Whereas Lindsay Kay Jones training for the Den County Sheriff Office since January 2nd, 2005, will retire on September 9th, 2015, after a 10-year career with Den County and a 30-year career in law enforcement. And whereas during her time with the Den County Sheriff Office, Lindsay continued training to achieve advanced knowledge of her job duties and was highly respected for her ability to develop and manage training programs. Work with other agencies and ensure all employees were compliant with T-Cole requirements. And whereas Lindsey received numerous letters of commendation while employed with the DIN County Sheriff Office. And whereas Lindsay has faithfully and diligently dischoiced the duties and obligations of the office offices and trusted to her, worked well with her co-workers and implemented the policies of the Sheriff Office in an honorable and responsible manner with vigilance for the safety and security of the families and citizens of Den County, and whereas the citizens of Den County are grateful to Lindsay for answering the call to service for her commitment to duty and for the service she has rendered to her law enforcement career and tenure with Den County. Now therefore, be it resolved with Den County Commission of the School of DIN County, Texas, does hereby extend to Lindsey Kay Jones, a sincere and grateful appreciation for her dedicated service to DIN County. We congratulate Lindsey on her well earned retirement and extend our best wishes to her for continued success, happiness and good health in the years to come. First of all, I want to recognize some people that took time out from their very busy schedules, especially after a holiday. We have Sheriff Terry Gilbert with us from Cook County. And we have chief Ed Reynolds from UNT who brought quite a few of his staff to up. I've known and worked with over the years. I'll tell a story on Ed. He in fact, I trained in a basic academy and every once in a while I remind him of the times he sat on the bench in my office and we had very serious discussions. So I'm very proud of the fact that those talks worked. So and of course there's quite a few representatives from agencies that I have worked with over the years. We have from Frisco PD, we have Alex Bestida. And Todd UBanks retired Carrollton PD who worked for me part time when I had UNT Academy. He's now the director of the Academy at Colin County. Glad you guys. And I look around and I see so many people that I've known for so long. I started in 1982 with the City of Duncanville. I'd spent five years as a high school teacher and decided I wanted to do something where I would be outside. I spent almost 10 years with them working nights and evenings, advanced to sergeant. The last two years that I was there, I also worked fulltime for the Cog Academy, the Regional Police Academy in Arlington. And after five Saturday nights in a row of holding somebody while they died of violent death, I decided that I needed to move on. So I worked for the Academy in Arlington for a couple years. Mr. Jones and I reconnected we had gone to the Academy together. And so in 91 I moved north and the chief at UNT then Eric Jackson asked me to come and start UNT's Academy, so I was there for six years. And there's a considerable number of officers, peace officers within the jail that I have watched go up from their time going to the Academy while they were also working for the jail. I can't even put a number on all of those people. So when the UNT's Academy was given to the Department of Criminal Justice, I moved on going to work for Carrollton and did their training for five years and actually retired, went home. And a couple months later, Benny Parkick called me and he said, well it looks like I'm going to be sheriff, would you come over and clean up the training that we've had over the last few years. And I said yes, thank been a full circle for me. And at this point, I'm going to do legal updates for all the officers in Denton County and the surrounding areas through December. And I hope to work part time as a volunteer at Denton's New Training Center that they're trying so very hard to make a very shining light in training in the state of Texas. My good friend taught you banks, has a couple projects he wants me to do for them. So I have plenty to do. I intend to give my life master and bridge. I've been working on that for 30 years and job keeps getting in the way so I'm going to finish that. But that's my life in a nutshell and I can't tell you what a joy it is to work in an empire that didn't county is and have people like Beth Fleming and Amy Phillips and Mr. Wells, I truly love him. Because of all of the support, Byron Gruder and Mike Tuglio, these are phenomenal people and the county is very fortunate to have people of that caliber. So thank you. I appreciate this. We've been very blessed to have you work for Denton County and we certainly wish you a heartfelt, happy retirement doesn't sound like you're going to be too retired, something like you're going to be pretty busy, but we were blessed to have you with us. We're going to go on to item 12A on the agenda. 12A is approval of establishing the volunteers and police service program through the Dent kind of sheriff's office. And I've asked Commissioner Marchant to read that resolution All right, this is a resolution honoring Denton County Sheriff's Office volunteer service Volunteers and Police Service. Whereas the Ditten County Sheriff in an effort to further community based, policing initiatives into initiate a greater cooperation, communication and community support. Between the Sheriff's Office, its employees in the community has developed a Ditton County Sheriff's Office Volunteers Service. Whereas a Ditton County Sheriff's Office Volunteers Service has been established, an affiliation with the nationally recognized volunteer and police service program created in 2002, which is managed and supported by the International Association of Chiefs of Police in partnership with the Bureau of Justice Programs of the U.S. Department of Justice. Vips was informed so that law enforcement agencies may establish a volunteer service for citizens who wish to volunteer their time and skills and support their community law enforcement agency. Excuse me. Whereas the Dyn County Sheriff's Office volunteer services is designed to address the increasing demands in the sheriff's office and service and resources. At a time when law enforcement's limited resources are being stressed even further, many agencies are turning to civilian volunteers to enable law enforcement officers to be on the front lines working to make community safer. Whereas the Denton County Sheriff's Office volunteer service will be an important program to support and enhance current services. Volunteers will be assigned specific duties and tasks that will create efficiencies for the agency and result in improved services to the community. The volunteer service will perform such duties as volunteering in local schools, crime watch groups, assisting in community-based crime prevention education, as well as volunteering with various administrative duties within the office. Whereas the Ditton County Sheriff's Office volunteer services is yet another mechanism for the sheriff's offices to inform the public of what they do. Improved communication and a pain citizen input assistance and support throughout the community by sharing information and partnering together to control crime. Together we can make Ditton County a safe place for all who live, work and visit our county. Now therefore be it resolved that the Commission's Court of Ditton County approves the establishment of the Ditton County Sheriff's Office, Volunteer Service, Volunteer and Police Service program through the Ditton County Sheriff's Office made by emotion by myself. We're going to start off with a cowboy breakfast. Then we're going to have activities throughout the day for families. We're going to have a children's event, we're going to have music, and then the evening we will close with live entertainment. Here it will all be here on the square. But in order to put on an event like this, we are going to have to raise some money. So in the next couple of weeks, we are going to be sending out letters to people here in Denton Creek County asking them to volunteer some of their good money to help us put on this event. So what we are asking of you is that if you have anyone that's in your precinct that you think that we should send a letter to, if you will send an email with their name and address to Roslyn, we would certainly appreciate it. Of course we will be comprehending lists from different organizations to notify them of the event coming. Also, if you have different people in your precinct that you would like to have on our committee, because it's going to take a lot of hard work to put something on the size of this. So if you have someone that you want to put on our committee, we're also asking that you email Roslyn because we will start meeting. We will meet at least once a month until the first of the year. I come to you at a heavy heart, after viewing the slave cemetery in PowerPoint, and looking at that section that is marked kids, children, walking the grounds that's very, very overgrown, and looking at those stones on the ground that has names on them, most of them, and the lady who's monitoring the cemetery said, if we ever get someone to help clean this up, don't throw those rocks away. Those are headstones of the kids. That I come before you who won't even let me speak in a agenda item fashion. And I think, so this is a response that I'm going to when I'm out there demonstrating and people say, I have nothing to do with slavery. Why are we still talking about it? I have nothing to do with it. They tell me, where you have something to do with it. Shame on you. You're in charge of these these cemeteries. I can tell you what my next ideal is going to be by Gale. Grave by grave. God helped me. I'm uncover those kids and those adults out there. Shame on you. It's been discussed at the state level, for some reason, Denton's been exempted, but I think you should do the right thing and realize that in-person visits are an important part of rehabilitation. In fact, if you actually look at the research, prisoners who visit directly with loved ones are less violent and less likely to commit crimes in the future once they're released. So I think it just be a good idea. Sir Hudspith and myself did go out and see the slaves cemetery. It's surrounded by private property. In fact, the county sold the road to it. There's a single strand of barbed wire that's not really protecting it at all. Drunks and vandals go out there and smash what's left of the headstones. For decades, somebody was allowed to graze their cattle on it, not everything over. So, it's a little disturbing. Somebody should really start looking into that and taking it seriously. And it's just another point that maybe Denton County is not taking African American history seriously. Maybe the Denton County Historical Commission, which this court is supposed to be overseeing, is not quite doing its job. And I think it's time we go back to 2002, where this court had an agreement. Judge Mary Horn had an agreement. The Denton County Historical Commission, the City Council, the Texas Historical Commission, everybody was in agreement. And I don't know why I'm reading things in the newspaper that say otherwise because I've seen the paperwork. We're going to put water pipes in and we're going to water on the square. The business owners would like water on the square. I've talked to several of them. We're going to put another monument up that acknowledges racial issues in Denton County. I think the cemetery speaks for itself. I'd like to see a statue of Zach Rollins who worked here in this very room every day until he died. Former slave, the best he could hope for is to be your janitor. Something needs to be done and there was an agreement in 2002. I really am having a lot of trouble understanding why when we agreed this is what's going to happen. You know somebody that was on the county commissioners court himself said we're going to have a countywide effort, we're going to make this a big deal, we're going to do all these things and it all got approved. We're here now have a countywide effort. We're going to make this a big deal. We're going to do all these things. And it all got approved. We're here now 13 years later. I mean, at the very least, you need to go out there and look at that cemetery for yourself. Thanks. Last public comment from I have is from Mr. John Goodman. Good morning. Thank you for waiting. Thank you. I would like to request that the Confederate Monument issue be put on the agenda. Currently the Monument 6, as it it stands as a monument not only to our Confederate soldiers but also to the Confederacy the whole and the actions of the Confederate Standard Army. The cause of the Confederate soldiers fought for whether they knew it or not was one born of perpetuating slavery and white supremacy. Many might find that to be untrue or shocking, but in our history classes, we didn't really get presented with the contents of the succession papers or important documents, such as the cornerstone speech by Alexander Stevens, Vice President of the Confederacy. He was actually speaking as to what the cornerstone of the Confederacy, it was currently in its infancy, he was speaking as to what that cornerstone would be. And he said, our new government has found it up on exactly the opposite idea. Its foundations are laid. Its cornerstone rests upon the great truth that the Negro is not equal to the white man. That slavery, subordination to the superior race is his natural and normal condition. There was a pause and he says, this is our new government, is the first in the history of the world based upon this great physical, philosophical and moral truth. It's pretty clear that he believed the Negro not being equal to the white man was a great moral truth of his time. This isn't just in the cornerstone speech. It's throughout the Sistession Papers as a whole. It's all throughout their documents. It's what the Confederacy itself states it's stood for. And that's just not out in the public. The monument as it stands, I believe there was a plaque previously that mentioned the racial issues that the Confederate monument could stand for and it was removed and replaced with a current plaque. I believe that was 2010. I'll have to double check. Taking this into account, I recommend we move the Confederate Monument indoors surrounded by relevant history to tell the entire story, such as the cornerstone speech and succession papers so that people have all the information and can make an informed decision by themselves. As it currently stands without that historical context, the Confederate monument is endorsement by the Confederacy's actions and those Confederate soldiers' actions, who, whether they knew it or not, were fagging for this cause. They deserve to be remembered. They don't deserve to be endorsed. And that's my real problem for the mind of current. I'd also like to speak about the slave cemetery. I mean. I'd be to wrap up here in a few minutes, Susan. Okay. I would have quickly like to mention slave cemetery being neglected. I believe that's a horrible commentary on how we see African American history and especially slave history. Zach Rawlins is a further comment on that and we really need to take these things seriously or it reflects badly on us. Thank you. The balances are, as you saw from the back up quite large and there is sufficient money in attrition to pay off a chunk of that, reduce the county's liability without significantly impacting the reserve. I think I said in my communication that several departments, the Treasurer's Office, the auditor's office, budget office, sheriff's office, and HR office have consulted on this and our recommendation is to approve the payment of these funds to employees and reduce the county's liability and to look at it. And I'm an ongoing basis and see to what extent this would be possible to continue to do each year to try to pay down that liability. Okay, well I had a couple of questions. So is this regarding their gap time, the eight? Is this gap time we're paying off? Or is this gap time? It's gap time. I believe holiday time as well. Right? Is it enough? Any overtime earned at straight salary rate rather than time I had. About time. So it's not compensatory, come and scout time. Well, it can be both. We'll notice there's not only law enforcement involved here. So certain officers of person in any office might work in a week we had a holiday work extra time and get some so they would work maybe 34 a person could work 34 hours they get two hours of this non-FSLA comp time or gap time for a non-law enforcement employee it wouldn't be I don't think what you I think what you're considering gap time right But there are. People get compensated for working, I'm sure, but they don't get compensated at time and a half, either at the time, till they work over 40 hours in a week. Right. That is exactly what we're talking about here, though, and the much majority of it is what you call get time. Okay. Because a lot of people don't realize that compensatory time only kicks in after 86 hours for law enforcement. People operating under that 207K exemption, and that's correct. And we track that under FFLSA Compton because it's required by law, yes. But this is really going to be directed. The vast majority of it to people who aren't getting paid holiday time are the things for law enforcement, because that will, because they're really- It's not, I mean, it's actually county-wide. It's the DA's office, the medical examiners office. They all courts that- Emergency services. They all get holiday time. Public works, technology services, the county clerk's office. I saw that. I was trying to figure out how on earth they would, how they, other than holiday time. Commissioner. This is a close like the empty. Where does they get gaped? The equivalent of none. Episodiality compensatory time. I think James explained that during a holiday week, an employee could work 34 hours before the holiday comes in. In that instance, they would get their eight hours of holiday time, but if they were 34 hours, they would also have two hours. So if you can't gap time there, if you want to call it that and those two hours would be on the books for them and that could happen to spend any department in the county so that's that's what it's for and the majority of it is law enforcement time because they work the most overtime But we also have white road and bridge and the treasures. And they're included in this. I think, go ahead, P. Under the context, generally, you know, we've had in the past employees think that 80-86, and we had in the past, it was a lot easier to account for it as FSO time. But it's gap time. And every time we give somebody a raise, we pay it off at the higher rate. So it's a liability that keeps increasing. If it's FSO a compensatory time, if it's a non-law enforcement employee, we have to pay cash overtime at 240 hours. If they're at law enforcement, we have to start cash overtime at 240 hours if they're at law enforcement We have to start paying for a 400 and 80 hours And it's a liability we're carrying Every time we give a raise like we did this year for 5% Basically that time you carried as an employee just increased 5% Heck, that's a hell of an investment particularly when you you're getting what? Less than a quarter of a percent at the bank? I was just trying to, I'd looked at it. To me, when it was gap time, I thought it would be in light of previous comments that we've had to the court. I thought it was something that would benefit our law enforcement. But you're right, when I was looking to list, I was trying to figure out how they got it. So I got it's when we get a snow day or a holiday, those employees would get time, I think, in a crew that was non-FSLI. In other words, non that section 207K provision that we can carry, okay. And you know, when the county treasurer came and talked to all of us about the comp time, it was served with million dollars. I mean, something like eight million dollars that the county would have to be and this was like two years ago. So I think this is a great idea to start trying to pay some of this money to the employees rather than having to pay when they retire a quit. We have worked the auditor's office and my office have worked together and the majority of these funds will be paid from salary attrition from each individual department's budget. You might see a budget amendment for just a minimal amount coming from personnel contingency. So the good news is we're not going to be having to use our regular contingency for it. It's attrition. We think it's a good year. It also lets departments know that we're all looking at the comp time balances each year. And we are hopeful that there won't be any abuse of this because this is just a one time thing at this time. Eventually, like we said, if there's sufficient attrition funds, we may come back to you next year asking to pay another 25% Or whatever amount we think the departments might have left in the budget To do this without impacting our other contingencies. I can ask you something Very small so it's really I guess not that big a deal, but when we contract with other interlocal agencies For like Copper Canyon, CTA, the DISD resource officers, are we paying for their overtime? They will pay their own because this time was earned while they worked under that contract. So they should be paying their own overtime. So they will pay these numbers that are on the line? That's correct. If I could just add the Sheriff's Department actually raised this issue, even though we're doing it countywide. They were concerned about their comp time balances and they have worked on a system that they intend to use in the future. And that they feel like we'll better track and reduce their overtime and also make sure that the opportunity to work over time is distributed equitably among their employees as opposed to certain employees working most of the over time. So we noticed, I think Cindy Brown ran a report initially when they came to her and then after we met she ran an updated report and we noticed that the balances were down somewhat somewhat and we attribute that to partially to some people who had a lot of comp time leaving. May also be because we're waiting on the jail to open and so we have more staff and we usually have in a facility. So they might not need to work as much over time. And also I think they've been starting to implement their process to reduce overtime earns. So we're hoping that this will grow less and we feel like before October 1st is an opportunity time to make this payment before reclases and reclases and pay increases for next year. So we kind of ramped up for the last couple of weeks and now we've really plateaued good good news. We only have three additional posthumous keto pools in Denton County. So all in all that was a light week. We're hoping that that's going to continue through September, but no guarantees sadly so Well, we've got you up there. Let's do nine. There'll be no vote taken on mining 9b is approval award of contract 2016 0-038-7-0-0. This is between Texas State Department Health Services in Denton County and then wound of 146,000 to $142 for fiscal year 2016-2017. I'm going to talk about this a little bit now. You bet. So what this represents is an exceptional item in the legislative process this year at the Texas Legislature. This was an EI that was submitted by the Department of State Health Services for contact tracing and some of the paperwork that goes along with monitoring travelers who had been exposed or came from a high risk area of Ebola. So this is really the state's budgetary response to this monitoring in public health departments all across the state. What they did is they took the health departments who did the most contact tracing and they offered some specific dollars for that effort with additional epidemiological capacity. In other words, we're making sure that one of our staff members, this is a primary responsibility is to provide this monitoring, this contact tracing. We then do those reports, we send those to the State Health Department daily. That's what this represents. This is a two year grant. So this is for 16 and 17. One of the interesting things about these exceptional items from the legislature is they then become part of a general fund request in the legislature. So I anticipate these funds to continue. That's not graven in stone, but that's typically what happens with these types of grants. And then there'll be a competitive process probably in three or four years. This wasn't, this was born out of Ebola, but this happens in several places with tuberculosis, with murs. You may remember that middle Eastern respiratory syndrome. So there are several emerging pathogens that happen globally. This is to support the grant work of the reporting to the State Health Department and the CDC. And just to give you an idea, this isn't necessarily advertised. We're not keeping it a secret, but what has happened over time, the Health Department here in Denton County has monitored 46 people since October. That monitoring doesn't sound like a lot of work, but in some instances that's daily monitoring, daily phone calls, texts. Sometimes, the monitoring, if they're a higher risk, requires an in-home visit. So my staff has been, your staff has been doing that kind of work since October. We've monitored 46 patients or contacts since October. And currently you might that might be a next question. How many are we monitoring as of today? That's zero, but that could change. So if someone travels to Liberia, if someone travels to Sierra Leone, the CDC works with the airlines, they provide those manifests. There's an initial investigation in Atlanta. They then forward that information to us same day, and we pick up that monitoring the day of arrival in Denton County. And this money is to help support that effort.
