley, administrative foreman, will be retiring on April the 6th, 2015, after completing a total of 22 years of service to the Ditton County Road and Bridge Department. Whereas Mike Riley was originally hired by Ditton County on September 1st, 1989 as a crewman. And due to his abundant construction experience and knowledge, he was quickly promoted through the ranks. He served the residents of Ditton County and the Road and Bridge Department as a formant from April 27th 1994 to October 13th 2012. And whereas on May 29th 2013, Mike returned as our administrative formant and devoted an additional two years of leadership to the Rodin Bridge Department for which we will always be grateful. After his retirement, we hope to carry us with us the pride and spirit that might demonstrated every day. And whereas during all the time of said service to the Road and Bridge Department, Mike faithfully and diligently carried out his duties and obligations while maintaining a high level of excellence and conducted himself in a responsible manner with vigilance for the safety and security of the entire department and the citizens of Ditton County. And whereas Mike plans to enjoy his retirement years traveling with his wife Donna, attending hot rod shows, swap meets rodeos and spending time with his family. Now therefore be it resolved the Ditton County Commissioner's Court, Ditton County, Texas. This hereby extend to Mike Riley, our sincere and grateful appreciation for his dedicated service to Ditton County. We congratulate Mike on his well-earned retirement and extend our best wishes to him for continued success, happiness and good health in the years to come. I have done an open court the 17th day of March 2015 upon a motion by myself. Thank you. Motion by Commissioner Ead, seconded by Commissioner Mitchell. the 17th day of March 2015 upon a motion by myself. Thank you. Motion by Commissioner Ead, seconded by Commissioner Mitchell. All in favor, please say aye. Aye. Opposed to the city. Let's hear you. Thank you. Thank you. I'd like to say something before Mike. I think Mike has done a great job of balancing three things and one of those is what's good for our constituents, what's good for our crews and what's good for the county, the actual government of the county. And I think he's been a real role model to me and Mike, we've worked together for eight years and I appreciate you so much. I trust you and you're a great friend. This is kind of funny. I was out at the barn of the day interviewing some guys and one of the employees said at the best. Gosh, that's some of my, that's a real summary of him and his work ethic and the way he does things and his personality. You know, in the road department, we get a lot of complaints. You don't always get a lot of compliments, we get a lot of complaints, people are quick to call and complain about something or put a request for service in. And many times people are, their emotions are quite elevated, shall we say. And so, they're very passionate. And one of the guys of the day said, Mike has such a way about him that if a resident's mad and ready to pull a gun on you, after Mike gets done visiting with them, they want to shine his boots. And I think that really summarizes Mike in his demeanor with our residents. And he's always had a strong value system of promoting the employees. And all the guys here in this department, every decision that he makes that we talk about, he has your own mind and I want you to know that. And that's a true legacy that I hope we continue here so. Mike, thank you for your leadership, thank you for your service and your friendship. So thank you and I know Commissioner Mitchell has some comments. What can I say? I want to thank you when we were in our needs of someone to step up to the plate at the Danny Paz. Mike, Commissioner Eats called me and said, what about Mike and we were both in agreement at the same time? I wanna thank you, you could have said no. You didn't have time, you just retired, you were doing things, but you stepped up to the plate and said, yes, I'll do this. And I know you did it because of your love, not only for the department guys, but for the constituents. And for us, you know, you have to trust us in order to do that. Don't I appreciate the fact that you allowed him to come back? I know you had a lot of honeydews on your list and you allowed him to come back and work for us. And I certainly do appreciate you. Mike, every time that we had an event, and I was there, you wanted to make sure that I gave the prayer. You honored me, and I honored you this morning for all that you've done for Ben County. And I just wish you the best you in Donna, and your family, I know you all have gone through some trials and tribulations, but there is sunshine at the end of the town. Just be patient and trust in the lower. Thank you. Anything else? Just thank you all. Like Donna said, it's been, it's been a great job. And I couldn't have done it without Bobby Andy and these guys. Well, obviously we have a big crowd here. All wanting to thank you for your service. Well, I really appreciate you. I really appreciate you. Well, and a very happy retirement. I was always so to surround yourself with good people. And I feel like I have done it. We are all blessed. Thank you. Hey, Dominga Azuna. Come on up to the podium if you would please come on up. Okay, this is item 3C on the agenda and I've asked Commissioner Marchant to read the resolution. Good morning, Dominga. Good morning. This is an honor, this is resolution honoring Dominga Azina for 23 years of service to Denton County. The Denton County Commission's Court, Denton County, Texas during a regular session on the 17th day of March of 2015, considered the following resolution. of Benton County, CSCD on March 23rd, 1992. And whereas Dominga has been the mainstay of the department's indirect unit during her career. And whereas Dominga patiently clarifies the conditions of supervision to probationers who live in other counties or states and ensures that they have the information they need to comply with the courts orders. And whereas Dominga works diligently with other agencies in order to protect the communities where probationers reside and whereas Dominga has trained many new co-workers is a true team player. And whereas Dominga is always one of the first to volunteer to help with special events and her humor and positive attitude make big jobs easier to handle. And whereas Domingo is consistently polite, respectful and professional. Whereas Domingo will retire on March 31, 2015 after 23 years of dedicated service to Ditton County. Now therefore, be it resolved, the Ditton County, Commissioner's Court, Ditton County, Texas does hereby extend to Domingue, Azuna, Arsinceir, and grateful appreciation for a dedicated service to Ditton County. We congratulate you, Domingue, on your well-earned retirement and extend our best wishes to you for Daminga, on your well-earned retirement and extend our best wishes to you for continued success, happiness, and good health and years to come. Done an open court by a motion by myself. Chair, we'll second the motion. Motion made by Commissioner Marchant, seconded by me. All in favor of the motion, please say aye. Aye. Opposed to the motion. I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I, I County. This is a good place to work and I've enjoyed working for the probation department and and I hope they've enjoyed having me. Not sure but but I thank everyone for being here and like I said I really appreciate everyone. Thank you. Well you're appreciated too. You know every month we do these retirement resolutions and I don't know about you all but I just kind of feel a sense of loss because we lose obviously very valuable people. We lose long term employees. There's all that historical knowledge that the county has certainly benefited from your many years of service. And so when we tell you that we appreciate you, those aren't hollow words. They're meant sincerely. So we do wish you a happy retirement and thank you very much for your service. Thank you very much for your time. Thank you. Okay, let's see here. We have one more retirement resolution. It's for Larry Graham. Larry couldn't be here this morning that I want Bobby Mitchell to read the resolution. We'd like to honor these people even if they couldn't be with us this morning. Bobby, go ahead. Thank you, Judge. This is a resolution honoring Larry Graham for 25 years of service to Den County. Den County Commission is cool. Den County, Texas, doing a regular session on the 17th day of March, 2015, considered the following resolution. Whereas Larry Graham joined Den County CSCD on May 29, 1989, after working four years as a case worker for child protective services. And whereas Larry has built a strong professional relationship with area law enforcement agencies and prosecutors that he has maintained throughout his career. And whereas Larry supervised the department first specialized caseload for sex offenders has been the supervisor of sex offenders officers and has remained the department, and whereas Larry has served on numerous committees and projects for the department as well as community and statewide committees, and whereas Larry has trained in mentored numerous probation officers, and whereas Larry has been dedicated to protecting victims of crime and serving the community for the past 30 years, and whereas Larry will retire from DIN County, CSCD. On March 31, 2015, now therefore be it resolved, but DIN County Commission is called DIN County Texas, does hereby extend to Larry Graham a sincere and grateful appreciation for his dedicated service to Den County. We congratulate Larry on his well-earned retirement and extend our best wishes to him for continued success, happiness and good health in the years to come. Done and open course this to 17th day of March 2015 upon a motion made by myself. Motion by Commissioner Mitchell, second and back Commissioner Eads. All in favor, please say aye. Aye. Aye. Opposed, Cine? Motion does carry. Let's go ahead and give my round. I hope at some point in time he can watch the video of the proceedings and Larry, when you do, we want to extend the best wishes and appreciation to you for your many years of dedicated service. CSCD is going to be losing a couple of great people. I'd like to fill those shoes after so many years of service. Okay, we're going to take just a couple of minute break so that road and bridge can get back to work. So we're in recess for about two minutes. Commissioners Court is reconvened. I think we could do the public hearing for 4B at the same time. I move we open the public hearing for A and B. Thank you. The 4B is a putt. Thank you. We have a motion by Commissioner E. Seconded by Commissioner March and to open the public hearing for A, 4-4-B. 4-B is to consider, discuss, end or take any appropriate action on the request for zoning change for abstract 5-69. H. Hobo, I think that is, survey tracks 4 and 5, and this is also on Commissioner Prissington. Good morning, Stephen. Any judge, commissioners? The first public hearing is for Lake Ray Roberts Reson. That plan is splitting off to 4.9 acre tracks. The existing zoning for that area is currently ag and once that split occurs those tracks will be non-conforming. They're requesting an R4 which is 4 acres of greater and that meets the intended land use. The Lake Ray Roberts planning and zoning commission met on January 12th and voted unanimously to recommend approval of the request. Okay, and on four B, go ahead and do that too. The four B is also Lake Ray Roberts Reson request. The applicant's request and a change to two existing tracks that are both not conforming. They're both a little over five acres. They're requesting R5, which meets the intended land use. The Lake River Arbor's planning is only commissioned to met on January 12th and about unanimously to approve the request. Thank you. Is anyone an attendance that would like to address commissioners card on either one of these issues for a or for B? He's not hitting the input that I'm aware of. He's not here and I don't want to take action if it gets his desire. It doesn't say here just that public hearing. It doesn't say to and to approve. I'm going to take any appropriate action. Is that what it says? Yeah. I mean, we can hold it if you want to, but I feel confident that if he had an issue with it, he would have expressed it. It has been before the Lake River Roberts Planning and Zoning Commission, and on both items, I believe they voted unanimously and support. Since it makes the areas in question conform to- I'll move for approval on- To the region. I'll move for approval on- Okay. The- I just wanted to be- Sure. I appreciate that. I'll bring you to the back up. So this is a bad or any question, y'all? Answer whoever is most appropriate. So, what is the goal and desire here? It is to buy something that's already on a ready-made system. It's not customized, but it has some modules that we can customize. I mean, what's the? It is to buy a ready made system. It's a flexible system. It's not customized, but it's a flexible system that we should be able to configure, configurable to meet our needs. It's the same similar RFP if you remember we put in our P out last fall and then we're Yeah, we had contraction problems and so we're putting it out again. Motion does carry. Eight a is approval of a revision to the tobacco usage policy 2.12. Second. Hold on to the manager. to back owe usage policy 2.12. Second. Hold on a minute here. We have a motion by Commissioner Mitchell, seconded by Commissioner Marchand. Amy, you were getting ready to say something or did you want to? I was just going to say that this is the issue that we discussed last week. And I know that Dr. Richardson addressed you on this and I sent you some additional information. Okay, well I'm going to be voting against this for the simple reason that obviously I don't want everybody to start smoking quite the contrary. I feel confident in saying that if somebody has never been a smoker, they don't really understand how hard it is to get off of cigarettes. And it's harder for some people than it is others for sure. That's why some people can just put, never go back to them and some people quit, start, quit, start, quit, start, quit, start numerous times. I feel that our department heads and elected officials should be able to manage their offices in such a way as to impress upon their employees that they need to be considered or their fellow employees so that if they go into a break room and somebody is not comfortable with an e-said in there, fine, leave or quit or whatever, be considered of your fellow employees. But I know that the school is still out on the effects of e-said. I'm not going to sit here and tell you if they're good for you, but I'm just not convinced that they're all that bad, either. Certainly they are a nicotine delivery system. I don't question that, but I know a lot of people myself included that got off of cigarettes because of e-sales. I do not want to discourage anybody from got off of cigarettes because of e-cigs. I do not want to discourage anybody from getting off of cigarettes. And if this is a way to do it for them, I want to encourage that. So I understand the policy and I understand the reasoning behind it. And I understand why my fellow members of court here are voting for it, but I'm not going to be supporting this policy for the reason stated. So anybody else want to make a comment or are you ready to do that? New one. I will support the policy, but I do agree with your cinnamon judge as far as I do believe that the e-cigs are a step that we should encourage people to get off, to quick tobacco and it's a way that people can segue to a tobacco free or nicotine lifestyle. But I do agree with you that the jury is still out on the science and so I will support that by the policy that I do agree with your general sentiments that it is a step in the right direction to wean people off of tobacco. All right, so we have a motion in a second. All in favor, please say aye. Opposed, C&A? Me? Motion carries three in favor, one of those. 10A is approval of the final plaid for the AMX Higgs edition commissioner percent one. Motion by Commissioner Mitchell, seconded by Commissioner Eads. Here in no discussion, I'll in favor, please say aye. Aye. Posting a motion just carried 10B is approval of the preliminary plaid for Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Any other questions? Motion to carry, ten C's approval to use a little bit different process on these two projects. We're getting ready to start design here on the Phase Three and law enforcement slash laundry kitchen project. And they're both very large projects. Both of them are right now before we even get started over budget. Just by looking at square foot numbers and HDR did an analysis for us. So we're going to have to make very upfront some tough decisions on what parts to keep in and cut out of the project. So the one unknown that we have is the public infrastructure segment of those projects. And so what we want to do is front load to a PO to get before the City of Denton work out all the issues with what we might need for traffic signals, turn lanes, electrical infrastructures. So that way we have a budget number so we know better off what we're dealing with when we start the projects. These services would have been done anyway so this fee will be taken off their fee when we negotiate the contract but we just wanted to get a jump start on it before that money is issued in the spring here. So that's the reason we want to want to do this. Can you get the City of Dentons requirements? You do get that in writing, do you not? Yeah, it'll be a formal submittal. We have a site plan for both projects, so we'll sit, actually submit that to them, go through the R.C. review process and get the formal comments. And there's always some negotiation and things to look at when we get those comments back. Okay. Questions? Move for approval. Thank you. We have a motion by Commissioner Marchant. Seconded by Commissioner Mitchell. All in favor, please say aye. Aye. I'm Paterson E. Motion to carry. Thank you, Michael. motion. This carried. Thank you, Michael. 13A is approval of legislative policy statements and our resolutions and discussion or approval of other matters related to 84th legislative session. I just have one for you today. Right before court, I got an email from Peggy Carr that we're going to be bringing a resolution concerning herd apartment next week. We can have time to pull it together today, but this is a Denton County Opposes House Bill 790, which relates to noise abatement procedures on certain turnfights. Says written keyword here, as written, House Bill 790 would require NTTA to conduct a sound study following petition by the neighborhoods to erect a sound barrier while if the study finds that certain decibel levels are exceeded. Also, as written, House Bill 790 would require a 5% revenue set aside to conduct additional studies. Since NTTA already complies with such sound studies as they are mandated by state and federal guidelines, we are opposed to South Coast spill 790, compliant with this legislation with established poor policy. We create a special benefit for one community and would set an open-ended financial precedent that would be difficult to overcome, all contrary to good to ideas of good government, local control, or a fiscal responsibility and accountability to all NTTA drivers. Both Dant and County and NTTA take its responsibilities under the federal and state environmental guidelines very seriously and fully support constructing sound barriers as required. That county advocates following one process is outlined that federal and state guidelines and NTTA already ensures all projects meet each federal and state environmental guideline. The environmental process is long and deliberate with many opportunities for public input. We had this on the agenda last week and we wanted to reword our statement of opposition and this is the wording that seemed to be agreeable to everybody. Are there further comments or questions? Thank you. We have a motion by Commissioner Mitchell, seconded by Commissioner Marchand. On favor, please say aye. Aye. Posting. Motion does carry. Thank you. Go ahead. Thank you, Your Honor. Under other legislative items, I would just bring you all's attention to CRTC transportation, legislative items that I forwarded you all last night. If you all look those over, and if there's any bills in particular, if you want to get that are concerned, if you want to get with me, I'll be happy to track it down with our delegation down there and get a status to see if it's viable or not. See if we need to pass a resolution for next week. Thank God that filing deadline has passed. I can get yes, I can get with our TRTC. I'll be happy to give our TRTC or the DRN judge. You can give it or I'll give the DRNC legislative staff. Where I said thank goodness Bill Finley is done, but that's the good news. The bad news is there's over 7,000 bills filed. So it's been cumbersome. Thankfully not all of them are going to even get a hearing. Not all of them will get out of the committee, but it's always an unknown where that's going to finally fall out. We appreciate Department heads and elected officials keeping my office surprised of things that they know about that effect their offices and if you'd like commissioners court to do a resolution resolution to pass on to our elected officials continue to contact us and We'll be glad to do what we can in that regard Okay We have voted on that. Yeah, okay. So make sure I will skip the sentence here. Which is there? Okay, let's go on to 13b, which is approval of the 17 2014 continuing education credit hours for Commissioner Mitchell, precinct three in accordance with section 81.0025, the Texas local government code. Y'all are just so smart. You've all finished your training. I'll move for approval. The motion by Commissioner Eads. The chair will second the motion. All in favor, please say aye. Aye. Post and aye. Let's take 13G at the same time because this is approval of the New St request for Denton Holiday Festival Association to use a quarter of the square building in Lawn and parking lot of the historical park of Denton County for the annual holiday lighting event for noon on Thursday, December 3rd, 20th, I think that's supposed to be 2015 or 14. Yeah, 15. I'll get it right through 10 30 PM on Friday, December 4th, 2015 Commissioner Eads. I'd like to make a comment before I make a motion here. We had a great holiday lighting event last year and it's beautiful weather and an abundant crowd. I think it may have been a record year, Judge. I can't remember what art was. I think it was. But Judge Horn and I represented it from the holiday lighting. We had a great meeting last year following the event and talked about scheduling the building in collaboration with our Office of History and Culture and our outreach efforts, whether they at the park or at the courthouse lawn. And so I'm totally supportive of our holiday lighting as we all are. And I'll move for approval of this and to waive their fee. But I want to make it abundantly clear that there will be a, as we move forward on this, that we will have a true spirit of cooperation as far as the Ditton County staff and officials working at concert and our departments working with the department and a festival committee as far as space allocation and and collaborating on the use. And so we're going to be having our staff get together with their committee and regarding who does what and so that we work together on that. So we're very supportive and so pleased to have them back again and we have great things in store. So anyway, I appreciate them. We were lucky it was great weather last year and I think we really did have a record turnout. Was Laughan Cheryl, did you need to clarify anything? Yes, good morning. I just wanted to point out that all of these are on other departments. 13C through G didn't main street is paying the security fee and paying for the 250 deposit. They are all requesting to have the fees of $25 an hour away. Which I believe Commissioner Eads added that to his motion. Yes, I'll recognize my motion accordingly. I think I made all those. Okay, thank you. Okay, thank you. So we have a motion in the second, I'll second the motion. So we have a motion in the second, I'll second the motion. I'll hear no further discussion. Funding for the project, shall come from 2010, permanent improvement bonds, Louisville Government Center, architect fees, auditor line item 853809020, is recommended by the county director of purchasing best Fleming and the Denton County Construction Manager, Michael Tudillo. Let me ask a question. Okay, this is for our potential services, correct? Okay, when we get further down the line into construction, I want to see a retainment on construction to see a retaining construction so that if they're installing in air conditioning unit or they're installing whatever that bottom line, we sign off on it that it's working before they get the final check. I don't want people getting paid until everything is working the way it's supposed to be working. Michael, if you do address that, we've had some issues in the past and I'm trying to make sure that that happened again. Well, we do that. There's some different processes that we go through to get that accomplished. There's, you know, in the contract, there's substantial completion and final completion. Substantial is basically where the systems are working and you can occupy the building. Final completion went all that is completed and everything's done, all everything's fixed. So we do have a process that we go through to make sure everything works in the building. I do want to clarify though that this building is designed. This is mostly construction management services on behalf of the architect that's what this contract is. They're basically finishing up the monitor the bid documents to get those together to be ready to bid. Okay. And it's picking up at that point. All right further questions or comments?
