Father, we live in a world today that there's not a whole lot of patience and not a lot of love. The Father, I pray that as we connect, conduct business to this court, that we'll remember, Father, that we're all your children, that we do disagree, but ultimately we're all your children. And as such, Father, we should honor you. Father, I'm grateful for these commissioners and officials that serve and serve your kingdom, Father. Father, I pray for those who stand in harm's way to protect our freedom. And I also pray, Father pray for our first responders, particularly Father our law enforcement personnel, is we're going through so many difficulties and there are so many threats on them these days Father. The first public comment front I have is from Mr. Willie Hudsmith and as he's coming up to the podium I will remind everyone once again that there's a document available on the side table over here that has information that you may or may not be interested in but it's available for anybody that wants to take one. Good morning, Mr. Hudsmith. Good morning, morning, Judge and Commissioner, my name is Willie Hudsmith. As you were saying, the pledge I was thinking about what I had to do in the Vietnam War. I remember as a young man, 20 years old, having been drafted and standing there and I had to say that pledge. They didn't have to. They asked me to say the pledge. I went to a segregated school. We were still having to go in the back doors of shops to get something to eat. It was a bad time in my young life. And I was asked to be my family. I've never been away from home in my life for worth Texas. Having to go and fight in the country, Vietnam, that I knew nothing about didn't know what I was going there for. I didn't understand it at all. And I had to say that pledge. I looked over the room as you were saying the rest of you. I don't know if any of you been in combat. I've had to go somewhere to be taken away from your families. First time, 20-year-old kid just left high school for when one year I was out. And then I had to go somewhere to fight, kill people that I didn't know and then understand he needed. And I looked at you as you were saying to play as you were all standing out of tension and your hands are over your heart as though that makes any difference in your commitment to your country and what you're doing. I don't know. I just remembered when I had to do it and I had to in my heart of hearts and in my uttermost being, I had to say, okay, I'll do it, but I really don't understand it. That's just something I thought about. And then I saw someone in here struggling with their allergies as another thing that I noticed. And I'm struggling with mine and I thought, gee, many Christmas wise, my nose keep running like it is. That's another subject. Anyway, back to you. You sit there high, elevated, commissioners and judge. You have power. Here's your power. You can make decisions that affect many, many people. And you do. Weak after week. One of the powers that you have is you can say, no, Mr. Hutsmith, citizen who fought in Vietnam, we are not going to put that item on the agenda. There's nothing I can do. You have spoken. Thank God I live in America. There is another answer that can come about. It's called the vote. Two of you are up for re-election. The majority rules, I don't know how many people would agree with me that you should put that on their agenda. It's a citizen. It's an issue. It should be discussed, but you have the power. Here's what happens in America. The vote determines what you're going to do. The vote determines whether or not in your group if you're going to do it. So far, the vote has been no, we're not going to let a citizen who fought for me in Vietnam put an item on the agenda. We have the power to do that. But election time in America, that's when the voters have the same. And I'm just wondering how many people agree with me? The majority, we've got to get the majority and they have to come and they have to sign and they have to vote and I just want to see for the two of you that's up for a election how that's going to work out. I've already talked to a large population that's kind of large, let's see, my I say 10, 10 people who I've talked to about their, the money that you pay them, the hourly workers. They're not happy. When the insurance takes more of their money than the little raise you gave them, they are not happy. I hope to tap into that little organization like the Tea Party, but I'm going to be called the Watermelon Party, and we don't get in there and it's good we can see if we can work together and see if the majority says you're wrong for not giving the marines. And they will see how the vote turns out. Thank you. The second public comment from I have is from Mr. John Goodman. Mr. Goodman. Good morning. Hello, everyone. I just wanted to talk more about continuing protest of the Confederate Monument. And, mindedly, we should at least discuss it as an issue on the agenda officially? Many don't know that the Confederate Monument and the causes that the soldiers many of who were conscriptive fought for Many of who were conscriptive fought for. They don't understand that the beliefs that we listed in our Declaration of Causes, our own Texas Declaration causes, were that the only way black people could be useful was or tolerable was as slaves. That in this free government, all white men are and right ought to be entitled to equal civil and political rights, that the servitude of the African race as existing in these states is mutually beneficial to both bond and free and is abundantly authorized and justified by the experience of mankind in the revealed will of the Almighty career as recognized by all Christian nations. They actually believed that this was God's will for black people to be enslaved. I feel that that means that's the moment that we shouldn't revere. It should be remembered. It should be something to look back at as a horrible time in our history and learn from, but as it is freestanding, the poem on it actually goes and speaks to the pure actions of the Confederate soldiers, which I really don't feel were as pure. They were fighting for something bigger than them. They were fighting for something bigger than themselves whether they knew it or not and that mistake needs to be highlighted. It's kind of sad, but it's something we need to move past. We need to acknowledge that horrible history before we can begin to move past it. That's why I wish for the Confederate monument issue to be on the agenda. In my studies, I also came across an architect who said that the Confederate monument is dangerously leaning towards Hickory Street. I've personally looked at it a few times myself and it does look like it's leaning a bit. I encourage you all to do the same. And I believe that we should put an issue on the agenda to get an architect to analyze the safety of the magnet as is as well. I welcome anyone who's interested to find out more about our position to check out our protests on Sundays from six to eight. I know you've had a lot of different county commissioners that really appreciate your hard work. This is a resolution honoring Martin Tichler for 34 years of service, 34 years of service to Denton County. I'm not gonna tell you where I was in school when he first started it. No, don't do that. The Denton County Commissioner's Court Denton County, Texas during the regular session on the 29th, day of September 2015, considered the following. Whereas Martin was hired on July 1st, 1981, I think I was in sixth grade. As a truck driver, equipment operator with Denton County in Rubenbridge, and whereas as a result of Martin's knowledge and mechanical skills and abilities, he was promoted to heavy equipment operator on June 26, 1987. And whereas Martin, a dedicated county employee has provided high quality skills and performance as well as an outstanding level of valuable service to Rubenbridge East. And he has earned the respect of all that have worked with him and whereas Martin's devotion to assisting his co-workers is greatly appreciated and respected by his fellow colleagues of Denton County and he will be greatly missed and whereas Martin will retire in September 30th 2015 after completing 34 years of dedicated service to Denton County. Now therefore, be it resolved that the Denton County Commissioner's Court does hereby extend the Martin Arson. Seren, grateful appreciation for his dedicated service to Denton County. I just wanted to say I heard from, I talked to again to the city manager for the city of Sanger. He said they didn't have a problem. I then late yesterday got an email from the fire chief for the city of Sanger and he's basically stated that much like all the other roads that they contract for the county they stand prepared to provide fire protection to that area. Okay, and I'm sure they would. I mean that's what firemen do. You call them and they become. Yes ma'am, go ahead. If you'll pull the microphone down this week right here. I was going to give you the details from the meeting. We did meet on January the 15th with the like Ray Roberts planning zoning committee. And we did also mail out to all the affected property owners within 200 feet radius. We did five certified mail. We received three back in favor. And then at the public hearing with the commission like Robert's commission we did have two residents that also were in favor. So um, he like Ray Roberts, so I mean, putting in zoning commission and public works does recommend approval. That's correct. Right. Okay. Bobby had asked for Bobby to put a map up on the screen. Okay, he's working on it. I just so people understand what we're a little bit hard to see those numbers. Obviously the blue is make Ray Roberts. It adjacent to that R59260, that's all core property that long stretch that goes along there. I will explain the circle in a moment, but that top rectangular box shape the R562094 that's the property that's asking for the variance. The property immediately above that R216872 into the left 285221 and even up above that which is off your screen. Those three tracks are owned by the same family. There you go. That is the second letter in your attachment that I just handed to you where they bottom line they have a problem with the access back to this property for fire service. Had if the road is approved they don't have a problem with it but the road in the condition that it's in they do have a problem with it. The property to the left, there are 59245. Good morning. Yeah, I did it. That is the property that belongs to the tenants. And here again, the tenants have a problem with the variance due to the road. They would not if the road was improved. Now, I totally understand that if you call the fire department, like I said, they're going to come. That's what firemen do. But it's certainly not ideal conditions. Roger Hennons serves on the Lake Ray Roberts planning and zoning commission but he happened to be he did not vote on this issue nor did he address the commission on this issue for two reasons. One, he was out of town and two while he did receive the notice of the meeting, he was not one of the property owners that was notified because of the requested variance. And that brings me to the circle that I've got around the property and something that I think we should discuss and probably take up concerning the Lake or Robert's rules in the future. That's a 200 foot marker around the property that's requesting the variance. Now 200 feet in town is quite a bit. If 200 feet in the country may or may not touch your neighbor. We speak in terms of acres in the country, not feet. So that's for a future discussion, but that's why the circle around that property is there. It really notified the core, the property owner to the north, the property owner to the south, and the one to the left. That's Carl Seduz property. He is not in good health. We'll put it that way. and good health. We'll put it that way. So there's limited notification there. But I wanted to point out that these two property owners have concerns for the safety of their property and equipment and fencing and livestock and buildings. The line that comes straight down kind of to the right of the property that's asking for the variance that goes straight down and then makes a dog leg to the, yes, where he's showing you, that makes a dog leg to the right down here at the bottom for Macarons Road. That is actually the road. So a fire truck providing service back there would have to do one of two things. They could drive in there Now they'd get straight down both sides because of Everything that's growing on both sides of that road. I believe Jody drove in there and his pickup and That was the case in a pickup surely it would be the case in a fire truck, too That was the case in a pickup surely it would be the case in a fire truck too. There's no turnaround down there. It just dead ends on that property. If they drove in there they'd probably have to back out that would not be easy. So there are choices to do that or to leave the truck somewhere and McRannels and Hall Hoses back there and either one of those are ideal conditions. So anyway, are there questions from members of court? I had something from a fire chief. I sent it to you. I didn't want to, I mean, I just shared it with you and I think wrong. You know, I wasn't out soliciting comments. I greatly trust the Lake Ray Roberts Planning and Zoning and our Planning Department. This is one of those many situations that we have in Denton County that we're growing up. And these are vestigial situations leftover from the past. I think there's a tremendous amount of expertise on our Lake Ridge average point in zoning. I've repeatedly discussed this with the city manager who's spoken about it with the fire chief. He doesn't think there's gonna be any other problems that don't exist on other areas. Frankly, they have a vested right. I don't know how we could overturn it if the Lake Ray Roberts planning and zoning voted unanimously for it. All the people who are notified, didn't object or either were in favor of it. This item got knocked off. I'm still wondering how, because it was my agenda item. But it was removed by somebody else on the court without my permission. And then the planning, the item was posted later. And then from my understanding, comments were elicited. So I just fear that we've got a vested right. It's been approved administratively. We have some extrajudicial action to get additional comments. You know, if they are prohibited from building a house or whatever they want with this property, I think we're probably going to get sued. So that's all I got to say. Hey, first of all, Commissioner Cohen, nobody removed anything that you had hosted. Secondly, I did not solicit comments. Actually, it was Roger Henning that came to me because he had been out of town when this came up on the Lake River Roberts board meeting. And he was very concerned about it. Mr. Henning went to the Sanger City Council meeting when Mr. Sadoo presented his plans for this area and he presented a document to Sanger showing the road improvements that he was going to do. Sanger, for whatever reason, didn't follow through to ensure that those erudents that he was showing in his development plans ever got done. And the plaque that was filed, what it says on the plant, is the road is the responsibility of the homeowner's association, which is kind of crazy because there is not a homeowner's association. So anyway anyway let me I'm going to ask you a question. You don't need a pause for her. It's a classic flag. Okay. I still have a question. What was I so writing of nine? Writing of nine. Yes, man. I so stands for Insurance Service Organization. It is a rating from 1 to 10, 1 being the best fire protection services that one can get. For example, Frisco is a 1. 10 is the worst ISO rating that you can get. And those unincorporated areas like that are nines because of the lack of water supply. ISO typical and this is the best to using round numbers if you will probably 60% of the ISO's rating is based off of water. So that's how you really get the best ISO rating is based off of 60% being how much water is provided for that and that's why I would say that Almost all or a majority of the unincorporated areas sits between and eight and nine Water in Any road or Because they have volunteered for the importance. Yes, and majority across the county without the water supply Then what closest water supply is going to be out near the main highway, 455. Now, Joe, yeah, I looked it up, but I couldn't figure it out. You know, Judge Horn lives out there. What do you think her ISO radius? Hers would be a nine. OK. Yes, sir. I got a road to get to the house. And Mr. Hinden, his ISO. They would all be nine's yes sir okay so you got people with a nine objecting to somebody building a house with a nine and claiming that it's too dangerous because of fire safety basically right well they would all be nine's okay yes sir yes sir okay are there other questions or comments the only other thing I would add is prior to you joining Commissioner's Court Commissioner Coleman, this body did vote against a recommended recommendation of the Lake Ray Roberts Commission. So it's not unheard of. It was a unanimous recommendation of Commissioner Thyrr. Is that the tree farm? Is that the tree farm? The cross from your house? Yep. Did I did not vote on. I did not take part in that. I worked with the DA's office at the time, and I know you didn't vote on it, but you did participate in the discussion. I did, but I did not vote on it. You're right. Actually, I turned the meeting over to Commissioner Jacobs. After you've given input, I was there. OK, for the question. Yeah. you given input? I was there. Okay, for the question. Yeah, I read the, I read the email essentially. R. Marshall, so he's validating basically what Jody said. He can't get his main apparatus down that roadway, but they would have to haul in with the truck. Much like all the that's been in the situation ever since any houses have ever been built there hasn't it I mean when you said that it's rated at nine yes I mean that's there's no there's no water out there. So Sanger would have to use compliments from tanker operations as well. We call tanker operations. So city of Sanger fire department has a tanker a belief 3000 gallon tanker So standard operating procedures for a for structure fire with that's actually with smoke and fire showing would be to use their tanker as well as pilot point and crumb would send three tankers to that fire and they would have to drive in and dump water into a dump tank and they would draft out of that water that's being brought in to fire. But I'll tell you, you know we did make improvements of the port. I believe in 2010, if you remember correctly, right, Mr. Felt? We passed, we amended our subdivision, or we don't allow private drives anymore like this. So you can't flat something like this in the future or presently, but this is one of, like I said, something vestigial from when we had rural subdivision rules or rights. So I don't know those things. So this is the Sanger E2J. So this is the Sanger E.T.J. So. Third reason why Mr. Henning didn't and subsequent, subsequent meeting. So the right, like Ray Roberts, bring this back up for the reconsideration of the committee. No, I don't know if he knew he could bring it back up for reconsideration, but he was out of time at the time the meeting took place. So if he ever testified on any of the improvements that were on the rest of the... I have no idea. That's what I'm in a quandary for. I mean, if a quandary about, if it has not... I mean, I only go back. I don't I'm not sure just how long he's been on the Lake River Roberts board but obviously with that circle around. They've been there quite a while and I'm thinking when those were plated that he was not on the Lake River Roberts Committee and that he would be outside the 200 foot marker so he wouldn't have been notified. When he said bring that back up, make 200 foot markers, that is tablify. No, the Lake River Roberts rules are established by the county, the published rules for the Lake River Roberts Commission and that's something we can take up at a later time. I just wanted to have people thinking about it because really 200 feet in the country is not very far. We speak in terms of acres in the country not feet. Orton that's already a planted law. Were you here when I was talking about Roger Henning being at the Sanger City Councilor M Council meeting when that was presented and he said he was going to make these road improvements and then sign up and follow through to make sure that he did. the public hearing. We have a lot more people who live. You know, always teach people, you know, the good thing about living in the county is nobody can tell you what to do. Torch and flower mound 11 in high and village, five in Louisville, five in Littlewell, two in trophy club and four in the city of Denton. Okay.
